		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Education Opportunity Act </short-title></quote>.</text>
		</section><section id="idc1ecbd57f3964d358f73f1d0e25ad9dc"><enum>2.</enum><header>Native American education opportunity program</header>
 <subsection id="id503C4D6348F84670ADA653DE0AEA8DB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part B of title XI of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2000">25 U.S.C. 2000</external-xref> et seq.) is amended—</text> <paragraph id="id7f063b6bbee64ff99036c46d31ca1cbf"><enum>(1)</enum><text>by redesignating section 1141 as section 1142; and</text>
 </paragraph><paragraph id="id1b62da297bfe42dc9604b42c624e5e2b"><enum>(2)</enum><text>by inserting after section 1140 the following:</text> <quoted-block display-inline="no-display-inline" id="id887fcbf7072444b490c78de8f5027148" style="OLC"> <section id="id340114707b924c6ebfea008fa98331af"><enum>1141.</enum><header>Bureau funding of tribal-based education savings account programs</header> <subsection id="id81f995d616ba4b8e8a70aafae584ad34"><enum>(a)</enum><header>Program authorized</header> <paragraph id="id292e714226124d68a5a9f65028e218ec"><enum>(1)</enum><header>Bureau disbursements</header><text>At the request of Tribes, the Secretary of the Interior shall, for the 2018–2019 school year and each subsequent school year, disburse not more than 90 percent of the amounts made available under sections 1127 and 1130 for the school year to such Tribes that administer education savings account programs to enable the Tribes to award grants to education savings accounts for ESA eligible students for such school year, in accordance with subsection (b).</text>
 </paragraph><paragraph id="id4e4a2c73b5b04e87a52fbb831d6d7bfa"><enum>(2)</enum><header>Applicability</header><text>This section shall apply with respect to ESA eligible students who have submitted their application for participation under this section to the Tribe of which the student is an enrolled member on or after January 1, 2018.</text>
								</paragraph><paragraph id="idBA1260DBDB884B7CB7B972553B82FC4E"><enum>(3)</enum><header>Account administration</header>
 <subparagraph id="id87EEC702C0B148DE91F68FB600CCE3F8"><enum>(A)</enum><header>In general</header><text>A Tribe may enter into an agreement with a nonprofit entity for the administration of the accounts created through the Tribe's education savings account program.</text>
 </subparagraph><subparagraph id="idD6442416B0044F8FBC8A2196F9653781"><enum>(B)</enum><header>Nonprofit entity defined</header><text>In this paragraph, the term <term>nonprofit entity</term> means an entity that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text>
 </subparagraph></paragraph><paragraph id="id52986ba949fa4c9397ce2bab5dccf1de"><enum>(4)</enum><header>Use of funds</header><text>Funds disbursed to a Tribe under this section may be used for—</text> <subparagraph id="idfef00553030b4dcbbe5e435713052183"><enum>(A)</enum><text>private school tuition and fees;</text>
 </subparagraph><subparagraph id="id868539a4369f4f909e2756139b673adc"><enum>(B)</enum><text>textbooks, curriculum, and instructional materials;</text> </subparagraph><subparagraph id="id8b56dee5fd304d198b248bf9ccc48aee"><enum>(C)</enum><text>academic, Native language, or cultural tutoring;</text>
 </subparagraph><subparagraph id="idea9d132fdd8d494ba45c427f01962693"><enum>(D)</enum><text>educational services and therapies for students with special needs;</text> </subparagraph><subparagraph id="id602cb7c53e124764b5fe8ff03dee747a"><enum>(E)</enum><text>tuition and fees for a non-public online learning program;</text>
 </subparagraph><subparagraph id="id7EE9B52148D9460AA5037B7242D50EAF"><enum>(F)</enum><text>educational technology;</text> </subparagraph><subparagraph id="id4B3F76466E9648F6A24A4EE36E7C713C"><enum>(G)</enum><text>examination fees; or</text>
 </subparagraph><subparagraph id="idc24e9996f4bd4e359cf763411c734dbf"><enum>(H)</enum><text>transportation to and from a school not to exceed $2,000 per year, per ESA eligible student.</text> </subparagraph></paragraph></subsection><subsection id="idfb43d01bdf7d4c8a9e31af5e5fdefd01"><enum>(b)</enum><header>Disbursements</header> <paragraph id="idae08776b754e4a7f9fafeb4fa5884e07"><enum>(1)</enum><header>Amount</header><text>The amount disbursed by the Secretary of the Interior under subsection (a) to a Tribe shall be, with respect to each ESA eligible student for which the Tribe awards a grant under this section for a school year, the lesser of—</text>
 <subparagraph id="id074225d8a42248ea8c9243c5a13c0a12"><enum>(A)</enum><text>the amount of the grant provided by the Tribe to the education savings account of the ESA eligible student for the applicable school year; and</text>
 </subparagraph><subparagraph id="id32e6e3eedd404e668c3e646a42c0d214"><enum>(B)</enum><text>90 percent of the amount that the Secretary would provide to a Bureau-funded school on behalf of such student for the applicable school year under sections 1127 and 1130.</text>
 </subparagraph></paragraph><paragraph id="idb83e7883146f4a7aa51344c3084fe3c4"><enum>(2)</enum><header>Quarterly disbursements</header><text>A Tribe that receives a disbursement amount under subsection (a) shall make quarterly grant distributions of such amount to education savings accounts for ESA eligible students.</text>
 </paragraph><paragraph id="idec3c9122a1a143829b1430d5f36bcb32"><enum>(3)</enum><header>Limitation</header><text>A Tribe shall allocate not more than 15 percent of the amount received per pupil under this section to the administration of the education savings account programs of the Tribe.</text>
 </paragraph><paragraph id="id6BF0CEA342A046659050C2D2C0305954"><enum>(4)</enum><header>Roll over and remaining funds in an account</header><text>Not more than 50 percent of an ESA eligible student's total grant amount for a school year made under this section may roll over for use to the following school year.</text>
 </paragraph></subsection><subsection id="id03c0674101e641bebbbef141155ed8f3"><enum>(c)</enum><header>Effect on allotments</header><text>For purposes of any calculation regarding the total number of eligible Indian students under section 1127, the Secretary shall include all ESA eligible students who participate in an education savings account program under this section.</text>
 </subsection><subsection id="idae63ef65516e401aa8d3101161c830c6"><enum>(d)</enum><header>Rule of construction</header><text>A grant awarded to an ESA eligible student under this section shall be considered assistance to the student and shall not be considered assistance to a school that enrolls the ESA eligible student or any other educational service provider from which the ESA eligible student receives services.</text>
 </subsection><subsection id="id065494886f714482b8d75721f4b23aee"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id65b32792fcf9460184a8bdbd589970f8"><enum>(1)</enum><header>ESA eligible student</header> <subparagraph id="idfd3c5bcb48ca4c1a9e99f293e8984e47"><enum>(A)</enum><header>In general</header><text>The term <term>ESA eligible student</term> means an individual who—</text>
 <clause id="id1b91beb48cb241faa735e8a5f97751bd"><enum>(i)</enum><text>is—</text> <subclause id="idbac4a6fa99c141ca8ae951d1922233b1"><enum>(I)</enum><text>an elementary school or secondary school student who attended a Bureau-funded school in the semester preceding the date on which the student first applies for participation in an education savings account program; or</text>
 </subclause><subclause id="iddb24695e813245f382d66e4f21a4cd11"><enum>(II)</enum><text>a child who will be eligible to attend a Bureau-funded school for kindergarten or any other elementary school grade in the next semester that will start after the date on which the student first applies for participation in an education savings account program;</text>
 </subclause></clause><clause id="idd573463ca10a4b0eb19294c566c287cc"><enum>(ii)</enum><text>will not be attending a Bureau-funded school, receiving an education savings account from another Tribe, or attending a public elementary school or secondary school, while the student is participating in an education savings account program of a Tribe; and</text>
 </clause><clause id="id6803a99f758b4b1e9bfe734d01f3bfb4"><enum>(iii)</enum><text>meets any eligibility requirements of the education savings account program of the Tribe in which the student applies to participate.</text>
 </clause></subparagraph><subparagraph id="ide80b2007561248f39af336cf00de9bd5"><enum>(B)</enum><header>Period of eligibility</header><text>A student who meets the requirements of clauses (i) and (iii) of subparagraph (A) for a school year and who was an enrolled member of the Tribe to which the student submitted an application for participation in the education savings account program of the Tribe at the time of submitting the application to the Tribe shall be deemed to meet the requirements of such clauses until the date on which the student graduates high school or reaches the age of 21 years, whichever occurs first.</text>
 </subparagraph></paragraph><paragraph id="id12a006f6ccdf44c1aff51bbbbd2e07cd"><enum>(2)</enum><header>Education savings account program</header><text>The term <term>education savings account program</term> means a program administered by a Tribe in which the Tribe awards a grant to an account controlled by a parent of an elementary school or secondary school student from which the parent may purchase goods and services needed for the education of the student.</text>
 </paragraph><paragraph id="id5309285950a74aff9529c469620ef41c"><enum>(3)</enum><header>Parent</header><text>The term <term>parent</term> means a parent, guardian, custodian, or other person with the authority to act on behalf of an ESA eligible student.</text>
 </paragraph><paragraph id="id83df2aff2d934678bbc7dfaca05a0406"><enum>(4)</enum><header>Tribe</header><text>The term <term>Tribe</term> means any recognized Indian tribe included on the current list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id62D0E65C6B1D44D399BB984CD0DC4115"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1126(c) of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2006">25 U.S.C. 2006(c)</external-xref>) is amended by striking <quote>section 1141(12)</quote> and inserting <quote>section 1142(12)</quote>.</text> </subsection><subsection id="id6648F8C53EC44805919D2B3A7698BB19"><enum>(c)</enum><header>GAO Study</header><text>Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall—</text>
 <paragraph id="id7e89557dc702438f8f7e63d178f3fb05"><enum>(1)</enum><text>conduct a review of the implementation of the amendments made by this Act during the preceding 3-year period, including any factors impacting increased participation in education savings account programs established pursuant to the amendments made by this Act;</text>
 </paragraph><paragraph id="ide8022ba6b2d74fa28c64c8a39731200a"><enum>(2)</enum><text>submit a report describing the results of the review under paragraph (1) to—</text> <subparagraph id="id09C11CC99B104F9EA4885083D36F3030"><enum>(A)</enum><text>the Committee on Indian Affairs of the Senate; and</text>
 </subparagraph><subparagraph id="idD48277AAACF04D3BAE3C8EF48DEF8822"><enum>(B)</enum><text>the Subcommittee on Indian, Insular and Alaska Native Affairs of the Committee on Natural Resources of the House of Representatives; and</text>
 </subparagraph></paragraph><paragraph id="id8B8C2E9EB1DC473ABD1BF0C83E5AA9AB"><enum>(3)</enum><text>publish the report under paragraph (2).</text></paragraph></subsection></section></legis-body> </bill>
