 <subsection id="H515FACB3C9D848FBA1087E6A43082CF6"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>New Deal Rural Broadband Act</short-title> of 2017</quote>.</text> </subsection><subsection id="H050B84F9CC8942F1A40872A46EC1179D"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for this Act is as follows:</text>

 <subsection id="HF5A72B426CF24FEB8C034A14D7F4AB5B"><enum>(a)</enum><header>Establishment</header><text>Title VI of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref> et seq.) is amended—</text> <paragraph id="H8344756A39484850BE327201BF2FD2E0"><enum>(1)</enum><text>by redesignating sections 601 through 603 as sections 603 through 605, respectively; and</text>
 </paragraph><paragraph id="HCE90AE2CFA524553BC6FE3D67F284676"><enum>(2)</enum><text>by inserting before section 603 (as so redesignated) the following new sections:</text> <quoted-block id="H677DB0E3C74646EFACA2F5D5CE92D9C7" style="OLC"> <section id="HD5EB3ACE68AB4EDEA3678DEF33BF268F"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
 <paragraph id="H68E9E5248F444F4AA66C1A5297ACE6CE"><enum>(1)</enum><header>Office</header><text>The term <quote>Office</quote> means the Office of Rural Broadband Initiatives established under section 602(a)(1).</text> </paragraph><paragraph id="HF21D74FFFCAE4155B16A8C679BE82011"><enum>(2)</enum><header>Panel</header><text display-inline="yes-display-inline">The term <quote>Panel</quote> means the Rural Broadband Advisory Panel established pursuant to section 602(d).</text>
 </paragraph><paragraph id="H360B2737736D46BFB79DC819471316AE"><enum>(3)</enum><header>Under secretary</header><text>The term <quote>Under Secretary</quote> means the Under Secretary for Rural Broadband Initiatives appointed under section 602(a)(2).</text> </paragraph></section><section id="H0F97B7015DD64FEF98659D1928D8CF77"><enum>602.</enum><header>Office of rural broadband initiatives</header> <subsection id="H7E846A10CA6146059A56FCD1FC718A27"><enum>(a)</enum><header>Establishment</header> <paragraph id="H98590E19EEC841FDB65C90F43A3E00D4"><enum>(1)</enum><header>In general</header><text>There is established in the Department of Agriculture the Office of Rural Broadband Initiatives.</text>
 </paragraph><paragraph id="HB844AAAE1A8842C582A47E4C2E3D98A1"><enum>(2)</enum><header>Under Secretary</header><text>The head of the Office shall be the Under Secretary for Rural Broadband Initiatives, who shall—</text> <subparagraph id="H1C0066729A3E4DA4B099493A9777600D"><enum>(A)</enum><text>be appointed by the President, by and with the advice and consent of the Senate; and</text>
 </subparagraph><subparagraph id="HFA70282C2F6645CFB9BF5FCD585996F7"><enum>(B)</enum><text>report directly to the Secretary.</text> </subparagraph></paragraph></subsection><subsection id="HB6ADCDD585284ACDADD9B853426B5296"><enum>(b)</enum><header>Responsibilities</header> <paragraph id="HDEBCA83D69D844CA87ACD42D71C21A0D"><enum>(1)</enum><header>In general</header><text>The Under Secretary shall administer all rural and underserved areas broadband-related grant, loan, and loan guarantee programs administered by the Administrator of the Rural Utilities Service as of the date of the enactment of this section, including—</text>
 <subparagraph id="HAD03CCA590624010B33EB51C5D7D3D1F"><enum>(A)</enum><text>the rural broadband access loan, loan guarantee, and grant program under section 603;</text> </subparagraph><subparagraph id="H7D031C3F50D942F0AEB32A87C7669C0E"><enum>(B)</enum><text>the breaking ground on rural broadband program under section 606;</text>
 </subparagraph><subparagraph id="HF8956327B180459BA47041F9CA7C1AD2"><enum>(C)</enum><text>the tribal broadband assistance program under section 607;</text> </subparagraph><subparagraph id="H54A43F7106334816B22C3886D15BE7E2"><enum>(D)</enum><text>the Community Connect Grant Program described in subpart A of part 1739 of title 7, Code of Federal Regulations (or successor regulations); and</text>
 </subparagraph><subparagraph commented="no" id="H50FAE8494AA24D77AD5F0C2830B97C75"><enum>(E)</enum><text>loans under title II.</text> </subparagraph></paragraph><paragraph id="H94BADFF72C65426E95A9373650A4E9AE"><enum>(2)</enum><header>Requirements</header><text>The Under Secretary shall—</text>
 <subparagraph id="H1C1CFD8109F644D9864677B9F525626B"><enum>(A)</enum><text>conduct extensive, nationwide outreach to rural and underserved areas;</text> </subparagraph><subparagraph id="H72FAFBE9A03E4ACCB9EDAF36289A2B5E"><enum>(B)</enum><text>develop a comprehensive strategy for broadband in rural and underserved areas;</text>
 </subparagraph><subparagraph id="H2BAC7D5C6C8243458E6F27888194CD90"><enum>(C)</enum><text>coordinate Federal resources for State, regional, and local governments to provide broadband assistance to citizens living and working in rural and underserved areas;</text>
 </subparagraph><subparagraph id="H5B46E76F9FBB43A1BF7E74A681EF5EFB"><enum>(D)</enum><text>assess all relevant technologies (including WiFi, WIMAX, DSL, cable, satellite, fiber, and broadband over power lines), to determine if such technologies are able to support in whole or in part rural broadband requirements;</text>
 </subparagraph><subparagraph id="HF1A1879008534040B2BEFA4C74347B07"><enum>(E)</enum><text>establish and maintain the Web-based clearinghouse described in subsection (e);</text> </subparagraph><subparagraph id="H20E2E8481EE7439C882A52B7E5AE904A"><enum>(F)</enum><text>coordinate Federal rural broadband programs; and</text>
 </subparagraph><subparagraph id="H9A160105D8934332BBB93C3CFB240333"><enum>(G)</enum><text>provide technical assistance to State, regional, and local governments to develop deployment strategies for broadband in rural and underserved areas.</text>
									</subparagraph></paragraph></subsection><subsection id="H896F165786FF484EAE7E754B98F963C1"><enum>(c)</enum><header>Comprehensive rural broadband strategy</header>
 <paragraph id="HD5C23FF7AC054FA5A629F2519404F183"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the appointment of the first Under Secretary under subsection (a), and annually thereafter, the Under Secretary shall submit to the President and to the Committees on Agriculture and Energy and Commerce of the House of Representatives and the Committees on Agriculture, Nutrition, and Forestry and Commerce, Science, and Transportation of the Senate, a report describing a comprehensive strategy for broadband in rural and underserved areas that includes—</text>
 <subparagraph id="HA4A19DC9100445D09E39A3245077750C"><enum>(A)</enum><text>recommendations—</text> <clause id="HBD193AD84916445AB46D3A97918C0575"><enum>(i)</enum><text>to promote interagency coordination between Federal agencies with respect to policies, procedures, targeted resources, and existing rural and underserved areas broadband programs;</text>
 </clause><clause id="HFB95C8EEBEF64971A6830901A0DD730E"><enum>(ii)</enum><text>to improve and streamline the Federal policies, programs, and services relating to rural and underserved areas broadband technologies;</text>
 </clause><clause id="H6CDA46E58434473D994B68F43BC569A2"><enum>(iii)</enum><text>to specify how Federal agency programs and resources can meet rural and underserved area broadband requirements; and</text>
 </clause><clause id="H478BD4A900F9454F86748AC5BA12B259"><enum>(iv)</enum><text>to promote successful model deployments and appropriate technology use in rural and underserved areas so that State, regional, and local governments can benefit from the cataloging of successes of other State, regional, and local governments;</text>
 </clause></subparagraph><subparagraph id="HBA924A67AB844D9494D6A139655ACD50"><enum>(B)</enum><text>a needs assessment for the implementation of rural and underserved areas broadband; and</text> </subparagraph><subparagraph id="H96F79E4735C041918495D9CEDCF82641"><enum>(C)</enum><text>a strategic plan for comprehensive rural and underserved areas broadband and a description of the amount of time needed to achieve such strategic plan.</text>
 </subparagraph></paragraph><paragraph id="H4A718CF83F9A42C78B3D3B58EC2CE33A"><enum>(2)</enum><header>Annual report update</header><text>The Under Secretary shall update the report required under paragraph (1) on an annual basis.</text> </paragraph></subsection><subsection id="HE3A95A7F9401438680353AB5ACF1F5E0"><enum>(d)</enum><header>Rural broadband advisory panel</header> <paragraph id="H203C812C3E0D4D1691D54AB1134C8C58"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of appointment of the first Under Secretary under subsection (a), the Under Secretary shall submit to the Committees on Agriculture and Energy and Commerce of the House of Representatives and the Committees on Agriculture, Nutrition, and Forestry and Commerce, Science, and Transportation of the Senate, a plan to establish a Rural Broadband Advisory Panel.</text>
 </paragraph><paragraph id="HEBD62CD3CDCE4FEAB28E39AFEADB14E1"><enum>(2)</enum><header>Chairperson</header><text>The Panel shall be chaired by the Under Secretary or a designee thereof.</text> </paragraph><paragraph id="HDDBACFAD013E4671A243F63E3FB6D1BB"><enum>(3)</enum><header>Membership</header><text>The Panel shall be composed of representatives of—</text>
 <subparagraph id="HAC9454F0B8A240C1B1E59D2C4301E52F"><enum>(A)</enum><text>State governments;</text> </subparagraph><subparagraph id="H264B7F30381742E9AEA36AFD5992716C"><enum>(B)</enum><text>local governments;</text>
 </subparagraph><subparagraph id="H8CDCCF3D7AB047E88344F03C215EA88B"><enum>(C)</enum><text>tribal governments;</text> </subparagraph><subparagraph id="HD530FF16247040F4841D3C16753E2D8A"><enum>(D)</enum><text>communications equipment vendors (including broadband data service providers);</text>
 </subparagraph><subparagraph id="HDBD5DA20BB074AE9BB19774D9C0EDAC5"><enum>(E)</enum><text>public utility services;</text> </subparagraph><subparagraph id="HC9A4162A3E194E44B6B6045AA76C8111"><enum>(F)</enum><text>local exchange carriers;</text>
 </subparagraph><subparagraph id="H3510832AE4894E47B2C4662A734ED1C4"><enum>(G)</enum><text>wireless carriers;</text> </subparagraph><subparagraph id="H060857371BA04276B6A2648223E80BF1"><enum>(H)</enum><text>satellite communications services; and</text>
 </subparagraph><subparagraph id="H3C68348B986B4DBCA5540ED48A0774A6"><enum>(I)</enum><text>other entities, as determined by the Under Secretary.</text> </subparagraph></paragraph><paragraph id="HB9E9083907414420B81594101B06C525"><enum>(4)</enum><header>Meetings</header><text>The Panel shall meet not less than 4 times each year.</text>
 </paragraph><paragraph id="H1E45F2B789E047ABA30697AB568AC620"><enum>(5)</enum><header>Duties</header><text>The Panel shall—</text> <subparagraph id="HDD0ACF919A21422FAE3A052EA88AEFCF"><enum>(A)</enum><text>assist the Under Secretary in the annual report update under subsection (c)(2);</text>
 </subparagraph><subparagraph id="H8AD6E5CF07AA475BBBC474A7F5570389"><enum>(B)</enum><text>evaluate the effectiveness of all Federal broadband assistance programs and policies with respect to providing broadband access in rural and underserved areas;</text>
 </subparagraph><subparagraph id="H12FB3E40D56043B0BD864914DE0D55DF"><enum>(C)</enum><text>evaluate best practices employed at the State and local government level to foster broadband access in rural and underserved areas.</text>
 </subparagraph></paragraph></subsection><subsection id="HCC704BE8934B453DADCEB0F86D70B9B4"><enum>(e)</enum><header>Web-Based clearinghouse</header><text>The Under Secretary shall establish and maintain a comprehensive and interactive rural broadband Web-based clearinghouse of resources for rural and underserved areas broadband, including—</text>
 <paragraph id="H42000F09C7824D208BBFF125AF67C6FD"><enum>(1)</enum><text display-inline="yes-display-inline">successful public-private partnerships;</text> </paragraph><paragraph id="H2749838E04114D8EAB61A616662B9E19"><enum>(2)</enum><text>funding sources;</text>
 </paragraph><paragraph id="HBCDF9BFA51E04991A1825C8AAA0A3B3A"><enum>(3)</enum><text>technology tutorials;</text> </paragraph><paragraph id="H5CE97A2138704362A53AC3B55C29649E"><enum>(4)</enum><text>descriptions of best practices;</text>
 </paragraph><paragraph id="HBB55E6950AB347AFADB4144792A2DBC1"><enum>(5)</enum><text>assessments of various technology solutions;</text> </paragraph><paragraph id="H8A280023F6A843EC9F744F0453528723"><enum>(6)</enum><text>case studies and feasibility studies;</text>
 </paragraph><paragraph commented="no" id="HC7FF685935784424BA7BD646E0B35A49"><enum>(7)</enum><text>descriptions of the applications of broadband in rural and underserved areas, including telework, telemedicine, distance learning, training, homeland security, senior citizen connectivity and program development, and business and economic development;</text>
 </paragraph><paragraph id="H178B5358C42742628A69FA1E717005D2"><enum>(8)</enum><text>analyses of broadband policies in rural and underserved areas; and</text> </paragraph><paragraph id="HD5CC09D1ABCE475BB7676A8C7DF3D2EF"><enum>(9)</enum><text>supports for networks among rural and underserved communities and economic development agencies.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H748FF67C99AA455CBA73DA94B3CADAE2"><enum>(b)</enum><header>Conforming amendments</header><text>Section 603 of the Rural Electrification Act of 1936, as redesignated by subsection (a)(1), is amended by striking <quote>Administrator</quote> and inserting <quote>Under Secretary</quote>.</text>
 </subsection><subsection display-inline="no-display-inline" id="HE5A1FBDD886C45B89F0115C1B0590143"><enum>(c)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the appointment of the first Under Secretary under section 602(a) of title VI of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref> et seq.), as amended by this Act, the Secretary of Agriculture shall issue regulations with respect to the qualification criteria for the loan and loan guarantee programs under such title that—</text>
 <paragraph id="HEA7601A1A1084A56A60F27689C4AA7D4"><enum>(1)</enum><text>emphasize streamlining the application process and processing time;</text> </paragraph><paragraph id="HBA5741CD02E64B64A24215579041285B"><enum>(2)</enum><text>ensure that the financial requirements for applicants do not unduly disqualify applicants that have demonstrated a viable business plan; and</text>
 </paragraph><paragraph id="HFF20C36F1EC7446C80DFD081406A8F11"><enum>(3)</enum><text>do not diminish the mission of the program to deliver broadband service to rural and underserved areas.</text>
				</paragraph></subsection><subsection id="H979FA7A8729744C8A5826310BC23E2E9"><enum>(d)</enum><header>Implementation report</header>
 <paragraph id="H115BC97F79F44B89B102FCA41F65596E"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary of Agriculture shall submit to Congress a report describing the resources and staff necessary to carry out this section and the amendments made by this section.</text>
				</paragraph><paragraph id="H38A70123E5DE4097A6630A5C75F919BE"><enum>(2)</enum><header>Comptroller General Review</header>
 <subparagraph id="H44F9DE733A6A4E0794A3769A1BFE39F2"><enum>(A)</enum><header>In general</header><text>The Comptroller General of the United States shall review the report submitted under paragraph (1) for validity.</text>
 </subparagraph><subparagraph id="H8D55FF48939E46AD9DB7EA7ED3044A40"><enum>(B)</enum><header>Report</header><text>Not later than 30 days after the date on which the report is submitted under paragraph (1), the Comptroller General of the United States shall submit to Congress a report containing the findings of the review under subparagraph (A).</text>
 </subparagraph></paragraph></subsection></section><section id="H651964535FC44627B1AE9EFDECDDAC3A"><enum>3.</enum><header>Breaking Ground on Rural Broadband Program</header><text display-inline="no-display-inline">Title VI of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref> et seq.), as amended by section 2, is further amended by adding at the end the following new section:</text>
			<quoted-block id="H7F04E2C4C8DD41E1B82668F594636DF8">
				<section id="H79E10DE271B244129F907D1C7A64FD71"><enum>606.</enum><header>Breaking Ground on Rural Broadband Program</header>
					<subsection id="H1E6B6C66518C49DBA18E8B729038BB8F"><enum>(a)</enum><header>Grants, loans, and loan guarantees</header>
 <paragraph id="H9DFB199AEED04B3CB31F1C8A657B5909"><enum>(1)</enum><header>In general</header><text>The Under Secretary, in consultation with the Federal Communications Commission and other relevant Federal agencies, shall establish the breaking ground on rural broadband program to make grants, loans, or loan guarantees to eligible entities for broadband programs to, with respect to rural and underserved areas—</text>
 <subparagraph display-inline="no-display-inline" id="HD23472DA4453442689DE8F1C2FA6E256"><enum>(A)</enum><text>acquire equipment, instrumentation, networking capability, hardware and software, digital network technology, and infrastructure for broadband services;</text>
 </subparagraph><subparagraph id="H6F8316345DDF49A2879B5894C42ECC01"><enum>(B)</enum><text>construct and deploy broadband service related infrastructure;</text> </subparagraph><subparagraph id="HAFE3B2D09F4748FF9655865BC7D6F58A"><enum>(C)</enum><text>ensure access to broadband service by community anchor institutions;</text>
 </subparagraph><subparagraph id="H13D3EA5703744DBD93CA67CC928D9140"><enum>(D)</enum><text>facilitate access to broadband service to low-income, unemployed, aged, and otherwise vulnerable populations;</text>
 </subparagraph><subparagraph id="HC2EF990731BA4656BF6F51F87523DEF9"><enum>(E)</enum><text>construct and deploy broadband facilities that improve public safety;</text> </subparagraph><subparagraph id="H20BB1FD844904881B16FCBB6DF8D8A78"><enum>(F)</enum><text>provide broadband communications services; and</text>
 </subparagraph><subparagraph id="H89F3B5C656C94C9787FCAC90FE84FCDE"><enum>(G)</enum><text>such other activities the Under Secretary determines appropriate.</text> </subparagraph></paragraph><paragraph id="HADFF21EA94DC45F8A3E2DAFFC0022EC5"><enum>(2)</enum><header>Award locations</header><text display-inline="yes-display-inline">To the extent practical, the Under Secretary shall award not less than one grant, loan, or loan guarantee under this section to an eligible entity located in each State.</text>
 </paragraph><paragraph id="HDD42EFFAD1ED46BE89F121FEF0D4E43D"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Under Secretary shall consult a State with respect to—</text> <subparagraph id="HD696261BCC874887BD98B78752BAF848"><enum>(A)</enum><text>identifying areas in need of broadband programs located in the State; and</text>
 </subparagraph><subparagraph id="HE28B82D3CE9B472C8B712E693AED0626"><enum>(B)</enum><text display-inline="yes-display-inline">the allocation of grant funds and loans and loan guarantees for broadband programs within the State.</text>
 </subparagraph></paragraph></subsection><subsection id="HB0D10DB5F8114A029E97286CF1BCECD7"><enum>(b)</enum><header>Expiration of program</header><text display-inline="yes-display-inline">The Under Secretary may not award grants, loans, or loan guarantees under this section on a date that is after September 30, 2022.</text>
 </subsection><subsection id="HBDDF62C2ABF447F7B469875E406F78E5"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To receive a grant, loan, or loan guarantee under this section, an eligible entity shall submit an application to the Under Secretary at such time, in such manner, and containing such information as the Under Secretary may require, including a description of how—</text>
 <paragraph id="H1A8DF137A34A4675894F52E7B6012BBE"><enum>(1)</enum><text>the eligible entity will use funds awarded under this section;</text> </paragraph><paragraph id="HDA83FE53AB0F40DFB2B2D1C1A08D916D"><enum>(2)</enum><text>such funds are necessary to implement the broadband program;</text>
 </paragraph><paragraph id="HB2CC0AF8CBC14A50B0C810FB5B7936B4"><enum>(3)</enum><text>the broadband program will comply with all applicable Federal, State, and local laws;</text> </paragraph><paragraph id="HFB0083E3B2A0440AA527D82DCD90E12F"><enum>(4)</enum><text>the eligible entity will meet the non-Federal funds requirements under subsection (e), including the source and amount of such other funding; and</text>
 </paragraph><paragraph id="H422F2D65628A4EBA8EC130CA45361CE6"><enum>(5)</enum><text>the eligible entity will accomplish the broadband program goals not later than to 5 years after receiving an award under this section.</text>
 </paragraph></subsection><subsection id="HB10A5B00400C492B87454B27A2D019C0"><enum>(d)</enum><header>Priority</header><text>In awarding grants, loans, or loan guarantees under this section, the Under Secretary may give priority to—</text>
 <paragraph id="H6A8E4E1265C54237834ACF8B45B99E66"><enum>(1)</enum><text>a broadband program that—</text> <subparagraph id="H250C33CE99D54645A5EB2B47096F6CE3"><enum>(A)</enum><text>will serve the largest population by—</text>
 <clause id="H4A6AD8A326ED425D9118C24A08B18A95"><enum>(i)</enum><text>increasing the affordability and number of subscribers;</text> </clause><clause id="H7F68C04BDD0C4DADA561266C60D11E11"><enum>(ii)</enum><text>increasing broadband speed; or</text>
 </clause><clause id="H7130CB25FB614988B9FF5E297AF84D8C"><enum>(iii)</enum><text>enhancing healthcare delivery, education, or services for children; and</text> </clause></subparagraph><subparagraph commented="no" id="HFB437A7E0CA544628C2DFD2CD9D9D8A1"><enum>(B)</enum><text>will serve a rural area (as such term is defined in section 203(b)); and</text>
 </subparagraph></paragraph><paragraph id="HCCC5A8BCFBF1409486CC9FA8CD25AE28"><enum>(2)</enum><text display-inline="yes-display-inline">an eligible entity that is a socially and economically disadvantaged small business concern as defined under section 8(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)</external-xref>).</text>
						</paragraph></subsection><subsection id="H00D2F838ABEF4AD6B37CF3D544194576"><enum>(e)</enum><header>Non-Federal funds requirements</header>
 <paragraph id="HAED8E5B674A04512955F34853A2EED5B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the recipient of a grant under this section shall provide funds, in-kind contributions, or a combination of both, from sources other than funds provided through such grant in an amount that is at least equal to 20 percent of the amount of such grant.</text>
 </paragraph><paragraph id="HF0CF320C29D74FE1BBC934B3058236D7"><enum>(2)</enum><header>Exception</header><text>The Under Secretary may provide a waiver to the requirements of paragraph (1) to an eligible entity that—</text>
 <subparagraph id="H07AB2475855F40CFB3C09FB320577D0E"><enum>(A)</enum><text display-inline="yes-display-inline">submits an application for such waiver, at such time, in such manner, and containing such information as the Under Secretary may require; and</text>
 </subparagraph><subparagraph id="H2F92E628C0644CC4BFC1FFB77F6ADA73"><enum>(B)</enum><text>demonstrates financial need.</text> </subparagraph></paragraph></subsection><subsection id="H95A1EAD9DB8F4DA79DB14AABD2D3D4DD"><enum>(f)</enum><header>Deobligate funds</header><text display-inline="yes-display-inline">In addition to other authority under applicable law, the Under Secretary may deobligate awards under this section if an eligible entity demonstrates—</text>
 <paragraph id="H62599130D8D6468DB5762108F63BCBEC"><enum>(1)</enum><text>an insufficient level of performance; or</text> </paragraph><paragraph id="HBF45FB4C4B6F4A6EB6667FD632FECAD7"><enum>(2)</enum><text>wasteful or fraudulent spending (as defined by the Under Secretary).</text>
 </paragraph></subsection><subsection id="HCE58342EE6EE40858B5158C8B90D3F98"><enum>(g)</enum><header>Reports by award recipients</header><text>At such time as may be determined by the Under Secretary, an eligible entity that receives a grant, loan, or loan guarantee under this section shall submit to the Under Secretary a report that includes a description of the use of funds made available pursuant to this section.</text>
 </subsection><subsection id="HA1552F8F976B480F92F6262C14F75112"><enum>(h)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which funds are first made available to carry out this section under subsection (k), and once each 180 days thereafter until the expiration of the program under subsection (b), the Under Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate, the Committees on Agriculture and Energy and Commerce of the House of Representatives, and the Committees on Agriculture, Nutrition, and Forestry and Commerce, Science, and Transportation of the Senate, a report that includes—</text>
 <paragraph id="H228946EC232B4F9CB19BFBC8A09721B5"><enum>(1)</enum><text>the number of grants, loans, and loan guarantees applied for and provided under this section;</text> </paragraph><paragraph id="H29225F95CEEC4567B3CC2FAE76079057"><enum>(2)</enum><text display-inline="yes-display-inline">the communities proposed to be served in each grant, loan, or loan guarantee application submitted in 180 days before the date such report is submitted;</text>
 </paragraph><paragraph id="HD8841E427DA4466192D690AAD99C69D0"><enum>(3)</enum><text>the period of time required to approve each grant, loan, or loan guarantee application under this section;</text>
 </paragraph><paragraph id="H9AE92D7656D040F1927AD4F51BB0C039"><enum>(4)</enum><text>any outreach activities carried out by the Under Secretary to encourage entities in rural and underserved areas to submit applications under this section; and</text>
 </paragraph><paragraph id="H3591488F05544BAB84C64EA7DA15F966"><enum>(5)</enum><text>each broadband service, including the type and speed of broadband service, for which assistance was sought, and each broadband service for which assistance was provided, under this section.</text>
 </paragraph></subsection><subsection id="H02DEB0ECAF674AECA5771C12A6AE6963"><enum>(i)</enum><header>Database</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which funds are first made available to carry out this section under subsection (k), the Under Secretary shall establish and maintain a fully searchable database, accessible on the Internet at no cost to the public, that includes—</text>
 <paragraph id="H6744B3AFA06141F4BE9537EAD8394236"><enum>(1)</enum><text>a list of—</text> <subparagraph id="H983739D584EE4ECFAB7AA33134354E18"><enum>(A)</enum><text>each entity that has applied for an award under this section; and</text>
 </subparagraph><subparagraph id="HC6F63D98412B444EBA86EB9895B10775"><enum>(B)</enum><text>each eligible entity that has received an award under this section;</text> </subparagraph></paragraph><paragraph id="H3C35D3E7946441849DB7C39DE06290DE"><enum>(2)</enum><text>a description of each application under this section, and the status of each application;</text>
 </paragraph><paragraph id="H81D099F00203421D9EFC1121831B0E23"><enum>(3)</enum><text>the purpose for which each eligible entity is receiving funds under this section; and</text> </paragraph><paragraph id="HF297AD304E9F472794B1049CD443FF7D"><enum>(4)</enum><text>each report submitted under subsection (h).</text>
 </paragraph></subsection><subsection id="HAFD54CBA268647D392F505EDD38540C3"><enum>(j)</enum><header>Eligible entity defined</header><text>In this section, the term <quote>eligible entity</quote> means—</text> <paragraph id="H431DE995658A45C9850DFB8F284EADBD"><enum>(1)</enum><text>a State or political subdivision thereof, the District of Columbia, a territory or possession of the United States, an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or native Hawaiian organization;</text>
 </paragraph><paragraph id="H9BBB52DDF9754E6986AA2B856D196EAD"><enum>(2)</enum><text>a nonprofit organization; or</text> </paragraph><paragraph id="H6F4050067080434A8FEAF24E763F8A92"><enum>(3)</enum><text>any other entity the Under Secretary determines to be in the public interest.</text>
 </paragraph></subsection><subsection id="H041C0E624B94478CA765AC7A1AA5FA4A"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Agriculture to carry out this section $20,000,000,000 to remain available until September 30, 2022.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H1582A24CFF5E46ECA1E8270516D785C1"><enum>4.</enum><header>Tribal broadband assistance program</header><text display-inline="no-display-inline">Title VI of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref> et seq.), is amended by inserting after section 606, as added by section 3, the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="HF8F216B2D9744EE499507C393CABA69F" style="OLC">
				<section id="H53561E216D9A4E32A48FEDB7A10C5C5B"><enum>607.</enum><header>Tribal broadband assistance program</header>
 <subsection id="HEEA904BE65B243BF92E2F88E0ABA84F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary shall make grants, loans, or loan guarantees to entities to—</text> <paragraph id="H0F8526AD10264E1F839A4CBA05EBD803"><enum>(1)</enum><text>plan, construct, acquire, or improve facilities or equipment for the purpose of providing broadband service on tribal lands;</text>
 </paragraph><paragraph id="HA12CB0A2053B4BF4A027F6F8966008DE"><enum>(2)</enum><text>provide broadband service on tribal lands;</text> </paragraph><paragraph id="H9E5462F3D72043198BE8C954B4FEBA3D"><enum>(3)</enum><text>develop among tribal members technical expertise related to broadband service; and</text>
 </paragraph><paragraph id="HEC5C58D546434BFE93BDCAAEA81AD0AC"><enum>(4)</enum><text>improve the adoption of broadband service by individuals on tribal lands.</text> </paragraph></subsection><subsection id="H9F00C7D94F6C4708B25BE88EA533C6DB"><enum>(b)</enum><header>Application</header><text>An entity desiring financial assistance under this section shall submit an application to the Under Secretary at such time, in such manner, and containing such information as the Under Secretary may require, including—</text>
 <paragraph id="H24A5147398B84188A92FEF84F5D9EE05"><enum>(1)</enum><text>a description of the ability of the entity to furnish the minimum acceptable level of broadband service for tribal lands; and</text>
 </paragraph><paragraph id="H1F49A6D525C94197AD09FA91A70976B8"><enum>(2)</enum><text>an assurance that the entity will submit a report, at such time, in such manner, and containing such information as the Under Secretary may specify, that describes—</text>
 <subparagraph id="HF359D76B98F141D088D24F08D563D938"><enum>(A)</enum><text>the use by the entity of funds under this section; and</text> </subparagraph><subparagraph id="H0D091AC9D4BB47DB959553F5D38A0FF2"><enum>(B)</enum><text>the provision by the entity of broadband service on tribal lands using such assistance, including—</text>
 <clause id="HE7E81A7C52FD4713BA2A9E6F3B7221CB"><enum>(i)</enum><text>the number and location of residences and businesses that receive improved broadband service as a result of such assistance; and</text>
 </clause><clause id="HC1BEDCC3C6CB455FA1499675639A248C"><enum>(ii)</enum><text>the average price and speed of broadband service for such residences and businesses before and after the use by the entity of such assistance.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H3B1BBC8C6B464648A1AEB71689AC7DB9"><enum>(c)</enum><header>Priority</header><text>In providing financial assistance under this section, the Secretary shall give priority to applications from entities proposing to—</text>
 <paragraph id="H4E25DDC3B959495DA98A7798C8735EAB"><enum>(1)</enum><text>provide broadband service in underserved tribal areas;</text> </paragraph><paragraph id="HAD7BE61E2A7B429DB96B23CC0F927669"><enum>(2)</enum><text>provide broadband service to the greatest number of households in underserved tribal areas; and</text>
 </paragraph><paragraph id="H1FCAB06ED8E84394AF61723074B46AD6"><enum>(3)</enum><text>improve the ability of tribal governments or their designees to provide telecommunications service on tribal lands.</text>
 </paragraph></subsection><subsection id="H64D49D7C23CA46DE9D246126C084EC41"><enum>(d)</enum><header>Limitation</header><text>The Under Secretary may not provide financial assistance under this section for a fiscal year to an entity that provides telecommunications service to 20 percent or more of the households in the United States if the cost to the Federal Government of such financial assistance exceeds 15 percent of the assistance made available under this section for the fiscal year.</text>
 </subsection><subsection id="H3F7167D65351447391068E228EDDD871"><enum>(e)</enum><header>Report</header><text>Not later than 3 years after the date on which funds are first made available to carry out this section under subsection (f), the Under Secretary shall submit to Congress and to the Rural Broadband Advisory Panel a report that describes the extent of participation under this section for the preceding fiscal year, including a description of—</text>
 <paragraph id="H84AF8F02CDE14B69A5768DE8B90EF3C2"><enum>(1)</enum><text>the communities served by activities supported by funds under this section;</text> </paragraph><paragraph id="H085FD7273E994CEBACE3253328162335"><enum>(2)</enum><text>the number of grants, loans, and loan guarantees applied for and provided under this section;</text>
 </paragraph><paragraph id="HE00EFCFC1204440CA3B2051A06ACE4A8"><enum>(3)</enum><text>the period of time required to approve each application under this section; and</text> </paragraph><paragraph id="H4B9FFFE7C8FE4C2796D7F9FEC36A17F7"><enum>(4)</enum><text>the overall progress towards fulfilling the goal of providing broadband service on tribal lands, including a description of—</text>
 <subparagraph id="H31714704148742E2B9F854449640F26F"><enum>(A)</enum><text>the number and location of residences and businesses that receive improved broadband service as a result of financial assistance under this section;</text>
 </subparagraph><subparagraph id="H16FA5AD1EB9745B9B7CA19E26BB6A6DF"><enum>(B)</enum><text>the average price and speed of broadband service for such residences and businesses;</text> </subparagraph><subparagraph id="HA27BAD06DA27468BBB635F24F54C1392"><enum>(C)</enum><text>any network improvements supported under this section; and</text>
 </subparagraph><subparagraph id="H224873A46C2F4811ABF36A90F233D72B"><enum>(D)</enum><text>activities supported under this section that improve broadband service on tribal lands for educational institutions, health care providers, and public safety service providers.</text>
 </subparagraph></paragraph></subsection><subsection id="H1D1C324BE8DE435AB641CCA3DA01D534"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Agriculture to carry out this section $25,000,000 for each of fiscal years 2017 through 2022, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA50C4809BA1D4F39A8784F4D68ED938C"><enum>5.</enum><header>Telecommunications loan and loan guarantee program</header>
 <subsection id="HB6BA2ED2BBCF4818BB4F8964D4BCADB3"><enum>(a)</enum><header>In general</header><text>Title II of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/922">7 U.S.C. 922</external-xref> et seq.) is amended by adding at the end the following new section:</text>
				<quoted-block id="H5BCC3D4CAA4B4B9CB24D812D8C5B1373" style="OLC">
					<section id="HB2F1CA980ACB485C93368A242EB7D0DC"><enum>208.</enum><header>Regional telecommunications development</header>
 <subsection id="H5E4C1CD8A9D84525A3DDF141671ADE9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any preference given under section 201 with respect to a telephone loan made under this Act, the Secretary may give preference to an application for such a loan for a project that, as determined by the Secretary, supports the development of telecommunications services on a multijurisdictional basis.</text>
 </subsection><subsection id="HA132E73B831E42E4803F9D832AE59C1C"><enum>(b)</enum><header>Evaluation of applications</header><text display-inline="yes-display-inline">In evaluating an application described in subsection (a), the Secretary shall consider whether—</text> <paragraph id="H8243330839414D8483B81B041EFD53C0"><enum>(1)</enum><text>the project that is the subject of the application was developed through the collaboration and participation of multiple stakeholders in the service area of the project, including State, local, and tribal governments, nonprofit institutions, institutions of higher education, and private entities;</text>
 </paragraph><paragraph id="H971D9FA50D1C41DE9723FAC30652A264"><enum>(2)</enum><text>the applicant has an understanding of the applicable regional resources that could support the project, including natural resources, human resources, infrastructure, and financial resources; and</text>
 </paragraph><paragraph id="H507BC7225E57494599BAA6B487CE58B0"><enum>(3)</enum><text>the project has clear objectives and includes a means to establish measurable performance measures and to track progress toward meeting such objectives.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H36DE56DA39994CFBA2580B2271C2EE8E"><enum>(b)</enum><header>Exemption from State agency requirement</header><text>Section 201 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/922">7 U.S.C. 922</external-xref>) is amended in the last sentence by inserting <quote>or the application involved is an application described in section 208</quote> before the period at the end.</text>
 </subsection><subsection id="H142FB5BFD64E44B983064B86087A2C9C"><enum>(c)</enum><header>Definition of rural area</header><text>Section 203(b) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/924">7 U.S.C. 924(b)</external-xref>) is amended by striking <quote>5,000</quote> and inserting <quote>20,000</quote>.</text> </subsection></section><section id="H8F342CE8C203413EBBB7B356951D68B8"><enum>6.</enum><header>Modifications to existing rural broadband programs</header> <subsection id="HFC7B7E0188254D2CA03CDE114B41E9BD"><enum>(a)</enum><header>Award of grants</header><text>Section 603 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref>), as redesignated by section 2, is further amended—</text>
 <paragraph id="H8E50676F0EEB416A960E499CE0735968"><enum>(1)</enum><text>in subsection (a), by striking <quote>loans and loan guarantees</quote> and inserting <quote>loans, loan guarantees, and grants</quote>;</text> </paragraph><paragraph id="HC7BEA80DE042404DBA62993D87A64AE2"><enum>(2)</enum><text>in subsection (c)—</text>

 </paragraph><paragraph id="HE7E62E4106234D7AA08DA5A3502C8F96"><enum>(7)</enum><text>by inserting after subsection (j) the following new subsection:</text> <quoted-block id="H607E7149B3F24460BCFE8A3DA25F1D51" style="OLC"> <subsection id="H752D8D8D40AF4BCBB48CC600EA5FE70F"><enum>(k)</enum><header>Matching funds requirement</header><text>The recipient of a grant under this section shall provide funds, in-kind contributions, or a combination of both, from sources other than funds provided through such grant in an amount that is at least equal to 10 percent of the amount of such grant.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HD5D5A1D146B44BDF9749AFD5D2D64971"><enum>(8)</enum><text>in subsection (l) (as so redesignated)—</text> <subparagraph id="H01C0AC61E595493AAA055C1673E8BAB5"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$25,000,000 for each of fiscal years 2008 through 2018</quote> and inserting <quote>$50,000,000 for each of fiscal years 2017 through 2020</quote>; and</text>

 </subparagraph></paragraph></subsection><subsection id="H56DA0B2498F74E8A9BE0A29DCCA8B620"><enum>(b)</enum><header>Priority for support for development of broadband service</header><text>Section 601(c)(2) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(c)(2)</external-xref>), as amended by subsection (a), is further amended—</text>
 <paragraph id="H68BEC8EFD20744D9A9F4A1A56877FB8F"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="H2A366726DDE94AC7B91FDBA33EFE435B"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="HBAA13FA12EC746FF992B4294C8908E30"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block id="H60D1B5C24EFA49C6A4D21113F07AF54B" style="OLC"> <subparagraph id="HF4AB5DE48248406D9C6213973223A0A2"><enum>(E)</enum><text>give priority to applicants that offer in the applications of the applicants to provide support for multijurisdictional projects for the development of broadband service in rural and underserved areas that are developed through the collaboration and participation of multiple stakeholders in the service area of such a project, including State, local, and tribal governments, nonprofit institutions, institutions of higher education, and private entities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H65C2A02535B94C8BB3AEFF5F2ABF1657"><enum>7.</enum><header>Inventory of Federal and State assets</header>
 <subsection id="H594C7840F04D47AA9EB2EB705683FF03"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Under Secretary for Rural Broadband Initiatives shall—</text>
 <paragraph id="H2F92568D355E4D71850FA6CBF69D4012"><enum>(1)</enum><text display-inline="yes-display-inline">establish and maintain an inventory of any real property that is owned, leased, or otherwise managed by the Federal Government on which a broadband facility could be constructed, as determined by the Under Secretary for Rural Broadband Initiatives; and</text>
 </paragraph><paragraph id="H20030366C1454FAA9F3AC3A968659C14"><enum>(2)</enum><text>make such inventory available to the public.</text> </paragraph></subsection><subsection id="H92915FABE5124B35B47ABCB19C843D91"><enum>(b)</enum><header>Executive agency reports</header> <paragraph id="H2EA3557AB43B47B7A479715AE6E494BE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, each executive agency shall submit to the Under Secretary for Rural Broadband Initiatives a report that includes information regarding any real property that is owned, leased, or otherwise managed by such agency on which a broadband facility could be constructed.</text>
 </paragraph><paragraph id="H976E183EE6F0425A98D499CA7C64948C"><enum>(2)</enum><header>Changes in real property</header><text display-inline="yes-display-inline">Not later than 30 days after receiving notice of changes in the information included in a report under paragraph (1), the head of an applicable executive agency shall notify the Under Secretary for Rural Broadband Initiatives of such changes.</text>
 </paragraph><paragraph id="H52DF1863FBD94C67B30CF1D22B3F208A"><enum>(3)</enum><header>National security exemption</header><text>An agency may exclude from the report described in paragraph (1) any information the head of the executive agency determines would harm national security.</text>
				</paragraph></subsection><subsection id="H5F25C8B08D224607B6095A8ADD8382EB"><enum>(c)</enum><header>State and local assets</header>
 <paragraph id="HCA266E0496D34CB496BDA60C642A33A3"><enum>(1)</enum><header>In general</header><text>A State, local, or tribal government may provide to the Under Secretary for Rural Broadband Initiatives information regarding any real property that is owned, leased, or otherwise managed by the State, local, or tribal government on which a broadband facility could be constructed.</text>
 </paragraph><paragraph id="H53F443A415224D5894269FF098632665"><enum>(2)</enum><header>Consultation</header><text>The Under Secretary for Rural Broadband Initiatives shall, in consultation with State, local, or tribal governments, issue such guidance or regulations as may be necessary to ensure that information provided by a State, local, or tribal government under paragraph (1) is accurate.</text>
				</paragraph></subsection></section><section id="H2BEAB3275075497EBC645C1C2D94E193"><enum>8.</enum><header>Retention of rental fees associated with communications use authorizations on Federal lands</header>
 <subsection id="H01686A1DB18540C0A192EBCBBF1468A3"><enum>(a)</enum><header>Special account required</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall establish a special account in the Treasury for each Federal land management agency for the deposit of rental fees received by a Federal land management agency for communications use authorizations on Federal lands granted, issued, or executed by the Federal land management agency.</text>
 </subsection><subsection id="HDF163585EE0A40AFAC681C8214398829"><enum>(b)</enum><header>Deposit and Retention of rental fees</header><text display-inline="yes-display-inline">Rental fees received by a Federal land management agency shall—</text> <paragraph id="HA937D9848FB84A2CBC476E8D2C21276F"><enum>(1)</enum><text display-inline="yes-display-inline">be deposited in the special account established for that Federal land management agency; and</text>
 </paragraph><paragraph id="H8D5CE87A195B4659B7572BA7826E54F6"><enum>(2)</enum><text>remain available for expenditure under subsection (c), to the extent and in such amounts as are provided in advance in appropriation Acts.</text>
 </paragraph></subsection><subsection id="HE2E83A1FF6624FAB9E538FA9140C5239"><enum>(c)</enum><header>Expenditure of retained fees</header><text display-inline="yes-display-inline">Amounts deposited in the special account for a Federal land management agency shall be used for Federal land management agency activities related to communications sites, including the following:</text>
 <paragraph id="H6522719957714595B24C651388D66E7E"><enum>(1)</enum><text>Administering communications use authorizations, including cooperative agreements under subsection (d).</text>
 </paragraph><paragraph id="H6C91EE8F459F475D925877AAA3332C1E"><enum>(2)</enum><text>Preparing needs assessments or other programmatic analyses necessary to designate communications sites and authorize communications uses on or adjacent to Federal lands.</text>
 </paragraph><paragraph id="H8AB3CB2D55F246ECBB9A5D5CD48E2126"><enum>(3)</enum><text display-inline="yes-display-inline">Developing management plans for communications sites on or adjacent to Federal lands.</text> </paragraph><paragraph id="HA7E82E9C688A4EBBB673C2769B92D37C"><enum>(4)</enum><text display-inline="yes-display-inline">Training for management of communications sites on or adjacent to Federal lands.</text>
 </paragraph><paragraph id="H0F1E1F40F5C14B3CA8476F94C4F39D67"><enum>(5)</enum><text display-inline="yes-display-inline">Obtaining or improving access to communications sites on or adjacent to Federal lands.</text> </paragraph></subsection><subsection id="H79204BDAB7024AB1B00280AF4406CAEA"><enum>(d)</enum><header>Cooperative agreement authority</header> <paragraph id="HD95ACBE1AEB944918CF570E1939A3459"><enum>(1)</enum><header>Department of the interior</header><text>The Secretary of the Interior may enter into cooperative agreements to carry out the activities described in subsection (c).</text>
 </paragraph><paragraph id="H6DF2F1BF2C914331BFEAF9686D0F9C95"><enum>(2)</enum><header>Forest service</header><text display-inline="yes-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service, may enter into cooperative agreements to carry out the activities described in subsection (c).</text>
 </paragraph></subsection><subsection id="H63F807E02AFF4A45B5C63A08A558A639"><enum>(e)</enum><header>No effect on other fee retention authorities</header><text display-inline="yes-display-inline">This section shall not limit or otherwise affect fee retention by a Federal land management agency under any other authority.</text>
 </subsection><subsection id="H0812A8B153A341A4AFC7ED872F7E13C4"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H784E78E7A8FB448AB75760E0DD37B217"><enum>(1)</enum><header>Communications site</header><text>The term <quote>communications site</quote> means an area of Federal lands designated for telecommunications uses.</text>
 </paragraph><paragraph id="H307841B185274C9987724F40F40AB715"><enum>(2)</enum><header>Communications use</header><text display-inline="yes-display-inline">The term <quote>communications use</quote> means the placement and operation of infrastructure for wireless telecommunications, regardless of whether the use of radio frequencies by such telecommunications is pursuant to a license issued by the Federal Communications Commission or on an unlicensed basis in accordance with the regulations of the Commission. The term includes ancillary activities directly related to such placement and operation.</text>
 </paragraph><paragraph id="H4DED6CC4B07E4C65A33E647C413E1C83"><enum>(3)</enum><header>Communications use authorization</header><text>The term <quote>communications use authorization</quote> means a right-of-way, permit, or lease granted, issued, or executed by a Federal land management agency for the primary purpose of authorizing the occupancy and use of Federal lands for communications use.</text>
 </paragraph><paragraph id="H4C65D97D6D484687B789CD18774CC09E"><enum>(4)</enum><header>Federal land management agency</header><text>The term <quote>Federal land management agency</quote> means the National Park Service, the United States Fish and Wildlife Service, the Bureau of Land Management, the Bureau of Reclamation, and the Forest Service.</text>
 </paragraph><paragraph id="H6DD56C013E784FC5B6EB644A6D975A2A"><enum>(5)</enum><header>Federal lands</header><text>The term <quote>Federal lands</quote> means lands under the jurisdiction and management of a Federal land management agency.</text> </paragraph><paragraph id="H4985FFDCE6B149AF86B3CEADD0167D37"><enum>(6)</enum><header>Rental fee</header><text display-inline="yes-display-inline">The term <quote>rental fee</quote> means the fee collected by a Federal land management agency for the occupancy and use authorized by a communications use authorization pursuant to and consistent with authorizing law.</text>
				</paragraph></subsection></section></legis-body></bill>
