 <section id="H0F72AA8DBF15477C97BB1956B396DF3D"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>) is amended—</text>
 <paragraph id="HD4BAFDF288924C6780D610924BD4CE5F"><enum>(1)</enum><text>by redesignating paragraphs (9) through (18) and paragraphs (19) through (34) as paragraphs (10) through (19) and paragraphs (21) through (36), respectively;</text>
 </paragraph><paragraph id="H70FCD26361E24E97AFA50F5207D92F75"><enum>(2)</enum><text>by inserting after paragraph (8) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H356B76C1A26042CDA4BF3D813AEB3A20" style="OLC"> <paragraph id="H933E390FC0C8414BB5B2419E28884F1A"><enum>(9)</enum><header>Community partner</header><text display-inline="yes-display-inline">The term <term>community partner</term> means a nonprofit organization that has expertise in the planning and delivery of education, career training, and related programs, in forging coordination and cooperation between educators and other members of the community, in training educators and other deliverers of educational services, or in development and implementation of data systems that measure the progress of students, schools and institutions of higher education, and programs.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H35980599AF1A4066B519B4FD70E88731"><enum>(3)</enum><text>by inserting after paragraph (19) (as redesignated by paragraph (1)) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H73E9631E3828409AB5DB91C1C7692128" style="OLC"> <paragraph id="H44CC6DF67D3140058F4B323FB8B542D9"><enum>(20)</enum><header>Intermediary organization</header><text display-inline="yes-display-inline">The term <term>intermediary organization</term> means a nonprofit organization that has expertise in training, forging public-private partnerships, systems development, capacity-building, improving scalability, and evaluation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HF75B3DF09053446A8775215D8DDEA9D1"><enum>102.</enum><header>Attainment of 21st century skills</header>
 <subsection id="H673D06A5021C46C9B0B71B90E832ABC3"><enum>(a)</enum><header>Accountability</header><text display-inline="yes-display-inline">Section 113(b)(2)(C) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323(b)(2)(C)</external-xref>) is amended by inserting <quote>attainment of 21st century skills (such as critical thinking, problem-solving, communication, and collaboration) and</quote> after <quote>such as</quote>.</text>
 </subsection><subsection id="H0D5044DD5FE04B89BFF05C99BE0318B8"><enum>(b)</enum><header>Local and State reports</header><text display-inline="yes-display-inline">Section 113 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323</external-xref>) is further amended—</text>
 <paragraph id="HC998592CE7B34731B135525027EC0F32"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(4)(C)(ii)—</text> <subparagraph id="HE52CFAF46DD24B0086DD50F872F05D8B"><enum>(A)</enum><text>in subclause (I), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </subparagraph><subparagraph id="H0C06A0E63105435A88F51742D595F2E7"><enum>(B)</enum><text>in subclause (II), by striking the period and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="H63DD57BC27AD418B83FC36E03DD27BBD"><enum>(C)</enum><text>by inserting after subclause (II) the following new subclause:</text>

						</subparagraph></paragraph></subsection></section><section id="H2091194123134C4097E285AA928A6F5B"><enum>103.</enum><header>Inclusion of community partners and intermediary organizations in State and local plans</header>
 <subsection id="H54ED6D99F1B84037B4396AFE7006AA29"><enum>(a)</enum><header>State plan</header><text display-inline="yes-display-inline">Section 122 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2342">20 U.S.C. 2342</external-xref>) is amended—</text>
 <paragraph id="H5F29039420514EAC8EE5B383B0D7CBAB"><enum>(1)</enum><text>in subsection (b)(1)(A)(ix), by striking <quote>including parent and community organizations</quote> and inserting <quote>including parent and intermediary organizations and community partners</quote>;</text> </paragraph><paragraph id="HDC5267816BA14AEFBE36E0D7FFF30C10"><enum>(2)</enum><text>in subsection (c)(1)(A)—</text>
 <subparagraph id="H2519168E2595465ABC54C684BA3454F1"><enum>(A)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon; and</text> </subparagraph><subparagraph id="H2888CCE8DEB842DB8295AAC2C5021A96"><enum>(B)</enum><text>by inserting after clause (iv) the following new clauses:</text>

 <clause id="H3BB279970BA44418A4CEC970B212FB5B"><enum>(v)</enum><text display-inline="yes-display-inline">are carried out in partnership with one or more community partners, including through joint planning and implementation, shared professional development designed to improve the effectiveness of eligible recipient and community partner staff, development and implementation of shared data systems that support program improvement and the improvement of program outcomes, and the alignment and coordination of eligible recipient and community partner goals, activities, and training; and</text>
 </clause><clause id="H249B6E8ED59842E29D8E43022F778881"><enum>(vi)</enum><text>are carried out with the involvement of one or more intermediary organizations that will assist the eligible applicants by training staff, providing technical assistance that is designed to ensure continuous improvement, helping to ensure accountability for results, and helping to ensure that program funds flow quickly and effectively to effective service providers and activities;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H523E098584994B8FAA1A1DB14C714C68"><enum>(3)</enum><text>in subsection (c)(2)—</text> <subparagraph id="HC065BE630E9D4D38A3A55B69BD71947D"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </subparagraph><subparagraph id="HA98008D0186F4C0EBDE7BD0B63CAEA1F"><enum>(B)</enum><text>in subparagraph (G), by inserting <quote>and</quote> after the semicolon; and</text> </subparagraph><subparagraph id="H7D033781D6454ADCB553E2E8E30C9494"><enum>(C)</enum><text>by inserting after subparagraph (G) the following:</text>

 <subparagraph id="HFD607072827C47B6AF76141E24127877"><enum>(H)</enum><text display-inline="yes-display-inline">may be provided by a community partner or an intermediary organization;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection><subsection id="H3E5FB228A7E449A9AD2DF38ACE071705"><enum>(b)</enum><header>Local plan</header><text display-inline="yes-display-inline">Section 134(b) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2354">20 U.S.C. 2354(b)</external-xref>) is amended—</text>
 <paragraph id="HD7CF2E694B9E4B03BAC7B6B75AF3700C"><enum>(1)</enum><text>in paragraph (5), by inserting <quote>community partners, intermediary organizations,</quote> after <quote>labor organizations,</quote>;</text> </paragraph><paragraph id="H5B2F1C02C95244EFB5A74FEEF2FF702D"><enum>(2)</enum><text>in paragraph (11), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="HDE53F93813C44541998BD2859E7DD132"><enum>(3)</enum><text>in paragraph (12)(B), by striking the period and inserting a semicolon; and</text> </paragraph><paragraph id="H829B4B43E91A4A248228E5BC81F95EF5"><enum>(4)</enum><text>by inserting after paragraph (12) the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H7BD75DC9D8034F16949C7DE0EEDC2603" style="OLC">
 <paragraph id="H65B965C207924E0391F5C01973139433"><enum>(13)</enum><text display-inline="yes-display-inline">describe the data-sharing agreement or agreements that the eligible recipient agency has entered into with other agencies and organizations so as to provide for shared access to information on student progress and success (consistent with the requirements of subpart 4 of part C of the General Education Provisions Act), integrated planning and joint review of the data, and coordinated adjustments in program strategies and activities in response to changes in student needs or to new challenges;</text>
 </paragraph><paragraph id="H8D3055B510FB42DA8C929C7297110BFD"><enum>(14)</enum><text>describe how the eligible recipient will carry out its program under this part in partnership with one or more community partners, including through joint planning and implementation, shared professional development designed to improve the effectiveness of eligible recipient and community partner staff, development and implementation of shared data systems that support program improvement and the improvement of program outcomes, and the alignment and coordination of eligible recipient and community partner goals, activities, and training; and</text>
 </paragraph><paragraph id="H7977AE5F83C24E8EB15B1AE38D39B44B"><enum>(15)</enum><text>a description of how the eligible recipient will carry out its program under this part with the involvement of one or more intermediary organizations that will assist the eligible entity by training staff, providing technical assistance that is designed to ensure continuous improvement, helping to ensure accountability for results, and helping to ensure that program funds flow quickly and effectively to effective service providers and activities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HECF8FFFF9B0944B88C6996DD9EE87CC3"><enum>(c)</enum><header>Local use of funds</header><text display-inline="yes-display-inline">Section 135(b) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2355">20 U.S.C. 2355(b)</external-xref>) is amended—</text>
 <paragraph id="HEF9F40D843344F339947B82473D33D67"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>development programs that</quote> and inserting <quote>development programs, which may be provided by community partners or intermediary organizations, that</quote>;</text>
 </paragraph><paragraph id="H3A742FBBF0E243C1A09F7F4F3650B390"><enum>(2)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="H9BA5A2089E6B490899FFD32F41094E42"><enum>(3)</enum><text>in paragraph (9), by striking the period and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H1DCA26AAD28B4DEAA1B47580034029C4"><enum>(4)</enum><text>by inserting after paragraph (9) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H9972EAB496064986BCDDCB276A7516F0" style="OLC"> <paragraph id="HE3D0F7AF66C54E71B0992CE024EAA8D7"><enum>(10)</enum><text display-inline="yes-display-inline">development and implementation of data-sharing agreements between the eligible recipient and other agencies and organizations that provide for shared access to information on student progress and success (consistent with the requirements of subpart 4 of part C of the General Education Provisions Act), integrated planning and joint review of the data, and coordinated adjustments in program strategies and activities in response to changes in student needs or to new challenges.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HE1F196C64A834EEC999B94B30756593F"><enum>104.</enum><header>Evaluations</header><text display-inline="no-display-inline">Section 114(d)(2)(B) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2324">20 U.S.C. 2324</external-xref>) is amended—</text>
 <paragraph id="H30A7D0FA9BA44F2D9458C4607F7E03D2"><enum>(1)</enum><text>in clause (vi), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="HA04C96228FB44F3FAE268D1479A14B0A"><enum>(2)</enum><text>in clause (vii), by striking the period and inserting a semicolon; and</text>
 </paragraph><paragraph id="H1C1C287A11A54A359336158B1B9AC677"><enum>(3)</enum><text>by inserting after clause (vii) the following new clauses:</text> <quoted-block display-inline="no-display-inline" id="HD5FBC06E61DE47789EB510C0F15EAB55" style="OLC"> <clause id="H9BA4F544A26A419F8F7F4521174BA2BA"><enum>(viii)</enum><text display-inline="yes-display-inline">whether and how eligible recipients are involving community partners and intermediary organizations in their activities carried out under part C, and the impact of that involvement; and</text>
 </clause><clause id="H3D40E221075249769776678869F70473"><enum>(ix)</enum><text>the implementation of the data-sharing agreements entered into under section 135(b)(10), and the impact of that implementation.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H6EF2FB78441F46C78F1134FACC69586D"><enum>II</enum><header>Amendments to the Higher Education Act of 1965</header>
 <section id="HD5ADD817AA0F487191D7AE7841FCC5D8"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 481 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088</external-xref>) is amended by adding at the end the following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="HC45B7795FB8141AE876D36864144A63E" style="OLC">
 <subsection id="H8CC6325B86224D7DACF41392CBE60A10"><enum>(g)</enum><header>Community partner</header><text display-inline="yes-display-inline">For purposes of this title, the term <term>community partner</term> means a nonprofit organization that has expertise in the planning and delivery of education, career training, and related programs, in forging coordination and cooperation between educators and other members of the community, in training educators and other deliverers of educational services, or in development and implementation of data systems that measure the progress of students, schools and institutions of higher education, and programs.</text>
 </subsection><subsection id="HBF3C8307C18C492BBC7B3E0853678E6E"><enum>(h)</enum><header>Intermediary organization</header><text display-inline="yes-display-inline">For purposes of this title, the term <term>intermediary organization</term> means a nonprofit organization that has expertise in training, forging public-private partnerships, systems development, capacity-building, improving scalability, evaluation, and development and implementation of data systems that measure the progress of students, schools and other educational institutions, and programs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HF30A45A9B46E4730A85ACA5D22A2BFDC"><enum>202.</enum><header>TRIO programs</header><text display-inline="no-display-inline">Section 402A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11</external-xref>) is amended—</text> <paragraph id="HBCBCC326DF3C45B4BF95F3DD97DBE5FD"><enum>(1)</enum><text>in subsection (b)(1)—</text>
 <subparagraph id="HBFF62E8BA08D44989680F447E64AED85"><enum>(A)</enum><text>by striking <quote>For the purposes described</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H52DA5F3F397D4267A84360A89B120567" style="OLC"> <subparagraph id="HE27C973EA81B4519AE846968A279112E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes described</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H7CF9D0EA821445BC9E8D29AE1C733D98"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE4E6BDD2C081487D97B54A82EA87D43F" style="OLC"> <subparagraph id="HE5C5685AB2EC4CED98B7C9D42F7B7AD4"><enum>(B)</enum><header>Community partners and intermediary organizations</header><text>An entity described in subparagraph (A) receiving a grant or entering into a contract under this chapter shall, to the extent practicable, carry out the grant or contract—</text>
 <clause id="H3FFEF5CE382D4A0A8E59419CE08878CB"><enum>(i)</enum><text>with one or more community partners, including through joint planning and implementation, shared professional development designed to improve the effectiveness of such eligible entity and community partner staff, development and implementation of shared data systems that support the improvement of the operations and outcomes of the program carried out with such grant or contract, and the alignment and coordination of such eligible entity and community partner goals, activities, and training; and</text>
 </clause><clause id="H1379BC089A11490CBC2BED613C582398"><enum>(ii)</enum><text>with the involvement of one or more intermediary organizations that will assist such eligible entity by training staff, providing technical assistance that is designed to ensure continuous improvement, helping to ensure accountability for results, and helping to ensure that the grant or contract funds flow quickly and effectively to effective service providers and activities.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H3A7635569AA247F39AFB52EF5967448E"><enum>(2)</enum><text>in subsection (c)(6), by adding at the end the following: <quote>The Secretary shall encourage entities receiving grants or entering into contracts under this chapter to enter into data-sharing agreements with other agencies and organizations so as to provide for shared access to information on student progress and success (consistent with the requirements of subpart 4 of part C of the General Education Provisions Act), integrated planning and review of the data, and coordinated adjustments in program strategies and activities in response to changes in student needs or to new challenges.</quote>; and</text>

 <subsection id="H23E065F0C38E4D3EAA3E1934803C8FC2"><enum>(a)</enum><header>Definition of eligible entity</header><text display-inline="yes-display-inline">Section 404A(c)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-21">20 U.S.C. 1070a–21(c)(2)</external-xref>) is amended—</text> <paragraph id="HCB95AAC54F214DA9B12BEDA22057F55C"><enum>(1)</enum><text>in subparagraph (A)—</text>

 <subsection id="H62452EC2396848C08E0DB49A8EEA6E5B"><enum>(a)</enum><header>Program authority</header><text display-inline="yes-display-inline">Section 418A(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070d-2">20 U.S.C. 1070d–2(a)</external-xref>) is amended—</text> <paragraph id="H30FFBBAED4D3476CBFD9214E61CFDB79"><enum>(1)</enum><text>by striking <quote>The Secretary shall</quote> and inserting the following:</text>

 </subparagraph><subparagraph id="H03DBCC25D8DE4999A2F746E48E6995A5"><enum>(B)</enum><text>with the involvement of one or more intermediary organizations that assist the grantee by training staff, providing technical assistance that is designed to ensure continuous improvement, helping to ensure accountability for results, and helping to ensure that program funds flow quickly and effectively to effective service providers and activities.</text>
 </subparagraph></paragraph><paragraph id="HD34452BDD3D14133944BAF34ABDC02E5"><enum>(3)</enum><header>Data sharing</header><text display-inline="yes-display-inline">Each such program shall include the implementation of one or more data-sharing agreements between the grantee and other organizations or agencies that provide for shared access to information on student progress and success (consistent with the requirements of subpart 4 of part C of the General Education Provisions Act), integrated planning and joint review of the data, and coordinated adjustments in program strategies and activities in response to changes in student needs or to new challenges.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
