<section id="H30CF6D563FB34430839E4D41A043FC0B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agency Accountability Act of 2017</short-title></quote>.</text></section> <section id="H3F535F89BBD741C58ADC16A89169DEBE"><enum>2.</enum><header>Appropriation of funds required</header> <subsection id="HF74D08CB5C0D4E94A322AA89EB5F2B9F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and consistent with subsection (c), an agency that receives a fee, fine, penalty, or proceeds from a settlement shall deposit such amount in the general fund of the Treasury.</text></subsection> 
<subsection id="H10E2F998C5FC4B36B7988396619640AA"><enum>(b)</enum><header>Use of amounts</header> 
<paragraph id="HC66561121041401FA7145ECEAA4B5AC2"><enum>(1)</enum><header>Subject to appropriation</header><text display-inline="yes-display-inline">Consistent with paragraph (2), any amounts deposited pursuant to subsection (a) shall only be available to the extent, and in such amounts, as are provided in advance in appropriation Acts.</text></paragraph> <paragraph id="HCF933B77C1CB46A19384DD9CA7CE811B"><enum>(2)</enum><header>Obligation limitation; deficit reduction</header><text>Of the amounts so deposited during the fiscal year in which this section is enacted, such amounts—</text> 
<subparagraph id="H74BC559AD74F41AF9B954C7D419D870B"><enum>(A)</enum><text>may not be available for obligation during such fiscal year; and</text></subparagraph> <subparagraph id="H278FC21272E24973880A650E6C7BB15D"><enum>(B)</enum><text>shall be used for purposes of deficit reduction.</text></subparagraph></paragraph></subsection> 
<subsection id="H6C7272CD3004479B8D3AE863E69FFD90"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">This section shall not apply to any amounts to be paid to an individual entitled to such amounts as a whistleblower, including any amounts received as a percentage of amounts received by the Government pursuant to a judgment or settlement agreement.</text></subsection> <subsection id="H93E2EF6E79574D16B3F4D24BD558EBC7"><enum>(d)</enum><header>USPTO Report to Congress required</header><text display-inline="yes-display-inline">Not later than March 1 of each year, the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office shall submit to Congress a report that describes any fee, fine, penalty, or proceeds from a settlement collected by the United States Patent and Trademark Office for the previous fiscal year.</text></subsection> 
<subsection commented="no" id="H88924F03F30041F48B67382EB25CC8A9"><enum>(e)</enum><header>Agency defined</header><text display-inline="yes-display-inline">The term <quote>agency</quote> has the meaning given that term in section 551 of title 5, United States Code, but does not include the United States Postal Service or the United States Patent and Trademark Office.</text></subsection></section> <section id="H467664F2632147C0A50FD33244337ED4"><enum>3.</enum><header>Offsetting collections and receipts as revenue</header> <subsection id="H752AE8E7CAA942AF891A7A7E9DC78D5F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/621">2 U.S.C. 621</external-xref> et seq.) is amended—</text> 
<paragraph id="H93559F0F030E4C598C00B17FE1E28316"><enum>(1)</enum><text>in section 3(2)(A)(iv), by inserting <quote>except as provided in section 316,</quote> before <quote>offsetting receipts</quote>; and</text></paragraph> <paragraph id="HCA053DD1B9F4465BBA165E136E33F6FD"><enum>(2)</enum><text>by adding after section 315 the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC8CECD80B01D462BBC8EB788F32C726D" style="appropriations"> 
<section id="HF4FB38A3F5974BBA8ADB69500CC763E2"><enum>316.</enum><header>Treatment of offsetting collections and receipts</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, offsetting receipts and collections shall be treated as revenue for purposes of carrying out this or any other Act. The preceding sentence shall not apply to the United States Postal Service or the United States Patent and Trademark Office.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H97B13C85A42E4B6AB7497D81576B8A77"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 315 the following:</text>

<subsection id="H21F9A030DC6740DBA05C7C1E30CA7369"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply during budget years (as that term is defined in section 250(c)(12) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900(c)(12)</external-xref>)) beginning in 2019.</text></subsection></section> </legis-body></bill>
