 <paragraph id="id9f025b77-8c12-4dc2-8d8c-b3119305700c"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text> <subparagraph id="id3db06c33-08c7-41f1-801a-6d180e9753c9"><enum>(A)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text>
 </subparagraph><subparagraph id="id66121391-01a4-47a7-98e6-f91ab8d742aa"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>; and</text> </subparagraph><subparagraph id="iddb63751b-cb60-439e-9ca4-6052486c5d42"><enum>(C)</enum><text>each committee of the Senate or of the House of Representatives with jurisdiction over a Federal entity affected by the applicable section in which the term appears.</text>
 </subparagraph></paragraph><paragraph id="idd4de4322-03ae-4b6e-b127-e68afa317672"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text> </paragraph><paragraph id="idc239af0f-e3cb-4026-91e2-369bfd4b8bd0"><enum>(3)</enum><header>Federal entity</header><text>The term <term>Federal entity</term> has the meaning given the term in section 113(l) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(l)</external-xref>).</text>
 </paragraph><paragraph id="id605e714f-2a18-4ab0-88fd-7f8ddbd21d58"><enum>(4)</enum><header>NTIA</header><text>The term <term>NTIA</term> means the National Telecommunications and Information Administration of the Department of Commerce.</text>
 </paragraph><paragraph id="id013aae8a-f266-4276-8fd6-82a28702cde2"><enum>(5)</enum><header>OMB</header><text>The term <term>OMB</term> means the Office of Management and Budget.</text> </paragraph><paragraph id="ide0951075-673d-4886-9acb-3e352f7b10e0"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text>
			</paragraph></section><section id="idae8e510f-ec9d-4839-a99a-2f9ba888478c"><enum>3.</enum><header>Making 500 megahertz available</header>
			<subsection id="id24dab4ac-3636-4afd-a7d3-467e19eb8db0"><enum>(a)</enum><header>Requirements</header>
 <paragraph id="idb34b648c-e8c0-4afb-a1dd-8d83383caaeb"><enum>(1)</enum><header>In general</header><text>Consistent with the Presidential Memorandum of June 28, 2010, entitled <quote>Unleashing the Wireless Broadband Revolution</quote> and establishing a goal of making a total of 500 megahertz of Federal and non-Federal spectrum available on a licensed or unlicensed basis for wireless broadband use by 2020, not later than December 31, 2020, the Secretary, working through the NTIA, and the Commission shall make available a total of at least 255 megahertz of Federal and non-Federal spectrum below the frequency of 6000 megahertz for mobile and fixed wireless broadband use.</text>
 </paragraph><paragraph id="idcdf9c1e6f7f0420abcb658da296644ce"><enum>(2)</enum><header>Unlicensed and licensed use</header><text>Of the spectrum made available under paragraph (1), not less than—</text> <subparagraph id="id184F0FA3BC034C658FBBC9C13802CA58"><enum>(A)</enum><text>100 megahertz shall be made available on an unlicensed basis; and</text>
 </subparagraph><subparagraph id="id72EBB06AB7964422906A240A277D668E"><enum>(B)</enum><text>100 megahertz shall be made available on an exclusive, licensed basis for commercial mobile use, pursuant to the Commission's authority to implement such licensing in a flexible manner, and subject to potential continued use of such spectrum by incumbent Federal entities in designated geographic areas indefinitely or for such length of time as is necessary for those incumbent entities to be relocated to other spectrum.</text>
 </subparagraph></paragraph><paragraph id="idb9ecbeda-573b-45f1-8dc4-8ed07ac30673"><enum>(3)</enum><header>Non-eligible spectrum</header><text>For purposes of satisfying the requirement under paragraph (1), the following spectrum shall not be counted:</text>
 <subparagraph id="id8f5d66df-8fe9-4b0d-a972-c18b9663b6f2"><enum>(A)</enum><text>The frequencies between 1695 and 1710 megahertz.</text> </subparagraph><subparagraph id="id4460b893-2a52-4ff0-a7cb-79c28bd3cf33"><enum>(B)</enum><text>The frequencies between 1755 and 1780 megahertz.</text>
 </subparagraph><subparagraph id="id58cbcbdb-d6b4-4115-975f-7a4aaf504d10"><enum>(C)</enum><text>The frequencies between 2155 and 2180 megahertz.</text> </subparagraph><subparagraph id="id05771578-9fc1-4912-9077-b3c1677aa69e"><enum>(D)</enum><text>The frequencies between 3550 and 3700 megahertz.</text>
 </subparagraph><subparagraph id="id655EE82130434642B729795EB9ADD4F9"><enum>(E)</enum><text>Spectrum that the Commission determines had more than de minimis mobile or fixed wireless broadband operations within the band on the day before the date of enactment of this Act.</text>
 </subparagraph></paragraph><paragraph id="id530596f7-1788-4897-8e24-c941aadb0cb8"><enum>(4)</enum><header>Relocation prioritized over sharing</header><text>This section shall be carried out in accordance with section 113(j) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(j)</external-xref>).</text>
 </paragraph><paragraph id="idd82bc8ae-ad4d-4379-8189-fc3701daf8da"><enum>(5)</enum><header>Considerations</header><text>In making spectrum available under this section, the Secretary and Commission shall consider—</text>
 <subparagraph id="id8e375677-083d-482c-9567-8bcf03167c1c"><enum>(A)</enum><text>the need to preserve critical existing and planned Federal Government capabilities;</text> </subparagraph><subparagraph id="idbcddb155-fa23-4e70-a14e-28aa99de5d27"><enum>(B)</enum><text>the impact on existing State, local, and tribal government capabilities;</text>
 </subparagraph><subparagraph id="idb8e7bf0e-a376-4a77-b28d-e1af02f8d2d4"><enum>(C)</enum><text>the international implications;</text> </subparagraph><subparagraph id="id03c62195-e3da-416b-88f3-b7fb5dc384f1"><enum>(D)</enum><text>the need for appropriate enforcement mechanisms and authorities; and</text>
 </subparagraph><subparagraph id="idD7F41CCCD3DD4BA78520E846EDF19043"><enum>(E)</enum><text>the importance of the deployment of wireless broadband services in rural areas of the United States.</text>
 </subparagraph></paragraph></subsection><subsection id="ide71fe7f1-d0e6-475f-ae4a-6dba4e7db94b"><enum>(b)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed—</text> <paragraph id="id25ed75db-c994-4524-9a9a-984ad04dc787"><enum>(1)</enum><text>to impair or otherwise affect the functions of the Director of OMB relating to budgetary, administrative, or legislative proposals;</text>
 </paragraph><paragraph id="id78134312-dcdb-4480-866b-dee99fe1db80"><enum>(2)</enum><text>to require the disclosure of classified information, law enforcement sensitive information, or other information that must be protected in the interest of national security; or</text>
 </paragraph><paragraph id="id222044b8-e36a-4328-984e-8d73ae559590"><enum>(3)</enum><text>to affect any requirement under section 156 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/921">47 U.S.C. 921</external-xref> note), as added by section 1062(a) of the National Defense Authorization Act for Fiscal Year 2000, or any other relevant statutory requirement applicable to the reallocation of Federal spectrum.</text>
				</paragraph></subsection></section><section id="id282df8f6-f759-4912-b485-8f1344aed2d3"><enum>4.</enum><header>Millimeter wave spectrum</header>
 <subsection id="idf855e530-fdf4-4741-8c06-e817394d09c6"><enum>(a)</enum><header>Feasibility assessment</header><text>Not later than 18 months after the date of enactment of this Act, the NTIA, in consultation with the Commission, shall conduct a feasibility assessment regarding the impact, on Federal entities and operations in any of the following bands, of authorizing mobile or fixed terrestrial wireless operations, including for advanced mobile service operations, in the following bands:</text>
 <paragraph id="id04842fab-662a-46ad-9e46-de57b149ebd2"><enum>(1)</enum><text>The band between 31800 and 33400 megahertz.</text> </paragraph><paragraph id="id41e6f258-3534-49e3-acad-863b3596782a"><enum>(2)</enum><text>The band between 71000 and 76000 megahertz.</text>
 </paragraph><paragraph id="id781758d3-cafe-4e33-beb3-31a52e56c723"><enum>(3)</enum><text>The band between 81000 and 86000 megahertz.</text> </paragraph></subsection><subsection id="id9a600a5f-eb48-4e67-9bb5-c058fb12d1d2"><enum>(b)</enum><header>Requirements</header><text>In conducting the feasibility assessment under subsection (a), the NTIA shall—</text>
 <paragraph id="ide6136528-fc6a-4a3f-af05-a40fec3e23e4"><enum>(1)</enum><text>consult directly with Federal entities with respect to frequencies allocated to Federal use by such entities in the bands identified in that subsection;</text>
 </paragraph><paragraph id="idd3981afb-0fe8-49ae-a260-98007bda3011"><enum>(2)</enum><text>consider what, if any, impact authorizing mobile or fixed terrestrial wireless operations, including advanced mobile services operations, in any of such frequencies would have on an affected Federal entity; and</text>
 </paragraph><paragraph id="ida7afef1c-8e3b-410e-ad1f-bc3da2eeea78"><enum>(3)</enum><text>identify any such frequencies in the bands described in that subsection that the NTIA assessment determines are feasible for authorizing for mobile or fixed terrestrial wireless operations, including any advanced mobile service operations.</text>
 </paragraph></subsection><subsection id="id639c0f10-3955-424b-8359-95bd519f88f7"><enum>(c)</enum><header>Report to Congress and the Commission</header><text>Not later than 30 days after the date the feasibility assessment under subsection (a) is complete, the NTIA shall submit to the appropriate committees of Congress a report on the feasibility assessment and provide a copy to the Commission.</text>
 </subsection><subsection id="idb01967d5-f559-4b4a-9fab-aeb420e8e166"><enum>(d)</enum><header>FCC proceeding</header><text>Not later than 2 years after the date of enactment of this Act or 90 days after the date it receives the feasibility assessment under subsection (c), whichever is earlier, the Commission, in consultation with the NTIA, shall publish a notice of proposed rulemaking to consider service rules to authorize mobile or fixed terrestrial wireless operations, including for advanced mobile service operations, in the following radio frequency bands:</text>
 <paragraph id="id40a62da2-ee4b-4e27-a0d7-14b20f47b40d"><enum>(1)</enum><text>The band between 24250 and 24450 megahertz.</text> </paragraph><paragraph id="idfa0232f5-c621-4099-a64e-ca7139b62020"><enum>(2)</enum><text>The band between 25050 and 25250 megahertz.</text>
 </paragraph><paragraph id="idc7a7d3bd-1fa3-4647-b5e7-89ac24cd5aa7"><enum>(3)</enum><text>The band between 31800 and 33400 megahertz, except for any frequencies with Federal allocations.</text> </paragraph><paragraph id="ide2d785ab-9c2c-485e-8b7f-6d722664cd33"><enum>(4)</enum><text>The band between 42000 and 42500 megahertz.</text>
 </paragraph><paragraph id="id24d072e8-066b-4ba8-8f1e-52eb233dbfa2"><enum>(5)</enum><text>The band between 71000 and 76000 megahertz, except for any frequencies with Federal allocations.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id505d3bd3-7784-459a-b842-943eeb5c217e"><enum>(6)</enum><text>The band between 81000 and 86000 megahertz, except for any frequencies with Federal allocations.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id446f3fd3-3fa0-46eb-92ab-c045d2db752c"><enum>(7)</enum><text>Any frequencies with Federal allocations identified as feasible under subsection (b)(3).</text> </paragraph></subsection><subsection id="id84d2ccc8-1cd7-48ff-8a7b-e75c62be5dc9"><enum>(e)</enum><header>Considerations</header><text>In conducting a rulemaking under subsection (d), the Commission shall—</text>
 <paragraph id="ide7d92f75-284c-41a5-a806-f481458204c3"><enum>(1)</enum><text>consult with Federal entities via the NTIA regarding the frequencies described in subsection (d)(7);</text>
 </paragraph><paragraph id="ida92bd47b-ef9b-45d3-9875-2d298a846599"><enum>(2)</enum><text>consider how the bands described in subsection (d) may be used to provide commercial wireless broadband service, including whether—</text>
 <subparagraph id="id46c338bc-96c6-44a5-bbea-c0cf0d85aebf"><enum>(A)</enum><text>such spectrum may be best used for licensed or unlicensed services, or some combination thereof; and</text>
 </subparagraph><subparagraph id="ide5bae591-a91f-480f-93d3-0dd3c42431ed"><enum>(B)</enum><text>to permit additional licensed operations in such bands on a shared basis; and</text> </subparagraph></paragraph><paragraph id="ide28d5127-1701-495a-9013-d3fae83bd2cf"><enum>(3)</enum><text>include technical characteristics under which the bands described in subsection (d) may be employed for mobile or fixed terrestrial wireless operations, including any appropriate coexistence requirements.</text>
				</paragraph></subsection></section><section id="idffb53bfb-0e3d-4ffe-abdb-1fa831f405e4"><enum>5.</enum><header>3 gigahertz spectrum</header>
 <subsection id="id1dc4a680-0fa4-41a8-970d-ed732199e8a7"><enum>(a)</enum><header>Between 3100 megahertz and 3550 megahertz</header><text>Not later than 18 months after the date of enactment of this Act, and in consultation with the Commission and the head of each affected Federal agency (or a designee thereof), the Secretary shall submit to the Commission and the appropriate committees of Congress a report evaluating the feasibility of allowing commercial wireless services, licensed or unlicensed, to share use of the frequencies between 3100 megahertz and 3550 megahertz.</text>
 </subsection><subsection id="id6bd370f6-a386-4e20-8eef-36401d39f407"><enum>(b)</enum><header>Between 3700 megahertz and 4200 megahertz</header><text>Not later than 18 months after the date of enactment of this Act, after notice and an opportunity for public comment, and in consultation with the Secretary and the head of each affected Federal agency (or a designee thereof), the Commission shall submit to the Secretary and the appropriate committees of Congress a report evaluating the feasibility of allowing commercial wireless services, licensed or unlicensed, to share use of the frequencies between 3700 megahertz and 4200 megahertz.</text>
 </subsection><subsection id="ida0831ed3-7f11-4b9e-a070-13e6654b6e23"><enum>(c)</enum><header>Requirements</header><text>A report under subsection (a) or subsection (b) shall include the following:</text>
 <paragraph id="idce35dd9c-335c-47b6-90e7-965fdb7f8210"><enum>(1)</enum><text>An assessment of the operations of Federal entities that operate Federal Government stations authorized to use the frequencies described in that subsection.</text>
 </paragraph><paragraph id="ida214058c-136b-4941-9c59-fc915761c242"><enum>(2)</enum><text>An assessment of the possible impacts of such sharing on Federal and non-Federal users already operating on the frequencies described in that subsection.</text>
 </paragraph><paragraph id="id8d894383-101e-48ed-943e-d720e6db38f1"><enum>(3)</enum><text>The criteria that may be necessary to ensure shared licensed or unlicensed services would not cause harmful interference to Federal or non-Federal users already operating in the frequencies described in that subsection.</text>
 </paragraph><paragraph id="id8515a691-8610-494e-8ff0-adcde3d8e0ae"><enum>(4)</enum><text>If such sharing is feasible, an identification of which of the frequencies described in that subsection are most suitable for sharing with commercial wireless services through the assignment of new licenses by competitive bidding, for sharing with unlicensed operations, or through a combination of licensing and unlicensed operations.</text>
 </paragraph></subsection><subsection id="iddfaafbd0-8673-4ecf-8198-95c473a86e69"><enum>(d)</enum><header>Commission action</header><text>The Commission, in consultation with the NTIA, shall seek public comment on the reports required under subsections (a) and (b), including regarding the bands identified in such reports as feasible pursuant to subsection (c)(4).</text>
 </subsection></section><section id="id77a95f9d-f24b-4c76-82d7-4ef62f56b5c2"><enum>6.</enum><header>Distributed antenna systems and small cell infrastructure</header><text display-inline="no-display-inline">Not later than December 31, 2017, the Commission shall take action in its Program Alternatives for Small Wireless Communications Facility Deployments proceeding (WT Docket 15–180).</text>
		</section><section id="idcd9189de-140c-4d88-bd40-15736d69eb92"><enum>7.</enum><header>Communications facilities deployment on Federal property</header>
 <subsection id="ida160446d-5a2a-446b-a1ac-e7fdb5bf89ec"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455</external-xref>) is amended by striking subsections (b), (c), and (d) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id317636dc-8ee0-4a98-b788-6a605a60908d" style="OLC">
					<subsection id="idabada7d7-6b84-4319-a729-9a1243f3b350"><enum>(b)</enum><header>Federal easements, rights-of-Way, and leases</header>
 <paragraph id="id6294624e-923b-4bf0-8bfc-8815b59491b0"><enum>(1)</enum><header>Grant</header><text>If an executive agency, a State, a political subdivision or agency of a State, or a person, firm, or organization applies for the grant of an easement, right-of-way, or lease to, in, over, or on a building or other property owned by the Federal Government for the right to install, construct, modify, or maintain a communications facility installation, the executive agency having control of the building or other property may grant to the applicant, on behalf of the Federal Government, subject to paragraph (5), an easement, right-of-way, or lease to perform such installation, construction, modification, or maintenance.</text>
						</paragraph><paragraph id="id2c6e26ea-d187-4c17-8146-d2eeec6bf548"><enum>(2)</enum><header>Application</header>
 <subparagraph id="id5a700f6b-1137-4e91-b8e4-81d5905f698e"><enum>(A)</enum><header>In general</header><text>The Administrator of General Services shall develop a common form for applications for easements, rights-of-way, and leases under paragraph (1) for all executive agencies that, except as provided in subparagraph (B), shall be used by all executive agencies and applicants with respect to the buildings or other property of each such agency.</text>
 </subparagraph><subparagraph id="ide449eda5-5708-489e-8c1a-b20b8bba008f"><enum>(B)</enum><header>Exception</header><text>The requirement under subparagraph (A) for an executive agency to use the common form developed by the Administrator of General Services shall not apply to an executive agency if the head of an executive agency notifies the Administrator that the executive agency uses a substantially similar application.</text>
							</subparagraph></paragraph><paragraph id="id0e8dc6b1-62bc-4e23-b70b-41ab9b14bd1d"><enum>(3)</enum><header>Fee</header>
 <subparagraph id="id0736892d-afde-42f0-bd96-4a6ca9569a63"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Administrator of General Services shall establish a fee for the grant of an easement, right-of-way, or lease pursuant to paragraph (1) that is based on direct cost recovery.</text>
 </subparagraph><subparagraph id="idade0084f-2462-4cc2-b058-a19afd68490a"><enum>(B)</enum><header>Exceptions</header><text>The Administrator of General Services may establish exceptions to the fee amount required under subparagraph (A)—</text>
 <clause id="id8c9a42fd-778a-40eb-a926-c353576866c1"><enum>(i)</enum><text>in consideration of the public benefit provided by a grant of an easement, right-of-way, or lease; and</text>
 </clause><clause id="ida28e0e67-bda7-4bc7-b5de-874b11979a2d"><enum>(ii)</enum><text>in the interest of expanding wireless and broadband coverage.</text> </clause></subparagraph></paragraph><paragraph id="idcf3a41c4-8347-49c6-bdb7-0c764b9898b3"><enum>(4)</enum><header>Use of fees collected</header><text>Any fee amounts collected by an executive agency pursuant to paragraph (3) may be made available, as provided in appropriations Acts, to such agency to cover the costs of granting the easement, right-of-way, or lease.</text>
						</paragraph><paragraph id="ida87af4ba-cb13-407a-95f0-aba40dd28011"><enum>(5)</enum><header>Timely consideration of applications</header>
 <subparagraph id="id5b47ce25-9ab0-4865-88ab-4d24341b6038"><enum>(A)</enum><header>In general</header><text>Not later than 270 days after the date on which an executive agency receives a duly filed application for an easement, right-of-way, or lease under this subsection, the executive agency shall—</text>
 <clause id="id3f35d47f-2210-4523-8e93-f389c682f38b"><enum>(i)</enum><text>grant or deny, on behalf of the Federal Government, the application; and</text> </clause><clause id="id5d0738fc-35de-4a61-9913-10f3bbaf974e"><enum>(ii)</enum><text>notify the applicant of the grant or denial.</text>
 </clause></subparagraph><subparagraph id="idac049db9-6894-466f-8189-5e35ff51f662"><enum>(B)</enum><header>Explanation of denial</header><text>If an executive agency denies an application under subparagraph (A), the executive agency shall notify the applicant in writing, including a clear statement of the reasons for the denial.</text>
 </subparagraph><subparagraph id="id4a0ffbe8-380d-42b0-964e-c1d835553ecb"><enum>(C)</enum><header>Applicability of environmental laws</header><text>Nothing in this paragraph shall be construed to relieve an executive agency of the requirements of division A of subtitle III of title 54, United States Code, or the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text>
 </subparagraph><subparagraph id="id775ab663-486b-450a-905f-07492fac91e3"><enum>(D)</enum><header>Point of contact</header><text>Upon receiving an application under subparagraph (A), an executive agency shall designate one or more appropriate individuals within the executive agency to act as a point of contact with the applicant.</text>
							</subparagraph></paragraph></subsection><subsection id="id2fb04fdf-6cd5-451f-97cb-097efc409160"><enum>(c)</enum><header>Master contracts for communications facility installation sitings</header>
 <paragraph id="idf1df54d4-8e94-4b92-9c3d-e79be4669fe2"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 704 of the Telecommunications Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/104">Public Law 104–104</external-xref>; 110 Stat. 151) or any other provision of law, the Administrator of General Services shall—</text>
 <subparagraph id="id4cc511b7-981c-4a7d-a280-b4241ad67b99"><enum>(A)</enum><text>develop one or more master contracts that shall govern the placement of communications facility installation on buildings and other property owned by the Federal Government; and</text>
 </subparagraph><subparagraph id="id271b1ae8-618d-435f-9de9-860838a2c353"><enum>(B)</enum><text>in developing the master contract or contracts, standardize the treatment of the placement of communications facility installation on building rooftops or facades, the placement of communications facility installation on rooftops or inside buildings, the technology used in connection with communications facility installation placed on Federal buildings and other property, and any other key issues the Administrator of General Services considers appropriate.</text>
 </subparagraph></paragraph><paragraph id="id019d7ef6-c14c-4a62-98af-a84702a6fd7d"><enum>(2)</enum><header>Applicability</header><text>The master contract or contracts developed by the Administrator of General Services under paragraph (1) shall apply to all publicly accessible buildings and other property owned by the Federal Government, unless the Administrator of General Services decides that issues with respect to the siting of a communications facility installation on a specific building or other property warrant nonstandard treatment of such building or other property.</text>
						</paragraph><paragraph id="idae810995-8815-47dd-932b-ac04005ca404"><enum>(3)</enum><header>Application</header>
 <subparagraph id="id72d04907-cf97-4ade-875f-f8b92d44afae"><enum>(A)</enum><header>In general</header><text>The Administrator of General Services shall develop a common form or set of forms for communications facility installation siting applications that, except as provided in subparagraph (B), shall be used by all executive agencies and applicants with respect to the buildings and other property of each such agency.</text>
 </subparagraph><subparagraph id="idfa600723-e2f3-49a0-b8f1-c7d488e78d42"><enum>(B)</enum><header>Exception</header><text>The requirement under subparagraph (A) for an executive agency to use the common form or set of forms developed by the Administrator of General Services shall not apply to an executive agency if the head of the executive agency notifies the Administrator that the executive agency uses a substantially similar application.</text>
 </subparagraph></paragraph></subsection><subsection id="id0cb165e2-fae6-4dff-8659-04570203b9c1"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id46b04f84-cfca-4e12-808d-cd2334d3aa3f"><enum>(1)</enum><header>Communications facility installation</header><text>The term <term>communications facility installation</term> includes—</text>
 <subparagraph id="id2af222e9-160c-4179-8fb9-12a04389eac4"><enum>(A)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the licensed or permitted unlicensed wireless or wireline transmission of writings, signs, signals, data, images, pictures, and sounds of all kinds; and</text>
 </subparagraph><subparagraph id="id294cd9b8-d87a-4619-b34d-9e00d2202784"><enum>(B)</enum><text>any antenna or apparatus that—</text> <clause id="id6b20172b-e8c8-45ae-9ab9-cf2f83b6427c"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text>
 </clause><clause id="idcbe3838a-e3ff-4c27-b916-be7bb2c723cb"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Commission or is using duly authorized devices that do not require individual licenses; and</text>
 </clause><clause id="idb9da347d-a2a2-4ca0-8e35-c181e79f0bec"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text> </clause></subparagraph></paragraph><paragraph id="id72780028-09c3-4dcb-9633-a0ae6d7b752a"><enum>(2)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given such term in section 102 of title 40, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id45dd4a56-ac0c-4d72-bcf9-67fca04f24e0"><enum>(b)</enum><header>Savings provision</header><text>An application for an easement, right-of-way, or lease that was made or granted under section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455</external-xref>) before the effective date of this Act shall continue, subject to that section as in effect on the day before such effective date.</text>
			</subsection><subsection id="idb367114dcdd04e89b88b39b7cca4ac16"><enum>(c)</enum><header>Streamlining broadband facility applications</header>
 <paragraph id="idc9dd72e487e44aaf8271305ac44bb54d"><enum>(1)</enum><header>Definition of communications facility installation</header><text>In this subsection, the term <term>communications facility installation</term> has the meaning given the term in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>), as amended by subsection (a).</text>
				</paragraph><paragraph id="idd1c03c602f68412db6bcf53e9c13806b"><enum>(2)</enum><header>Recommendations</header>
 <subparagraph id="ida1ede0fa2f0941efb4fb1ae29761deb7"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the NTIA, in coordination with the Department of the Interior, the Department of Agriculture, the Department of Defense, the Department of Transportation, the Office of Management and Budget, and the General Services Administration, shall develop recommendations to streamline the process for considering applications by those agencies under section 6409(b) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)</external-xref>), as amended by subsection (a).</text>
 </subparagraph><subparagraph id="id3ac3d309b4644adb9100fcd1d605d421"><enum>(B)</enum><header>Requirements for recommendations</header><text>The recommendations developed under subparagraph (A) shall include—</text> <clause id="ida6f4afd6a4674fc2a3782cd8151f9c95"><enum>(i)</enum><text>procedures for the tracking of applications described in subparagraph (A);</text>
 </clause><clause id="id639c3e17850749bba9414f750064f956"><enum>(ii)</enum><text>methods by which to reduce the amount of time between the receipt of an application and the issuance of a final decision on an application; and</text>
 </clause><clause id="idd3042416ac55447db6bd766f1fb068d4"><enum>(iii)</enum><text>policies to expedite renewals of an easement, license, or other authorization to locate a communications facility installation on land managed by the agencies described in subparagraph (A).</text>
 </clause></subparagraph><subparagraph id="idf50a1b73e3bc4c829668d7bda4abeeb6"><enum>(C)</enum><header>Report to Congress</header><text>Not later than 2 years after the date on which the recommendations required under subparagraph (A) are developed, the NTIA shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report that describes—</text>
 <clause id="id6d136735e07c4bdf90f829163a36f314"><enum>(i)</enum><text>the status of the implementation of the recommendations developed under subparagraph (A); and</text> </clause><clause id="ideae186be26824be8a36cc55d1b4fa602"><enum>(ii)</enum><text>any improvements to the process for considering applications described in subparagraph (A) that have resulted from those recommendations, including in particular the speed at which such applications are reviewed and a final determination is issued.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="id1A249F88B1CD4C73AEEC2645FE9A731D"><enum>8.</enum><header>Broadband infrastructure deployment</header>
 <subsection id="id72E22BDF81754649A162684BF2FF2DE4"><enum>(a)</enum><header>United States policy</header><text display-inline="yes-display-inline">It is the policy of the United States for the Department of Transportation and State departments of transportation—</text>
 <paragraph id="ide667453b02314c2495648a2e9be6ff3f"><enum>(1)</enum><text>to adjust or otherwise develop right-of-way policies for Federal-aid highways to effectively accommodate broadband infrastructure;</text>
 </paragraph><paragraph id="id5d03a781575c4f49afc112653eaaef0e"><enum>(2)</enum><text>to ensure the safe and efficient accommodation of broadband infrastructure in the public right-of-way;</text>
 </paragraph><paragraph id="id1444e583450245a096f4f1995e88c3fd"><enum>(3)</enum><text>to include broadband stakeholders in the transportation planning process; and</text> </paragraph><paragraph id="id1d151e7c5da64d91ae6bd5d7fdfc58c7"><enum>(4)</enum><text>to coordinate highway construction plans with other statewide telecommunications and broadband plans.</text>
 </paragraph></subsection><subsection id="idD4166ECC2A8C4853BCD270DB83AFB03E"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id6C3D3A80ECEA40288E102A31A4D64770"><enum>(1)</enum><header>Appropriate State agency</header><text>The term <term>appropriate State agency</term> means a State governmental agency that is recognized by the executive branch of the State as having the experience necessary to evaluate and carry out projects relating to the proper and effective installation and operation of broadband infrastructure.</text>
 </paragraph><paragraph id="id2649D3B923084E6DBD7EA817EFD2CF41"><enum>(2)</enum><header>Broadband infrastructure</header><text>The term <term>broadband infrastructure</term> means any buried or aerial facility, and any wireless or wireline connection, that enables users to send and receive voice, video, data, graphics, or any combination thereof.</text>
 </paragraph><paragraph id="id24E398CC352D4A17B9648715DC3CD1D7"><enum>(3)</enum><header>Broadband infrastructure entity</header><text>The term <term>broadband infrastructure entity</term> means any entity that—</text> <subparagraph id="idF7B3A8A947A2465FABB912F3B2931DCF"><enum>(A)</enum><text>installs, owns, or operates broadband infrastructure; and</text>
 </subparagraph><subparagraph id="id1455FF6C237E420CA9755A4815C11A85"><enum>(B)</enum><text>provides broadband services to the public in a manner consistent with the public interest, convenience, and necessity, as determined by the State.</text>
 </subparagraph></paragraph><paragraph id="ID914346B62C5D497EA7E427F09091F8FA"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means—</text>
 <subparagraph id="ID1AA0C8024B5B488EA17F81A36FBC1821"><enum>(A)</enum><text>a State;</text>
 </subparagraph><subparagraph id="ID792A8B98FE9C42679797E3F1D68FC25F"><enum>(B)</enum><text>the District of Columbia; and</text>
 </subparagraph><subparagraph id="ID28D43A31F3264D79A65D4436F400AF2F"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text>
 </subparagraph></paragraph></subsection><subsection id="id43C028DD7D2040758DF85E5638049540"><enum>(c)</enum><header>Broadband infrastructure deployment</header><text display-inline="yes-display-inline">To facilitate the installation of broadband infrastructure and achieve the policy described in subsection (a), the Secretary of Transportation shall ensure that each State that receives funds under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, meets the following requirements:</text>
 <paragraph id="id80D4F8999D644B479BAA83C40ACDBAF5"><enum>(1)</enum><header>Broadband coordination</header><text>The State department of transportation, in coordination with appropriate State agencies, shall—</text> <subparagraph id="ide64fa44696c945ad8cee2b8a0c0e80e2"><enum>(A)</enum><text>identify a broadband utility coordinator, that may have additional responsibilities, whether in the State department of transportation or in another State agency, and that is responsible for coordinating the broadband infrastructure right-of-way needs of the State with Federal-aid highway projects carried out in the State;</text>
 </subparagraph><subparagraph id="id81bb2630e3244a38a08f5ee73e28e0f8"><enum>(B)</enum><text>establish a process for the registration of broadband infrastructure entities that seek to be included in those broadband infrastructure right-of-way coordination efforts within the State;</text>
 </subparagraph><subparagraph id="idace8ec3166db4ddc8b01505524ef4ec9"><enum>(C)</enum><text>coordinate initiatives carried out under this section with other statewide telecommunication and broadband plans and State and local transportation and land use plans; and</text>
 </subparagraph><subparagraph id="id41ee1c7e5ed34b7186d48a35e2dbbdf6"><enum>(D)</enum><text>develop strategies to minimize repeated excavations that involve the installation of broadband infrastructure in a right-of-way.</text>
 </subparagraph></paragraph><paragraph id="id14F15F7E3DAE4CE59A8EC3BF691CD703"><enum>(2)</enum><header>Priority</header><text>If a State chooses to provide for the installation of broadband infrastructure in the right-of-way of an applicable Federal-aid highway under this subsection in a given case, the State department of transportation shall carry out any appropriate measures to ensure that any existing broadband infrastructure entities are not disadvantaged, as compared to other broadband infrastructure entities, with respect to the program under this subsection.</text>
 </paragraph></subsection><subsection id="idac99fe7fabaa4a51b189504258de3738"><enum>(d)</enum><header>Effect of section</header><text display-inline="yes-display-inline">This section applies only to activities for which obligations or expenditures are initially approved on or after the date of enactment of this Act. Nothing in this section establishes a mandate or requirement, or authorizes the Secretary to establish a mandate or requirement, that a State install broadband infrastructure in a highway right-of-way.</text>
			</subsection></section><section id="idefe6036a-04bf-49cc-8913-dd7d0a28dca3"><enum>9.</enum><header>National broadband facilities asset database</header>
 <subsection id="id1adffa75-f207-4c45-895f-fc8e46c29372"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idfe05e240-5417-41b8-9b73-7b8c68f9a538"><enum>(1)</enum><header>Communications facility installation</header><text>The term <term>communications facility installation</term> includes—</text>
 <subparagraph id="id410c3174-f958-4b99-8aa1-5e265ce1c96d"><enum>(A)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the licensed or permitted unlicensed wireless or wireline transmission of writings, signs, signals, data, images, pictures, and sounds of all kinds; and</text>
 </subparagraph><subparagraph id="id0e451dbc-08dd-4729-820b-302e06dc539e"><enum>(B)</enum><text>any antenna or apparatus that—</text> <clause id="id036a3900-97c8-4926-b1ad-69372e7729a0"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text>
 </clause><clause id="id070aed87-1934-4217-b12f-16d6563b5cf3"><enum>(ii)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Federal Communications Commission or is using duly authorized devices that do not require individual licenses; and</text>
 </clause><clause id="id08cf4f35-9860-47d5-8210-f630eb372809"><enum>(iii)</enum><text>is added to a tower, building, or other structure.</text> </clause></subparagraph></paragraph><paragraph id="ide63ba7ec-5a19-4570-9795-57504d8dd0f2"><enum>(2)</enum><header>Covered property</header><text>The term <term>covered property</term>—</text>
 <subparagraph id="idbe33ae11-181e-41e4-a522-f1019fef2a13"><enum>(A)</enum><text>means any real property capable of supporting a communications facility installation; and</text> </subparagraph><subparagraph id="id2f6882aa-1c3d-4f48-b105-5c4a26502516"><enum>(B)</enum><text>includes any interest in real property described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id4aa56139-8c7f-46fb-90b8-dc9a5af45496"><enum>(3)</enum><header>Database</header><text>The term <term>database</term> means the database established under subsection (b).</text> </paragraph><paragraph id="id7c769d55-859d-47b3-bba7-4499fa63d07e"><enum>(4)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given the term in section 105 of title 5, United States Code.</text>
 </paragraph></subsection><subsection id="id548939a4-c2e1-4a21-8dcb-ddb6a2e7f96f"><enum>(b)</enum><header>Database established</header><text>Not later than June 30, 2018, the Director of the Office of Science and Technology Policy, in consultation with the Chairman of the Commission, Assistant Secretary of Commerce for Communications and Information, Under Secretary of Commerce for Standards and Technology, Administrator of General Services, and Director of OMB, shall—</text>
 <paragraph id="idf701828a-7589-4748-8f71-684ec42cf13f"><enum>(1)</enum><text>establish and operate a single database of any covered property that is owned, leased, or otherwise managed by an Executive agency;</text>
 </paragraph><paragraph id="id4bb076b3-3d0b-4da1-b5ae-9b1713cec06d"><enum>(2)</enum><text>make the database available to—</text> <subparagraph id="id33c03356-1543-40b1-9280-638297e63b0c"><enum>(A)</enum><text>any entity that—</text>
 <clause id="id95930ad1-028d-45e6-93a9-507e5ba0a746"><enum>(i)</enum><text>constructs or operates communications facility installations; or</text> </clause><clause id="id504158a7-92ad-4d88-ba02-dc685e3f4871"><enum>(ii)</enum><text>provides communications service; and</text>
 </clause></subparagraph><subparagraph id="idd8c6fa50-8556-463e-8ab6-64e880bb8e7a"><enum>(B)</enum><text>any other entity that the Director of the Office of Science and Technology Policy determines is appropriate; and</text>
 </subparagraph></paragraph><paragraph id="id7cc15f18-8d97-41af-9445-5093bc48c4e5"><enum>(3)</enum><text>establish a process for withholding data from the database for national security, public safety, or other national strategic concerns in accordance with existing statutory authority and Executive order mandates with respect to handling and protection of such information.</text>
				</paragraph></subsection><subsection id="id7b0937ac-2520-4be5-939b-c4d32992d0fd"><enum>(c)</enum><header>Public comment</header>
 <paragraph id="id4a493ecd-6e5f-4e81-8b9c-c26d74570b4b"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of the <short-title>MOBILE NOW Act</short-title>, the Director of the Office of Science and Technology Policy shall seek public comment to inform the establishment and operation of the database.</text>
 </paragraph><paragraph id="id84ed5aea-7d38-4e4a-92ff-d1e70dff0e59"><enum>(2)</enum><header>Contents</header><text>In seeking public comment under paragraph (1), the Director shall include a request for recommendations on—</text>
 <subparagraph id="iddcf0a3f5-1391-4fab-ba43-a5bcfa94f6dd"><enum>(A)</enum><text>criteria that make real property capable of supporting communications facility installations;</text> </subparagraph><subparagraph id="idaaba67c8-c0c5-490a-b1d4-69561f7756c0"><enum>(B)</enum><text>types of information related to covered property that should be included in the database;</text>
 </subparagraph><subparagraph id="id754ff0e2-9a0a-4db6-989c-6d90653c0d3f"><enum>(C)</enum><text>an interface by which accessibility to the database for all users will be appropriately efficient and secure; and</text>
 </subparagraph><subparagraph id="idf2a58beb-cd17-4a80-92c2-b1d4487506d2"><enum>(D)</enum><text>other information the Director determines necessary to establish and operate the database.</text>
					</subparagraph></paragraph></subsection><subsection id="id0559dc56-3e53-4f77-aa88-8b18362576a9"><enum>(d)</enum><header>Federal agencies</header>
 <paragraph id="idc931a788-e2af-4d4d-bac6-a4fae4af1887"><enum>(1)</enum><header>Initial provision of information</header><text>Not later than 90 days after the date on which the database is established under subsection (b), the head of an Executive agency shall provide to the Director of the Office of Science and Technology Policy, in a manner and format to be determined by the Director, such information as the Director determines appropriate with respect to covered property owned, leased, or otherwise managed by the Executive agency.</text>
 </paragraph><paragraph id="id4636168e-0670-4d5e-86da-d59fc7d7257c"><enum>(2)</enum><header>Change to information previously provided</header><text>In the case of any change to information provided to the Director of the Office of Science and Technology Policy by the head of an Executive agency under paragraph (1), the head of the Executive agency shall provide updated information to the Director not later than 30 days after the date of the change.</text>
 </paragraph><paragraph id="id45852137-cc15-4f2a-8865-802b35f07ff3"><enum>(3)</enum><header>Subsequently acquired property</header><text>If an Executive agency acquires covered property after the date on which the database is established under subsection (b), the head of the Executive agency shall provide to the Director of the Office of Science and Technology Policy the information required under paragraph (1) with respect to the covered property not later than 30 days after the date of the acquisition.</text>
				</paragraph></subsection><subsection id="idEAF0088F9C0949E7988D64E04FAD450A"><enum>(e)</enum><header>State and local governments</header>
 <paragraph id="idF03BBC74D1424397A0776778421EF323"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Science and Technology Policy (referred to in this subsection as the <term>Director</term>) shall make the database available to State and local governments so that such governments may provide to the Director for inclusion in the database similar information to the information required under subsection (d)(1) regarding covered property owned, leased, or otherwise managed by such governments.</text>
				</paragraph><paragraph id="id950710760e8444a1a573a28207234092"><enum>(2)</enum><header>Report on incentivizing participation by  State and local governments</header>
 <subparagraph id="idCE925B6C4E5C4A97BCA5EEA2AA005A66"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in consultation with the Chairman of the Commission, the Assistant Secretary of Commerce for Communications and Information, the Under Secretary of Commerce for Standards and Technology, the Administrator of General Services, and the Director of OMB, shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report on potential ways to incentivize State and local governments to provide to the Director for inclusion in the database similar information to the information required under subsection (d)(1) regarding covered property owned, leased, or otherwise managed by such governments pursuant to paragraph (1) of this subsection or through other means.</text>
 </subparagraph><subparagraph id="id5DCEFCB8880046B28F520781BDCF8B53"><enum>(B)</enum><header>Considerations</header><text>The Director, in preparing the report under subparagraph (A), shall—</text> <clause id="id40759E6911264E0895035B08DA43F7E4"><enum>(i)</enum><text>consult with State and local governments, or their representatives, to identify for inclusion in the report the most cost-effective options for State and local governments to collect and provide the information described in subparagraph (A), including utilizing and leveraging State broadband initiatives and programs; and</text>
 </clause><clause id="id685d7ac149d049479cd30852f05749d0"><enum>(ii)</enum><text>make recommendations on ways the Federal Government can assist State and local governments in collecting and providing the information described in subparagraph (A).</text>
 </clause></subparagraph><subparagraph id="id5030239353d6476c83f47631cd23abde"><enum>(C)</enum><header>Report update</header><text>Not later than 2 years after the date on which the database is established under this section, the Director shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> an update to the report required under subparagraph (A) that identifies State and local governments that have contributed to the database and recommends ways to further incentivize participation by State and local governments pursuant to paragraph (1) of this subsection or through other means.</text>
					</subparagraph></paragraph></subsection><subsection id="idff4978b6-54e5-44b9-a2bd-7c2f40adf618"><enum>(f)</enum><header>Database updates</header>
 <paragraph id="id26e25068-f889-487d-9ec6-97f4694f3069"><enum>(1)</enum><header>Timely inclusion</header><text>After the establishment of the database, the Director of the Office of Science and Technology Policy shall ensure that information provided under subsection (d) or subsection (e) is included in the database not later than 7 days after the date on which the Director receives the information.</text>
 </paragraph><paragraph id="id9c4e89a2-e9d7-4f63-a132-74c440987d69"><enum>(2)</enum><header>Date of addition or update</header><text>Information in the database relating to covered property shall include the date on which the information was added or most recently updated.</text>
 </paragraph></subsection><subsection commented="no" id="id4750392c-a07e-4b3b-982c-e13b5445b8c6"><enum>(g)</enum><header>Report</header><text>Not later than 180 days after the date the Director of the Office of Science and Technology Policy seeks public comment under subsection (c)(1), the Director shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report on the progress in establishing the database under this section. The Director shall update the report annually until the date that the database is fully operational. After the database is fully operational and for the next 5 years thereafter, the Director shall provide annual reports regarding the use of the database, recommendations of how the database may provide additional utility to the entities described in subsection (b)(2), if any recommendations are warranted, and how previous recommendations have been implemented.</text>
			</subsection></section><section id="id39309355-c7cd-453f-8bb7-ea651485bf8c"><enum>10.</enum><header>Reallocation incentives</header>
 <subsection id="ide134b3da-fc28-48b1-a7ad-c050e56d30a8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary, in consultation with the Commission, the Director of OMB, and the head of each affected Federal agency (or a designee thereof), after notice and an opportunity for public comment, shall submit to the appropriate committees of Congress a report that includes legislative or regulatory recommendations to incentivize a Federal entity to relinquish, or share with Federal or non-Federal users, Federal spectrum for the purpose of allowing commercial wireless broadband services to operate on that Federal spectrum.</text>
			</subsection><subsection id="id911c31af-9a23-47fa-acc8-a209223cd822"><enum>(b)</enum><header>Post-Auction payments</header>
 <paragraph id="idb206bfaa-3208-4dfc-9fb1-6c1d1a6dda1a"><enum>(1)</enum><header>Report</header><text>In preparing the report under subsection (a), the Secretary shall—</text>
 <subparagraph id="id84cde644-6df6-4dde-83a7-371859d6cde0"><enum>(A)</enum><text>consider whether permitting eligible Federal entities that are implementing a transition plan submitted under section 113(h) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(h)</external-xref>) to accept payments could result in access to the eligible frequencies that are being reallocated for exclusive non-Federal use or shared use sooner than would otherwise occur without such payments; and</text>
 </subparagraph><subparagraph id="id669c8e9b-f0c2-4c30-985e-3ef0dcb34af9"><enum>(B)</enum><text>include the findings under subparagraph (A), including the analysis under paragraph (2) and any recommendations for legislation, in the report.</text>
 </subparagraph></paragraph><paragraph id="id1c57d8de-a34f-4ba4-930e-b3aa1878fe11"><enum>(2)</enum><header>Analysis</header><text>In considering payments under paragraph (1)(A), the Secretary shall conduct an analysis of whether and how such payments would affect—</text>
 <subparagraph id="idd8f77a8e-7bd2-433c-bc5d-619cb5680a3f"><enum>(A)</enum><text>bidding in auctions conducted under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) of such eligible frequencies; and</text>
 </subparagraph><subparagraph id="id1ed4c10d-5c76-4d87-b3e3-6af8bf3df850"><enum>(B)</enum><text>receipts collected from the auctions described in subparagraph (A).</text> </subparagraph></paragraph><paragraph id="id05e9dbdb-7bce-4e61-a3d4-12ce34a36089"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text>
 <subparagraph id="id2dd218ee-3cd1-48b6-9a2a-cb3d27629360"><enum>(A)</enum><header>Payment</header><text>The term <term>payment</term> means a payment in cash or in-kind by any auction winner, or any person affiliated with an auction winner, of eligible frequencies during the period after eligible frequencies have been reallocated by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) but prior to the completion of relocation or sharing transition of such eligible frequencies per transition plans approved by the Technical Panel.</text>
 </subparagraph><subparagraph id="idc2e09e94-6f34-475c-81f3-2261d1cd0502"><enum>(B)</enum><header>Eligible frequencies</header><text>The term <term>eligible frequencies</term> has the meaning given the term in section 113(g)(2) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(g)(2)</external-xref>).</text>
					</subparagraph></paragraph></subsection></section><section id="idfd5a4ce2-73b8-45e3-aa33-87cabef91146"><enum>11.</enum><header>Bidirectional sharing study</header>
 <subsection id="id3dcf4559-5af5-4ce5-a2f7-14f3dcbc1b58"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, including an opportunity for public comment, the Commission, in collaboration with the NTIA, shall—</text>
 <paragraph id="ide78eae08-0e58-405d-a781-b79ac9fb7034"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a bidirectional sharing study to determine the best means of providing Federal entities flexible access to non-Federal spectrum on a shared basis across a range of short-, mid-, and long-range timeframes, including for intermittent purposes like emergency use; and</text>
 </paragraph><paragraph id="id7b5fc963-20c0-4b6d-85fa-1a7c7a328e44"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report on the study under paragraph (1), including any recommendations for legislation or proposed regulations.</text>
 </paragraph></subsection><subsection id="idad8da942-3993-4526-8e4e-684becd33427"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Commission shall—</text> <paragraph id="idf66b5b57907045b180e0e286a9f9e8ae"><enum>(1)</enum><text>consider the regulatory certainty that commercial spectrum users and Federal entities need to make longer-term investment decisions for shared access to be viable; and</text>
 </paragraph><paragraph id="id6a2758aaa5db4f09a08cfe5e63875b71"><enum>(2)</enum><text>evaluate any barriers to voluntary commercial arrangements in which non-Federal users could provide access to Federal entities.</text>
				</paragraph></subsection></section><section id="idd74a5b64-1481-47ca-a741-8369e6c9aa8c"><enum>12.</enum><header>Unlicensed services in guard bands</header>
 <subsection id="id66ccedd0-fb5c-4996-b1b9-069f9fd5a656"><enum>(a)</enum><header>In general</header><text>After public notice and comment, and in consultation with the Secretary and the head of each affected Federal agency (or a designee thereof), with respect to frequencies allocated for Federal use, the Commission shall adopt rules that permit unlicensed services where feasible to use any frequencies that are designated as guard bands to protect frequencies allocated after the date of enactment of this Act by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>), including spectrum that acts as a duplex gap between transmit and receive frequencies.</text>
 </subsection><subsection id="id6f0f97a1-376e-4ea5-88f8-4429f2643523"><enum>(b)</enum><header>Limitation</header><text>The Commission may not permit any use of a guard band under this section that would cause harmful interference to a licensed service or a Federal service operating in the guard band or in an adjacent band.</text>
 </subsection><subsection id="id1f2764c9-d84a-4869-8b5b-91fb5ed66003"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as limiting the Commission or the Secretary from otherwise making spectrum available for licensed or unlicensed use in any frequency band in addition to guard bands, including under section 3, consistent with their statutory jurisdictions.</text>
 </subsection></section><section id="id78bd2406-bd50-46a4-92f4-e818bf2284c1"><enum>13.</enum><header>Pre-auction funding</header><text display-inline="no-display-inline">Section 118(d)(3)(B)(i)(II) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928(d)(3)(B)(i)(II)</external-xref>) is amended by striking <quote>5 years</quote> and inserting <quote>8 years</quote>.</text>
 </section><section id="id7170d0aa-7041-4e23-b412-5ae633bc4eb5"><enum>14.</enum><header>Immediate transfer of funds</header><text display-inline="no-display-inline">Section 118(e)(1) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928(e)(1)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idfc1c2f89-2153-4d3c-9a3a-3749e53cd336" style="OLC">
 <subparagraph id="idc8beb9bd-6e62-491c-8c2e-54ededafcdc4"><enum>(D)</enum><text>At the request of an eligible Federal entity, the Director of OMB may transfer the amount under subparagraph (A) immediately—</text>
 <clause id="id9410e770-0a1b-4c38-a9ec-435eada9e3b4"><enum>(i)</enum><text>after the frequencies are reallocated by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>); or</text>
 </clause><clause id="id58d7208c-308a-4545-85cd-e75954a9ec90"><enum>(ii)</enum><text>in the case of an incumbent Federal entity that is incurring relocation or sharing costs to accommodate sharing spectrum frequencies with another Federal entity, after the frequencies from which the other eligible Federal entity is relocating are reallocated by competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>), without regard to the availability of such sums in the Fund.</text>
 </clause></subparagraph><subparagraph id="id67216c54-cee3-4896-b2a2-6b39a3c4ecbe"><enum>(E)</enum><text>Prior to the deposit of proceeds into the Fund from an auction, the Director of OMB may borrow from the Treasury the amount under subparagraph (A) for a transfer under subparagraph (D). The Treasury shall immediately be reimbursed, without interest, from funds deposited into the Fund.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="idcdac1245-2c26-4d2b-958e-85a1d824b0b5"><enum>15.</enum><header>Amendments to the Spectrum Pipeline Act of 2015</header><text display-inline="no-display-inline">Section 1008 of the Spectrum Pipeline Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/74">Public Law 114–74</external-xref>; 129 Stat. 584) is amended in the matter preceding paragraph (1) by inserting <quote>, after notice and an opportunity for public comment,</quote> after <quote>the Commission</quote>.</text>
		</section><section id="id46adb7edf7804fa8b50597fd2420bb53"><enum>16.</enum><header>GAO assessment of unlicensed spectrum and Wi-Fi use in low-income neighborhoods</header>
			<subsection id="id7bb00653a3d9445bb48066be19f1298b"><enum>(a)</enum><header>Study</header>
 <paragraph id="id7c4199ba17094537aae686a78c62c2c5"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study to evaluate the availability of broadband Internet access using unlicensed spectrum and wireless networks in low-income neighborhoods.</text>
 </paragraph><paragraph id="id4c0588c850b3467ab105c5dbfe1b3811"><enum>(2)</enum><header>Requirements</header><text>In conducting the study under paragraph (1), the Comptroller General shall consider and evaluate—</text> <subparagraph id="ide252997de1864747b5da9769ceb5b1ba"><enum>(A)</enum><text>the availability of wireless Internet hot spots and access to unlicensed spectrum in low-income neighborhoods, particularly for elementary and secondary school-aged children in such neighborhoods;</text>
 </subparagraph><subparagraph id="idd9a221fa69a143298c5e06910400cd76"><enum>(B)</enum><text>any barriers preventing or limiting the deployment and use of wireless networks in low-income neighborhoods;</text>
 </subparagraph><subparagraph id="id8ed9a53acb81434a95918c41893eb0a5"><enum>(C)</enum><text>how to overcome any barriers described in subparagraph (B), including through incentives, policies, or requirements that would increase the availability of unlicensed spectrum and related technologies in low-income neighborhoods; and</text>
 </subparagraph><subparagraph id="id7bd71e4f06cb49ef9e5ad7cc941859d4"><enum>(D)</enum><text>how to encourage home broadband adoption by households with elementary and secondary school-age children that are in low-income neighborhoods.</text>
 </subparagraph></paragraph></subsection><subsection id="id4db2041f69fb4e91b7b18aca38d96b3b"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report that—</text>
 <paragraph id="id1d097ea16db44a0cb431623f308629f4"><enum>(1)</enum><text>summarizes the findings of the study conducted under subsection (a); and</text> </paragraph><paragraph id="id59b762d5f4604b9aa85e6166db2f71b6"><enum>(2)</enum><text>makes recommendations with respect to potential incentives, policies, and requirements that could help achieve the goals described in subparagraphs (C) and (D) of subsection (a)(2).</text>
				</paragraph></subsection></section><section id="id39F589AD54B548B8AD8752F83BCC02B2"><enum>17.</enum><header>Rulemaking related to partitioning or disaggregating licenses</header>
 <subsection id="id513E90739EB043F68D18052915F985C8"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="id6C03E4ADA59943F7AED4F09AE5F1198F"><enum>(1)</enum><header>Covered small carrier</header><text>The term <term>covered small carrier</term> means a carrier (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)) that—</text>
 <subparagraph id="idF16B43507FD34F0F941970BE95AFB4F0"><enum>(A)</enum><text>has not more than 1,500 employees (as determined under section 121.106 of title 13, Code of Federal Regulations, or any successor thereto); and</text>
 </subparagraph><subparagraph id="id931D8B0EAB1342EE9F347218A0B0D975"><enum>(B)</enum><text>offers services using the facilities of the carrier.</text> </subparagraph></paragraph><paragraph id="id552345E883AE4F1CBF9B1D6E47224559"><enum>(2)</enum><header>Rural area</header><text>The term <term>rural area</term> means any area other than—</text>
 <subparagraph id="id0C399B8CD10340E09E3BA3A86C7DEFC0"><enum>(A)</enum><text>a city, town, or incorporated area that has a population of more than 20,000 inhabitants; or</text> </subparagraph><subparagraph id="idF09D0EEE0E8C4E97A058D036E7C49FDA"><enum>(B)</enum><text>an urbanized area contiguous and adjacent to a city or town that has a population of more than 50,000 inhabitants.</text>
					</subparagraph></paragraph></subsection><subsection id="idBE32715663144B699B784BD3A3A5C72C"><enum>(b)</enum><header>Rulemaking</header>
 <paragraph id="id63070E834EEA4F4B80B00FC635FA6BE4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall initiate a rulemaking proceeding to assess whether to establish a program, or modify existing programs, under which a licensee that receives a license for the exclusive use of spectrum in a specific geographic area under section 301 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref>) may partition or disaggregate the license by sale or long-term lease—</text>
 <subparagraph id="id6244DE5C995345098BBE83D702080460"><enum>(A)</enum><text>in order to—</text>
 <clause id="id72C9A6029A6D4C73A07DA5C2F61065FA"><enum>(i)</enum><text>provide services consistent with the license; and</text> </clause><clause id="id850E09501427430488D82B2DB3F4981E"><enum>(ii)</enum><text>make unused spectrum available to—</text>
 <subclause id="id86C0570D8A1A4938B6A3BDD1EF7FAA7B"><enum>(I)</enum><text>an unaffiliated covered small carrier; or</text> </subclause><subclause id="id3B29C30A60CB496EA7FF615E67908928"><enum>(II)</enum><text>an unaffiliated carrier to serve a rural area; and</text>
 </subclause></clause></subparagraph><subparagraph id="id8452BEB28E964BBDAB13BA906AE4AD4D"><enum>(B)</enum><text>if the Commission finds that such a program would promote—</text> <clause id="id75F91122A9E44BDD8E36D78C87F8AA82"><enum>(i)</enum><text>the availability of advanced telecommunications services in rural areas; or</text>
 </clause><clause id="idC9C278235E0D4585BFBB9741DC7D89FD"><enum>(ii)</enum><text>spectrum availability for covered small carriers.</text> </clause></subparagraph></paragraph><paragraph id="id479AB801C1A54B3EBEEC367D095B6F84"><enum>(2)</enum><header>Considerations</header><text>In conducting the rulemaking proceeding under paragraph (1), the Commission shall consider, with respect to the program proposed to be established under that paragraph—</text>
 <subparagraph id="id3C681BADD6194B55BE2306F6CFD9576D"><enum>(A)</enum><text>whether reduced performance requirements with respect to spectrum obtained through the program would facilitate deployment of advanced telecommunications services in the areas covered by the program;</text>
 </subparagraph><subparagraph id="idCBA8D4E7A0BD4E44B8277AE2583FCB9C"><enum>(B)</enum><text>what conditions may be needed on transfers of spectrum under the program to allow covered small carriers that obtain spectrum under the program to build out the spectrum in a reasonable period of time;</text>
 </subparagraph><subparagraph id="id418208D3ADD14E9EB373BEE30D8A2E9A"><enum>(C)</enum><text>what incentives may be appropriate to encourage licensees to lease or sell spectrum, including—</text> <clause id="idAA8B5064283D41619F282ED232FF89F1"><enum>(i)</enum><text>extending the term of a license granted under section 301 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref>); or</text>
 </clause><clause id="id1BBD34AAC0044B7FADEE1262855CE8A2"><enum>(ii)</enum><text>modifying performance requirements of the license relating to the leased or sold spectrum; and</text> </clause></subparagraph><subparagraph id="idF7745551BA8342FD924C77EA8DC48E80"><enum>(D)</enum><text>the administrative feasibility of—</text>
 <clause id="id4659FAF411764A5B88967E7EC732B7E5"><enum>(i)</enum><text>the incentives described in subparagraph (C); and</text> </clause><clause id="id065E4C4EA6504EB18BEED59C76E620A4"><enum>(ii)</enum><text>other incentives considered by the Commission that further the goals of this section.</text>
 </clause></subparagraph></paragraph><paragraph id="id9DA454FAE669426BA200A3F5D7B7B42F"><enum>(3)</enum><header>Forfeiture of spectrum</header><text>If a party fails to meet any build out requirements set by the Commission for any spectrum sold or leased under this section, the right to the spectrum shall be forfeited to the Commission unless the Commission finds that there is good cause for the failure of the party.</text>
 </paragraph><paragraph id="idF8AF78D73D7C4B9CBA83F4A540C027E6"><enum>(4)</enum><header>Requirement</header><text>The Commission may offer a licensee incentives or reduced performance requirements under this section only if the Commission finds that doing so would likely result in increased availability of advanced telecommunications services in a rural area.</text>
				</paragraph></subsection></section><section id="id015FDEA0B98A480BAF2B7585B1C1E338"><enum>18.</enum><header>Unlicensed spectrum policy</header>
 <subsection id="idE940DB462CCB49AD9B35518DEAA0803B"><enum>(a)</enum><header>Statement of policy</header><text>It is the policy of the United States—</text> <paragraph id="idA04D88EFA70749FCBA4F8D4316D3FB98"><enum>(1)</enum><text>to maximize the benefit to the people of the United States of the spectrum resources of the United States;</text>
 </paragraph><paragraph id="id9230D3F9C3B548A8BFB50E205484B02F"><enum>(2)</enum><text>to advance innovation and investment in wireless broadband services; and</text> </paragraph><paragraph id="id24B9354D25CC49698C4EEA6C82F74AA3"><enum>(3)</enum><text>to promote spectrum policy that makes available on an unlicensed basis radio frequency bands sufficient to meet consumer demand for unlicensed wireless broadband operations.</text>
 </paragraph></subsection><subsection id="idC8F87AA83A3941E3BF5FBD068829F3E4"><enum>(b)</enum><header>Commission responsibilities</header><text>The Commission shall ensure that the efforts of the Commission related to spectrum allocation and assignment make available on an unlicensed basis radio frequency bands sufficient to meet demand for unlicensed wireless broadband operations if doing so is, after taking into account the future needs of other spectrum users—</text>
 <paragraph id="id76423E28DCB049C1A046AE008DF03A80"><enum>(1)</enum><text>reasonable; and</text> </paragraph><paragraph id="id4DD5C28FA2F643D4A5DE50626B6B3071"><enum>(2)</enum><text>in the public interest.</text>
 </paragraph></subsection><subsection id="id16406A8B658F4F4EB480B3BCC064487D"><enum>(c)</enum><header>Commission action</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall take action to implement subsection (b).</text>
			</subsection></section><section id="idEAD274335B9F48508E5941DADC03FB7B"><enum>19.</enum><header>National plan for unlicensed spectrum</header>
 <subsection id="id4C23D86E26834051B88D14B286329323"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7E870D7F779842778B3E6A9DB428F171"><enum>(1)</enum><header>Spectrum Relocation Fund</header><text>The term <term>Spectrum Relocation Fund</term> means the Fund established under section 118 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928</external-xref>).</text>
 </paragraph><paragraph id="id3889A6C811AC4561B3CF9BF694450329"><enum>(2)</enum><header>Unlicensed operations</header><text>The term <term>unlicensed operations</term> means the use of spectrum on a non-exclusive basis under—</text> <subparagraph id="id9DB84E59A1A04630930F36C98E802D7C"><enum>(A)</enum><text>part 15 of title 47, Code of Federal Regulations; or</text>
 </subparagraph><subparagraph id="id971AAFC73A7F41C2BC7C38E61B4E9E66"><enum>(B)</enum><text>licensing by rule under part 96 of title 47, Code of Federal Regulations.</text> </subparagraph></paragraph></subsection><subsection id="idD0CB5DE6214C466980C4E78B19BF0E57"><enum>(b)</enum><header>National plan</header><text>Not later than 1 year after the date of enactment of this Act, the Commission, in consultation with the NTIA, shall develop a national plan for making additional radio frequency bands available for unlicensed operations.</text>
 </subsection><subsection id="id4B9647BF9EAA44DB9741CF542A50C509"><enum>(c)</enum><header>Requirements</header><text>The plan developed under this section shall—</text> <paragraph id="id8D7E463F64994D659E9CAC3F05E49A27"><enum>(1)</enum><text>identify an approach that ensures that consumers have access to additional spectrum to conduct unlicensed operations in a range of radio frequencies to meet consumer demand;</text>
 </paragraph><paragraph id="idED91E5B36E664F18AC683A39F4B3C1E5"><enum>(2)</enum><text>recommend specific actions by the Commission and the NTIA to permit unlicensed operations in additional radio frequency ranges that the Commission finds—</text>
 <subparagraph id="id6B6661D15D39404884C7E4D30FF29D54"><enum>(A)</enum><text>are consistent with the statement of policy under section 18(a);</text> </subparagraph><subparagraph id="id4A982D3A852D476990573E29049089BC"><enum>(B)</enum><text>will—</text>
 <clause id="id107925C8190C453F8947CE0D2A02A017"><enum>(i)</enum><text>expand opportunities for unlicensed operations in a spectrum band; or</text> </clause><clause id="idDF32C4C2819341B1BB8B55B81561883B"><enum>(ii)</enum><text>otherwise improve spectrum utilization and intensity of use of bands where unlicensed operations are already permitted;</text>
 </clause></subparagraph><subparagraph id="id7AD728CDB5E54954A8CF668045FD1E00"><enum>(C)</enum><text>will not cause harmful interference to Federal or non-Federal users of such bands; and</text> </subparagraph><subparagraph id="idB9FB606B1061446C81BA98D6A28D978A"><enum>(D)</enum><text>will not significantly impact homeland security or national security communications systems; and</text>
 </subparagraph></paragraph><paragraph id="id8572B730966A4310827449895B288057"><enum>(3)</enum><text>examine additional ways, with respect to existing and planned databases or spectrum access systems designed to promote spectrum sharing and access to spectrum for unlicensed operations—</text>
 <subparagraph id="id78A1160E705F44309F70D2DBC85C3FB2"><enum>(A)</enum><text>to improve accuracy and efficacy;</text> </subparagraph><subparagraph id="id745841AADE3046E98A0CA151D15DC62A"><enum>(B)</enum><text>to reduce burdens on consumers, manufacturers, and service providers; and</text>
 </subparagraph><subparagraph id="id230360255CF5408E87CDF4668F6E890C"><enum>(C)</enum><text>to protect sensitive Government information.</text> </subparagraph></paragraph></subsection><subsection id="id1E542A94F8AE43F4A0932DB58E538BDE"><enum>(d)</enum><header>Spectrum relocation fund</header><text>To be included as part of the plan developed under this section, the NTIA shall share with the Commission recommendations about how to reform the Spectrum Relocation Fund—</text>
 <paragraph id="idDCBBD1F1E18B4FB89A0A8E978ABF2E3C"><enum>(1)</enum><text>to address costs incurred by Federal entities related to sharing radio frequency bands with radio technologies conducting unlicensed operations; and</text>
 </paragraph><paragraph id="idC1FC3DA1973F4923BC65FFD17E24855C"><enum>(2)</enum><text>to ensure the Spectrum Relocation Fund has sufficient funds to cover—</text> <subparagraph id="id6FE5304551E44F9BA7AB0B1000BDDD5E"><enum>(A)</enum><text>the costs described in paragraph (1); and</text>
 </subparagraph><subparagraph id="id450B82ECC97742D5BA8C51F32A313DE2"><enum>(B)</enum><text>other expenditures allowed of the Spectrum Relocation Fund under section 118 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/928">47 U.S.C. 928</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="id74CD7DB2374541478E7155D2102AB737"><enum>(e)</enum><header>Report required</header>
 <paragraph id="id7B86DA88FAC2411FAE2C257ADBE2D5D3"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report that describes the plan developed under this section, including any recommendations for legislative change.</text>
 </paragraph><paragraph id="idB0B73D165C5F4887A5EFB9FE7ECEFD21"><enum>(2)</enum><header>Publication on Commission website</header><text>Not later than the date on which the Commission submits the report under paragraph (1), the Commission shall make the report publicly available on the website of the Commission.</text>
				</paragraph></subsection></section><section id="id9B74A59E553040779AAD011BF155603B"><enum>20.</enum><header>Spectrum challenge prize</header>
 <subsection id="id3b5cd92cf16c4290afad9657c59e52b3"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> <paragraph id="id70431406A1504ECC867C4EA483FD29AF"><enum>(1)</enum><text display-inline="yes-display-inline">The future competitiveness and global technology leadership of the United States depend, in part, upon the availability and efficient use of spectrum.</text>
 </paragraph><paragraph id="idBDCCFF7C9F61404D86F0D23BAA6648E1"><enum>(2)</enum><text display-inline="yes-display-inline">Dramatic improvement in spectrum efficiency would spur innovation, investment, and economic growth.</text> </paragraph><paragraph id="id8C9143AE186F43A29EF0A2CCFDB6ECF5"><enum>(3)</enum><text display-inline="yes-display-inline">Radio frequency spectrum is vital for emergency communications, national security, law enforcement, aviation, maritime safety, space communications, and numerous other Federal functions.</text>
 </paragraph><paragraph id="idFCE477F281E24DECB1BB4F7CCC46D934"><enum>(4)</enum><text display-inline="yes-display-inline">Prize competitions can spur innovation in the private and public sectors.</text> </paragraph></subsection><subsection id="id86F8D9FC620C47D494E6D2256D552088"><enum>(b)</enum><header>Definition of prize competition</header><text display-inline="yes-display-inline">In this section, the term <term>prize competition</term> means a prize competition conducted by the Secretary under subsection (c)(1).</text>
			</subsection><subsection id="id2cb9fc052b264fa1af420ec124ed9cef"><enum>(c)</enum><header>Spectrum challenge prize</header>
 <paragraph id="id9E74522439184C6AB0CE8E198521A42F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Assistant Secretary of Commerce for Communications and Information and the Under Secretary of Commerce for Standards and Technology, shall, subject to the availability of funds for prize competitions under this section—</text>
 <subparagraph id="id75A156C3B7E643978279E203FF5D57BE"><enum>(A)</enum><text display-inline="yes-display-inline">conduct prize competitions to dramatically accelerate the development and commercialization of technology that improves spectrum efficiency and is capable of cost-effective deployment; and</text>
 </subparagraph><subparagraph id="idDCB69424F80D415CB95EC4D05CA0384A"><enum>(B)</enum><text display-inline="yes-display-inline">define a measurable set of performance goals for participants in the prize competitions to demonstrate their solutions on a level playing field while making a significant advancement over the current state of the art.</text>
 </subparagraph></paragraph><paragraph id="id789F8014060B4FCCAA032C569CF5689A"><enum>(2)</enum><header>Authority of Secretary</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary may—</text> <subparagraph id="idD53B00A70AEA4C0CBE2709C8E143B8DB"><enum>(A)</enum><text display-inline="yes-display-inline">enter into a grant, contract, cooperative agreement, or other agreement with a private sector for-profit or nonprofit entity to administer the prize competitions;</text>
 </subparagraph><subparagraph id="idBA2AFCAD4F694337BC3E99DFBC1F5542"><enum>(B)</enum><text display-inline="yes-display-inline">invite the Defense Advanced Research Projects Agency, the Commission, the National Aeronautics and Space Administration, the National Science Foundation, or any other Federal agency to provide advice and assistance in the design or administration of the prize competitions; and</text>
 </subparagraph><subparagraph id="idEC40D455E3B745B7A267573DE0BAE7BF"><enum>(C)</enum><text display-inline="yes-display-inline">award not more than $5,000,000, in the aggregate, to the winner or winners of the prize competitions.</text>
 </subparagraph></paragraph></subsection><subsection id="id143187c9b9734e7ebb07a7b64b59dd00"><enum>(d)</enum><header>Criteria</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which funds for prize competitions are made available pursuant to this section, the Commission shall publish a technical paper on spectrum efficiency providing criteria that may be used for the design of the prize competitions.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3c54525b4568436690f29dc0b94c7c82"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this section.</text> </subsection></section><section id="id8BE4EF92429F46C7B90B129BA08E4AD3"><enum>21.</enum><header>Wireless telecommunications tax and fee collection fairness</header> <subsection id="idF3828E78580E40A9AA69ECBEA707ACCC"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Wireless Telecommunications Tax and Fee Collection Fairness Act</short-title></quote>.</text>
 </subsection><subsection id="id458A7F5EA5054634BF2BA235407589E3"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text> <paragraph id="id69723db671b5498eb35052117c831e62"><enum>(1)</enum><text>A State may designate an in-State or out-of-State person as a collection agent for the State and impose upon the person a duty to collect certain taxes and fees for wireless telecommunications services from residents of the State.</text>
 </paragraph><paragraph id="id67496499c97644cab4a732490b3526f7"><enum>(2)</enum><text>States have the sovereign right to tax their citizens, subject to the Constitution of the United States and Federal law. States do not have the right to tax interstate commerce or to impose taxes or other obligations on citizens of other States without limitation.</text>
 </paragraph><paragraph id="id9fe81e9b60234e61b32d1613ff384f7e"><enum>(3)</enum><text>A collection agent for a State may feasibly collect taxes and fees from a customer in connection with a financial transaction to which the agent and customer are parties.</text>
 </paragraph><paragraph id="id46BA8C7744A64E7081DBA54CA0674AFD"><enum>(4)</enum><text>Congress can help ensure against unreasonable burdens on interstate commerce by prohibiting each State from imposing a duty on any person to serve as a collection agent for the State unless the collection is in connection with a financial transaction.</text>
 </paragraph></subsection><subsection id="id86C8637073FB4BF6899332E8EDFAE57F"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id16264263DCAC40B2B1AD1E9A870F456D"><enum>(1)</enum><header>Financial transaction</header><text>The term <term>financial transaction</term> means a transaction in which the purchaser or user of a wireless telecommunications service upon whom a tax, fee, or surcharge is imposed gives cash, credit, or any other exchange of monetary value or consideration to the person who is required to collect or remit the tax, fee, or surcharge.</text>
 </paragraph><paragraph id="id41BF94B0D0AE40DFB54639DC74B46FF4"><enum>(2)</enum><header>Local jurisdiction</header><text>The term <term>local jurisdiction</term> means a political subdivision of a State.</text> </paragraph><paragraph id="idF3C43BF8561342829C0B7919064EB37D"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means any of the several States, the District of Columbia, and any territory or possession of the United States.</text>
 </paragraph><paragraph id="idBC5A01F2D60349E2A76BD2290BDBE219"><enum>(4)</enum><header>State or local jurisdiction</header><text>The term <term>State or local jurisdiction</term> includes any governmental entity or person acting on behalf of a State or local jurisdiction that has the authority to assess, impose, levy, or collect taxes or fees.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id431E3D9016F74F5C91603CEF75F12FF6"><enum>(5)</enum><header>Wireless telecommunications service</header><text>The term <term>wireless telecommunications service</term> means a commercial mobile radio service, as defined in section 20.3 of title 47, Code of Federal Regulations, or any successor thereto.</text>
				</paragraph></subsection><subsection id="id7BF7FD15C453473AB8C394BF6D3D2D41"><enum>(d)</enum><header>Financial transaction requirement</header>
 <paragraph id="id876CEE8EC20C40E0B23C6D5D98F1E56A"><enum>(1)</enum><header>In general</header><text>A State, or a local jurisdiction of a State, may not require a person to collect from, or remit on behalf of, any other person a State or local tax, fee, or surcharge imposed on a purchaser or user with respect to the purchase or use of any wireless telecommunications service within the State unless the collection or remittance is in connection with a financial transaction between—</text>
 <subparagraph id="idD806A1BFD93A4FB6A6B29AF14EB64F55"><enum>(A)</enum><text>the person that the State or local jurisdiction requires to collect or remit the tax, fee, or surcharge; and</text>
 </subparagraph><subparagraph id="idE147A503BE3045498DEA700B9077A9A3"><enum>(B)</enum><text>the purchaser or user of the wireless telecommunications service.</text> </subparagraph></paragraph><paragraph id="idCC1D0655B09A420898454E8348495CA2"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to affect the right of a State or local jurisdiction to require the collection of any tax, fee, or surcharge in connection with a financial transaction.</text>
				</paragraph></subsection><subsection id="idc240ed3d67ac4fc2828cddb7d44387bd"><enum>(e)</enum><header>Enforcement</header>
 <paragraph id="id3BFFA989096041CB81C60A1258BDA936"><enum>(1)</enum><header>Private right of action</header><text display-inline="yes-display-inline">Any person aggrieved by a violation of subsection (d) may bring a civil action in an appropriate district court of the United States for equitable relief in accordance with paragraph (2) of this subsection.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9AD1F96E7A3F4C88B5E8F7AF73BDAC47"><enum>(2)</enum><header>Jurisdiction of district courts</header><text display-inline="yes-display-inline">Notwithstanding section 1341 of title 28, United States Code, or the constitution or laws of any State, the district courts of the United States shall have jurisdiction, without regard to the amount in controversy or citizenship of the parties, to grant such mandatory or prohibitive injunctive relief, interim equitable relief, and declaratory judgments as may be necessary to prevent, restrain, or terminate any acts in violation of subsection (d).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF97F2797B641404192ADE05B278B6E11"><enum>22.</enum><header>Rules of construction</header>
 <subsection id="id72f1be04-769d-49f6-9c13-4a01d48b74f3"><enum>(a)</enum><header>Ranges of frequencies</header><text display-inline="yes-display-inline">Each range of frequencies described in this Act shall be construed to be inclusive of the upper and lower frequencies in the range.</text>
 </subsection><subsection id="id96a885b8-b4f5-4007-9594-71b7a59c84a4"><enum>(b)</enum><header>Assessment of electromagnetic spectrum reallocation</header><text>Nothing in this Act shall be construed to affect any requirement under section 156 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/921">47 U.S.C. 921</external-xref> note), as added by section 1062(a) of the National Defense Authorization Act for Fiscal Year 2000.</text>
 </subsection></section><section id="id1338cfef-86d2-41a7-a635-57cfc733c4c3"><enum>23.</enum><header>Relationship to Middle Class Tax Relief and Job Creation Act of 2012</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit, restrict, or circumvent in any way the implementation of the nationwide public safety broadband network defined in section 6001 of title VI of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>) or any rules implementing that network under title VI of that Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401 et seq.</external-xref>).</text></section></legis-body></bill>
