	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HBFDD7DF1DFA547A7AA24BAEEAFF7FA5B" style="OLC">
 <section id="HDA4576252EF74125A01FE6FBD8674227" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Rehabilitation Innovation Centers Act of 2017</short-title></quote>.</text> </section><section id="HFA21DCF35DA6455B9B64165B20D1462B" section-type="subsequent-section"><enum>2.</enum><header>Preserving access to rehabilitation innovation centers under Medicare</header><text display-inline="no-display-inline">Section 1886(j)(7)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(j)(7)(E)</external-xref>) is amended—</text>
 <paragraph id="H57278FDCF1C447DEBAEFD28B630EBA01"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subparagraph" style="OLC">Public Availability of Data Submitted.</header-in-text>—The</quote> and inserting</text> <quoted-block display-inline="yes-display-inline" id="HACF9871B50514A51A5C234BDEC985D8B" style="OLC"> <text><header-in-text level="subparagraph" style="OLC">Public Availability of Data Submitted.—</header-in-text></text><clause id="HA2C3F86665AD4A2AB96FD404F7684586"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="H67D270FEFCD5486FBB00C54FFFF8E486"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after clause (i), as redesignated by paragraph (1), the following new clauses:</text>
				<quoted-block display-inline="no-display-inline" id="HDAA26FB81A7043F1A82ECAE15EAC9F3D" style="OLC">
 <clause id="H5D4506251E994B95A13954C3ED36E489"><enum>(ii)</enum><header>Public recognition of rehabilitation innovation centers</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this clause, the Secretary shall make publicly available on such Internet website, in addition to the information required to be reported on such website under clause (i), a list of all rehabilitation innovation centers.</text>
 </clause><clause id="H953CF08ECC0E4188A39489969E3D0E0C"><enum>(iii)</enum><header>Rehabilitation innovation centers defined</header><text>For purposes of clause (ii), the term <quote>rehabilitation innovation centers</quote> means a rehabilitation facility that, as of the date of the enactment of this clause, is a rehabilitation facility described in either clause (iv) or (v).</text>
 </clause><clause id="HD8A86E37E6A64C71A477B7F31CDE0186"><enum>(iv)</enum><header>Not-for-profit</header><text display-inline="yes-display-inline">A rehabilitation facility described in this clause is a rehabilitation facility that—</text> <subclause id="H75CF244976554386AD63E85DA09E020E"><enum>(I)</enum><text>is classified as a not-for-profit entity under the IRF Rate Setting File for the Inpatient Rehabilitation Facility Prospective Payment System for Federal Fiscal Year 2016 (80 Fed. Reg. 47142);</text>
 </subclause><subclause id="H50395C6713124D6696CC509499A57A3D"><enum>(II)</enum><text>holds at least one Federal rehabilitation research and training designation for research projects on traumatic brain injury, spinal cord injury, or stroke rehabilitation research from the National Institute on Disability, Independent Living, and Rehabilitation Research at the Department of Health and Human Services, based on such data submitted to the Secretary by a facility, in a form, manner, and time frame specified by the Secretary;</text>
 </subclause><subclause id="H3C69A99149E741D598E614943715389A"><enum>(III)</enum><text>has a minimum Medicare estimated weight per discharge of 1.1144 for fiscal year 2016 according to the IRF Rate Setting File described in subclause (I); and</text>
 </subclause><subclause id="H3BF6FE112E5748B594092A4CB41D804C"><enum>(IV)</enum><text display-inline="yes-display-inline">is determined by the Secretary, based upon such data submitted by the facility to the Secretary as the Secretary may require, to have had at least 300 Medicare discharges in a year.</text>
 </subclause></clause><clause id="H9E0A92E965BC4196836E3CA785043215"><enum>(v)</enum><header>Government-owned</header><text display-inline="yes-display-inline">A rehabilitation facility described in this clause is a rehabilitation facility that—</text> <subclause id="H2A63FB11932F48AFAF35644079081530"><enum>(I)</enum><text>is classified as a Government-owned institution under the IRF Rate Setting File described in clause (iv)(I);</text>
 </subclause><subclause id="H3CC9EA38351847CB9FAB633755D27594"><enum>(II)</enum><text>holds at least one Federal rehabilitation research and training designation for research projects on traumatic brain injury, spinal cord injury, or stroke rehabilitation research from the National Institute on Disability, Independent Living, and Rehabilitation Research at the Department of Health and Human Services, as determined based on such data submitted to the Secretary by the facility as the Secretary may require (and in a form, manner, and time frame specified by the Secretary);</text>
 </subclause><subclause id="H4188322E4AE742998E37AD01F45E5FBB"><enum>(III)</enum><text>has a minimum Medicare estimated weight per discharge of 1.1144 according to the IRF Rate Setting File described in clause (iv)(I); and</text>
 </subclause><subclause id="HE987CDD45DF34BF9BC5B145A9ECBEA8C"><enum>(IV)</enum><text>has a Medicare disproportionate share hospital (DSH) percentage of at least 0.6300 according to the IRF Rate Setting File described in clause (iv)(I).</text>
 </subclause></clause><clause id="HE401C82929634397A59D34A15A651E02"><enum>(vi)</enum><header>Implementation</header><text>Notwithstanding any other provision of law the Secretary may implement clauses (ii) through (v) by program instructions or otherwise.</text>
 </clause><clause id="H5D3A62BBF27E4ED1AA33BB11C5E685AF"><enum>(vii)</enum><header>Nonapplication of paperwork reduction act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, shall not apply to data collected under this clause.</text> </clause><clause id="HCCCD4139149B4BAC91311DDCF5DE8FC1"><enum>(viii)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this clause, the Medicare Payment Advisory Commission established under section 1805 shall submit to Congress a report analyzing the most recent three years of cost report data available for all rehabilitation innovation centers (as defined in clause (ii)) and assess the payment adequacy for such innovation centers under the Medicare program.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
