			 to transfer entitlement to Post-9/11 Educational Assistance to their

 <section id="H8910327565E24C28BBA14591110EF29B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Education Assistance to Realign New Eligibilities for Dependents Act of 2017</short-title></quote> or the <quote><short-title>EARNED Act of 2017</short-title></quote>.</text> </section><section id="H99CFC8E3C63D428688EED10C7ED1C721"><enum>2.</enum><header>Authority of certain members of the Armed Forces who have served 20 years on active duty to transfer entitlement to Post-9/11 Educational Assistance to their dependents</header> <subsection id="H1126278BBD3E47CCB0674746732D6FB9"><enum>(a)</enum><header>Transfer authorized</header><text display-inline="yes-display-inline">Section 3319 of title 38, United States Code, is amended—</text>
 <paragraph id="H8171F53FAA684375A31D0A6DCE9AFD2A"><enum>(1)</enum><text>by striking subsection (b) and inserting the following new subsection (b):</text> <quoted-block display-inline="no-display-inline" id="H334D35A4A7A94EE8B902FFEA53F13B23" style="USC"> <subsection id="H1780F2429D06424587336DEC5D0B94CD"><enum>(b)</enum><header>Eligible individuals</header><text display-inline="yes-display-inline">An individual referred to in subsection (a)—</text>
 <paragraph id="H63BFCE85F27840429AECC648E79DFF00"><enum>(1)</enum><text>is any member of the uniformed services who, at the time of the approval of the individual's request to transfer entitlement to educational assistance under this section, has completed at least—</text>
 <subparagraph id="HAF15260B7E1C45ADB2460914F4CF7327"><enum>(A)</enum><text>six years of service in the Armed Forces and enters into an agreement to serve at least four more years as a member of the uniformed services; or</text>
 </subparagraph><subparagraph id="H9AB56A8BBC3846FABD35B35DE63D3257"><enum>(B)</enum><text>the years of service as determined in regulations pursuant to subsection (j); or</text> </subparagraph></paragraph><paragraph id="HC16553E7D4EB42268978EA720AD8119B"><enum>(2)</enum><text>any member of the uniformed services, or retired member of the uniformed services, who, at the time of the approval of the individual’s request to transfer entitlement to educational assistance under this section has completed at least 20 years of active duty service in the Armed Forces, including at least 90 days of such service after September 10, 2001.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H7942476C1C8A41F5BCB771FBBE162ADA"><enum>(2)</enum><text>in subsection (f)(1), by inserting <quote>described in subsection (b)(1) who is</quote> after <quote>an individual</quote>.</text> </paragraph></subsection><subsection id="H757CB8309BB9404384881FB8EDD5779F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect as if included in the enactment of the Post-9/11 Veterans Educational Assistance Act of 2008 (title V of <external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>).</text>
