			 requests for funding projects or programs, and for other purposes.</official-title></form>
	<legis-body id="H141B4F52AF3043EFB076E6ADB81ABF65" style="OLC">
 <section id="H2EF3E4A18B2D4835AF93A7D5290A69E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Missed Opportunities in Transportation Act of 2017</short-title></quote>.</text> </section><section id="H832A81F88C30483C8AA99C94C82568BC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H3A2AC9B01A2D4428AED8E5E0C58772C7"><enum>(1)</enum><text display-inline="yes-display-inline">the United States relies on an integrated, multimodal system of transportation to facilitate the movement of people and goods across the Nation;</text>
 </paragraph><paragraph id="HAB0BD00707CB4BC5A536765E37E3D90A"><enum>(2)</enum><text>the United States has a history of investing in forward-thinking ideas to improve transportation;</text> </paragraph><paragraph id="HE8844563FC3946B09D863892F83487FA"><enum>(3)</enum><text>Congress has a duty to do all it can to improve transportation in the United States;</text>
 </paragraph><paragraph id="H87C349811CE74D6DAECAA43EF7E45DD7"><enum>(4)</enum><text>both Congress and the States have failed to meet the needs of the American people in recent years;</text> </paragraph><paragraph id="H68E17146DAF04C56A87F33D8C242DF21"><enum>(5)</enum><text>inflation-adjusted public spending on transportation infrastructure has declined over the past decade;</text>
 </paragraph><paragraph id="H6F7475FB4A3346CAA0418554B3779DFD"><enum>(6)</enum><text>Americans are suffering from the consequences of that inaction;</text> </paragraph><paragraph id="H3B4C2FC0B9224C1A8013B18DAEFFDBC8"><enum>(7)</enum><text>investment in transportation and infrastructure is vital to national security and prosperity;</text>
 </paragraph><paragraph id="HDA4FFD1D7F6F41C48527A495B3BB95F7"><enum>(8)</enum><text>failure to invest adequately in United States infrastructure will continue to impede economic growth and harm the health and competitiveness of the United States economy;</text>
 </paragraph><paragraph id="H6B1AC49B43B2450EB5E1D4338176BD44"><enum>(9)</enum><text>proposals to improve transportation in the United States exceed available funds;</text> </paragraph><paragraph id="H5EC229944B654CCE864C87EDE1ABF26F"><enum>(10)</enum><text>the American people deserve to be informed about and consider possible solutions for the gridlock and disrepair they experience every day; and</text>
 </paragraph><paragraph id="HCF0F24622C3E497B88A894E5BED4DB51"><enum>(11)</enum><text>Congress must have good information about potential projects for transportation modernization in order to make reasonable judgments about funding levels for transportation projects and research.</text>
			</paragraph></section><section id="H3649727F168A4A1381101828FDBB7926"><enum>3.</enum><header>Annual reporting on missed opportunities</header>
 <subsection id="HF6A03143BAD444C4A59761A2E693B291"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/3">Chapter 3</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1FF0E67FF8284D7CBC0A04B9DD86961C" style="USC"> <section id="HD2E5A12D61344F4596710A8823B01CDB"><enum>312.</enum><header>Annual reporting on missed opportunities</header> <subsection id="H548CB36C40554E97A0F4C51B7FDEAF1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31 of each year, the Secretary of Transportation shall submit to Congress a report on missed opportunities for each competitive or discretionary grant program administered by the Department of Transportation in the preceding fiscal year.</text>
 </subsection><subsection id="H334473FC93AE41419182C93E6677E9B3"><enum>(b)</enum><header>Contents</header><text>For each grant program described in subsection (a), the report shall detail the 10 individual applications, proposals, or requests for funding that—</text>
 <paragraph id="H154F122C59584A7E8D2E25100FDA3310"><enum>(1)</enum><text>were not funded or awarded, completely or partially; but</text> </paragraph><paragraph id="HD2DC4A414F044331A87DB287F3D851FB"><enum>(2)</enum><text>showed the greatest potential to improve transportation in the United States, according to the selection criteria and established goals of that grant program.</text>
 </paragraph></subsection><subsection id="H65511CB86A3E46D19CF20157030F2C50"><enum>(c)</enum><header>Reporting date flexibility</header><text display-inline="yes-display-inline">If a law requires an annual report to Congress with respect to a grant program described in subsection (a), the report on missed opportunities required under this section for that program may—</text>
 <paragraph id="HC2EE0F66C8D1454EAE2BF248C48EBF93"><enum>(1)</enum><text>be included in that annual report; and</text> </paragraph><paragraph id="HEE6BB6F291CE467AA7DA23BEAC995908"><enum>(2)</enum><text>be submitted on or before the date that annual report is due.</text>
 </paragraph></subsection><subsection id="HCAF4284E866649BCA6A2DA7F472B1C4F"><enum>(d)</enum><header>Public transparency</header><text display-inline="yes-display-inline">Upon submission of a report on missed opportunities to Congress under this section, the Secretary shall make the report available to the public on an internet website of the Department of Transportation in a manner that is user friendly and able to be searched and downloaded by users of the website.</text>
 </subsection><subsection id="H4196B486828444DF816499F90BB8B6AF"><enum>(e)</enum><header>Trade secrets and confidential information</header><text>Nothing in this section authorizes the Secretary to disclose any information that is a trade secret or confidential information subject to section 552(b)(4) of title 5 or section 1905 of title 18.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H1A63598C9B3C48EFA1025AFD8DBE96C8"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/3">chapter 3</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/311">section 311</external-xref> the following:</text>
