			 exercise the proper degree of care in the case of a child who survives an
			 abortion or attempted abortion.</official-title></form>
	<legis-body id="H96CE69E0D71040DB9B3D3F3CD9CCBC0F" style="OLC">
 <section id="H568CF86358BF47E2ADDAF422D6EA84EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Born-Alive Abortion Survivors Protection Act</short-title></quote>.</text> </section><section commented="no" id="H11BC07F1F0BB4D5E962DADB9762CA991" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text>
 <paragraph commented="no" id="H5B839FA7F8BF4738A98CEFA3B7783BFF"><enum>(1)</enum><text display-inline="yes-display-inline">If an abortion results in the live birth of an infant, the infant is a legal person for all purposes under the laws of the United States, and entitled to all the protections of such laws.</text>
 </paragraph><paragraph commented="no" id="H63D72318C9994BEB9F01DE043836FCC0"><enum>(2)</enum><text>Any infant born alive after an abortion or within a hospital, clinic, or other facility has the same claim to the protection of the law that would arise for any newborn, or for any person who comes to a hospital, clinic, or other facility for screening and treatment or otherwise becomes a patient within its care.</text>
			</paragraph></section><section id="H75FD0EC2B8D4439FBB11FB7D202C3DE9"><enum>3.</enum><header>Born-alive infants protection</header>
 <subsection id="H87D987033F34482DAE66C7C9F543BADC"><enum>(a)</enum><header>Requirements pertaining to born-Alive abortion survivors</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1531">section 1531</external-xref> the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4EB91092DD8A475E854C77BEE4F88003" style="USC">
					<section id="H2E76C59F712848E1A17E2F5A9A99F369"><enum>1532.</enum><header>Requirements pertaining to born-alive abortion survivors</header>
 <subsection id="HF677B72AD2C54A839005D1408283D9E6"><enum>(a)</enum><header>Requirements for health care practitioners</header><text>In the case of an abortion or attempted abortion that results in a child born alive (as defined in section 8 of title 1, United States Code (commonly known as the <quote>Born-Alive Infants Protection Act</quote>)):</text>
 <paragraph id="H13B9F6765F184DC6A48630DA0E23F457"><enum>(1)</enum><header>Degree of care required; immediate admission to a hospital</header><text>Any health care practitioner present at the time the child is born alive shall—</text> <subparagraph id="H5AFD5DA653C44257B064F9E87FAA1547"><enum>(A)</enum><text>exercise the same degree of professional skill, care, and diligence to preserve the life and health of the child as a reasonably diligent and conscientious health care practitioner would render to any other child born alive at the same gestational age; and</text>
 </subparagraph><subparagraph id="H5ED3E5832D9541D7B794317FC7ACD55F"><enum>(B)</enum><text display-inline="yes-display-inline">following the exercise of skill, care, and diligence required under subparagraph (A), ensure that the child born alive is immediately transported and admitted to a hospital.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H0FDA79CCC46A4537A9923926D770EC57"><enum>(2)</enum><header>Mandatory reporting of violations</header><text>A health care practitioner or any employee of a hospital, a physician’s office, or an abortion clinic who has knowledge of a failure to comply with the requirements of paragraph (1) shall immediately report the failure to an appropriate State or Federal law enforcement agency, or to both.</text>
							</paragraph></subsection><subsection id="HA9E1D61321CC4226BA9B824AB8B4CA89"><enum>(b)</enum><header>Penalties</header>
 <paragraph id="HA9A1F65F048F46398EB1BA47267AF7A6"><enum>(1)</enum><header>In general</header><text>Whoever violates subsection (a) shall be fined under this title or imprisoned for not more than 5 years, or both.</text>
 </paragraph><paragraph id="HB00BA59FF8834DD9A59FA3A81803FB73"><enum>(2)</enum><header>Intentional killing of child born alive</header><text>Whoever intentionally performs or attempts to perform an overt act that kills a child born alive described under subsection (a), shall be punished as under section 1111 of this title for intentionally killing or attempting to kill a human being.</text>
 </paragraph></subsection><subsection id="H159ABB8A3F5C427CAF49EA610887B3F2"><enum>(c)</enum><header>Bar to prosecution</header><text>The mother of a child born alive described under subsection (a) may not be prosecuted under this section, for conspiracy to violate this section, or for an offense under section 3 or 4 of this title based on such a violation.</text>
						</subsection><subsection id="HC73571EDBC244B16B88A942D61D73A9F"><enum>(d)</enum><header>Civil remedies</header>
 <paragraph id="H3D66B67511B74559AA745E0548B80FD4"><enum>(1)</enum><header>Civil action by a woman on whom an abortion is performed</header><text display-inline="yes-display-inline">If a child is born alive and there is a violation of subsection (a), the woman upon whom the abortion was performed or attempted may, in a civil action against any person who committed the violation, obtain appropriate relief.</text>
 </paragraph><paragraph id="H809DE12AC728485A97563E6539387050"><enum>(2)</enum><header>Appropriate relief</header><text>Appropriate relief in a civil action under this subsection includes—</text> <subparagraph id="HC93469660A434B949929D3E3FB4E0B90"><enum>(A)</enum><text>objectively verifiable money damage for all injuries, psychological and physical, occasioned by the violation of subsection (a);</text>
 </subparagraph><subparagraph id="H1C2460510EBA42FBAFE79D9AD1952C64"><enum>(B)</enum><text>statutory damages equal to 3 times the cost of the abortion or attempted abortion; and</text> </subparagraph><subparagraph id="H8D42A6E0E2B74EF0882EC383D8A34AF7"><enum>(C)</enum><text>punitive damages.</text>
 </subparagraph></paragraph><paragraph id="HD389CDDE64C847C1B675086B1C16177D"><enum>(3)</enum><header>Attorney’s fee for plaintiff</header><text>The court shall award a reasonable attorney’s fee to a prevailing plaintiff in a civil action under this subsection.</text>
 </paragraph><paragraph id="HBA43EC50C26149C0A8F38D490266B2C2"><enum>(4)</enum><header>Attorney’s fee for defendant</header><text display-inline="yes-display-inline">If a defendant in a civil action under this subsection prevails and the court finds that the plaintiff’s suit was frivolous, the court shall award a reasonable attorney’s fee in favor of the defendant against the plaintiff.</text>
 </paragraph></subsection><subsection id="HA8B5912CF8BA48D49ABA4FA41211906D"><enum>(e)</enum><header>Definitions</header><text>In this section the following definitions apply:</text> <paragraph id="H39B9B36BFA8D4080AC0B6ABC5806411F"><enum>(1)</enum><header>Abortion</header><text>The term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text>
 <subparagraph id="HBC6928C4EC91451CB7870E15BC7D69A9"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text> </subparagraph><subparagraph id="HC7FE7B86F36E4D3090D9042C0CEFE103"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text>
 <clause id="H2DF1E1B6B6BE42FF97444B8344C8EB0F"><enum>(i)</enum><text>after viability, to produce a live birth and preserve the life and health of the child born alive; or</text>
 </clause><clause id="H87B9577C4E07493DB8E26CF534876BCB"><enum>(ii)</enum><text>to remove a dead unborn child.</text> </clause></subparagraph></paragraph><paragraph id="H5B0F557A45084F369BAB4A136D182BD0"><enum>(2)</enum><header>Attempt</header><text>The term <term>attempt</term>, with respect to an abortion, means conduct that, under the circumstances as the actor believes them to be, constitutes a substantial step in a course of conduct planned to culminate in performing an abortion.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC0ABB34D7E0C4435AA474CC5124490F6"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">chapter 74</external-xref> of title 18, United States Code, is amended by inserting after the item pertaining to section 1531 the following:</text>

 <paragraph id="H71537E22C89045BE8183297196CFB119"><enum>(1)</enum><header>Chapter heading in chapter</header><text>The chapter heading for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">chapter 74</external-xref> of title 18, United States Code, is amended by striking <quote><header-in-text level="section" style="USC">Partial-Birth Abortions</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Abortions</header-in-text></quote>.</text> </paragraph><paragraph id="H60C6EF3B2601461186D22A771E0839C6"><enum>(2)</enum><header>Table of chapters for part I</header><text>The item relating to chapter 74 in the table of chapters at the beginning of part I of title 18, United States Code, is amended by striking <quote>Partial-Birth Abortions</quote> and inserting <quote>Abortions</quote>.</text>
