 <section id="id750BC26A3D4C4D2F96338C9E376BE2AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Economic Assistance Act of 2017</short-title></quote>.</text> </section><section id="id09F29F680F404C49A278AF9B7DCB9017" section-type="subsequent-section"><enum>2.</enum><header>Extension of empowerment zone provisions to certain communities</header> <subsection id="id5724D591B01E4A4BBFF4CE092C7EBAE4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">Chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after subchapter U the following new subchapter:</text>

					<subchapter id="H46A2E3C882324507B1491AF54B75DB6B"><enum>U–1</enum><header>Community economic assistance zones</header><toc><toc-entry idref="H9F9EAD1B592F4AC8A7DAA05FE12EB09C" level="section">Sec. 1397G. Designation of community economic assistance zones.</toc-entry><toc-entry idref="idE982769FE2194755B5FF841F3AAFE7F6" level="section">Sec. 1397H. Incentives for community economic assistance zones.</toc-entry></toc>
						<section id="H9F9EAD1B592F4AC8A7DAA05FE12EB09C"><enum>1397G.</enum><header>Designation of community economic assistance zones</header>
							<subsection id="id37F8D8AE5FF548749D45916805105669"><enum>(a)</enum><header>In general</header>
 <text>For purposes of this title, the term <term>community economic assistance zone</term> means any area—</text> <paragraph id="id831BAA82EF0844EFB3B81A8B011D4B56"><enum>(1)</enum><text>which is nominated by the governor or governors of the State or States in which it is located for designation as a community economic assistance zone (hereafter in this section referred to as a <quote>nominated area</quote>, and</text>
 </paragraph><paragraph id="id78b724cb64064abfa6e3863fd5e4aaa8"><enum>(2)</enum><text>which the Secretary designates as a community economic assistance zone, after consultation with—</text> <subparagraph id="idf5b73957fa55417a9a4274e3fd7405ec"><enum>(A)</enum><text>the Secretary of Labor, and</text>
 </subparagraph><subparagraph id="idf8f4e7791a8741a9b04fe753b3a350df"><enum>(B)</enum><text>in the case of an area on an Indian reservation, the Secretary of the Interior.</text> </subparagraph></paragraph></subsection><subsection id="id9715A6498FC24B8F8E7750DF4FD388CF"><enum>(b)</enum><header>Designation based on loss of employment, etc</header> <paragraph id="id814697FDAC33476D9C798E01A8B1723D"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this section, a nominated area designated as a community economic assistance zone under this subsection shall be—</text>
 <subparagraph id="id3A7650500F614A949FBE655641EFEFA9"><enum>(A)</enum><text>a nominated area—</text> <clause id="id334F289D1D6C4F88AD86587956C64FF4"><enum>(i)</enum><text>where—</text>
 <subclause id="id4191AB5A45F54680A109CDB552E6E6C3"><enum>(I)</enum><text>a facility is located with respect to which a notice was issued after December 31, 2014, under section 3 of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102</external-xref>) with respect to 250 or more employees, or</text>
 </subclause><subclause id="id455C3E04BE3245FA8493AEA705CBF7FC"><enum>(II)</enum><text>where 100 or more employees with respect to which such a notice was issued reside,</text> </subclause></clause><clause id="idF0E32AE3F1CF4669A5071324C679D5E5"><enum>(ii)</enum><text>where the number of employees—</text>
 <subclause id="idD00EDA9FA98B40A0853618F263F92663"><enum>(I)</enum><text>with respect to which the notice was issued (in the case of an area described in clause (i)(I)), or</text> </subclause><subclause id="idDA9E25C3F8EA4A1990420B3CEC52CA25"><enum>(II)</enum><text>the number of employees who are described in clause (i)(II) (in any other case),</text>
											</subclause><continuation-text continuation-text-level="clause">is equal to or greater
			 than 0.5 percent of the employed population of the metropolitan
			 statistical area (as
 determined by the Secretary), and</continuation-text></clause><clause commented="no" display-inline="no-display-inline" id="id93038709472D41488BBE65180E9661D9"><enum>(iii)</enum><text display-inline="yes-display-inline">where a loss of employment satisfying the requirements applicable to such notice under clauses (i) and (ii) actually occurs,</text>
 </clause></subparagraph><subparagraph id="id97320AF254804CA18F4D95003C8459FC"><enum>(B)</enum><text>a nominated area which the Secretary, in consultation with the Secretaries of Labor and Commerce, determines has been or will be seriously impacted by changes in trade through loss of employment (directly or indirectly), taking into account the number of individuals certified as eligible to apply for trade adjustment assistance under chapter 2 of title II of the Trade Act of 1974 or who are receiving benefits under such chapter, or</text>
 </subparagraph><subparagraph id="id3B93878A34C74171987333357AA67051"><enum>(C)</enum><text>a nominated area which satisfies not less than two of the conditions described in paragraph (2).</text>
 </subparagraph></paragraph><paragraph id="id5A39CEA331644C7AAF316CACC212EB9D"><enum>(2)</enum><header>Conditions described</header><text>The conditions described in this subparagraph are the following:</text> <subparagraph id="id7C5F9161BDF14716A47B3B80FBF17925"><enum>(A)</enum><text>The area is designated by the governor of the State as an energy-transitioning community.</text>
 </subparagraph><subparagraph id="id47BA03314D84408DB22282B82B4525A7"><enum>(B)</enum><text>The area, at the time of nomination—</text> <clause id="idE15633CCFCFF46168A0F9FF28778FD92"><enum>(i)</enum><text>has a composite index value, as determined by the Appalachian Regional Commission, among the lowest 10 percent of counties in the State,</text>
 </clause><clause id="id138A3B523BE14748B0F780EBB284A1C5"><enum>(ii)</enum><text>is a low-income community (as defined in section 45D(e)), or</text> </clause><clause id="idC2F5BF7C6B1148F88C98126FBDF69483"><enum>(iii)</enum><text>has an unemployment rate which is 8 percent or greater, or which is 6.5 percent or greater and is equal to or greater than 125 percent of the average unemployment rate of the State.</text>
 </clause></subparagraph><subparagraph id="id12C22CA28AE14564ADE7A0CB18517113"><enum>(C)</enum><text>Tax revenues collected in the area decreased, not due to any changes in tax law or policy, by at least—</text>
 <clause id="id5325F34A91124A55B6F0F6CB442C5747"><enum>(i)</enum><text>7 percent as compared to the preceding year, or</text> </clause><clause id="id49593AEEC36A4511B8B448F2BB72BD8F"><enum>(ii)</enum><text>an average of 10 percent over the preceding 3 years.</text>
 </clause></subparagraph><subparagraph id="id044C9027968845F589E56B7E279C0A53"><enum>(D)</enum><text>The number of business establishments in the area decreased significantly during the preceding year or on average during the preceding 3 years, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="idD43A1250CF084E8393545DCAD9D7F53C"><enum>(E)</enum><text>The area is among the 10 percent of counties nationally which have experienced the largest increases in unemployment and the largest decreases in manufacturing over the preceding 3 years, as determined by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="id84F2E20510AC4AE4A7FAFF40CB48B956"><enum>(3)</enum><header>Energy-transitioning communities</header><text>For purposes of paragraph (2)(A)—</text> <subparagraph id="idF5C97354028E4347BF162B6FBA789E81"><enum>(A)</enum><header>In general</header><text>The term <term>energy-transitioning communities</term> means those nominated areas where the Secretary of Labor, in consultation with the Secretary of Energy, determines there is a high concentration of jobs in industries or at facilities directly affected by an energy source transition.</text>
 </subparagraph><subparagraph id="idA28D5E33F5FC4C958C4B8092D61EF959"><enum>(B)</enum><header>Energy source transition</header><text>For purposes of subparagraph (A), the term <term>energy source transition</term> means—</text> <clause id="id11FF202B22184D40A2D5E5B61BECC731"><enum>(i)</enum><text>a situation in which the occurrence of a shift from the use of a type of fossil fuel to use of other sources of energy is followed by the closing of a facility, or layoff of employees at a facility, that mines, extracts, produces, processes, or utilizes fossil fuels to generate electricity, and</text>
 </clause><clause id="id88DC637657E64F32BD1C92E5C59C005A"><enum>(ii)</enum><text>another situation as determined by the Secretary of Labor, in consultation with the Secretary of Energy, which is indicative of new demands or burdens on affected employees or employees in affected industries due to a significant change in the source of energy used by the facility or industry involved.</text>
 </clause></subparagraph></paragraph><paragraph id="id6B65BDD157614EF3BB2F6AD4765BA627"><enum>(4)</enum><header>Eligibility criteria</header><text>A nominated area shall be eligible for designation under this subsection only if it meets the requirements of section 1392(a)(1) and subparagraphs (A), (B), and (C) of section 1392(a)(3).</text>
 </paragraph></subsection><subsection id="idDCE9B3CAFB054DD1B9BB37EBE3225F31"><enum>(c)</enum><header>Period for which designation is in effect</header><text>Any designation of an area as a community economic assistance zone shall remain in effect during the period beginning on January 1, 2017, and ending on the date that is 5 years after the latest designation of such area as a community economic assistance zone.</text>
 </subsection><subsection id="id2D77D8D469264A7695670BAB35CD8DA7"><enum>(d)</enum><header>Limitation relating to State population</header><text>An area shall not be designated as a community economic assistance zone under subsection (b) if such designation would result in more than 10 percent of the population of the State residing in such a zone (determined by aggregating all such zones within the State).</text>
 </subsection><subsection id="idA74AE9878F4D4930B1D0088E5BE13AB6"><enum>(e)</enum><header>Coordination with treatment of renewal communities, empowerment zones, and enterprise communities</header><text>For purposes of this title, the designation under any other provision of this title of any area as a renewal community, empowerment zone, or enterprise community shall cease to be in effect as of the date that the designation of any portion of such area as a community economic assistance zone takes effect.</text>
							</subsection></section><section id="idE982769FE2194755B5FF841F3AAFE7F6"><enum>1397H.</enum><header>Incentives for community economic assistance zones</header>
							<subsection id="idA541C4957C034510A0766FD8E78FE5FB"><enum>(a)</enum><header>Employment credit</header>
 <paragraph id="idAF2B0B504D6B4A16909E2B85277C47B9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1396 shall be applied—</text> <subparagraph id="id5BABC7A89B544211B405C96F6790F5EA"><enum>(A)</enum><text display-inline="yes-display-inline">by treating any reference to an empowerment zone as a reference to a community economic assistance zone,</text>
 </subparagraph><subparagraph id="id8BD6C8B32FE04C08B7E066958ECB2AA1"><enum>(B)</enum><text>by treating any reference to an employer as a reference to a qualified employer, and</text> </subparagraph><subparagraph id="id519003B8239B470E86D6D47A51F78FD6"><enum>(C)</enum><text display-inline="yes-display-inline">without respect to subsection (d)(1)(B) thereof.</text>
 </subparagraph></paragraph><paragraph id="idF0269211F2EF4829AA0E56D771CB8116"><enum>(2)</enum><header>Qualified zone employer</header><text>For purposes of paragraph (1), with respect to a taxable year, the term <term>qualified employer</term> means any employer other than an excepted taxpayer described in subsection (g).</text> </paragraph></subsection><subsection id="id0146E7C7F89B4647850B207C27D8F7D4"><enum>(b)</enum><header>Increase in expensing under section 179</header> <paragraph id="idAC6E11C890114F0C9C250BFE14C7EA84"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1397A shall be applied—</text>
 <subparagraph id="id19FD911F35B24BD1819A6F2AAFFFB1EE"><enum>(A)</enum><text>by treating any reference to an empowerment zone as a reference to a community economic assistance zone,</text>
 </subparagraph><subparagraph id="idA05C23684B7549479806E984539C50DF"><enum>(B)</enum><text display-inline="yes-display-inline">by treating any reference to an enterprise zone business as a reference to a community economic assistance zone business,</text>
 </subparagraph><subparagraph id="id5799FDC98B41411CA611E9DD40E0B3B8"><enum>(C)</enum><text display-inline="yes-display-inline">by treating any reference to qualified zone property as a reference to qualified community economic assistance zone property, and</text>
 </subparagraph><subparagraph id="idC3EDC39E74B241EB82D0BC5A03C0FA4A"><enum>(D)</enum><text>by substituting <quote>20 percent of such limitation</quote> for <quote>$35,000</quote> in subsection (a)(1)(A) thereof.</text> </subparagraph></paragraph><paragraph id="idC803CB406F6B4534A4DDE876874F12E9"><enum>(2)</enum><header>Community economic assistance zone business</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>community economic assistance zone business</term> means—</text>
 <subparagraph id="id4ECF1D9A52AF4C03BF1A8828D99859C7"><enum>(A)</enum><text display-inline="yes-display-inline">any business entity, and</text> </subparagraph><subparagraph id="id1CEF0A2A704E406F8A5DF34560D9258B"><enum>(B)</enum><text display-inline="yes-display-inline">any proprietorship,</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">other than an excepted taxpayer described in subsection (g), which would be a qualified business
			 entity (as defined in section 1397C(b)) or a qualified
			 proprietorship (as defined in section 1397C(c)) if section 1397C were
			 applied by substituting <quote>community economic assistance zone</quote> for <quote>empowerment zone</quote> each place it appears.</continuation-text></paragraph></subsection><subsection id="id6B7E6C033DC84B16BDDF6E83B49F5FA8"><enum>(c)</enum><header>Nonrecognition of gain on rollover of community economic assistance zone investments</header>
 <paragraph id="id280F8872B4EF434AA1ED2B7EA6496613"><enum>(1)</enum><header>In general</header><text>In the case of any sale of a qualified community economic assistance zone asset held by the taxpayer for more than 1 year and with respect to which such taxpayer elects the application of this subsection, gain from such sale shall be recognized only to the extent that the amount realized on such sale exceeds—</text>
 <subparagraph id="id3C3B81BA128441D18B76184152249581"><enum>(A)</enum><text>the cost of any qualified community economic assistance zone asset (with respect to the same zone as the asset sold) purchased by the taxpayer during the 60-day period beginning on the date of such sale, reduced by</text>
 </subparagraph><subparagraph id="idF08F0EF6E18541559894FB7668ECEB81"><enum>(B)</enum><text>any portion of such cost previously taken into account under this subsection.</text> </subparagraph></paragraph><paragraph id="idA63C5FFC2FA243AC9884B281AC98B4DB"><enum>(2)</enum><header>Definitions and special rules</header><text>For purposes of this subsection—</text>
 <subparagraph id="id51D32061F8B248E191A03059DC1791A6"><enum>(A)</enum><header>Qualified community economic assistance zone asset</header><text>The term <term>qualified community economic assistance zone asset</term> means any property which would be a qualified community asset (as defined in section 1400F(b)) if in section 1400F(b)—</text>
 <clause id="id8E95BB9235104AC799AAF07328C54969"><enum>(i)</enum><text><quote>after December 31, 2016</quote> were substituted for <quote>after December 31, 2001, and before January 1, 2010</quote> each place it appears,</text> </clause><clause id="idD5C6F8E8E4744FE4ABE71950302DD1CE"><enum>(ii)</enum><text><quote>after December 31, 2016</quote> were substituted for <quote>before January 1, 2010</quote> in paragraph (4)(B)(i) thereof,</text>
 </clause><clause id="idF4CEAEC4899B45039F31380F6890D872"><enum>(iii)</enum><text>references to community economic assistance zone businesses (as defined in subsection (b)(2) of this section) were substituted for references to renewal community businesses, and</text>
 </clause><clause id="idA92BDDDE7397491BB5516510D9C3B40C"><enum>(iv)</enum><text>references to community economic assistance zones were substituted for references to renewal communities.</text>
 </clause></subparagraph><subparagraph id="id004355A86EF14E269B7815A937D41EB3"><enum>(B)</enum><header>Other rules</header><text>The rules of paragraphs (2), (3), (4), and (5) of section 1397B(b) shall apply—</text> <clause id="idEEC3607009CF48AFBFEA7C0620D44A50"><enum>(i)</enum><text>by treating any reference to an enterprise zone business as a reference to a community economic assistance zone business (as defined in subsection (b)(2)),</text>
 </clause><clause id="idEFD57B2B27B54C5DAE55D74294F47BEB"><enum>(ii)</enum><text>by treating any reference to a qualified empowerment zone asset as a reference to a qualified community economic assistance zone asset, and</text>
 </clause><clause id="idD4ED62AC4224475B96DD31F9B840FAC6"><enum>(iii)</enum><text>by treating any reference to subsection (a) of section 1397B as a reference to paragraph (1) of this subsection.</text>
 </clause></subparagraph></paragraph><paragraph id="idBB63961E99684839829299FDD855CCF6"><enum>(3)</enum><header>Excepted taxpayers</header><text>Paragraph (1) shall not apply in the case of an excepted taxpayer described in subsection (g).</text> </paragraph></subsection><subsection id="id21FCA39A0EF443F5B3BC7A3EBBF6AB15"><enum>(d)</enum><header>3-Year carryback of net operating losses</header> <paragraph id="idDE6E557AA38E418CB94308E064ECC8E6"><enum>(1)</enum><header>In general</header><text>If a portion of any net operating loss of a taxpayer for any taxable year is a qualified community economic assistance zone loss, section 172(b)(1) shall be applied with respect to such portion—</text>
 <subparagraph id="idC019E6214DE64FA2B1CB870E70A4EDCD"><enum>(A)</enum><text>by substituting <quote>3 taxable years</quote> for <quote>2 taxable years</quote> in subparagraph (A)(i), and</text> </subparagraph><subparagraph id="id1F9314947EF947F6AEA957F5E35DDC75"><enum>(B)</enum><text>by not taking such portion into account in determining any eligible loss of the taxpayer under subparagraph (E) thereof for the taxable year.</text>
 </subparagraph></paragraph><paragraph id="idE42FBB60BC6F4F4089035AB89AAD10DC"><enum>(2)</enum><header>Qualified community economic assistance zone loss</header><text>For purposes of paragraph (1), the term <term>qualified community economic assistance zone loss</term> means the portion of the net operating loss (as defined in section 172(c)) for the taxable year which is attributable to deductions arising from—</text>
 <subparagraph id="id49889BE17A8347ADBBC9E5569EA4ACEE"><enum>(A)</enum><text>losses in a community economic assistance zone,</text> </subparagraph><subparagraph id="idD57B412BE73F4366945EA0F61426B5CD"><enum>(B)</enum><text>expenses paid or incurred within a community economic assistance zone, and</text>
 </subparagraph><subparagraph id="id2757B3C86DF44730BF0CF3EA5104D421"><enum>(C)</enum><text>expenses paid or incurred with respect to property placed in service in a community economic assistance zone,</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">during either the taxable year in which the designation of such zone goes into effect under section
			 1397G or the immediately succeeding taxable year, whichever is elected by
 the taxpayer.</continuation-text></paragraph><paragraph id="id480955831EF246F681D5CB4D22221020"><enum>(3)</enum><header>Excepted taxpayers</header><text>Paragraph (1) shall not apply in the case of an excepted taxpayer described in subsection (g).</text> </paragraph></subsection><subsection id="idFF06D171C62145219F1A3BB16FE0383A"><enum>(e)</enum><header>Credit to holders of community economic support bonds</header> <paragraph id="id8FA2149C13F14978BCC03525A41B23D9"><enum>(1)</enum><header>In general</header><text>With respect to a taxpayer holding a community economic support bond, such bond shall be treated in the same manner as a Gulf tax credit bond under section 1400N(l), applied—</text>
 <subparagraph id="id3EACF143E0894A7CBD8AEC8B12E64BD7"><enum>(A)</enum><text>by substituting <quote>community economic support bond</quote> for <quote>Gulf tax credit bond</quote> each place it appears in paragraphs (1), (2), (3), and (7) thereof, and</text> </subparagraph><subparagraph id="idD48EA48CB7A74B848E52D9263E20732E"><enum>(B)</enum><text>without regard to paragraphs (4) and (5) thereof.</text>
 </subparagraph></paragraph><paragraph id="id1eecbf98b0ea48379d14e4efd648f1e3"><enum>(2)</enum><header>Community economic support bond</header><text>For purposes of this subsection—</text> <subparagraph id="id3cd540603e744b21abbb4402df192b50"><enum>(A)</enum><header>In general</header><text>The term <term>community economic support bond</term> means any bond issued as part of an issue if—</text>
 <clause id="id5d2e608b340b4c888f97978b1149ee1c"><enum>(i)</enum><text>the bond is issued by a State in which a community economic assistance area (as defined in section 45D(f)(3)(B)) is located,</text>
 </clause><clause id="idb0ddb18a256d44d88201e819ed3d23fb"><enum>(ii)</enum><text>95 percent or more of the proceeds of such issue are to be used in accordance with the priorities outlined in the community economic development plan approved under section 6 of the <short-title>Community Economic Assistance Act of 2017</short-title> to implement the strategies and objectives under such plan described in section 6(3) of such Act,</text>
 </clause><clause id="idfac585585c974ff0b3c8fe8e93b256d6"><enum>(iii)</enum><text>the Governor of such State designates such bond for purposes of this subsection,</text> </clause><clause id="id32175a2b66014a43993066870214d0c9"><enum>(iv)</enum><text>the bond is a general obligation of such State and is in registered form (within the meaning of section 149(a)),</text>
 </clause><clause id="id8d911143ac3744ec9c2b177ea4414b09"><enum>(v)</enum><text>the maturity of such bond does not exceed 15 years, and</text> </clause><clause id="id414120a5f986428d88c6b1761f1a1479"><enum>(vi)</enum><text>the bond is issued after the designation of such zone goes into effect under section 1397G, and before such designation ends under section 1397G(c).</text>
 </clause></subparagraph><subparagraph id="id06d98b962f69460ba44bd1a3fda0f909"><enum>(B)</enum><header>Aggregate limit on bond designations</header><text>The maximum aggregate face amount of bonds which may be designated under this subsection by the Governor of a State shall not exceed $100,000,000 per community economic assistance area located in the State.</text>
 </subparagraph><subparagraph id="id2359a0eaae374d279d0d994176e5093f"><enum>(C)</enum><header>Special rules relating to arbitrage</header><text>A bond which is part of an issue shall not be treated as a community economic support bond unless, with respect to the issue of which the bond is a part, the issuer satisfies the arbitrage requirements of section 148 with respect to proceeds of the issue and any loans made with such proceeds.</text>
 </subparagraph></paragraph><paragraph id="idEE33ADD071AF41CBAB316323133EB203"><enum>(3)</enum><header>Excepted taxpayers</header><text>Paragraph (1) shall not apply in the case of an excepted taxpayer described in subsection (g).</text> </paragraph></subsection><subsection id="id8C1B58F584C24841B92BBC52CEDE5F24"><enum>(f)</enum><header>Qualified community economic assistance zone property</header><text>For purposes of this section, the term <term>qualified community economic assistance zone property</term> means any property which would be qualified zone property for purposes of section 1397D if such section were applied by substituting <quote>community economic assistance zone</quote> for <quote>empowerment zone</quote> each place it appears.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idABF40006CD7F4F46B0EAE0A09158534B"><enum>(g)</enum><header display-inline="yes-display-inline">Taxpayers excepted</header><text display-inline="yes-display-inline">With respect to any community economic assistance zone, an excepted taxpayer described in this subsection is—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idC55E2D49B5D649CD89561C93E5E539F4"><enum>(1)</enum><text display-inline="yes-display-inline">an entity that operates a facility in such zone with respect to which a notice under section 3 of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102</external-xref>) was issued, if such notice caused the region to be designated as such a zone, and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90A9796D7D5840F7AB46B0BC090E487A"><enum>(2)</enum><text display-inline="yes-display-inline">any entity that would be treated as a single employer with such an entity under the rules of subsection (a) or (b) of section 52 or subsection (m) or (o) of section 414.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idCE0818391381402280A2101351672D5D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of subchapters for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to subchapter U the following new item:</text>
				<quoted-block id="id191d6b44-4e53-46fb-8052-3a3c39054d55" style="OLC"><toc><toc-entry idref="H46A2E3C882324507B1491AF54B75DB6B" level="subchapter">SUBCHAPTER U–1—Community economic assistance zones</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id6349296DA2A7441FB9749618E9A9B0C2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2016.</text> </subsection></section><section id="idE69C305FA1564D6490E3BF6BE44D0F7C"><enum>3.</enum><header>15-year depreciation for certain rebuilt and retrofitted community economic assistance zone property</header> <subsection id="idBC2B9AC0E86542C290476B9EF24DF793"><enum>(a)</enum><header>In general</header><text>Subparagraph (E) of <external-xref legal-doc="usc" parsable-cite="usc/26/168">section 168(e)(3)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
 <paragraph id="id16A87C237C6447BC82335D43820960D5"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (viii),</text> </paragraph><paragraph id="idE0210CF375D447B88F2D750C7231CF15"><enum>(2)</enum><text>by striking the period at the end of clause (ix) and inserting <quote>, and</quote>, and</text>
 </paragraph><paragraph id="idC440568956064C2A99A6ED69CAE9482D"><enum>(3)</enum><text>by adding at the end the following new clause:</text> <quoted-block act-name="" id="id030912C021FE4CD296BB5F199BE9D0CE" style="OLC"> <clause id="idA45CAC9F23514E2FA316695ACD5FADC6"><enum>(x)</enum><text>any qualified rebuilt or retrofitted community economic assistance zone property.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idC0E20EA7D86C4B1F9D5E32B7E02B23AC"><enum>(b)</enum><header>Qualified rebuilt or retrofitted community economic assistance zone property</header><text>Subsection (e) of <external-xref legal-doc="usc" parsable-cite="usc/26/168">section 168</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

 <subparagraph id="idC49253E53FA64E4D933D7A9E1A7CE1BB"><enum>(A)</enum><header>In general</header><text>The term <term>qualified rebuilt or retrofitted community economic assistance zone property</term> means property placed in service in a community economic assistance zone by a qualified taxpayer during the period the designation of such zone is in effect under section 1397G which relates to the rebuilding or retrofitting of—</text>
 <clause id="id7E920C681FF844A3A05B55FCC50B2D63"><enum>(i)</enum><text>any qualified community economic assistance zone property (as defined in section 1397H(f)), and</text> </clause><clause id="idAF3377B850C54E4D9AFC1EBFEE1184A9"><enum>(ii)</enum><text>any residential real property located in a community economic assistance zone which is acquired by the taxpayer by purchase (as defined in section 179(d)(2)) during such period,</text>
							</clause><continuation-text continuation-text-level="subparagraph">if such property was unoccupied and had been deemed condemned, neglected, or derelict as of the
 time of acquisition by the taxpayer.</continuation-text></subparagraph><subparagraph id="idF203250818234A65BFDFA3664136A257"><enum>(B)</enum><header>Qualified taxpayer</header><text>For purposes of this paragraph, the term <term>qualified taxpayer</term> means a taxpayer other than an excepted taxpayer (within the meaning of section 1397H(g)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="id5AFF5CF0A1224F6183530392778719D1"><enum>4.</enum><header>Increase in start-up expenditures for community economic assistance zone businesses</header><text display-inline="no-display-inline">Paragraph (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/195">section 195(b)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text>
			<quoted-block act-name="" id="id093B4395073D444D8A6843EAEBF44832" style="OLC">
 <paragraph id="id81BD041B566B4369A1261079F862B0BB"><enum>(3)</enum><header>Special rule for community economic assistance zone businesses</header><text>In the case of any start-up expenditures made within a community economic assistance zone during the period the designation of such zone is in effect under section 1397G—</text>
 <subparagraph id="id06823A3175FE4C8C88C75652F207A716"><enum>(A)</enum><text>such expenditures shall be treated separately from other start-up expenditures of the taxpayer for the taxable year, and</text>
 </subparagraph><subparagraph id="idE0F65C2370014C2DA907008FF263FF01"><enum>(B)</enum><text>in determining the deduction under paragraph (1) with respect to such expenditures within such zone, paragraph (1)(A)(ii) shall be applied—</text>
 <clause id="idD1294FC567CF4A55B9ECC140D5097983"><enum>(i)</enum><text>by substituting <quote>$30,000</quote> for <quote>$5,000</quote>, and</text> </clause><clause id="idA6AFBA6C28894A88A75A27ED1C9D197D"><enum>(ii)</enum><text>by substituting <quote>$120,000</quote> for <quote>$50,000</quote>.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="idB3689D07545D4AF089964DAC21A3790C"><enum>5.</enum><header>Increase in new markets tax credit designation for community economic assistance zones</header><text display-inline="no-display-inline">Subsection (f) of <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="id90CDC82FF1FC448EBF0A5C5B57E22E23"><enum>(1)</enum><text>by striking <quote>The limitation</quote> in paragraph (2) and inserting <quote>Except as provided in paragraph (3), the limitation</quote>,</text>
 </paragraph><paragraph id="id9A4E715D6A4D450289A3C4EAC28C001C"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4),</text> </paragraph><paragraph id="idA56713AF86E24E819E125A3B88EE842A"><enum>(3)</enum><text>by inserting after paragraph (2) the following new paragraph:</text>
				<quoted-block act-name="" id="id4DA5D5041FB948DD9C7332FF3B85F258" style="OLC">
					<paragraph id="idFCEFB16773E24A98B6988B73B12B27C1"><enum>(3)</enum><header>Allocation of limitation for calendar years after 2016</header>
 <subparagraph id="idD7CFB1B2856E4F36ADFADE9F49A4F726"><enum>(A)</enum><header>In general</header><text>In the case of any calendar year described in paragraph (1)(G) beginning after December 31, 2016, the limitation under paragraph (1) shall be increased by $500,000,000, and such increase shall be allocated as provided in paragraph (2) among qualified community development entities located in community economic assistance areas.</text>
 </subparagraph><subparagraph id="id86258A4AB3B64B548C39F76BF95EE0C6"><enum>(B)</enum><header>Community economic assistance area</header><text>For purposes of subparagraph (A), the term <term>community economic assistance area</term> means an area which—</text> <clause id="id12916A27AA7741B59A3104E3632646A6"><enum>(i)</enum><text>is a community economic assistance zone, and</text>
 </clause><clause id="id9C1A365D0D0B4DE7BE838A086121FA74"><enum>(ii)</enum><text>has a community economic development plan approved under section 6 of the <short-title>Community Economic Assistance Act of 2017</short-title>.</text> </clause></subparagraph><subparagraph id="idBABB64FDAE4541CC8D3772050A1909A2"><enum>(C)</enum><header>Use of increase</header><text>Any amount of such increase which is so allocated to such an entity shall be used only in accordance with the priorities outlined in such community economic development plan to implement the strategies and objectives under such plan described in section 6(3) of <short-title>Community Economic Assistance Act of 2017</short-title>.</text></subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id6BDC3C18BDE142829D1D6C0F7E0D0EF9"><enum>(4)</enum><text>by striking <quote>paragraph (2)</quote> in paragraph (4), as so redesignated, and inserting <quote>paragraph (2) or (3)</quote>, and</text> </paragraph><paragraph id="id0CCCFA833E674BEA8DD504474D152E6C"><enum>(5)</enum><text>by striking the second sentence of paragraph (4), as so redesignated, and inserting the following: <quote>Any carryover under the preceding sentence of an amount allocated under paragraph (3) shall be allocated first among qualified community development entities located in community economic assistance areas, and may then be allocated among any qualified community development entities selected by the Secretary under paragraph (2). No amount may be carried under the preceding sentences to any calendar year after 2024.</quote>.</text>
 </paragraph></section><section id="idA4E6AD5F50B34E248873A52FD47F3983"><enum>6.</enum><header>Approval of community economic development plans</header><text display-inline="no-display-inline">A community economic development plan for a region shall be considered approved under this section if each of the following criteria are satisfied:</text>
 <paragraph id="id43B694ADC83A41A2B1F99B9E0B6EF0B8"><enum>(1)</enum><text>The plan is submitted to the Secretary of the Treasury in such form, and containing such information, as the Secretary may require.</text>
 </paragraph><paragraph id="id9CAD5EA940614485B697FA31BBB8BCC2"><enum>(2)</enum><text>The plan contains a certification that the plan was developed and approved through a process that included participation from the following:</text>
 <subparagraph id="ide4b4e0bb721a426db5919601a2f98546"><enum>(A)</enum><text>State, Indian tribal, and local governments and agencies or instrumentalities of State, Indian tribal, and local governments.</text>
 </subparagraph><subparagraph id="id9ed31524da2948d5a7e872dbb47df0eb"><enum>(B)</enum><text>State planning boards, workforce investment boards, chambers of commerce, and economic development organizations, if relevant.</text>
 </subparagraph><subparagraph id="idbb5de4b39f494ea297796a29dc155c9f"><enum>(C)</enum><text>Local businesses.</text> </subparagraph><subparagraph id="idd196895a35234b32807291cb62b1a6a5"><enum>(D)</enum><text>Labor and health organizations.</text>
 </subparagraph><subparagraph id="id9f985014b4354e65b2d010305bd853cd"><enum>(E)</enum><text>Public school systems and institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text>
 </subparagraph><subparagraph id="id8dbfe0bf218249179a515896b89a47f2"><enum>(F)</enum><text>Religious and other community-based groups in the region, including those that provide assistance to the workers of the region and the families of the workers.</text>
 </subparagraph><subparagraph id="id35096EAB0BFC477DA9342A7E55AE6F8C"><enum>(G)</enum><text>Other public community institutions, such as library and park systems.</text> </subparagraph><subparagraph id="iddb2db905c7de44d59edd67aec87a3908"><enum>(H)</enum><text>Members of the public, including unemployed or soon to be unemployed workers.</text>
 </subparagraph></paragraph><paragraph id="idF121942647924CDAA176833AC4DA68F2"><enum>(3)</enum><text>The Secretary determines that the plan—</text> <subparagraph id="id583bca41276549c2b0e357fdb73c37a7"><enum>(A)</enum><text>ascertains the severity of an anticipated or existing economic dislocation of the region, including consideration of measures of unemployment rates and employment opportunities;</text>
 </subparagraph><subparagraph id="id4dbb889952b74696a0cef1223e1ea201"><enum>(B)</enum><text>assesses the capacity of the region to respond to such economic dislocation and the needs of the region, as the region undertakes economic advancement or adjustment, including with respect to—</text>
 <clause id="id78F033BD6C4A48F5AAAE5E585590A654"><enum>(i)</enum><text>the diversity of industries in the region;</text> </clause><clause id="id6E0DA2A4C6954A4D913B473AB4A2CF89"><enum>(ii)</enum><text>the skills of the labor force in the region;</text>
 </clause><clause id="id7821d6c9ff0c4ad7bd08bfb52acb5509"><enum>(iii)</enum><text>the condition of the labor market of the region;</text> </clause><clause id="id0dcdbba2100a4e63bf4fdd67617fe36f"><enum>(iv)</enum><text>the availability of financial resources in the region;</text>
 </clause><clause id="idf85d1a17668f4e8b9bf947ce959607c2"><enum>(v)</enum><text>the quality and availability of educational facilities, including 2-year institutions of higher education and vocational institutions, that serve the region; and</text>
 </clause><clause id="id17AD7C59B77142B495CAE991AAD28F03"><enum>(vi)</enum><text>the infrastructure of the region;</text> </clause></subparagraph><subparagraph id="idAAF15FF929474A1CA654506E817B7AF6"><enum>(C)</enum><text>includes a plan to use a local workforce and, when necessary, to train a local workforce;</text>
 </subparagraph><subparagraph id="idb518e3a4bee643b197d20a478c9172fe"><enum>(D)</enum><text>addresses the need of the region to attract investment, create jobs, increase wages, improve educational opportunities, and expand the availability of broadband Internet access;</text>
 </subparagraph><subparagraph id="idb6f688bc2e9f4b7190c5a68727c0f323"><enum>(E)</enum><text>leverages the region's economic strengths and outlines targeted investments to develop competitive advantages to execute the objectives outlined, including a plan to utilize a local workforce and recently dislocated workers and, when necessary, train a local workforce;</text>
 </subparagraph><subparagraph id="id45d2412c2acd4e4ca6b9d23464e9c645"><enum>(F)</enum><text>is the result of collaboration across a wide range of stakeholders;</text> </subparagraph><subparagraph id="id92555045dc5b4fb19d13e02b3d089426"><enum>(G)</enum><text>outlines a strategy which connects the region to drivers of regional economic growth;</text>
 </subparagraph><subparagraph id="idede13aad4d6a485c90042ca3403b9330"><enum>(H)</enum><text>proposes a strategy for focusing on increased access to high quality, affordable, stable housing and improved public safety; and</text>
 </subparagraph><subparagraph id="id3d1bf51bc19f4005976529068b290897"><enum>(I)</enum><text>discusses the anticipated benefits execution of the plan will deliver for community integration, safety, employment outcomes, and home weatherization and energy efficiency, and the expected contribution of the project to the inclusion of individuals with disabilities.</text>
				</subparagraph></paragraph></section><section id="id20BFD76E44B240638843E2BE1F625F60"><enum>7.</enum><header>Grants to carry out assessments required for development of community economic development plans</header>
 <subsection id="idB1F8E864214E4854923AC95B46EC8153"><enum>(a)</enum><header>In general</header><text>The Secretary of the Treasury may award a grant to an eligible entity involved in the development of a community economic development plan described in section 6 to carry out such assessments and other activities as may be required for the plan to meet the requirements of section 6(3).</text>
 </subsection><subsection id="id96661B886AFB4EF2926A3D4524A8550A"><enum>(b)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is a local or Indian tribal government or an agency or instrumentality of such a government.</text>
 </subsection><subsection id="idCFF1D9F33D104E9793555E6D29E1366F"><enum>(c)</enum><header>Grant amount</header><text>The Secretary may not award a grant under this section in excess of $1,000,000.</text> </subsection><subsection id="id85EB846622874A7D86E24995668BE1BC"><enum>(d)</enum><header>Matching requirement</header> <paragraph id="idED2741690D014BBFB08DE53B9B81051B"><enum>(1)</enum><header>In general</header><text>An eligible entity receiving a grant under this section shall provide non-Federal matching funds equal to not less than 20 percent of the amount of the grant.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CAFEF5FB93B4740A2A511FB557937E9"><enum>(2)</enum><header>In-kind support</header><text>Matching funds may include in-kind support.</text> </paragraph></subsection></section><section id="id3845B14C6619424E9A67F82C7C35E0D5"><enum>8.</enum><header>Federal economic support team</header> <subsection id="id98149B59AFC74EBDB73755BD8B101002"><enum>(a)</enum><header>Deployment required</header><text display-inline="yes-display-inline">The Secretary of Commerce shall deploy a targeted investment generating economic recovery team to a region to provide support and assistance to such region if—</text>
 <paragraph id="id0051602F858F4FF2A7D4DAF4A46D23E6"><enum>(1)</enum><text display-inline="yes-display-inline">the Governor of the State requests such deployment; and</text> </paragraph><paragraph id="id1E366563F13446C192263DCF423EADE8"><enum>(2)</enum><text>the Secretary of Commerce determines that the region is experiencing an actual or threatened abrupt rise of unemployment or economic hardship due to the closing or curtailment of a major source of employment, significant industry transition, or other mitigating economic factors, including international trade.</text>
				</paragraph></subsection><subsection id="idf73a6bdb549c4db4892a628e07df3fc9"><enum>(b)</enum><header>Support and assistance</header>
 <paragraph id="id70D73DACCC064A1FB4AD6D7FD7839258"><enum>(1)</enum><header>Development of economic recovery and employment plan</header><text>In providing support and assistance to a region under subsection (a), a targeted investment generating economic recovery team shall work in coordination with a State or regional economic development and workforce agency and the Rapid Response team of the Department of Labor to assist in the development of an economic recovery and employment plan for the region, including by identifying grants, sources of State and Federal funding, and unemployment insurance resources (including short-time compensation) which may be beneficially utilized in the region.</text>
 </paragraph><paragraph id="idA14C7AC684A84F93A345C96747CF16BD"><enum>(2)</enum><header>Cases of facilities shutdown</header><text>In addition to the support and assistance provided under paragraph (1), in a case in which the actual or threatened abrupt rise of unemployment or economic hardship in the region involves the shutdown of a facility of a business unit, the team shall work in coordination with the Administrator of the Small Business Administration to assess the feasibility and advisability of an employee purchase of such business unit.</text>
 </paragraph><paragraph id="id9D32049B3BD444DFA68ABBE40F163A8C"><enum>(3)</enum><header>Coordination</header><text>In addition to the support and assistance provided by a team under paragraph (1) to a region, the team, in coordination with the Secretary of Labor, shall—</text>
 <subparagraph id="id9B1B8CBD455341F890915F21FF6E7444"><enum>(A)</enum><text>coordinate the activities of all Federal agencies relating to the provision of assistance to the region in response to the actual or threatened abrupt rise of unemployment or economic hardship referred to in subsection (a)(2); and</text>
 </subparagraph><subparagraph id="id68BE2BB626314E6DACC9563825859BE1"><enum>(B)</enum><text>act as a liaison between the region and all Federal agencies providing assistance in response to such actual or threatened abrupt rise of unemployment or economic hardship, including, as the case may be, the following:</text>
 <clause id="id05b760bf83a7461890113d76e468e659"><enum>(i)</enum><text>The Department of Agriculture.</text> </clause><clause id="ide93e7bf787774b9c93fbb71914419647"><enum>(ii)</enum><text>The Department of Commerce.</text>
 </clause><clause id="ided8a4edd1e3a4b0584795bff94bc9b98"><enum>(iii)</enum><text>The Department of Defense.</text> </clause><clause id="id07515f7172604fd188f2aeae112e636a"><enum>(iv)</enum><text>The Department of Education.</text>
 </clause><clause id="id089bf81ca3d54f11b96b5f6ee548c6e2"><enum>(v)</enum><text>The Department of Energy.</text> </clause><clause id="id94a95e0a50d540fb8e951012b36312d6"><enum>(vi)</enum><text>The Department of Health and Human Services.</text>
 </clause><clause id="idb67098a10f0949eea74ac3e80b6a7dda"><enum>(vii)</enum><text>The Department of Housing and Urban Development.</text> </clause><clause id="id4cfe51efb51f4a18bde51133b28751e3"><enum>(viii)</enum><text>The Department of Labor.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6618c32837234ae7b4cec5deaf4f2169"><enum>(ix)</enum><text display-inline="yes-display-inline">The Department of Transportation.</text> </clause><clause id="idb48b8d52d02948f1ab049c6da781074c"><enum>(x)</enum><text>The Department of the Treasury.</text>
 </clause><clause id="idf14eaa5e263f4553b6a307bfa98b84a5"><enum>(xi)</enum><text>The National Economic Council.</text> </clause><clause id="id23E330EE3CCC4A90B1C7832104ECED68"><enum>(xii)</enum><text>The Small Business Administration.</text></clause><clause id="idC64C0172CB324409BCFFE26F4403693E"><enum>(xiii)</enum><text>The Department of Veterans Affairs.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
