			 Federal Communications Commission generally, to establish criteria for the
			 provision of video visitation services by the Bureau of Prisons, and for
			 other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HD9DD324088C148C09A74DE046CEE47DE" style="OLC">
 <section id="H418012DADA3840938EB28E555D0918E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Video Visitation and Inmate Calling in Prisons Act of 2017</short-title></quote>.</text> </section><section display-inline="no-display-inline" id="HFE00DE16998248EC966CA00CE45CC31A" section-type="subsequent-section"><enum>2.</enum><header>FCC regulation of video visitation service and inmate calling service</header> <subsection id="HFE1211BD4A7E4ABE9710773F78B38A83"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="id75ed547be8124effaa4bd7fa3c4401a7"><enum>(1)</enum><header>Ancillary service charge</header><text>The term <term>ancillary service charge</term> means any charge that a consumer may be assessed for the use of inmate calling services that is not included in the per-minute charges assessed for the individual call.</text>
 </paragraph><paragraph id="id6F847E26270E4D139A8405BEC3284E36"><enum>(2)</enum><header>Call</header><text display-inline="yes-display-inline">The term <term>call</term>—</text> <subparagraph id="id22213D4792564C17B0FBBFE14C6D39A9"><enum>(A)</enum><text display-inline="yes-display-inline">means a voice or video call using a covered service; and</text>
 </subparagraph><subparagraph id="id5727CCAAA7EA4E448AD9AAC25602648D"><enum>(B)</enum><text display-inline="yes-display-inline">includes any other session of use that is similar to a telephone call.</text>
 </subparagraph></paragraph><paragraph id="idEABF1B8E8A7D44AB82E169BEB883A4FE"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text> </paragraph><paragraph id="idDB12690BEE2448A081BF5905EE375FA9"><enum>(4)</enum><header>Consumer</header><text>The term <term>consumer</term> means the party paying a provider of inmate calling services.</text>
 </paragraph><paragraph id="id2604147C4DDB4B71A06C05CB80C3C150"><enum>(5)</enum><header>Correctional facility</header><text>The term <term>correctional facility</term> means a jail or prison.</text> </paragraph><paragraph id="id4EAC2EC426444F188BBE6A3DD85BC096"><enum>(6)</enum><header>Covered service</header><text>The term <term>covered service</term> means an inmate calling service or a video visitation service.</text>
 </paragraph><paragraph id="id96E051D6C72544718A68AE1B81BA6794"><enum>(7)</enum><header>Inmate</header><text>The term <term>inmate</term> means an individual detained in a correctional facility, regardless of the duration of the detention.</text>
 </paragraph><paragraph id="idA6F5C101932E414A8038589C37E20312"><enum>(8)</enum><header>Inmate calling service</header><text>The term <term>inmate calling service</term> means a service that allows inmates to make calls to individuals outside the correctional facility where the inmate is detained, regardless of the technology used to deliver the service.</text>
 </paragraph><paragraph id="ida48a18b70521411d8f47f4e6c3e95129"><enum>(9)</enum><header>Site Commission</header><text>The term <term>site commission</term> means any form of monetary payment, in-kind payment, gift, exchange of services or goods, fee, technology allowance, or product that a provider of inmate calling services or affiliate of such a provider may pay, give, donate, or otherwise provide to—</text>
 <subparagraph id="id8E402AA468814ABA9BC54F9A21779E46"><enum>(A)</enum><text>an entity that operates a correctional institution;</text> </subparagraph><subparagraph id="id01B7A418A2AA4A1AB5C9395756C9405D"><enum>(B)</enum><text>an entity with which the provider of inmate calling services enters into an agreement to provide such services;</text>
 </subparagraph><subparagraph id="id3270388305AD412C8065AEDEE3D484E0"><enum>(C)</enum><text>an agency that oversees a correctional facility;</text> </subparagraph><subparagraph id="id3B70CE6397E74A72BC4AA12858366F0D"><enum>(D)</enum><text>the city, county, or State in which a correctional facility is located; or</text>
 </subparagraph><subparagraph id="idC5A80C6A2F6545A59A7B26D6453A9170"><enum>(E)</enum><text>an agent of any such correctional facility.</text> </subparagraph></paragraph><paragraph id="id361E2C74001E4CE9962804FC2DFA37F4"><enum>(10)</enum><header>Video visitation service</header><text display-inline="yes-display-inline">The term <term>video visitation service</term> means a service that allows inmates to make video calls to individuals outside the correctional facility where the inmate is being held, regardless of the technology used to deliver the service. A video visitation service may be classified as an inmate calling service, as the Commission considers appropriate.</text>
 </paragraph></subsection><subsection id="id7BECE38FB5C1442C888AB5A16CCDD4CA"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall—</text>
 <paragraph id="idF6DE32F415964A248A12E1807F1EC8E4"><enum>(1)</enum><text display-inline="yes-display-inline">promulgate regulations with respect to video visitation service; and</text>
 </paragraph><paragraph id="idABC7A6A6452B471BB8E8397A395BFAD4"><enum>(2)</enum><text display-inline="yes-display-inline">amend the regulations of the Commission with respect to inmate calling service (as necessary), to ensure that all charges, practices, classifications, and regulations for and in connection with video visitation service and inmate calling service are just and reasonable.</text>
 </paragraph></subsection><subsection id="H4830E869D2C148BB91D7350BAD920910"><enum>(c)</enum><header>Requirements for regulations</header><text>The regulations promulgated under subsection (b) shall include the following:</text> <paragraph id="H6817C910BE6E431AA7FC9FF3A5525548"><enum>(1)</enum><text>Video visitation services may be used only to supplement, not supplant, in-person visitation.</text>
 </paragraph><paragraph id="idE5D77E794FC14B9DB5267066DA173FD1"><enum>(2)</enum><text>Caps on the rates (and any related fees or charges) that a provider of a covered service may charge for such service.</text>
 </paragraph><paragraph id="HF3BF24A9E89E45A5AFE31DA3DDDBB34B"><enum>(3)</enum><text>A prohibition against a provider of a covered service charging a flat rate for a call, regardless of the duration of the call.</text>
 </paragraph><paragraph id="HE4BF36C19F9E449A865A3B0D9B307DC0"><enum>(4)</enum><text>A prohibition against a provider of a covered service requiring a correctional facility to restrict in-person visitation as a condition of providing such service in such facility.</text>
 </paragraph><paragraph id="H569F2662E68F4AFF81054963B9D246E9"><enum>(5)</enum><text>A requirement that a provider of a covered service certify annually to the Commission that such provider is in compliance with the prohibition under paragraph (4).</text>
 </paragraph><paragraph id="id27786B92BB5641729F42750A3D94BCBB"><enum>(6)</enum><text>A requirement that the provider of a covered service submit an annual report to the Commission regarding interstate, intrastate, and international inmate calling services for the prior calendar year, which shall—</text>
 <subparagraph id="idC9D70C243ADC47619468E4C15BABC5A5"><enum>(A)</enum><text>be categorized both by facility type and size; and</text> </subparagraph><subparagraph id="id7C2346B640704522BD118EF36A3BD33C"><enum>(B)</enum><text>contain—</text>
 <clause id="id46ef12fbe56145f9a7daae0094aedde1"><enum>(i)</enum><text>current interstate, intrastate, and international rates for inmate calling services;</text> </clause><clause id="ide5259b8148e74f6fa9dbf424873514c1"><enum>(ii)</enum><text>current ancillary service charge amounts and the instances of use of each;</text>
 </clause><clause id="idebf0f662599a44a4ba85d822fe83e0d9"><enum>(iii)</enum><text>the monthly amount of each site commission paid;</text> </clause><clause id="id820d2792ad1e455cba9796deee89a1d4"><enum>(iv)</enum><text>minutes of use, per-minute rates, and ancillary service charges for video visitation services;</text>
 </clause><clause id="id3d72bc7ae3674f57adbd5895f504ea5e"><enum>(v)</enum><text>the number of TTY-based inmate calling services calls provided per facility during the reporting period;</text>
 </clause><clause id="idfd27834b299c48ba897f31bccbd666dd"><enum>(vi)</enum><text>the number of dropped calls the reporting provider experienced with TTY-based calls; and</text> </clause><clause id="ide9485c733dfb4fe4845a60b1ba1903fa"><enum>(vii)</enum><text>the number of complaints that the reporting provider received relating to issues such as dropped calls, poor call quality, and the number of incidences of each by TTY and telecommunications relay service (TRS) users.</text>
 </clause></subparagraph></paragraph><paragraph id="H99FDDF747D8A49F5AD3833F1AC871CB9"><enum>(7)</enum><text>A prohibition against a provider of a covered service offering or entering into an agreement to provide a covered service as part of a bundle of services that includes any service that is not a communications service.</text>
 </paragraph><paragraph id="HCD4FD2F12E9E469BA2B6C859F3F6417B"><enum>(8)</enum><text>Requirements for the offering or entering into an agreement to provide a covered service as part of a bundle of services that ensure that correctional facilities are able to review each service separately during the request for proposals process.</text>
 </paragraph><paragraph id="H788778787728448C85EFBD597C3C1BC7"><enum>(9)</enum><text>With respect to video visitation service, quality standards that are the best commercially available for effective human communication by video, which shall be developed by the Commission after seeking comments that review the academic literature regarding the appropriate thresholds for effective human communication by video.</text>
				</paragraph></subsection><subsection commented="no" id="H75A03FDF1553405894F13F197DA9BC04"><enum>(d)</enum><header>Applicability</header>
 <paragraph commented="no" id="id63E2EA4C4BD34C73ABB9FBE59973D6D3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The regulations promulgated under subsection (b) shall apply to interstate service, intrastate service, and international service.</text>
 </paragraph><paragraph commented="no" id="id2FC7F752F85A4431A98AEBA9ACF3A929"><enum>(2)</enum><header>Different requirements</header><text display-inline="yes-display-inline">In promulgating regulations under subsection (b), the Commission may provide for different requirements for interstate service, intrastate service, and international service.</text>
				</paragraph></subsection></section><section id="H8F320F489AC34B76BDDE8D12AF9BC7ED"><enum>3.</enum><header>Bureau of Prisons Oversight</header>
 <subsection id="idFEFC4F67C2814223966ACAD5EAB91FEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H82E2B11FE4634F67AD66A57D9911E759" style="USC"> <section id="H2F4EB7CD4DA4484697133A7F45933687"><enum>4015.</enum><header>Video visitation</header> <subsection id="H3DD2974F8C87492C9BE9BD3CFE8A2119"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Bureau of Prisons shall take such actions as may be necessary to ensure that, in the case of any prisoner in the custody of the Bureau of Prisons, video visitation services are available subject to the following:</text>
 <paragraph id="H8E25FF1DCF00457398692DB51F67FD6F"><enum>(1)</enum><text>Video visitation services may be used only to supplement, not supplant, in-person visitation.</text> </paragraph><paragraph id="H78123FA5143C4DB18097FE608FDB11DA"><enum>(2)</enum><text>Any equipment or area made available for purposes of video visitation shall maximize privacy to the extent practicable, and shall include measures to ensure the operability of the equipment by visitors, including children.</text>
 </paragraph><paragraph id="H8C196C9B144C41BEB5F584BEE281A5C1"><enum>(3)</enum><text display-inline="yes-display-inline">In entering into any agreement to provide covered services, the Director—</text> <subparagraph id="HE9B4802B650047B7A070DDB89468FC72"><enum>(A)</enum><text>shall give priority to bids submitted that require the purchase of equipment for video visitation;</text>
 </subparagraph><subparagraph id="HFF9ADA0B6F104B6F81CE1A9FCFA9C8E1"><enum>(B)</enum><text display-inline="yes-display-inline">may not enter into any agreement including a term providing for—</text> <clause id="H108771DE1F4E4ECBA234DF91CF26C6FA"><enum>(i)</enum><text>any services other than those that are minimally required by the Director;</text>
 </clause><clause id="H7550C7AA20BE4934905B8C3394AA6310"><enum>(ii)</enum><text display-inline="yes-display-inline">any authority to a person other than a corrections officer to make a determination that affects the terms of a prisoner’s imprisonment, including visitation schedules or ability of a person to move about within a correctional facility; or</text>
 </clause><clause id="H15056DDA089348C0883AE62276EC8FC0"><enum>(iii)</enum><text display-inline="yes-display-inline">a covered service as part of a bundle of services that includes any service that is not a covered service; and</text>
 </clause></subparagraph><subparagraph id="H4D38F1159BE04E619879F70B5502BBF1"><enum>(C)</enum><text>may not enter into any agreement that does not include terms requiring—</text> <clause id="H588164D9DBE04C2B8E6B39752F20DF77"><enum>(i)</enum><text>that the service provider provide a list of each video visitation and each individual fee charged to the visitor and the prisoner;</text>
 </clause><clause id="HCCEE720E3FF24FAF8E07E73455E02BFB"><enum>(ii)</enum><text>that the service provider offer a minimum number of free visits each month based on good behavior (as determined by the head of the correctional facility wherein the service is provided); and</text>
 </clause><clause id="HF84437407D9F4948A6ED58003ABACBB5"><enum>(iii)</enum><text>that the service provider submit quarterly reports including such information as the Director may require to ensure compliance with the terms of this section.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H7E2CA919AF8645DCA02B6545513D1740"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, terms used have the meanings given such terms in section 2 of the <short-title>Video Visitation and Inmate Calling in Prisons Act of 2017</short-title>, except that, for purposes of this section, the term <term>video visitation service</term> includes a service that allows the use of videoconferencing or analog closed circuit television systems and software to allow inmates and visitors to visit at a distance with an inmate in a correctional facility.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idE963E9CFC5B840C3B3EA47E6DE911B56"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">chapter 301</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/4014">section 4014</external-xref> the following:</text>
