 <section id="H92B365D772EB4D3E9FDA9B5551EB6A38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taxpayers Right-To-Know Act</short-title></quote>.</text> </section><section id="H14E59642C1D94225836B8BC47BD602C6"><enum>2.</enum><header>Inventory of Government programs</header> <subsection id="H6545CF74C0D84CFF82EF810240024CB0"><enum>(a)</enum><header>In general</header><text>Section 1122(a) of title 31, United States Code, is amended—</text>
 <paragraph id="HF2A21F97125F48729FD2D9890787DBA2"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively;</text> </paragraph><paragraph id="H74273EFEBD7C4C26AD2D84633A6E83B6"><enum>(2)</enum><text>by inserting before paragraph (2), as so redesignated, the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDB1459B0DBF347A882BA2AF241ECCDC1" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="H2D2ECB17298C486ABF0B8DE925B81110"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of program</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>program</term> means an organized set of activities by one or more agencies directed toward a common purpose or goal.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H4E86FF10C8594EFDA514BA2FA451B295"><enum>(3)</enum><text>in paragraph (2), as so redesignated—</text> <subparagraph id="H9D328B8AB7CE4C6C8B16CE8A338CEA6D"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="USC">In general</header-in-text>.—Not later than October 1, 2012, the Office of Management and Budget shall</quote> and inserting <quote><header-in-text level="paragraph" style="USC">Website and program inventory</header-in-text>.—The Director of the Office of Management and Budget shall</quote>;</text>
 </subparagraph><subparagraph id="HE81A5ACFE4A748E5A41890FA035074A8"><enum>(B)</enum><text>by striking subparagraph (C) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H9F6AB925916649FDA11E86A539D16C39" style="OLC"> <subparagraph id="H2EA443D3B23046C0AFA93C64E634C665"><enum>(C)</enum><text>include on the website—</text>
 <clause id="H2C7604B294F845A5B800B06EF3F9BFB8"><enum>(i)</enum><text>a program inventory that shall identify each program of the Federal Government for which there is more than $1,000,000 in annual budget authority, which shall include—</text>
 <subclause id="H66C59AA3CC834A8EB4D12697C9DDB330"><enum>(I)</enum><text>any activity that is commonly referred to as a program by a Federal agency in communications with Congress, including any activity identified as a program in a budget request;</text>
 </subclause><subclause id="H48BE6E8B89EF48DB92EFF8057C115800"><enum>(II)</enum><text>any activity that is commonly referred to as a program by a Federal agency in communications with the public, including each program for which financial awards are made on a competitive basis; and</text>
 </subclause><subclause id="HE8BFAD9C53D847F391C2BD9A5EE91BD8"><enum>(III)</enum><text>any activity referenced in law as a program after June 30, 2019; and</text> </subclause></clause><clause id="H08CBEA9C268B4D239A250D49436FF6CA"><enum>(ii)</enum><text>for each program identified in the program inventory, the information required under paragraph (3) or paragraph (4), as applicable.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HDD44F56FAFE240898BAE5AD8D84394BC"><enum>(4)</enum><text>in paragraph (3), as so redesignated—</text> <subparagraph id="HDD6EE7F2405243FCAEF18A716FF00516"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote><header-in-text level="paragraph" style="USC">Information</header-in-text>.—Information for each program described under paragraph (1)</quote> and inserting <quote><header-in-text level="paragraph" style="USC">Information for larger programs</header-in-text>.—Information for each program identified in the program inventory required under paragraph (2) for which there is more than $10,000,000 in annual budget authority</quote>;</text>
 </subparagraph><subparagraph id="H6C4F807D86A14A7EA9887EAA95336F7C"><enum>(B)</enum><text>by striking subparagraph (C);</text> </subparagraph><subparagraph id="HDC9AD967BE5B41049B56702937A684E9"><enum>(C)</enum><text>by redesignating subparagraph (B) as subparagraph (D);</text>
 </subparagraph><subparagraph id="H073A51F9245D40199FD31DAD990701B7"><enum>(D)</enum><text>by striking subparagraph (A) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HE31868504A6045C8AC2EFA030501EA97" style="OLC"> <subparagraph id="H2DF58A34D2284A88B01A5F3698C1318F"><enum>(A)</enum><text>an identification of the program activities that are aggregated, disaggregated, or consolidated as part of identifying programs;</text>
 </subparagraph><subparagraph id="HEDCC9209218F45AA87033DB7928D7467"><enum>(B)</enum><text>for each program activity described in subparagraph (A), the amount of funding for the current fiscal year and previous 2 fiscal years;</text>
 </subparagraph><subparagraph id="H182EEB899BB5462FA3CA0C27EBE6E555"><enum>(C)</enum><text>an estimate of the amount of funding for the program;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H09C996C81D784CA2B5D5D76AAD703BF2"><enum>(E)</enum><text>in subparagraph (D), as so redesignated, by striking <quote>and</quote> at the end; and</text>
 </subparagraph><subparagraph id="HB397574D6FEA405C870C6DCD287CDBC2"><enum>(F)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H8425E33D112D415D917998C7E496367A" style="OLC"> <subparagraph id="H7A090BB33BA549B59477E5971A0B028A"><enum>(E)</enum><text>an identification of the statutes that authorize the program and any major regulations specific to the program;</text>
 </subparagraph><subparagraph id="H9849347122FD4BE88B914ECFC5F2BE6B"><enum>(F)</enum><text>for any program that provides grants or other financial assistance to individuals or entities, for the most recent fiscal year—</text>
 <clause id="H17CA6F735A764D268361B6B237EA7EE6"><enum>(i)</enum><text>a description of the individuals served by the program and beneficiaries who received financial assistance under the program, including an estimate of the number of individuals and beneficiaries, to the extent practicable;</text>
 </clause><clause id="H3D63DF24BC134C4E950F1EC7ED64EE33"><enum>(ii)</enum><text>for each program for which the head of an agency determines it is not practicable to provide an estimate of the number of individuals and beneficiaries served by the program—</text>
 <subclause id="HF25B2974C01C4B6EB1893C8E013CFB98"><enum>(I)</enum><text>an explanation of why data regarding the number of such individuals and beneficiaries cannot be provided; and</text>
 </subclause><subclause id="HAFEF3666EE64408188ED75F263E6676B"><enum>(II)</enum><text>a discussion of the measures that could be taken to gather the data required to provide such an estimate; and</text>
 </subclause></clause><clause id="H38543AE2812E4164AA5A15900A6BCD4C"><enum>(iii)</enum><text>a description of—</text> <subclause id="H1236807F69D44360B9B4782357F1DF2E"><enum>(I)</enum><text>the Federal employees who administer the program, including the number of full-time equivalents with a pro rata estimate for full-time equivalents associated with multiple programs; and</text>
 </subclause><subclause id="H9DEF7112F7E04DBDA1CBEE21039AF840"><enum>(II)</enum><text>other individuals whose salary is paid in part or full by the Federal Government through a grant, contract, cooperative agreement, or another form of financial award or assistance who administer or assist in any way in administering the program, including the number of full-time equivalents, to the extent practicable;</text>
 </subclause></clause></subparagraph><subparagraph id="H3EE71241695B4A5F8ADA178970516233"><enum>(G)</enum><text>links to any evaluation, assessment, or program performance reviews by the agency, an Inspector General, or the Government Accountability Office (including program performance reports required under section 1116) released during the preceding 5 years; and</text>
 </subparagraph><subparagraph id="HDC50D240B70541FD8A0D101906E53C86"><enum>(H)</enum><text>to the extent practicable, financial and other information for each program activity required to be reported under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H0DDE7AC089A545E0B17E8100E97D8CA9"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H3FCDDCEFE61D4111AB42FD84A75117AC" style="OLC"> <paragraph id="H5DA30B053988454CA1A3DF9CFBE639F9"><enum>(4)</enum><header>Information for smaller programs</header><text>Information for each program identified in the program inventory required under paragraph (2) for which there is more than $1,000,000 and not more than $10,000,000 in annual budget authority shall, at a minimum, include—</text>
 <subparagraph id="HBD99CECD40D742B898C0E6E6CAD75367"><enum>(A)</enum><text>an identification of the program activities that are aggregated, disaggregated, or consolidated as part of identifying programs;</text>
 </subparagraph><subparagraph id="HEED75A08B2624DE8B9DB5B3118C2750C"><enum>(B)</enum><text>for each program activity described in subparagraph (A), the amount of funding for the current fiscal year and previous 2 fiscal years;</text>
 </subparagraph><subparagraph id="H5F3CB2338DD3489EB4629C0B3997E003"><enum>(C)</enum><text>an identification of the statutes that authorize the program and any major regulations specific to the program;</text>
 </subparagraph><subparagraph id="H12E5FD891D724EA5B2EF252CA021251A"><enum>(D)</enum><text>for any program that provides grants or other financial assistance to individuals or entities, a description of the individuals served by the program and beneficiaries who received financial assistance under the program for the most recent fiscal year; and</text>
 </subparagraph><subparagraph id="H2C1589D1EA0B4BE59E2D4A550232E5F9"><enum>(E)</enum><text>links to any evaluation, assessment, or program performance reviews by the agency, an Inspector General, or the Government Accountability Office (including program performance reports required under section 1116) released during the preceding 5 years.</text>
 </subparagraph></paragraph><paragraph id="HD1B61694AA7242628B1E38CEB5B52F69"><enum>(5)</enum><header>Archiving</header><text>After the end of each fiscal year, the Director of the Office of Management and Budget shall archive and preserve the information included in the program inventory required under paragraph (2) relating to that fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HB3CDC29559FC4EC89B924C9F70E65681"><enum>(b)</enum><header>Expired grant funding</header><text display-inline="yes-display-inline">Not later than February 1 of each fiscal year, the Director of the Office of Management and Budget shall publish on a public website the total amount of undisbursed grant funding remaining in grant accounts for which the period of availability to the grantee has expired.</text>
			</subsection></section><section id="HBC27AAA2299C4E3EA74CE984C4AF2A9B"><enum>3.</enum><header>Guidance and implementation</header>
 <subsection id="HC241443F06C943359D255E1A194FEA53"><enum>(a)</enum><header>Guidance</header><text>Not later than June 30, 2018, the Director of the Office of Management and Budget—</text> <paragraph id="HB6F4759A035E4CFAAFE225062D353B44"><enum>(1)</enum><text>shall prescribe guidance to implement this Act, and the amendments made by this Act;</text>
 </paragraph><paragraph id="H621A6E6E19AA41C58D7BC491FF483B13"><enum>(2)</enum><text>shall issue guidance to agencies to identify how the program activities used for reporting under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) are associated with programs identified in the program inventory required under section 1122(a)(2)(C)(i) of title 31, United States Code, as amended by subsection (a);</text>
 </paragraph><paragraph id="H2379706B6C604482B9AE25DC36B040F4"><enum>(3)</enum><text>may issue guidance to agencies to ensure that the programs identified in the program inventory required under section 1122(a)(2)(C)(i) of title 31, United States Code, as amended by subsection (a), are presented at a similar level of detail across agencies and are not duplicative or overlapping; and</text>
 </paragraph><paragraph id="H621DB16BCB98427EB0AEDDCCE9936CE0"><enum>(4)</enum><text>may, based on an analysis of the costs of implementation, and after submitting to Congress a notification of the action by the Director—</text>
 <subparagraph id="H07989A80252742FBAE520220E936A5BB"><enum>(A)</enum><text>exempt from the requirements under section 1122(a) of title 31, United States Code, an agency that—</text> <clause id="H8A31EE63B80E423B8C8DFA43A85B86A5"><enum>(i)</enum><text>is not listed in section 901(b) of title 31, United States Code; and</text>
 </clause><clause id="HF08EDEAFE0A144979530FE2E50FC3671"><enum>(ii)</enum><text>for the fiscal year during which the exemption is made, has budget authority (as defined in section 3 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>)) of not more than $10,000,000; and</text>
 </clause></subparagraph><subparagraph id="HB35EA45D31D94CD48D18C6E68303F427"><enum>(B)</enum><text>extend the implementation deadline under subsection (b) by not more than 1 year.</text> </subparagraph></paragraph></subsection><subsection id="H7616A6E640C84564AEA49F4CC66BA990"><enum>(b)</enum><header>Implementation</header><text>This Act, and the amendments made by this Act, shall be implemented not later than June 30, 2019.</text>
 </subsection></section><section id="HB37D95C145F6444D90A7FAD712798B8E"><enum>4.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to carry out the requirements of this Act and the amendments made by this Act. Such requirements shall be carried out using amounts otherwise authorized.</text>
