 <paragraph id="idD5B210EB1D4E46F7BCB8DC299257347B"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency;</text> </paragraph><paragraph id="id6867F35DC7E246EAA62A4F729C52429A"><enum>(2)</enum><text>the terms <term>Federal flood insurance</term> and <term>private flood insurance</term> have the meanings given those terms in section 102(b)(7) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(b)(7)</external-xref>), as amended by section 401(a)(1) of this Act;</text>
 </paragraph><paragraph id="idB8C2CBA962E44946A574EEE15F8D108B"><enum>(3)</enum><text>the term <term>mandatory purchase requirement</term> means the requirement under subsections (a) and (b) of section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>), as amended by section 401 of this Act, to have flood insurance coverage;</text>
 </paragraph><paragraph id="id02891EDB4EF04DA6AF78BDC8289F2350"><enum>(4)</enum><text>the term <term>National Flood Insurance Program</term> means the program established under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B4D5F85084546378708627B08DEB12A"><enum>(5)</enum><text>the term <term>repetitive loss structure</term> has the meaning given the term in section 1370(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121(a)</external-xref>);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id799F14683DD54FFF901C94C5D417640E"><enum>(6)</enum><text>the term <term>severe repetitive loss structure</term> has the meaning given the term in section 1366(h) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c(h)</external-xref>);</text>
 </paragraph><paragraph id="idF3135F638F5B4188831E42D9321C3C47"><enum>(7)</enum><text>the term <term>Standard Flood Insurance Policy</term> means the Standard Flood Insurance Policy set forth in appendix A to part 61 of title 44, Code of Federal Regulations (or any successor regulation);</text>
 </paragraph><paragraph id="id0AB4B10295A64C97AF27AA523AF429A4"><enum>(8)</enum><text>the term <term>target housing</term> means a house structure that—</text> <subparagraph id="idC3F64B2C1EF4450CB4AF28B4C2FF589F"><enum>(A)</enum><text>is in an area that has been identified by the Administrator as an area having special flood hazards; or</text>
 </subparagraph><subparagraph id="idAF5AF89381BE4FCAAC2A6B05A824CA93"><enum>(B)</enum><text>has incurred flood damage;</text> </subparagraph></paragraph><paragraph id="id17ECCEB192DF4104B202837F22DE10BB"><enum>(9)</enum><text>the term <term>Write Your Own company</term> means a private property insurance company that participates in the Write Your Own Program; and</text>
 </paragraph><paragraph id="idC68506207AAE4757A4A284C1DE5B56DE"><enum>(10)</enum><text>the term <term>Write Your Own Program</term> means the program under which the Federal Emergency Management Agency enters into a standard arrangement with private property insurance companies to—</text>
 <subparagraph id="id04707E20369741ECBD568C4F2CBDE04B"><enum>(A)</enum><text>sell contracts for Federal flood insurance under their own business lines of insurance; and</text> </subparagraph><subparagraph id="id3E8158FBE78F426F81A4B03799BFF0DD"><enum>(B)</enum><text>adjust and pay claims arising under the contracts described in subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection id="idDC53B021C17E4970AB53E9730A8120A0"><enum>(b)</enum><header>National Flood Insurance Act</header><text>Section 1370(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121(a)</external-xref>) is amended—</text> <paragraph id="idD549004BD1A7452EB199ABDB862323AB"><enum>(1)</enum><text>in paragraph (14), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id2A8B135781A84EB1AFBE9E2C67443038"><enum>(2)</enum><text>in paragraph (15), by striking the period at the end and inserting a semicolon; and</text> </paragraph><paragraph id="id62278A07A2C145B2AC20EEE379585A7A"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id60D0540C2F5445269DF229F03DD542E6" style="OLC">
 <paragraph id="id143a7c7de89c4f6d83589b08f05b569a"><enum>(16)</enum><text>the term <term>claim report</term> means a report created for the purpose of investigating, adjusting, or processing a claim under the national flood insurance program, including such reports produced by adjusters, engineers, surveyors, salvors, architects, and certified public accountants;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45C2A3E240FA454885D6918C32206CAD"><enum>(17)</enum><text>the term <term>private flood insurance</term> has the meaning given the term in section 102(b) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(b)</external-xref>);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48201ba8b3f6437e9900f59baa687437"><enum>(18)</enum><text>the term <term>Write Your Own company</term> means a private property insurance company that participates in the Write Your Own Program; and</text> </paragraph><paragraph id="id966A4169B005420D8BEA6CA10D743139"><enum>(19)</enum><text>the term <term>Write Your Own Program</term> means the program under which the Federal Emergency Management Agency enters into a standard arrangement with private property insurance companies to—</text>
 <subparagraph id="id96322FF1D07743E3B3D6B4D47711842C"><enum>(A)</enum><text>sell contracts for Federal flood insurance under their own business lines of insurance; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9567EBAD839D4A5DBD2FB4E23138C51C"><enum>(B)</enum><text>adjust and pay claims arising under the contracts described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id3570DC8558A347B791E9530AFFDE47B7"><enum>(c)</enum><header>Technical and conforming amendment</header><text>Section 100202(a) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4004">42 U.S.C. 4004(a)</external-xref>) is amended by striking paragraph (5) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB29DA347CB924D7ABDBD2274BE1DD5D7" style="OLC">
 <paragraph id="id23E6121ED8554C91BA797AE5371352E3"><enum>(5)</enum><header>Write Your Own Program</header><text>The term <term>Write Your Own Program</term> means the program under which the Federal Emergency Management Agency enters into a standard arrangement with private property insurance companies to—</text>
 <subparagraph id="id56490B46A2A64668809A914108F5230E"><enum>(A)</enum><text>sell contracts for Federal flood insurance under their own business lines of insurance; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2210E003FCBA41A980413693CD04A5E0"><enum>(B)</enum><text>adjust and pay claims arising under the contracts described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idE8589A200E0A456694E19BDD6A261783"><enum>4.</enum><header>Extension of national flood insurance program</header>
 <subsection id="id5C82DFA53BED4FEE826253DD2098E209"><enum>(a)</enum><header>Financing</header><text>Section 1309(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4016">42 U.S.C. 4016(a)</external-xref>) is amended, in the first sentence, by striking <quote>September 30, 2017</quote> and inserting <quote>September 30, 2027</quote>.</text>
 </subsection><subsection id="idA0E01D8B06414B7A94C29168AA3F8D8D"><enum>(b)</enum><header>Program expiration</header><text>Section 1319 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4026">42 U.S.C. 4026</external-xref>) is amended by striking <quote>September 30, 2017</quote> and inserting <quote>September 30, 2027</quote>.</text> </subsection></section><title id="id524BBE77FFE94D75897326B4060343BC" style="OLC"><enum>I</enum><header>Enhancing the Solvency and Sustainability of the National Flood Insurance Program</header> <section id="id9A03B150701340808C3E5BF8A1DE7048"><enum>101.</enum><header>Risk transfer</header><text display-inline="no-display-inline">Section 1345 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081</external-xref>) is amended by striking subsection (e) and inserting the following:</text>
				<quoted-block act-name="" id="idFE74F0239B6549A88500A1FDED4039CB" style="OLC">
					<subsection id="id9F900AE170404B92BB86BA43DAD412CD"><enum>(e)</enum><header>Risk transfer</header>
 <paragraph id="idAB0839A4BF0B4AD6A479F390A8A6A86A"><enum>(1)</enum><header>In general</header><text>The Administrator shall annually transfer a portion of the risk associated with the flood insurance program to the private reinsurance or capital markets—</text>
 <subparagraph id="idC9C161A8DF024F7A85DE49797494E1F4"><enum>(A)</enum><text>if the Administrator has determined that the rates and terms of the transfer are reasonable and appropriate; and</text>
 </subparagraph><subparagraph id="idE645CD9A471D42978753E613500C6674"><enum>(B)</enum><text>in an amount that is sufficient to—</text> <clause id="idD22F284E8D224C5FAEFCE907EF6BE46D"><enum>(i)</enum><text>maintain the ability of the program to pay claims; and</text>
 </clause><clause id="id1F1EC81B8E6B4C3D890BF64374D8170E"><enum>(ii)</enum><text>limit the exposure of the program to potential catastrophic losses from extreme events.</text> </clause></subparagraph></paragraph><paragraph id="idBDE4DCCD31E14305A4AE306D8A7A1749"><enum>(2)</enum><header>Forms of transfer</header><text>In carrying out paragraph (1), the Administrator shall consider all forms of risk transfer, including traditional reinsurance, catastrophe bonds, collateralized reinsurance, resilience bonds, and other insurance-linked securities, in order to—</text>
 <subparagraph id="id4E24F312A89D411B8744530F3106F1E4"><enum>(A)</enum><text>maximize pricing competition and the diversity of sources of capital; and</text> </subparagraph><subparagraph id="id0A20E21D6D874814975B4C36A4194FD2"><enum>(B)</enum><text>secure the best value for the flood insurance program.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idDBFB9CD88D5447F388C30F4364829216"><enum>102.</enum><header>Expanded flood insurance participation study</header>
 <subsection id="id126c568da2bf4490bcafca91b9bdeb2f"><enum>(a)</enum><header>In general</header><text>The Administrator, in coordination with the National Association of Insurance Commissioners, shall conduct a study that proposes to address, through programmatic and regulatory changes, how to increase participation in flood insurance coverage, including flood insurance purchased under the National Flood Insurance Program and private flood insurance.</text>
 </subsection><subsection id="id031540070f1c494695a24f2600729558"><enum>(b)</enum><header>Options</header><text>In conducting the study under subsection (a), the Administrator shall consider the following options:</text>
 <paragraph id="id41fd1213644a4a4baa88926440f2e18f"><enum>(1)</enum><text>Expanding participation in flood insurance coverage, beyond areas having special flood hazards, to areas of moderate or minimal flood hazard risk.</text>
 </paragraph><paragraph id="id2eb7ef97a23c4bbf9a95b6acb192c134"><enum>(2)</enum><text>Automatically enrolling consumers in flood insurance while providing consumers the opportunity to decline enrollment.</text>
 </paragraph><paragraph id="id7d099a94b0df4a0a9653bb3370e90be9"><enum>(3)</enum><text>Bundled flood insurance coverage that diversifies risk across all or multiple-peril forms.</text> </paragraph></subsection><subsection id="id72deae97a49842949d55d8f6f38c2be5"><enum>(c)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit a report on the study conducted under subsection (a) to—</text>
 <paragraph id="idB7A5E5C66CDC4574A72FDA367ECF2B97"><enum>(1)</enum><text>the Committee on Banking, Housing, and Urban Affairs of the Senate;</text> </paragraph><paragraph id="idAEB6D5277A994781A5466F441EE9778F"><enum>(2)</enum><text>the Committee on Appropriations of the Senate;</text>
 </paragraph><paragraph id="id7C882DB0CC714139BEF45A5DBF34F5DF"><enum>(3)</enum><text>the Committee on Financial Services of the House of Representatives; and</text> </paragraph><paragraph id="idEDCE1EF895ED45A08825290BB2D2CC0C"><enum>(4)</enum><text>the Committee on Appropriations of the House of Representatives.</text>
					</paragraph></subsection></section></title><title id="idF55F0C35A1AF4C159E7B33117C2E5C3F" style="OLC"><enum>II</enum><header>Enhancing Flood Insurance Affordability and Accessibility </header>
 <section id="id601203FF892742B2A9B767A52765B21B"><enum>201.</enum><header>Use of premium surcharges</header><text display-inline="no-display-inline">Chapter I of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> et seq.) is amended—</text> <paragraph id="id1D48FB34014E4B26AC8CC99769889CA1"><enum>(1)</enum><text>in section 1308A (<external-xref legal-doc="usc" parsable-cite="usc/42/4015a">42 U.S.C. 4015a</external-xref>)—</text>
 <subparagraph id="id08B00E7524FD4E35AEF1288CACEB0B16"><enum>(A)</enum><text>by redesignating subsection (c) as subsection (d);</text> </subparagraph><subparagraph id="id04991B16FD04437983588190146B47F5"><enum>(B)</enum><text>by inserting after subsection (b) the following:</text>

 <subsection id="idF26B22AFEA9B4C4F9463937532E6610B"><enum>(c)</enum><header>Use of surcharges</header><text>The Administrator shall use any surcharge imposed and collected under subsection (a) to help fund flood mitigation programs, including the program established under section 1366.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idF80599EDD3B74AD091102980725E1084"><enum>(C)</enum><text>in subsection (d), as so redesignated, by striking <quote>Subsections (a) and (b)</quote> and inserting <quote>Subsections (a) through (c)</quote>; and</text> </subparagraph></paragraph><paragraph id="idB16F8BC41EDF4B249143DB81CCBA37F3"><enum>(2)</enum><text>in section 1310A(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/4017A">42 U.S.C. 4017A(c)</external-xref>), by striking paragraph (4).</text>
 </paragraph></section><section id="id6575E990A8094F89B1311E46D40808F0"><enum>202.</enum><header>Disclosure with respect to the affordability standard</header><text display-inline="no-display-inline">Section 1308(j) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(j)</external-xref>) is amended, in the second sentence, by inserting <quote>and shall include in the report the number of those exceptions as of the date on which the Administrator submits the report and the location of each policyholder insured under those exceptions, organized by county and State</quote> after <quote>of the Senate</quote>.</text>
			</section><section id="id24F849D79E9F4AF7A088FB7AC3EC4F3A"><enum>203.</enum><header>Flood risk disclosure</header>
 <subsection id="id0CF6CC8D91EF406594FC04D89550A239"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall promulgate regulations for the disclosure of flood risk hazards with respect to any residential or commercial property that is offered for sale or lease.</text>
 </subsection><subsection id="id01DD384052DF4A3CB7113E9EE3A88EEC"><enum>(b)</enum><header>Requirements</header><text>The regulations promulgated under subsection (a) shall require that, before a purchaser or lessee is obligated under any contract to purchase or lease a property, the seller or lessor, as applicable, shall—</text>
 <paragraph id="id63A80D1B762C4EC595325E26F78F8C7B"><enum>(1)</enum><text>provide the purchaser or lessee with a flood risk information pamphlet produced by the Administrator;</text>
 </paragraph><paragraph id="id9F2163E7EA1C438A8FBAA3923A3553B5"><enum>(2)</enum><text>disclose to the purchaser or lessee the available flood risk profile of the property, including—</text>
 <subparagraph id="idFC8DE637DA42414DAA527E56C89ABE38"><enum>(A)</enum><text>information available to the seller or lessor regarding any past—</text> <clause id="id5F2BDC051E5840CA84EBFF62F0767390"><enum>(i)</enum><text>flood damage to the property; or</text>
 </clause><clause id="id875438263BC142C98EAAA58CB3B2F6EA"><enum>(ii)</enum><text>claim for loss with respect to the property under—</text> <subclause id="id07EAA902AF514317B884D5484DD9B1BA"><enum>(I)</enum><text>the National Flood Insurance Program; or</text>
 </subclause><subclause id="id338778F1E9334334B75A7D21D0FD622C"><enum>(II)</enum><text>private flood insurance;</text> </subclause></clause></subparagraph><subparagraph id="idADA79BB53E3C414EA61D77F9554076C7"><enum>(B)</enum><text>information known to the seller or lessor regarding any designation of the property as—</text>
 <clause id="idF0530301C619402E93528A19E1AC2C0B"><enum>(i)</enum><text>a repetitive loss structure; or</text> </clause><clause id="id2A0D1F40780242D0B577EF7F0D2CD39A"><enum>(ii)</enum><text>a severe repetitive loss structure;</text>
 </clause></subparagraph><subparagraph id="id985B0353EA2D44088F00DB8904EA73B3"><enum>(C)</enum><text>any elevation certificate obtained with respect to the property that is available to the seller or lessor; and</text>
 </subparagraph><subparagraph id="id3455FBC37B3A4ACDBC103B39919395F1"><enum>(D)</enum><text>any requirement that the property be covered by flood insurance because the property owner, on the date on which the property is sold or leased, or a previous owner, obtained any form of disaster assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.); and</text>
 </subparagraph></paragraph><paragraph id="id0E3DC2C640BA404BB6C26E07A869222C"><enum>(3)</enum><text>establish a 10-day period (or a period of a different length of time if mutually agreed upon by the parties) during which the purchaser or lessor may review options for managing or mitigating flood risk with respect to the property.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0701A14855C44273B3E4F003B5B01D0C"><enum>(c)</enum><header>Compliance assurance</header><text>The regulations promulgated under subsection (a) shall require that, when a seller or lessor has entered into a contract with an agent to sell or lease a unit of target housing, the agent shall, on behalf of the seller or lessor, ensure compliance with this section.</text>
				</subsection></section><section id="idECE62CD8012D48368304006016E08CD5"><enum>204.</enum><header>Increased cost of compliance</header>
 <subsection id="id105E7CAEBDC146EE8FAF72035ED49A8C"><enum>(a)</enum><header>Increase in limitation on liability</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall amend the Standard Flood Insurance Policy to—</text>
 <paragraph id="id5E9C697D4B0C4884AB31CC95FA6305D7"><enum>(1)</enum><text>increase the limitation on liability relating to <quote>Coverage D—Increased Cost of Compliance</quote> from $30,000 to $75,000; and</text> </paragraph><paragraph id="id634DD91B8203443B8AB6A8E1A5D4CDFD"><enum>(2)</enum><text>provide that 50 percent of the amount described in paragraph (1) shall be available to the insured without regard to whether making that amount available to the insured would exceed the overall policy limit of the insured.</text>
 </paragraph></subsection><subsection id="idEF53DF1827E6485089A92779FA289FBB"><enum>(b)</enum><header>Premiums; coverage limits</header><text>Section 1304(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011(b)</external-xref>) is amended—</text> <paragraph id="id76C737FEF6B44882BAC55D535D974850"><enum>(1)</enum><text>in paragraph (3), by striking <quote>compliance with the land use and control measures.</quote> and inserting <quote>the implementation of such measures; and</quote>;</text>
 </paragraph><paragraph id="idA1816EF82C4941FF9992D6A9BDC26C0E"><enum>(2)</enum><text>in paragraph (4), by redesignating subparagraphs (A) through (D) as clauses (i) through (iv), respectively, and adjusting the margins accordingly;</text>
 </paragraph><paragraph id="id37CAD24B9C5243E883FDAEE357AF7719"><enum>(3)</enum><text>by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and adjusting the margins accordingly;</text>
 </paragraph><paragraph id="id3EF2C1A0B3054A918A77A410D4DEC459"><enum>(4)</enum><text>in the matter preceding subparagraph (A), as so redesignated, by striking <quote>The national</quote> and inserting the following:</text> <quoted-block act-name="" id="id3D8A7F015D64455B960471EF75E730A5" style="OLC"> <paragraph id="id12D0F2B70872485C81C4453C3EB9A80B"><enum>(1)</enum><header>In general</header><text>The national</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idCF4601797A12438FBB0F580F5EBF563B"><enum>(5)</enum><text>by striking the flush text following paragraph (1)(D)(iv), as so redesignated, and inserting the following:</text>
						<quoted-block act-name="" id="idEEC596CFC1984B2FA180663A7A4E5BDE" style="OLC">
 <paragraph id="id284D71F824554FA5A6C1C797231480B2"><enum>(2)</enum><header>Premiums</header><text>The Administrator shall charge a premium on each insured of not more than $75 per policy to provide cost of compliance coverage in accordance with the provisions of this subsection.</text>
 </paragraph><paragraph id="id2D1ADCB22C3241669AE944896EE129F9"><enum>(3)</enum><header>Coverage limits</header><text>Any amount of coverage that is provided under this subsection with respect to a property is in addition to, and shall not be considered for the purposes of, any limitation on coverage that is applicable to the property under section 1306(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="id0F346AED972E406A97F954E75D3BC062"><enum>205.</enum><header>Property risk data</header><text display-inline="no-display-inline">Chapter I of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB1D4B43940114ACEB3C3467A085F1C02" style="OLC">
					<section id="idDE9301408CAC42879140507E24D0EC6B"><enum>1326.</enum><header>Premium credit for submitting property risk data</header>
 <subsection id="idD0D0E91B4D804587ABB1FECEF5CFF3F1"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the Administrator may offer a policyholder under the national flood insurance program a premium credit of not more than $500 if the policyholder submits data and information that is necessary for the Administrator to determine the level of risk of flood with respect to the property covered by the policy as of the date on which the policyholder submits the data and information to the Administrator.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id67864015C0384079860AF5E9120793CF"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The Administrator may offer a premium credit under subsection (a) only once with respect to any building.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id0896C71453E0489CAB0C360346F66806"><enum>206.</enum><header>Mitigation provisions</header>
 <subsection id="id21745DF192014EC69D22EC538F0911A9"><enum>(a)</enum><header>Mitigation strategies</header><text>Section 1361(d)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4102">42 U.S.C. 4102(d)(1)</external-xref>) is amended—</text> <paragraph id="id9EA0AAB2CBB5411BA994C4473007BF21"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id737A406E715048FA8C84A40A1FF2EB19"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end; and</text> </paragraph><paragraph id="id0EC3D63D508A4A80BD2EE25CD1E5ECAD"><enum>(3)</enum><text>by inserting after subparagraph (B) the following:</text>
						<quoted-block act-name="" id="idCC69FD624846439482486AA778DCC950" style="OLC">
 <subparagraph id="id79A376D82D3A41E09894EB8088E07BF8"><enum>(C)</enum><text>with respect to buildings in dense urban environments, methods that can be deployed on a block or neighborhood scale; and</text>
 </subparagraph><subparagraph id="id6693667ABA70485199F2BACE5AA6EC6F"><enum>(D)</enum><text>elevation of mechanical systems; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id50189CE04CF244B08BCAB6EBFC96A2A7"><enum>(b)</enum><header>Mitigation credit</header><text>Section 1308(k) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(k)</external-xref>) is amended—</text>
 <paragraph id="id7C6BEED1A16E4643A1CF56018D94659E"><enum>(1)</enum><text>by striking <quote>shall take into account</quote> and inserting “shall—</text> <quoted-block act-name="" id="idDCFA29A091B1478695054B87DE28A6B3" style="OLC"> <paragraph id="id11E6858C34994C1DA54CDCCCDEB83912"><enum>(1)</enum><text>take into account</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="id23AC73C6DFEF4385883F1743DD3DAD83"><enum>(2)</enum><text>in paragraph (1), as so designated, by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="id8E891B0B10B44DA284130BED5E937FB9"><enum>(3)</enum><text>by adding at the end the following:</text>
						<quoted-block act-name="" id="idE186CF213BD24F0087C761C08B0F1DBA" style="OLC">
 <paragraph id="id4C89FE2C2E23481FAFC942C648CD1989"><enum>(2)</enum><text>offer a reduction of the risk premium rate charged to a policyholder in an amount that is not less than 10 percent of that rate if the policyholder implements any mitigation method described in paragraph (1).</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idA2BA47FD30F743D585FA25B4122B3447"><enum>(c)</enum><header>Coverage for cooperatives</header>
 <paragraph id="id5FC9DFEFAD904C329CA3BA30617060C1"><enum>(1)</enum><header>In general</header><text>Section 1306 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013</external-xref>) is amended by adding at the end the following:</text>
						<quoted-block act-name="" id="id932787252D924825ABDA9F76EB9CE008" style="OLC">
							<subsection id="id549F7D24097241BCB22A5C2485CF79D3"><enum>(e)</enum><header>Cooperatives</header>
 <paragraph id="id94691430B2FD4C86AA316D93C4A01B06"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>cooperative building</term> has the meaning given the term in section 1312(d).</text> </paragraph><paragraph id="idAC3B2ED5FE90476A97B0ABBC29830EF0"><enum>(2)</enum><header>Equal treatment with condominiums</header><text>Notwithstanding any other provision of law, an owner of a share of a cooperative building shall be eligible to purchase flood insurance coverage under the national flood insurance program on the same terms as a condominium owner.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id75E5E74A82764B09828DB402B4077D2D"><enum>(2)</enum><header>Payment of claims</header><text>Section 1312 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019</external-xref>) is amended—</text> <subparagraph id="idD13F3024C9424AFB9203671DBAD864AE"><enum>(A)</enum><text>in subsection (c)—</text>
 <clause id="id4A97DA4A901F49F8A118B18DBA1B6A3F"><enum>(i)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and cooperative</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">condominium</header-in-text></quote>;</text> </clause><clause id="idBB1FFC8724F4475683E84354EFF64663"><enum>(ii)</enum><text>by inserting <quote>or owners of a share of a cooperative building</quote> after <quote>condominium owners</quote>; and</text>
 </clause><clause id="id79F00C9EF00140AB8B0FD824B919CA5D"><enum>(iii)</enum><text>by inserting <quote>or cooperative association</quote> after <quote>condominium association</quote> each place that term appears; and</text> </clause></subparagraph><subparagraph id="id8DF9476BCE5644E5BA32DC365C850CCD"><enum>(B)</enum><text>by adding at the end the following:</text>
							<quoted-block act-name="" display-inline="no-display-inline" id="idB86CF2AFADE141C99141A2D7201CC45A" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="idA31AAE7A21B849B194DD5863A3C5032D"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <term>cooperative association</term> and <term>cooperative building</term> have the meanings given the terms by the Administrator.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection></section><section id="id2D3FDF489DFA4FB58DE5038BCD08FDF0"><enum>207.</enum><header>Home structure values</header> <subsection id="id011DF8679BC64BEF91CA15DCC8060716"><enum>(a)</enum><header>Study and report</header> <paragraph id="idBCF7A6DACF4E4B148D35694E6F7B9833"><enum>(1)</enum><header>Study</header><text>The Administrator shall conduct a study, the purpose of which shall be to—</text>
 <subparagraph id="id57EDDE30D33942D4901D5BDA15246F6A"><enum>(A)</enum><text>evaluate best practices in the insurance industry for risk rating and classification, including practices that consider replacement cost value when estimating premium rates; and</text>
 </subparagraph><subparagraph id="id272918648A084000AEB0C949CD2FA694"><enum>(B)</enum><text>with respect to the estimates made by the Administrator under section 1307(a)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)</external-xref>), as in effect on the day before the date of enactment of this Act—</text>
 <clause id="id933793B8D45F40F9839C942B883FAD64"><enum>(i)</enum><text>assess options, methods, and strategies for including replacement cost value in the estimates;</text> </clause><clause id="id9EF022D65C8F407CAAAAF5246B4142EF"><enum>(ii)</enum><text>identify recommendations for including replacement cost value in the estimates;</text>
 </clause><clause id="id20195AE098514B629E4DD9912CE2B477"><enum>(iii)</enum><text>identify an appropriate methodology by which replacement cost value could be incorporated into the estimates; and</text>
 </clause><clause id="id96576169589A4EC1B4985BF2470D1350"><enum>(iv)</enum><text>develop a feasible implementation plan and projected timeline for including replacement cost value in the estimates.</text>
 </clause></subparagraph></paragraph><paragraph id="idDA272C3A7F6A4F01BE392DBF82DA7CA7"><enum>(2)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that contains—</text>
 <subparagraph id="id0414874208044107B811E7FD1F178508"><enum>(A)</enum><text>the results of the study conducted under paragraph (1) (referred to in this paragraph as <quote>the study</quote>);</text> </subparagraph><subparagraph id="idD8A29BF39606457D9E20A224BC897B90"><enum>(B)</enum><text>an analysis of the recommendations made by the study and the impacts that those recommendations would have on the National Flood Insurance Program, including cost considerations;</text>
 </subparagraph><subparagraph id="id4E922A91020B4596972ECCA9042F4829"><enum>(C)</enum><text>a description of actions taken by the Administrator to implement the recommendations made by the study;</text>
 </subparagraph><subparagraph id="id8CAB66BB792E47A5B0CA019486858ECE"><enum>(D)</enum><text>a list of any recommendations made by the study that, as of the date on which the Administrator submits the report, the Administrator has deferred or upon which the Administrator has not acted; and</text>
 </subparagraph><subparagraph id="idCE95614C190E4488AFF3AC2E277259F0"><enum>(E)</enum><text>an explanatory statement with respect to each recommendation described in subparagraph (D).</text> </subparagraph></paragraph></subsection><subsection id="idB20F8750E1924DF482327EC00FC1801D"><enum>(b)</enum><header>Implementation</header> <paragraph id="idAEA744DF56BD472195E12AAB56450000"><enum>(1)</enum><header>In general</header><text>Section 1307(a)(1)(A) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)(A)</external-xref>) is amended—</text>
 <subparagraph id="id35BAFB89B6AA422FBCAC216B889B5A6F"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id826ABB19D84442AEB07B4D903C989AED"><enum>(B)</enum><text>in clause (ii), by striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text>
 </subparagraph><subparagraph id="idE292A67A99944B848D6B594D205B948D"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" display-inline="no-display-inline" id="idCCAA650BEB1F45F0BB347BC82FA09E85" style="OLC"> <clause commented="no" display-inline="no-display-inline" id="id401DB3EE50B7432EAAE8C428A2B47B38"><enum>(iii)</enum><text>the replacement cost value of an insured structure when determining underinsurance loading factors, consistent with the requirements of section 1308(e) and taking into account the results of the study conducted under section 206(a)(1) of the <short-title>Flood Insurance Affordability and Sustainability Act of 2017</short-title>; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idD37BF7C0ACF945FDA99EF6912827FBBC"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on the date that is 1 year after the date on which the Administrator submits the report under subsection (a)(2).</text>
					</paragraph></subsection></section><section id="id1D2F7F8497944B6FA97D1DCB62ACE706"><enum>208.</enum><header>Affordability vouchers</header>
 <text display-inline="no-display-inline">Chapter I of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> et seq.), as amended by section 205 of this Act, is further amended by adding at the end the following:</text>
				<quoted-block act-name="" id="id1C0F84F584324B0DBE9135ACBE24A5B3" style="OLC">
					<section id="idFC591C884C0E4829B73882E0FC4C2526"><enum>1327.</enum><header>Affordability vouchers</header>
 <subsection id="id4A18D7CEB2DD4B5B9A1031119CBD5A87"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="id2A0FC7F0B63D46609714F850EC920A66"><enum>(1)</enum><text>the term <term>area median income</term> means, with respect to an area, the area median income for the area, as defined for the applicable year by the Secretary of Housing and Urban Development;</text>
 </paragraph><paragraph id="id8F768C4DF5E748B2B36C46DAF07E1AEE"><enum>(2)</enum><text>the term <term>eligible household</term> means an owner-occupied household—</text> <subparagraph id="idE9A6C57D4E284E3EA03F4884FD3CEE45"><enum>(A)</enum><text>that has a total household income that is less than 165 percent of the area median income for the area in which the household is located;</text>
 </subparagraph><subparagraph id="id223F2FE121F54F8EA881C1649D0166C8"><enum>(B)</enum><text>for which the cost of flood insurance premiums, surcharges, and fees in a year would result in excess costs for the household for that year; and</text>
 </subparagraph><subparagraph id="id0C3B8BB98BBD40109CCB42DC193F4EA6"><enum>(C)</enum><text>that—</text> <clause id="idF5120E3E4C634803B6307E0F84D1791D"><enum>(i)</enum><text>renews an existing flood insurance policy under the national flood insurance program for building coverage for a property that is in an area having special flood hazards; or</text>
 </clause><clause id="id93FCC34D2B384221A58C620B9C7A86B7"><enum>(ii)</enum><text>purchases a flood insurance policy under the national flood insurance program for building coverage for an existing structure that was owned and occupied by the household before the date on which the building was determined to be located in an area having special flood hazards due to a revision of, or an update to, a floodplain area or flood risk zone that is identified, delineated, or established by the Administrator;</text>
 </clause></subparagraph></paragraph><paragraph id="id7D3BDE5DFC2F46E7800D30A38D0315B9"><enum>(3)</enum><text>the term <term>excess costs</term> means—</text> <subparagraph id="idA97A4C43E1F54999B1A7586FCEF0C6D0"><enum>(A)</enum><text>for a household that has a total household income that is greater than 80 percent of the area median income for the area in which the household is located, the amount by which—</text>
 <clause id="id83007EAA2A1B42659793D3C44EC53376"><enum>(i)</enum><text>the sum of—</text> <subclause id="id18F08FAFF4C64B6B9EE849EF3BF6D0F6"><enum>(I)</enum><text>the total amount of premiums, surcharges, and fees paid by a household in a year with respect to a flood insurance policy provided under this title; and</text>
 </subclause><subclause id="idA7319319C951484FB88EDA6E3B0365FA"><enum>(II)</enum><text>the housing expenses incurred by the household in that year; exceeds</text>
 </subclause></clause><clause id="id43FB7425A49549098FF6811A2405F733"><enum>(ii)</enum><text>40 percent of the total household income for the household in that year; and</text>
 </clause></subparagraph><subparagraph id="id0C4EFDB112B448B28A40FA788538A910"><enum>(B)</enum><text>for a household that has a total household income that is not greater than 80 percent of the area median income for the area in which the household is located, the amount by which the flood insurance premiums, surcharges, and fees for a flood insurance policy provided under this title in a year for the household exceeds 1 percent of the coverage limit of that flood insurance policy under section 1306(b); and</text>
 </subparagraph></paragraph><paragraph id="id32F8CDC5136645589E65A86EDA7EE2B8"><enum>(4)</enum><text>the term <term>housing expenses</term> means, with respect to a household, the total amount that the household spends in a year on—</text> <subparagraph id="id37746A23B3B94E1FAB0E46EDEA8AF50A"><enum>(A)</enum><text>mortgage payments;</text>
 </subparagraph><subparagraph id="id003005BB4911447689F93EE3151D8F87"><enum>(B)</enum><text>property taxes; and</text> </subparagraph><subparagraph id="idF69D4C5F271644D180A5AE4A9595FA15"><enum>(C)</enum><text>homeowners insurance.</text>
 </subparagraph></paragraph></subsection><subsection id="idD9DA0FFE34D243F2B36DD7BCE22FFC6C"><enum>(b)</enum><header>Vouchers</header><text>The Administrator shall, when the Administrator determines appropriate, provide a voucher to an eligible household in accordance with subsection (c) to use toward the payment of flood insurance premiums, surcharges, and fees incurred by the household in the year for which the voucher is provided.</text>
						</subsection><subsection id="id1817673EDABE435A93CF8AB2B9FA25CB"><enum>(c)</enum><header>Calculation</header>
 <paragraph id="id6B89AAAB38564A458B9ED8E7BDFB5D28"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Administrator shall provide a voucher to an eligible household as follows:</text>
 <subparagraph id="id28901FF4FDB049ED87180FF1EC5CCA07"><enum>(A)</enum><text>An eligible household that has a total household income that is not greater than 80 percent of area median income shall receive a voucher in an amount that is equal to 100 percent of the excess costs incurred by the household for the year preceding the year in which the eligible household receives the voucher.</text>
 </subparagraph><subparagraph id="id26A965EB582C43C18AB3D601C3A04DF1"><enum>(B)</enum><text>An eligible household that has a total household income that is greater than 80 percent of area median income and not greater than 120 percent of area median income shall receive a voucher in an amount that is equal to 80 percent of the excess costs incurred by the household for the year preceding the year in which the eligible household receives the voucher.</text>
 </subparagraph><subparagraph id="id954E4080489C42CEA0B888416BB8A716"><enum>(C)</enum><text>An eligible household that has a total household income that is greater than 120 percent of area median income and less than 165 percent of area median income shall receive a voucher in an amount that is equal to 60 percent of the excess costs for the year preceding the year in which the eligible household receives the voucher.</text>
 </subparagraph></paragraph><paragraph id="id034407FF09F34B7E9022E0B13AFD2E4B"><enum>(2)</enum><header>Limitation</header><text>The Administrator may not provide a voucher to an eligible household in an amount that is more than the total amount that the eligible household paid in premiums, surcharges, and fees for a flood insurance policy provided under this title during the year preceding the year in which the voucher is provided.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id1E00482B6F4E483EB2121A7C30DA946D"><enum>209.</enum><header>Coverage limits</header>
 <subsection id="id8E70C07FA7F8445FB8B0FE670EBC3E56"><enum>(a)</enum><header>In general</header><text>Section 1306 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013</external-xref>) is amended—</text> <paragraph id="id93548AE8213F4E28B03772D55A9F0B85"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="idEBABA295EAAC4913B7E2FBD7DFB4379A"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>In addition to any other terms and conditions under subsection (a), such regulations</quote> and inserting <quote>The Administrator</quote>;</text> </subparagraph><subparagraph id="id8C1BF054CC12473BA644675A0A895785"><enum>(B)</enum><text>in paragraph (2)—</text>
 <clause id="id38AA749B437449A3BBC0635637710605"><enum>(i)</enum><text>by striking <quote>shall be made</quote> and inserting <quote>may be made</quote>; and</text> </clause><clause id="id3EDE5CE78DED4064BB70FD87D2E9152D"><enum>(ii)</enum><text>by striking <quote>$250,000</quote> and inserting <quote>the baseline amount</quote>;</text>
 </clause></subparagraph><subparagraph id="idEB3088D7182249E2BF371F493AE695B8"><enum>(C)</enum><text>in paragraph (3)—</text> <clause id="idDD49920FF14B4BDE9B42A098368574E0"><enum>(i)</enum><text>by striking <quote>shall be made</quote> and inserting <quote>may be made</quote>; and</text>
 </clause><clause id="id7EAD2213F70B4A449847D9101090E5BE"><enum>(ii)</enum><text>by striking <quote>$100,000</quote> and inserting <quote>50 percent of the baseline amount</quote>; and</text> </clause></subparagraph><subparagraph id="idA47778A0BE8C44F0A8BB00BC4974F29C"><enum>(D)</enum><text>in paragraph (4)—</text>
 <clause id="id307EAE806DA34E6DB9412F105DBF5A3C"><enum>(i)</enum><text>by striking <quote>shall be made</quote> each place that term appears and inserting <quote>may be made</quote>; and</text> </clause><clause id="id972AAC0D594C436C98F33A97ED273164"><enum>(ii)</enum><text>by striking <quote>$500,000</quote> each place that term appears and inserting <quote>200 percent of the baseline amount</quote>; and</text>
 </clause></subparagraph></paragraph><paragraph id="id78C2BB31B0944F71895057C3FC0C8EAF"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="idE93D585155FF4D6CADD902AB9C6E281E" style="OLC"> <subsection id="idEFFDB26005654FA9A0B4750D236A80B6"><enum>(e)</enum><header>Definition</header> <paragraph id="id0650076BB7AE4E2F9178CD443DB6186C"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), in this section, the term <term>baseline amount</term>, with respect to a property, means the maximum original principal obligation of a conventional mortgage that may be purchased by the Federal National Mortgage Association in the area in which the property as located, as established under section 302(b)(2) of the Federal National Mortgage Association Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1717">12 U.S.C. 1717(b)(2)</external-xref>).</text>
 </paragraph><paragraph id="idA47F0CBB7F9E48DBA1EFEF096033ABB0"><enum>(2)</enum><header>Clarification</header><text>If, after the date of enactment of this subsection, the baseline amount, as defined in paragraph (1), decreases as compared with the baseline amount in effect on the day before the date of enactment of this subsection, the baseline amount that was in effect on the day before the date of enactment of this subsection shall be deemed to be the baseline amount for the purposes of paragraphs (2), (3), and (4) of subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id4FAD3391C27449E09563DF473ADA9A9B"><enum>(b)</enum><header>Authority of Administrator To sell policies</header><text>The Administrator may sell a policy for flood insurance under the National Flood Insurance Program that meets the requirements of paragraphs (2), (3), and (4) of section 1306(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013(b)</external-xref>), as amended by subsection (a), without regard to—</text>
 <paragraph id="id58804019237348908BE3861A2FF8B6AD"><enum>(1)</enum><text>section 61.6 of title 44, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act; or</text>
 </paragraph><paragraph id="idD25C6374AF6A4201A4DEBDE7A8916516"><enum>(2)</enum><text>any other provision of law.</text> </paragraph></subsection></section><section id="idC51B02638DAD4AE08E4800A851DBAA41"><enum>210.</enum><header>Monthly installment payment of premiums</header> <text display-inline="no-display-inline">Section 1308(g) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(g)</external-xref>) is amended—</text>
 <paragraph id="id3B49E7098A564F85B9F31A263D1CD9D3"><enum>(1)</enum><text>by striking <quote>With respect to</quote> and inserting the following:</text> <quoted-block act-name="" id="id674A81ABF6FF4F2FB3F156C8A32C60D5" style="OLC"> <paragraph id="id3DEBBF7AF2DE404B889C506A1374FCF5"><enum>(1)</enum><header>Annual or monthly option</header><text>Subject to paragraph (2), with respect to</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id602E7AC8D44C47089B95913580BA12EB"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="idD24515B4712340A29FE550B6EE014606" style="OLC"> <paragraph id="id2110BDDB06564D27B9425F2FC4E718AA"><enum>(2)</enum><header>Monthly installment</header><text>With respect to a policyholder that opts under paragraph (1) to pay premiums on a monthly basis, the Administrator may charge the policyholder an annual fee of not more than $15.</text>
 </paragraph><paragraph id="id7D6D02269CEB4C0E8B3750FC7DEDCB9B"><enum>(3)</enum><header>Exemption from rule making; pilot program</header><text>During the period beginning on the date of enactment of this paragraph and ending on the date on which the Administrator promulgates regulations carrying out paragraph (1), the Administrator may, notwithstanding any other provision of law—</text>
 <subparagraph id="id8F6C8B8F13E64487B039BC75C16932A4"><enum>(A)</enum><text>adopt policies and procedures to carry out that paragraph without—</text> <clause id="id938D9CC94F954A2490EC5EEFBB37E900"><enum>(i)</enum><text>undergoing notice and comment rule making under section 553 of title 5, United States Code; or</text>
 </clause><clause id="id41AD51437B7A440C94EDE7C6BFD7440E"><enum>(ii)</enum><text>conducting regulatory analyses otherwise required by statute, regulation, or Executive order; or</text> </clause></subparagraph><subparagraph id="id3251640009D744709578BDCD02683910"><enum>(B)</enum><text>carry out that paragraph by establishing a pilot program that gradually implements the requirements of that paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="idEC291D7DB5F046A08A9A08B40A283FBF" style="OLC"><enum>III</enum><header>Agreed Value Pilot Program</header>
 <section id="idffd1ab02aae140169f4cd18f319740cd"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Agreed Value Flood Protection Program Act of 2017</quote>.</text> </section><section id="ida21ada893ff74deaa272efb6b9c44a99"><enum>302.</enum><header>Definitions</header> <text display-inline="no-display-inline">In this title—</text>
 <paragraph id="idFD5857F44C0A45CEB8D397A7E71F353A"><enum>(1)</enum><text>the term <term>agreed value flood protection policy</term> means a flood protection policy providing that, if a flood occurs, the National Flood Insurance Program will make payments according to agreed schedules of payments determined by flood height in covered structures participating in the Program;</text>
 </paragraph><paragraph id="idC64D31EB875A498BBC9603F790A2E3CD"><enum>(2)</enum><text>the term <term>catastrophic loss year</term> means a year in which the combined ratio is not less than 130 percent;</text> </paragraph><paragraph id="idF6E31C87BA4246C3BB319E9C89DE1330"><enum>(3)</enum><text>the term <term>combined ratio</term> means the quotient obtained when the sum obtained by adding the losses paid under the National Flood Insurance Program in a year and the expenses of the National Flood Insurance Program in that year is divided by the total amount of premiums collected under the National Flood Insurance Program in that year;</text>
 </paragraph><paragraph id="id5CDFA0931729487DB60D7003CF8D424D"><enum>(4)</enum><text>the term <term>covered agent</term> means any insurance agent, producer, or intermediary licensed by a State;</text> </paragraph><paragraph id="idF5A69BC802BA43798E9DBB0C795E7499"><enum>(5)</enum><text>the term <term>covered structure</term> means real property eligible for flood insurance coverage under the National Flood Insurance Program;</text>
 </paragraph><paragraph id="id792F31C065B542B1902B48FC01BC4EB9"><enum>(6)</enum><text>the term <term>eligible participant</term> means a person that has demonstrated ownership of a covered structure;</text> </paragraph><paragraph id="id904273CD045546DB8FBB8A6125F045E3"><enum>(7)</enum><text>the term <term>flood height</term> means the distance between the lowest adjacent grade and the high water mark of a flood on the first floor of a covered structure, as measured or as determined by other appropriate methods;</text>
 </paragraph><paragraph id="id523C81160AB5467BA10883AB1F4657C2"><enum>(8)</enum><text>the term <term>Program</term> means the Agreed Value Flood Protection Program established under section 303(a); and</text> </paragraph><paragraph id="id13CC51E8FD454787A58DBB7C4A3C2155"><enum>(9)</enum><text>the term <term>Reserve Fund</term> means the Agreed Value Flood Protection Program Reserve Fund established under section 305(a).</text>
				</paragraph></section><section id="id455a8605bd1e404e80806cfe30c8e35c"><enum>303.</enum><header>Agreed Value Flood Protection Pilot Program</header>
 <subsection id="id6B58C558476F41D99C28E9CFCA508131"><enum>(a)</enum><header>In general</header><text>The Administrator may establish and carry out an optional Agreed Value Flood Protection Pilot Program for the 8-year period beginning on the date of enactment of this Act, or during the period beginning on the date of enactment of this Act and ending on the date on which authorization for the National Flood Insurance Program expires, whichever is shorter, under which—</text>
 <paragraph id="idE97EC20C25A644BF9520127ED0910490"><enum>(1)</enum><text>an eligible participant may purchase an agreed value flood protection policy to protect against losses resulting from physical damage to, or loss of, a covered structure, including any personal property related thereto, owned by the eligible participant arising from a flood occurring in the United States during the period for which the policy is in force;</text>
 </paragraph><paragraph id="id82700CC9E73D49A58BEDDFB3FA3922EF"><enum>(2)</enum><text>a covered agent may issue an agreed value flood protection policy to an eligible participant; and</text> </paragraph><paragraph id="idE343BA6541B4423797ECCFFEA54F2628"><enum>(3)</enum><text>an eligible participant may not be denied the opportunity to purchase an agreed value flood protection policy solely on the basis of the geographic location of the eligible participant.</text>
 </paragraph></subsection><subsection id="idFBBB7361D3DA4924BDEC365FEE7B9109"><enum>(b)</enum><header>Eligibility</header><text>In order to purchase an agreed value flood protection policy, an eligible participant shall demonstrate that the value of the covered structure to be covered under the policy, including any contents within the covered structure, is not less than the coverage amount of the policy.</text>
				</subsection><subsection id="id46838337D9A44B9AAD808FCA5CC8AE48"><enum>(c)</enum><header>Issuance</header>
 <paragraph id="idF1DD268614804D219070B3A6C9EE28A7"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), any covered agent may issue an agreed value flood protection policy to an eligible participant under the Program.</text>
 </paragraph><paragraph id="idC614D0B5633C4352B965E25481DD349D"><enum>(2)</enum><header>Exception</header><text>A covered agent may not issue a policy under paragraph (1) if the structure with respect to which the policy would apply is insured under the National Flood Insurance Program.</text>
					</paragraph></subsection><subsection id="id1720199eb5cf41d09f95ca0182ef0adb"><enum>(d)</enum><header>Brochure</header>
 <paragraph id="id3659732F3DC9456FADDE155C52427308"><enum>(1)</enum><header>In general</header><text>The Administrator shall publish a brochure that compares the premium rates charged under the National Flood Insurance Program with the premium rates charged under the Program.</text>
					</paragraph><paragraph id="idD2339F704BFE43E8B40ADD14E6F50A6D"><enum>(2)</enum><header>Covered agents</header>
 <subparagraph id="idDFA0A253978C4A5987F2C9A8F6F15A8D"><enum>(A)</enum><header>In general</header><text>A covered agent shall explain to an eligible participant the risks associated with an agreed value flood protection policy before the eligible participant purchases a policy.</text>
 </subparagraph><subparagraph id="id8514B69DB2104C3F8197EE08888E2B94"><enum>(B)</enum><header>Delivery</header><text>If a covered agent delivers the brochure published under paragraph (1) to an eligible participant before the eligible participant purchases an agreed value flood protection policy, the delivery shall constitute prima facie evidence that the covered agent has satisfied the requirement under subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection id="idE0E1AB6A972340EE848C33DAA69880D6"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date on which the Program ends, the Administrator shall submit to Congress a report—</text>
 <paragraph id="idFEC5DE41A19645BDA467B5572119634A"><enum>(1)</enum><text>containing data that was collected during the administration of the Program relating to underinsurance factors, claims statistics, claims disputes (including how such disputes were adjudicated), and actuarial rate reviews; and</text>
 </paragraph><paragraph id="idBBE2EBDAE6D6484C9E552850B9170515"><enum>(2)</enum><text>that compares premium rates charged under the Program with comparable premium rates charged under the standard flood insurance policy, controlling for comparable risk factors.</text>
					</paragraph></subsection></section><section id="id7ca247fb22374de49b4977611399d4ef"><enum>304.</enum><header>Use of agreed value flood protection to satisfy requirement to purchase flood insurance to receive
 a mortgage loan</header><text display-inline="no-display-inline">An agreed value flood protection policy shall satisfy the mandatory purchase requirement.</text> </section><section id="id13365875c04e48e289cc03ffc3129a8a"><enum>305.</enum><header>Agreed Value Flood Protection Program Reserve Fund</header> <subsection id="id5af1b43129934007ae1ddc471e921316"><enum>(a)</enum><header>Establishment of an agreed value flood protection reserve fund</header><text>In carrying out the Program, the Administrator shall establish in the Treasury of the United States an Agreed Value Flood Protection Program Reserve Fund, which shall be—</text>
 <paragraph id="idb675fa14e5564804801c1801c44becd4"><enum>(1)</enum><text>separate from any other accounts or funds available to the Administrator; and</text> </paragraph><paragraph id="iddfef93cff24c4f66bb39bef969d18872"><enum>(2)</enum><text>available for meeting the expected future obligations of the Program, including—</text>
 <subparagraph id="idd9da8a02546f4e559279cf8cfe214064"><enum>(A)</enum><text>the payment of claims during catastrophic loss years; and</text> </subparagraph><subparagraph id="id01f83d0918194ef681cdbda6823a4850"><enum>(B)</enum><text>the repayment of amounts outstanding under any note or other obligation issued by the Administrator under section 1309(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4016">42 U.S.C. 4016(a)</external-xref>).</text>
 </subparagraph></paragraph></subsection><subsection id="id958c895d6ea64ac1805519b532f6069b"><enum>(b)</enum><header>Reserve ratio</header><text>Subject to the phase-in requirements under subsection (d), the Reserve Fund shall maintain a balance that, together with any risk financing covering the Program, is an amount that is equal to—</text>
 <paragraph id="id394ff82db5094858981d1bd2c622b644"><enum>(1)</enum><text>1.5 percent of the sum of the total potential loss exposure of all outstanding agreed value flood protection policies in force during the prior fiscal year; or</text>
 </paragraph><paragraph id="id66827a712271400997828286a179e8be"><enum>(2)</enum><text>a higher percentage of the sum described in paragraph (1) that the Administrator determines to be appropriate, taking into consideration any circumstance that may raise a significant risk of substantial future losses to the Reserve Fund.</text>
					</paragraph></subsection><subsection id="id9ca5b0e2b4804e188a0c0b677d8d62e0"><enum>(c)</enum><header>Maintenance of reserve ratio</header>
 <paragraph id="id06614c08ef684f26993e515679156911"><enum>(1)</enum><header>In general</header><text>The Administrator may establish, increase, or decrease the amount of aggregate annual policy charges to be collected for any fiscal year that are necessary in order to—</text>
 <subparagraph id="id8aff72c237554c1bbad2ca779c2c53be"><enum>(A)</enum><text>maintain the amount required under subsection (b); and</text> </subparagraph><subparagraph id="id43fb65d2db89458d8ac4e1c5daf0d5a0"><enum>(B)</enum><text>if the balance of the Reserve Fund is an amount that is less than the amount required under subsection (b), obtain the amount required under subsection (b).</text>
 </subparagraph></paragraph><paragraph id="ida233421921d849b98fb90a34fe458517"><enum>(2)</enum><header>Considerations</header><text>In exercising the authority under paragraph (1), the Administrator shall consider—</text> <subparagraph id="idccf8aab0e08a43ac93daf7af89c8aaba"><enum>(A)</enum><text>the expected operating expenses of the Reserve Fund;</text>
 </subparagraph><subparagraph id="id11cd1781f1f74c1eb9dac3aec4f1af04"><enum>(B)</enum><text>the covered loss expenditures under the Program;</text> </subparagraph><subparagraph id="ida722c42c8eeb4df1bedb31b1e9769597"><enum>(C)</enum><text>any investment income generated under the Program; and</text>
 </subparagraph><subparagraph id="ide400956da4ca4c4cbc35ca7315c0e1c6"><enum>(D)</enum><text>any other factor that the Administrator determines appropriate.</text> </subparagraph></paragraph><paragraph id="idbef5324da3a84fa08f0c61972d05954f"><enum>(3)</enum><header>Limitation</header><text>Notwithstanding any other provision of law or any agreement entered into by the Administrator, the Administrator shall ensure that all amounts attributable to the establishment or increase of annual policy charges under paragraph (1) are transferred to the Administrator for deposit into the Reserve Fund to be available for meeting the expected future obligations of the Program, as described in subsection (a)(2).</text>
 </paragraph></subsection><subsection id="id2fa7ce2358ef4d018ba58fbb091c605c"><enum>(d)</enum><header>Phase-In requirements</header><text>The phase-in requirements under this subsection are as follows:</text> <paragraph id="id9b58caa8c33949a0b607d1792093c41e"><enum>(1)</enum><header>In general</header><text>Beginning in fiscal year 2018, and in each successive fiscal year thereafter until the amount required under subsection (b) is obtained, the Administrator shall deposit in the Reserve Fund an amount that is not less than 10 percent of the amount required under subsection (b).</text>
 </paragraph><paragraph id="id71df771e377e4068867a09878a842c68"><enum>(2)</enum><header>Amount satisfied</header><text>Except as provided in paragraph (3), beginning on the date on which the amount required under subsection (b) is obtained, the Administrator shall not be required to set aside any amounts for the Reserve Fund.</text>
 </paragraph><paragraph id="id7c26c596bb9246c7bdde941b2828ebc6"><enum>(3)</enum><header>Exception</header><text>If, at any time during any fiscal year after the amount required under subsection (b) is obtained, the amount in the Reserve Fund is less than the amount required under subsection (b), the Administrator shall deposit in the Reserve Fund during that fiscal year an amount that is not less than the lesser of—</text>
 <subparagraph id="id22CF3571B9974E689F1BC240AD340E47"><enum>(A)</enum><text>the difference between the amount required under subsection (b) and the amount in the Reserve Fund; or</text>
 </subparagraph><subparagraph id="id22978A3D5FA44931B4937A41C493F334"><enum>(B)</enum><text>10 percent of the amount required under subsection (b).</text> </subparagraph></paragraph></subsection><subsection id="ida3ebc1437cd949f4a0f07f881ddd8edd"><enum>(e)</enum><header>Limitation on reserve ratio</header><text>If, in any fiscal year, the Administrator determines that the amount required under subsection (b) cannot be obtained, the Administrator shall submit to Congress a report that—</text>
 <paragraph id="idbe4b618348b044e48a959c2fa5423fdf"><enum>(1)</enum><text>describes and details the specific concerns of the Administrator regarding the consequences of that amount not being obtained;</text>
 </paragraph><paragraph id="id4cb2ddc6678a4f1583fcddc7ea8b7065"><enum>(2)</enum><text>demonstrates how the consequences described in paragraph (1) would harm the long-term financial soundness of the Program; and</text>
 </paragraph><paragraph id="ida7b52df15a264623aabd0a17f6f5859b"><enum>(3)</enum><text>indicates the maximum attainable amount for that fiscal year.</text> </paragraph></subsection><subsection id="idb8a64dea76d947748a0c06884ccde760"><enum>(f)</enum><header>Investment</header><text>The Secretary of the Treasury shall invest such amounts of the Reserve Fund as the Secretary determines advisable in obligations issued or guaranteed by the United States.</text>
				</subsection></section><section id="idF8972D72E5B044CDA8CB1D949C662876"><enum>306.</enum><header>Rule of construction</header>
 <text display-inline="no-display-inline">Nothing in this title may be construed to—</text> <paragraph id="id90F9AF4B9FC2434CB1BC979864F1B4DB"><enum>(1)</enum><text>limit the National Flood Insurance Program, including the ability of a person to purchase flood insurance under the National Flood Insurance Program to satisfy the mandatory purchase requirement; or</text>
 </paragraph><paragraph id="idBD2B9BF5597A4346A70621DC4D31BC91"><enum>(2)</enum><text>require a person to participate in the Program.</text> </paragraph></section></title><title id="id9CFEDBA81E404AA8B98EB0EB4C317A5E" style="OLC"><enum>IV</enum><header>Providing private market access, accountability, and competition</header> <section id="ida50e02df71994f0dafd933a6a5c6a48c"><enum>401.</enum><header>Use of private flood insurance to satisfy mandatory purchase requirement</header> <subsection id="id33E35873CB51486C8387CD87904F0938"><enum>(a)</enum><header>In general</header> <paragraph id="ide11dd78710da41ae9ee009476c438545"><enum>(1)</enum><header>Mandatory purchase requirement</header> <subparagraph id="id7b4473cd229540a0912487259726da61"><enum>(A)</enum><header>Amount and term of coverage</header><text>Section 102 of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a</external-xref>) is amended by striking <quote><header-in-text level="section" style="traditional"><enum-in-header>S</enum-in-header>ec. </header-in-text> 102. (a)</quote> and all that follows through the end of subsection (a) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="idee2a2537e3cd480aae81342d37ca8b6c" style="traditional">
								<section id="id205b90702a0a4242930be5ce26d0cba0"><enum>102.</enum><subsection commented="no" display-inline="yes-display-inline" id="id543d7ef55a4e445aaa55457ae1281d51"><enum>(a)</enum><header>Amount and term of coverage</header>
 <paragraph id="idBE7F8A553D8F4FF0A053D5664ECBE04C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), on and after the date that is 60 days after the date of enactment of this Act, no Federal officer or agency may approve any financial assistance for acquisition or construction purposes for use in any area that has been identified by the Administrator as an area having special flood hazards and in which the sale of flood insurance has been made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.), unless the building or mobile home and any personal property to which the financial assistance relates is covered by flood insurance.</text>
										</paragraph><paragraph id="idF45BFEA9EBD147B4B50D0942F35E263A"><enum>(2)</enum><header>Amount and term</header>
 <subparagraph id="id823B00B249EB48939CD7ADCE0099C8C1"><enum>(A)</enum><header>Amount generally</header><text display-inline="yes-display-inline">The amount of flood insurance required under paragraph (1)—</text> <clause id="idC6D3E1396EEA4A40ABD75B84F0B6D6F3"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of Federal flood insurance, shall be not less than the lesser of—</text>
 <subclause id="idBEEDB6339F0C44B6AC7D2439D9A8C0F7"><enum>(I)</enum><text>80 percent of the purchase price of the property;</text> </subclause><subclause id="id0403255270CF49D5A9ADF6E2A3F41F5E"><enum>(II)</enum><text display-inline="yes-display-inline">the development or project cost of the building, mobile home, or personal property (less estimated land cost);</text>
 </subclause><subclause id="idDBC5CA61C1444E41916BD0258051E76B"><enum>(III)</enum><text display-inline="yes-display-inline">the maximum limit of Federal flood insurance coverage made available with respect to the particular type of property; or</text>
 </subclause><subclause id="idCFC457D7B1074D6786E0C77AFE2F5903"><enum>(IV)</enum><text>for multi-unit structures only, the outstanding principal balance of the loan; or</text> </subclause></clause><clause id="id27E19E2ADCC24DA9BEA7FDABDB3FF05E"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of private flood insurance, shall be not less than the lesser of—</text>
 <subclause id="idA9795F2D337A4D5B9233346026431FAC"><enum>(I)</enum><text>80 percent of the purchase price of the property;</text> </subclause><subclause id="id5D2BA514C3A44609BABA992ACF95D4BD"><enum>(II)</enum><text display-inline="yes-display-inline">the development or project cost of the building, mobile home, or personal property (less estimated land cost);</text>
 </subclause><subclause id="idDCD2175DA86649CC80D5E26E422A52B1"><enum>(III)</enum><text display-inline="yes-display-inline">the maximum limit of Federal flood insurance coverage made available with respect to the particular type of property; or</text>
 </subclause><subclause id="id9219E13E207B4F3482CE73C3B3C8A8A6"><enum>(IV)</enum><text>for multi-unit structures only, the outstanding principal balance of the loan.</text> </subclause></clause></subparagraph><subparagraph id="idC8789DEE640443A4B2CF02C99BBD24E4"><enum>(B)</enum><header>Loans and insured and guaranteed loans</header><text>If the financial assistance described in paragraph (1) is in the form of a loan or an insurance or guaranty of a loan, flood insurance need not be required beyond the term of the loan.</text>
 </subparagraph><subparagraph id="id69EE5C682CDB4AD5B829AF77C574F456"><enum>(C)</enum><header>Term generally</header><text display-inline="yes-display-inline">The requirement of maintaining flood insurance under paragraph (1) shall apply during the life of the property, regardless of transfer of ownership of the property.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id12fa3874e71a4882a3cd241553bf3486"><enum>(B)</enum><header>Mortgage loans</header><text>Section 102(b) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(b)</external-xref>) is amended—</text>
 <clause id="id7618634e97be444b90e0b1f3401d9c58"><enum>(i)</enum><text>by striking paragraphs (1) through (5) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="id572A989AE13A49A6B998E81DFA9AA06D" style="traditional">
									<paragraph id="id6971c1c02c3a441e8490fc8d7218ef55"><enum>(1)</enum><header>Regulated lending institutions</header>
 <subparagraph id="id106E2356CF704D9CB3213A1DE5DA1CD2"><enum>(A)</enum><header>In general</header><text>Each Federal entity for lending regulation (after consultation and coordination with the Financial Institutions Examination Council established under section 1004 of the Federal Financial Institutions Examination Council Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/3303">12 U.S.C. 3303</external-xref>)) shall by regulation direct regulated lending institutions not to make, increase, extend, or renew any loan secured by improved real estate or a mobile home located or to be located in an area that has been identified by the Administrator as an area having special flood hazards and in which flood insurance has been made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.), unless the building or mobile home and any personal property securing the loan is covered for the term of the loan by flood insurance in an amount described in subparagraph (B).</text>
 </subparagraph><subparagraph id="id5778945E582642D58F71DE8A8C9F7842"><enum>(B)</enum><header>Amount</header><text>The amount of flood insurance required under subparagraph (A)—</text> <clause id="idB0FC298C75194C52BB16B8EF1ECCF07A"><enum>(i)</enum><text>in the case of Federal flood insurance, shall be not less than the lesser of—</text>
 <subclause id="idB4C69E2BAE64473399D7431C60DA3106"><enum>(I)</enum><text>80 percent of the purchase price of the property;</text> </subclause><subclause id="idD8F8BEADED4541C2B240E5971330CEF7"><enum>(II)</enum><text>the maximum limit of Federal flood insurance coverage made available with respect to the particular type of property; or</text>
 </subclause><subclause id="id4E53817B5A364851B470625B0D0BD5D5"><enum>(III)</enum><text>for multi-unit structures only, the outstanding principal balance of the loan; or</text> </subclause></clause><clause id="id646326AD59C841459BA1B6735138B286"><enum>(ii)</enum><text>in the case of private flood insurance, shall be not less than the lesser of—</text>
 <subclause id="idEB067300E5834CFA8D4354D957DCBE11"><enum>(I)</enum><text>80 percent of the purchase price of the property;</text> </subclause><subclause id="idFFEBC028F63348CA80EE3820BADBFF56"><enum>(II)</enum><text>the maximum limit of Federal flood insurance coverage made available with respect to the particular type of property; or</text>
 </subclause><subclause id="id0A8CB45C395D41C7A2F2DBF842BF84AE"><enum>(III)</enum><text>for multi-unit structures only, the outstanding principal balance of the loan.</text> </subclause></clause></subparagraph></paragraph><paragraph id="id7c24c31ead0f4889b17bc0be17aebf44"><enum>(2)</enum><header>Federal agency lenders</header> <subparagraph id="id223940b012a3497592ee142d6f3645b0"><enum>(A)</enum><header>In general</header> <clause id="id29D20D2C280844F6B0ECB4647C758290"><enum>(i)</enum><header>Insurance required</header><text>A Federal agency lender may not make, increase, extend, or renew any loan secured by improved real estate or a mobile home located or to be located in an area that has been identified by the Administrator as an area having special flood hazards and in which flood insurance has been made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.), unless the building or mobile home and any personal property securing the loan is covered for the term of the loan by flood insurance in accordance with paragraph (1).</text>
											</clause><clause id="id5A7912A7ABC04450AE21104F80EA707C"><enum>(ii)</enum><header>Regulations</header>
 <subclause id="id2011D7A917DC461CB84DF846035B9800"><enum>(I)</enum><header>In general</header><text>Each Federal agency lender may issue any regulations necessary to carry out this paragraph.</text>
 </subclause><subclause id="id58656936BB99464EACA1F73B6A4C39B0"><enum>(II)</enum><header>Consistency</header><text>Any regulations issued under subclause (I) shall be consistent with and substantially identical to any regulations issued under paragraph (1).</text>
 </subclause></clause></subparagraph><subparagraph id="id13f7c7e7970c479080998c4591116c6a"><enum>(B)</enum><header>Requirement to accept flood insurance</header><text>Each Federal agency lender shall accept flood insurance as satisfaction of the flood insurance coverage requirement under subparagraph (A)(i) if the flood insurance coverage meets the requirements for coverage under that subparagraph.</text>
										</subparagraph></paragraph><paragraph id="idcb3d51ed8bac46ad89ad5a80edb76350"><enum>(3)</enum><header>Government-sponsored enterprises for housing</header>
										<subparagraph id="id207CC34DE77F4D9F8121312C36EE0030"><enum>(A)</enum><header>Implementation of procedures</header>
 <clause id="id6842CC014746464CA592BF63F954A9DC"><enum>(i)</enum><header>Requirement</header><text>The Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation shall implement procedures reasonably designed to ensure that, for any loan described in clause (ii) that is purchased or guaranteed by such entity, the building or mobile home and any personal property securing the loan is covered for the term of the loan by flood insurance in the amount provided in paragraph (1)(B).</text>
 </clause><clause id="id7F9BAC5CC7CC47499BC88C084D9DDFDF"><enum>(ii)</enum><header>Secured loan</header><text>A loan described in this clause is a loan secured by improved real estate or a mobile home located in an area—</text>
 <subclause id="idc88d06e787ca45f69d3de14138d92a39"><enum>(I)</enum><text>that has been identified, at the time of the origination of the loan or at any time during the term of the loan, by the Administrator as an area having special flood hazards; and</text>
 </subclause><subclause id="id42D0E7090D614373832E899B9A00FB4E"><enum>(II)</enum><text>in which flood insurance is made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.).</text>
												</subclause></clause></subparagraph><subparagraph id="idd483854dde824d279a1f5ed8e6640bc1"><enum>(B)</enum>
 <header>Acceptable insurance</header><text>Subject to subparagraph (C), the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation shall accept flood insurance as satisfaction of the flood insurance coverage requirement under paragraph (1) if the flood insurance coverage provided meets the requirements for coverage under that paragraph and any requirements established by the Federal National Mortgage Association or the Federal Home Loan Corporation, respectively, relating to the financial strength of private insurance companies from which the Federal National Mortgage Association or the Federal Home Loan Mortgage Corporation will accept private flood insurance.</text>
 </subparagraph><subparagraph id="id664CC808223D4298BA7E79201A58397F"><enum>(C)</enum><header>Relation to State law</header><text>A requirement described in subparagraph (B) may not affect or conflict with any State law, regulation, or procedure concerning the regulation of the business of insurance.</text>
										</subparagraph></paragraph><paragraph id="iddb53d4a00cbb455b99f956f320a4cff8"><enum>(4)</enum><header>Applicability</header>
 <subparagraph id="id5577dd6e53c44e8aab2388927012df7e"><enum>(A)</enum><header>Existing coverage</header><text>Except as provided in subparagraph (B), paragraph (1) shall apply on the date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="idd0ce81dee9ca4bc08884315ff1f5e157"><enum>(B)</enum><header>New coverage</header><text>Paragraphs (2) and (3) shall apply only with respect to any loan made, increased, extended, or renewed after the expiration of the 1-year period beginning on the date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701</external-xref> et seq.). Paragraph (1) shall apply with respect to any loan made, increased, extended, or renewed by any lender supervised by the Farm Credit Administration only after the expiration of the period under this subparagraph.</text>
 </subparagraph><subparagraph id="id04b9d0ea10024b1aa3a93832fd459d7b"><enum>(C)</enum><header>Continued effect of regulations</header><text>Notwithstanding any other provision of this subsection, the regulations to carry out paragraph (1), as in effect immediately before the date of enactment of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701</external-xref> et seq.), shall continue to apply until the regulations issued to carry out paragraph (1), as amended by section 522(a) of such Act, take effect.</text>
										</subparagraph></paragraph><paragraph id="id45fe1dca19ed449a9db6711a1bdd3542"><enum>(5)</enum><header>Rule of construction</header>
 <subparagraph id="id1424F0BE8B974E6AB7ACA0137D3BD3BA"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), nothing in this subsection shall be construed to supersede or limit the authority of a Federal entity for lending regulation, the Federal Housing Finance Agency, a Federal agency lender, the Federal National Mortgage Association, or the Federal Home Loan Mortgage Corporation to establish requirements relating to the financial strength of private insurance companies from which the entity or agency will accept private flood insurance.</text>
 </subparagraph><subparagraph id="id0682126C6DE242DCACB09EC867182E82"><enum>(B)</enum><header>Relation to State law</header><text>A requirement described in subparagraph (A) may not affect or conflict with any State law, regulation, or procedure concerning the regulation of the business of insurance.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="idba5816886c7343b591c8cf0a4245169d"><enum>(ii)</enum><text>by striking paragraph (7) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id1D054F027024451884FEA654FDF1023C" style="traditional"> <paragraph id="ida501c542b4e04f9eb4bc9a940a4bc5cb"><enum>(7)</enum><header>Definitions</header><text>In this section:</text>
 <subparagraph id="id1b7ada5c0b684fb79c5afc273349cdf2"><enum>(A)</enum><header>Federal flood insurance</header><text>The term <term>Federal flood insurance</term> means an insurance policy made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="id098dcfd47487430385ef716561354bc4"><enum>(B)</enum><header>Flood insurance</header><text>The term <term>flood insurance</term> means—</text> <clause id="idcc39f2b2f06a47e4b5c145b36e1737a7"><enum>(i)</enum><text>Federal flood insurance; and</text>
 </clause><clause id="id5765414cc078412ba636af9f9ce399cf"><enum>(ii)</enum><text>private flood insurance.</text> </clause></subparagraph><subparagraph id="id3b99befa84644272b8a2e355626abcf5"><enum>(C)</enum><header>Private flood insurance</header><text>The term <term>private flood insurance</term> means an insurance policy that—</text>
 <clause id="idfe660b378f694304a644839058c41612"><enum>(i)</enum><text>is issued by an insurance company that is—</text> <subclause id="idf65ff10cc8fc47a291a1ee0215f5903a"><enum>(I)</enum><text>licensed, admitted, or otherwise approved to engage in the business of insurance in the State in which the insured building is located, by the insurance regulator of that State; or</text>
 </subclause><subclause id="id050957b6b14549998f10d5ef25fe0c03"><enum>(II)</enum><text>eligible as a nonadmitted insurer to provide insurance in the home State of the insured, in accordance with sections 521 through 527 of the Nonadmitted and Reinsurance Reform Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/15/8201">15 U.S.C. 8201</external-xref> through 8206);</text>
 </subclause></clause><clause id="id140b72a0e67d46818f65032d535cdad7"><enum>(ii)</enum><text>is issued by an insurance company that is not otherwise disapproved as a surplus lines insurer by the insurance regulator of the State in which the property to be insured is located; and</text>
 </clause><clause id="id8dd9214cdb5c4638afbb221a058dd25d"><enum>(iii)</enum><text>provides flood insurance coverage that complies with the laws and regulations of that State.</text> </clause></subparagraph><subparagraph id="ide6efdb5c3c254a6f849ef8719392efd1"><enum>(D)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the Northern Mariana Islands, the Virgin Islands, and American Samoa.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="id08b5b677f9164c819d253dc87cd4a19d"><enum>(2)</enum><header>Effect of private flood insurance coverage on continuous coverage requirements</header><text>Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idA9ADE20C70384A8BB9D3AC52B8B84C17" style="traditional">
 <subsection id="id2a8b6809cfa14365849645c74e029aba"><enum>(n)</enum><header>Effect of private flood insurance coverage on continuous coverage requirements</header><text>For purposes of applying any statutory, regulatory, or administrative continuous coverage requirement, including under section 1307(g)(1), the Administrator shall consider any period during which a property was continuously covered by private flood insurance to be a period of continuous coverage.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAF24DFCCB50748FDA44393670E183E6E"><enum>(b)</enum><header>Report on level of perceived adverse selection</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to Congress a report on the extent to which, of the properties that are required to satisfy the mandatory purchase requirement, the properties for which private flood insurance is purchased tend to be at a lower risk of flooding than the properties for which Federal flood insurance is purchased (commonly referred to as <quote>adverse selection</quote>), by detailing risk classifications of private flood insurance policies.</text>
				</subsection></section><section id="id31f2a10edb3f4854ae16fc1e42b8288e"><enum>402.</enum><header>Provision of private flood insurance by write your own companies</header>
				<subsection id="id9985f806b41a4eb9af23a37b3a8968e2"><enum>(a)</enum><header>Temporary authority for provision of private flood insurance by Write Your Own companies for
 certain properties</header><text>During the first 2 years beginning after the date of enactment of this Act, the Administrator may not prohibit a Write Your Own company from offering or selling private flood insurance outside of the Write Your Own Program for properties that are described in subparagraphs (A) through (D) of section 1307(a)(2) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(2)</external-xref>).</text>
 </subsection><subsection id="idca0fe61dbf114c5bbcc39f7a0f9525fd"><enum>(b)</enum><header>Authority for expanded provision of private flood insurance by Write Your Own companies</header><text>On and after January 1 of the third year beginning after the date of enactment of this Act, if the Administrator determines, based on the report required under subsection (d)(1) and any other independent data available, that the provision of private flood insurance by a Write Your Own company—</text>
 <paragraph id="id715D70FD419B4245A808CEBE3A1FD8C6"><enum>(1)</enum><text>to properties in addition to the properties described in subsection (a) will not adversely impact the ability of the National Flood Insurance Program to maintain a diverse risk pool, the Administrator may waive any remaining restriction, under a Federal statute or regulation, on the ability of a Write Your Own company to offer or sell private flood insurance outside the Write Your Own Program, if the Administrator promulgates regulations to ensure a diverse risk pool for Write Your Own companies that are competing with the National Flood Insurance Program; or</text>
 </paragraph><paragraph id="id4dae8136618a472ead2b5adb63633289"><enum>(2)</enum><text>is a deterrent to the National Flood Insurance Program maintaining a diverse risk pool of policies, the Administrator may place further restrictions on the ability of a Write Your Own company to offer or sell private flood insurance.</text>
 </paragraph></subsection><subsection id="id7ad9838ac345479582d55a26042b6f7a"><enum>(c)</enum><header>WYO Arrangement</header><text>The Administrator shall amend article XIII of the WYO Company Financial Assistance/Subsidy Arrangement as necessary to implement subsections (a) and (b).</text>
				</subsection><subsection id="idba91187131104d3eaf1f5b1fcbf975a8"><enum>(d)</enum><header>Reports</header>
 <paragraph id="id97C7718347B545159B2F3350DD8E6DD3"><enum>(1)</enum><header>Initial report</header><text>Not later than the last day of the 2-year period described in subsection (a), the Administrator shall submit to Congress a report detailing the risk classifications of properties for which private flood insurance was sold and underwritten by Write Your Own companies during that 2-year period.</text>
 </paragraph><paragraph id="id2B786EDA42054C5A95C88E1873E6ABB4"><enum>(2)</enum><header>Additional report</header><text>Not later than 5 years after the date on which the report is required to be submitted under paragraph (1), the Administrator shall submit to Congress a report detailing the risk classifications of properties for which private flood insurance was sold and underwritten by Write Your Own companies during that 5-year period.</text>
					</paragraph></subsection></section><section id="ida4d49ea752264fe7a1190311c0f3663d"><enum>403.</enum><header>Availability of NFIP claims data</header>
				<subsection id="idbbe98af4fca64bc8b7b1ce0d2a20d3ad"><enum>(a)</enum><header>Study required</header>
 <paragraph id="idF8AE804D9A434FD1891B2CDCAA0F5E45"><enum>(1)</enum><header>In general</header><text>The Administrator shall study the feasibility of selling or licensing the use of historical structure-specific National Flood Insurance Program claims data (referred to in this section as <term>covered claims data</term>) to nongovernmental entities.</text>
 </paragraph><paragraph id="idA19E311361A449E5AB9AEFAA27368E8F"><enum>(2)</enum><header>Contents</header><text>In conducting the study required under paragraph (1), the Administrator shall, at a minimum—</text> <subparagraph id="id29a0c92906f246f1b2b07165006bf2f3"><enum>(A)</enum><text>investigate one or more methods of providing the most specific covered claims data possible while reasonably protecting policyholder privacy;</text>
 </subparagraph><subparagraph id="ida102e079a38c4d57bc4f2e7c249cd84a"><enum>(B)</enum><text>review existing means, as of the date of enactment of this Act, by which the Federal Government provides leases or licenses to private persons, and the various regulations, terms, conditions, and guidance employed;</text>
 </subparagraph><subparagraph id="id6fd4ed37d39a42babf76625bbcc1bd30"><enum>(C)</enum><text>identify potential uses for covered claims data, any known risks concerning those uses, and ways to mitigate or eliminate the risks;</text>
 </subparagraph><subparagraph id="id5df160f1a93042798e8908719462edd7"><enum>(D)</enum><text>identify mechanisms for determining the likely market value for access to covered claims data; and</text> </subparagraph><subparagraph id="id56fb414e3db6456787a1afa6be9b87fb"><enum>(E)</enum><text>recommend actions the Administrator could take, if any, to prevent unintended consequences associated with the sale or licensing for private insurance purposes covered claims data.</text>
						</subparagraph></paragraph></subsection><subsection id="id1c354f0a2f7c4f4da04943cde925d5a1"><enum>(b)</enum><header>Report by Administrator</header>
 <paragraph id="ida37c924f792847c2885fad17a4681e0c"><enum>(1)</enum><header>Report required</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that contains the results and conclusions of the study conducted under subsection (a) (referred to in this subsection as <term>the study</term>).</text>
 </paragraph><paragraph id="idd69b7a019fbe43e19b917b98d1eea0bf"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall include—</text> <subparagraph id="idfb0ce2987533488e9e475c9aa087468f"><enum>(A)</enum><text>an analysis of—</text>
 <clause id="id74A4B258DBA84F6C982CBF2B79CB62A3"><enum>(i)</enum><text>the recommendations of the study; and</text> </clause><clause id="idC3145334C9EC41469C0B4E95F98E4FFD"><enum>(ii)</enum><text>the potential for covered claims data to increase the number of individuals insured against the peril of flood, to reduce the amount of debt the National Flood Insurance Program is required to service, or both;</text>
 </clause></subparagraph><subparagraph id="id58e4bae7221446c8a3006bba2f9cafea"><enum>(B)</enum><text>a description of actions taken by the Administrator to implement any of the recommendations of the study; and</text>
 </subparagraph><subparagraph id="id031774accd8f46e79441dfcc1c4794e7"><enum>(C)</enum><text>any recommendations of the study that, as of the date on which the report is submitted, have been deferred or not acted upon, together with an explanatory statement.</text>
						</subparagraph></paragraph></subsection><subsection id="idc53588a5fbe749959c406d08028d776b"><enum>(c)</enum><header>Authorization To sell or license claims data</header>
					<paragraph id="idD96D635111824CEAB64F75F233666C81"><enum>(1)</enum><header>Amendments</header>
 <subparagraph id="id7f5c20f6dde3412fa0b1dd9ee868d15f"><enum>(A)</enum><header>In general</header><text>Section 1313 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4020">42 U.S.C. 4020</external-xref>) is amended—</text> <clause id="id4f797cc5cb0f4390a29f5280507b767b"><enum>(i)</enum><text>by striking <quote>The Administrator</quote> and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="id7C6D0FAA4F4941308F837A23A093610D" style="OLC">
 <subsection id="id1E1108FDB019464182C97FCE51536AAB"><enum>(a)</enum><header>In general</header><text>The Administrator</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </clause><clause id="id0aa3ecec2e404c50ae7dcd34aafaa564"><enum>(ii)</enum><text>by adding at the following:</text>
								<quoted-block display-inline="no-display-inline" id="id7A17DC29EA4442CEBEC3B81FEBB46049" style="OLC">
									<subsection id="id6f7602a535a94172bfb950c0f41ebcc5"><enum>(b)</enum><header>Selling or licensing of claims data</header>
 <paragraph id="id6ece68b7aec746a7bc4e2614ae7ce82c"><enum>(1)</enum><header>In general</header><text>The Administrator may sell or license the use of historical structure-specific claims data obtained and maintained by the National Flood Insurance Program (referred to in this subsection as <term>covered claims data</term>) to nongovernmental entities as the Administrator determines is appropriate and in the public interest.</text>
 </paragraph><paragraph id="id086f2a65284b4cbb81bd08ea8e601541"><enum>(2)</enum><header>Rules, procedures</header><text>The Administrator may adopt rules, terms, conditions, policies, and procedures concerning—</text> <subparagraph id="id6469de93b98f40f982c8bf4ef1b6a1f5"><enum>(A)</enum><text>the selling or licensing of covered claims data; and</text>
 </subparagraph><subparagraph id="id90450a30193b4f718e780a6d9b754202"><enum>(B)</enum><text>the use, protection, and maintenance of covered claims data by nongovernmental entities.</text> </subparagraph></paragraph><paragraph id="id24604dc21b7643f5b236e6ced06a2c87"><enum>(3)</enum><header>Proceeds</header><text>The Administrator shall deposit the proceeds from selling or licensing covered claims data under this subsection in the National Flood Insurance Fund.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="id6c6e278421b1471a99b23d311f753908"><enum>(B)</enum><header>Funding</header><text>Section 1310 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4017">42 U.S.C. 4017</external-xref>) is amended—</text> <clause id="idf70ffa52d282431ab7610335f248d0a3"><enum>(i)</enum><text>in subsection (a)—</text>
 <subclause id="id61688d3ad7404551a72ee2320c8a33ef"><enum>(I)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text> </subclause><subclause id="id0205bf9a6ed1432883c838e6ded58ef0"><enum>(II)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </subclause><subclause id="id1aa2201684b24ec599ab03817dd32d70"><enum>(III)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id0CA4AD8E45FC45BA85FC37B37E140524" style="OLC"> <paragraph id="idd2199e850ea84358bc7497f1d2b4bec8"><enum>(9)</enum><text>for carrying out section 1313.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subclause></clause><clause id="id8162a19129c04a7e8c3bf4f5593f35a8"><enum>(ii)</enum><text>in subsection (b)—</text> <subclause id="idb3912aeeceb24e5982d89f31475e6ced"><enum>(I)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text>
 </subclause><subclause id="id5456A83640CA4AF3BF939C5ED7607B96"><enum>(II)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text> </subclause><subclause id="id2a83151938f048b1b1c46354b64756ac"><enum>(III)</enum><text>by inserting after paragraph (5) the following:</text>
									<quoted-block display-inline="no-display-inline" id="idC705278F8A34414EB2EE8F77564AD20B" style="OLC">
 <paragraph id="id467014692e2a4f32b0431585f513239f"><enum>(6)</enum><text>proceeds from the sale or licensing of historical structure-specific claims data, as authorized under section 1313(b); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</subclause></clause></subparagraph></paragraph><paragraph id="id9ff840ecf2e94583b50e04fdcb1db5bc"><enum>(2)</enum><header>Effective date</header>
 <subparagraph id="idB55D644E16D848438CDCA8EE86721755"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amendments made by paragraph (1) shall take effect on the date on which the Administrator publishes in the Federal Register a certification that the Administrator has—</text>
 <clause id="id766b5618dc114bbdba33781f0421c606"><enum>(i)</enum><text>submitted the report required under subsection (b);</text> </clause><clause id="id1bc63fde1b0e441c9027f9617cc5fe08"><enum>(ii)</enum><text>determined that it is legally and practically feasible to implement a program to sell or license the use of covered claims data to nongovernmental entities; and</text>
 </clause><clause id="idde622e8b1bed4f8da07c405a0f2a141e"><enum>(iii)</enum><text>determined that a program described in subparagraph (B) would be in the public interest.</text> </clause></subparagraph><subparagraph id="idF2D21D38120F4B558B4D4A6FE5EB7463"><enum>(B)</enum><header>Credits to Fund</header><text>The amendment made by clause (ii) of paragraph (1)(B) shall take effect on the date of enactment of this Act.</text>
						</subparagraph></paragraph></subsection></section><section id="id6a4368b1e346481f8a03b216c4119757"><enum>404.</enum><header>Fees and surcharges for private flood insurance policies</header>
 <subsection id="id00db407704434a4f90163f0146951cbe"><enum>(a)</enum><header>Surcharges</header><text>Section 1308A(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015a">42 U.S.C. 4015a(a)</external-xref>) is amended—</text> <paragraph id="id0c0aafed0be74e8397275b5db0ddd721"><enum>(1)</enum><text>by striking <quote>The Administrator</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id745895be2c9d4c2684a62aa1a83ab571" style="OLC">
 <paragraph id="id1d6874e9c66e4ef09d707c3c6995de96"><enum>(1)</enum><header>Collection on nfip policies</header><text>The Administrator</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id979141c0879d447db56e394edfd4eb1a"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id52783aff3c5244b28844bafe47364722" style="OLC">
							<paragraph id="idc79cd2cb291d4e5fbc097b16f126a8a2"><enum>(2)</enum><header>Collection on private policies</header>
 <subparagraph id="ida29407dd414a40ba847404394ede2237"><enum>(A)</enum><header>In general</header><text>An insurance company that issues a policy for private flood insurance shall impose and collect an annual surcharge, in the amount provided in subsection (b), on a private flood insurance policy.</text>
 </subparagraph><subparagraph id="id21ae8c459f874cdea604cf6c7f7222fd"><enum>(B)</enum><header>In addition to increased cost of compliance surcharge</header><text>The surcharge imposed under subparagraph (A) shall be in addition to the surcharge imposed under section 1304(c) and any other assessments and surcharges applied to such coverage.</text>
 </subparagraph><subparagraph id="id6e9699ecbc9a46f49f1c0a4b05fe66e2"><enum>(C)</enum><header>Federal equivalency fee payable to administrator</header><text>Not later than 180 days after the date on which an insurance company collects a surcharge under subparagraph (A), the insurance company shall transfer the amount of the surcharge to the Administrator, who shall deposit the amount in the National Flood Insurance Fund established under section 1310.</text>
 </subparagraph><subparagraph id="id0e4eeaa16bb443d4b4f80122c89a2edd"><enum>(D)</enum><header>Information</header><text>The Administrator may require the provision of such information as the Administrator decides is necessary to verify that a surcharge imposed and collected under subparagraph (A) has been imposed and collected at the proper time and in the proper amount.</text>
 </subparagraph><subparagraph id="id79c38413aa2d4ca8a374646e9dc258cf"><enum>(E)</enum><header>Cost of collecting surcharge</header><text>No portion of the surcharge collected under subparagraph (A) may be retained by the insurance company for the costs of collecting, handling, or remitting the surcharge except for interest accruing to the company after collection and before remittance.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id772a200881d140269d69b59a61ce0314"><enum>(b)</enum><header>Federal policy fee</header><text>Section 1307(a) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)</external-xref>) is amended—</text> <paragraph id="id5b4d34b14243451b94b24072715cb434"><enum>(1)</enum><text>in paragraph (1)(B)(iii), by striking <quote>shall be recovered by</quote> and all that follows and inserting “shall be recovered—</text>
						<quoted-block display-inline="no-display-inline" id="id7c9fb09cb71d4b77bd02d11916a9e531" style="OLC">
 <subclause id="idad5c9ef1a59b4e0cadfa70d0f6d67d64"><enum>(I)</enum><text>in the case of a policy under the national flood insurance program, by a fee that—</text> <item id="id85cb024d56e74104b5956d236b773b9c"><enum>(aa)</enum><text>shall be charged to policyholders; and</text>
 </item><item id="idafd6b557598e4f1fbb1c9e059e7fa2bb"><enum>(bb)</enum><text>shall not be subject to any agents’ commissions, company expense allowances, or State or local premium taxes; and</text>
 </item></subclause><subclause id="idc2be2e420216447e841f334e47f3d954"><enum>(II)</enum><text>in the case of a private flood insurance policy, by a fee—</text> <item id="id6707b61258714ce98dbdb90c90c2e380"><enum>(aa)</enum><text>that shall be—</text>
 <subitem id="idfd7926b50712460998e0b76b988ad5cc"><enum>(AA)</enum><text>charged to policyholders;</text> </subitem><subitem id="id4af8a2c882d445d1a1e23e63d8bb0f0b"><enum>(BB)</enum><text>collected by the insurance company that issued the policy; and</text>
 </subitem><subitem id="id67477b7293db48d89d3e8fd0fedcc8e2"><enum>(CC)</enum><text>transferred, not later than 180 days after the date on which the fee is collected, to the Administrator, who shall deposit the amount of the fee in the National Flood Insurance Fund established under section 1310;</text>
 </subitem></item><item id="ida02d489dd9ff4d9289d9f8a0050423dd"><enum>(bb)</enum><text>that shall not be subject to any agents’ commissions, company expense allowances, or State or local premium taxes; and</text>
 </item><item id="id4d910ae31245490aa71aa86a96b7a46e"><enum>(cc)</enum><text>with respect to which—</text> <subitem id="idaa793a3ee3594b5f832662cf679a0bdb"><enum>(AA)</enum><text>the Administrator may require the provision of such information as the Administrator decides is necessary to verify that the fee has been imposed and collected at the proper time and in the proper amount; and</text>
 </subitem><subitem id="id7d9d727fd3d5410689096a41ff80781c"><enum>(BB)</enum><text>no portion may be retained by the insurance company that collected the fee for the costs of collecting, handling, or remitting the fee except for interest accruing to the company after collection and before remittance; and</text></subitem></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id2da919620934436097bc8a2f3ccadfe6"><enum>(2)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by inserting <quote>, including a fee charged to policyholders of private flood insurance in a manner that is consistent with paragraph (1)(B)(iii)(II),</quote> after <quote>policyholders</quote>.</text>
 </paragraph></subsection><subsection id="id6d9277fa731d42e19b29aac77e992e7c"><enum>(c)</enum><header>Increased cost of compliance coverage under private policies</header><text>Section 102(b)(7)(C) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4012a">42 U.S.C. 4012a(b)(7)(C)</external-xref>), as amended by section 401 of this Act, is amended—</text>
 <paragraph id="id495a3dcfb21f4cba832723d47d9a10f9"><enum>(1)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="id208cba8868984bf1b15ae6c3a45fda8d"><enum>(2)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id346de3a08b51436d877a1dc758e6cf09"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idb8606bb058cf4978a5c13ac871c6df5d" style="OLC"> <clause id="id1d615349830048f999ee9dd59f0b26b4"><enum>(iv)</enum><text>provides ordinance and law coverage that meets or exceeds increased cost of compliance coverage provided under a standard flood insurance policy under the national flood insurance program</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idbd28dbb46bd648cfa75f1ad9a5d936fd"><enum>(d)</enum><header>Applicability</header><text>The amendments made by subsections (a), (b), and (c) shall apply with respect to a private flood insurance policy that is newly issued or renewed after the date of enactment of this Act.</text>
				</subsection><subsection id="id4a67d52fb5664f6690f47a72054517ee"><enum>(e)</enum><header>Technical and conforming amendments</header>
 <paragraph id="id80056a92d2a34e229eb8e974e5cd8101"><enum>(1)</enum><header>Premium surcharge</header><text>Section 1308A(a)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015a">42 U.S.C. 4015a(a)(1)</external-xref>), as so designated by subsection (a)(1) of this section, is amended, in the second sentence, by striking <quote>section 1304(b)</quote> and inserting <quote>section 1304(c)</quote>.</text>
 </paragraph><paragraph id="id7905a9d8c07b409482e6635e094146be"><enum>(2)</enum><header>National Flood Insurance Fund</header><text>Section 1310(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4017">42 U.S.C. 4017(b)</external-xref>), as amended by section 403(c)(1)(B)(ii) of this Act, is amended—</text>
 <subparagraph id="idbe686c3269ac4a8b8ef5813ceacf34d3"><enum>(A)</enum><text>in paragraph (6), as so designated, by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id0d516033df6a435e84fefb154e145bc1"><enum>(B)</enum><text>by redesignating paragraph (7) as paragraph (9); and</text>
 </subparagraph><subparagraph id="id0cd52c4ba5f8492f8a4bdc5db6727900"><enum>(C)</enum><text>by inserting after paragraph (6) the following:</text> <quoted-block display-inline="no-display-inline" id="id9759f7bdffa443dea75ad49f98801f88" style="OLC"> <paragraph id="id1ddecc58b85f42b6921aaccf3f822d97"><enum>(7)</enum><text>surcharges collected under section 1308A(a)(2);</text>
 </paragraph><paragraph id="id0afcc97ed994461e8ee0391eb5d142d6"><enum>(8)</enum><text>fees collected under section 1307(a)(1)(B)(iii); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection></section><section id="id9D6962B79FE54AAA8A41334C83FD82C4"><enum>405.</enum><header>Write Your Own Risk Sharing Pilot Program</header> <subsection id="id668F2688CA7F431AA1C59A98B2214DD5"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section—</text>
 <paragraph id="id6A40E8BBA38A44DFA14385A56ADE1A35"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>excess flood insurance policy</term> means a flood insurance policy sold under the Pilot Program; and</text> </paragraph><paragraph id="idFFEBFB5C6B094F2A9A1680401FACB66B"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Pilot Program</term> means the Write Your Own Risk Sharing Pilot Program established under subsection (b).</text>
 </paragraph></subsection><subsection id="idEA94A633EF0945F599DEB159408D5DBB"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish and conduct a pilot program under the National Flood Insurance Program, to be known as the <term>Write Your Own Risk Sharing Pilot Program</term>, to make available a flood insurance policy applying only to loss or damage in excess of not less than $50,000 for sale by Write Your Own companies that agree to participate in the Pilot Program.</text>
 </subsection><subsection id="id9ac379157c2d409db2f3b306cdea941f"><enum>(c)</enum><header>Eligibility To participate in Pilot Program</header><text>The Administrator may establish terms, conditions, and eligibility criteria for Write Your Own companies participating in the Pilot Program.</text>
				</subsection><subsection id="id97F50ACEDCF240488C410EB2DFA5372A"><enum>(d)</enum><header>Terms and conditions of excess flood policy</header>
 <paragraph id="idD19255C0E32349F8920AA77C6938072A"><enum>(1)</enum><header>Chargeable rates</header><text>The chargeable rate for an excess flood insurance policy sold in an area (or subdivision thereof) shall be not less than the applicable estimated risk premium rate for the area (or subdivision thereof) under section 1307(a)(1) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)</external-xref>).</text>
 </paragraph><paragraph id="idf1a205ecdb754ae185b68781fc1e5d79"><enum>(2)</enum><header>Application of surcharges and fees</header><text>Any surcharge or fee, with respect to an excess flood insurance policy, charged to a policyholder participating in the Pilot Program for a period shall be reduced by the amount of any surcharge for a private flood insurance policy under section 1308A(a)(2) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015a">42 U.S.C. 4015a(a)(2)</external-xref>) (as added by section 404) or fee for a private flood insurance policy under section 1307(a)(1)(B)(iii) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(a)(1)(B)(iii)</external-xref>) (as amended by section 404), respectively, paid by the policyholder for coverage during the same period.</text>
					</paragraph><paragraph id="id1d9c85215f9140d192b168dcb4a934d8"><enum>(3)</enum><header>Terms and conditions of insurance</header>
 <subparagraph id="idF2B608EFF7594E1D897ED4DA0B2015F2"><enum>(A)</enum><header>In general</header><text>An excess flood insurance policy shall have the same coverages, exclusions, and limitations as the Standard Flood Insurance Policy insofar as the Policy relates to the requirements of this section.</text>
 </subparagraph><subparagraph id="idDC1F36AE8BA04F84926F5F3BB3683FA5"><enum>(B)</enum><header>Coverage amounts</header><text>Coverage amounts for an excess flood insurance policy shall not exceed the coverage amounts established under section 1306(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013(b)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id6b7f04e2586d4b3691bb0364dfde097e"><enum>(4)</enum><header>Underlying policy requirement</header><text>An excess flood insurance policy sold under the Pilot Program shall require the insured to carry primary flood insurance that—</text>
 <subparagraph id="id66e8f43b74d644c08e23c2762ade7025"><enum>(A)</enum><text>provides a maximum coverage limit of not less than $50,000;</text> </subparagraph><subparagraph id="id135bfdf4da954ed6bd69dd96a8df128c"><enum>(B)</enum><text>is issued by a Write Your Own company; and</text>
 </subparagraph><subparagraph id="id1a424086077c4930a579c132b0047953"><enum>(C)</enum><text>complies with any other conditions adopted by the Administrator.</text> </subparagraph></paragraph></subsection><subsection id="id48abe8534c664cc19a72a9fc4d7c598c"><enum>(e)</enum><header>Authority</header><text>The Administrator shall carry out the Pilot Program as authorized by and in accordance with the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.) insofar as that Act relates to this section, subject to the modifications made by this section.</text>
 </subsection><subsection id="id13a0aeabbe304ad1953c6fb16fb309a0"><enum>(f)</enum><header>Implementation</header><text>The Administrator shall make policies available for sale to the public under the Pilot Program not later than 18 months after the date of enactment of this Act.</text>
 </subsection><subsection id="idC61CB5F903D5477BAF9CBE8B043B2A71"><enum>(g)</enum><header>Sunset</header><text>The Administrator may not issue or renew contracts for flood insurance under the Pilot Program—</text> <paragraph id="idCDACA38C88F049CB8570A1A1761F58A7"><enum>(1)</enum><text>on and after the date is 5 years after the date contracts for flood insurance under this section are made available for purchase; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A258064C27447C1A616294100850934"><enum>(2)</enum><text>at any time after the expiration of the National Flood Insurance Program under section 1319 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4026">42 U.S.C. 4026</external-xref>).</text>
 </paragraph></subsection><subsection id="id64b77a763f1e44829989b247e7f63c10"><enum>(h)</enum><header>Report</header><text>Not later than 180 days after the date on which the authority for the Pilot Program terminates under subsection (g), the Administrator shall submit to Congress a report on—</text>
 <paragraph id="idB5C85BCEFDD84E7CB543648E7984862D"><enum>(1)</enum><text>the aggregate amount of premiums, surcharges, and fees charged under the Pilot Program; and</text>
 </paragraph><paragraph id="idB6BADE9B120147DFB300901107CBD409"><enum>(2)</enum><text>claims loss data experienced by the Write Your Own companies participating in the Pilot Program and the National Flood Insurance Program on policies sold under the Pilot Program.</text>
					</paragraph></subsection></section></title><title id="idFDF8E4D8F1FB436FA2C665DEB808DC85" style="OLC"><enum>V</enum><header>Modernizing flood mapping and flood risk accuracy</header>
 <section id="id1C0360414460434383A3426846C8BFF4"><enum>501.</enum><header>Reauthorization of National Flood Mapping Program</header><text display-inline="no-display-inline">Section 100216(f) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(f)</external-xref>) is amended—</text>
 <paragraph id="idD11F9DE3643C4F28B8C3435EF8675CD5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>to carry out this section $400,000,000</quote> and inserting the following:</text> <quoted-block display-inline="yes-display-inline" id="idC001B19166E74702B7ED0E1F730AECD4" style="OLC"> <text>to carry out this section—</text><paragraph id="id8F7A0FB04B9643FFBFA24DCB592EB9DE"><enum>(1)</enum><text>$400,000,000</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id81A2682EB87840098E172DD096E193E0"><enum>(2)</enum><text>by striking the period at the end and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="id6F3B5AA372E544949DD43492FE1A3BBB" style="OLC">
 <text>; and</text><paragraph id="id382637BD8AC7490D84F03DD9C978F37D"><enum>(2)</enum><text>$500,000,000 for each of fiscal years 2018 through 2027.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="id591E7EAB438C4B0C948A0474AEB79552"><enum>502.</enum><header>Mapping standards and guidelines for nongovernmental entities</header><text display-inline="no-display-inline">Section 100215 of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101a">42 U.S.C. 4101a</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7574093f099b4cd589709a04fc69e40a" style="OLC">
					<subsection id="id697fa62e0d3a44139b5ed41295b48bb4"><enum>(m)</enum><header>Private or community flood maps</header>
 <paragraph id="id35b1d927e9f8466489a9d581da823162"><enum>(1)</enum><header>Standards and procedures</header><text>In addition to the other duties of the Council under this section, not later than 1 year after the date of enactment of this subsection, the Council shall develop and establish a set of standards, guidelines, and procedures for—</text>
 <subparagraph id="id0ae83d048e084598862c01d74dc5bc61"><enum>(A)</enum><text>State and local governments, federally or State-recognized metropolitan planning organizations (commonly known as <quote>MPOs</quote>), federally or State-recognized councils of local governments, and federally or State-recognized rural transportation planning organizations to use in mapping flood risks and developing alternative maps to the flood insurance rate maps developed by the Administrator; and</text>
 </subparagraph><subparagraph id="id821552ecbf984c74ac07b108e760f59b"><enum>(B)</enum><text>certification, by the Administrator not later than 90 days after the date on which a map developed under subparagraph (A) is submitted to the Administrator, for use under the National Flood Insurance Program in the case of any area covered by a flood insurance rate map developed or approved by the Administrator that has not been updated or reissued during the preceding 3-year period.</text>
 </subparagraph></paragraph><paragraph id="idc8a563864f2344009e8e97a8815e466b"><enum>(2)</enum><header>Treatment</header><text>On and after the date on which the Administrator certifies a map under paragraph (1)(B), the map—</text> <subparagraph id="ideb17915c428546e4a6924020bc0978f4"><enum>(A)</enum><text>shall be considered the flood insurance rate map in effect for all purposes of the National Flood Insurance Program with respect to the area covered by the map; and</text>
 </subparagraph><subparagraph id="id7e08a6f38b7144889c404be344bf01d6"><enum>(B)</enum><text>may not be revised, updated, or replaced in accordance with the standards, guidelines, and procedures established under paragraph (1) before the expiration of the 3-year period beginning on that date of certification.</text>
 </subparagraph></paragraph><paragraph id="id2176c69806aa4664bfecfd2f1121ab3a"><enum>(3)</enum><header>Exemption from rulemaking</header><text>Until the date on which the Administrator promulgates regulations implementing paragraphs (1) and (2), the Administrator may adopt policies and procedures, notwithstanding any other provision of law, necessary to implement those paragraphs without regard to section 553 of title 5, United States Code, and without conducting regulatory analyses otherwise required by statute, regulation, or Executive order.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id8EC931F060694A2598F517F175AC967B"><enum>503.</enum><header>Use of high-resolution mapping technology</header>
 <subsection id="idBC68024EA2E044A98661036A379A14C8"><enum>(a)</enum><header>In general</header><text>Section 100216(b)(1) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(b)(1)</external-xref>) is amended—</text>
 <paragraph id="idEFF829C273634426916A4EF28470132F"><enum>(1)</enum><text>in subparagraph (A)(i), by inserting <quote>subject to subparagraph (D),</quote> before <quote>all populated areas</quote>;</text> </paragraph><paragraph id="idB3771FF3BABA4F47BF4C973CB44FFC16"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id9B13F6081E814FC2A292E757E3B030E3"><enum>(3)</enum><text>in subparagraph (C), by striking the period at the end and inserting the following: <quote>, including by facilitating, partnering with other Federal, State, and local agencies with respect to, and leveraging the efficient acquisition of the most up-to-date high-resolution topographic data, such as Light Detection and Ranging (commonly known as <quote>LiDAR</quote>) data and other new and emerging technologies; and</quote>; and</text>
 </paragraph><paragraph id="id9FF52A01D12346FA91C6AD39C419D377"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idED624E88E41A4AE991E2F79C63A6C96B" style="OLC"> <subparagraph id="id85D70F5A06D5476697C50A37353DE4FE"><enum>(D)</enum><text>establish standards that may be used as the basis for insurance rating purposes to identify multi-frequency flood hazards and flood hazard information that appropriately characterizes the nature of flooding for areas subject to a mapping update, including by using the most up-to-date high-resolution topographic data as required under subparagraph (C), in order to reduce flood risk and improve the accuracy of National Flood Insurance Program rate maps.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id3FB0BC3CD20A463FB28347D35DAAEE5E"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall submit to Congress a report on compliance by the Administrator with the requirement under subparagraphs (C) and (D) of section 100216(b)(1) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(b)(1)</external-xref>), as amended by subsection (a), to use the most up-to-date high-resolution topographic data and multi-frequency flood hazards in order to reduce flood risk and improve the accuracy of National Flood Insurance Program rate maps.</text>
 </subsection></section><section id="id0F9A996F9D5C4C84975A423A667770D7"><enum>504.</enum><header>Protected areas</header><text display-inline="no-display-inline">Section 100216(b) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(b)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB3C662F00E73414CAF1BFCC92A1ACFCB" style="OLC">
					<paragraph id="id13248f63f68f48348199a44d60e410ee"><enum>(4)</enum><header>Zones protected by levee systems</header>
 <subparagraph id="idAC5FB34CFED548C99D4D368A226DAB62"><enum>(A)</enum><header>Applicability</header><text>Subject to full implementation of this section, and notwithstanding any other provision of law, this paragraph shall apply to a community in which the Administrator maps or re-maps a levee-impacted area in which the pertinent levee system fails to meet the minimum design, operation, and maintenance standards of the National Flood Insurance Program required for levee accreditation on a National Flood Insurance Program rate map.</text>
 </subparagraph><subparagraph id="idD2EDFB0DFABC4238BD5BA7D83A2B742C"><enum>(B)</enum><header>AL Zones</header><text>For levee-impacted areas described in subparagraph (A), the Administrator shall establish flood risk zones known as <term>AL Zones</term> on the National Flood Insurance Program rate map.</text>
						</subparagraph><subparagraph id="idD70295A9A3514A6AB907B3078EE3048D"><enum>(C)</enum><header>Actuarial rates</header>
 <clause id="id14AF87BE997E41FA87EEA0BFD7CA0C56"><enum>(i)</enum><header>In general</header><text>The Administrator shall make available flood insurance to properties in AL Zones at actuarial rates based upon the risk associated with structures within the applicable AL zone.</text>
 </clause><clause id="idF7B584BE46174B0F8876E89A10C13344"><enum>(ii)</enum><header>Temporary rates</header><text>Until the Administrator promulgates actuarial rates for the various AL zones, a structure within a portion of a community located within a levee-impacted area described in subparagraph (A) shall be eligible for rates associated with areas of moderate flood hazards (also known as <term>Standard X zone</term> rates).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id264195adcad8470cbd4395ad3f35ca3e"><enum>505.</enum><header>Coastal flood models</header><text display-inline="no-display-inline">Section 100216(b) of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/42/4101b">42 U.S.C. 4101b(b)</external-xref>), as amended by section 504, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0569462C82134D5C8AABBC4E99ED83FF" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="id5FD7DC5629744E878C168AECFDEDC467"><enum>(5)</enum><header>Coastal flood models</header><text>In updating maps under this section, the Administrator shall use coastal flood models that ensure technically and scientifically accurate modeling to represent and communicate flood risk.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="idD40B3450F3614123B6156F35F45F2E09" style="OLC"><enum>VI</enum><header>Enhancing National Flood Insurance Program transparency and accountability</header>
			<section id="id96637ba661d244a18d7e9b7f1f2e9869"><enum>601.</enum><header>Deadline for approval of claims</header>
 <subsection id="id32e0b5b896f840669edf98e82fa13da8"><enum>(a)</enum><header>In general</header><text>Section 1312 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019</external-xref>), as amended by section 205, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idb5825874539848f7a843851a7946fa39" style="OLC">
						<subsection id="idf106a7e76a27401b890e0ecc03095cbb"><enum>(e)</enum><header>Deadline for approval of claims</header>
 <paragraph id="id5a9a522973af4912a818235e81801ac9"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the submission of a proof of loss, the Administrator shall notify the insured regarding the approval or disapproval of the claim.</text>
 </paragraph><paragraph id="idfad1072484ad4dfd8dbed6417738f72a"><enum>(2)</enum><header>Extension of claim determination deadline</header><text>The Administrator may extend the deadline under paragraph (1) by a single additional 15-day period under extraordinary circumstances, as determined according to criteria adopted by the Administrator.</text>
 </paragraph><paragraph id="iddd59e0dce27d498a9077954515ee81d2"><enum>(3)</enum><header>Payment of claims</header><text>The Administrator shall make payment for an approved claim as soon as possible after approval of the claim.</text>
							</paragraph></subsection><subsection id="ida5b9aa5954d441e796e6c9e00cf48858"><enum>(f)</enum><header>Notification and proofs of loss</header>
 <paragraph id="idE4452893FB81431AB54910D0B6E820EB"><enum>(1)</enum><header>In general</header><text>A flood insurance claim filed under this title for damage to or loss of property may not be denied based on the proof of loss requirements of the standard flood insurance policy under the national flood insurance program if the policyholder—</text>
 <subparagraph id="idBA0AF4130E6B4E54A44E933705A9FE2B"><enum>(A)</enum><text>provides notice of the claim not later than 60 days after the date of the occurrence of the loss; and</text>
 </subparagraph><subparagraph id="id79BE81C705B54087B31364521D0B93B6"><enum>(B)</enum><text>complies with the remaining proof of loss requirements under the standard flood insurance policy not later than—</text>
 <clause id="id7130242A5EA14051A2889BD28B218B59"><enum>(i)</enum><text>180 days after the date of the occurrence of the loss; or</text> </clause><clause id="idA9F4FD158A554FC4A8FEB73819AFDE7A"><enum>(ii)</enum><text>any later date specified by the Administrator.</text>
 </clause></subparagraph></paragraph><paragraph id="id6F9F3ACB94124FBC8D504D193DCFBABF"><enum>(2)</enum><header>Supplemental proof of loss</header><text>A policyholder may amend or supplement a proof of loss not later than 180 days after the date on which the policyholder submits the initial proof of loss.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="ida2b2da20c9e3406995bc6187d9c2924f"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any claim for damage to or loss of property covered by flood insurance made available under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001</external-xref> et seq.) that is pending on, or made after, the date of enactment of this Act.</text>
				</subsection></section><section id="id74285ec6bfe5400286c75faf1db9650a"><enum>602.</enum><header>Flood insurance transparency, accountability, and reform</header>
 <subsection id="idd3f4b73fa2a74c04affa7be301b0e9f2"><enum>(a)</enum><header>Reports and other claim-Related documents</header><text>Section 1312 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019</external-xref>), as amended by section 601, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB0440201FA674152A2C7D50542AF17FC" style="OLC">
 <subsection id="ida26126b435824cf1a8178f0a70995a16"><enum>(f)</enum><header>Final Engineering Reports</header><text>The Administrator shall require that, in the case of any on-site inspection of a property by an engineer for the purpose of assessing any claim for losses covered by a policy for flood insurance coverage provided under this title (referred to in this subsection as a <term>covered claim</term>), the final engineering report shall be provided to the insured under the policy, as follows:</text>
 <paragraph id="id5500a2db8f9d4e86ad82b108733b0ce3"><enum>(1)</enum><header>Timing</header><text>The final engineering report may not be transmitted to any other person, employer, agency, or entity, before it is transmitted to the insured.</text>
 </paragraph><paragraph id="id2db882697d6942149311dc1188cba548"><enum>(2)</enum><header>Prohibition on alterations; certification</header><text>The final engineering report—</text> <subparagraph id="idCD326D2FB99643E5A4E196E55F957750"><enum>(A)</enum><text>shall be true, complete, and unredacted;</text>
 </subparagraph><subparagraph id="id6488DC2240F44B17AD4D8783FCB07786"><enum>(B)</enum><text>may not include alterations by, or at the request of, anyone other than the individual with responsible charge for the report; and</text>
 </subparagraph><subparagraph id="idD87B44DCB4E646208A33D3CC041BFA86"><enum>(C)</enum><text>shall include a certification, signed by the individual with responsible charge for the report, that the report does not contain any alterations described in subparagraph (B).</text>
								</subparagraph></paragraph><paragraph id="idf663ed64e7ac4ed7af5ec993285d387e"><enum>(3)</enum><header>Transmittal</header>
 <subparagraph id="id3D1AF524BBE743C290DBF3AF5F510F1B"><enum>(A)</enum><header>In general</header><text>The final engineering report shall be transmitted to the insured in a manner prescribed by the Administrator that provides reasonable assurance that it was transmitted directly to the insured by the individual with responsible charge.</text>
 </subparagraph><subparagraph id="id058d51c0c11343e4b16b46c691eac091"><enum>(B)</enum><header>Direct disclosure</header><text>A Write Your Own company or direct servicing agent in possession of a final engineering report subject to disclosure under this subsection may transmit the report to the insured without further review or approval by the Administrator.</text>
 </subparagraph></paragraph><paragraph id="ide5ebb2b81277499aab2c67435ab3460b"><enum>(4)</enum><header>Reports covered</header><text>For purposes of this subsection, the term <term>final engineering report</term> means an engineering report, survey, or other document in connection with the covered claim that—</text> <subparagraph id="ida91c1b2642e64170b5c867ab3950ac5d"><enum>(A)</enum><text>is based on the on-site inspection;</text>
 </subparagraph><subparagraph id="id0cf9c05c994c4cf5843c09e75cecf8bf"><enum>(B)</enum><text>contains final conclusions with respect to an engineering issue or issues involved in the claim; and</text>
 </subparagraph><subparagraph id="ida2598468061940599d41d4162e66d660"><enum>(C)</enum><text>is signed by the individual with responsible charge or affixed with the seal of the individual with responsible charge, or both.</text>
 </subparagraph></paragraph></subsection><subsection id="id2d033d030c0c4ad8a69025375a7e4f7e"><enum>(g)</enum><header>Claims adjustment reports</header><text>The Administrator shall require that, in the case of any on-site inspection of a property by a claims adjustor for the purpose of assessing any claim for losses covered by a policy for flood insurance coverage provided under this title (referred to in this subsection as a <term>covered claim</term>), any claims adjustment claims adjustment report shall be provided to the insured under the policy, as follows:</text>
 <paragraph id="id9599c3af17774ab8a5949b193c9fad93"><enum>(1)</enum><header>Timing</header><text>The claims adjustment report may not be transmitted to any other person, employer, agency, or entity, before it is transmitted to the insured.</text>
 </paragraph><paragraph id="id5844768463584d528766f9d5a3a95104"><enum>(2)</enum><header>Prohibition on alterations; certification</header><text>The claims adjustment report—</text> <subparagraph id="id48860C3266674352AE1CEB906E93348F"><enum>(A)</enum><text>shall be true, complete, and unredacted;</text>
 </subparagraph><subparagraph id="idE408AB3CBB13437781751F9F7E57126C"><enum>(B)</enum><text>may not include alterations by, or at the request of, anyone other than the preparer of the report; and</text>
 </subparagraph><subparagraph id="id997B28CB33CE491F9B5827B81B3FD437"><enum>(C)</enum><text>shall include a certification, signed by the preparer, that the report does not contain any alterations described in subparagraph (B).</text>
								</subparagraph></paragraph><paragraph id="ide45b500606e8451eb478ff5d21e0666d"><enum>(3)</enum><header>Transmittal</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id9B61092E737A4B16A5266BE511429641"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The claims adjustment report shall be transmitted to the insured in a manner prescribed by the Administrator that provides reasonable assurance that it was transmitted directly to the insured by the preparer.</text>
 </subparagraph><subparagraph id="idE33AABD468994B9BBA91380F8E442272"><enum>(B)</enum><header>Direct disclosure</header><text>A Write Your Own company or direct servicing agent in possession of a claims adjustment report subject to disclosure under this subsection may transmit the report to the insured without further review or approval by the Administrator.</text>
 </subparagraph></paragraph><paragraph id="id19df5ef434204fbe8c93aa66f69bc9b8"><enum>(4)</enum><header>Reports covered</header><text>For purposes of this subsection, the term <term>claims adjustment report</term>—</text> <subparagraph id="idE2660F2EC9AD47B28EAE82C2E39E053F"><enum>(A)</enum><text>means any report or document in connection with the covered claim that is based on the on-site inspection by the claims adjustor, including any adjustment report and field report;</text>
 </subparagraph><subparagraph id="id237264BBC7CE441BB94F87CB427CD5E2"><enum>(B)</enum><text>includes any draft, preliminary version, or copy of a report described in subparagraph (A) and any amendments or additions to any such report; and</text>
 </subparagraph><subparagraph id="id46B71FA2D2BD4369B5EB10A06BAAD99F"><enum>(C)</enum><text>does not include a final engineering report, as that term is defined for purposes of subsection (e).</text>
								</subparagraph></paragraph></subsection><subsection id="id5eb3f35b88fd4a89a77f62cae7baefc0"><enum>(h)</enum><header>Other claim-Related documents</header>
 <paragraph id="id6295763f48e54c94838809702d8ad848"><enum>(1)</enum><header>Definition of claim-related document</header><text>In this subsection, the term <term>claim-related document</term> means any document, other than a final engineering report (as defined in subsection (e)) or a claims adjustment report (as defined in subsection (f)), that was prepared for the purposes of assessing a claim for losses covered by flood insurance made available under this title, including—</text>
 <subparagraph id="idf25a943f7fe9450f9606b6903388e883"><enum>(A)</enum><text>a repair and replacement estimate or bid;</text> </subparagraph><subparagraph id="idbd85c34221b442c7b20f25846df4042a"><enum>(B)</enum><text>an appraisal;</text>
 </subparagraph><subparagraph id="id70924cf7a203422ab5bfa3e65f59ac10"><enum>(C)</enum><text>a scope of loss;</text> </subparagraph><subparagraph id="id142a7c97ae3f4439ae2e53936fd8e6c4"><enum>(D)</enum><text>a drawing;</text>
 </subparagraph><subparagraph id="id33945f9209bb426e924bf3d7f201db45"><enum>(E)</enum><text>a plan;</text> </subparagraph><subparagraph id="id6d1eeeb3212548099e1beb4e163fd261"><enum>(F)</enum><text>a report, including a draft report prepared based on an on-site inspection of a property conducted by a claims adjustor or engineer;</text>
 </subparagraph><subparagraph id="id1006c1d949a64746b76d00d0d92adbd9"><enum>(G)</enum><text>a third-party finding on the amount of loss, amount of covered damage, or cost of repairs; and</text> </subparagraph><subparagraph id="id9e60c8e3b2d14040b441733007311b1b"><enum>(H)</enum><text>any other valuation, measurement, or loss adjustment calculation of the amount of loss, amount of covered damage, or cost of repairs.</text>
 </subparagraph></paragraph><paragraph id="id2d5b5fc213664d31ad565a3981951bb4"><enum>(2)</enum><header>Availability of documents</header><text>Any entity servicing a claim under the national flood insurance program—</text> <subparagraph id="id505e601c7679434eb2687333848f1db1"><enum>(A)</enum><text>shall retain each claim-related document prepared by or for the entity;</text>
 </subparagraph><subparagraph id="id9c67f8ea88684b1d94f901f0b99dae1b"><enum>(B)</enum><text>upon request by a claimant or an authorized representative of a claimant, shall provide to the claimant or representative a copy of any claim-related document described in subparagraph (A) that pertains to the claimant; and</text>
 </subparagraph><subparagraph id="id71dd30afd77847f4852bea2a23fc329d"><enum>(C)</enum><text>not later than 30 days after receiving notice of a claim, shall notify the claimant that the claimant or an authorized representative of the claimant may obtain, upon request, a copy of any claim-related document described in subparagraph (A) that pertains to the claimant.</text>
								</subparagraph></paragraph></subsection><subsection id="id168959b7ae514943a242e6c1c97d97bb"><enum>(i)</enum><header>Use of claim reports</header>
 <paragraph id="id78cc5e20a11b4b57865ae4e72759720d"><enum>(1)</enum><header>In general</header><text>When adjusting claims for any damage to or loss of property covered by flood insurance made available under this title, the Administrator shall only rely upon final claim reports that are prepared in compliance with applicable State and Federal laws regarding professional licensure and conduct.</text>
 </paragraph><paragraph id="id1a2fedefad3647c5b2aa9f56503f2a3c"><enum>(2)</enum><header>Non-reimbursement</header><text>The Administrator may decline to reimburse a Write Your Own company for claim reports not prepared in accordance with paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ided0029bb48a840bea1436b6ba2efbe74"><enum>(b)</enum><header>Judicial review</header>
 <paragraph id="id1D8FD9DD6F32415D92B15D2B41C97C80"><enum>(1)</enum><header>Government program with industry assistance</header><text>Section 1341 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4072">42 U.S.C. 4072</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id451674C39B3344C3B12328F7901A62D7" style="OLC">
							<section id="id4D60DA015F464A8E874ECAEEEC7BDBA6"><enum>1341.</enum><header>Adjustment and payment of claims and judicial review</header>
 <subsection id="id3B5C05F8FCF0404490E5058B3C8FC3F2"><enum>(a)</enum><header>Adjustment and payment of claims</header><text display-inline="yes-display-inline">If the program is carried out as provided in section 1340, the Administrator may adjust and make payment of any claims for proved and approved losses covered by flood insurance.</text>
 </subsection><subsection id="id449B1F0708B542689A6ACB360762E703"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Upon the disallowance or partial disallowance by the Administrator of a claim described in subsection (a), or upon the refusal of the claimant to accept the amount allowed upon a claim described in subsection (a)—</text>
 <paragraph id="idF37D063AC2BA4717B6DA3B67217CF8D5"><enum>(1)</enum><text display-inline="yes-display-inline">the claimant may institute an action against the Administrator on the claim in the United States district court for the district in which the insured property or the major part thereof shall have been situated—</text>
 <subparagraph id="idA596596F8C6A46DFAFE7DF9885160762"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date on which the claimant receives notice of disallowance or partial disallowance of the claim; or</text>
 </subparagraph><subparagraph id="id474DEB0C26D2441BA8CEC8627CCA4C22"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a denial of a claim for losses that is appealed to the Administrator, not later than the later of—</text>
 <clause id="id141C835ADF3143F992B5703FC4A5BD28"><enum>(i)</enum><text display-inline="yes-display-inline">90 days after the date of a final determination upon appeal denying the claim in whole or in part; or</text>
 </clause><clause id="id077B2927F3774E64B742DCCDBB19F916"><enum>(ii)</enum><text display-inline="yes-display-inline">2 years after the date on which the claimant receives notice of disallowance or partial disallowance of the claim; and</text>
 </clause></subparagraph></paragraph><paragraph id="id35FA8F6D38EA4E9DAB1A7177803A8650"><enum>(2)</enum><text display-inline="yes-display-inline">a court described in paragraph (1) shall have original exclusive jurisdiction to hear and determine the action without regard to the amount in controversy.</text>
 </paragraph></subsection><subsection id="id31bf935175b14c5496d4405ff770193e"><enum>(c)</enum><header>Private rights of action</header><text>Nothing in this section, or in any regulation or policy implementing the national flood insurance program, may be construed to preclude a private right of action under any statute by a policyholder against a private entity for fraud arising from the handing or disposition of a claim for losses under this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idA26BF2E6C0334C2E9CC5FF842B043103"><enum>(2)</enum><header>Industry program with Federal financial assistance</header><text>Section 1333 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4053">42 U.S.C. 4053</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id48EF84AFEF1B418BAE745B8FFD0F2511" style="OLC">
							<section id="idA91747793A3F4CD5AF4677241ED6C4C4"><enum>1333.</enum><header>Adjustment and payment of claims and judicial review</header>
 <subsection id="id761F94682ADB4F13B4D4F45FF7E3002A"><enum>(a)</enum><header>Adjustment and payment of claims</header><text display-inline="yes-display-inline">The insurance companies and other insurers that form, associate, or otherwise join together in the pool under this part may adjust and pay all claims for proved and approved losses covered by flood insurance in accordance with the provisions of this title.</text>
 </subsection><subsection id="idB0897968F1804C5296450295ABB39488"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Upon the disallowance or partial disallowance by any company or other insurer described in subsection (a) of a claim described in that subsection, or upon the refusal of the claimant to accept the amount allowed upon a claim described in that subsection—</text>
 <paragraph id="idD4B13C2C08B24914B6403CE52FC6D9C4"><enum>(1)</enum><text display-inline="yes-display-inline">the claimant may institute an action on the claim against the company or other insurer in the United States district court for the district in which the insured property or the major part thereof shall have been situated—</text>
 <subparagraph id="id620FBD6823314ABF8AB2A7909E1AA6A6"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date on which the claimant receives notice of disallowance or partial disallowance of the claim; or</text>
 </subparagraph><subparagraph id="id6E27FA5C34DA4E318226F7ABFB9D8B5D"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a denial of a claim for losses that is appealed to the Administrator, not later than the later of—</text>
 <clause id="idC548610E61FF4A658454F0B3B67DB3EA"><enum>(i)</enum><text display-inline="yes-display-inline">90 days after the date of a final determination upon appeal denying the claim in whole or in part; or</text>
 </clause><clause id="id831C5DE0707F4D3FB1A94BABADF43DA6"><enum>(ii)</enum><text display-inline="yes-display-inline">2 years after the date on which the claimant receives notice of disallowance or partial disallowance of the claim; and</text>
 </clause></subparagraph></paragraph><paragraph id="idC43B14C9BA8F4B99A31D142E710346BF"><enum>(2)</enum><text display-inline="yes-display-inline">a court described in paragraph (1) shall have original exclusive jurisdiction to hear and determine the action without regard to the amount in controversy.</text>
 </paragraph></subsection><subsection id="idE615C9449ADF434E992A55931581EFA5"><enum>(c)</enum><header>Private rights of action</header><text>Nothing in this section, or in any regulation or policy implementing the national flood insurance program, may be construed to preclude a private right of action under any statute by a policyholder against a private entity for fraud arising from the handing or disposition of a claim for losses under this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id0e47c870d1684ae7885c814d575ae1d7"><enum>(c)</enum><header>Records and reviews</header><text>Section 1348 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4084">42 U.S.C. 4084</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4E9C1C38086A4417977B65AF121731EB" style="OLC">
 <subsection id="id722adf2dc0d24a909c9de047a585912c"><enum>(c)</enum><header>Annual review</header><text>The Administrator shall conduct an annual review of each private entity participating in the national flood insurance program, including any company that has entered into a contract with a Write Your Own company to provide any service related to a policy or claim under the national flood insurance program, including adjusting, engineering, and legal services, to ensure compliance with this title and with all policies and procedures established by the Administrator to prevent fraud and protect policyholders.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idc330d58c5b5c4441b764af1025e43eeb"><enum>(d)</enum><header>Publication of claims data</header><text>Section 1312 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4019">42 U.S.C. 4019</external-xref>), as amended by subsection (a), is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idE5C3094787274D308E3F8F127ED332B2" style="OLC">
 <subsection id="ide942a5a0477244f69bab258c512bc0ef"><enum>(j)</enum><header>Publication of claims data</header><text>Not later than 1 year after the date of enactment of the <short-title>Flood Insurance Affordability and Sustainability Act of 2017</short-title>, the Administrator shall create and maintain a publicly searchable online database that includes, with respect to claims filed under the national flood insurance program after that date of enactment—</text>
 <paragraph id="idc57f08b7c39840bcbda478b731096b45"><enum>(1)</enum><text>the aggregate number of claims filed each month, broken down by State;</text> </paragraph><paragraph id="id71090979fa774b61b9e1697819b61399"><enum>(2)</enum><text>the aggregate number of claims paid in part or in full; and</text>
 </paragraph><paragraph id="id7b3a6af8b6d94170ae7e654f6d2ffa16"><enum>(3)</enum><text>the aggregate number of claim denials appealed, the number of claim denials upheld on appeal, and the number of claim denials overturned on appeal.</text>
 </paragraph></subsection><subsection id="iddfec76b39ae0494f80f311b0a6a778d6"><enum>(k)</enum><header>Privacy</header><text>Nothing in this section or the <short-title>Flood Insurance Affordability and Sustainability Act of 2017</short-title>, or any amendment made by that Act, shall be construed to authorize the inclusion of personally identifiable information or individual claim or specific property information in any publicly searchable database.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="ideb2f1f9de8954aa29f92d560558c2549"><enum>(e)</enum><header>Oversight of litigation</header><text>Part C of chapter II of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4081">42 U.S.C. 4081</external-xref> et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8b4cb4a6e27b4fd8a9c50672e41a8bce" style="OLC">
						<section id="idbbec888e49a94a90b03e2600d0e995d9"><enum>1349.</enum><header>Oversight of litigation</header>
 <subsection id="id9937809A83704051876C5D9220F5043F"><enum>(a)</enum><header>In general</header><text>The Administrator shall oversee litigation arising under a contract for flood insurance sold under this title that is conducted by a Write Your Own company to ensure that the Write Your Own company and counsel for the company—</text>
 <paragraph id="id69903bab5ad74cc893e114100174fdde"><enum>(1)</enum><text>represent the national flood insurance program reasonably and in accordance with guidelines established by the Administrator and applicable ethical requirements; and</text>
 </paragraph><paragraph id="ida62bd9c9b8f747ad890f9d349a68786b"><enum>(2)</enum><text>conduct litigation in a cost-effective manner.</text> </paragraph></subsection><subsection id="idfa55fd464d41401e9d9f46c5168d7479"><enum>(b)</enum><header>Denial of reimbursement</header><text>The Administrator may deny reimbursement for litigation expenses that the Administrator determines to be unreasonable, excessive, contrary to guidance issued by the Administrator, or outside the scope of any arrangement entered into with a Write Your Own company.</text>
 </subsection><subsection id="id88073eefceb3406e808eaba28b8b1ca8"><enum>(c)</enum><header>Direction of strategy</header><text>The Administrator may direct litigation strategy for claims arising under a contract for flood insurance sold by a Write Your Own company.</text>
 </subsection><subsection id="ide833f4e684454cd29b33509e7f7feb53"><enum>(d)</enum><header>Substitution</header><text>The Administrator may promptly take any necessary action to be substituted for the Write Your Own company in any action arising out of any claim arising under a contract for flood insurance sold by a Write Your Own company if the Administrator determines that—</text>
 <paragraph id="id58CCB43DEA2641828F16BDE922FA4E0B"><enum>(1)</enum><text>there is a conflict of interest between a Write Your Own company and the national flood insurance program; or</text>
 </paragraph><paragraph id="idF88ADDBD83104A04BA7F10B377D8944B"><enum>(2)</enum><text>such substitution is in the best interest of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id8d9126ffbff8469ba159a6042a862ac3"><enum>(f)</enum><header>Earth movement</header><text>Section 1306 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4013">42 U.S.C. 4013</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id634DF7F78A944B739EA2AC5E8C665731" style="OLC">
 <subsection id="id509bf317a8b84c42898f70ea59513509"><enum>(e)</enum><header>Earth movement</header><text>A flood insurance claim filed under this title for damage to or loss of property may not be denied based on the earth movement exclusion in the Standard Flood Insurance Policy if the claim is filed as the result of a flood, including a claim for damage to or loss or property caused by earth movement that was caused by a flood.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="ide37e0f242a5e43edbea17cafb091a65f"><enum>(g)</enum><header>Appeals process</header><text>Section 205 of the Bunning-Bereuter-Blumenauer Flood Insurance Reform Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011</external-xref> note) is amended—</text>
 <paragraph id="id54393da020294d11ae13bcd4dd350382"><enum>(1)</enum><text>by striking <quote>Not later than</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—Not later than</quote>; and</text> </paragraph><paragraph id="idc2e0c2c2b1ea4ed4a3afafcde18d5756"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id7D5AF497EEAE4CC6939D5BEEBF8C21C0" style="OLC">
							<subsection id="idfcf108c4d66d4a3684d303193cc0505b"><enum>(b)</enum><header>Review of appeals</header>
 <paragraph id="id13f82c2d981340799022a50a2bd381eb"><enum>(1)</enum><header>Clarity</header><text>The Director shall ensure that the appeals process established under subsection (a) has clear rules, forms, and deadlines.</text>
 </paragraph><paragraph id="id878b5eeea333438ebc1067ce33b6a832"><enum>(2)</enum><header>Notification upon initial denial of claim</header><text>The Director shall ensure that a claimant is provided with the rules, forms, and deadlines described in paragraph (1) at the time a claim is first denied in full or in part, including—</text>
 <subparagraph id="id5b397432de0b4676885d0376bbb6af74"><enum>(A)</enum><text>the effective date of the denial;</text> </subparagraph><subparagraph id="id41a303d5e0df417a9a603bc7389cd806"><enum>(B)</enum><text>a justification for the denial, including supporting documentation;</text>
 </subparagraph><subparagraph id="ide54bd9ddea76432ea2a88dda7d4a8a36"><enum>(C)</enum><text>the date on which the period of limitation for instituting an action against the Administrator on the claim under section 1341 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4072">42 U.S.C. 4072</external-xref>) will end; and</text>
 </subparagraph><subparagraph id="id4677f3c380e5492b955da1ef692f7ff3"><enum>(D)</enum><text>a point of contact through which the claimant can directly discuss an appeal with a representative of the Federal Emergency Management Agency.</text>
 </subparagraph></paragraph><paragraph id="id3ab67d803e5444d9b5d40eaa11d705dd"><enum>(3)</enum><header>Notification upon denial of appeal</header><text>If the Administrator denies an appeal filed by a policyholder, the Administrator shall include with the notice of denial an explanation of the policyholder's legal options for further challenging the denial.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="id63361406dc16415790bd8ce25295b34d"><enum>603.</enum><header>Reports to Congress</header>
 <subsection id="idbc3a2ed65537415a84d67cbea824d265"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Task Force</term> means the National Flood Insurance Program Transformation Task Force established by the Federal Emergency Management Agency.</text>
 </subsection><subsection id="id213300b8319f42c89d933f81e8826493"><enum>(b)</enum><header>Report to Congress on accountability for defrauding policyholders</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report on specific actions the Department of Homeland Security will take to identify individuals and private entities that have engaged in activities to defraud policyholders under the National Flood Insurance Program following Superstorm Sandy and prevent those individuals and private entities from continuing to receive Federal funding through—</text>
 <paragraph id="id94491c5d979e4ff1a043c9554105ce2f"><enum>(1)</enum><text>contracts with, or employment by, a Write Your Own company; or</text> </paragraph><paragraph id="id478e677409b248bc8aed8fabf70b32e6"><enum>(2)</enum><text>employment by the Federal Emergency Management Agency.</text>
 </paragraph></subsection><subsection id="id9c7d1dc5ae9b43bd9f41eedd1332570c"><enum>(c)</enum><header>Report to Congress on Recommendations of the NFIP Transformation Task Force</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to Congress a report that describes—</text>
 <paragraph id="id6030ea648dcf41d1aaa5d846e679534f"><enum>(1)</enum><text>the recommendations of the Task Force for reforming the National Flood Insurance Program;</text> </paragraph><paragraph id="id3dd7642e26dd46ba86e987fe53480f69"><enum>(2)</enum><text>a timeline for implementing the recommendations of the Task Force; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64d0bc816f0d4453b4b8ed72c9135f1e"><enum>(3)</enum><text>any recommendations of the Task Force that require additional legislation.</text> </paragraph></subsection></section></title></legis-body> </bill>
