2.In this Act: (1)The term Administrator means the Administrator of the TSA.
(2)Appropriate committees of CongressThe term appropriate committees of Congress means— (A)the Committee on Commerce, Science, and Transportation of the Senate;
(B)the Committee on Homeland Security and Governmental Affairs of the Senate; and (C)the Committee on Homeland Security of the House of Representatives.
(3)The term ASAC means the Aviation Security Advisory Committee established under section 44946 of title 49, United States Code.
(4)The term Secretary means the Secretary of Homeland Security. (5)The term TSA means the Transportation Security Administration.
<enum>I</enum><header>Organization and authorizations</header>
<section id="id9A75AB94650E43AC90AF35B301C54D7B"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 114(w) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id411925B9353C4CE69959F70080B740CA" style="OLC"> <subsection id="id0C9DBB2B61554B01B2F1DC904104118E"><enum>(w)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Transportation Security Administration for salaries, operations, and maintenance of the Administration—</text>
<paragraph id="idDA7FE9C99B794865A86829AC649D0646"><enum>(1)</enum><text>$7,810,196,000 for fiscal year 2018;</text> </paragraph><paragraph id="idF8997174F42541248764019B162D2535"><enum>(2)</enum><text>$7,849,247,000 for fiscal year 2019; and</text>
</paragraph><paragraph id="id39B937C9C62D46259C60A1CAB657C72A"><enum>(3)</enum><text>$7,888,494,000 for fiscal year 2020.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="idAF96768AC75645FEB826EF967B39344D"><enum>102.</enum><header>Administrator of the Transportation Security Administration; five-year term</header> <subsection id="id557AA82B17F04E13A875259A58F865F2"><enum>(a)</enum><header>In general</header><text>Section 114, as amended by section 101, is further amended—</text>
<paragraph id="idFE737143F6D2461FBECE2144B805350C"><enum>(1)</enum><text>in subsection (a), by striking <quote>Department of Transportation</quote> and inserting <quote>Department of Homeland Security</quote>;</text> </paragraph><paragraph id="id7AD8D7EAAFD14355B84DCA56AF358CE7"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text>

<subsection id="id4BE7699DDE8A477DB7CC7EF0537628F7"><enum>(b)</enum><header>Leadership</header>
<paragraph id="id21D27A488F13441F898C4218A6E7C6B5"><enum>(1)</enum><header>Head of Transportation Security Administration</header>
<subparagraph id="id49B8653821A045FA9D822C67F3FB0431"><enum>(A)</enum><header>Appointment</header><text>The head of the Administration shall be the Administrator of the Transportation Security Administration (referred to in this section as the <quote>Administrator</quote>). The Administrator shall be appointed by the President, by and with the advice and consent of the Senate.</text>
</subparagraph><subparagraph id="id273372CB1403440C83164FD3F3EF088E"><enum>(B)</enum><header>Qualifications</header><text>The Administrator must—</text> <clause id="id1708C8B009A74EB0894323D1F125C3F6"><enum>(i)</enum><text>be a citizen of the United States; and</text>
</clause><clause id="id57939E97E8754531A2113F7D0AF7D194"><enum>(ii)</enum><text>have experience in a field directly related to transportation or security.</text> </clause></subparagraph><subparagraph id="id99692593B615446EB3F98BFA3604B675"><enum>(C)</enum><header>Term</header><text>Effective with respect to any individual appointment by the President, by and with the advice and consent of the Senate, after August 1, 2017, the term of office of an individual appointed as the Administrator shall be 5 years.</text>
</subparagraph></paragraph><paragraph id="id6AFBC345E63D4D3291569DDF55CE8626"><enum>(2)</enum><header>Deputy administrator</header>
<subparagraph id="id9770B14BE0DC43909CFBA426FE3BFDAE"><enum>(A)</enum><header>Appointment</header><text>There is established in the Transportation Security Administration a Deputy Administrator, who shall assist the Administrator in the management of the Transportation Security Administration. The Deputy Administrator shall be appointed by the President. The Deputy Administrator shall be Acting Administrator during the absence or incapacity of the Administrator or during a vacancy in the office of Administrator.</text>
</subparagraph><subparagraph id="id9CFAAE04CE374B10957862C751F1B8C2"><enum>(B)</enum><header>Qualifications</header><text>The Deputy Administrator must—</text> <clause id="id345E0F57E68E4A3D80641456FFE5AE78"><enum>(i)</enum><text>be a citizen of the United States; and</text>
</clause><clause id="idBB28ECB2462342038C9B164581B54923"><enum>(ii)</enum><text>have experience in a field directly related to transportation or security.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="idB09CA8E8EE6148C5AC2A741B6F95D96A"><enum>(3)</enum><text>in subsections (c) through (n), (p), (q), and (r), by striking <quote>Under Secretary</quote> each place it appears and inserting <quote>Administrator</quote>; and</text>
</paragraph><paragraph id="idF8899342184242F6940001BB22523B68"><enum>(4)</enum><text>by amending subsection (d) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id003BE5E50A414A4D9B63DBC9C99D89A1" style="OLC"> <subsection id="idE1591195203E4B0A8B145D9BF89D42D5"><enum>(d)</enum><header>Functions</header><text>The Administrator shall be responsible for—</text>

</paragraph><paragraph id="idB82FD638574D418FB5BD9C0451774BCF"><enum>(2)</enum><text>security in land-based transportation, including railroad, highway, pipeline, public transportation, and over-the-road bus; and</text>
</paragraph><paragraph id="idBC9CDD2FE5514232B7687F5E91ACA2C1"><enum>(3)</enum><text>supporting the Coast Guard with maritime security.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idA673A62A568C4B14915602627A1198ED"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 114, as amended by subsection (a), is further amended—</text>

</clause></subparagraph></paragraph><paragraph id="id087AD2F2A24D4353B5C598FC078FED1A"><enum>(2)</enum><header>Deputy administrator of the TSA</header><text>Section 5315 of title 5, United States Code, is amended by inserting after the item relating to the Deputy Administrator, Federal Aviation Administration the following:</text>

<subsection id="idDA326F6E34BD48D1B00D7C922E55B468"><enum></enum><text>Deputy Administrator, Transportation Security Administration.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section id="id404BB6137E0C448E8DF2C2F866454EF5"><enum>103.</enum><header>Transportation Security Administration organization</header><text display-inline="no-display-inline">Section 114, as amended by sections 101 and 102, is further amended by adding at the end the following:</text>

<subsection id="id82451394A4BA4D0A87033D1AB7532813"><enum>(w)</enum><header>Leadership and organization</header>
<paragraph id="id606F94B28FE844FFA3A0B86621312E07"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each of the areas described in paragraph (2), the Administrator of the Transportation Security Administration shall appoint at least 1 individual who shall—</text>
<subparagraph id="idDA94D18B8EB74CECAA6E4F5D2DD30E46"><enum>(A)</enum><text display-inline="yes-display-inline">report directly to the Administrator or the Administrator’s designated direct report; and</text> </subparagraph><subparagraph id="id9552C5D4D4F642329F54A5724F165D89"><enum>(B)</enum><text>be responsible and accountable for that area.</text>
</subparagraph></paragraph><paragraph id="idFD3927B4CAFC44989BEC83C69D6573C1"><enum>(2)</enum><header>Areas described</header><text>The areas described in this paragraph are as follows:</text> <subparagraph id="id18C6699C26EF48568D75DAEAB6F4CFC8"><enum>(A)</enum><text display-inline="yes-display-inline">Aviation security operations and training, including risk-based, adaptive security focused on airport checkpoint and baggage screening operations, cargo inspections, workforce training and development programs, and other specialized programs designed to secure air transportation.</text>
</subparagraph><subparagraph id="id9EA600E99CE8427C88EDEC914C424707"><enum>(B)</enum><text display-inline="yes-display-inline">Surface transportation security operations and training, including risk-based, adaptive security focused on accomplishing security systems assessments, reviewing and prioritizing projects for appropriated surface transportation security grants, operator compliance with voluntary industry standards, workforce training and development programs, and other specialized programs designed to secure surface transportation.</text>
</subparagraph><subparagraph id="id981896057E604802B773DBEDEFC295C6"><enum>(C)</enum><text display-inline="yes-display-inline">Security policy and industry engagement and planning, including the development, interpretation, promotion, and oversight of a unified effort regarding risk-based, risk-reducing security policies and plans (including strategic planning for future contingencies and security challenges) between government and transportation stakeholders, including airports, domestic and international airlines, general aviation, air cargo, mass transit and passenger rail, freight rail, pipeline, highway and motor carriers, and maritime.</text>
</subparagraph><subparagraph id="idF3AB087856AE4ABB86607CF0661CB173"><enum>(D)</enum><text display-inline="yes-display-inline">International strategy and operations, including agency efforts to work with international partners to secure the global transportation network.</text>
</subparagraph><subparagraph id="idF81489D0AF7C4EDDA578A89F6B681FC1"><enum>(E)</enum><text display-inline="yes-display-inline">Trusted and registered traveler programs, including the management and marketing of the agency’s trusted traveler initiatives, including the PreCheck Program, and coordination with trusted traveler programs of other Department of Homeland Security agencies and the private sector.</text>
</subparagraph><subparagraph id="id3E20D0B1587941D291D7D793020CB124"><enum>(F)</enum><text display-inline="yes-display-inline">Technology acquisition and deployment, including the oversight, development, testing, evaluation, acquisition, deployment, and maintenance of security technology and other acquisition programs.</text>
</subparagraph><subparagraph id="id9084D1C9F80449D3A37711870F683748"><enum>(G)</enum><text display-inline="yes-display-inline">Inspection and compliance, including the integrity, efficiency and effectiveness of the agency’s workforce, operations, and programs through objective audits, covert testing, inspections, criminal investigations, and regulatory compliance.</text>
</subparagraph><subparagraph id="idA3632F6C7FC047DBA07C0D2BF8866104"><enum>(H)</enum><text display-inline="yes-display-inline">Civil rights, liberties, and traveler engagement, including ensuring that agency employees and the traveling public are treated in a fair and lawful manner consistent with federal laws and regulations protecting privacy and prohibiting discrimination and reprisal.</text>
</subparagraph><subparagraph id="id913420472DBC4D83927B6D37495414D9"><enum>(I)</enum><text display-inline="yes-display-inline">Legislative and public affairs, including communication and engagement with internal and external audiences in a timely, accurate, and transparent manner, and development and implementation of strategies within the agency to achieve congressional approval or authorization of agency programs and policies.</text>
</subparagraph></paragraph><paragraph id="id4F379A913C8742B8A9850239ED12CAF3"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">The Administrator shall transmit to the appropriate committees of Congress—</text> <subparagraph id="idCD6AD9DA06F942C0AC5E6DB02A5B43F7"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of the <short-title>TSA Modernization Act</short-title>, a list of the names of the individuals appointed under paragraph (1); and</text>
</subparagraph><subparagraph id="id7C44121ACCD147958DB6AE487A1DF1F8"><enum>(B)</enum><text display-inline="yes-display-inline">an update of the list not later than 5 days after any new individual is appointed under paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="idd4c1fc29a1cd45cdad98d8e4dc760f35"><enum>104.</enum><header>Transmittals to Congress</header><text display-inline="no-display-inline">With regard to each report, legislative proposal, or other communication of the Executive Branch related to the TSA and required to be submitted to Congress or the appropriate committees of Congress, the Administrator shall transmit such communication directly to the appropriate committees of Congress.</text>
</section><enum>II</enum><header>Aviation security</header>
<subtitle id="idB991A52BAA96410D8686CC7621312F52" style="OLC"><enum>A</enum><header>Security technology</header>
<section id="id3DC9CBF9723248898162D5AECD9A6120"><enum>211.</enum><header>Third party testing and evaluation of screening technology</header>
<subsection id="id996F18729E3440CFA0DEEA4AE9987691"><enum>(a)</enum><header>In general</header><text>In carrying out the responsibilities under section 114(e)(1), the Administrator shall develop and implement, not later than 1 year after the date of enactment of this Act, a program to enable a vendor of related screening technology to obtain testing and verification, including as an alternative to the TSA's test and evaluation process, by an appropriate third party, of such technology before acquisition or deployment.</text>
</subsection><subsection id="idC8DEFFDC39354E14A6731B0D2D7EB6A0"><enum>(b)</enum><header>Detection testing</header>
<paragraph id="id610BD0E9B93C4E63AC3F5AC41972B41F"><enum>(1)</enum><header>In general</header><text>The third party testing and verification program authorized under subsection (a) shall include detection testing to evaluate the performance of the security technology system regarding the probability of detection, the probability of false alarm, and such other indicators that the system is able to meet the TSA's mission needs.</text>
</paragraph><paragraph id="id7CEBFA529E4F4C37B98556BB214BD6B7"><enum>(2)</enum><header>Coordination with final qualification processes</header><text>To the extent practicable, but without compromising the integrity of the TSA test and evaluation process, the Administrator shall coordinate the third party detection testing under paragraph (1) with subsequent final Federal Government qualification processes.</text>
</paragraph><paragraph id="id69307D408F7E4884BDDDF10881A359E4"><enum>(3)</enum><header>Results</header><text>The results of the third party detection testing under paragraph (1) shall be considered final if the results are approved by the Administration in accordance with approval standards developed by the Administrator.</text>
</paragraph><paragraph id="id19101D89C71C4B198821946CC3D93768"><enum>(4)</enum><header>International standards</header><text>To the extent practicable and permissible under law, the Administrator shall—</text>
<subparagraph id="idC403EDAF964A41FC8C1A6A05AEF77536"><enum>(A)</enum><text>share detection testing information and standards with appropriate international partners; and</text>
</subparagraph><subparagraph id="id5E5BBD4BE80545F686BFA03A3F956787"><enum>(B)</enum><text>coordinate with the appropriate international partners to harmonize TSA testing and evaluation with relevant international standards to maximize the capability to detect explosives and other threats.</text>
</subparagraph></paragraph></subsection><subsection id="id509200AEED3A4650A1B9F73E00B20A8F"><enum>(c)</enum><header>Operational testing</header>
<paragraph id="id26B266EC23CD47BA97B7FA4E7124ED77"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the third party testing and verification program authorized under subsection (a) shall include operational testing.</text>
</paragraph><paragraph id="id4B685B64FF0745A580FCD31B3D7DC491"><enum>(2)</enum><header>Limitation</header><text>Third party operational testing under paragraph (1) may not exceed 1 year.</text> </paragraph></subsection><subsection id="id5BB3D4BF68FD448AA25128A2E11385E9"><enum>(d)</enum><header>Alternative</header><text>Third party testing under subsection (a) shall replace as an alternative, at the discretion of the Administrator, the testing at the Transportation Systems Integration Facility, including operational testing for—</text>
<paragraph id="idFA5DD32225D045E5B6576DE0C3D1D7F6"><enum>(1)</enum><text>health and safety factors;</text> </paragraph><paragraph id="idB285EA3717264AD6B04767BD74FA5CF1"><enum>(2)</enum><text>operator interface;</text>
</paragraph><paragraph id="id8985953D718248DA89551D5A605695E2"><enum>(3)</enum><text>human factors;</text> </paragraph><paragraph id="id297B8D1E551549ACB73D74B3EBB02529"><enum>(4)</enum><text>environmental factors;</text>
</paragraph><paragraph id="id675BDDCD3F4B4C19AF567EF7C6404D97"><enum>(5)</enum><text>throughput; and</text> </paragraph><paragraph id="id3FB4053E5F754D69A08B1002B705C481"><enum>(6)</enum><text>baggage handling systems.</text>
</paragraph></subsection><subsection id="id8340FEAD2F30460CB95C82F0B2603CF2"><enum>(e)</enum><header>Testing and verification framework</header>
<paragraph id="idB5096A7E6E5E44AB8F28B12D24DB5429"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text> <subparagraph id="id83C4DE469F114D22AED5E2880773EB71"><enum>(A)</enum><text>establish a framework for the third party testing and for verifying a security technology is operationally effective and able to meet the TSA's mission needs before it may enter or re-enter, as applicable, the operational context at an airport or other transportation facility; and</text>
</subparagraph><subparagraph id="id7457D6D95A5E4762845800D49BA0840A"><enum>(B)</enum><text>use phased implementation to allow the TSA and the third party to establish best practices.</text> </subparagraph></paragraph><paragraph id="id15A9BD1F18364F9EA729F6A9F3A98978"><enum>(2)</enum><header>Recommendations</header><text>The Administrator shall request ASAC's Security Technology Subcommittee, in consultation with representatives of the security manufacturers industry, to develop and submit to the Administrator recommendations for the third party testing and verification framework.</text>
</paragraph></subsection><subsection id="idFC935DB6DA8C4805B500067956886104"><enum>(f)</enum><header>Field testing</header><text>The Administrator shall prioritize the field testing and evaluation of security technology and equipment at airports and on site at security technology manufacturers whenever possible as an alternative to the Transportation Systems Integration Facility.</text>
</subsection></section><section id="id9DF84CBF123343C9AADBAC72A93A7FAD"><enum>212.</enum><header>Reciprocal recognition of security standards</header>
<subsection id="id3581F19237404196BDBF77998726B567"><enum>(a)</enum><header>In general</header><text>The Administrator, in coordination with the European Civil Aviation Conference and Canadian Air Transport Security Authority, shall develop a validation process for the reciprocal recognition of security equipment technology approvals among international security partners or recognized certification authorities for deployment.</text>
</subsection><subsection id="id6FA76A6261A34071B2657FF9C734626C"><enum>(b)</enum><header>Requirement</header><text>The validation process shall ensure that the certification process of each participating international security partner or recognized certification authority complies with TSA security standards.</text>
</subsection></section><section id="idE3623B1EA9E14B25B194942F50603BE4"><enum>213.</enum><header>Transportation Security Laboratory</header>
<subsection id="id7CB41ACB25EE40FC8D16F147DBAF7B48"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator, shall administer the Transportation Security Laboratory.</text>
</subsection><subsection id="id288D1A418FA84F73982C9899E8FE0FC2"><enum>(b)</enum><header>Periodic reviews</header><text>The Administrator shall review the screening technology test and evaluation process conducted at the Transportation Security Laboratory to improve the coordination, collaboration, and communication between the Transportation Security Laboratory and the Office of Acquisition Program Management at the TSA to identify factors contributing to acquisition inefficiencies, develop strategies to reduce acquisition inefficiencies, facilitate more expeditious initiation and completion of testing, and identify how laboratory practices can better support acquisition decisions.</text>
</subsection></section><section id="id82A24E7A214B42DBA690E48100B61932"><enum>214.</enum><header>Innovation Task Force</header>
<subsection id="id47d030ebb087459182a9aa6351ee88c0"><enum>(a)</enum><header>In general</header><text>The Administrator shall establish an innovation task force—</text> <paragraph id="idada386c8d914457482ae4cb01e8f6dc5"><enum>(1)</enum><text>to cultivate innovations in aviation security;</text>
</paragraph><paragraph id="id2b1f4b95a07244f0807883cbe8c4e5fc"><enum>(2)</enum><text>to develop and recommend how to prioritize and streamline requirements for new approaches to aviation security;</text>
</paragraph><paragraph id="ide0a8a5dd90934fda8b0384964b683cee"><enum>(3)</enum><text>to accelerate the development and introduction of new innovative aviation security technologies and improvements to aviation security operations; and</text>
</paragraph><paragraph id="id3d768559734e47c5bdbc68b871d67138"><enum>(4)</enum><text>to provide industry with access to the airport environment during the technology development and assessment process to demonstrate the technology and to collect data to understand and refine technical operations and human factor issues.</text>
</paragraph></subsection><subsection id="idbb1fb48dd693472b9b81ba4036202eff"><enum>(b)</enum><header>Activities</header><text>The task force shall—</text> <paragraph id="id239bd820f53744d9b0f97cfcfe5dd6a5"><enum>(1)</enum><text>conduct activities to identify and develop an innovative technology, emerging security capability, or process designed to enhance aviation security, including—</text>
<subparagraph id="ideb355a5550974288be5b9cf314e6dce2"><enum>(A)</enum><text>by conducting a field demonstration of such a technology, capability, or process in the airport environment;</text>
</subparagraph><subparagraph id="idbf0cf1c1873b46a1b28681a48e437f4d"><enum>(B)</enum><text>by gathering performance data from such a demonstration to inform the acquisition process; and</text> </subparagraph><subparagraph id="idc4ed12076f284e0c8fbc026e902c9a62"><enum>(C)</enum><text>by enabling a small business with an innovative technology or emerging security capability, but less than adequate resources, to participate in such a demonstration;</text>
</subparagraph></paragraph><paragraph id="id3582e96fbb95473480eeca6caf611a73"><enum>(2)</enum><text>conduct at least quarterly collaboration meetings with industry, including air carriers, airport operators, and other aviation security stakeholders to highlight and discuss best practices on innovative security operations and technology evaluation and deployment; and</text>
</paragraph><paragraph id="idf9b24925e5b243e0b1e6bd42e0916c9d"><enum>(3)</enum><text>submit to the appropriate committees of Congress an annual report on the effectiveness of key performance data from task force-sponsored projects and checkpoint enhancements.</text>
</paragraph></subsection><subsection id="id9dadd80a0a5b42b7af00fbb37654a9ef"><enum>(c)</enum><header>Composition</header>
<paragraph id="idE2DE4FC643634D08BDDC76170B491B7B"><enum>(1)</enum><header>Appointment</header><text>The Administrator, in consultation with the Chairperson of ASAC shall appoint the members of the task force.</text>
</paragraph><paragraph id="id9e5b47bb0b3b46a2896e41c741f14b72"><enum>(2)</enum><header>Chairperson</header><text>The task force shall be chaired by the Administrator's designee.</text>
</paragraph><paragraph id="ida0edc367da134765a8c89137e10cabc7"><enum>(3)</enum><header>Representation</header><text>The task force shall be comprised of representatives of—</text> <subparagraph id="id4a40001602f7478daf04edf2b9b2a185"><enum>(A)</enum><text>the relevant offices of the TSA;</text>
</subparagraph><subparagraph id="ide423d423fcaa4e2db67b90051728ef3f"><enum>(B)</enum><text>if considered appropriate by the Administrator, the Science and Technology Directorate of the Department of Homeland Security;</text>
</subparagraph><subparagraph id="id4E02DE53B2854314A3AA4376CA099CAA"><enum>(C)</enum><text>any other component of the Department of Homeland Security that the Administrator considers appropriate; and</text>
</subparagraph><subparagraph id="id95E1FF220D2A4F39AFEC26A4477163E4"><enum>(D)</enum><text>such industry representatives as the Administrator considers appropriate.</text>
</subparagraph></paragraph></subsection><subsection id="id467e42285dee4d148b501721173e948f"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require the acquisition or deployment of an innovative technology, emerging security capability, or process identified, developed, or recommended under this section.</text>
</subsection><subsection id="id2a282c2489814eec9867f03e3ed2911e"><enum>(e)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the task force established under this section.</text>
</subsection></section><section id="id54190333DCB243248FFC6FA649CE4515"><enum>215.</enum><header>5-Year technology investment plan update</header><text display-inline="no-display-inline">Section 1611(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/563">6 U.S.C. 563(g)</external-xref>) is amended—</text> <paragraph id="id74D50219528D44C99708A56A0C631125"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the matter preceding paragraph (1) and inserting <quote>The Administrator shall, in collaboration with relevant industry and government stakeholders, annually submit to Congress in an appendix to the budget request and publish in an unclassified format in the public domain—</quote>;</text>
</paragraph><paragraph id="id0f38b386c73e421e9980a7088cca8e7e"><enum>(2)</enum><text>in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="id2fd6c3a8f30147b78c91a0e045c274c9"><enum>(3)</enum><text>in paragraph (2), by striking the period and inserting <quote>; and</quote>; and</text>
</paragraph><paragraph id="id4e251f2eeaf047028e3e8c1c82f3c7fd"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idefacf96b150e4d4da1ff3708aadf8439" style="OLC"> <paragraph id="idd4315ae402124bc98d20a6d7ea5d0097"><enum>(3)</enum><text>information about acquisitions completed during the fiscal year preceding the fiscal year during which the report is submitted.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="idA32ADA7D6CED4688955FBC7A959B9AE6"><enum>216.</enum><header>Biometrics expansion</header><text display-inline="no-display-inline">Not later than 270 days after the date of enactment of this Act, the Administrator, in coordination with the Commissioner of Customs and Border Protection, shall—</text>
<paragraph id="idF2FC457081E749A6B41457DE0686C786"><enum>(1)</enum><text display-inline="yes-display-inline">assess the operational and security impact of using biometric technology to identify passengers;</text>
</paragraph><paragraph id="id681AAEDB84C644948B555D3C502313AE"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate, if appropriate, the deployment of such biometric technology at checkpoints, screening lanes, bag drop and boarding areas, and other areas where such deployment would enhance security and facilitate passenger movement; and</text>
</paragraph><paragraph id="id312B0487770C4CC8897BCDAA2A4B20E8"><enum>(3)</enum><text>submit to the appropriate committees of Congress a report on the assessment under paragraph (1) and deployment under paragraph (2).</text>
</paragraph></section><section id="idE6F819B00BEE4F069FFE77E91C4F4E29"><enum>217.</enum><header>Pilot program for automated exit lane technology</header>
<subsection id="idE53ACE5B5748418EB36893B472A76A69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall establish a pilot program to implement and evaluate the use of automated exit lane technology at small hub airports and nonhub airports (as those terms are defined in section 40102 of title 49, United States Code).</text>
</subsection><subsection id="idA1865971157548BBB84F9E8498D55E7D"><enum>(b)</enum><header>Partnership</header><text display-inline="yes-display-inline">The Administrator shall carry out the pilot program in partnership with the applicable airport directors.</text>
</subsection><subsection id="id74B96068E98E41DAAB6DC5E342CD85AC"><enum>(c)</enum><header>Cost share</header><text display-inline="yes-display-inline">The Federal share of the cost of the pilot program under this section shall not exceed 85 percent of the total cost of the program.</text>
</subsection><subsection id="id0795FD5BC0E34B018E7295158E405D02"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out the pilot program under this section $15,000,000 for each of fiscal years 2018 through 2020.</text>
</subsection><subsection id="idA37783DDC864409C89DD65506C0E0BF4"><enum>(e)</enum><header>GAO report</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress a report on the pilot program, including—</text>
<paragraph id="id37431F6C4D2C44F2927D2F0B246B56A7"><enum>(1)</enum><text>the level of airport interest and participation in the pilot program;</text> </paragraph><paragraph id="id4638BCBCF6B14FCF8AED9B6CB5926203"><enum>(2)</enum><text>what return on investment, if any, was achieved by each program participant; and</text>
</paragraph><paragraph id="id5F38698B794F46758080EE48E745A68C"><enum>(3)</enum><text>recommendations regarding whether to expand or discontinue the pilot program.</text> </paragraph></subsection></section><section id="idA2D5E0FC32884BAF929FCBB295F1A9BF"><enum>218.</enum><header>Authorization of appropriations; exit lane security</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out section 44903(n)(1) of title 49, United States Code, $77,000,000 for each of fiscal years 2018 through 2020.</text>
</section><section id="id1AB3514E7ECA406D86A254E1CBFFD425"><enum>219.</enum><header>Real-time security checkpoint wait times</header>
<subsection id="idCD11477846754FE49537AC0E9CD74AE4"><enum>(a)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall make available to the public information on wait times at each airport security checkpoint.</text>
</subsection><subsection id="id3CE6CD2A162E4E729E87B50C53C7B1AD"><enum>(b)</enum><header>Requirements</header><text>The information described in subsection (a) shall be provided in real time via technology and published—</text>
<paragraph id="id2F7777AAE89749D9913006D6D5E8FD55"><enum>(1)</enum><text>online; and</text> </paragraph><paragraph id="id51EA753102994D25A6C64FC6AC9E8C96"><enum>(2)</enum><text>in physical locations at the applicable airport terminal.</text>
</paragraph></subsection><subsection id="idC6698E60A296483392BB7107833534C1"><enum>(c)</enum><header>Considerations</header><text>The Administrator shall make the information described in subsection (a) available to the public in a manner that does not increase public area security risks.</text>
</subsection><subsection id="idF40D8AAD227347528449785386483BE5"><enum>(d)</enum><header>Definition of wait time</header><text>In this section, the term <term>wait time</term> means the period beginning when a passenger enters a queue for a screening checkpoint and ending when the passenger has begun divestment of items requiring screening at that checkpoint.</text>
</subsection></section><section id="id44EEFB1CD5D84197A62BB36841DDE3A8"><enum>220.</enum><header>GAO report on universal deployment of advanced imaging technologies</header>
<subsection id="idC25F816AEBB843CEAE4540BD5CDE4E51"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study of the cost to the TSA or an airport to redesign, if necessary, airport security areas to fully deploy advanced imaging technologies at each airport at which security screening operations are conducted or overseen by the TSA.</text>
</subsection><subsection id="idE817440B6B8445E19E14671C34D544A7"><enum>(b)</enum><header>Cost analysis</header><text>As a part of the study conducted under subsection (a), the Comptroller General shall identify the costs that would be incurred by the TSA or the airport—</text>
<paragraph id="id6685749568BD4A45B1330E151F1B538D"><enum>(1)</enum><text>to purchase the equipment and other assets necessary to deploy advanced imaging technologies at the airport;</text>
</paragraph><paragraph id="id90B524A8B8F24633AAD116BFF26594EB"><enum>(2)</enum><text>to install such equipment, including any related variant, and assets in the airport; and</text> </paragraph><paragraph id="id6C39BA715C634A1EAA088347F371C420"><enum>(3)</enum><text>to maintain such equipment and assets.</text>
</paragraph></subsection><subsection id="idA7C0F444B7864195823193E5BA94A051"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the appropriate committees of Congress a report on the findings of the study under subsection (a).</text>
</subsection></section></subtitle><subtitle id="idE623CBDE008F4606BD50003441A6C41E" style="OLC"><enum>B</enum><header>Public area security</header>
<section id="id2A0213AD4C8048F4B3598EB564A788FA"><enum>221.</enum><header>Third party canines</header>
<subsection id="id8C506231760C48ACB06EAC6F9CF62B37"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, to increase the supply of canine teams for use by the TSA and aviation stakeholders, the Administrator shall develop and issue standards that a third party explosives detection canine team must satisfy to be certified for the screening of individuals and property, including detection of explosive vapors among individuals and articles of property, in public areas of an airport under section 44901 of title 49, United States Code.</text>
</subsection><subsection id="idA0C711BE768B476485ECE6C83A536A17"><enum>(b)</enum><header>Agreement</header><text>Subject to subsections (c), (d), and (e), not later than 180 days after the date of enactment of this Act, the Administrator shall enter into an agreement with at least 1 third party entity to test and certify the capabilities of canine teams in accordance with the standards under subsection (a).</text>
</subsection><subsection id="id127436676BE341D9BACC8F7E7CF9FF52"><enum>(c)</enum><header>Expedited deployment</header><text>In entering into an agreement under subsection (b), the Secretary shall use—</text> <paragraph id="id135720A3577B476398E99356878346BB"><enum>(1)</enum><text>the other transaction authority under section 114(m) of title 49, United States Code; or</text>
</paragraph><paragraph id="idDE4BBA0D09634EE5B56E355DB886E7DB"><enum>(2)</enum><text>such other authority of the Secretary as the Secretary considers appropriate to expedite the deployment of additional canine teams.</text>
</paragraph></subsection><subsection id="id0951DA4C29D441FA97AB9E99BE0AC90D"><enum>(d)</enum><header>Process</header><text>Before entering into an agreement under subsection (b), the Administrator shall—</text> <paragraph id="idA95621A1705044968F38C666F8AB9EDC"><enum>(1)</enum><text>evaluate and verify a third party entity’s ability to effectively evaluate the capabilities of canine teams;</text>
</paragraph><paragraph id="idF1CD7F24CEF2459E878F0459AFE0E33D"><enum>(2)</enum><text>designate at least 3 evaluation centers to which vendors may send canine teams for testing and certification by the third party entity; and</text>
</paragraph><paragraph id="idE63264B6DDB845A7B5AAC46713AABC55"><enum>(3)</enum><text>periodically assess the program at evaluation centers to ensure the proficiency of the canine team beyond the initial testing and certification by the third party entity.</text>
</paragraph></subsection><subsection id="id9403662CD7944CD2BA4302C4C2BCDF55"><enum>(e)</enum><header>Consultation</header><text>To determine best practices for the use of third party entities to test and certify the capabilities of canine teams, the Administrator shall consult with the following entities before entering into an agreement under subsection (b):</text>
<paragraph id="id947B2A2E9FAD4F3A99624730E6AA60E5"><enum>(1)</enum><text>The Secretary of State.</text> </paragraph><paragraph id="id7088E02B23A9442FA7BD1BF5FA05335C"><enum>(2)</enum><text>Non-profit organizations that train, certify, and provide the services of canines for various purposes.</text>
</paragraph></subsection><subsection id="id3A49638828804B9D89531B2EE0D7E722"><enum>(f)</enum><header>Oversight</header><text>The Administrator shall establish a process to ensure appropriate oversight of the certification program and compliance with the standards under subsection (a), including periodic audits of participating third party entities.</text>
</subsection><subsection id="id18a225507cde498fbfcaa374311ff57b"><enum>(g)</enum><header>Authorization</header>
<paragraph id="idE3EB04E7CD6B49C29FD2A57CC98EB769"><enum>(1)</enum><header>TSA</header><text>The Administrator shall develop and implement a process for the TSA to procure third party explosives detection canine teams certified under this section.</text>
</paragraph><paragraph id="id6df83d7c462c4c0ba6eac4954f2b3ab6"><enum>(2)</enum><header>Aviation stakeholders</header>
<subparagraph id="idBEE6CF74B6A64D2CBB5006285437C923"><enum>(A)</enum><header>In general</header><text>The Administrator shall authorize an aviation stakeholder, under the oversight of and in coordination with the Federal Security Director at an applicable airport, to contract with, procure or purchase, and deploy one or more third party explosives detection canine teams certified under this section to augment public area security at that airport.</text>
</subparagraph><subparagraph id="idb2b1bec49dcc4db4b5582a28c6ae4bf8"><enum>(B)</enum><header>Applicable large hub airports</header><text>Notwithstanding any law to the contrary and subject to the other provisions of this paragraph, an applicable large hub airport may provide a certified canine contracted with, or procured or purchased under subparagraph (A) on an in-kind basis to the TSA to be deployed as a passenger screening canine at that airport unless the applicable large hub airport consents to the use of that certified canine elsewhere.</text>
</subparagraph><subparagraph id="id2eea109fe334471186176f981dfdf98e"><enum>(C)</enum><header>Handlers</header><text>Not later than 30 days before an applicable large hub airport begins training a canine under subparagraph (B), the airport shall notify the TSA of such training and the Administrator shall assign a TSA canine handler to participate in the training with that canine, as appropriate.</text>
</subparagraph><subparagraph id="id6431e8135bc7405999e76179fcd3da12"><enum>(D)</enum><header>Limitation</header><text>The Administrator may not reduce the staffing allocation model for an applicable large hub airport based on that airport's participation in canine testing and certification under this paragraph.</text>
</subparagraph></paragraph></subsection><subsection id="id66BB3B871BC24F988F47DEBE64FBF8BE"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id12371697D432437993D124BD1FFCF318"><enum>(1)</enum><header>Applicable large hub airport</header><text>The term <term>applicable large hub airport</term> means a large hub airport (as defined in section 40102 of title 49, United States Code) that has less than 100 percent of the allocated passenger screening canine teams staffed by the TSA.</text>
</paragraph><paragraph id="id05B2B61FD1F746308DE4CFDC4F45AA7B"><enum>(2)</enum><header>Aviation stakeholder</header><text>The term <term>aviation stakeholder</term> includes an airport, airport operator, and air carrier.</text> </paragraph></subsection></section><section id="id7135C11855044418AFC041E02208B931"><enum>222.</enum><header>Tracking and monitoring of canine training and testing</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall use, to the extent practicable, a digital monitoring system for all training, testing, and validation or certification of public and private canine assets utilized by the TSA to facilitate improved review, data analysis, and record keeping of canine testing performance and program administration.</text>
</section><section id="id45E9EB3EE4564DA594453457EAA3D9A0"><enum>223.</enum><header>VIPR team statistics</header>
<subsection id="id9543702545994B3AA36FB311EC82C423"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, and annually thereafter, the Administrator shall notify the appropriate committees of Congress of the number of VIPR teams available for deployment at transportation facilities, including—</text>
<paragraph id="id92D39CEFEBC44DF7B36F2279C3C2759D"><enum>(1)</enum><text>the number of VIPR team operations that include explosive detection canine teams; and</text> </paragraph><paragraph id="id641949CEEB99464AA588EFAFF2831890"><enum>(2)</enum><text>the distribution of VIPR team operations deployed across different modes of transportation.</text>
</paragraph></subsection><subsection id="id8A54033EBE704D49BC5DB1F25D21EE66"><enum>(b)</enum><header>Annex</header><text>The notification under subsection (a) may contain a classified annex.</text> </subsection><subsection id="id7D3D1DDD060F4BE7AC6A88D14ACF598D"><enum>(c)</enum><header>Definition of VIPR team</header><text>In this section, the term <term>VIPR</term> means a Visible Intermodal Prevention and Response team authorized under section 1303 of the National Transit Systems Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1112">6 U.S.C. 1112</external-xref>).</text>
</subsection></section><section id="id5C1C428DF669437CAC79EDC8400B9302"><enum>224.</enum><header>Public area best practices</header>
<subsection id="id9889009131854EEAB50CAA5B7F42152F"><enum>(a)</enum><header>In general</header><text>The Administrator shall, in accordance with law and as received or developed, periodically submit to Federal Security Directors and appropriate aviation security stakeholders information on any best practices developed by the TSA or appropriate aviation stakeholders related to protecting aviation infrastructure from emerging threats to public spaces of transportation venues.</text>
</subsection><subsection id="idC1442405F5FC4B6F9F75994791A2B407"><enum>(b)</enum><header>Information sharing</header><text>The Administrator shall, in accordance with law—</text> <paragraph id="id0E8F7A7188424B488ED9D8511085C136"><enum>(1)</enum><text>in coordination with the Office of the Director of National Intelligence and industry partners, implement improvements to the Air Domain Intelligence and Analysis Center to encourage increased participation from aviation stakeholders and enhance government and industry aviation security information sharing on aviation security threats, including on cybersecurity threat awareness; and</text>
</paragraph><paragraph id="id1221B9738E6648D99BA86B0A532888AF"><enum>(2)</enum><text>expand and improve the City and Airport Threat Assessment or similar program to public and private aviation stakeholders to capture, quantify, communicate, and apply applicable intelligence to inform airport mitigation measures, such as—</text>
<subparagraph id="idFF15557021D1414081AB6920A8FFA481"><enum>(A)</enum><text>quantifying levels of risk by airport that can be used to determine risk-based security mitigation measures at each location;</text>
</subparagraph><subparagraph id="id8C28665F65304DB483F300D88B7DEF03"><enum>(B)</enum><text>determining random and surge employee inspection operations based on changing levels of risk; and</text> </subparagraph><subparagraph id="id63B73089CF194EECB6B1AE7B1E5C71DE"><enum>(C)</enum><text>targeting any high-risk employee groups and specific points of risk within the airport perimeter for such mitigation measures as random inspections;</text>
</subparagraph></paragraph><paragraph id="idEAFD067074754265A0A70E0BB7E0EF2C"><enum>(3)</enum><text>continue to disseminate Transportation Intelligence Notes, tear-lines, and related intelligence products to appropriate transportation security stakeholders on a regular basis; and</text>
</paragraph><paragraph id="idA1915090C6E7487CB448842CE673C40C"><enum>(4)</enum><text>continue to conduct both regular routine and threat-specific classified briefings between the TSA and appropriate aviation and other transportation sector stakeholders on an individual or group basis to provide greater information sharing between public and private sectors.</text>
</paragraph></subsection><subsection id="id8482DA8FDEE446BE951D032F21B7F3DA"><enum>(c)</enum><header>Mass notification</header><text>The Administrator shall encourage aviation security stakeholders to utilize mass notification systems, including the Integrated Public Alert Warning System of the Federal Emergency Management Agency and social media platforms, to disseminate information to transportation community employees, travelers, and the general public, as appropriate.</text>
</subsection><subsection id="idD0162C1B431D4CC99F7BAD8660553FD5"><enum>(d)</enum><header>Public awareness programs</header><text>The Secretary of Homeland Security, in coordination with the Administrator, shall expand public programs of the Department and the TSA that increase security threat awareness, education, and training to include transportation network public area employees, including airport and transportation vendors, local hotels, cab and limousine companies, ridesharing companies, cleaning companies, gas station attendants, cargo operators, and general aviation members.</text>
</subsection><subsection id="idA013C8DF1C514FA39A95B6B81FBA3747"><enum>(e)</enum><header>Aviation employee vetting</header><text>The Administrator shall allow an air carrier, airport, or airport operator, in addition to any background check required for initial employment, to utilize the Federal Bureau of Investigation's Rap Back Service and other vetting tools as appropriate, including the No-Fly and Selectee lists, to get immediate notification of any criminal activity relating to an employee with access to an airport or its perimeter, regardless of whether the employee is seeking access to a public or secured area of the airport.</text>
</subsection></section><section id="id5F417658BF1B48A69C08DDBC4EDD7BB0"><enum>225.</enum><header>Law Enforcement Officer Reimbursement
Program</header>
<subsection id="id56C386C1A849432B8281491AC174C5E7"><enum>(a)</enum><header>In general</header><text>In accordance with section 44903(c)(1) of title 49, United States Code, the Administrator shall increase the number of awards, and the total funding amount of each award, under the Law Enforcement Officer Reimbursement Program—</text>
<paragraph id="idE0678A107EDE4E3CB6CCEE00E8AA7FBE"><enum>(1)</enum><text>to increase the presence of law enforcement officers in the public areas of airports, including baggage claim, ticket counters, and nearby roads;</text>
</paragraph><paragraph id="id6FCD75FA42EE40E2B02F7C708E3D4805"><enum>(2)</enum><text>to increase the presence of law enforcement officers at screening checkpoints;</text> </paragraph><paragraph id="idDC5265F670864C6699AF2D7A1365BC7F"><enum>(3)</enum><text>to reduce the response times of law enforcement officers during security incidents; and</text>
</paragraph><paragraph id="id003E12F4C5DD4D6EADEA7630AA813F8B"><enum>(4)</enum><text>to provide visible deterrents to potential terrorists.</text> </paragraph></subsection><subsection id="id8976A8A8503B44759866564077C9AE1C"><enum>(b)</enum><header>Cooperation by Administrator</header><text>In carrying out subsection (a), the Administrator shall use the authority provided to the Administrator under section 114(m) of title 49, United States Code, that is the same authority as is provided to the Administrator of the Federal Aviation Administration under section 106(m) of that title.</text>
</subsection><subsection id="idAC24FEC0AE1149B0BF4ADA4AB04CCE3C"><enum>(c)</enum><header>Administrative burdens</header><text>The Administrator shall review the regulations and compliance policies related to the Law Enforcement Officer Reimbursement Program and, if necessary, revise such regulations and policies to reduce any administrative burdens on applicants or recipients of such awards.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id59038AFD5AA54D678F7D167E695043A5"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out section 44901(h) of title 49, United States Code, $55,000,000 for each of fiscal years 2018 through 2020.</text>
</subsection></section></subtitle><subtitle id="idFE7BD5B586B048CC9C6811A44C17E4B2" style="OLC"><enum>C<?LEXA-Enum C?></enum><header>Passenger and cargo security</header>
<section id="id91A3195089C24D4B9BDFCC31AA650A1D"><enum>231.</enum><header>PreCheck Program</header>
<subsection id="idB242889EF7CD45ECA67A6949EC94281E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 44919 is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="id30F53A799E3D478E9262B7123EC9F029" style="USC">
<section id="id4E8E01453D7F42B7BA7C59D3B398308B"><enum>44919.</enum><header>PreCheck Program</header>
<subsection id="id06AD37017E914DE080806BB218EF7157"><enum>(a)</enum><header>In general</header><text>The Administrator of the Transportation Security Administration shall continue to administer the PreCheck Program in accordance with section 109(a)(3) of the Aviation and Transportation Security Act (<external-xref legal-doc="usc" parsable-cite="usc/49/114">49 U.S.C. 114</external-xref> note).</text>
</subsection><subsection id="idF2E247CE81134C5A9C8FC6DAB019B127"><enum>(b)</enum><header>Expansion</header><text>Not later than 180 days after the date of enactment of the <short-title>TSA Modernization Act</short-title>, the Administrator shall enter into an agreement, using other transaction authority under section 114(m) of this title, with at least 2 private sector entities to increase the methods and capabilities available for the public to enroll in the PreCheck Program.</text>
</subsection><subsection id="id92D3C0AE23A7445096A8814A653EA4D1"><enum>(c)</enum><header>Minimum capability requirements</header><text>At least 1 agreement under subsection (b) shall include the following capabilities:</text>
<paragraph id="id3DFD11289D5C4F368EFE05FBE02EDF01"><enum>(1)</enum><text>Start-to-finish secure online or mobile enrollment capability.</text> </paragraph><paragraph id="idF66775238A254680B6A069226FFBAACC"><enum>(2)</enum><text>Vetting of an applicant by means other than biometrics, such as a risk assessment, if—</text>
<subparagraph id="id8E3E5B1911EF436DA0876988BD7D322F"><enum>(A)</enum><text>such means—</text> <clause id="idAA0F036317A54556945E7C7E19C0141A"><enum>(i)</enum><text>are evaluated and certified by the Secretary of Homeland Security;</text>
</clause><clause id="id75375634A1CF47389D3B983233FFE090"><enum>(ii)</enum><text>meet the definition of a qualified anti-terrorism technology under section 865 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/444">6 U.S.C. 444</external-xref>); or</text>
</clause><clause id="id71F875373E04410EACDFD4C911364390"><enum>(iii)</enum><text>are determined by the Administrator to provide a risk assessment that is as effective as a fingerprint-based criminal history records check conducted through the Federal Bureau of Investigation with respect to identifying individuals who are not qualified to participate in the PreCheck Program due to disqualifying criminal history; and</text>
</clause></subparagraph><subparagraph id="idC8547AB0070B4EAFB231FFAFF3C992FC"><enum>(B)</enum><text>with regard to private sector risk assessments, the Secretary has certified that reasonable procedures are in place with regard to the accuracy, relevancy, and proper utilization of information employed in such risk assessments.</text>
</subparagraph></paragraph></subsection><subsection id="idD1A8FD9D8E564D20BC6EF05ECD0A22A7"><enum>(d)</enum><header>Additional capability requirements</header><text>At least 1 agreement under subsection (b) shall include the following capabilities:</text> <paragraph id="id634D0D10A98944F9BA93302F5C2AA1FA"><enum>(1)</enum><text>Start-to-finish secure online or mobile enrollment capability.</text>
</paragraph><paragraph id="id03DD824E7430478AA8DC8725CA16F74D"><enum>(2)</enum><text>Vetting of an applicant by means of biometrics if the collection—</text> <subparagraph id="idE5512E26BC814C2989C7276847A68988"><enum>(A)</enum><text>is comparable with the appropriate and applicable standards developed by the National Institute of Standards and Technology; and</text>
</subparagraph><subparagraph id="id940622c35b2d4c58b1209c47d2fee2e8"><enum>(B)</enum><text>protects privacy and data security, including that any personally identifiable information is collected, retained, used, and shared in a manner consistent with section 552a of title 5, United States Code (commonly known as <quote>Privacy Act of 1974</quote>), and with agency regulations.</text>
</subparagraph></paragraph></subsection><subsection id="id48E80F7D0B084092B1CAD5F377FA7449"><enum>(e)</enum><header>Target enrollment</header><text>Subject to subsections (b), (c), and (d), the Administrator shall take actions to expand the total number of individuals enrolled in the PreCheck Program as follows:</text>
<paragraph id="id65CBB2944C804594ACF5D7EEF33B46F9"><enum>(1)</enum><text>7,000,000 passengers before October 1, 2018.</text> </paragraph><paragraph id="idF460B73657794B2B892A55BFC9264B1D"><enum>(2)</enum><text>10,000,000 passengers before October 1, 2019.</text>
</paragraph><paragraph id="id35DF8829456E4570826EC5E530198208"><enum>(3)</enum><text>15,000,000 passengers before October 1, 2020.</text> </paragraph></subsection><subsection id="id0b747bb513584443aa7d78fe1336a9db"><enum>(f)</enum><header>Marketing of PreCheck Program</header><text>Not later than 90 days after the date of enactment of the <short-title>TSA Modernization Act</short-title>, the Administrator shall—</text>
<paragraph id="id902a312ef27a4e62a2e29db3e40f27bf"><enum>(1)</enum><text>enter into at least 2 agreements, using other transaction authority under section 114(m) of this title, to market the PreCheck Program; and</text>
</paragraph><paragraph id="id5199901ce8114e2ab8ccdb78b50bcab4"><enum>(2)</enum><text>implement a long-term strategy for partnering with the private sector to encourage enrollment in such program.</text>
</paragraph></subsection><subsection id="idf7c825196ac242a892e90f55dbd280fa"><enum>(g)</enum><header>Identity verification enhancement</header><text>The Administrator shall—</text> <paragraph id="id6c70d1404dee472fa93fe2ceaf7ccbdd"><enum>(1)</enum><text>coordinate with the heads of appropriate components of the Department to leverage Department-held data and technologies to verify the identity and citizenship of individuals enrolling in the PreCheck Program;</text>
</paragraph><paragraph id="id5ca63022d1c04faa9ee237cb167087c3"><enum>(2)</enum><text>partner with the private sector to use biometrics and authentication standards, such as relevant standards developed by the National Institute of Standards and Technology, to facilitate enrollment in the program; and</text>
</paragraph><paragraph id="idac50741af4a04c9891ddb6f6fd3e4296"><enum>(3)</enum><text>consider leveraging the existing resources and abilities of airports to collect fingerprints for use in background checks to expedite identity verification.</text>
</paragraph></subsection><subsection id="id07bf7f794e564a03af9d421e24740224"><enum>(h)</enum><header>PreCheck Program lanes operation</header><text>The Administrator shall—</text> <paragraph id="id196b1d4f110b45b497a7f0a8a965ada2"><enum>(1)</enum><text>ensure that PreCheck Program screening lanes are open and available during peak and high-volume travel times at appropriate airports to individuals enrolled in the PreCheck Program; and</text>
</paragraph><paragraph id="id17465015e9ca42c2b77a8e2a0e69ac0d"><enum>(2)</enum><text>make every practicable effort to provide expedited screening at standard screening lanes during times when PreCheck Program screening lanes are closed to individuals enrolled in the program in order to maintain operational efficiency.</text>
</paragraph></subsection><subsection id="id7e42c48fb0d842b0bac4752ca4b170b7"><enum>(i)</enum><header>Vetting for PreCheck Program participants</header><text>The Administrator shall initiate an assessment to identify any security vulnerabilities in the vetting process for the PreCheck Program, including determining whether subjecting PreCheck Program participants to recurrent fingerprint-based criminal history records checks, in addition to recurrent checks against the terrorist watchlist, could be done in a cost-effective manner to strengthen the security of the PreCheck Program.</text>
</subsection><subsection id="idAB3A82B4BDE84B0C81E066477227CE6D"><enum>(j)</enum><header>Assurance of separate program</header><text>In carrying out this section, the Administrator shall ensure that the PreCheck program enrollment capabilities, including the additional private sector application capabilities under subsections (b), (c), and (d), are separate from any other related TSA program, initiative, or procurement, including the Universal Enrollment Services program.</text>
</subsection><subsection id="id6863B4D965D149C18D2DDDB71AA17BA1"><enum>(k)</enum><header>Expenditure of funds</header><text>Any Federal funds expended by the Administrator to expand PreCheck Program enrollment shall be expended in a manner that meets the requirements of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="idE1022A02030C4346984B6D2DE95BF0D8"><enum>(b)</enum><header>Technical and conforming amendments</header>
<paragraph id="idB703CDDF5E5642FEA6B26C809093E625"><enum>(1)</enum><header>Repeal</header><text>Subtitle A of title III of the FAA Extension, Safety, and Security Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/49/44901">49 U.S.C. 44901</external-xref> note) and the items relating to that subtitle in the table of contents of that Act are repealed.</text>
</paragraph><paragraph id="id44E3D68B90144FA7A725A8566D192F44"><enum>(2)</enum><header>Table of contents</header><text>The table of contents of chapter 449 is amended by amending the item relating to section 44919 to read as follows:</text>

</paragraph><paragraph id="id1AEB9A3A1AB1449195BEBB53F1AAA561"><enum>(3)</enum><header>Screening passengers and property</header><text>Section 44901(a) is amended by striking <quote>44919 or</quote>.</text> </paragraph></subsection></section><section id="id38084743E81647AB959F6E57F4A17866"><enum>232.</enum><header>Trusted traveler programs; collaboration</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Commissioner of U.S. Customs and Border Protection, shall—</text>
<paragraph id="id32FA1D4207E341B2BDC08D27AD4981FE"><enum>(1)</enum><text>review each trusted traveler program administered by U.S. Customs and Border Protection and the PreCheck Program;</text>
</paragraph><paragraph id="idAFBCC9A5E63749CDA61058A13790B81C"><enum>(2)</enum><text>identify any improvements that can be made to such programs—</text> <subparagraph id="id2983EFB11F3440E1B95B5C740E02C550"><enum>(A)</enum><text>to streamline and integrate the requirements and operations of such programs to reduce administrative burdens, including applications for inclusion and determining whether a valid credential can satisfy the requirements for another credential;</text>
</subparagraph><subparagraph id="idCF6FA7396FE94D5185BD7868DA407536"><enum>(B)</enum><text>to increase information and data sharing across such programs; and</text> </subparagraph><subparagraph id="id4976FC50C1484EDDB3AD15319B1D2E62"><enum>(C)</enum><text>to allow the public to access and link to the applications for enrollment in all of such programs from 1 online portal;</text>
</subparagraph></paragraph><paragraph id="idB152C183302D4215B529B2E8AA8A606B"><enum>(3)</enum><text>identify any law, including regulations, policy, or procedure that may unnecessarily inhibit collaboration among Department of Homeland Security agencies regarding such programs or implementation of the improvements identified under paragraph (2);</text>
</paragraph><paragraph id="idDC5F5A9EE26046C6A52CA3FDE7219E29"><enum>(4)</enum><text>recommend any legislative, administrative, or other actions that can be taken to eliminate any unnecessary barriers to collaboration or implementation identified in paragraph (3); and</text>
</paragraph><paragraph id="id08F88AC65D914EA092BFE45C975E76BE"><enum>(5)</enum><text>submit to the appropriate committees of Congress a report on the review, including any unnecessary barriers to collaboration or implementation identified under paragraph (3), and any recommendations under paragraph (4).</text>
</paragraph></section><section id="id956F46ED49BE49BF8959191215608AD6"><enum>233.</enum><header>Passenger security fee</header><text display-inline="no-display-inline">Section 44940(c) is amended by adding at the end the following:</text>

<paragraph commented="no" id="id685350C0A402418FA7D3821402ABD799"><enum>(3)</enum><header>Offsetting collections</header><text>Beginning on October 1, 2025, fees collected under subsection (a)(1) for any fiscal year shall be credited as offsetting collections to appropriations made for aviation security measures carried out by the Transportation Security Administration, to remain available until expended.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="idF04F31AC054E4696B1D4BF1638BA2578"><enum>234.</enum><header>Third party canine teams for air cargo security</header><text display-inline="no-display-inline">Section 1307 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1116">6 U.S.C. 1116</external-xref>) is amended by adding at the end the following:</text>

<subsection id="id57C07A75A8CA474599FE8A12219D308E"><enum>(h)</enum><header>Third party canine teams for air cargo security</header>
<paragraph id="id0801AB7E40574CFEB3E80381699C2451"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In order to enhance the screening of air cargo and ensure that third party explosives detection canine assets are leveraged for such purpose, the Administrator shall, not later than 180 days after the date of enactment of the <short-title>TSA Modernization Act</short-title>—</text>
<subparagraph id="id80EB58C84C5A4C958A6B2DCB022106C5"><enum>(A)</enum><text display-inline="yes-display-inline">develop and issue standards for the use of such third party explosives detection canine assets for the primary screening of air cargo;</text>
</subparagraph><subparagraph id="id8E4479AC36044D6AB14D2D9762D51186"><enum>(B)</enum><text display-inline="yes-display-inline">develop a process to identify qualified non-Federal entities that will certify canine assets that meet the standards established by the Administrator under subparagraph (A);</text>
</subparagraph><subparagraph id="id3CD94456BC7441548F6F406552958F4A"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that entities qualified to certify canine assets shall be independent from entities that will train and provide canines to end users of such canine assets;</text>
</subparagraph><subparagraph id="id77CA7587C4024A1791B88369212CB03B"><enum>(D)</enum><text display-inline="yes-display-inline">establish a system of Transportation Security Administration audits of the process developed under subparagraph (B); and</text>
</subparagraph><subparagraph id="id16392697A61E40C5B0AB53BC7152B3C8"><enum>(E)</enum><text display-inline="yes-display-inline">provide that canines certified for the primary screening of air cargo can be used by air carriers, foreign air carriers, freight forwarders, and shippers.</text>
</subparagraph></paragraph><paragraph id="id1D067B1CE5A84AB38AFD3EF440A7FE15"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">Beginning on the date that the development of the process under paragraph (1)(B) is complete, the Administrator shall—</text>
<subparagraph id="id6213BB767166467890F0382CC7570345"><enum>(A)</enum><text display-inline="yes-display-inline">facilitate the deployment of such assets that meet the certification standards of the Administration, as determined by the Administrator;</text>
</subparagraph><subparagraph id="id226FF6A53D4A40C1A473560FDD374838"><enum>(B)</enum><text display-inline="yes-display-inline">make such standards available to vendors seeking to train and deploy third party explosives detection canine assets; and</text>
</subparagraph><subparagraph id="id7852D5B39F7D4478BCB69CAC1021525E"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that all costs for the training and certification of canines, and for the use of supplied canines, are borne by private industry and not the Federal Government.</text>
</subparagraph></paragraph><paragraph id="idD00418D875D8435194ACDB536ECCE39F"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="idEA4CD8C9E3E848B9B65ED552DEA51A15"><enum>(A)</enum><header>Air carrier</header><text display-inline="yes-display-inline">The term <term>air carrier</term> has the meaning given the term in section 40102 of title 49, United States Code.</text>
</subparagraph><subparagraph id="id570BDDD78F4E4772A3435066FCDFB515"><enum>(B)</enum><header>Foreign air carrier</header><text display-inline="yes-display-inline">The term <term>foreign air carrier</term> has the meaning given the term in section 40102 of title 49, United States Code.</text> </subparagraph><subparagraph id="idBCEF33656F6F428AB794F4A28D481691"><enum>(C)</enum><header>Third party explosives detection canine asset</header><text display-inline="yes-display-inline">The term <term>third party explosives detection canine asset</term> means any explosives detection canine or handler not owned or employed, respectively, by the Transportation Security Administration.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="id089f68e2fb3a419889e7db894d13514d"><enum>235.</enum><header>Known Shipper Program review</header><text display-inline="no-display-inline">The Administrator shall direct the Air Cargo Subcommittee of ASAC—</text> <paragraph id="idAFC27A012F7C45E3AF86B2FEA104C742"><enum>(1)</enum><text display-inline="yes-display-inline">to conduct a comprehensive review and security assessment of the Known Shipper Program;</text>
</paragraph><paragraph id="id3E170A1180AF45ACB5CF08FA69790EF0"><enum>(2)</enum><text display-inline="yes-display-inline">to recommend whether the Known Shipper Program should be modified or eliminated considering the full implementation of 100 percent screening under section 44901(g) of title 49, United States Code; and</text>
</paragraph><paragraph id="idB1DC1CAB25514E40AB0A29BB5734E1EF"><enum>(3)</enum><text>to report its findings and recommendations to the Administrator.</text> </paragraph></section><section id="id90ab8ab3b7ce4834a40dfeee8e51e898"><enum>236.</enum><header>Screening partnership program updates</header> <subsection id="id0c13f288787448d88b0486087a07c0d0"><enum>(a)</enum><header>Security Screening Opt-Out Program</header><text>Section 44920 is amended—</text>
<paragraph id="idcdce356ab6be4fafb1ceacdd25dae1b5"><enum>(1)</enum><text>in the heading by striking <quote><header-in-text level="section" style="USC">Security screening opt-out program</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Screening partnership program</header-in-text></quote>;</text> </paragraph><paragraph id="id6b5864ea78634be28b30e4b133acd304"><enum>(2)</enum><text>by amending subsection (a) to read as follows:</text>

</paragraph><paragraph id="id5536c82334ea4af89742c7a1e6c6f1e8"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph id="idC885936C57AC41B59B8FED50395B2E48"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>

</clause></subparagraph><subparagraph id="idD38C8361AB794DF3A7A1482B953D01A8"><enum>(D)</enum><text>in paragraph (2), as redesignated—</text> <clause id="id9CA662ADE4B047D884808F49CA434A7C"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon;</text>

</subparagraph></paragraph><paragraph id="idaeb345267734453ca3c7f2ae22ade78a"><enum>(6)</enum><text>in subsection (f)—</text> <subparagraph id="id1534D888CF7F4B8C909254A06EE2A705"><enum>(A)</enum><text>in the heading, by inserting <quote><header-in-text level="subsection" style="USC">or suspension</header-in-text></quote>;</text>
</subparagraph><subparagraph id="id6269AA994D28432B82F0DC1FAE5FEB84"><enum>(B)</enum><text>by striking <quote>terminate</quote> and inserting <quote>suspend or terminate, as appropriate,</quote>; and</text> </subparagraph><subparagraph id="id58CCB4B80DA442779821A14A49F9C8EA"><enum>(C)</enum><text>by striking <quote>Under Secretary</quote> each place it appears and inserting <quote>Administrator</quote>; and</text>
</subparagraph></paragraph><paragraph id="id22b4aaa7328345138e74d61e47c5fa49"><enum>(7)</enum><text>by striking subsection (h).</text> </paragraph></subsection><subsection id="id73B25632388D44858AA62A6E4052B90E"><enum>(b)</enum><header>Applications submitted before the date of enactment</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall approve or deny, in accordance with section 44920(b) of title 49, United States Code, as amended by this Act, each application submitted before the date of enactment of this Act, by an airport operator under subsection (a) of that section, that is awaiting such a determination.</text>
</subsection></section><section id="idf7ab2f40989844caacd57e7bacbb1624"><enum>237.</enum><header>Screening performance assessments</header><text display-inline="no-display-inline">Subject to part 1520 of title 49, Code of Federal Regulations, the Administrator shall quarterly make available to the airport director of an airport—</text>
<paragraph id="id8199453F30BA479FAF851053946A5DF8"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the screening performance of that airport compared to the mean average performance of all airports in the equivalent airport category for screening performance data; and</text>
</paragraph><paragraph id="id6BFE56B35E484CD4957E45611ED1D963"><enum>(2)</enum><text>a quarterly briefing on the results of performance data reports, including—</text> <subparagraph id="idbdc679a5cbc94bb58a2da7244eeca44e"><enum>(A)</enum><text>a scorecard of objective metrics developed by the Office of Security Operations to measure screening performance, such as results of annual proficiency reviews and covert testing, at the appropriate level of classification; and</text>
</subparagraph><subparagraph id="idcd49d8cc8e4d49c6a6b6d1a76d56b2b8"><enum>(B)</enum><text>other performance data, including—</text> <clause id="idc03c06b6a16941d8aa051e678d17042c"><enum>(i)</enum><text>passenger throughput;</text>
</clause><clause id="id1f3409a640d647e39c187fd6d00a9dec"><enum>(ii)</enum><text>wait times; and</text> </clause><clause id="id2919e79f8ea7440f8790d902eda2277e"><enum>(iii)</enum><text>employee attrition, absenteeism, injury rates, and any other human capital measures collected by TSA.</text>
</clause></subparagraph></paragraph></section><section id="id3e2719a584c64f53abc658d6c8cfc947"><enum>238.</enum><header>TSA Academy review</header>
<subsection id="id3AD0EF67DCC94BB4A43AE614E06FA0E4"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Comptroller General of the United States shall—</text>
<paragraph id="id00F2355D815B40CBAC25D2D54F7D3273"><enum>(1)</enum><text>conduct an assessment of the efficiency and effectiveness of the new-hire TSA Academy at training airport security personnel compared to when such training of transportation security officers was conducted at local airports; and</text>
</paragraph><paragraph id="id5A7F064369B744E4B6BF1E038C6EC7CA"><enum>(2)</enum><text>submit to the appropriate committees of Congress a report on the findings of the assessment and any recommendations to maximize the efficiency and effectiveness of training for airport security personnel.</text>
</paragraph></subsection><subsection id="idDCA839A96CEC4DE3BB8DD8EF2DA2E89A"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The assessment shall—</text> <paragraph id="id62584829209649d1930b28013447d0dc"><enum>(1)</enum><text>include a cost-benefit analysis of training new Transportation Security Officer and Screening Partnership Program contractor hires at the TSA Academy compared to when such training of transportation security officers was conducted at local airports;</text>
</paragraph><paragraph id="id9da8cf4ecb2e4a239e7509f029115f03"><enum>(2)</enum><text>examine the impact on performance, professionalism, and retention rates of Transportation Security Officer and Screening Partnership Program contractor employees since the new training protocols at the TSA Academy have been put in place compared to when training was conducted at local airports; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a2e1fe71201426db367ef2735c35848"><enum>(3)</enum><text>examine whether new hire training at the TSA Academy has had any impact on the airports and companies that participate in the Screening Partnership Program.</text>
</paragraph></subsection></section></subtitle><subtitle id="idA2F0BC03AEC240AA8F880ADAB1909494" style="OLC"><enum>D</enum><header>Foreign airport security</header>
<section id="id26058ff02dac4cbaa32bfab7e8f6f039"><enum>241.</enum><header>Last point of departure airports; security
directives</header>
<subsection id="ida0d6b0c503fd447bbd98a603f970f196"><enum>(a)</enum><header>Notice and consultation</header>
<paragraph id="id5D657D4868104E8499B3C90E8FD40F8B"><enum>(1)</enum><header>In general</header><text>The Administrator shall, to the maximum extent practicable, consult and notify the following stakeholders prior to making changes to security standards via security directives and emergency amendments for last points of departure:</text>
<subparagraph id="idaac66b56be2046fbb1d0848022aba85a"><enum>(A)</enum><text>Trade association representatives, for affected air carriers and airports, who hold the appropriate security clearances.</text>
</subparagraph><subparagraph id="id06ebee720f6642b98a7049d86ae5b4fc"><enum>(B)</enum><text>The head of each relevant Federal department or agency, including the Administrator of the Federal Aviation Administration.</text>
</subparagraph></paragraph><paragraph id="idC817961100514ECBB077F9DACD7D3E56"><enum>(2)</enum><header>Transmittal to Congress</header><text>Not later than 3 days after the date that the Administrator issues a security directive or emergency amendment for a last point of departure, the Administrator shall transmit to the appropriate committees of Congress a description of the extent to which the Administrator consulted and notified the stakeholders under paragraph (1).</text>
</paragraph></subsection><subsection id="id4D82251AA762461F93D8E1D71AA3BF0C"><enum>(b)</enum><header>GAO report</header>
<paragraph id="id9DA35530AF774B2588C14FC55EA4FD83"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall review the effectiveness of the TSA process to update, consolidate, or revoke security directives, emergency amendments, and other policies related to international aviation security at last point of departure airports and submit to the appropriate committees of Congress and the Administrator a report on the findings and recommendations.</text>
</paragraph><paragraph id="id973706E4FEC34F0EB60A1764BD968319"><enum>(2)</enum><header>Contents</header><text>In conducting the review under paragraph (1), the Comptroller General shall—</text> <subparagraph id="id041D46C4989A4CEAB5BD285E869C9242"><enum>(A)</enum><text>review current security directives, emergency amendments, and any other policies related to international aviation security at last point of departure airports;</text>
</subparagraph><subparagraph id="id64BF4EBDA07A406F906A745A74FA8141"><enum>(B)</enum><text>review the extent of intra-agency and interagency coordination, stakeholder outreach, coordination, and feedback; and</text>
</subparagraph><subparagraph id="id5615A4EEF47D4D27AC158D1ED966A21D"><enum>(C)</enum><text>recommend any updates, consolidation, or revocation of such security directives, emergency amendments, and policies.</text>
</subparagraph></paragraph></subsection><subsection id="id37a3dd6d93a1495f857c3ee883ecac46"><enum>(c)</enum><header>Rescreening</header><text>Subject to section 44901(d)(4)(c) of title 49, United States Code, upon discovery of specific threat intelligence, the Administrator shall immediately direct TSA personnel to rescreen passengers and baggage arriving from an airport outside the United States and identify enhanced measures that should be implemented at that airport.</text>
</subsection><subsection id="id4a9d8f98f577489ca1d5389473736a32"><enum>(d)</enum><header>Notification to Congress</header><text>Not later than 1 day after the date that the Administrator determines that a foreign air carrier is in violation of part 1546 of title 49, Code of Federal Regulations, or any other applicable security requirement, the Administrator shall notify the appropriate committees of Congress.</text>
</subsection></section><section id="idf34f87d613a642a8a50d86a2cc7bfc09"><enum>242.</enum><header>Tracking security screening equipment from last point of departure airports</header>
<subsection id="id064B09CB477E4EDFACD62CF7D427055A"><enum>(a)</enum><header>Donation of screening equipment To protect the United States</header><text>Chapter 449 is amended—</text> <paragraph id="idFF75743F2F50451FB59F02020B5F9D88"><enum>(1)</enum><text>in subchapter I, by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id5FA3DA02734E4635B76788684DF61C61" style="USC">
<section id="idA6BB042AAFE7462190F1E140A962926E"><enum>44929.</enum><header>Donation of screening equipment to protect the United States</header>
<subsection id="id594C2F19A2D24A0C8CE0D76C24BE77E6"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the Administrator is authorized to donate security screening equipment to a foreign last point of departure airport operator if such equipment can be reasonably expected to mitigate a specific vulnerability to the security of the United States or United States citizens.</text>
</subsection><subsection id="id94FD0D22AF8F4F7CA7D843B79B6184A9"><enum>(b)</enum><header>Conditions</header><text display-inline="yes-display-inline">Before donating any security screening equipment to a foreign last point of departure airport operator the Administrator shall—</text>
<paragraph id="idDBD93614A3124ADCAC42D8398CB1951C"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the screening equipment has been restored to commercially available settings;</text> </paragraph><paragraph id="id830C10CAEFA844458DA98AA710FDD86E"><enum>(2)</enum><text>ensure that no TSA-specific security standards or algorithms exist on the screening equipment; and</text>
</paragraph><paragraph id="id82088005A2A44BF1BF64FA9AF925E463"><enum>(3)</enum><text display-inline="yes-display-inline">verify that the appropriate officials have an adequate system—</text> <subparagraph id="idE7DEA7ADD70E455688E581B4E66892C0"><enum>(A)</enum><text display-inline="yes-display-inline">to properly maintain and operate the screening equipment; and</text>
</subparagraph><subparagraph id="idF335C735DAD8471FA624E776F598C8A4"><enum>(B)</enum><text display-inline="yes-display-inline">to document and track any removal or disposal of the screening equipment to ensure the screening equipment does not come into the possession of terrorists or otherwise pose a risk to security.</text>
</subparagraph></paragraph></subsection><subsection id="idF2937CE913C7417BB94ADF7EF025DBA8"><enum>(c)</enum><header>Reports</header><text>Not later than 30 days before any donation of security screening equipment under subsection (a), the Administrator shall provide to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name> and the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> a detailed written explanation of the following:</text>
<paragraph id="idF29FF93902E34DA785FAAE45DF13D8D8"><enum>(1)</enum><text>The specific vulnerability to the United States or United States citizens that will be mitigated by such donation.</text>
</paragraph><paragraph id="id17F75F6693304BD0B4D0914BDD427EA1"><enum>(2)</enum><text>An explanation as to why the recipient of such donation is unable or unwilling to purchase security screening equipment to mitigate such vulnerability.</text>
</paragraph><paragraph id="idD4CFA5563C854989842056A77B6C57DB"><enum>(3)</enum><text>An evacuation plan for sensitive technologies in case of emergency or instability in the country to which such donation is being made.</text>
</paragraph><paragraph id="id96FB372518DD4D69A4564B34C63731C7"><enum>(4)</enum><text>How the Administrator will ensure the security screening equipment that is being donated is used and maintained over the course of its life by the recipient.</text>
</paragraph><paragraph id="idA91D700A60194BAE8E73D9EAABD132B0"><enum>(5)</enum><text>The total dollar value of such donation.</text> </paragraph><paragraph id="idC2365F3C2F164228B8A43A60862591E0"><enum>(6)</enum><text>How the appropriate officials will document and track any removal or disposal of the screening equipment by the recipient to ensure the screening equipment does not come into the possession of terrorists or otherwise pose a risk to security.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block>
</paragraph><paragraph id="idDB27017EDE3742449842FF9481692301"><enum>(2)</enum><text>in the table of contents, by inserting after the item relating to section 44928 the following:</text> <quoted-block display-inline="no-display-inline" id="id23501421B314401188D071B52B646DFE" style="OLC"><toc><toc-entry bold="off" level="section">44929. Donation of screening equipment to protect the United States.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idD5A71611A84944CD9D6047DDFAF0E259"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 3204 of the Aviation Security Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/49/44901">49 U.S.C. 44901</external-xref> note) and the item relating to that section in the table of contents of that Act are repealed.</text>
</subsection><subsection id="id2128D60073B64483836F9B5762B79A94"><enum>(c)</enum><header>Raising international standards</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator shall collaborate with other aviation authorities and the United States Ambassador or the Charge d’Affaires to the United States Mission to the International Civil Aviation Organization, as applicable, to advance a global standard for each international airport to document and track the removal and disposal of any security screening equipment to ensure the screening equipment does not come into the possession of terrorists or otherwise pose a risk to security.</text>
</subsection></section><section id="id068cef84173045ddb9f09ed41ee8d3b4"><enum>243.</enum><header>International security standards</header>
<subsection id="id9436d42342d64e8cae72ddca7cd32268"><enum>(a)</enum><header>Notification</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator, in consultation with the United States Ambassador to the International Civil Aviation Organization, shall notify the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name> and the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Homeland Security </committee-name>and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> of proposed international improvements to aviation security.</text>
</subsection><subsection id="id1D23E70B5D57494EA8EEF0CE50F2167C"><enum>(b)</enum><header>Security enhancement proposals</header><text>Subject to subsection (a), the Administrator and Ambassador shall take such action at the International Civil Aviation Organization as the Administrator and Ambassador consider necessary to advance aviation security improvement proposals, including if practicable, introducing a resolution to raise minimum standards for aviation security.</text>
</subsection><subsection id="id0f018a2ae91a42df9ff888de74fc07d8"><enum>(c)</enum><header>Briefings to Congress</header><text>Beginning not later than 180 days after the date of enactment of this Act, and periodically thereafter, the Administrator, in consultation with the Ambassador, shall brief the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name> and the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Homeland Security</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> a report on the implementation of subsection (a).</text>
</subsection></section></subtitle><subtitle id="idA82FCA9FF8AC43A1802DCFDA76384E5A" style="OLC"><enum>E</enum><header>Cockpit and cabin security</header>
<section id="id52f405a8bf10499c8630588c201bd354"><enum>251.</enum><header>Federal air marshal service updates</header>
<subsection id="id81d437a15e4c4d1582b7a414e6d5bca3"><enum>(a)</enum><header>Standardization</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall develop a standard written agreement that shall be the basis of all negotiations and agreements that begin after the date of enactment of this Act between the United States and foreign governments or partners regarding the presence of Federal air marshals on flights to and from the United States, including deployment, technical assistance, and information sharing.</text>
</subsection><subsection id="id6a5be0e9a46240bfbc320177773c08fd"><enum>(b)</enum><header>Written agreements</header><text>Except as provided in subsection (c), not later than 180 days after the date of enactment of this Act, all agreements between the United States and foreign governments or partners regarding the presence of Federal air marshals on flights to and from the United States shall be in writing and signed by the Administrator or other authorized United States Government representative.</text>
</subsection><subsection id="idD314BDFD05574E93A5BB42890F1C82E0"><enum>(c)</enum><header>Exception</header><text>The Administrator may schedule Federal air marshal service on flights operating to a foreign country with which no written agreement is in effect if the Administrator determines that—</text>
<paragraph id="id1EDD71C3CBD244499682CE8D32A9A945"><enum>(1)</enum><text>such mission is necessary for aviation security; and</text> </paragraph><paragraph id="id996E076F465F463582ED25F75B009627"><enum>(2)</enum><text>the requirements of subsection (d)(2) are met.</text>
</paragraph></subsection><subsection id="id75a683df66bb46438abeace93725bd1c"><enum>(d)</enum><header>Notification to Congress</header>
<paragraph id="id44A604B9684948DEAF8E4AB3A31D9852"><enum>(1)</enum><header>Written agreements</header><text>Not later than 30 days after the date that the Administrator enters into a written agreement under this section, the Administrator shall transmit to the appropriate committees of Congress a copy of the agreement.</text>
</paragraph><paragraph id="id923C37FCDF42471EBAB1DE69DE6E1060"><enum>(2)</enum><header>No written agreements</header><text>The Administrator shall submit to the appropriate committees of Congress—</text>
<subparagraph id="id7D747AC057494E70B46D8E9A2E10F120"><enum>(A)</enum><text>not later than 30 days after the date of enactment of this Act, a list of each foreign government or partner that does not have a written agreement under this section, including an explanation for why no written agreement exists and a justification for the determination that such a mission is necessary for aviation security; and</text>
</subparagraph><subparagraph id="id524DB6B8AA3143BCA4518597CA624221"><enum>(B)</enum><text>not later than 30 days after the date that the Administrator makes a determination to schedule Federal air marshal service on flights operating to a foreign country with which no written agreement is in effect under subsection (c), the name of the applicable foreign government or partner, an explanation for why no written agreement exists, and a justification for the determination that such mission is necessary for aviation security.</text>
</subparagraph></paragraph></subsection><subsection id="id450b910da5be4b6e9d0eb0c394b979cd"><enum>(e)</enum><header>Mission scheduling automation</header><text>The Administrator shall endeavor to acquire automated capabilities or technologies for scheduling Federal air marshal service missions based on current risk modeling.</text>
</subsection></section><section id="id2676e8ebb11144d99fcc9cc841445437"><enum>252.</enum><header>Crew member self-defense training</header><text display-inline="no-display-inline">The Administrator, in consultation with the Administrator of the Federal Aviation Administration, shall continue to carry out and encourage increased participation by air carrier employees in the voluntary self-defense training program under section 44918(b) of title 49, United States Code.</text>
</section><section id="id7975a1ff0aa143bcbbd96caa811839f1"><enum>253.</enum><header>Flight deck safety and security</header>
<subsection id="idcdc1d28c53524bfc8819c0bcabc81400"><enum>(a)</enum><header>Threat assessment</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator, in consultation with the Administrator of the Federal Aviation Administration, shall complete a detailed threat assessment to identify any safety or security risks associated with unauthorized access to the flight decks on commercial aircraft and any appropriate measures that should be taken based on the risks.</text>
</subsection><subsection id="id7edfe01c21094c1eaa9666bf53fb45d6"><enum>(b)</enum><header>RTCA report</header><text>The Administrator, in coordination with the Administrator of the Federal Aviation Administration, shall disseminate RTCA Document (DO–329) Aircraft Secondary Barriers and Alternative Flight Deck Security Procedure to aviation stakeholders, including air carriers and flight crew, to convey effective methods and best practices to protect the flight deck.</text>
</subsection></section><section id="ida4c4e9333b1a42518b5a8345cfa79b7f"><enum>254.</enum><header>Carriage of weapons, explosives, and incendiaries by individuals</header>
<subsection id="id25553F8EFB1A4B42B64C674C72EEBA0D"><enum>(a)</enum><header>Interpretive rule</header><text>Subject to subsections (b) and (c), the Administrator shall periodically review and amend, as necessary, the interpretive rule (68 Fed. Reg. 7444) that provides guidance to the public on the types of property considered to be weapons, explosives, and incendiaries prohibited under section 1540.111 of title 49, Code of Federal Regulations.</text>
</subsection><subsection id="idc5a8442a8c644e03be00484a9a07de45"><enum>(b)</enum><header>Considerations</header><text>Before determining whether to amend the interpretive rule to include or remove an item from the prohibited list, the Administrator shall—</text>
<paragraph id="id5730A5E671DF45D1A7A8EF0E0D274A93"><enum>(1)</enum><text>research and evaluate—</text> <subparagraph id="idd66bf6e68ba24af58e5dcbb1cb89b635"><enum>(A)</enum><text>the impact, if any, the amendment would have on security risks;</text>
</subparagraph><subparagraph id="id96309f6ab2d1469c89e83515e65f79f7"><enum>(B)</enum><text>the impact, if any, the amendment would have on screening operations, including effectiveness and efficiency; and</text>
</subparagraph><subparagraph id="id88fb30cb55a84568bf587d89f48a2c9d"><enum>(C)</enum><text>whether the amendment is consistent with international standards and guidance, including of the International Civil Aviation Organization; and</text>
</subparagraph></paragraph><paragraph id="id475000029afd40b4aaca6f57531f9723"><enum>(2)</enum><text>consult with appropriate aviation security stakeholders, including ASAC.</text> </paragraph></subsection><subsection id="id39f7749933674658bc771e66f01f9a7a"><enum>(c)</enum><header>Exceptions</header><text>Except for plastic or round bladed butter knives, the Administrator may not amend the interpretive rule described in subsection (a) to authorize any knife to be permitted in an airport sterile area or in the cabin of an aircraft.</text>
</subsection><subsection id="id3da836cac3224058990404e3341ebe43"><enum>(d)</enum><header>Notification</header><text>The Administrator shall—</text> <paragraph id="id54D48D05AA1D4945AC8B121F8E5D40FF"><enum>(1)</enum><text>publish in the Federal Register any amendment to the interpretive rule described in subsection (a); and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD8C44A7A5D0A4AF09106FD70FF938E4A"><enum>(2)</enum><text>notify the appropriate committees of Congress of the amendment not later than 3 days before publication under paragraph (1).</text>
</paragraph></subsection></section></subtitle><enum>III</enum><header>Conforming and miscellaneous amendments</header>
<section id="id3961a35a205440dea8135844aabdb7ba"><enum>301.</enum><header>Title 49 amendments</header>

</paragraph><paragraph id="id8c4ee0c808e247d6889a9e6beec870d9"><enum>(2)</enum><header>Disclosure</header>
<subparagraph id="id2ee44aa50c4a4c87b8b20fbfee0d682b"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 552 of title 5, the Administrator of the Transportation Security Administration shall prescribe regulations prohibiting disclosure of information obtained or developed in ensuring security under this title if the Secretary of Homeland Security decides disclosing the information would—</text>
<clause id="id2f0b0199395b44deb7504f30e862df10"><enum>(i)</enum><text>be an unwarranted invasion of personal privacy;</text> </clause><clause id="id498bb149f33c47c490b7cac70f835994"><enum>(ii)</enum><text>reveal a trade secret or privileged or confidential commercial or financial information; or</text>
</clause><clause id="id8161ac6b769241a5a83d552aa344090c"><enum>(iii)</enum><text>be detrimental to transportation safety.</text> </clause></subparagraph><subparagraph id="id3c2ec9b7768a40898802e40783336947"><enum>(B)</enum><header>Information to Congress</header><text>Subparagraph (A) does not authorize information to be withheld from a committee of Congress authorized to have the information.</text>
</subparagraph><subparagraph id="idacd8fd83b9f44b3b9a475c21c8e6b5d2"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to authorize the designation of information as sensitive security information (as defined in section 15.5 of title 49, Code of Federal Regulations)—</text>
<clause id="idc4440bee4f134f3ebf6acb0a5c0432ec"><enum>(i)</enum><text>to conceal a violation of law, inefficiency, or administrative error;</text> </clause><clause id="ida35b4c9114e546e4b44cf219f56e303f"><enum>(ii)</enum><text>to prevent embarrassment to a person, organization, or agency;</text>
</clause><clause id="id147e785ef3d2436195301f2284ad5162"><enum>(iii)</enum><text>to restrain competition; or</text> </clause><clause id="id3d3f2046be2c4d8aa5c8c8c46cc0e58d"><enum>(iv)</enum><text>to prevent or delay the release of information that does not require protection in the interest of transportation security, including basic scientific research information not clearly related to transportation security.</text>
</clause></subparagraph><subparagraph id="idd25c2219f17e484bb37cc46508e656c0"><enum>(D)</enum><header>Privacy Act</header><text>Section 552a of title 5 shall not apply to disclosures that the Administrator of the Transportation Security Administration may make from the systems of records of the Transportation Security Administration to any Federal law enforcement, intelligence, protective service, immigration, or national security official in order to assist the official receiving the information in the performance of official duties.</text>
</subparagraph></paragraph><paragraph id="id9f325a5208e449f79867f61867644b1e"><enum>(3)</enum><header>Transfers of duties and powers prohibited</header><text>Except as otherwise provided by law, the Administrator may not transfer a duty or power under this section to another department, agency, or instrumentality of the United States Government.</text>
</paragraph></subsection><subsection id="id5A90530DCF724315983C8C52264A4C63"><enum>(e)</enum><header>Definition of Administrator</header><text>In this section, the term <term>Administrator</term> means the Administrator of the Transportation Security Administration.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="idc299769da3f14672be12dee354739175"><enum>(11)</enum><text>section 44913 is amended—</text>
