			 recipients to create, maintain, and improve digital fabrication
			 laboratories, and for other purposes.</official-title></form>
	<legis-body id="H31832E2A41274DE8BE6EAD959221F3D9" style="OLC">
 <section id="HFD9D805F5D5945D7B4B46BD553D7DE12" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fab Lab Classroom Modernization Act</short-title></quote>.</text> </section><section id="H2E38CA14CEA9477D9C678A825B93FFBE"><enum>2.</enum><header>Grant program</header> <subsection id="H32220F5C026242D2A31D2103C2EC933C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts made available pursuant to <internal-xref idref="HBEBF9ABAF70B49BE9799A6C7E7B4C10F" legis-path="8.">section 9</internal-xref> for any fiscal year, the Secretary shall award a grant to each State with an approved application under <internal-xref idref="HFB85E989E2E047C797D312C25C510116" legis-path="2.">section 3</internal-xref>.</text>
 </subsection><subsection id="HFBC7318368134C1EA68401B524229E30"><enum>(b)</enum><header>Grant frequency</header><text display-inline="yes-display-inline">The Secretary may not award more than 1 grant under this Act to a State for a fiscal year.</text> </subsection><subsection id="H16B8FC45D2FA4100B5CE160C7C6B85DB"><enum>(c)</enum><header>Award amount limit</header><text display-inline="yes-display-inline">No grant awarded under this Act may exceed $200,000.</text>
			</subsection></section><section id="HFB85E989E2E047C797D312C25C510116"><enum>3.</enum><header>Application</header>
 <text display-inline="no-display-inline">Each State desiring a grant under this Act shall submit an application to the Secretary at such time and in such manner as the Secretary may require that shall include—</text>
 <paragraph id="HC7DD6B3DB5FC48DAA5BE143B500C8F99"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the State’s proposed or existing competitive subgrant program;</text> </paragraph><paragraph id="H2D009727402646D99F3F84F624D8D4F6"><enum>(2)</enum><text display-inline="yes-display-inline">a description of how the State’s program will comply or does comply with the requirements set forth in <internal-xref idref="HD64E228DD6264BA3BC0A35A10D8E4B9C" legis-path="3.">section 4</internal-xref>; and</text>
 </paragraph><paragraph id="H61E67B9146584ABF858729BB20F5A941"><enum>(3)</enum><text>any other information the Secretary may require.</text> </paragraph></section><section id="HD64E228DD6264BA3BC0A35A10D8E4B9C"><enum>4.</enum><header>Use of funds</header> <subsection id="HE476051A99784D88BF7EEDC89500A67D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State that receives a grant under this Act shall use the funds to—</text>
 <paragraph id="H3CCE6C29A4C941CDBEDBBCCE59FB208E"><enum>(1)</enum><text display-inline="yes-display-inline">establish a program that complies with the requirements set forth in this section under which the State awards, on a competitive basis, subgrants to eligible entities; or</text>
 </paragraph><paragraph id="H33066C6EA4C6484591920EC444AEA6ED"><enum>(2)</enum><text>expand an existing competitive subgrant program that complies with such requirements.</text> </paragraph></subsection><subsection commented="no" id="H3573356115BF4797A6D73C2E73FA0734"><enum>(b)</enum><header>Limitation; priority</header> <paragraph id="HFF96F5F4362D4B1085FD81CA987CE765"><enum>(1)</enum><header>Limitation</header><text>A State that receives a grant under this Act may not use any of such grant to pay any administrative costs associated with carrying out <internal-xref idref="HE476051A99784D88BF7EEDC89500A67D" legis-path="3.(a)">subsection (a)</internal-xref>.</text>
 </paragraph><paragraph id="HA052E6C6085A4F30AE1F55A8089BB1BD"><enum>(2)</enum><header>Priority</header><text>In awarding subgrants under this section, a State shall use not less than 15 percent of the grant received under this Act to award such subgrants to eligible entities in rural areas, except that a State may apply to the Secretary for a waiver of the requirement under this paragraph.</text>
 </paragraph></subsection><subsection id="H2BE57F1D4DFE4BB4866D8A41F39AB945"><enum>(c)</enum><header>Subgrant frequency</header><text display-inline="yes-display-inline">A State may not award more than 1 subgrant under this section to an eligible entity for a fiscal year.</text>
 </subsection><subsection id="HE4F2EE02385E4880A2FB30F53B6014FB"><enum>(d)</enum><header>Subgrant amount limits</header><text display-inline="yes-display-inline">A subgrant may not be awarded under this section in an amount greater than—</text> <paragraph id="HFAB471AA88E34CDDAB613CFA5F191E32"><enum>(1)</enum><text>in the case of an eligible entity described in <internal-xref idref="HBB58998C42EF44F78B941DE69040D963" legis-path="8.(1)(A)">section 10(1)(A)</internal-xref>, $25,000; or</text>
 </paragraph><paragraph id="H9677203D0427489CBD21EDE885D5EC46"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an eligible entity described in <internal-xref idref="HEAAEC748884545E19D01504F34C4031B" legis-path="8.(1)(B)">section 10(1)(B)</internal-xref>, $50,000.</text> </paragraph></subsection><subsection display-inline="no-display-inline" id="HCA71EAD8EEBF42778502F9B07961F8BA"><enum>(e)</enum><header>Use of subgrant</header> <paragraph id="H67B0C02EB6F445DCBDE756F72CF80BEF"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a subgrant under this section shall use the subgrant for the purposes of—</text>
 <subparagraph id="H706334AA130C42088D7036DF1027584B"><enum>(A)</enum><text>purchasing equipment for use in a digital fabrication laboratory; or</text> </subparagraph><subparagraph id="HCE0ADC9B44004C01B260389688B323BC"><enum>(B)</enum><text>providing professional development that relates to the incorporation of the digital fabrication laboratory into curriculum instruction.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HAA140EA980C4407192AD01729AAB64BC"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">An eligible entity that receives a subgrant under this section may not use any of such subgrant to pay any administrative costs associated with carrying out <internal-xref idref="H67B0C02EB6F445DCBDE756F72CF80BEF" legis-path="3.(e)(1)">paragraph (1)</internal-xref>.</text>
 </paragraph></subsection><subsection commented="no" id="HB115BA22006849249DFF7BC5BF103EEB"><enum>(f)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires a subgrant under this section shall, at such time and in such manner as the State that awards the subgrant may require, submit an application to such State that includes—</text>
 <paragraph id="H87071854946A4020B8A7350D0EAAC661"><enum>(1)</enum><text>an assurance that the eligible entity will adopt a policy that any digital fabrication laboratory equipped using subgrant funds shall be used predominantly for instructional and educational purposes by students enrolled in one of the eligible entity’s elementary or secondary schools; and</text>
 </paragraph><paragraph id="H563185F8FBBB40EB8864912ABF3E7023"><enum>(2)</enum><text>a description of—</text> <subparagraph id="H932DE564C3D646D48C68DE4B6411C269"><enum>(A)</enum><text>how the eligible entity plans to use the subgrant;</text>
 </subparagraph><subparagraph commented="no" id="HFA335D0248D94256832A3DACCED740F3"><enum>(B)</enum><text>how ready the eligible entity is to purchase equipment for a digital fabrication laboratory;</text> </subparagraph><subparagraph commented="no" id="H93946DB2281C43FB90FB3463526AE3DD"><enum>(C)</enum><text>the eligible entity’s long-term plan for the digital fabrication laboratory;</text>
 </subparagraph><subparagraph commented="no" id="H03B3D4167DC5400586EE003B824B97B0"><enum>(D)</enum><text>how the eligible entity will incorporate the digital fabrication laboratory into curriculum instruction;</text>
 </subparagraph><subparagraph id="HDBC0365051FB46EEB8CD400AC48ADF2C"><enum>(E)</enum><text>how constructing the digital fabrication laboratory aligns with the eligible entity’s academic goals;</text>
 </subparagraph><subparagraph commented="no" id="H0B2DB16538234CDD8F1B05A34532D794"><enum>(F)</enum><text>the extent to which the eligible entity plans to partner with local businesses and other community participants;</text>
 </subparagraph><subparagraph commented="no" id="HD9FC64D233314FBFA9F523549EC68FD6"><enum>(G)</enum><text>the eligible entity’s financial need;</text> </subparagraph><subparagraph commented="no" id="H19C905D851AF4E94B3CFCFA4DF05C156"><enum>(H)</enum><text>how, if applicable, the eligible entity has utilized previous subgrant awards; and</text>
 </subparagraph><subparagraph commented="no" id="HAACC059EC47E4B89AAB20DA7EFC5B616"><enum>(I)</enum><text>any other information the State may require.</text> </subparagraph></paragraph></subsection><subsection id="H35FCFA4A318E4475B2A1207271ADF9AC"><enum>(g)</enum><header>Matching requirement</header> <paragraph id="HCEA6629727F74BDC98189472C9AC88D6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="HCEA6629727F74BDC98189472C9AC88D6" legis-path="3.(f)(1)">paragraph (2)</internal-xref>, an eligible entity receiving a subgrant under this section shall provide, from non-Federal sources, an amount equal to the amount of the subgrant (which may be provided in cash or in-kind) to carry out the activities supported by the subgrant, except that an eligible may use up to 5 percent of such amount for administrative costs associated with carrying out such activities.</text>
 </paragraph><paragraph id="H3D8AD786FA134F1CAB0A482D1C1DCD8B"><enum>(2)</enum><header>Waiver option authorized</header><text display-inline="yes-display-inline">A State awarding a subgrant under this section may waive all or part of the matching requirement described in <internal-xref idref="HCEA6629727F74BDC98189472C9AC88D6" legis-path="3.(f)(1)">paragraph (1)</internal-xref> for an eligible entity if the State determines that applying the matching requirement would—</text>
 <subparagraph commented="no" id="H25A9CA5D89BB4A5CA8DFF84CB75434D4"><enum>(A)</enum><text>result in a serious financial hardship for the eligible entity; or</text> </subparagraph><subparagraph id="HD8E6F185A27346A0A671A797F67AA1A0"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise be inappropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="H613B27E1CFD546C9ABB492A928BF1B69"><enum>(h)</enum><header>Reporting requirement</header>
 <paragraph id="HE89E1647890D4B699ED27C1FED8FB61B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">At the end of each subgrant period, an eligible entity receiving a subgrant under this section shall submit, to the State that awards the subgrant, a performance report that documents any information that the Secretary determines to be appropriate.</text>
 </paragraph><paragraph id="H271F919C9F464A8CA67BAF43F6D106B8"><enum>(2)</enum><header>Performance report form</header><text display-inline="yes-display-inline">The performance report described in <internal-xref idref="HE89E1647890D4B699ED27C1FED8FB61B" legis-path="3.(g)(1)">paragraph (1)</internal-xref> shall be submitted on a form created by the State that awards the subgrant and approved by the Secretary before being used.</text>
 </paragraph></subsection></section><section id="HC424AD6AA95745A082C4D6281DFD8D93"><enum>5.</enum><header>Matching requirement</header><text display-inline="no-display-inline">Each State that receives a grant under this Act shall provide, from non-Federal sources, an amount equal to the amount of the grant to carry out the activities described in <internal-xref idref="HD64E228DD6264BA3BC0A35A10D8E4B9C" legis-path="3.">section 3</internal-xref>.</text>
		</section><section display-inline="no-display-inline" id="H8E22F206E9A741C9AF95FA8B3E2BE5FB" section-type="subsequent-section"><enum>6.</enum><header>State reports</header>
 <text display-inline="no-display-inline">Each State that receives a grant under this Act shall—</text> <paragraph id="H01BC7D0746B04BE89D9DE2D5B0149297"><enum>(1)</enum><text display-inline="yes-display-inline">at the end of the 1-year period that begins on the date the State receives the grant, submit a report to the Secretary containing any information the Secretary determines to be appropriate; and</text>
 </paragraph><paragraph id="H480C31C57BA544B5ABA6FA9938A77DEE"><enum>(2)</enum><text>in the case in which the State does not receive a grant for the next fiscal year following the fiscal year for which the grant was received, submit a report to the Secretary containing any information the Secretary determines to be appropriate at the end of a 2-year period that begins on the date the State receives the grant.</text>
			</paragraph></section><section id="H20C5C48BCCB24694B9FC670B896761B1"><enum>7.</enum><header>Evaluation</header>
 <subsection display-inline="no-display-inline" id="H8D339D3E6A594D61869F1AC0046ED309"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish an evaluation program to determine the efficacy of the grant program established by this Act that shall commence 18 months after the first grant under this Act is awarded.</text>
 </subsection></section><section id="H4C83D5B3633D46A583DC11DC9D8626B1"><enum>8.</enum><header>Sunset</header><text display-inline="no-display-inline">The Secretary may not award grants under this Act after the end of the 5-year period that begins on the date the Secretary awards the first grant under this Act.</text>
		</section><section id="HBEBF9ABAF70B49BE9799A6C7E7B4C10F"><enum>9.</enum><header>Authorization of appropriations</header>
 <subsection display-inline="no-display-inline" id="H226C8A07694E4FC7A2403A6CEC0A4C5A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated $10,000,000 for each of the fiscal years 2019 through 2023 to carry out this Act.</text>
 </subsection><subsection commented="no" id="HDBE7801197CE4C039089881149D06D9C"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">Of the amounts appropriated pursuant to <internal-xref idref="H226C8A07694E4FC7A2403A6CEC0A4C5A" legis-path="7.(a)">subsection (a)</internal-xref> for a fiscal year, the Secretary may not use more than 5 percent to pay any administrative costs associated with carrying out <internal-xref idref="HFD9D805F5D5945D7B4B46BD553D7DE12" legis-path="1.">section 1</internal-xref>.</text>
 </subsection></section><section id="HD84C99EC71484E73A3A9475498E139AA"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HB6D822FB139C4B93A9F2160C08BC4D84"><enum>(1)</enum><header>Digital fabrication laboratory</header><text>The term <quote>digital fabrication laboratory</quote> means a high-technology workspace that is equipped with computer-controlled additive and subtractive manufacturing components such as 3-dimensional printers, laser engravers, computer numerical control routers, and plasma cutters.</text>
 </paragraph><paragraph id="HC33EBBC4A4A549C2A9FBD26F580DF702"><enum>(2)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text> <subparagraph id="HBB58998C42EF44F78B941DE69040D963"><enum>(A)</enum><text>a local educational agency; or</text>
 </subparagraph><subparagraph id="HEAAEC748884545E19D01504F34C4031B"><enum>(B)</enum><text>a consortium of two or more local educational agencies.</text> </subparagraph></paragraph><paragraph id="H9F17DB01D1024B2294E24AAB737FA02F"><enum>(3)</enum><header>ESEA definitions</header><text display-inline="yes-display-inline">The terms <quote>elementary school</quote>, <quote>local educational agency</quote>, <quote>professional development</quote>, and <quote>secondary school</quote> have the meanings given the terms, respectively, in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="HBA83493779FF413ABC9F9A99EA0C3B6E"><enum>(4)</enum><header>Existing competitive subgrant program</header><text display-inline="yes-display-inline">The term <quote>existing competitive subgrant program</quote> means a competitive subgrant program that is being carried out by a State as of the date the State applies for a grant under this Act and under which the State awards subgrants to eligible entities to purchase equipment to be used in a digital fabrication laboratory or provide professional development that relates to the incorporation of the digital fabrication laboratory into curriculum instruction.</text>
 </paragraph><paragraph id="HEB9D2949FC504C16A6D64CF2653DB713"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Education.</text> </paragraph><paragraph id="HB7621DA9B41F475EBEB132A837426616"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the 50 States and the District of Columbia.</text>
