			 certain vehicles serving residents of municipalities adjacent to the
			 Delaware Water Gap National Recreation Area, and for other purposes.</official-title></form>

 <section id="H9D97BC988A024D25AFBCF04921EE08ED" section-type="section-one"><enum>1.</enum><header>Vehicular access and fees</header><text display-inline="no-display-inline">Section 4 of the Delaware Water Gap National Recreation Area Improvement Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/156">Public Law 109–156</external-xref>) is amended to read as follows:</text>

				<section id="H79670D73D83B44C2A8D4AEA915BF107E"><enum>4.</enum><header>Use of certain roads within the recreation area</header>
 <subsection id="H70B94F176E164CF48CAF7D66561C6F00"><enum>(a)</enum><header>In general</header><text>Except as otherwise provided in this section, Highway 209, a federally owned road within the boundaries of the Recreation Area, shall be closed to all commercial vehicles.</text>
 </subsection><subsection id="H2032F81224B243F99F95DC2E97413CD6"><enum>(b)</enum><header>Exception for local business use</header><text>Until September 30, 2021, subsection (a) shall not apply with respect to the use of commercial vehicles that have four or fewer axles and are—</text>
 <paragraph id="HA110E8FFEDE24779A86E757DB26F929C"><enum>(1)</enum><text>owned and operated by a business physically located in—</text> <subparagraph id="HC9C3FAB4B09541978F183502F7082648"><enum>(A)</enum><text>the Recreation Area; or</text>
 </subparagraph><subparagraph id="H71F84BED816B45018B8C8BB33A307776"><enum>(B)</enum><text>one or more adjacent municipalities; or</text> </subparagraph></paragraph><paragraph id="HDF7FEA86BB9643E28AFD4A063166797F"><enum>(2)</enum><text>necessary to provide services to businesses or persons located in—</text>
 <subparagraph id="HF68D1A05589743688874C78C8FC213DE"><enum>(A)</enum><text>the Recreation Area; or</text> </subparagraph><subparagraph id="HD1E59A78EEDA4F5AB3168FBA67443B52"><enum>(B)</enum><text>one of more adjacent municipalities.</text>
 </subparagraph></paragraph></subsection><subsection id="H417A45C60C5748FB887179E5E37BCA9C"><enum>(c)</enum><header>Fee</header><text>The Secretary shall establish a fee and permit program for the use by commercial vehicles of Highway 209 under subsection (b). The program shall include an annual fee not to exceed $200 per vehicle. All fees received under the program shall be set aside in a special account and be available, without further appropriation, to the Secretary for the administration and enforcement of the program, including registering vehicles, issuing permits and vehicle identification stickers, and personnel costs.</text>
 </subsection><subsection id="HC20B5F632CC44B1DB8C8A28B85B3C15A"><enum>(d)</enum><header>Exceptions</header><text>The following vehicles may use Highway 209 and shall not be subject to a fee or permit requirement under subsection (c):</text>
 <paragraph id="H86DA5800354E45AB900CA3B02C386050"><enum>(1)</enum><text>Local school buses.</text> </paragraph><paragraph id="H27A780D01D544E1A860B88EE16B8D71E"><enum>(2)</enum><text>Fire, ambulance, and other safety and emergency vehicles.</text>
 </paragraph><paragraph id="HC130A8FAC1614CB6AF4E7087CBFAD2E3"><enum>(3)</enum><text>Commercial vehicles using Federal Road Route 209, from—</text> <subparagraph id="HFA97EFD6C9594B9898F19079EFE335D0"><enum>(A)</enum><text>Milford to the Delaware River Bridge leading to U.S. Route 206 in New Jersey; and</text>
 </subparagraph><subparagraph id="H1E9943E33FD44B2588D7A1CB832DC133"><enum>(B)</enum><text>mile 0 of Federal Road Route 209 to Pennsylvania State Route 2001.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H6FA9388982F0403CB72A9E1107C49327"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Delaware Water Gap National Recreation Area Improvement Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/156">Public Law 109–156</external-xref>) is amended—</text>
 <paragraph id="H8D87F4ACB46E4718AFE4F2116F26A90D"><enum>(1)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (2) through (6), respectively; and</text> </paragraph><paragraph id="HB0CAE05E36364272A4453D1DC9E4BF21"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated by paragraph (1) of this section) the following:</text>

 <paragraph id="H3EF3B0785113437082BB71509FFBDEC0"><enum>(1)</enum><header>Adjacent municipalities</header><text>The term <term>adjacent municipalities</term> means Delaware Township, Dingman Township, Lehman Township, Matamoras Borough, Middle Smithfield Township, Milford Borough, Milford Township, Smithfield Township and Westfall Township, in Pennsylvania.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H513DC77AB46746BEB9A9BC30570B7075"><enum>3.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Section 702 of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/333">Public Law 104–333</external-xref>) is repealed.</text></section></legis-body><endorsement><action-date>May 9, 2017</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
