		</section><title id="id92f88c140c9648a6b62d4dda04f57994"><enum>I</enum><header>Conservation and management</header>
			<section id="idb21226ad75cc4cb7a674aa895f0a7ff8"><enum>101.</enum><header>Regional fishery management councils</header>
 <subsection id="id1850ebd843f546c39c13b18fa2b4f22f"><enum>(a)</enum><header>Voting members</header><text>Section 302(b)(2)(D) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(D)</external-xref>) is amended—</text> <paragraph id="id25f3d1cf271e45efb8d7e22592e1da08"><enum>(1)</enum><text>in clause (i), in the matter before subclause (I)—</text>
 <subparagraph id="id15263fbb65044243828bdb7d768b4d3c"><enum>(A)</enum><text>by striking <quote>Fisheries</quote> and inserting <quote>Fishery</quote>; and</text> </subparagraph><subparagraph id="id431483fe7fd743debf6367a14f8aa3d9"><enum>(B)</enum><text>by inserting <quote>or the South Atlantic Fishery Management Council</quote> after <quote>Management Council</quote>; and</text>
 </subparagraph></paragraph><paragraph id="id8af82d6e164948dd8c70d0610da758e7"><enum>(2)</enum><text>by striking clause (iv).</text> </paragraph></subsection><subsection id="ida84cc21a94bc42a9ada9b2ab771efcb7"><enum>(b)</enum><header>Committees and advisory panels</header><text>Section 302(g)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(g)(1)(B)</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idd62edd2c671f4384a9fa0c8f5f9b7d07" style="OLC">
 <subparagraph id="id98d461630d5b4d64845d39d074c47135"><enum>(B)</enum><text>Each scientific and statistical committee shall—</text> <clause id="id4d3b9656c05f4034b229f518b7ff0ebc"><enum>(i)</enum><text>provide its Council ongoing scientific advice for fishery management decisions, including recommendations for acceptable biological catch, preventing overfishing, maximum sustainable yield, achieving rebuilding targets, and reports on stock status and health, bycatch, habitat status, social and economic impacts of management measures, and sustainability of fishing practices; and</text>
 </clause><clause id="id1390433f7402408f9e8d8494e3b661c2"><enum>(ii)</enum><text>carry out the requirements of this subparagraph in a transparent manner, allowing for public involvement in the process.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id3226ef9e60814757b6e6c1e941cfe42a"><enum>(c)</enum><header>Functions</header><text>Section 302(h) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>) is amended—</text> <paragraph id="idb123c98d84a14795bd081ea93fdd64c8"><enum>(1)</enum><text>in paragraph (7)(C), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id51c19e4eccef482eb6d960a3894d2bb9"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text> </paragraph><paragraph id="id3c75134b894944db820ff5f7e9888704"><enum>(3)</enum><text>by inserting after paragraph (7) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idcf6aed8283c848b3b3e781d36bdbd8c3" style="OLC">
 <paragraph id="id9518d6c20c0e4fb29888cb33a416ea6d"><enum>(8)</enum><text>have the authority to use alternative fishery management measures in a recreational fishery (or the recreational component of a mixed-use fishery), including extraction rates, fishing mortality, and harvest control rules, to the extent they are in accordance with the requirements of this Act; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="ide714fee4a37149efb9dc56bcf17684a2"><enum>(d)</enum><header>Webcasts of council meetings</header><text>Section 302(i)(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(i)(2)</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id9ba9ea93346841138e46d64ece96a62e" style="OLC"> <subparagraph id="id013077c125a94257b0c32dbc41b533c6"><enum>(G)</enum><text>Unless closed in accordance with paragraph (3), each Council shall, where practicable, make available on the Internet website of the Council a video or audio webcast of each meeting of the Council and each meeting of the scientific and statistical committee of the Council not later than 30 days after the date of the conclusion of such meeting.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="idc93aeb8e7adf4b80815d34c940a81ee1"><enum>102.</enum><header>Contents of fishery management plans</header>
 <subsection id="id57B69EAC0E134C178CF0BB550EFBCC1C"><enum>(a)</enum><header>Limitations</header><text display-inline="yes-display-inline">Section 303 (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id760dfd2a6c5f4b1eacd3f90187232d52" style="OLC"> <subsection id="id211bbc3df2b04cdaaa040b01a50b7bd5"><enum>(d)</enum><header>Limitations</header> <paragraph id="idb59f9d71b0264a968ea5f33fe0b09dee"><enum>(1)</enum><header>In general</header><text>The requirements under subsection (a)(15) shall not—</text>
 <subparagraph id="idcfa1a7fad1564fb0aec50aacd9b93cc1"><enum>(A)</enum><text>apply to a species in a fishery that has a mean life cycle of 12 months or less, or to a species in a fishery with respect to which the vast majority of spawning and recruitment occurs beyond State waters and the exclusive economic zone, unless the Secretary has determined the fishery is subject to overfishing of that species; or</text>
 </subparagraph><subparagraph id="id124a1c90e35f48d58a4f95a31f656200"><enum>(B)</enum><text>limit or otherwise affect the requirements of section 301(a)(1) or 304(e) of this Act.</text> </subparagraph></paragraph><paragraph id="id322e43a4ccc444eba1d70a064bf582aa"><enum>(2)</enum><header>Construction</header><text>Nothing in this subsection shall be construed to affect any effective date regarding the requirements under subsection (a)(15) otherwise provided for under an international agreement in which the United States participates.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="id4367c44b5cfe428289911ceabc518a2c"><enum>(b)</enum><header>Relationship of catch limit requirements to international fishery efforts</header><text>Such section is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idfc72fd523fda4447ad1e794d3362e489" style="OLC"> <subsection commented="no" id="id18fb5e116bf64e71b75dad4671219a74"><enum>(e)</enum><header>Consideration of international fishery efforts in developing catch limits</header> <paragraph commented="no" id="id85314D2E67EC401AA8C0F6B0DF1E8112"><enum>(1)</enum><header>In general</header><text>Each annual catch limit developed under section 302(h)(6) and each mechanism established under subsection (a)(15) of this section—</text>
 <subparagraph commented="no" id="id6d24c28a8e3441bf8ca70c6bffec295e"><enum>(A)</enum><text>may take into account management measures under international agreements in which the United States participates; and</text>
 </subparagraph><subparagraph commented="no" id="id1bdcae5cb69a422b99b4857d00b45127"><enum>(B)</enum><text>in the case of an annual catch limit developed by a Council for a species, shall take into account fishing for the species outside the exclusive economic zone and the life-history characteristics of the species that are not subject to the jurisdiction of the Council.</text>
 </subparagraph></paragraph><paragraph commented="no" id="idf87896418b574977a055a2708b1d8209"><enum>(2)</enum><header>Exception to annual catch limit requirement</header><text>If fishery management activities by another country with respect to fishing outside the exclusive economic zone may hinder conservation efforts by United States fishermen for a fish species for which any of the recruitment, distribution, life history, or fishing activities are transboundary, and for which there is no informal transboundary agreement with that country in effect—</text>
 <subparagraph commented="no" id="id9d93be98964d4a3b896c05a1d1267984"><enum>(A)</enum><text>notwithstanding section 302(h)(6), no annual catch limit is required to be developed for the species by a Council; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad49b3fe8bea439baedd002c2a5977cb"><enum>(B)</enum><text>if an annual catch limit is developed by a Council for the species, the catch limit shall take into account fishing for the species outside the exclusive economic zone that is not subject to the jurisdiction of the Council.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="ideb1775df92f1492a923e49093169e832"><enum>103.</enum><header>Funding for stock assessments, surveys, and data collection</header><text display-inline="no-display-inline">Section 311(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861(e)(1)</external-xref>) is amended—</text> <paragraph id="id0603dc27979e404c88707b2ad267c60d"><enum>(1)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="id0cfa9f526e1b4b9f91fb6dcc30138c93"><enum>(2)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="ida2e128fedc11457d86c25a98a4a82dd6"><enum>(3)</enum><text>by inserting after subparagraph (F) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idd2b79cc7c3a14f7d997d831cad7745fd" style="OLC">
 <subparagraph id="id490a966bcfeb4a7b9b6ba0aeae0ef480"><enum>(G)</enum><text>the costs of stock assessments, surveys, and data collection in fisheries managed under this Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="id33c5a0a6a5104b418affb7b9e2e0933b"><enum>104.</enum><header>Capital construction</header> <subsection id="id67b2bb5f0dc74d4ebaf33aa0ecdfb690"><enum>(a)</enum><header>Definitions; eligible and qualified fishery facilities</header><text>Section 53501 of title 46, United States Code, is amended—</text>
 <paragraph id="id4d93e38c227a4f8197fab2deeaf361f6"><enum>(1)</enum><text>by striking <quote>(7) <header-in-text level="paragraph" style="OLC">United states foreign trade</header-in-text>.—</quote> and inserting <quote>(11) <header-in-text level="paragraph" style="OLC">United States foreign trade</header-in-text>.—</quote>;</text> </paragraph><paragraph id="id095b200087e84079ab0b7af080f5b0d0"><enum>(2)</enum><text>by striking <quote>(8)<header-in-text level="paragraph" style="OLC">Vessel</header-in-text>.—</quote> and inserting <quote>(12) <header-in-text level="paragraph" style="OLC">Vessel</header-in-text>.—</quote>;</text>
 </paragraph><paragraph id="id54e48a8ba41b44f98209e2a021796ab9"><enum>(3)</enum><text>by redesignating paragraphs (5), (6), and (7) as paragraphs (8), (9), and (10), respectively;</text> </paragraph><paragraph id="iddac022e708b84d1a9ef530e68ca25203"><enum>(4)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (4), (5), and (6), respectively;</text>
 </paragraph><paragraph id="id1b359a1d50774f93ab4e76b984fd61f9"><enum>(5)</enum><text>by redesignating paragraph (1) as paragraph (2);</text> </paragraph><paragraph id="id67797bb45d924fa5baba2ce204edf294"><enum>(6)</enum><text>by inserting before paragraph (2), as redesignated, the following:</text>
						<quoted-block display-inline="no-display-inline" id="idcf27c128f00848d59f4c6b3cdb97eef9" style="OLC">
 <paragraph id="ida0cb9bc7c66e4a5e8a3f266ef8655ff9"><enum>(1)</enum><header>Agreement fishery facility</header><text>The term <term>agreement fishery facility</term> means an eligible fishery facility or a qualified fishery facility that is subject to an agreement under this chapter.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idbb0dbf38697c46aebfb47d06472ad59f"><enum>(7)</enum><text>by inserting after paragraph (2), as redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="id8fefe43f948943c9976f2dd0048dbb6a" style="OLC"> <paragraph id="id9aa2445f8373425594f1b47c6838b9ec"><enum>(3)</enum><header>Eligible fishery facility</header><text>The term <term>eligible fishery facility</term> means—</text>
 <subparagraph id="ida15f26855bd84781a4fb3b7d3200ac9f"><enum>(A)</enum><text>for operations on land—</text> <clause id="id967b1ebe6e334aec8d5399aca27de1d9"><enum>(i)</enum><text>a structure or an appurtenance thereto designed for unloading and receiving from a vessel, processing, holding pending processing, distribution after processing, or holding pending distribution, of fish from a fishery;</text>
 </clause><clause id="id3c948c7cbde140c8a0176cb259651d4c"><enum>(ii)</enum><text>the land necessary for the structure or appurtenance described in subsection (1); and</text> </clause><clause id="id50d80faa2f444b3ca9821a721660a570"><enum>(iii)</enum><text>equipment that is for use with the structure or appurtenance that is necessary to perform a function described in clause (i);</text>
 </clause></subparagraph><subparagraph id="id4f891e0299fa4a35a7843339d1ea822f"><enum>(B)</enum><text>for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </subparagraph><subparagraph id="id71a9e02267344129b9cb693ed33e0b46"><enum>(C)</enum><text>for aquaculture, including operations on land or elsewhere—</text> <clause id="id4ff1de794a8a4b899ea361bc4206ec82"><enum>(i)</enum><text>a structure or an appurtenance thereto designed for aquaculture;</text>
 </clause><clause id="ide1aea678d6a845169a63e02562fa8cd5"><enum>(ii)</enum><text>the land necessary for the structure or appurtenance;</text> </clause><clause id="id47f138236eaf41beaa39fcae850365f4"><enum>(iii)</enum><text>equipment that is for use with the structure or appurtenance and that is necessary to perform a function described in clause (i); and</text>
 </clause><clause id="idaab85f40225a49ea9d61406376898666"><enum>(iv)</enum><text>a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, aquaculture.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idbe66e7043d184f4595a89534f9e3ef4c"><enum>(8)</enum><text>by inserting after paragraph (6), as redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="id1d14ddd2465c473f9566d62c6faf6c52" style="OLC"> <paragraph id="idde1e8aa6e5544fd99e8bb8ce79af3180"><enum>(7)</enum><header>Qualified fishery facility</header><text>The term <term>qualified fishery facility</term> means—</text>
 <subparagraph id="id54cc5666cc6f40e89dd2472354b69f0e"><enum>(A)</enum><text>for operations on land—</text> <clause id="id753fa62c3870474b927aabc8bc5a3046"><enum>(i)</enum><text>a structure or an appurtenance thereto designed for unloading and receiving from a vessel, processing, holding pending processing, distribution after processing, or holding pending distribution, of fish from a fishery;</text>
 </clause><clause id="id4fd141afd6f8439cbc10e3156ef62ab9"><enum>(ii)</enum><text>the land necessary for the structure or appurtenance; and</text> </clause><clause id="id949dc2686abd4a028aa3c0b61f840855"><enum>(iii)</enum><text>equipment that is for use with the structure or appurtenance and necessary to perform a function described in clause (i);</text>
 </clause></subparagraph><subparagraph id="id511ef4b802b34ed895ee4b9552f6bf18"><enum>(B)</enum><text>for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </subparagraph><subparagraph id="idd568938a39c14451958a62fbae29a121"><enum>(C)</enum><text>for aquaculture, including operations on land or elsewhere—</text> <clause id="id18cc183fbf5944568727d9d0457bd0d0"><enum>(i)</enum><text>a structure or an appurtenance thereto designed for aquaculture;</text>
 </clause><clause id="id53dd1177274c4e6996d6c07b2855b729"><enum>(ii)</enum><text>the land necessary for the structure or appurtenance;</text> </clause><clause id="id2b81c504e87645a79730effe4a030951"><enum>(iii)</enum><text>equipment that is for use with the structure or appurtenance and necessary for performing a function described in clause (i); and</text>
 </clause><clause id="idc419d7a231f848318a30e58d10b34a4c"><enum>(iv)</enum><text>a vessel built in the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id8966be941dae44cca764db36212b28ca"><enum>(b)</enum><header>Eligible fishery facilities</header> <paragraph id="id8a9b73db9e354c6b959d717dcabd46a7"><enum>(1)</enum><header>Definition of secretary</header><text>Paragraph (9)(A) of section 53501 of title 46, United States Code, as redesignated by subsection (a) of this section, is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idb89fb17f8d124345a19d9eb28a6d022b" style="OLC">
 <subparagraph id="id9e64868633e347b18d855188892fd7cf"><enum>(A)</enum><text>the Secretary of Commerce with respect to—</text> <clause id="idc52bd45db4f44cefa2c4054d34c51b16"><enum>(i)</enum><text>an eligible vessel or a qualified vessel operated or to be operated in the fisheries of the United States; or</text>
 </clause><clause id="id1cbd7257dbb7491bb4ea93f952e13806"><enum>(ii)</enum><text>an eligible fishery facility or a qualified fishery facility; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph><paragraph id="id1d108d573bff47c8a6ced1487842b9e3"><enum>(2)</enum><header>Establishing a capital construction fund</header><text>Section 53503 of title 46, United States Code, is amended—</text>
 <subparagraph id="id0fcead115c2743d487fc096afb4724e3"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="id11d2a125e4ed4b8e9f8ffa4dea0cb2f2"><enum>(i)</enum><text>by inserting <quote>or eligible fishery facility</quote> after <quote>eligible vessel</quote>; and</text>

 </subsection></section><section id="id6de583f040a640f8a05ec846ec1757c7"><enum>105.</enum><header>Fisheries disaster relief</header><text display-inline="no-display-inline">Section 312(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>) is amended—</text> <paragraph id="id8dd778c1e30b4a3b852067b4cc30d262"><enum>(1)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively; and</text>

 <subsection id="id55f64e6769da49ce9a7068ef7ef38221"><enum>(a)</enum><header>In general</header><text>Title III (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851</external-xref> et seq.) is amended by inserting after section 313, the following:</text> <quoted-block display-inline="no-display-inline" id="idf71fed90e9f94d86a30abfb5476e6c08" style="OLC"> <section id="id5421544fb2224782b50b3fd0be928cac"><enum>313A.</enum><header>Gulf of mexico fisheries conservation and management</header><text display-inline="no-display-inline">At least once every 5 years, the Gulf of Mexico Fishery Management Council shall review, in accordance with the provisions of this Act, any allocation of fishing privileges among the commercial, recreational, and charter components of a fishery managed under a fishery management plan prepared by the Council, except that the Council may delay action for not more than 3 additional 1-year periods if necessary.</text>
 </section><section id="idb97ca5a88ab44db8808ca6333abf9e38"><enum>313B.</enum><header>South Atlantic fisheries conservation and management</header><text display-inline="no-display-inline">At least once every 5 years, the South Atlantic Fishery Management Council shall review, in accordance with the provisions of this Act, any allocation of fishing privileges among the commercial, recreational, and charter components of a fishery managed under a fishery management plan prepared by the Council, except that the Council may delay action for not more than 3 additional 1-year periods if necessary.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection id="idecb5e63875d0494d8e5c8dc24ef350e2"><enum>(a)</enum><header>Study requirements</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Commerce shall seek to enter into an arrangement with the National Academy of Sciences to conduct a study—</text>
 <paragraph id="id7fcf969e92ea440ea8642bb5ed9d4905"><enum>(1)</enum><text>to provide guidance on criteria that could be used for allocating fishing privileges, including consideration of the conservation and socioeconomic benefits of the commercial, recreational, and charter components of a fishery, to the Gulf of Mexico and South Atlantic Regional Fishery Management Councils established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>) in the preparation of a fishery management plan under that Act; and</text>
 </paragraph><paragraph id="id8e679ded419449a5acca53058503db0d"><enum>(2)</enum><text>to identify sources of information that could reasonably support the use of such criteria in allocation decisions.</text>
 </paragraph></subsection><subsection id="idff825b3519424862839eb7bd151c5643"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date the Secretary enters into an arrangement under subsection (a), the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on the study conducted under subsection (a).</text>
				</subsection><subsection commented="no" id="id89B7E1686EEC4ECC8BB7AF8CF70C7E3F"><enum>(c)</enum><header>Alternate
			 contract scientific organization</header>
					<paragraph commented="no" id="idA71943EB4A26479ABF6BF536741F6037"><enum>(1)</enum><header>In
 general</header><text>If the Secretary is unable within the time period prescribed in subsection (a) to enter into an agreement described in such subsection (a) with the National Academy of Sciences on terms acceptable to the Secretary, the Secretary shall seek to enter into such an agreement with the Atlantic Coastal Cooperative Statistics Program.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6A5BA702E2C448C6AE86551C767D1C6F"><enum>(2)</enum><header>Treatment</header><text>If the Secretary enters into an agreement with the Atlantic Coastal Cooperative Statistics Program as described in paragraph (1), any reference in this section to the National Academy of Sciences shall be treated as a reference to the Atlantic Coastal Cooperative Statistics Program.</text>
					</paragraph></subsection></section><section commented="no" id="idb3e557482b6749778013fd252dba0a9b"><enum>108.</enum><header>Requirements relating to experimental fishing permits for fishing in Gulf of Mexico or South
 Atlantic</header><text display-inline="no-display-inline">Section 318(d) (<external-xref legal-doc="usc" parsable-cite="usc/16/1867">16 U.S.C. 1867(d)</external-xref>) is amended—</text> <paragraph commented="no" id="idDF909ADF262F45E78EA26E74D39AF477"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Not later</quote> and inserting the following:</text>

 <subparagraph id="idc3906768165b41f88f669e31966c921d"><enum>(A)</enum><header>Consultation</header><text>The Regional Administrator or Director shall consult with the State Fish and Wildlife Agency of any State with a fishing community that would be affected by the issuance of an experimental fishing permit under paragraph (1) for fishing in Federal waters in the Gulf of Mexico or the South Atlantic before issuing such permit.</text>
 </subparagraph><subparagraph id="id5b56deeddbd34ef1835d37b08f585381"><enum>(B)</enum><header>Limitation</header><text>The process created under paragraph (1) may not be used in such manner as to implement a region-wide limited access privilege program under section 303A or a sector allocation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="id9e47e5e9484841c399500bd8c10fa47c"><enum>II</enum><header>Fishery information, research, and development</header>
			<section id="idecfbb03ed911410fbee2b0b6acae96fd"><enum>201.</enum><header>Fisheries research</header>
 <subsection id="id4aeef91b86394593b8c08cea9dcd46d8"><enum>(a)</enum><header>Stock assessment plan</header><text>Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id294bf06dee9548d0aea84d64f52096d4" style="OLC"> <subsection id="id15cf516166ca4eda88ecb3947d9d05a5"><enum>(e)</enum><header>Stock assessment plan</header> <paragraph id="ida73ab81faecb4bb7bd2bfbc73237aa20"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Councils, shall develop, submit to <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name>, and publish in the Federal Register, on the same schedule as required for the strategic plan required under subsection (b), a plan to conduct stock assessments for all stocks of fish for which a fishery management plan is in effect under this Act.</text>
 </paragraph><paragraph id="id3b00bc2598aa443cae87ac44ba696ed2"><enum>(2)</enum><header>Contents</header><text>The plan shall—</text> <subparagraph id="idc72654bc36a140e781179ab0cc12b8cf"><enum>(A)</enum><text>for each stock of fish for which a stock assessment has previously been conducted—</text>
 <clause id="id3666a5a3f3f44adba6782d0937f28c39"><enum>(i)</enum><text>establish a schedule for updating the stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause id="id79dee4d10e834f6cabb8983de49654cb"><enum>(ii)</enum><text>subject to the availability of appropriations, require completion of a new stock assessment, or an update of the most recent stock assessment—</text>
 <subclause id="id68690e175eee404493fc1de98622a271"><enum>(I)</enum><text>at least once every 5 years, except a Council may delay action for not more than 3 additional 1-year periods; or</text>
 </subclause><subclause id="id146d14bf9d6748e2897d7b3d4785c387"><enum>(II)</enum><text>within such other time period specified and justified by the Secretary in the plan;</text> </subclause></clause></subparagraph><subparagraph id="id6cf7551d6d7346588a65da54d81f51ce"><enum>(B)</enum><text>for each economically important stock of fish for which a stock assessment has not previously been conducted—</text>
 <clause id="id32326571c8264a6e9c049b51bb196ab8"><enum>(i)</enum><text>establish a schedule for conducting an initial stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause id="id6a143de343ac416db8ba07226a240b1e"><enum>(ii)</enum><text>subject to the availability of appropriations, require completion of the initial stock assessment not later than 3 years after the date that the plan is published in the Federal Register unless another time period is specified and justified by the Secretary in the plan; and</text>
 </clause></subparagraph><subparagraph id="id527e991d992e49558b0a9a3b5f70338c"><enum>(C)</enum><text>identify data and analysis, especially concerning recreational fishing, that, if available, would reduce uncertainty in and improve the accuracy of future stock assessments, including whether that data and analysis could be provided by State fish and wildlife agencies, fishermen, fishing communities, universities, research institutions, and philathropic organizations.</text>
 </subparagraph></paragraph><paragraph id="id83ae26b9cc3e4b95848778cc9ce72e0a"><enum>(3)</enum><header>Waiver of stock assessment requirement</header><text>Notwithstanding subparagraphs (A)(ii) and (B)(ii) of paragraph (2), a stock assessment shall not be required for a stock of fish in the plan if the Secretary determines that such a stock assessment is not necessary and justifies the determination in the Federal Register notice required by this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id84771cbec4544fbc8710f7ab3681f778"><enum>(b)</enum><header>Deadline</header><text>Notwithstanding paragraph (1) of section 404(e) of the Magnuson-Stevens Fishery Conservation and Management Act, as added by this section, the Secretary of Commerce shall issue the first stock assessment plan under that section by not later than 1 year after the date of the enactment of this Act.</text>
				</subsection></section><section id="idffcc8826caee4616a251acfe152d8257"><enum>202.</enum><header>Improving science</header>
				<subsection id="idb69dc55deff94ed8ab62e2605b35d768"><enum>(a)</enum><header>Improving data collection and analysis</header>
 <paragraph id="id4d9748fa97824b5a909df76eb648a070"><enum>(1)</enum><header>In general</header><text>Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>), as amended by section 201 of this Act, is further amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idf98c96606bfd4f6d9ae686cb4d744030" style="OLC">
							<subsection id="id91599cdbf88b4e06ae94ed42de23ceb1"><enum>(f)</enum><header>Improving data collection and analysis</header>
 <paragraph id="id58aed439e68f4af6916eb2008af9e6a6"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the scientific and statistical committees of the Councils established under section 302(g), shall develop and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on facilitating greater incorporation of data, analysis, stock assessments, and surveys from State fish and wildlife agencies, fishermen, fishing communities, universities, research institutions, and philanthropic organizations, into fisheries management decisions.</text>
 </paragraph><paragraph id="idbfd34ba34eac40d29b948c7a9b9a2432"><enum>(2)</enum><header>Content</header><text>The report under paragraph (1) shall—</text> <subparagraph id="idc324088ad24a440eb02ae9c9f42bb196"><enum>(A)</enum><text>identify types of data and analysis, especially concerning recreational fishing, that can be reliably used for purposes of this Act and the basis for establishing conservation and management measures as required by section 303(a)(1), including setting standards for the collection and use of that data and analysis in stock assessments and surveys and for other purposes;</text>
 </subparagraph><subparagraph id="id8d936f4aa7aa41ada28c31ec5c5f2871"><enum>(B)</enum><text>provide specific recommendations for collecting data and performing analyses identified as necessary to reduce the uncertainty referred to in section 404(e)(2)(C);</text>
 </subparagraph><subparagraph id="idb240d7d9beb54bec8fc23d13468e1640"><enum>(C)</enum><text>consider the extent to which it is possible to establish a registry of persons providing such information; and</text>
 </subparagraph><subparagraph id="idf7710f528cdc4412ba61be0b66fd9685"><enum>(D)</enum><text>consider the extent to which the acceptance and use of data and analysis identified in the report in fishery management decisions is practicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idc559c6fc840145e79ecc4e808fb7fbed"><enum>(2)</enum><header>Deadline</header><text>The Secretary of Commerce shall submit the report required by section 404(f) of the Magnuson-Stevens Fishery Conservation and Management Act, as added by paragraph (1), not later than 1 year after the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="id1d5ec30e03ab4a429cf858fdd6c91ea7"><enum>(b)</enum><header>NAS report recommendations</header><text>The Secretary of Commerce shall consider, and to the extent feasible, implement the recommendations of the National Academy of Sciences in its report entitled <quote>Review of the Marine Recreational Information Program (2017)</quote>, including—</text>
 <paragraph id="id45a436b4e3b24daeb44d2aff79ce0e82"><enum>(1)</enum><text>prioritizing the evaluation of electronic data collection for the Fishing Effort Survey, including smartphone applications, electronic diaries for prospective data collection, and an Internet website option; and</text>
 </paragraph><paragraph id="id5d0193b28b244aeaacd05425a674701b"><enum>(2)</enum><text>evaluating whether the design of the Marine Recreational Information Program for the purposes of stock assessment and the determination of stock management reference points is compatible with the needs of in-season management of annual catch limits and, if such program is incompatible with such needs, determining an alternative method for in-season management that is consistent with the requirements of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.).</text>
					</paragraph></subsection></section></title></legis-body>
