<section id="H0531D44E94AE4BE1899332C24281DD7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fix NICS Act of 2017</short-title></quote>.</text> </section> <section id="HE78F8C84DFCE430AAD2280A9BB3223D2" section-type="subsequent-section"><enum>2.</enum><header>Accountability for Federal departments and agencies</header><text display-inline="no-display-inline">Section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) is amended—</text> 
<paragraph id="H35938DE49BAA4B7782B9D89664B84A7D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (e)(1), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HF5C58FC7939D41198638CC9F3CCBE93E" style="OLC"> <subparagraph id="H0588E6656A504F62AC4E8DCBCE4A2D76"><enum>(F)</enum><header>Semiannual certification and reporting</header> <clause id="H69E6AE9EFDDD4FF78529DA73421C6DE4"><enum>(i)</enum><header>In general</header><text>The head of each Federal department or agency shall submit a semiannual written certification to the Attorney General indicating whether the department or agency is in compliance with the record submission requirements under subparagraph (C).</text> </clause>
<clause id="H85D7C2EAD0EB4DAABA3DFACEA8E3A032"><enum>(ii)</enum><header>Submission dates</header><text>The head of a Federal department or agency shall submit a certification to the Attorney General under clause (i)—</text> <subclause id="H83BE25133D25415C8E9F7937EAC838EC"><enum>(I)</enum><text>not later than July 31 of each year, which shall address all relevant records, including those that have not been transmitted to the Attorney General, in possession of the department or agency during the period beginning on January 1 of the year and ending on June 30 of the year; and</text> </subclause>
<subclause id="H607FE627687346B5A3C3E01F290ABF78"><enum>(II)</enum><text>not later than January 31 of each year, which shall address all relevant records, including those that have not been transmitted to the Attorney General, in possession of the department or agency during the period beginning on July 1 of the previous year and ending on December 31 of the previous year.</text> </subclause></clause> <clause id="H63C05F6803EE4B14A2A2D722AD630B8C"><enum>(iii)</enum><header>Contents</header><text>A certification required under clause (i) shall state, for the applicable period—</text> 
<subclause id="HD4C0D4D670EC4A7E9EECCBA431876F7A"><enum>(I)</enum><text>the total number of records of the Federal department or agency demonstrating that a person falls within one of the categories described in subsection (g) or (n) of section 922 of title 18, United States Code;</text> </subclause> <subclause id="HBFF94E75F088419DA470284C71023060"><enum>(II)</enum><text>for each category of records described in subclause (I), the total number of records of the Federal department or agency that have been provided to the Attorney General; and</text> </subclause>
<subclause id="H2CDBD2A27F284BDF883EBA9328AA983F"><enum>(III)</enum><text>the efforts of the Federal department or agency to ensure complete and accurate reporting of relevant records, including efforts to monitor compliance and correct any reporting failures or inaccuracies.</text> </subclause></clause></subparagraph> <subparagraph id="H99C57C0BBBA04341A3B0114738ACAE48"><enum>(G)</enum><header>Implementation plan</header> <clause id="H0A3BEE198EDB4DF5B192EF6BAB81B0C3"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subparagraph, the head of each Federal department or agency, in coordination with the Attorney General, shall establish a plan to ensure maximum coordination and automated reporting or making available of records to the Attorney General as required under subparagraph (C), and the verification of the accuracy of those records, including the pre-validation of those records, where appropriate, during a 4-year period specified in the plan. The records shall be limited to those of an individual described in subsection (g) or (n) of section 922 of title 18, United States Code.</text> </clause>
<clause id="H8036E1BE157843108184077A00351870"><enum>(ii)</enum><header>Benchmark requirements</header><text>Each plan established under clause (i) shall include annual benchmarks to enable the Attorney General to assess implementation of the plan, including—</text> <subclause id="H6E66A3C1A5C34AA6984FCB18CD82827D"><enum>(I)</enum><text>qualitative goals and quantitative measures;</text> </subclause>
<subclause id="H16C70EC3C6384C3F911C3E6C0A4B0D72"><enum>(II)</enum><text>measures to monitor internal compliance, including any reporting failures and inaccuracies;</text> </subclause> <subclause id="HF4C223E7798E4736B04B4C1F02B7D144"><enum>(III)</enum><text>a needs assessment, including estimated compliance costs; and</text> </subclause>
<subclause id="H0C3C38FCD310463BB02BA31C7E239FF5"><enum>(IV)</enum><text>an estimated date by which the Federal department or agency will fully comply with record submission requirements under subparagraph (C).</text> </subclause></clause> <clause id="H6C86255B51464B4CBCDE0B5F423B2FAF"><enum>(iii)</enum><header>Compliance determination</header><text>Not later than the end of each fiscal year beginning after the date of the establishment of a plan under clause (i), the Attorney General shall determine whether the applicable Federal department or agency has achieved substantial compliance with the benchmarks included in the plan.</text> </clause></subparagraph>
<subparagraph id="H5766875D092A49C3830CEB5A99D412E3"><enum>(H)</enum><header>Accountability</header><text>The Attorney General shall publish, including on the website of the Department of Justice, and submit to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives a semiannual report that discloses—</text> <clause id="H94AF76CA00B0437CA9CB96E8307B3A87"><enum>(i)</enum><text>the name of each Federal department or agency that has failed to submit a required certification under subparagraph (F);</text> </clause>
<clause id="HD65FADE41003400C99B1A42C4AF9AE00"><enum>(ii)</enum><text>the name of each Federal department or agency that has submitted a required certification under subparagraph (F), but failed to certify compliance with the record submission requirements under subparagraph (C);</text> </clause> <clause id="H6B873381C8DD429390D640CAA1AC799F"><enum>(iii)</enum><text>the name of each Federal department or agency that has failed to submit an implementation plan under subparagraph (G);</text> </clause>
<clause id="H41EDC5E06D194B6A96E957A62C80AF3B"><enum>(iv)</enum><text>the name of each Federal department or agency that is not in substantial compliance with an implementation plan under subparagraph (G);</text> </clause> <clause id="H1517520D64774E95908806BFA3A39ECF"><enum>(v)</enum><text>a detailed summary of the data, broken down by department or agency, contained in the certifications submitted under subparagraph (F);</text> </clause>
<clause id="H01BDC2BCE75A452AB880BDB5DB510C8B"><enum>(vi)</enum><text>a detailed summary of the contents and status, broken down by department or agency, of the implementation plans established under subparagraph (G); and</text> </clause> <clause commented="no" id="H103B874EB54B4AC3AD4EDF97B0134F7B"><enum>(vii)</enum><text>the reasons for which the Attorney General has determined that a Federal department or agency is not in substantial compliance with an implementation plan established under subparagraph (G).</text> </clause></subparagraph>
<subparagraph id="H033442EEC90E46C1931E24616DE23498"><enum>(I)</enum><header>Noncompliance penalties</header><text>For each of fiscal years 2019 through 2022, each political appointee of a Federal department or agency that has failed to certify compliance with the record submission requirements under subparagraph (C), and is not in substantial compliance with an implementation plan established under subparagraph (G), shall not be eligible for the receipt of bonus pay, excluding overtime pay, until the department or agency—</text> <clause id="H6427D661649F4894B4F7347F6DBB52E8"><enum>(i)</enum><text>certifies compliance with the record submission requirements under subparagraph (C); or</text> </clause>
<clause id="H93C0922582064782843E553626EF313B"><enum>(ii)</enum><text>achieves substantial compliance with an implementation plan established under subparagraph (G).</text> </clause></subparagraph> <subparagraph id="H7EC506102B6242F0A163552FE2568C15"><enum>(J)</enum><header>Technical assistance</header><text>The Attorney General may use funds made available for the national instant criminal background check system established under subsection (b) to provide technical assistance to a Federal department or agency, at the request of the department or agency, in order to help the department or agency comply with the record submission requirements under subparagraph (C).</text> </subparagraph>
<subparagraph id="HE7F35E3665F54BACAC0A1EF4E8FE1386"><enum>(K)</enum><header>Application to Federal courts</header><text>For purposes of this paragraph—</text> <clause id="HE92598D8B7E740F1B428B88EBC56A34A"><enum>(i)</enum><text>the terms <term>department or agency of the United States</term> and <term>Federal department or agency</term> include a Federal court; and</text> </clause>
<clause id="H713729C8819848DE851B1C604362A3BB"><enum>(ii)</enum><text>the Director of the Administrative Office of the United States Courts shall perform, for a Federal court, the functions assigned to the head of a department or agency.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> <paragraph id="H60E2927B0EC7407D88D4CD56E66F3F23"><enum>(2)</enum><text>in subsection (g), by adding at the end the following: <quote>For purposes of the preceding sentence, not later than 60 days after the date on which the Attorney General receives such information, the Attorney General shall determine whether or not the prospective transferee is the subject of an erroneous record and remove any records that are determined to be erroneous. In addition to any funds made available under subsection (k), the Attorney General may use such sums as are necessary and otherwise available for the salaries and expenses of the Federal Bureau of Investigation to comply with this subsection.</quote>.</text> </paragraph></section>
<section id="HFCA96FC0025D4AB18A7D44E32393AA38"><enum>3.</enum><header>Reauthorization of NICS Act Record Improvement Program</header> 
<subsection id="HD3BFB57E6436471FA70C97D71A97D18C"><enum>(a)</enum><header>Requirements To obtain waiver</header><text>Section 102 of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40912">34 U.S.C. 40912</external-xref>) is amended—</text> <paragraph id="H223ED02C2FB94DBBA80134233DCF397C"><enum>(1)</enum><text>in subsection (a), in the first sentence—</text> 
<subparagraph id="HE6EFDF55CD294DCC816B2B721EF0E49F"><enum>(A)</enum><text>by striking <quote>the Crime Identification Technology Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/42/14601">42 U.S.C. 14601</external-xref>)</quote> and inserting <quote>section 102 of the Crime Identification Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/34/40301">34 U.S.C. 40301</external-xref>)</quote>; and</text> </subparagraph> <subparagraph id="HF0CC398C73694EC295D45861AD973B88"><enum>(B)</enum><text>by inserting <quote>is in compliance with an implementation plan established under subsection (b) or</quote> before <quote>provides at least 90 percent of the information described in subsection (c)</quote>; and</text> </subparagraph></paragraph>
<paragraph id="HD14040A0FE01440AA3AC8430C019B585"><enum>(2)</enum><text>in subsection (b)(1)(B), by inserting <quote>or has established an implementation plan under section 107</quote> after <quote>the Attorney General</quote>.</text> </paragraph></subsection> <subsection id="H9BAF5C0F3DCA432A9C73A4A4E77A0413"><enum>(b)</enum><header>Implementation assistance to States</header><text>Section 103 of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40913">34 U.S.C. 40913</external-xref>) is amended—</text> 
<paragraph id="H3B1FBA2771E34E45A8C9E7FDC09BB548"><enum>(1)</enum><text>in subsection (b)(3), by inserting before the semicolon at the end the following: <quote>, including through increased efforts to pre-validate the contents of those records to expedite eligibility determinations</quote>;</text> </paragraph> <paragraph id="HF1C91C809B95408D80A6738F46EC62DE"><enum>(2)</enum><text>in subsection (e)—</text> 
<subparagraph id="H28AFEB95368B457BA90F80185077CC2C"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H0FDD7B291D844121BCF6BB905BBB60C1"><enum>(i)</enum><text>by striking <quote>and</quote>; and</text> </clause>
<clause id="H9BD0B27B5FE24D988830C37CCDB8C7C5"><enum>(ii)</enum><text>by inserting before the period at the end the following: <quote>, and $125,000,000 for each of fiscal years 2018 through 2022</quote>; and</text> </clause></subparagraph> <subparagraph id="HBE09D679E00D41A7A2CAAB9B2E077E1B"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following—</text>

<paragraph id="H5C1D3BAF52DD42D5866F1E511710ECF3"><enum>(2)</enum><header>Domestic Abuse and Violence Prevention Initiative</header> 
<subparagraph id="H6754A2035CA24AE5AF737786883F4589"><enum>(A)</enum><header>Establishment</header><text>For each of fiscal years 2018 through 2022, the Attorney General shall create a priority area under the NICS Act Record Improvement Program (commonly known as <quote>NARIP</quote>) for a Domestic Abuse and Violence Prevention Initiative that emphasizes the need for grantees to identify and upload all felony conviction records and domestic violence records.</text> </subparagraph> <subparagraph id="H950D2109871C4652A143655D31A115D0"><enum>(B)</enum><header>Funding</header><text>The Attorney General—</text> 
<clause id="HF9CA17A52E0D492B81E1508E31BAD380"><enum>(i)</enum><text>may use not more than 50 percent of the amounts made available under this subsection for each of fiscal years 2018 through 2022 to carry out the initiative described in subparagraph (A); and</text> </clause> <clause id="HBCF12B421C944947B0E101B662E5C0FC"><enum>(ii)</enum><text>shall give a funding preference under NARIP to States that—</text> 
<subclause id="H1BAF75E425FC497ABA584ADD2C833486"><enum>(I)</enum><text>have established an implementation plan under section 107; and</text> </subclause> <subclause id="HF6A786B5691C47E9B2291B49C7849988"><enum>(II)</enum><text>will use amounts made available under this subparagraph to improve efforts to identify and upload all felony conviction records and domestic violence records described in clauses (i), (v), and (vi) of section 102(b)(1)(C) by not later than September 30, 2022.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="HD3EFCF04A7CB48DABBA2B06D936AC433"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1FD63F66632B4AFB927A3EDC329C9F46" style="OLC"> <subsection id="H2151AA874FDA4000A8D7403399AA2DCE"><enum>(g)</enum><header>Technical assistance</header><text>The Attorney General shall direct the Office of Justice Programs, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Federal Bureau of Investigation to—</text> 
<paragraph id="H1AFF4236F70C434DB9688D3B3A1399A6"><enum>(1)</enum><text>assist States that are not currently eligible for grants under this section to achieve compliance with all eligibility requirements; and</text> </paragraph> <paragraph id="HF29648AFDA9F4FCF89FD51C4946879CE"><enum>(2)</enum><text>provide technical assistance and training services to grantees under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
<section id="HE30FBAF706D34562A5676684A16B7016"><enum>4.</enum><header>Reauthorization of the National Criminal History Improvement Program</header> 
<subsection id="HE7174969AD2B470AB60BB3A27A45295D"><enum>(a)</enum><header>State grant program for criminal justice identification, information, and communication</header><text>Section 102 of the Crime Identification Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/34/40301">34 U.S.C. 40301</external-xref>) is amended—</text> <paragraph id="HEBCB28CFAA964D3C9ED37EBBE968852E"><enum>(1)</enum><text>in subsection (a)(3)—</text> 
<subparagraph id="H13F430D40C1E4275A54646DD68FCA95C"><enum>(A)</enum><text>by redesignating subparagraphs (C), (D), and (E) as subparagraphs (D), (E), and (F), respectively; and</text> </subparagraph> <subparagraph id="H1C63744CE18A442E9F7A85994895B42D"><enum>(B)</enum><text>by inserting after subparagraph (B) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC1B8CC65F3AD4CAF8D036D4BCC0A5311" style="OLC"> 
<subparagraph id="H330EBB25C1414A2B8EE1C7FF503C11F3"><enum>(C)</enum><text>identification of all individuals who have been convicted of a crime punishable by imprisonment for a term exceeding 1 year</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="HF651779C57524A598E3780A6681EB084"><enum>(2)</enum><text>in subsection (b)(6)—</text> 
<subparagraph id="H69FE3B6515AD4097ADCA4AFB54273D3B"><enum>(A)</enum><text>by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901(b)</external-xref>)</quote>; and</text> </subparagraph> <subparagraph id="H9A099D41B80744E68FA1D5FF56439DCF"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, including through increased efforts to pre-validate the contents of felony conviction records and domestic violence records to expedite eligibility determinations, and measures and resources necessary to establish and achieve compliance with an implementation plan under section 107 of the NICS Improvement Amendments Act of 2007</quote>;</text> </subparagraph></paragraph>
<paragraph id="HEE6B6D3F7DAD458FAFCC094D64525EF3"><enum>(3)</enum><text>in subsection (d), by inserting after <quote>unless</quote> the following: <quote>the State has achieved compliance with an implementation plan under section 107 of the NICS Improvement Amendments Act of 2007 or</quote>; and</text> </paragraph> <paragraph id="HCA746F4D71E24E6EA34A8B6E0A3B58D0"><enum>(4)</enum><text>in subsection (e)(1), by striking <quote>2002 through 2007</quote> and inserting <quote>2018 through 2022</quote>.</text> </paragraph></subsection>
<subsection id="H8DEA3016323340FF91871369D2A8F0F7"><enum>(b)</enum><header>Grants for the improvement of criminal records</header><text>Section 106(b)(1) of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40302">34 U.S.C. 40302(1)</external-xref>) is amended—</text> <paragraph id="H7AB8672B611C45C8A30B60858C5A0326"><enum>(1)</enum><text>in the matter preceding subparagraph (A)—</text> 
<subparagraph id="H3301FB6FC6094275880DEAE6E1544D4A"><enum>(A)</enum><text>by striking <quote>as of the date of enactment of this Act</quote> and inserting <quote>, as of the date of enactment of the <short-title>Fix NICS Act of 2017</short-title>,</quote>; and</text> </subparagraph> <subparagraph id="H07B747228A364DC8AFDF0DED509941A9"><enum>(B)</enum><text>by striking <quote>files,</quote> and inserting the following: <quote>files and that will utilize funding under this subsection to prioritize the identification and transmittal of felony conviction records and domestic violence records,</quote>;</text> </subparagraph></paragraph>
<paragraph id="H776A4731FD2444F199074A906B23E464"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text> </paragraph> <paragraph id="H2BAFACEA8B594C5C8206853087B508FB"><enum>(3)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="H1BC1351725194B5CB3C111BCDF08E026"><enum>(A)</enum><text>by striking <quote>upon establishment of the national system,</quote>; and</text> </subparagraph> <subparagraph id="H7F3F233828F248EBAD3BFD9E9C59A27C"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph></paragraph>
<paragraph id="H25417FDECECA4387A50C3E89D615EF7C"><enum>(4)</enum><text>by adding at the end the following—</text> <quoted-block display-inline="no-display-inline" id="H3BFBD9965C614655AF0F93CB50791193" style="OLC"> <subparagraph id="HEAF0FDD142B24826AE4835B53BDBD89C"><enum>(D)</enum><text>to establish and achieve compliance with an implementation plan under section 107 of the NICS Improvement Amendments Act of 2007.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
<section id="H5440068E00484954BF89AA97666DE93F"><enum>5.</enum><header>Improving information sharing with the States</header> 
<subsection id="H7541F66DFE714D2E908F350CFB30E864"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the NICS Improvement Amendments Act of 2007 (34 U.S. 40911 et seq.) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H60FDB16770E545E888F201D397BBE113" style="OLC"> <section id="HFE8F0CA113B04B94A3B10D9E48CD1E1A"><enum>107.</enum><header>Implementation plan</header> <subsection id="HF469D2F945E9487FA418D28DED67B3F1"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Fix NICS Act of 2017</short-title>, the Attorney General, in coordination with the States and Indian tribal governments, shall establish, for each State or Indian tribal government, a plan to ensure maximum coordination and automation of the reporting or making available of appropriate records to the National Instant Criminal Background Check System established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) and the verification of the accuracy of those records during a 4-year period specified in the plan. The records shall be limited to those of an individual described in subsection (g) or (n) of section 922 of title 18, United States Code.</text> </subsection>
<subsection id="H34909FEDE9814F24970716E80B448F35"><enum>(b)</enum><header>Benchmark requirements</header><text>Each plan established under this section shall include annual benchmarks to enable the Attorney General to assess the implementation of the plan, including—</text> <paragraph id="H033C550F469746DE8D2B0DB2797279D4"><enum>(1)</enum><text>qualitative goals and quantitative measures; and</text> </paragraph>
<paragraph id="H5018DC355ACB4AB098B7E521BA83978A"><enum>(2)</enum><text>a needs assessment, including estimated compliance costs.</text> </paragraph></subsection> <subsection id="HB43FED8620894D6EA05C27D15E7C7744"><enum>(c)</enum><header>Compliance determination</header><text>Not later than the end of each fiscal year beginning after the date of the establishment of an implementation plan under this section, the Attorney General shall determine whether each State or Indian tribal government has achieved substantial compliance with the benchmarks included in the plan.</text> </subsection>
<subsection id="H704F5E8E3568440D942DCE5E8EEA504A"><enum>(d)</enum><header>Accountability</header><text>The Attorney General—</text> <paragraph id="H441D600971004D5EA7891D40F1F8C9A7"><enum>(1)</enum><text>shall disclose and publish, including on the website of the Department of Justice—</text> 
<subparagraph id="HE030FE34CA5C470D97D7D8BE4FA51F2C"><enum>(A)</enum><text>the name of each State or Indian tribal government that received a determination of failure to achieve substantial compliance with an implementation plan under subsection (c) for the preceding fiscal year; and</text> </subparagraph> <subparagraph id="HCD3B2CFA157A4FE2960FABE615601CFB"><enum>(B)</enum><text>a description of the reasons for which the Attorney General has determined that the State or Indian tribal government is not in substantial compliance with the implementation plan, including, to the greatest extent possible, a description of the types and amounts of records that have not been submitted; and</text> </subparagraph></paragraph>
<paragraph id="H48197E03B55640D98841CED0C302F0DA"><enum>(2)</enum><text>if a State or Indian tribal government described in paragraph (1) subsequently receives a determination of substantial compliance, shall—</text> <subparagraph id="H0B704673EAAB4F57AFFD9FCA001DD5E6"><enum>(A)</enum><text>immediately correct the applicable record; and</text> </subparagraph>
<subparagraph id="H25645B9951534913AF567A3823CE859B"><enum>(B)</enum><text>not later than 3 days after the determination, remove the record from the website of the Department of Justice and any other location where the record was published.</text> </subparagraph></paragraph></subsection> <subsection id="H31193670BE0348F291362EB643FCAD35"><enum>(e)</enum><header>Incentives</header><text>For each of fiscal years 2018 through 2022, the Attorney General shall give affirmative preference to all Bureau of Justice Assistance discretionary grant applications of a State or Indian tribal government that received a determination of substantial compliance under subsection (c) for the fiscal year in which the grant was solicited.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
