 <section commented="no" display-inline="no-display-inline" id="H884D58D82F4F43D2A4C8D3D2C4923549" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Harmful Algal Bloom and Hypoxia Research and Control Amendments Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="HB59BB8CACE6B42ACBF8CDBBA4592B79D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">References to the Harmful Algal Bloom and Hypoxia Research and Control Act of 1998</header><text display-inline="no-display-inline">Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Harmful Algal Bloom and Hypoxia Research and Control Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/4001">33 U.S.C. 4001</external-xref> et seq.).</text>
 </section><section commented="no" display-inline="no-display-inline" id="H7F77EC71C47849ECBB2D6F45CBA3CC46" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Inter-Agency Task Force</header><text display-inline="no-display-inline">Section 603(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/4001">33 U.S.C. 4001(a)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HFC3C70991EC744CE99829C8A55A8F21E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC574F221867941039A3E36B53FF1590D"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (13) as paragraph (14); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00E124D494C64C8AB60B092598AA4249"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (12) the following:</text>

 <paragraph commented="no" display-inline="no-display-inline" id="H5E82AA42DC8B49B9BADB05B9CC8B051B"><enum>(13)</enum><text display-inline="yes-display-inline">the Army Corps of Engineers; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" display-inline="no-display-inline" id="HEDC7203579BA47C2838E8CE45D2D2BC1" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Scientific assessments of freshwater harmful algal blooms</header><text display-inline="no-display-inline">Section 603 (<external-xref legal-doc="usc" parsable-cite="usc/33/4001">33 U.S.C. 4001</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H92ED1817F5144ECDB121BB7979D22664"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (f);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H459BE1EA99624D08BB1B11892B588D73"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (g), (h), (i), and (j) as subsections (f), (g), (h), and (i), respectively; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB46C6D975C224E5C84E4960CAA1F130C"><enum>(3)</enum><text display-inline="yes-display-inline">by amending subsection (g) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HC59202AA6992499FAE38BA1393E4B988" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="HB734FC1CCEF8426C9FF6C6FE4A778804"><enum>(g)</enum><header display-inline="yes-display-inline">Scientific assessments of marine and freshwater harmful algal blooms</header><text display-inline="yes-display-inline">Not less than once every 5 years the Task Force shall complete and submit to Congress a scientific assessment of harmful algal blooms in United States coastal waters and freshwater systems. Each assessment shall examine both marine and freshwater harmful algal blooms, including those in the Great Lakes and upper reaches of estuaries, those in freshwater lakes and rivers, and those that originate in freshwater lakes or rivers and migrate to coastal waters.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HB3DC766AD4FB4781891605F249E0FCCD" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">National Harmful Algal Bloom and Hypoxia Program</header>
 <subsection commented="no" display-inline="no-display-inline" id="HAFD4D794D8344817BD735255FB73E598"><enum>(a)</enum><header display-inline="yes-display-inline">Program duties</header><text display-inline="yes-display-inline">Section 603A(e) (<external-xref legal-doc="usc" parsable-cite="usc/33/4002">33 U.S.C. 4002(e)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HA88D8945711D4E8E9F8F71A881ECAC99"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, including to local and regional stakeholders through the establishment and maintenance of a publicly accessible Internet website that provides information as to Program activities completed under this section</quote> after <quote>Program</quote>;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H339D79311B0B4A8C85B14472857C8F02"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H1D2166C9F60C4EB6A136E1CBB5F7188E"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8794BD68C99D4E66BB35DB5FF232F18D"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting <quote>and</quote> after the semicolon at the end; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF69F834563D743D0A94910D7C044D276"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF3B61439E2FB4966B3087965D5753DD3" style="OLC">
 <subparagraph commented="no" display-inline="no-display-inline" id="HFAB0AF99955C4641AAC1D729D9697BF4"><enum>(D)</enum><text display-inline="yes-display-inline">to accelerate the utilization of effective methods of intervention and mitigation to reduce the frequency, severity, and impacts of harmful algal bloom and hypoxia events;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EDFD6530EC44F6C9B6E39498E1AE259"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>and work cooperatively with</quote> and inserting <quote>, and work cooperatively to provide technical assistance to,</quote>; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H794D5D0DA9044B47873B6747FFC3A7A4"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (7)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H508CEC2651A94D31847DFC6FEA7B11B4"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>and extension</quote> after <quote>existing education</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H03498A21D9ED4F26A8B86ABB57CCB60D"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>intervention,</quote> after <quote>awareness of the causes, impacts,</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H87B422A71960446CA8C47731943E8533"><enum>(b)</enum><header display-inline="yes-display-inline">National Oceanic and Atmospheric Administration activities</header><text display-inline="yes-display-inline">Section 603A(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/4002">33 U.S.C. 4002(f)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HABAD65A4CF4F45B4936041BCC9446D38"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>, which shall include unmanned systems,</quote> after <quote>infrastructure</quote>;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B0E910A2A41427287B002EBFFEF2DE3"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40DDF57BC549479084B80EBA344747E4"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6)(C), by striking the period at the end and inserting a semicolon; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H319E4F7FFBF44F688B294142F320FE30"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HB40482EBECCA4899936FA520C217EFC4" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H6B24430C14D0477BA3E087974CBD3E62"><enum>(7)</enum><text display-inline="yes-display-inline">use cost effective methods in carrying out this Act; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4489A7CE2FCF41DEA0B2617DAE626C03"><enum>(8)</enum><text display-inline="yes-display-inline">develop contingency plans for the long-term monitoring of hypoxia.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H1F0A9F7AAB844FD497998CDED6C6DF6F" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Consultation required</header><text display-inline="no-display-inline">Section 102 of the Harmful Algal Bloom and Hypoxia Amendments Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/33/4001a">33 U.S.C. 4001a</external-xref>) is amended by striking <quote>the amendments made by this title</quote> and inserting <quote>the Harmful Algal Bloom and Hypoxia Research and Control Act of 1998</quote>.</text>
		</section><section id="H600029C51E104284A444388FBB780521"><enum>7.</enum><header>Hypoxia or harmful algal bloom of national significance</header>
			<subsection id="H2D80DA944CCD4BC9A7908BDBAE643CE4"><enum>(a)</enum><header>Relief</header>
 <paragraph id="HD6A6446071D34E5AA9ED6C37C5667721"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Upon a determination under subsection (b) that there is an event of national significance, the appropriate Federal official is authorized to make sums available to the affected State or local government for the purposes of assessing and mitigating the detrimental environmental, economic, subsistence use, and public health effects of the event of national significance.</text>
 </paragraph><paragraph id="H385A3DC2C4C347F6B35243973A78BD18"><enum>(2)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of any activity carried out under this subsection for the purposes described in paragraph (1) may not exceed 50 percent of the cost of that activity.</text>
 </paragraph><paragraph id="H81B9462B5CEA4528A22E0A1CF8983828"><enum>(3)</enum><header>Donations</header><text>Notwithstanding any other provision of law, an appropriate Federal official may accept donations of funds, services, facilities, materials, or equipment that the appropriate Federal official considers necessary for the purposes described in paragraph (1). Any funds donated to an appropriate Federal official under this paragraph may be expended without further appropriation and without fiscal year limitation.</text>
				</paragraph></subsection><subsection id="H5F327D76D6D24F73AC4ABBD1FE2401BA"><enum>(b)</enum><header>Determinations</header>
 <paragraph id="HCF1E21C04AE942B89DDA84902CBDDC50"><enum>(1)</enum><header>In general</header><text>At the discretion of an appropriate Federal official, or at the request of the Governor of an affected State, an appropriate Federal official shall determine whether a hypoxia or harmful algal bloom event is an event of national significance.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13DFAAA9D52F4F43A7B067218301C4F6"><enum>(2)</enum><header>Considerations</header><text>In making a determination under paragraph (1), the appropriate Federal official shall consider the toxicity of the harmful algal bloom, the severity of the hypoxia, its potential to spread, the economic impact, the relative size in relation to the past 5 occurrences of harmful algal blooms or hypoxia events that occur on a recurrent or annual basis, and the geographic scope, including the potential to affect several municipalities, to affect more than 1 State, or to cross an international boundary.</text>
 </paragraph></subsection><subsection id="HE0A60B7C33814DD3B72B5F2CD97272A8"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H6E41595B3AB948AE8EB4B841C9116D06"><enum>(1)</enum><header>Appropriate Federal official</header><text>The term <term>appropriate Federal official</term> means—</text>
 <subparagraph id="HC1AA426AA45D49D58462A69A695A33BE"><enum>(A)</enum><text>in the case of a marine or coastal hypoxia or harmful algal bloom event, the Under Secretary of Commerce for Oceans and Atmosphere; and</text>
 </subparagraph><subparagraph id="H0F71858778F641CDAE0353EF014D4C96"><enum>(B)</enum><text>in the case of a freshwater hypoxia or harmful algal bloom event, the Administrator of the Environmental Protection Agency.</text>
 </subparagraph></paragraph><paragraph id="H27DD459823F74A32A2A02CEFDD1D41AB"><enum>(2)</enum><header>Event of national significance</header><text>The term <term>event of national significance</term> means a hypoxia or harmful algal bloom event that has had or will likely have a significant detrimental environmental, economic, subsistence use, or public health impact on an affected State.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7874DAC671EF47BA8288CCA968A34705"><enum>(3)</enum><header>Hypoxia or harmful algal bloom event</header><text>The term <term>hypoxia or harmful algal bloom event</term> means the occurrence of hypoxia or a harmful algal bloom as a result of a natural, anthropogenic, or undetermined cause.</text>
 </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HBE38FA351037496BA4F23D6F6F48798E" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">Section 609(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/4009">33 U.S.C. 4009(a)</external-xref>) is amended by inserting <quote>, and $22,000,000 for each of fiscal years 2019 through 2023</quote> before the period at the end.</text> </section></legis-body></bill>
