 <section id="idB4DF62DCE84A4C599DFA4B247EC089AC"><enum>101.</enum><header>Sense of Congress on appropriations levels</header><text display-inline="no-display-inline">It is the sense of Congress that Congress should provide robust funding of capitalization grants to States to fund those States’ drinking water treatment revolving loan funds established under section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) and the State water pollution control revolving funds established under title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref> et seq.).</text>
 </section><section commented="no" display-inline="no-display-inline" id="iddd74ab09-704a-4139-b286-658a9e81af16" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Other authorized activities</header><text display-inline="no-display-inline">Section 1452(k) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(k)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idAFD9C770EE8946A394E212B6CF700E2F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(D), by inserting <quote>and the implementation of plans to protect source water identified in a source water assessment under section 1453</quote> before the period at the end; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5E454811545948E88BAA9E30B39BE599"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(E), by inserting <quote>and implement plans to protect source water identified in a source water assessment under section 1453</quote> after <quote>wellhead protection programs</quote>.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="idc2b57e66-5689-4b80-b1d7-efb040739cc0" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Negotiation of contracts</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6d7ddcba-c57e-48bb-bdf2-c7eba88642ed" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="id06014335-837c-43bc-8d14-d608c2d5a13a"><enum>(s)</enum><header display-inline="yes-display-inline">Negotiation of contracts</header><text display-inline="yes-display-inline">For communities with populations of more than 10,000 individuals, a contract to be carried out using funds directly made available by a capitalization grant under this section for program management, construction management, feasibility studies, preliminary engineering, design, engineering, surveying, mapping, or architectural or related services shall be negotiated in the same manner as—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6629a9a5-db2b-484f-b7c2-c337586e5312"><enum>(1)</enum><text display-inline="yes-display-inline">a contract for architectural and engineering services is negotiated under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/11">chapter 11</external-xref> of title 40, United States Code; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22b1e081-7cef-43c1-8528-d4c193f34350"><enum>(2)</enum><text display-inline="yes-display-inline">an equivalent State qualifications-based requirement (as determined by the Governor of the State).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="id3eb876a4-b00d-47eb-9668-7fd716cc7c0e" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">WaterSense program</header><text display-inline="no-display-inline">The Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j</external-xref> et seq.) is amended by adding after part F the following:</text>

					<part commented="no" id="id917E31B9323E4595B033F999DC5FA9EB" level-type="subsequent" style="OLC"><enum>G</enum><header display-inline="yes-display-inline">Additional provisions</header>
						<section commented="no" display-inline="no-display-inline" id="idF43F01D1E93B4334AC9297A7F40BA7FD" section-type="subsequent-section"><enum>1471.</enum><header display-inline="yes-display-inline">WaterSense program</header>
							<subsection commented="no" display-inline="no-display-inline" id="id7079066e-2ea3-4efd-ac02-5621466a62f1"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of WaterSense program</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id9a6545a9-55b1-4fc9-8ecd-27c7b4a3e6f7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established within the Agency a voluntary WaterSense program to identify and promote water-efficient products, buildings, landscapes, facilities, processes, and services that, through voluntary labeling of, or other forms of communications regarding, products, buildings, landscapes, facilities, processes, and services while meeting strict performance criteria, sensibly—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8f5e88bd-6690-48d9-85b2-3d7f2e6d3b47"><enum>(A)</enum><text display-inline="yes-display-inline">reduce water use;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11e5f8d6-1b7e-4311-971e-6c1849da0817"><enum>(B)</enum><text display-inline="yes-display-inline">reduce the strain on public and community water systems and wastewater and stormwater infrastructure;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb920a23-326a-43bf-bb5a-856f1066e99a"><enum>(C)</enum><text display-inline="yes-display-inline">conserve energy used to pump, heat, transport, and treat water; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15c34163-7565-4871-8d46-37c62c48d3bd"><enum>(D)</enum><text display-inline="yes-display-inline">preserve water resources for future generations.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e586a93-2f39-4d64-bad5-f1da6c31ebd2"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The Administrator shall, consistent with this section, identify water-efficient products, buildings, landscapes, facilities, processes, and services, including categories such as—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ide3c293d1-4b93-4d34-b8e7-5d8ab106c3da"><enum>(A)</enum><text display-inline="yes-display-inline">irrigation technologies and services;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafdf352a-442c-43da-8f8f-a8e209ae86d4"><enum>(B)</enum><text display-inline="yes-display-inline">point-of-use water treatment devices;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1375d354-983d-4b4f-84ec-2362d780902c"><enum>(C)</enum><text display-inline="yes-display-inline">plumbing products;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb48c821f-c2df-4ef3-8c94-aff47df7dc2b"><enum>(D)</enum><text display-inline="yes-display-inline">reuse and recycling technologies;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb60f69a3-009c-4d0d-9be5-413be768d432"><enum>(E)</enum><text display-inline="yes-display-inline">landscaping and gardening products, including moisture control or water enhancing technologies;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1effaf87-2158-4244-8019-c0143b213d71"><enum>(F)</enum><text display-inline="yes-display-inline">xeriscaping and other landscape conversions that reduce water use;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94d35be7-b403-476e-aabc-09f751aba96e"><enum>(G)</enum><text display-inline="yes-display-inline">whole house humidifiers; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb47528d5-3db5-4e01-a0a2-97ae6430a82a"><enum>(H)</enum><text display-inline="yes-display-inline">water-efficient buildings or facilities.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide933290e-6fcb-4dbd-913c-1ab96f1fc523"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Administrator, coordinating as appropriate with the Secretary of Energy, shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="idbadcec18-6b22-4f86-924e-af39845564b5"><enum>(1)</enum><text display-inline="yes-display-inline">establish—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id3e8d861b-201c-4601-9607-f35912312ebb"><enum>(A)</enum><text display-inline="yes-display-inline">a WaterSense label to be used for items meeting the certification criteria established in accordance with this section; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e868343-5c78-4712-9d14-123731a953c7"><enum>(B)</enum><text display-inline="yes-display-inline">the procedure, including the methods and means, and criteria by which an item may be certified to display the WaterSense label;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a9a0304-ddbd-4123-b7cb-b231d3386658"><enum>(2)</enum><text display-inline="yes-display-inline">enhance public awareness regarding the WaterSense label through outreach, education, and other means;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb7850f8e-a6af-4fc7-8b68-634dd60c837b"><enum>(3)</enum><text display-inline="yes-display-inline">preserve the integrity of the WaterSense label by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id90f5d32e-b7f7-418d-b71f-3f9e4b5376fb"><enum>(A)</enum><text display-inline="yes-display-inline">establishing and maintaining feasible performance criteria so that products, buildings, landscapes, facilities, processes, and services labeled with the WaterSense label perform as well or better than less water-efficient counterparts;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf8576bd-d88c-46ba-8cda-35f554c5b111"><enum>(B)</enum><text display-inline="yes-display-inline">overseeing WaterSense certifications made by third parties, which shall be independent third-party product certification bodies accredited by an accreditation entity domiciled in the United States, such as the American National Standards Institute, as achieving—</text>
 <clause commented="no" display-inline="no-display-inline" id="id7E2B778E836C43C0BF3F6EBD4DF198F4"><enum>(i)</enum><text display-inline="yes-display-inline">the requirements described in the document of the International Organization for Standardization and the International Electrotechnical Commission entitled <quote>ISO/IEC 17065 Conformity assessment—Requirements for bodies certifying products, processes and services</quote> and dated September 2012; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id45DEAFB4B3D64D3CBBE33508BF6D41ED"><enum>(ii)</enum><text>the applicable WaterSense requirements;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b5f0372-c745-4095-8727-4444482d2cd5"><enum>(C)</enum><text display-inline="yes-display-inline">as determined appropriate by the Administrator, using testing protocols, from the appropriate, applicable, and relevant consensus standards, for the purpose of determining standards compliance; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9740ab9b-1b89-4e8b-8558-a87bae9f33bb"><enum>(D)</enum><text display-inline="yes-display-inline">auditing the use of the WaterSense label in the marketplace and preventing cases of misuse;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb00eee07-0bb1-4444-beeb-abfc8d096907"><enum>(4)</enum><text display-inline="yes-display-inline">not more than 6 years after adoption or major revision of any WaterSense specification, review and, if appropriate, revise the specification to achieve additional water savings;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71de0709-f259-4156-bf70-4721bda65bdc"><enum>(5)</enum><text display-inline="yes-display-inline">in revising a WaterSense specification—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfeb9fa96-ac7b-4c91-b707-a269c0f3f040"><enum>(A)</enum><text display-inline="yes-display-inline">provide reasonable notice to interested parties and the public of any changes, including effective dates, and an explanation of the changes;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd62c198a-8e25-46a6-84fb-11e35d800916"><enum>(B)</enum><text display-inline="yes-display-inline">solicit comments from interested parties and the public prior to any changes;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e0e3b60-762c-4d1b-a71f-35a58942bdf5"><enum>(C)</enum><text display-inline="yes-display-inline">as appropriate, respond to comments submitted by interested parties and the public; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id629343bc-3bb8-431a-94b7-3256803c1e60"><enum>(D)</enum><text display-inline="yes-display-inline">provide an appropriate transition time prior to the applicable effective date of any changes, taking into account the timing necessary for the manufacture, marketing, training, and distribution of the specific water-efficient product, building, landscape, process, or service category being addressed; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11cb5b0b-a7ae-4e2a-a07c-bca5343d2153"><enum>(6)</enum><text display-inline="yes-display-inline">not later than December 31, 2018, consider for review and revision any WaterSense specification adopted before January 1, 2012.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7e604765-cf56-4bc5-a3aa-9b89958df379"><enum>(c)</enum><header display-inline="yes-display-inline">Transparency</header><text display-inline="yes-display-inline">The Administrator shall, to the maximum extent practicable and not less than annually, regularly estimate and make available to the public the production and relative market shares and savings of water, energy, and capital costs of water, wastewater, and stormwater attributable to the use of WaterSense-labeled products, buildings, landscapes, facilities, processes, and services.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idcb931911-234d-41fb-b1f7-754d6f7fe530"><enum>(d)</enum><header display-inline="yes-display-inline">Distinction of authorities</header><text display-inline="yes-display-inline">In setting or maintaining specifications for Energy Star pursuant to section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>), and WaterSense under this section, the Secretary of Energy and the Administrator shall coordinate to prevent duplicative or conflicting requirements among the respective programs.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id5caa2cd8-5023-4742-86cd-3cbe576a4844"><enum>(e)</enum><header display-inline="yes-display-inline">No warranty</header><text display-inline="yes-display-inline">A WaterSense label shall not create an express or implied warranty.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block> </section></title><title id="id2B8B70DA29844CCDB2A15BD791F264AE" style="OLC"><enum>II</enum><header>Wastewater infrastructure</header> <section commented="no" display-inline="no-display-inline" id="idd3e4be05-250d-4f73-8375-dee8f91e461c" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Sewer overflow control grants</header><text display-inline="no-display-inline">Section 221 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1301">33 U.S.C. 1301</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6f0dad27-e0b4-4f70-999d-3f0f38d2e869"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking the subsection designation and heading and all that follows through <quote>subject to subsection (g), the Administrator may</quote> in paragraph (2) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id8c421aa6-5f88-4f74-ae37-536bf7b71821" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idfb8149a5-5625-48af-999d-88ca1c4442ff"><enum>(a)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">The Administrator may—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3372407c-982c-4a6e-8d6e-2f1867f11ecc"><enum>(1)</enum><text display-inline="yes-display-inline">make grants to States for the purpose of providing grants to a municipality or municipal entity for planning, designing, and constructing—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id88bd8d89-d7bb-4eb5-b2da-86db916487fd"><enum>(A)</enum><text display-inline="yes-display-inline">treatment works to intercept, transport, control, or treat municipal combined sewer overflows and sanitary sewer overflows; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf811ffb9-8829-4b45-bef6-ebba671b542d"><enum>(B)</enum><text display-inline="yes-display-inline">measures to manage, reduce, treat, or recapture stormwater or subsurface drainage water; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9169887-f7c8-4f98-883b-7ce791a09e19"><enum>(2)</enum><text display-inline="yes-display-inline">subject to subsection (g),</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc428b73-78c2-42f9-b32e-8c2399ed574d"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idb445a7e0-d2dc-4772-908e-dede35a55d71"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking the semicolon at the end and inserting <quote>; or</quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e112bac-3a5c-4ccb-92c1-99a2c8cd57d5"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraphs (2) and (3); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide63730f0-232b-46c0-ba91-7e0164dca695"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (2);</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d3a8b67-9c5b-4999-abf5-38aacb004133"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsections (e) through (g) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id6dd47818-e05b-4dd0-9b30-b3c49d9edb70" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idd43c3899-10ee-4759-8500-5fa164ded718"><enum>(e)</enum><header display-inline="yes-display-inline">Administrative requirements</header> <paragraph commented="no" display-inline="no-display-inline" id="id90491bc1-54c5-4a85-8e73-569d5d48842b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), a project that receives grant assistance under subsection (a) shall be carried out subject to the same requirements as a project that receives assistance from a State water pollution control revolving fund established pursuant to title VI.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbb24969-16ca-451e-a9ec-bb4648a9c0de"><enum>(2)</enum><header display-inline="yes-display-inline">Determination of governor</header><text display-inline="yes-display-inline">The requirement described in paragraph (1) shall not apply to a project that receives grant assistance under subsection (a) to the extent that the Governor of the State in which the project is located determines that a requirement described in title VI is inconsistent with the purposes of this section.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5e85d960-8469-43b7-a5f4-93c6b5a64650"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section, to remain available until expended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idfb2a45e5-31e8-4756-9572-f5ec51e49775"><enum>(1)</enum><text display-inline="yes-display-inline">$250,000,000 for fiscal year 2017;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id093cc546-b4e9-4077-99a5-15ae71d9cb7e"><enum>(2)</enum><text display-inline="yes-display-inline">$300,000,000 for fiscal year 2018;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef2250d1-e9c1-4044-aa63-e3af0f46abf3"><enum>(3)</enum><text display-inline="yes-display-inline">$350,000,000 for fiscal year 2019;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6ee1b97-6db5-4337-8297-dbfe6b72cd3c"><enum>(4)</enum><text display-inline="yes-display-inline">$400,000,000 for fiscal year 2020; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70bc51e8-265f-4cdb-8525-47d8e2322ad0"><enum>(5)</enum><text display-inline="yes-display-inline">$500,000,000 for fiscal year 2021.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcda7abe9-9f4a-43e2-acd8-db78cdc5a7a4"><enum>(g)</enum><header display-inline="yes-display-inline">Allocation of funds</header> <paragraph commented="no" display-inline="no-display-inline" id="id03965940-cf8b-4a42-addf-5973d17acd31"><enum>(1)</enum><header display-inline="yes-display-inline">Fiscal year 2017 and 2018</header><text display-inline="yes-display-inline">For each of fiscal years 2017 and 2018, subject to subsection (h), the Administrator shall use the amounts made available to carry out this section to provide grants to municipalities and municipal entities under subsection (a)(2)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idba700e23-f073-4600-b54b-4cc2b845ca87"><enum>(A)</enum><text display-inline="yes-display-inline">in accordance with the priority criteria described in subsection (b); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd49d847d-9a16-4aef-9286-6ee9dbc50e62"><enum>(B)</enum><text display-inline="yes-display-inline">with additional priority given to proposed projects that involve the use of—</text>
 <clause commented="no" display-inline="no-display-inline" id="idb4af547b-5729-48b5-89bc-06977963396b"><enum>(i)</enum><text display-inline="yes-display-inline">nonstructural, low-impact development;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id99294c41-c6bf-40e8-8815-356c09b4f208"><enum>(ii)</enum><text display-inline="yes-display-inline">water conservation, efficiency, or reuse; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ida27d5554-e201-4a9d-941d-483ac99bdbe8"><enum>(iii)</enum><text display-inline="yes-display-inline">other decentralized stormwater or wastewater approaches to minimize flows into the sewer systems.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb329af9d-394b-4a26-a0f2-0f91ac643a04"><enum>(2)</enum><header display-inline="yes-display-inline">Fiscal year 2019 and thereafter</header><text display-inline="yes-display-inline">For fiscal year 2019 and each fiscal year thereafter, subject to subsection (h), the Administrator shall use the amounts made available to carry out this section to provide grants to States under subsection (a)(1) in accordance with a formula that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ide63ea1ef-3da1-41d2-87f7-5a6e6c27cc04"><enum>(A)</enum><text display-inline="yes-display-inline">shall be established by the Administrator, after providing notice and an opportunity for public comment; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf85207cb-307e-4894-99d7-70930f78fef5"><enum>(B)</enum><text display-inline="yes-display-inline">allocates to each State a proportional share of the amounts based on the total needs of the State for municipal combined sewer overflow controls and sanitary sewer overflow controls, as identified in the most recent survey—</text>
 <clause commented="no" display-inline="no-display-inline" id="id6821f5e1-b927-4046-8bcd-c6dd68a7eba2"><enum>(i)</enum><text display-inline="yes-display-inline">conducted under section 210; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ida26d2622-f5be-4543-a18f-a62bb3fe0cba"><enum>(ii)</enum><text display-inline="yes-display-inline">included in a report required under section 516(b)(1).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
