 <section changed="added" id="HFEA40BD233D54E709CBD915ADBCB43DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance Recoupment Fairness Act of 2017</short-title></quote>.</text> </section><section changed="added" id="H75B14B752CAB41679CB4402EF9A03839"><enum>2.</enum><header>Debts arising since 2012</header> <subsection id="H687E9C8B265E4AE09B8FCB9CD8ECF621"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered assistance</term> means assistance provided—</text>
 <paragraph id="H84A3E8ACE62B4A8A9704590059E103C7"><enum>(1)</enum><text display-inline="yes-display-inline">under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>); and</text>
 </paragraph><paragraph id="HFA4A628CF2514225A2ADFF8EC72C1BAC"><enum>(2)</enum><text display-inline="yes-display-inline">in relation to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) during the period beginning on January 1, 2012, and ending on the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="H9B405F5EF8104241A2FACBB3BBFB1130"><enum>(b)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall waive a debt owed to the United States related to covered assistance provided to an individual or household, unless the debt involves fraud, the intentional presentation of a false claim, or intentional misrepresentation by the debtor or any party having an interest in the claim.</text>
 </subsection><subsection id="H100B0787F288421BB8610F6DAF7E9AEE"><enum>(c)</enum><header>Repayment authority</header><text>The Administrator of the Federal Emergency Management Agency shall reimburse a debtor for any payments made by the debtor on a debt owed to the United States related to covered assistance, if the Administrator would have otherwise been required to waive the debt under subsection (b).</text>
