 <section id="H9FF1BE05681F46DB94A72C6265F7E8D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Industrial Mineral Parity Act of 2017</short-title></quote>.</text> </section><section id="H827BD9EF887A453F97FC1573A85B37B0"><enum>2.</enum><header>Modified Permit for Remining Operations</header> <subsection id="H79FEDFC0D3B2408A94DE0217EBFD3022"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 301(p)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311(p)(1)</external-xref>) is amended by striking <quote>coal</quote>.</text>
 </subsection><subsection id="HD6114257739F4B26AFBCC2C185E0AC04"><enum>(b)</enum><header>Limitations</header><text display-inline="yes-display-inline">Section 301(p)(2) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311(p)(2)</external-xref>) is amended by striking <quote>coal</quote> each place it appears.</text>
 </subsection><subsection id="HEBF9843B78AA42D1929A280B2BF22AD4"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 301(p)(3) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311(p)(3)</external-xref>) is amended—</text> <paragraph id="HF13C14143C82455F86A3178613CC420D"><enum>(1)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (D) and (F), respectively;</text>
 </paragraph><paragraph id="H12FDC4CCF2FE4FBA8443688BB66FEC57"><enum>(2)</enum><text>by inserting after subparagraph (A) the following:</text> <quoted-block display-inline="no-display-inline" id="H7FCB0272DB3949E1BFD9DE3DCEA4E540" style="OLC"> <subparagraph id="HEB3EA2D7AE6342F28618A19CF0321C7E"><enum>(B)</enum><header>Industrial mineral</header><text display-inline="yes-display-inline">The term <term>industrial mineral</term> means limestone, clay, sand, gravel, diatomite, kaolin, bentonite, silica, barite, gypsum, or talc.</text>
 </subparagraph><subparagraph id="H48F0F9E9720342BEA967CD821B9EB4E8"><enum>(C)</enum><header>Industrial minerals remining operation</header><text display-inline="yes-display-inline">The term <term>industrial minerals remining operation</term> means an industrial minerals mining operation that begins after the date of the enactment of the <short-title>Industrial Mineral Parity Act of 2017</short-title> at a site on which coal mining was conducted before the effective date of the Surface Mining Control and Reclamation Act of 1977.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HD939ED4305694190916CEF8EA7C8BBFD"><enum>(3)</enum><text>in subparagraph (D), as so redesignated, by striking <quote>coal remining</quote> and inserting <quote>remining</quote>; and</text> </paragraph><paragraph id="H7F265A91AB4141A0A419DAE38489A98F"><enum>(4)</enum><text>by inserting after subparagraph (D), as so redesignated, the following:</text>

 <subparagraph id="H756915FC82064081B1072CF27FA6F0DA"><enum>(E)</enum><header>Remining operation</header><text display-inline="yes-display-inline">The term <term>remining operation</term> means a coal remining operation or an industrial minerals remining operation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HABAC953EFA884F138C33CCB1F8C9BCD9"><enum>(d)</enum><header>Applicability of strip mining laws</header><text display-inline="yes-display-inline">Section 301(p)(4) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311(p)(4)</external-xref>) is amended by striking <quote>coal</quote>.</text>
 </subsection><subsection id="HF5529F7B1FA14C45A6D0DE3480218BAA"><enum>(e)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 301(p) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311(p)</external-xref>) is amended in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">coal</header-in-text></quote>.</text>
