			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to provide for cost-of-living adjustments indexed to
			 the Consumer Price Index for the Elderly, and for other purposes.</official-title></form>
	<legis-body id="HBDF0F6A1E8EA4AD881705BE6F19BD58C" style="OLC">
 <section id="H4CDC70A33C1247E7A8D2ECCEB3F0D315" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seniors’ Security Act of 2017</short-title></quote>.</text> </section><section id="HC0685D8A0443474EA6F0A1A53A039D44"><enum>2.</enum><header>Use of Consumer Price Index for the Elderly for cost-of-living adjustments of social security benefits</header> <subsection id="H88C2E4D71D474A9D8526961C507F7A06"><enum>(a)</enum><header>In general</header><text>Section 215(i)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

 <subparagraph id="H2DB49988435A4DB99E7D3B72FA187E74" indent="up1"><enum>(H)</enum><text>the term <quote>Consumer Price Index</quote> means the Consumer Price Index for Elderly Consumers (CPI–E, as published by the Bureau of Labor Statistics of the Department of Labor).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2D0947A3D7FB4BC9ADE138A0AD66B24C"><enum>(b)</enum><header>Application to pre-1979 law</header>
 <paragraph id="H4D6BDEBC96554F7488FF701DB55C90F6"><enum>(1)</enum><header>In general</header><text>Section 215(i)(1) of the Social Security Act as in effect in December 1978, and as applied in certain cases under the provisions of such Act as in effect after December 1978, is amended by adding at the end the following new subparagraph:</text>
					<quoted-block id="HD52DE515BA6A4616A8DA1D26336142CF" style="OLC">
 <subparagraph id="HE5CD5FD832C14318AF40C0967AF91F8F" indent="up1"><enum>(D)</enum><text>the term <quote>Consumer Price Index</quote> means the Consumer Price Index for Elderly Consumers (CPI–E, as published by the Bureau of Labor Statistics of the Department of Labor).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HE9169CFE160744C591E96E17B3CE75E5"><enum>(2)</enum><header>Conforming change</header><text>Section 215(i)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)(4)</external-xref>) is amended by inserting <quote>and by section 2 of the <short-title>Seniors’ Security Act of 2017</short-title></quote> after <quote>1986</quote>.</text> </paragraph></subsection><subsection id="HD2B00B7ACA344155A496095B16795308"><enum>(c)</enum><header>Publication of Consumer Price Index for Elderly Consumers</header><text>The Bureau of Labor Statistics of the Department of Labor shall prepare and publish the index authorized by section 191 of the Older Americans Amendments Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/29/2">29 U.S.C. 2</external-xref> note) for each calendar month, beginning with July of the calendar year following the calendar year in which this Act is enacted, and such index shall be known as the <quote>Consumer Price Index for Elderly Consumers</quote>.</text>
 </subsection><subsection id="HBAFA85C271A44217AA472A30784F5B37"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to determinations made with respect to cost-of-living computation quarters (as defined in section 215(i)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)(1)(B)</external-xref>)) ending on or after September 30 of the second calendar year following the calendar year in which this Act is enacted.</text>
			</subsection></section><section id="HBECD9ABDA4E847ADBC57672DE1151D78"><enum>3.</enum><header>Use of Consumer Price Index for the Elderly for cost-of-living adjustments of Federal annuities</header>
 <subsection id="HC68E9AFFE36C4A2ABD78F4326E64401A"><enum>(a)</enum><header>CSRS and FERS</header><text display-inline="yes-display-inline">Section 8331(15) of title 5, United States Code, is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H36C0BD95983848F694D876F949203FBC" style="USC"> <paragraph id="H3C2D7C2B9E314F769FB9F89724EE3E67"><enum>(15)</enum><text display-inline="yes-display-inline"><quote>price index</quote> means the Consumer Price Index for Elderly Consumers (CPI–E, as published by the Bureau of Labor Statistics of the Department of Labor);</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H5630C4EA25574C23BE6638CC21E542BF"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to determinations made with respect to cost-of-living computation quarters ending on or after September 30 of the second calendar year following the calendar year in which this Act is enacted.</text>
			</subsection></section><section id="HEB64314B5226418BB8F032780F514774" section-type="subsequent-section"><enum>4.</enum><header>Use of Consumer Price Index for the Elderly for cost-of-living adjustments of retired pay and
			 retainer pay of members of the Armed Forces</header>
 <subsection id="HD069904347FC471E91330C0C90224B73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1401a(g)(1) of title 10, United States Code, is amended by striking <quote>Consumer Price Index (all items, United States city average)</quote> and inserting <quote>Consumer Price Index for the Elderly</quote>.</text> </subsection><subsection id="HE08F2FDBDF644AFFA3BBCD6B3430680D"><enum>(b)</enum><header>Application of amendment</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply only to adjustments of retired and retainer pay of members of the Armed Forces effective after the date of the enactment of this Act.</text>
 </subsection></section><section id="H1E9E47C65262491A9872F3455A984C35"><enum>5.</enum><header>Limitation on certain increases in Medicare part B premiums</header><text display-inline="no-display-inline">Section 1839(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(f)</external-xref>) is amended in the first sentence—</text> <paragraph id="H654C3A6474534F8D9A706D630C930555"><enum>(1)</enum><text>by striking <quote>such increase would reduce</quote> and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="HEAA25C0C11B14FCCB05DE1E379E7CEF8" style="OLC">
 <text>such increase—</text><paragraph id="H5CDA3A611FDE43B690C58DD1DC7C6E6A"><enum>(1)</enum><text display-inline="yes-display-inline">for calendar years beginning before the date of the enactment of section 5 of the <short-title>Seniors’ Security Act of 2017</short-title>, would reduce</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="H220896DB1AD84560A7E8CDE29B07504E"><enum>(2)</enum><text>by striking the period at the end and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="H95993C7C73B04492907D841C15FB0F5B" style="OLC">
 <text>; and</text><paragraph id="HF296576A3D2443588E8EE7328E055FA9"><enum>(2)</enum><text display-inline="yes-display-inline">for calendar years beginning on or after the date of the enactment of section 5 of the <short-title>Seniors’ Security Act of 2017</short-title>, would exceed 30 percent of the difference between the amount of benefits payable to that individual for that December and the amount of benefits payable to that individual for that November (both amounts determined before the deduction of a premium under this section).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
