			 Innovation Fellows Program.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Presidential Innovation Fellows Program Act of 2017</short-title></quote>.</text>
 </section><section id="id548b7a58f5454bddb896fcc04dc28e81"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="id718CE6B00B1C41609AEB7526ECACA1C7"><enum>(1)</enum><text display-inline="yes-display-inline">It is in the national interest for the Federal Government to attract the brightest minds skilled in technology or innovative practices to serve in the Federal Government to work on some of the biggest and most pressing challenges facing the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23B88F444DBC4AFF8ACD4CC7CB09D75A"><enum>(2)</enum><text display-inline="yes-display-inline">The Presidential Innovation Fellows Program will encourage successful entrepreneurs, executives, and innovators to join the Federal Government and work in close cooperation with Federal Government leaders, to create meaningful solutions that can help save lives and Federal funds, fuel job creation, and significantly improve how the Federal Government serves the people of the United States.</text>
			</paragraph></section><section id="id8EA8FA453D194D1797DF2209E430204F"><enum>3.</enum><header>Presidential Innovation Fellows Program</header>
 <subsection id="idCBA2AF7E676B478DBD542C81F72B31B5"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">Chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idDFDD25E7033D47D2B88ACEF8646E3AD4" style="USC"> <subchapter id="idBA6E39E5B7C14F519F9A6B083F7FC192" style="OLC"><enum>V</enum><header>Presidential Innovation Fellows Program</header> <section id="id50326A6657A54739B460473B46B6C807"><enum>3171.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter—</text>
 <paragraph id="id5C1A6A61DEC248B687B24803F6778423"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given the term <term>Executive agency</term> under section 105;</text> </paragraph><paragraph id="idAAAA436397944EDDA860D77EB884F191"><enum>(2)</enum><text>the term <term>Administration</term> means the General Services Administration;</text>
 </paragraph><paragraph id="id0D806242691343DF84BD98151793E277"><enum>(3)</enum><text>the term <term>Administrator</term> means the Administrator of General Services;</text> </paragraph><paragraph id="id35EBBB3BCF1D4336BB84C0E5068A1CB3"><enum>(4)</enum><text>the term <term>Advisory Board</term> means the Presidential Innovation Fellows Program Advisory Board under section 3174(a)(1);</text>
 </paragraph><paragraph id="id273B8DC539BC4ED2AFE3F34A990B5BF5"><enum>(5)</enum><text>the term <term>Director</term> means the Director of the Program;</text> </paragraph><paragraph id="id343734A79BA842589A65BAE779FC18C5"><enum>(6)</enum><text>the term <term>Fellow</term> means a Presidential Innovation Fellow; and</text>
 </paragraph><paragraph id="id9BFA007942734271918AE15DE30AA9A8"><enum>(7)</enum><text>the term <term>Program</term> means the Presidential Innovation Fellows Program under this subchapter.</text> </paragraph></section><section id="id43047a5983dc40b88a616f0150c9f1d9"><enum>3172.</enum><header>Establishment and administration</header> <subsection id="idF8B2C4EFA01F42268FBCB327307EF33E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is in the Administration the Presidential Innovation Fellows Program to enable exceptional individuals with proven track records to serve time-limited appointments in agencies as Presidential Innovation Fellows to address some of the most significant challenges facing the United States and improve efforts by the Federal Government that would particularly benefit from expertise using innovative techniques and technology.</text>
							</subsection><subsection id="id7f8591a83d1a4766b07f8da1ffbec16d"><enum>(b)</enum><header>Administration</header>
 <paragraph id="id4AA25F909AD34B4D86A5606E6BE7441F"><enum>(1)</enum><header>Director</header><text>The Program shall be administered by a Director, who shall be appointed by the Administrator.</text> </paragraph><paragraph id="id62767F1585AA4BA0858182698BC51EA4"><enum>(2)</enum><header>Administrative support</header><text>To the extent permitted by law and that amounts are provided in appropriation Acts, the Administration shall provide the employees, resources, and administrative support necessary to carry out the Program.</text>
 </paragraph></subsection><subsection id="id8a8f75c2aec1422b9fa6e6438f47b434"><enum>(c)</enum><header>Appointment of Fellows</header><text>The Director shall appoint Fellows and, in cooperation with agencies, shall facilitate placement of Fellows to participate in projects that have the potential for significant positive effects and are consistent with the goals of the President.</text>
							</subsection></section><section id="id206071f652384bfba86a6b3c7331e6c8"><enum>3173.</enum><header>Appointment of Fellows</header>
 <subsection id="idF5D053D2133942FDBAA7B72BA2F2E0C6"><enum>(a)</enum><header>Application process</header><text>The Director—</text> <paragraph id="id3D8C14E183274253AE5E55D834A29917"><enum>(1)</enum><text>shall prescribe and make publicly available the process for applications and nominations of individuals to be Fellows; and</text>
 </paragraph><paragraph id="idC70DB22877FF4910A43EEB66FA084A40"><enum>(2)</enum><text>may accept applications and nominations in accordance with such process.</text> </paragraph></subsection><subsection id="id5ebaf73c552247ca9eac7fa14dd080c2"><enum>(b)</enum><header>Program standards</header><text>The Director shall—</text>
 <paragraph id="idBACDA08505E74B969F29E349A78ACC3F"><enum>(1)</enum><text>establish, administer, review, and revise, if appropriate, a Government-wide cap on the number of Fellows; and</text>
 </paragraph><paragraph id="idEFC7C047BFDC45B4BB23A508EC06374A"><enum>(2)</enum><text>establish and publish salary ranges, benefits, and standards for the Program.</text> </paragraph></subsection><subsection id="id8517aedd27284ae0905847120bdc507c"><enum>(c)</enum><header>Selection, appointment, and assignment of fellows</header> <paragraph id="id76D7CC40A5104CBF822C35D208C9388D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall prescribe appropriate procedures for the selection, appointment, and assignment of Fellows.</text>
 </paragraph><paragraph id="id86cc07b0aca6414386fc559ae2a33cd2"><enum>(2)</enum><header>Consultation</header><text>Before the selection of Fellows, the Director shall consult with the heads of agencies regarding potential projects and how best to meet the needs of the agencies.</text>
 </paragraph><paragraph id="id69dc63a75ed44a3ab623511c3cdcfca0"><enum>(3)</enum><header>Time limitation</header><text>The appointment of a Fellow shall be for a period of not less than 6 months and not more than 2 years.</text>
 </paragraph><paragraph id="idEB5B2D1A1E6441F0B680133EC65AA026"><enum>(4)</enum><header>Placing of Fellows</header><text>The Director shall facilitate the process of placing Fellows at agencies requesting a Fellow.</text> </paragraph></subsection><subsection id="id5344dbd404604b16a19bf563fb092395"><enum>(d)</enum><header>Responsibilities of agencies</header> <paragraph id="id8B406933DE264034952B288AAA5226D1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each agency shall work with the Director and the Advisory Board to attempt to maximize the benefits of the Program to the agency and the Federal Government, including by identifying initiatives that will have a meaningful effect on the people served and that will benefit from involvement by 1 or more Fellows.</text>
 </paragraph><paragraph id="id7CE7D56139EF4D57B202DDCC314B1662"><enum>(2)</enum><header>Coordination of work</header><text display-inline="yes-display-inline">Each agency shall ensure that each Fellow placed at the agency works closely with 1 or more responsible senior officials for the duration of the placement.</text>
								</paragraph></subsection></section><section id="idc7eb35647ad04176aea1554f0e005830"><enum>3174.</enum><header>Presidential Innovation Fellows Program Advisory Board</header>
							<subsection id="idB3C8F61486644CC1A0D45D5D172051DB"><enum>(a)</enum><header>Establishment</header>
 <paragraph id="idFB77506EA7024D5791612FE0D8C16E4C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is, under the authority of the Administrator, a Presidential Innovation Fellows Program Advisory Board to—</text>
 <subparagraph id="id7F9ADAC6E664444486C1B1F64F6472AE"><enum>(A)</enum><text display-inline="yes-display-inline">advise the Director by recommending such priorities and standards as may be beneficial to fulfill the mission of the Program; and</text>
 </subparagraph><subparagraph id="id26DC4B2AB4EA4E1B8B499E1B2E1284C4"><enum>(B)</enum><text display-inline="yes-display-inline">assist in identifying potential projects and placements for Fellows.</text> </subparagraph></paragraph><paragraph id="idBB19DAF1B8F34B1AAC7387ACD0F48918"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Advisory Board shall not participate in the selection of Fellows.</text>
 </paragraph></subsection><subsection id="id90f698d41c904cbf8eb06eabea11a31a"><enum>(b)</enum><header>Membership</header><text>The members of the Advisory Board shall be as follows:</text> <paragraph id="id2ED86F5FEDF34FF7A970EAF04E100304"><enum>(1)</enum><text>A representative designated by the Administrator, who shall serve as the Chairperson of the Advisory Board.</text>
 </paragraph><paragraph id="idB1E3E10232FD4B389915D2000C82BB5B"><enum>(2)</enum><text>The Deputy Director for Management of the Office of Management and Budget.</text> </paragraph><paragraph id="idAAF8C03F802146CCAE83824407AD8FD8"><enum>(3)</enum><text>The Director of the Office of Personnel Management.</text>
 </paragraph><paragraph id="id371D31C1660A499AB0E4F58982C87C7A"><enum>(4)</enum><text>The Administrator of the Office of Electronic Government.</text> </paragraph><paragraph id="idE3DFFE894B384F2587F90479439DE1DB"><enum>(5)</enum><text>The Assistant to the President and Chief Technology Officer.</text>
 </paragraph><paragraph id="id3CC3C1DD09314942970620FB162FEC0E"><enum>(6)</enum><text>Other individuals, as designated by the Administrator.</text> </paragraph></subsection><subsection id="idB7F7C3B42C80464E860FF2508A1CDC69"><enum>(c)</enum><header>Consultation</header><text>The Advisory Board may consult with industry, academia, and nonprofit organizations to ensure the Program is continually identifying opportunities to apply advanced skillsets and innovative practices in effective ways to address the most significant challenges to the United States.</text>
 </subsection></section><section id="id243c19220aaa4821a78a8f9695b2a68c"><enum>3175.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed to—</text> <paragraph id="id094EF956B3144C9C886071BBDFB1FA51"><enum>(1)</enum><text display-inline="yes-display-inline">impair or otherwise affect—</text>
 <subparagraph id="id74242257454d48deac22f3b24a6ae3ea"><enum>(A)</enum><text>the authority granted by law to an agency, or the head thereof; or</text> </subparagraph><subparagraph id="idde2b2d42521243e39531eb9294bcc749"><enum>(B)</enum><text>the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals; or</text>
 </subparagraph></paragraph><paragraph id="id84B99EFFE19043BEAB6A43398D86C975"><enum>(2)</enum><text>create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</text></paragraph></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idA2A0B7DF8FD84621A17DA0E9A8A05674"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="id9c2a6973-1b5d-422a-81a8-55ff6e909b68" style="USC"><toc><toc-entry idref="idBA6E39E5B7C14F519F9A6B083F7FC192" level="subchapter">SUBCHAPTER V—Presidential Innovation Fellows Program</toc-entry><toc-entry idref="id50326A6657A54739B460473B46B6C807" level="section">3171. Definitions.</toc-entry><toc-entry idref="id43047a5983dc40b88a616f0150c9f1d9" level="section">3172. 			</subsection><subsection id="id35d7e07eea944e6c8f97f8a963f73d40"><enum>(c)</enum><header>Transitional provision</header>
 <paragraph id="idCE426F7F833746328FB8A42A4E0A7695"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>function</term> means any duty, obligation, power, authority, responsibility, right, privilege, activity, program, or employee.</text>
 </paragraph><paragraph id="idF4E25E7A4D68402386EA5DE61AB8E32C"><enum>(2)</enum><header>Transition</header><text>The functions of the Presidential Innovation Fellows Program established pursuant to Executive Order 13704 (<external-xref legal-doc="usc" parsable-cite="usc/5/3301">5 U.S.C. 3301</external-xref> note), as in existence on the day before the date of enactment of this Act, shall be functions of the Presidential Innovation Fellows Program under subchapter V of title 5, United States Code, as added by this Act.</text></paragraph></subsection></section></legis-body></bill>
