			 for
			 onshore pipeline facilities that could discharge oil into the Great Lakes
			 system with such requirements for offshore pipelines, to authorize the
			 Secretary of Transportation to issue an emergency order directing pipeline
			 owners
			 to comply with existing pipeline operating agreements or acquire
			 sufficient resources to appropriately respond to possible oil spill
			 incidents, and for
			 other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Liability Insurance in Event of Spill Act</short-title></quote> or the <quote><short-title>LINES Act</short-title></quote>.</text>
 </section><section id="idBF9C7C75BE3246B7BA8ADE407D31F8AC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1001 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701</external-xref>) is amended—</text> <paragraph id="id67B2754EE45247E1A8E19D6D8952A539"><enum>(1)</enum><text>by redesignating paragraphs (9), (10), (11), (12) through (15), (16) through (24), (25), (26), (27), (28), (29), (30), (31), (32), (33), (34) through (37), (38), (39), (40), (41), (42), (43), and (44) as paragraphs (10), (13), (14), (17) through (20), (22) through (30), (32), (33), (36), (35), (37), (39), (38), (40), (41), (43) through (46), (34), (9), (11), (12), (21), (31), and (42), respectively; and</text>
 </paragraph><paragraph id="idC63D2B60E2834A70A289B6068D45DDCB"><enum>(2)</enum><text>by inserting after paragraph (14) (as redesignated) the following:</text> <quoted-block display-inline="no-display-inline" id="idA40D8CF8ED2549B990E386F76D116F99" style="OLC"> <paragraph id="idF63B37DE0AB34F24B047B8AAB547A847"><enum>(15)</enum><header>Great Lakes pipeline</header><text>The term <term>Great Lakes pipeline</term> means any pipeline that crosses the navigable waters of the Great Lakes system.</text>
 </paragraph><paragraph id="id93BE5D8177B74C80A3958916D4A4C1FD"><enum>(16)</enum><header>Great Lakes system</header><text>The term <term>Great Lakes system</term> means—</text> <subparagraph id="idC59A1E94915D415AAE02FC1C52743D34"><enum>(A)</enum><text>Lake Ontario, Lake Erie, Lake Huron (including Lake St. Clair), Lake Michigan, and Lake Superior, and the connecting channels (Saint Mary's River, Saint Clair River, Detroit River, Niagara River, and Saint Lawrence River to the Canadian border); and</text>
 </subparagraph><subparagraph id="idB56D445F94104403B07879EB93E86ECF"><enum>(B)</enum><text>any tributary of a lake or connecting channel described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="id2F1A2B2BEE8A4A8C9D3A807B9B68590F"><enum>3.</enum><header>Liability for Great Lakes pipelines</header><text display-inline="no-display-inline">Section 1004(a) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704(a)</external-xref>) is amended—</text>
 <paragraph id="idE008D0C5D33B415CBF50D721F09E9837"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="id3E179BF4E387400281E81280B5CACA82"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id2D37D60001CD442DB263815657136609"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7C9A298716B740699D1890AC9A968243" style="OLC"> <paragraph id="id7FF14732B75349069880C0A6DAD02FA7"><enum>(5)</enum><text>for a Great Lakes pipeline, the total of all removal costs plus $75,000,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="idE1ECD094580843B79E37C9361B7577D2"><enum>4.</enum><header>Financial responsibility requirement for Great Lakes pipelines</header><text display-inline="no-display-inline">Section 1016(c) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2716">33 U.S.C. 2716(c)</external-xref>) is amended—</text> <paragraph id="id8D7A7BD9C26F403C93B824A906E6F422"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and Great Lakes pipelines</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">facilities</header-in-text></quote>; and</text>
 </paragraph><paragraph id="idC01526C149FE4C22905A4531CA525E2F"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idD553FFC3CFD349C4B314889839CFD5CB" style="OLC"> <paragraph id="id698A0CD7DA464A6F8B38DEA97A35B429"><enum>(3)</enum><header>Great Lakes pipelines</header><text>A responsible party with respect to a Great Lakes pipeline shall establish and maintain evidence of financial responsibility in the same manner as described in paragraph (1).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id93D2BBF71BA44BC3BA92D1B463667361" section-type="subsequent-section"><enum>5.</enum><header>Emergency order authority</header><text display-inline="no-display-inline">Section 60117(o) of title 49, United States Code, is amended—</text> <paragraph id="id526EB175ED2F4CAA8AF2A3A2A9B3B570"><enum>(1)</enum><text display-inline="yes-display-inline">by amending paragraph (1) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id19BCB8B7C70644C098B17B812649E77D" style="OLC">
 <paragraph id="idc3f3b2d0c57b49cfbad7453502ef7881"><enum>(1)</enum><header>In general</header><text>The Secretary may issue an emergency order described in paragraph (3) to impose emergency restrictions, prohibitions, and safety measures on owners and operators of hazardous liquid pipeline facilities, without prior notice or an opportunity for a hearing, to the extent necessary to abate an imminent hazard described in subparagraph (A), comply with the conditions referred to in subparagraph (B), or acquire the necessary insurance or other resources needed to respond to an oil spill referred to in subparagraph (C) if the Secretary—</text>
 <subparagraph id="id6E83A1DBDBC6488AA1295A478566E695"><enum>(A)</enum><text>determines that an unsafe condition or practice, or a combination of unsafe conditions and practices, constitutes or is causing an imminent hazard;</text>
 </subparagraph><subparagraph id="id8fb3c3562f3c45649cdb380df986f48f"><enum>(B)</enum><text>discovers reliable evidence that the pipeline is violating conditions required for its operation that were previously agreed upon between the responsible party and a State, tribal, or local government; or</text>
 </subparagraph><subparagraph id="ide7880d8608c14a20a0c2aaa3a2802b5d"><enum>(C)</enum><text>after consultation with the Administrator of the Environmental Protection Agency and the Commandant of the Coast Guard, determines that—</text>
 <clause id="id224FD3FC724A4936AC2D13FDFCB1C827"><enum>(i)</enum><text>inadequate resources are available to respond to and clean up an oil spill during seasonal conditions or conditions expected or caused by an extreme weather event; or</text>
 </clause><clause id="id4E1193741E2A4044B7E15FE8C9DA577B"><enum>(ii)</enum><text>the responsible party cannot demonstrate, through any of the methods described in section 1016(e) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2716">33 U.S.C. 2716(e)</external-xref>) that it has sufficient financial resources to satisfy the liability limits described in section 1004 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2704">33 U.S.C. 2704</external-xref>) in the event of an oil spill incident.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id57BAD6AC676744318DE5D7AA857A60DE"><enum>(2)</enum><text>in paragraph (3)—</text> <subparagraph id="id8B5E812EA86E4D48814BFC92F351599C"><enum>(A)</enum><text>in subparagraph (A)—</text>
 <clause id="id1442EE7C3EB44741BB5ABEB2BCF05120"><enum>(i)</enum><text>by inserting <quote>(i)</quote> before <quote>the violation</quote>; and</text> </clause><clause id="idE274E129CFE143A6A9AFF2E647AE6E90"><enum>(ii)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idB322BFCFCF654920AC4FEB216689C779" style="OLC">
 <clause id="id700EF7F1461145309DFFE964D12EBCE5"><enum>(ii)</enum><text>evidence that the pipeline is violating required operating conditions; or</text> </clause><clause id="idF5BEE957F50E43BC9936F7BB086DDDC4"><enum>(iii)</enum><text>the reasons that responsible party’s existing resources are inadequate to remedy either of the situations described in paragraph (1)(C);</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="idD18852A384E44E2DAA542AFAEA94785D"><enum>(B)</enum><text>in subparagraph (E)—</text> <clause id="id16212E933F3C41C581D5C1B70B6CEF79"><enum>(i)</enum><text>by inserting <quote>(i)</quote> before <quote>how the order</quote>; and</text>
 </clause><clause id="id9938CBE7719A49CB963A4C660CD763AA"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id5CE1E7C7F5A94B4886F8ECC35991487E" style="OLC"> <clause id="id91CC7253BE704F02A736EC3A9B077F3A"><enum>(ii)</enum><text>what the responsible party shall be required to do to ensure that the pipeline complies with applicable operating conditions; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id1D846721FEA94A879537631BB6C55527"><enum>(iii)</enum><text>the resources that the responsible party shall be required to acquire to remedy either of the situations described in paragraph (1)(C); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph></section></legis-body></bill>
