			 Commissioner of the Social Security Administration to disclose certain
			 return information related to identity theft, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H6139148EB9874187B42377C895296FE3" style="OLC">
 <section id="H23FECEDDD34F44E991737EA058F14D44" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Identity Defense Act of 2017</short-title></quote>.</text>
		</section><section id="H0A82B1BAB21C4169A4C38A5F828C6805"><enum>2.</enum><header>Disclosure of
			 certain return information with respect to identity theft</header>
			<subsection id="HD679E15B3F9D47A2B64A1FD42A0157D3"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Subsection (l) of <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id80F53D988C66464BA56160C907E3F74F" style="OLC">
					<paragraph id="H5DC60DACCB2B47598F70653FBC1AEDD4"><enum>(23)</enum><header>Disclosure of
				return information in certain cases of identity theft</header>
 <text display-inline="yes-display-inline">If the Secretary has reason to believe that there has been a fraudulent use of a social security account number on a statement described in section 6051, the Secretary shall disclose to the individual who was validly assigned such social security account number—</text>
 <subparagraph id="HE3F08A0DF65D47D1AB310C9E1730937B"><enum>(A)</enum><text>that the Secretary has reason to believe that the social security account number assigned to such individual has been fraudulently used in the employment context, and</text>
 </subparagraph><subparagraph id="id29473944725E485A8AE4C490E543FA3E"><enum>(B)</enum><text>such other information (other than return information) as the Secretary determines, in consultation with the Federal Trade Commission, would be helpful and appropriate to provide to a victim of identity theft.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H5877D3D4286F4F4B8FDB4DF819EBC381"><enum>(b)</enum><header>Prevention of identity theft</header><text>In the case of an employee for whom the Commissioner of Social Security has reason to believe that the social security number included on any statement described in <external-xref legal-doc="usc" parsable-cite="usc/26/6051">section 6051(a)</external-xref> of the Internal Revenue Code of 1986 with respect to such employee is not the correct social security number for such employee, the Commissioner shall provide notification to the employer of such employee which includes—</text>
 <paragraph id="idE79E689553194A7CB712FD2101ABE730"><enum>(1)</enum><text>the name of the employee and the social security number included on such statements; and</text> </paragraph><paragraph id="id30880E79B9794F5483EDAECB5AF9B69E"><enum>(2)</enum><text>relevant information regarding the availability of the Social Security Number Verification Service for verification of social security numbers.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1AC92B6111CF46918F3D878D4DC5F682"><enum>3.</enum><header>Penalties for tax-related identity theft</header>
 <subsection commented="no" display-inline="no-display-inline" id="id365E5BFE0D7249DBAE8347712DD3FA4A"><enum>(a)</enum><header>In general</header><text>Section 1028A(c) of title 18, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id18692DE5686E4FA7AECA036C17BA1C40"><enum>(1)</enum><text>by redesignating paragraphs (8) through (11) as paragraphs (10) through (13), respectively; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4725ED6905924C4CBA1AEA20888C2B7F"><enum>(2)</enum><text>by inserting after paragraph (7) the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="id346D8A996C704712A03FEA5915037299" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id83C4240E03FF457D8DA83FBAB9614F13"><enum>(8)</enum><text>section 286 (relating to conspiracy to defraud the government with respect to claims), section 287 (relating to false, fictitious, or fraudulent claims), section 371 (relating to conspiracy to commit an offense or to defraud the United States), section 1001 (relating to statements or entries), section 1341 (relating to frauds and swindles), section 1342 (relating to a fictitious name or address), section 1343 (relating to fraud by wire, radio, or television), or section 1344 (relating to bank fraud), if the felony violation is a tax-related offense punishable under such section;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17E8D8338302413F826876E257FCF60D"><enum>(9)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/7206">section 7206</external-xref> of the Internal Revenue Code of 1986 (relating to fraud and false statements);</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4851C2C41AC54DDB952E5305F865A432"><enum>(b)</enum><header>Penalty
			 for misappropriation of taxpayer identification numbers</header>
				<paragraph id="idB490474C1E514783A84B9C71B686C13A"><enum>(1)</enum><header>In
 general</header><text>Part I of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/68">chapter 68</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="idD2E58C65E9144DB4824D96BDC5214B8D" style="OLC">
 <section id="id141D30E45F234120872B7004B65C8CEE"><enum>6720D.</enum><header>Misappropriation of taxpayer identification number</header><text display-inline="no-display-inline">In addition to any penalty provided by law, any person who knowingly or willfully misappropriates another person's taxpayer identification number in connection with any list, return, account, statement, or other document submitted to the Secretary shall pay a penalty of $5,000.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H2472B5D1029B414DA51631236604FF0F"><enum>(2)</enum><header>Conforming amendment</header><text>The table of sections for part I of subchapter B of chapter 68 of such Code is amended by adding at the end the following new item:</text><toc><toc-entry bold="off" level="section"><quote>Sec. 6720D. Misappropriation of taxpayer identification number.</quote>.</toc-entry></toc>

 date</header><text>The amendments made by this subsection shall apply to returns and information submitted after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
