	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H0F598ADE024C459FA15CC875739AB85F" style="OLC">
 <section display-inline="no-display-inline" id="H0545BBB8DC2044EF908DDFE029FF0FCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Interstate Abortion Notification Act</short-title></quote>.</text>
		</section><section id="HF955D2FDA26249439490A13763AB8441"><enum>2.</enum><header>Transportation of
 minors in circumvention of certain laws relating to abortion</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended by inserting after chapter 117 the following:</text>

				OF MINORS IN CIRCUMVENTION OF CERTAIN LAWS RELATING TO ABORTION</header><toc regeneration="no-regeneration"><toc-entry level="section">Sec.</toc-entry><toc-entry level="section">2431. Transportation of minors in
				  circumvention of certain laws relating to abortion.</toc-entry><toc-entry level="section">2432. Transportation of minors in
				  circumvention of certain laws relating to abortion and incest.</toc-entry></toc>
					<section id="H02D8724D14A44898BA64AA12998B2BEB"><enum>2431.</enum><header>Transportation
				of minors in circumvention of certain laws relating to abortion</header>
						<subsection id="H3403532FA4874B3198CC9D0BA54D4575"><enum>(a)</enum><header>Offense</header>
 <paragraph id="H6FEF9407097F4F3ABA8C63C6DDECBA62"><enum>(1)</enum><header>Generally</header><text>Except as provided in subsection (b), whoever knowingly transports a minor across a State line, with the intent that the minor obtain an abortion, and thereby in fact abridges the right of a parent of the minor under a law requiring parental involvement in a minor’s abortion decision, in force in the State in which the minor resides, shall be fined under this title or imprisoned not more than 1 year, or both.</text>
 </paragraph><paragraph id="H8275B7E1C2454D899B1CD492B121A0D0"><enum>(2)</enum><header>Definition</header><text>For the purposes of this subsection, an abridgement of the right of a parent of a minor occurs if an abortion is performed or induced on the minor, in a State other than the State in which the minor resides or in a foreign country, without the parental consent or notification, or the judicial authorization, that would have been required under a law requiring parental involvement in a minor’s abortion decision had the abortion been performed in the State in which the minor resides.</text>
							</paragraph></subsection><subsection id="H21825E08CA734D709D0BBA46CBC51DCC"><enum>(b)</enum><header>Exceptions</header>
 <paragraph id="H63FB8FD667644F50BD9D5046FEBD21F3"><enum>(1)</enum><header>Life-endangering conditions</header><text>The prohibition under subsection (a) shall not apply if the abortion is necessary to save the life of the minor because her life is endangered by a physical disorder, physical injury, or physical illness, including a life endangering physical condition caused by or arising from the pregnancy itself.</text>
 </paragraph><paragraph id="H92FD09FD08BF4633B2C2F08612E27AA4"><enum>(2)</enum><header>Minors and parents</header><text>A minor transported in violation of this section, and any parent of that minor, may not be prosecuted or sued for a violation of this section, a conspiracy to violate this section, or an offense under section 2 or 3 of this title based on a violation of this section.</text>
							</paragraph></subsection><subsection id="H6DE0EC388B5B401EB56533E76CBB4640"><enum>(c)</enum><header>Affirmative
 Defense</header><text>It is an affirmative defense to a prosecution for an offense, or to a civil action, based on a violation of this section that the defendant—</text>
 <paragraph id="HE080FC5D1CFC4DE8AF282EC40049623F"><enum>(1)</enum><text>reasonably believed, based on information the defendant obtained directly from a parent of the minor, that before the minor obtained the abortion, the parental consent or notification took place that would have been required under the law requiring parental involvement in a minor’s abortion decision, had the abortion been performed in the State in which the minor resides; or</text>
 </paragraph><paragraph id="H2457CF9F2BEA42948ED4BCFFBA3A78B9"><enum>(2)</enum><text>was presented with documentation showing with a reasonable degree of certainty that a court in the minor’s State of residence waived any parental notification required by the laws of that State, or otherwise authorized that the minor be allowed to procure an abortion.</text>
							</paragraph></subsection><subsection id="H0E35EB32DCC74F8F8D3C4B4A07680C22"><enum>(d)</enum><header>Civil
 Action</header><text>Any parent who suffers harm from a violation of subsection (a) may obtain appropriate relief in a civil action unless the parent has committed an act of incest with the minor described in subsection (a).</text>
 </subsection><subsection id="H35015ABC7DFA449BBFFBFCB3223A5401"><enum>(e)</enum><header>Definitions</header><text>For the purposes of this section—</text>
 <paragraph id="HDD2CE0BCA96C48ECAEDD3FDB7A9ED823"><enum>(1)</enum><text>the term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or other substance or device to intentionally—</text>
 <subparagraph id="id4F49625075FC4172BCDD20392453D1CC"><enum>(A)</enum><text>kill the unborn child of a woman known to be pregnant; or</text> </subparagraph><subparagraph id="id511AC1639A424FA8A09BBAF291299DFE"><enum>(B)</enum><text>prematurely terminate the pregnancy of a woman known to be pregnant, with an intention other than to—</text>
 <clause id="id9AFDED85D4DA4C42A52C718D5FD24083"><enum>(i)</enum><text>increase the probability of a live birth or of preserving the life or health of the child after live birth; or</text>
 </clause><clause id="id09CA8CCE2446415CAD45D2CAC65C0223"><enum>(ii)</enum><text>remove a dead unborn child;</text>
 </clause></subparagraph></paragraph><paragraph id="H1274490F86BF423BBF7519D268EC9BB2"><enum>(2)</enum><text>the term <term>law requiring parental involvement in a minor’s abortion decision</term> means a law—</text>
 <subparagraph id="H15CAC270513E4FBCBAA31DA1973DFA28"><enum>(A)</enum><text>requiring, before an abortion is performed on a minor, either—</text>
 <clause id="H6BA9F0E52A4D4A1BA98062087EBA4484"><enum>(i)</enum><text>the notification to, or consent of, a parent of that minor; or</text>
 </clause><clause id="HDBC46E8BA4CB48F7A46755F35478FAE3"><enum>(ii)</enum><text>proceedings in a State court; and</text>
 </clause></subparagraph><subparagraph id="H15A8DF3FE45641109063B7B215BE43A4"><enum>(B)</enum><text>that does not provide as an alternative to the requirements described in subparagraph (A) notification to or consent of any person or entity not described in that subparagraph;</text>
 </subparagraph></paragraph><paragraph id="HB9480D63013943C6B49DC07D12F2C2E5"><enum>(3)</enum><text>the term <term>minor</term> means an individual who is not older than the maximum age requiring parental notification or consent, or proceedings in a State court, under a law requiring parental involvement in a minor’s abortion decision;</text>
 </paragraph><paragraph id="HD2B29E518B054E2AB56521ED2A90F875"><enum>(4)</enum><text>the term <term>parent</term> means—</text>
 <subparagraph id="H9B18BDF33EAA45D2A8B53E7237A5387F"><enum>(A)</enum><text>a parent or guardian;</text>
 </subparagraph><subparagraph id="H38887F31518A4764B45FAB4D05093B34"><enum>(B)</enum><text>a legal custodian; or</text>
 </subparagraph><subparagraph id="H0FA06019CCCD42E39DA07D1A7C5D052B"><enum>(C)</enum><text>an individual standing in loco parentis—</text>
 <clause id="id5E3CCD92720E4C779733272DA4BF5F4E"><enum>(i)</enum><text>who has care and control of the minor;</text> </clause><clause id="id059C15BBE71042D1ADD6AE442FAE6BDF"><enum>(ii)</enum><text>with whom the minor regularly resides; and</text>
 </clause><clause id="id38102ED87649420D85DFBC0DE9B0A30A"><enum>(iii)</enum><text>who is designated by the law requiring parental involvement in the minor’s abortion decision as an individual to whom notification, or from whom consent, is required; and</text>
 </clause></subparagraph></paragraph><paragraph id="H4DC11F39089B4B568C175A9601CA5769"><enum>(5)</enum><text>the term <term>State</term> includes—</text>
 <subparagraph id="id97F2A2023D334820BE29D05BC2EABD48"><enum>(A)</enum><text>the District of Columbia;</text> </subparagraph><subparagraph id="id0DBBFEC7F19B4859A3DE8E304397274F"><enum>(B)</enum><text>any commonwealth, possession, or other territory of the United States; and</text>
 </subparagraph><subparagraph id="id3E5DAB46D7DD45F887F89F2BC24AD84C"><enum>(C)</enum><text>any Indian tribe or reservation.</text>
								</subparagraph></paragraph></subsection></section><section id="H6F6DE25C5CA94AF7BC1F2A95BDD90EBA"><enum>2432.</enum><header>Transportation
				of minors in circumvention of certain laws relating to abortion and
			 incest</header>
 <subsection id="idAEF20525789D41DD88AE37A470DA7BE7"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Notwithstanding section 2431(b)(2), whoever has committed an act of incest with a minor and knowingly transports the minor across a State line with the intent that the minor obtain an abortion, shall be fined under this title or imprisoned not more than 1 year, or both.</text>
 </subsection><subsection id="id9FB88184926E44BA841BFAD519ECE381"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section, the terms <term>abortion</term>, <term>minor</term>, and <term>State</term> have the meanings given those terms in section 2435.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3C94DD5F63F741CD87ECF8B2E451B459"><enum>3.</enum><header>Child interstate
 abortion notification</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended by inserting after chapter 117A (as added by section 2) the following:</text>

				INTERSTATE ABORTION NOTIFICATION</header><toc regeneration="no-regeneration"><toc-entry level="section">Sec.</toc-entry><toc-entry level="section">2435. Child interstate abortion
				  notification.</toc-entry></toc>
					<section id="HD7BBD45743484B77B875E143BE2C9975"><enum>2435.</enum><header>Child
				interstate abortion notification</header>
						<subsection id="H7EB6F169BB394BFEBDE84D1B2FA2DCBC"><enum>(a)</enum><header>Offense</header>
 <paragraph id="HBDC749918D9E4A51AEFEF0301EC86272"><enum>(1)</enum><header>Generally</header><text>A physician who knowingly performs or induces an abortion on a minor in violation of the requirements of this section shall be fined under this title or imprisoned not more than 1 year, or both.</text>
							</paragraph><paragraph id="H021AE2C6D39942CF88EC1E7D9FB47868"><enum>(2)</enum><header>Parental
				notification</header>
 <subparagraph id="id668843C6B39846EAA0C45FC9BFE5999E"><enum>(A)</enum><header>Actual notice</header><text>A physician who performs or induces an abortion on a minor who is a resident of a State other than the State in which the abortion is performed or induced shall provide, or cause his or her agent to provide, not less than 24 hours actual notice to a parent of the minor before performing or inducing the abortion.</text>
 </subparagraph><subparagraph id="idE8BCAD404E2D414F93BDDA95772406AC"><enum>(B)</enum><header>Constructive notice</header><text>If actual notice to a parent under subparagraph (A) is not accomplished after a reasonable effort has been made, not less than 24 hours constructive notice shall be given to a parent of the minor before the abortion is performed or induced.</text>
 </subparagraph></paragraph></subsection><subsection id="HC40BB247B8E843FF8A77FF8E2F0A42BE"><enum>(b)</enum><header>Exceptions</header><text>The notification requirement under subsection (a)(2) shall not apply if—</text>
 <paragraph id="H53E0AA97DE964690A26DD8DE989A3683"><enum>(1)</enum><text>the abortion is performed or induced in a State that has in force a law requiring parental involvement in a minor’s abortion decision and the physician complies with the requirements of that law;</text>
 </paragraph><paragraph id="HA14DA26356144CDE825F3CF1867F7E8F"><enum>(2)</enum><text>the physician is presented with documentation showing with a reasonable degree of certainty that a court in the minor’s State of residence has waived any parental notification required by the laws of that State, or has otherwise authorized that the minor be allowed to procure an abortion;</text>
 </paragraph><paragraph id="H468A1091C5FE44ECA5ECC41CEEFEAFD6"><enum>(3)</enum><text>the minor declares in a signed written statement that she is the victim of sexual abuse, neglect, or physical abuse by a parent, and, before an abortion is performed on the minor, the physician notifies the authorities specified to receive reports of child abuse or neglect by the law of the State in which the minor resides of the known or suspected abuse or neglect;</text>
 </paragraph><paragraph id="HBAE6A22842354DC2B594465081542D93"><enum>(4)</enum><text>the abortion is necessary to save the life of the minor because her life was endangered by a physical disorder, physical injury, or physical illness, including a life endangering physical condition caused by or arising from the pregnancy itself, except that an exception under this paragraph shall not apply unless the attending physician or an agent of such physician, not later than 24 hours after completion of the abortion, notifies a parent of the minor in writing that an abortion was performed on the minor and of the circumstances that warranted invocation of this paragraph; or</text>
 </paragraph><paragraph id="H512ACA70757F4BECB6950E7D6827109A"><enum>(5)</enum><text>the minor is physically accompanied by a person who presents the physician or his or her agent with documentation showing with a reasonable degree of certainty that he or she is in fact the parent of that minor.</text>
							</paragraph></subsection><subsection id="H41A1EC2D08F94A638BB3CCD3C98F61D7"><enum>(c)</enum><header>Civil
 Action</header><text>Any parent who suffers harm from a violation of subsection (a) may obtain appropriate relief in a civil action unless the parent has committed an act of incest with the minor described in subsection (a).</text>
 </subsection><subsection id="H95FF175CEB3B403885E988D1E93DE29D"><enum>(d)</enum><header>Definitions</header><text>For the purposes of this section—</text>
 <paragraph id="id2CA2CCFD9B8746BFA87D87AFE7AF0FFD"><enum>(1)</enum><text>the term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or other substance or device to intentionally—</text>
 <subparagraph id="id9AF349038CAC491EB74B40792F036CB6"><enum>(A)</enum><text>kill the unborn child of a woman known to be pregnant; or</text> </subparagraph><subparagraph id="id98A66556A61D4F3EABAA9576ED628F0B"><enum>(B)</enum><text>prematurely terminate the pregnancy of a woman known to be pregnant, with an intention other than to—</text>
 <clause id="id250A44B59A4F45D7AF155203DFC10A98"><enum>(i)</enum><text>increase the probability of a live birth or of preserving the life or health of the child after live birth; or</text>
 </clause><clause id="id7F068EDBA6A04CF38249EE149AB12EC1"><enum>(ii)</enum><text>remove a dead unborn child;</text>
 </clause></subparagraph></paragraph><paragraph id="H5369573CC5D94607A23471B84AB648FB"><enum>(2)</enum><text>the term <term>actual notice</term> means the giving of written notice directly, in person, by the physician or any agent of the physician;</text>
 </paragraph><paragraph id="H238F824A140A4FF59104826B794F83B0"><enum>(3)</enum><text>the term <term>constructive notice</term> means notice that is given by certified mail, return receipt requested, restricted delivery to the last known address of the person being notified, with delivery deemed to have occurred 48 hours following noon on the next day subsequent to mailing on which regular mail delivery takes place, excluding days on which mail is not delivered;</text>
 </paragraph><paragraph id="H369417E637C544FEB3102FBB8FE2215F"><enum>(4)</enum><text>the term <term>law requiring parental involvement in a minor’s abortion decision</term> means a law—</text>
 <subparagraph id="HBBFB64D8FE50494CBA3E5701C2C19462"><enum>(A)</enum><text>requiring, before an abortion is performed on a minor, either—</text>
 <clause id="HCE7E8E8303C947F2936015C58C1DA15A"><enum>(i)</enum><text>the notification to, or consent of, a parent of that minor; or</text>
 </clause><clause id="H30B4A471CCD74F938927605C6C2FDB65"><enum>(ii)</enum><text>proceedings in a State court; and</text>
 </clause></subparagraph><subparagraph id="H3D7F8EDD01354BFC8C47F62454A20852"><enum>(B)</enum><text>that does not provide as an alternative to the requirements described in subparagraph (A) notification to or consent of any person or entity not described in that subparagraph;</text>
 </subparagraph></paragraph><paragraph id="H59904DE9924C48909FF3B55FCC30A60A"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>minor</term> means an individual who—</text>
 <subparagraph id="id7827723882F44387AACFA313BFC76DA9"><enum>(A)</enum><text display-inline="yes-display-inline">has not attained the age of 18 years; and</text> </subparagraph><subparagraph id="id650CE228D55049AD9781C613BF6DB6C3"><enum>(B)</enum><text display-inline="yes-display-inline">is not emancipated under the law of the State in which the minor resides;</text>
 </subparagraph></paragraph><paragraph id="H46B4A3B4ED5C4F8FB07C31BEC3154657"><enum>(6)</enum><text>the term <term>parent</term> means—</text>
 <subparagraph id="H1A0A04EF46E942978AD14903728A7F29"><enum>(A)</enum><text>a parent or guardian;</text>
 </subparagraph><subparagraph id="H005AB5EBCE9943D5A9D79262CF1DE0FA"><enum>(B)</enum><text>a legal custodian; or</text>
 </subparagraph><subparagraph id="H5C8898852EDF489D8E40934CFF5660E1"><enum>(C)</enum><text>an individual standing in loco parentis—</text>
 <clause id="id2DCA8BF8BA1543739C44CA8207283C53"><enum>(i)</enum><text>who has care and control of the minor; and</text> </clause><clause id="id447DF937D9684D6B89EB0A475CA475BF"><enum>(ii)</enum><text>with whom the minor regularly resides,</text>
									</clause></subparagraph><continuation-text continuation-text-level="paragraph">as
 determined by State law;</continuation-text></paragraph><paragraph id="H42B247E02C2C4AD4A6EC559EA3390965"><enum>(7)</enum><text>the term <term>physician</term> means—</text>
 <subparagraph id="idE49AF690868B4BF39197C0FFBAC5842E"><enum>(A)</enum><text>a doctor of medicine legally authorized to practice medicine by the State in which the doctor practices medicine; or</text>
 </subparagraph><subparagraph id="id4DB51CEC407846899ECEC04B2938050D"><enum>(B)</enum><text>any other person legally empowered under State law to perform an abortion; and</text>
 </subparagraph></paragraph><paragraph id="H64A9D3D85968477BAF0FA7389363D7AE"><enum>(8)</enum><text>the term <term>State</term> includes—</text>
 <subparagraph id="id86C6C724A82F4E0A90D189231A3A263B"><enum>(A)</enum><text>the District of Columbia;</text> </subparagraph><subparagraph id="idBE19894E64074EF784CDF0024B37D4F8"><enum>(B)</enum><text>any commonwealth, possession, or other territory of the United States; and</text>
 </subparagraph><subparagraph id="id2A0A0EE37C124F38B431822306A3B913"><enum>(C)</enum><text>any Indian tribe or reservation.</text></subparagraph></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0D1DC496A0DD4228A2D0D90E9045830C"><enum>4.</enum><header>Clerical
 amendment</header><text display-inline="no-display-inline">The table of chapters at the beginning of part I of title 18, United States Code, is amended by inserting after the item relating to chapter 117 the following new items:</text>

		</section><section id="H82C2B20EEE3143E49C00F35F4695CBFB"><enum>5.</enum><header>Severability and
			 effective date</header>
 <subsection id="H3B7D71A547854988A69289D5B71AB17C"><enum>(a)</enum><header>Severability</header><text>The provisions of this Act shall be severable. If any provision of this Act, or any application thereof, is found unconstitutional, that finding shall not affect any provision or application of the Act not so adjudicated.</text>
 </subsection><subsection id="H87516C8AEDE049DBA8B79ADCB966AEBB"><enum>(b)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall take effect 45 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
