	<legis-body id="H1909C188A90A403F9AE9C1FA4AB26CB9" style="OLC">
 <section id="HB25B4FEC619E459DAACF1783C2576372" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Domestic Violence Reporting Enhancement Act</short-title></quote>.</text> </section><section id="H92BB3D36E0C1498E86C69D8739397928" section-type="subsequent-section"><enum>2.</enum><header>Punitive article in the Uniform Code of Military Justice on domestic violence</header> <subsection id="H4E3366E066F34A0F9BD810CC50FF1165"><enum>(a)</enum><header>Punitive article</header> <paragraph id="H973FDE691FB04140B748D11600B27D1D"><enum>(1)</enum><header>In general</header><text>Subchapter X of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), is amended by inserting after the item relating to section 928 (article 128) the following new section (article):</text>

						<section id="HDFF30F96EC5F485FAD9A5056500A4752"><enum>928a. Art 128a.</enum><header>Domestic violence</header>
 <subsection id="HE9AD06467E904C828EC94AE86B58B1D7"><enum>(a)</enum><header>Domestic violence</header><text display-inline="yes-display-inline">Any person subject to this chapter who, unlawfully and with force or violence, attempts, offers to, or does intimidate, manipulate, humiliate, isolate, frighten, terrorize, coerce, threaten, blame, hurt, injure, or wound another person of whom the person is an intimate partner is guilty of domestic violence and shall be punished as a court-martial may direct.</text>
 </subsection><subsection id="HD381A33DAB0644C1A45577F113F08493"><enum>(b)</enum><header>Aggravated domestic violence</header><text>Any person subject to this chapter who, in committing domestic violence, uses a weapon, means, or force in a manner likely to produce death or grievous bodily harm is guilty of aggravated domestic violence and shall be punished as a court-martial may direct.</text>
 </subsection><subsection id="HB0AC873441D24E07BD874B8A8C66B831"><enum>(c)</enum><header>Intimate partner defined</header><text>In this section, the term <term>intimate partner</term>, in the case of a person, means another person—</text> <paragraph id="HC5BC03531633469190344A9BF9A2A2AF"><enum>(1)</enum><text>who is the spouse or former spouse of the person;</text>
 </paragraph><paragraph id="H6A5015CC66DF43A2920E2551AF4CEE52"><enum>(2)</enum><text>who shares a child in common with the person;</text> </paragraph><paragraph id="H6A5EEF9F7CB44D0FBDA596FE2E9AEBE7"><enum>(3)</enum><text>who cohabits or has cohabited with the person;</text>
 </paragraph><paragraph id="HD25C8D7F0C92451FAF61CEA2EAE69E1A"><enum>(4)</enum><text>who is a dating partner of the person; or</text> </paragraph><paragraph id="H774F669EAE21449495B6006EBF56457D"><enum>(5)</enum><text>of whom the person is situated as a parent or guardian or is similarly situated.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCEE884EC68084947B99AAAAFF0AE1FC4"><enum>(2)</enum><header>Clerical amendments</header>
 <subparagraph id="H4B82B0C6946D4116ADE428842E7AC9E1"><enum>(A)</enum><header>In general</header><text>The table of sections at the beginning of subchapter X of chapter 47 of such title is amended by inserting after the item relating to section 928 (article 128) the following new item:</text>

 </subparagraph><subparagraph id="H4BE47591E9094C4597BF1E89C26F14F1"><enum>(B)</enum><header>Coordination with UCMJ reform</header><text>Effective as of the effective date of the amendments made by the Military Justice Act of 2016 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/101">10 U.S.C. 101</external-xref> note), as provided in section 5542(a) of that Act (130 Stat. 2967; <external-xref legal-doc="usc" parsable-cite="usc/10/801">10 U.S.C. 801</external-xref> note), the table of sections at the beginning of subchapter X of chapter 47 of such title, as amended by section 5452 of that Act (130 Stat. 2958), is further amended by inserting after the item relating to section 928 (article 928) the following new item:</text>

 </subparagraph><subparagraph id="H8F33FA5BC6B444088DD139F256EB9BE3"><enum>(C)</enum><header>Coordination of amendments</header><text>If the date of the enactment of this Act occurs after the effective date of the amendments made by the Military Justice Act of 2016, as provided in section 5542(a) of that Act, subparagraph (A) and the amendment made by that subparagraph shall not go into effect.</text>
					</subparagraph></paragraph></subsection><subsection id="H24D9B5D3F20D418FB4FB63373EA3CD93"><enum>(b)</enum><header>Coordination with prohibitions on sale, transit, or possession of firearms or ammunition by persons
 convicted of domestic violence</header><text>Section 922 of title 18, United States Code, is amended—</text> <paragraph id="H5E0711127DFA40DE995669A80AF15C30"><enum>(1)</enum><text>in subsection (d)(9), by inserting before the period at the end the following: <quote>, or has been convicted by general or special court-martial of an offense of domestic violence under section 928a of title 10 (article 128a of the Uniform Code of Military Justice)</quote>; and</text>
 </paragraph><paragraph id="H21C6559DBDB24642812910CDFF88BC20"><enum>(2)</enum><text>in subsection (g)(9), by inserting before the comma at the end the following: <quote>, or who has been convicted by general or special court-martial of an offense of domestic violence under section 928a of title 10 (article 128a of the Uniform Code of Military Justice)</quote>.</text>
				</paragraph></subsection><subsection id="H493DC81B31604A91B2641BDCC0D9B412"><enum>(c)</enum><header>Prompt reporting of convictions</header>
 <paragraph id="H469A46500EA646AFACE6069AE442D716"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Under regulations and procedures prescribed by the Secretary of Defense, each Secretary concerned shall submit to the Attorney General for inclusion in the national instant criminal background check system and other appropriate systems or databases the name and other appropriate information on each member of the Armed Forces under the jurisdiction of such Secretary who has been convicted of an offense under section 928a title 10, United States Code (article 128a of the Uniform Code of Military Justice), as added by subsection (a).</text>
 </paragraph><paragraph id="H940BF07DBFC249429B7AEA19868743B4"><enum>(2)</enum><header>Deadline for reporting</header><text>The name and other information on a member required to be submitted pursuant to paragraph (1) shall be submitted not later than three days after the date of entry of judgment with respect to the member for the offense concerned.</text>
 </paragraph><paragraph id="HFC2673624ED74C51A236179B6CCD7D60"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HEA23CBA1CEB546E3A87C039155969AC7"><enum>(A)</enum><text>The term <term>national instant criminal background check system</term> means the system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BAAE6FDA14D418B87F641CC51500546"><enum>(B)</enum><text>The term <term>Secretary concerned</term> has the meaning given that term in section 101(a)(9) of title 10, United States Code.</text> </subparagraph></paragraph></subsection></section></legis-body></bill>
