			 within the competitive service and the Senior Executive Service, and for

 <section id="H16EBF00A744E496AAF6ACB50DF89D5CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring a Qualified Civil Service Act of 2017</short-title></quote> or the <quote><short-title>EQUALS Act of 2017</short-title></quote>.</text> </section><section id="H86ECF6AB00334D50A01F80A0E486267C" section-type="subsequent-section"><enum>2.</enum><header>Extension of probationary period for positions within the competitive service</header> <subsection id="H18C7163394004AEE8794A520720FBDCC"><enum>(a)</enum><header>In general</header><text>Section 3321 of title 5, United States Code, is amended—</text>
 <paragraph id="H4D0E73B35C5C48E59DCDB29E730C2F9E"><enum>(1)</enum><text>in subsection (a), by striking <quote>The President</quote> and inserting <quote>Subject to subsections (c) and (d), the President</quote>;</text> </paragraph><paragraph id="H3BC3460B60274D9BA47653E21000BBA8"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (e); and</text>
 </paragraph><paragraph id="HF38A9C7C1BCD4210B42DE1121755219F"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block display-inline="no-display-inline" id="H11E4BEFD9DD14F78AE913C0C3AC3CCAB" style="USC"> <subsection id="HE1D4CB8DBA6748DE91B8FC0AA662212C"><enum>(c)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HA5FD9DF4043C45AA96B5E0CC0287EA21"><enum>(1)</enum><text>The length of a probationary period established under paragraph (1) or (2) of subsection (a) shall—</text>
 <subparagraph id="HEA876946B2BE4AE192D5A9F313DE586A" indent="up1"><enum>(A)</enum><text>with respect to any position that requires formal training, begin on the date of appointment to the position and end on the date that is 2 years after the date on which such formal training is completed;</text>
 </subparagraph><subparagraph id="H94CB043F44F744CC9B64DD6392F9F24F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to any position that requires a license, begin on the date of appointment to the position and end on the date that is 2 years after the date on which such license is granted; and</text>
 </subparagraph><subparagraph id="HC265B0178E3B41F9B95353ACB115688E" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to any position not covered by subparagraph (A) or (B), be a period of 2 years beginning on the date of the appointment to the position.</text>
 </subparagraph></paragraph><paragraph id="H4FB43E4D8BF445688092A0BE347436D6" indent="up1"><enum>(2)</enum><text>In paragraph (1)—</text> <subparagraph id="H3D282F15A4AA4E62A395704CE12835B3"><enum>(A)</enum><text>the term <quote>formal training</quote> means, with respect to any position, a training program required by law, rule, or regulation, or otherwise required by the employing agency, to be completed by the employee before the employee is able to successfully execute the duties of the applicable position; and</text>
 </subparagraph><subparagraph id="H4439C396462D47EDAC6DFFE1C7F692CA"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>license</quote> means a license, certification, or other grant of permission to engage in a particular activity.</text> </subparagraph></paragraph></subsection><subsection id="H45CC72EEAECA4AAE86008C8481014960"><enum>(d)</enum><text display-inline="yes-display-inline">The head of each agency shall, in the administration of this section, take appropriate measures to ensure that—</text>
 <paragraph id="H7EBAB08FD771446CB229FE235C4CBA02"><enum>(1)</enum><text display-inline="yes-display-inline">any announcement of a vacant position within the agency and any offer of appointment made to any individual with respect to any such position clearly states the terms and conditions of any applicable probationary period, including any formal training period and any license requirement;</text>
 </paragraph><paragraph id="HA464607FB123499DAC9BC58D1AD68088"><enum>(2)</enum><text display-inline="yes-display-inline">any individual who is required to complete a probationary period under this section receives timely notice of any requirements, including performance requirements, that must be met in order to satisfactorily complete such period;</text>
 </paragraph><paragraph id="HCB7FA2BAD6B5475197891E085AD10189"><enum>(3)</enum><text display-inline="yes-display-inline">any supervisor or manager of an individual who is required to complete a probationary period under this section receives periodic notifications of the end date of such period not later than 1 year, 6 months, 3 months, and 30 days before such end date; and</text>
 </paragraph><paragraph commented="no" id="HABEB50A0349D4ED6AE737EED9421CF86"><enum>(4)</enum><text display-inline="yes-display-inline">if the head decides to retain an individual after the completion of a probationary period under this section, the head submits a certification to that effect, supported by a brief statement of the basis for the certification, in such form and manner as the President may by regulation prescribe.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H0891BB2FD72448AEB1EBDF2FB4B29CA6"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 3321(e) of title 5, United States Code (as so redesignated by subsection (a)(2)), is amended by striking <quote>Subsections (a) and (b)</quote> and inserting <quote>Subsections (a) through (d)</quote>.</text>
 </subsection><subsection id="H7A39103FCADA48E3845993538CF6FE38"><enum>(c)</enum><header>Effective date</header><text>This section and the amendments made by this section—</text> <paragraph id="H30DE1FE234F04CEB8328B55B49F521A8"><enum>(1)</enum><text>shall take effect 1 year after the date of enactment of this Act; and</text>
 </paragraph><paragraph id="H67296E4B00904B21840DA4BFF04DBEE8"><enum>(2)</enum><text>shall apply in the case of any appointment (as referred to in section 3321(a)(1) of title 5, United States Code) and any initial appointment (as referred to in section 3321(a)(2) of such title) taking effect on or after the date on which this section takes effect.</text>
				</paragraph></subsection></section><section commented="no" id="H6F4F75323F82435195ACA6B74BC0281A"><enum>3.</enum><header>Extension of probationary period for positions within the Senior Executive Service</header>
 <subsection commented="no" id="H37890825FFCF49EA983A22FFDE213D62"><enum>(a)</enum><header>In general</header><text>Section 3393(d) of title 5, United States Code, is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text> </subsection><subsection commented="no" id="H3268D6E195D849A7AD3CBD0A97FD9218"><enum>(b)</enum><header>Conforming amendment</header><text>Section 3592(a)(1) of such title is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
 </subsection><subsection id="H4BAFD7C914D544A2AC35C4C882ACB113"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section—</text> <paragraph commented="no" id="H3D400843D77A4D499BCB503E2C9AACFC"><enum>(1)</enum><text>shall take effect 1 year after the date of enactment of this Act; and</text>
 </paragraph><paragraph commented="no" id="H53AEB69C98714D2E8F01AB2C19A38F21"><enum>(2)</enum><text>shall apply in the case of any individual initially appointed as a career appointee under section 3393 of title 5, United States Code, on or after the date on which this section takes effect.</text>
				</paragraph></subsection></section><section commented="no" id="H4B1434B8F1C8409ABCDF4F06BF480FD4"><enum>4.</enum><header>Adverse actions</header>
 <subsection commented="no" id="H73F7C36645434B859F2CDF6A81A670AC"><enum>(a)</enum><header>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5</header><text>Section 7501(1) of title 5, United States Code, is amended—</text> <paragraph id="H5E3757988F7540C5A77B80DE8E75E42B"><enum>(1)</enum><text>by striking <quote>or, except</quote> and inserting <quote>and, except</quote>; and</text>
 </paragraph><paragraph commented="no" id="HF76E37577379417CA99BD7910459561F"><enum>(2)</enum><text>by striking <quote>1 year of current</quote> and inserting <quote>2 years of current</quote>.</text> </paragraph></subsection><subsection commented="no" id="HF91B427FF4284EF19C42864FC374A985"><enum>(b)</enum><header>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5</header><text>Section 7511(a)(1) of title 5, United States Code, is amended—</text>
 <paragraph id="HEEC0573BFA2E4B4CBBD87F6123C52044"><enum>(1)</enum><text>in subparagraph (A)(i) by striking <quote>; or</quote> and inserting <quote>; and</quote>;</text> </paragraph><paragraph id="H74E9C6A2E4C6433A8952D39372DCC69A"><enum>(2)</enum><text>in subparagraph (A)(ii), by striking <quote>1 year</quote> the first place it appears and inserting <quote>2 years</quote>;</text>
 </paragraph><paragraph id="H0AE6EC4732854F149EE090A7814D8127"><enum>(3)</enum><text>in subparagraph (B) by striking <quote>1 year</quote> and inserting <quote>2 years</quote>; and</text> </paragraph><paragraph id="HFC2DEE00DEAE4876A173F39E5AB091E0"><enum>(4)</enum><text>in subparagraph (C)(i), by striking <quote>; or</quote> and inserting <quote>; and</quote>.</text>
 </paragraph></subsection><subsection id="HA24E442C8555461EA2D8D8EB33B22B6B"><enum>(c)</enum><header>Actions based on unacceptable performance</header><text>Section 4303(f) of title 5, United States Code, is amended—</text> <paragraph id="HB88956F5527B4F6EA41662D51F320F79"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking <quote>1 year of current</quote> and inserting <quote>2 years of current</quote>; and</text>
 </paragraph><paragraph id="HE4ECD14336984E17B7F197AF394A6C78"><enum>(2)</enum><text>in paragraph (3) by striking <quote>1 year</quote> and inserting <quote>2 years</quote>.</text> </paragraph></subsection><subsection commented="no" id="H72370FF83A8C4ADC85FC7F9E8357783C"><enum>(d)</enum><header>Effective date</header><text>The amendments made by subsections (a), (b), and (c)—</text>
 <paragraph commented="no" id="H81964DCFD53440B297EE987DFC5F5CE5"><enum>(1)</enum><text>shall take effect 1 year after the date of enactment of this Act; and</text> </paragraph><paragraph commented="no" id="H771773E1FC8740C1B221F29E32473C2D"><enum>(2)</enum><text>shall apply in the case of any individual whose period of continuous service (as referred to in the provision of law amended by paragraph (1) or (2) of subsection (b), as the case may be) commences on or after the date on which this section takes effect.</text>
 </paragraph></subsection></section><section id="HEC9A475A4A084D7EB1D497BC24095D5B"><enum>5.</enum><header>Regulations required</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out this Act and the amendments made by this Act.</text>
