			 mammograms, and for other purposes.</official-title></form>
	<legis-body id="H305AF3F6C6DF4BB58700225BF807CDB2" style="OLC">
 <section id="H27D6440C3ED542388F28D54FD1E854A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Breast Density and Mammography Reporting Act of 2017</short-title></quote>.</text> </section><section id="H0E416C89D99341FD92ACC4FFB5B78679"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
 <paragraph id="H5304050D345846F98DFDD22AA256588F"><enum>(1)</enum><text>The National Cancer Institute estimates that 1 in 8 women in the United States will develop a cancer of the breast in their lifetime.</text>
 </paragraph><paragraph id="H4C7703C1F1A8469692DD132DBA0C0C8D"><enum>(2)</enum><text>The Centers for Disease Control and Prevention reports that breast cancer is the number one cause of cancer death among Hispanic women, and the number two cause of cancer death among White, Black, Asian/Pacific Islander, and American Indian/Alaska Native women.</text>
 </paragraph><paragraph id="H0DA0C44EC8B247F49A1F482D409CFD9A"><enum>(3)</enum><text display-inline="yes-display-inline">Individuals receiving mammograms are not currently required to receive medical summaries or reports from their mammogram providers which address breast density or its correlation to masking the presence of breast cancer on mammograms, despite the fact that the radiologist interpreting the mammogram makes an assessment of the patient’s breast density.</text>
			</paragraph></section><section id="H72B8B95D9CC44D489EDFB7ECFFC6042A"><enum>3.</enum><header>Breast density reporting by facilities that perform mammograms to physicians and patients</header>
 <subsection id="H2E95E21850104A8EA9F97625156C4442"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Clause (ii) of section 354(f)(1)(G) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/263b">42 U.S.C. 263b(f)(1)(G)</external-xref>) is amended—</text>
 <paragraph id="H8ABCE2C7029148A2B898D054027E2E3D"><enum>(1)</enum><text>in each of subclauses (III) and (IV), by striking <quote>and</quote> at the end; and</text> </paragraph><paragraph id="H45FE322CC235401FA3827F7E35FCFE3C"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE16DC40A03524F538D3889A93BCE964F" style="OLC">
 <subclause id="H04622D5F5F5244769DC0A4A70B6ED6F4" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">the report under subclause (I) and the summary under subclause (IV) shall include information about breast density, as specified by the Secretary based upon—</text>
 <item id="H25D7C844C99E47ED9BE17F254E8FE978"><enum>(aa)</enum><text>current scientific knowledge;</text> </item><item id="HCC8530ACB9364A7ABD14C4011F518CC5"><enum>(bb)</enum><text>technological advances; or</text>
 </item><item id="HF1FBC184B18341F2971E744E01C9860C"><enum>(cc)</enum><text>other updated medical procedures where the use of such screening developments is consistent with the practice of medical experts in the field;</text>
 </item></subclause><subclause id="H913DBD825FAF4F2C93AC57D7FC386CFA" indent="up1"><enum>(VI)</enum><text display-inline="yes-display-inline">the summary under subclause (IV) shall convey the effect of breast density in masking the presence of breast cancer on mammography, using the provider’s qualitative assessment of the patient’s breast density; and</text>
 </subclause><subclause id="HC139C008324D4B369CD549DD5ED04D89" indent="up1"><enum>(VII)</enum><text>the summary under subclause (IV) shall include language, developed by the Secretary in consultation with leading experts and leading cancer organizations, communicating that individuals with dense breasts should talk with their health care providers about—</text>
 <item id="H78E1BFA9CC8A4BEDA0E5BF7671EAED6E"><enum>(aa)</enum><text>any questions or concerns regarding the summary; and</text> </item><item id="H55348264B70F4F309193CFDB4702EEEF"><enum>(bb)</enum><text display-inline="yes-display-inline">whether the individuals would benefit from additional tests; and</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H153A3789AEFE4A7E9680E5C25C534EDA"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall not be construed to alter in any way Federal requirements relating to financial obligations of any person in connection with health insurance.</text>
 </subsection></section><section id="HFBC779598B004C9BAF8EDF327C2B1794"><enum>4.</enum><header>Enhancing research relating to breast density</header><text display-inline="no-display-inline">Title III of the Public Health Service Act is amended by inserting after section 354 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/263b">42 U.S.C. 263b</external-xref>) the following:</text>
			<quoted-block display-inline="no-display-inline" id="H60AE21B41F654CCF89A989F98C25AFAB" style="OLC">
 <section id="HB11CD212D2E54F11AB26D380FE6FA0CF"><enum>354A.</enum><header>Enhancing research relating to breast density</header><text display-inline="no-display-inline">The Secretary shall expand and intensify the programs and activities of the Department of Health and Human Services for conducting or supporting—</text>
 <paragraph id="H4385F5BB679D44D9A38B97FBDFC33476"><enum>(1)</enum><text>applied research on breast density;</text> </paragraph><paragraph id="H52232B8A8BFB43E09D7AB0BBE2B95D3F"><enum>(2)</enum><text display-inline="yes-display-inline">research on the cost-effectiveness, effectiveness, and feasibility of reimbursement models for supplemental imaging relating to breast density; and</text>
 </paragraph><paragraph id="HC18BA5322E394E039F1D875BEA12F6C0"><enum>(3)</enum><text display-inline="yes-display-inline">research in support of clinical guidelines and best practices concerning use of mammograms and supplemental screening for women with dense breasts.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
