			 Account for the State Response to the Opioid Abuse Crisis meets certain
			 minimum requirements, and for other purposes.</official-title></form>
	<legis-body id="H07A284C39FBF402EA99BA95D07FF3A84" style="OLC">
 <section id="H793BDCDBE0AD42E298FF10B70AB3FEA3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Monitoring and Obtaining Needed Information to Track Opioids Responsibly Act of 2017</short-title></quote> or the <quote><short-title>MONITOR Act of 2017</short-title></quote>.</text> </section><section id="H613A2ABA9803408CB1CEDC153E9B47CC"><enum>2.</enum><header>Minimum requirements for State prescription drug monitoring programs</header><text display-inline="no-display-inline">Section 1003 of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note; relating to the Account for the State Response to the Opioid Abuse Crisis) is amended—</text>
 <paragraph id="H4A5C3EAFBC7E44D49869D2667A22CE91"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text> </paragraph><paragraph id="HF012D820A0BF4471B8B1BC3E9E08A348"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H27EEDABE6AF2462B9F5B53F2637B4C39" style="OLC">
					<subsection id="H4478EC67F52E4E789233B30E48998A4B"><enum>(f)</enum><header>Minimum requirements for State prescription drug monitoring programs</header>
 <paragraph id="H764416B12CA24B14B4B17CFBD054AB99"><enum>(1)</enum><header>In general</header><text>As a condition on receipt of a grant under this section, a State shall—</text> <subparagraph id="H19BF99A712F84466A950F867DB54E025"><enum>(A)</enum><text>certify that the State has in effect a prescription drug monitoring program meeting the requirements of paragraph (2); or</text>
 </subparagraph><subparagraph id="H129AE7314F844D678FBEF4BFBA335FF7"><enum>(B)</enum><text>agree to use a portion of the funds received through the grant to meet (or make progress in meeting) the requirements of paragraph (2).</text>
 </subparagraph></paragraph><paragraph id="HC1EC729ECD13448C99047A42B10C75A9"><enum>(2)</enum><header>Requirements</header><text>To meet the requirements of this paragraph, a State’s prescription drug monitoring program must meet each of the following:</text>
 <subparagraph id="H94C7DEBA03604D20B8528796886AFA47"><enum>(A)</enum><text display-inline="yes-display-inline">The program complies with the uniform electronic format specified by the Secretary under paragraph (3) for the reporting, sharing, and disclosure of information.</text>
 </subparagraph><subparagraph id="H7AB7689834A04CFA8CDE989D6C136D37"><enum>(B)</enum><text display-inline="yes-display-inline">The program meets the standards of interoperability specified by the Secretary under paragraph (3).</text> </subparagraph><subparagraph id="H1C463E94059647B6A8FCFFD1F9BAB022"><enum>(C)</enum><text display-inline="yes-display-inline">The State requires dispensers to report to the program each dispensing in the State of a controlled substance listed in schedule II, III, or IV of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) no later than 1 business day after the controlled substance is dispensed to the patient.</text>
 </subparagraph><subparagraph id="H4783A748D1ED4CFC92B0257A4A8566C4"><enum>(D)</enum><text>The program makes reported information available to practitioners on a timely basis.</text> </subparagraph></paragraph><paragraph id="HCDCFB208869443148DE7D415DBDAFDC2"><enum>(3)</enum><header>Uniform electronic format; interoperability</header> <subparagraph id="H90AF9D8015C943749BC53A6E8C935A8C"><enum>(A)</enum><header>Establishment</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall specify for prescription drug monitoring programs—</text>
 <clause id="H05AC12747EAA4F36858A1027C769A027"><enum>(i)</enum><text>a uniform electronic format for the reporting, sharing, and disclosure of information; and</text> </clause><clause id="HC29CC6F7FF644C609415F40D2FDE9026"><enum>(ii)</enum><text display-inline="yes-display-inline">standards of interoperability.</text>
 </clause></subparagraph><subparagraph id="H7345FC81E01C455881FE6E3D48DDF320"><enum>(B)</enum><header>Advisory group</header><text>In carrying out subparagraph (A), the Secretary shall—</text> <clause id="H4791407AE4C6403A85699BBAA0FEC27F"><enum>(i)</enum><text display-inline="yes-display-inline">convene an advisory group of licensed and practicing community pharmacists and other health practitioners who prescribe and dispense; and</text>
 </clause><clause id="HFE82E968EFD14E3B80F96E557D717887"><enum>(ii)</enum><text>take the recommendations of such advisory group into consideration.</text> </clause></subparagraph></paragraph><paragraph id="H247A0CBA4DEE4DBDB91CB36473AA84BA"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
 <subparagraph id="H3432AF90568D4A0DB82B7786AEB6D208"><enum>(A)</enum><text>The term <term>controlled substance</term> has the meaning given to that term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text>
 </subparagraph><subparagraph id="H4E73BA9B052345A3B6C754A037635E10"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>dispenser</term> means a person licensed or otherwise authorized by a State to deliver a prescription drug product to a patient or an agent of the patient.</text>
 </subparagraph><subparagraph id="H7196EF389FD24476A6A014C1811E2680"><enum>(C)</enum><text>The term <term>practitioner</term> means a practitioner registered under section 303(f) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)</external-xref>) to prescribe, administer, or dispense controlled substances.</text>
 </subparagraph><subparagraph id="HA5C769693E234166A4A897F8E1381593"><enum>(D)</enum><text>The term <term>State</term> means each of the several States and the District of Columbia.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section></legis-body></bill>
