			 Department of Veterans Affairs, and for other purposes.</official-title></form>

 <section commented="no" id="H36F632B7B8494574995F05C14DFBA4E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fixing VHA Facilities Act</short-title></quote>.</text> </section><section id="HFFA37675E18E441A8256369E90261D04" section-type="subsequent-section"><enum>2.</enum><header>Health monitor</header> <subsection id="H50BF9BBCBA384ACC9A346DE5FC9E7432"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/3">Chapter 3</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/312A">section 312A</external-xref> the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H071645BA205B41328704BD199C2A473C" style="USC">
					<section id="H4DBC298E017945EA91CB425159A8A960"><enum>312B.</enum><header>Health Monitor.</header>
						<subsection id="H5F64A98C058B4E2BB8901AD92C0F79E9"><enum>(a)</enum><header>In general</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HB07C0227DE8A4714BEA7AA1DADDF7E6B"><enum>(1)</enum><text>There is in the Department a Health Monitor who shall appointed by the Secretary.</text> </paragraph><paragraph id="H5CB8C41A9551457388D7C760225650B8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Health Monitor shall report to the Inspector General in the discharge of the duties of the Health Monitor under subsection (c). The Inspector General may not terminate the Health Monitor until 60 days after the date the Inspector General notifies Congress of such impending termination.</text>
 </paragraph><paragraph id="HD14DA790DAD64F778138D9FEEBD9EC11" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In discharging the duties under subsection (c), the Health Monitor shall have the powers of an Inspector General under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /6">section 6</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.).</text>
 </paragraph></subsection><subsection id="H4EDD9A0E453B4BF9845F9E3BAEE05FD7"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">Each individual appointed as Health Monitor shall be an individual who has substantive professional experience in at least one of the following areas:</text>
 <paragraph id="H12C8B22DF57A4CB488C71D530AC0A673"><enum>(1)</enum><text display-inline="yes-display-inline">Federal oversight.</text> </paragraph><paragraph id="H36EE5E6E952B44D2A47FDD8FF577426E"><enum>(2)</enum><text>Health care administration.</text>
 </paragraph><paragraph id="HC33BA42A1B0C476E9D15193EE23E1FF1"><enum>(3)</enum><text>Health care delivery.</text> </paragraph><paragraph id="HAB6906BAC01D4DEBA8AC341FE0825A2D"><enum>(4)</enum><text>Patient advocacy.</text>
							</paragraph></subsection><subsection id="H0E43A31763EB47BF8F71D08B26A9BF3F"><enum>(c)</enum><header>Duties</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HECEC03EAC5E0435682B5EB91CDE2FA7D"><enum>(1)</enum><text>Not later than 60 days after the issuance of the end-of-year relative performance star ratings (in this section referred to as <quote>Star Ratings</quote>) for each fiscal year, the Health Monitor shall identify and transmit a list of specific improvement recommendations for each medical center of the Department that received fewer than three stars in the Star Ratings for the most recent fiscal year. The Health Monitor shall transmit each such list to—</text>
 <subparagraph id="H90078F72D73F47D0A2231B457D41CCE4" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the Director of the medical center named in the list;</text> </subparagraph><subparagraph id="H884F6D09ED5749B8825FD3EC224F8BCF" indent="up1"><enum>(B)</enum><text>the Secretary;</text>
 </subparagraph><subparagraph id="H89BB664AE95A4F14A4A0CE20B940FFC0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">the Committees on Veterans’ Affairs of the Senate and the House of Representatives;</text> </subparagraph><subparagraph id="H07BEB1EA7E6E498FA0AD1CE69A88CFEE" indent="up1"><enum>(D)</enum><text>the Senators for the State in which the medical center is located; and</text>
 </subparagraph><subparagraph id="HCE6C6F0509E44EF095BB37F12A1F4B2C" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">the Representative in whose congressional district the medical center is located.</text> </subparagraph></paragraph><paragraph id="H719A1D1B47754B339E86CB09938FF40B" indent="up1"><enum>(2)</enum><text>Not later than 180 days after the Health Monitor transmits a list under paragraph (1), the Health Monitor shall submit a report to the recipients of that list a report that identifies—</text>
 <subparagraph id="H051B1553B8314E788A0AF2BA4A4E7547"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which the Director of the medical center implemented the plan;</text> </subparagraph><subparagraph id="H2A2E8EDC2379406FAA4C3ED8D388906A"><enum>(B)</enum><text display-inline="yes-display-inline">any change in the performance of the medical center.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB7B8700A4A7447578C73FF81331C7139"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 312A the following new item:</text>
