			 purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Volunteer Pilot Protection Act of 2017</short-title></quote>.</text> </section><section id="idf2069e70342d48f8a661a942c60e34b1"><enum>2.</enum><header>Findings and purposes</header> <subsection id="idc3a294901c0648f1b51369b947d07c7e"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
 <paragraph id="id3be3c1d0683f48c29e386d2ef565abc0"><enum>(1)</enum><text>Many volunteer pilots fly for the public benefit for nonprofit organizations and provide valuable services to communities and individuals in need.</text>
 </paragraph><paragraph id="id0d2a15cf55b74ea29dc6f897762d4a7b"><enum>(2)</enum><text>In each calendar year volunteer pilots and the nonprofit organizations those pilots fly for provide long-distance, no-cost transportation for tens of thousands of people during times of special need. Flights provide patient and medical transport, disaster relief, and humanitarian assistance, and conduct other charitable missions that benefit the public.</text>
 </paragraph><paragraph id="id9ab9eaa0cf724f058a0779e7db58b2d8"><enum>(3)</enum><text>Such nonprofit organizations have supported the homeland security of the United States by providing volunteer pilot services during and following disasters and during other times of national emergency.</text>
 </paragraph><paragraph id="id5a7fa34866774ead9e33436f59b72983"><enum>(4)</enum><text>Most other kinds of volunteers are protected from liability by the Volunteer Protection Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14501">42 U.S.C. 14501</external-xref> et seq.), but volunteer pilots are not.</text>
 </paragraph></subsection><subsection id="id3007a99e1a4d4f0db038e173dbb363b2"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are to amend the Volunteer Protection Act of 1997—</text> <paragraph id="id5824E70893C7422DBD0BB3C4CFFC104C"><enum>(1)</enum><text>to extend the protection of that Act to volunteer pilots;</text>
 </paragraph><paragraph id="idE98E93A64C6E4AA481A5B803EBEEC1A8"><enum>(2)</enum><text>to promote the activities of volunteer pilots and the nonprofit organizations those pilots fly for in providing flights for the public benefit; and</text>
 </paragraph><paragraph id="id0BC0F528395F448DA5A89F9CF1DD363E"><enum>(3)</enum><text>to sustain and enhance the availability of the services that such pilots and nonprofit organizations provide, including—</text>
 <subparagraph id="idd569bbde44f94e0394cfbf05ad78d213"><enum>(A)</enum><text>transportation at no cost to financially needy medical patients for medical treatment, evaluation, and diagnosis;</text>
 </subparagraph><subparagraph id="iddd5b8e225a0f473eb1a14bc374c66295"><enum>(B)</enum><text>flights for humanitarian and charitable purposes; and</text> </subparagraph><subparagraph id="idbac274c25e174cd29c25fb6f1e03594c"><enum>(C)</enum><text>other flights of compassion.</text>
 </subparagraph></paragraph></subsection></section><section id="id23bdda3c8bbd48f6bbe84c6dd13905c1"><enum>3.</enum><header>Liability protection for volunteer pilots who fly for the public benefit</header><text display-inline="no-display-inline">Section 4 of the Volunteer Protection Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14503">42 U.S.C. 14503</external-xref>) is amended—</text> <paragraph id="id6772920fa3004c759cc10117130da8f0"><enum>(1)</enum><text>by redesignating subsections (b) through (f) as subsections (c) through (g), respectively;</text>
 </paragraph><paragraph id="id87BAB15352C7443FA0BD8860F2EEF7DA"><enum>(2)</enum><text>in subsection (a), by striking <quote>subsections (b) and (d)</quote> and inserting <quote>subsections (b), (c), and (e)</quote>;</text> </paragraph><paragraph id="idE02C8D2CE4834C02A1484CAD9D58B9AA"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4CD5135E0DF74D9C8531BBCB735ACD7E" style="OLC">
 <subsection id="id706202F975AD4E8FA6466A4531AB25AF"><enum>(b)</enum><header>Liability protection for pilots that fly for public benefit</header><text>Except as provided in subsections (c) and (e), no volunteer of a volunteer pilot nonprofit organization that arranges flights for public benefit shall be liable for harm caused by an act or omission of the volunteer on behalf of the organization if, at the time of the act or omission, the volunteer—</text>
 <paragraph id="id272b5f53d8504e61b83f75d73e934747"><enum>(1)</enum><text>was operating an aircraft in furtherance of the purpose of, and acting within the scope of the volunteer’s responsibilities on behalf of, the nonprofit organization;</text>
 </paragraph><paragraph id="id9aec9068041b4cc8938d5b1bce772061"><enum>(2)</enum><text>was properly licensed and insured for the operation of the aircraft;</text> </paragraph><paragraph id="idfa6a18085aef41a7a488d85d79cb7732"><enum>(3)</enum><text>was in compliance with all requirements of the Federal Aviation Administration for recent flight experience; and</text>
 </paragraph><paragraph id="id6f3018126f7341d29a974c4fbbe452e8"><enum>(4)</enum><text>did not cause the harm through willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious, flagrant indifference to the rights or safety of the individual harmed by the volunteer.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id37B9713C53B24509B18D9A8C73F058F9"><enum>(4)</enum><text>in subsection (g)(2), as redesignated, by striking <quote>(e)</quote> and inserting <quote>(f)</quote>.</text></paragraph></section></legis-body></bill>
