			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to prohibit the Secretary of Homeland Security and the
			 Attorney General from using eminent domain to acquire land for the purpose
			 of constructing a wall, or other physical barrier, along the international
			 border between the United States and Mexico, and for other purposes.</official-title></form>

 <section id="HC4800C21CD20436CBE4A9652C4293A8D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Property Rights of Border Landowners Act</short-title></quote>.</text> </section><section id="H0207882CEBD248ECAAA71D20EBFFD9CB"><enum>2.</enum><header>Use of eminent domain to acquire land for purposes of border wall prohibited</header><text display-inline="no-display-inline">Section 103(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103(b)</external-xref>) is amended—</text>
 <paragraph id="H73709335305947EB98C7CA89F9113B0C"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H2F8FCF2C8C0A4B4E860518A1D53BC718"><enum>(A)</enum><text>by striking <quote>Attorney General may</quote> and inserting <quote>Attorney General and the Secretary of Homeland Security may</quote>; and</text>
 </subparagraph><subparagraph id="H7E9CEDAD46184AE1A377ED2056D6B9A9"><enum>(B)</enum><text>by striking <quote>the Attorney General deems</quote> and inserting <quote>the Attorney General or the Secretary of Homeland Security, as applicable, deems</quote>;</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE8B3C03AF95A4A27AA284EB0B123447F"><enum>(2)</enum><text>in paragraph (2)—</text>
 <subparagraph id="H005C88C879C3469BA986EDB159169534"><enum>(A)</enum><text>by striking <quote>Attorney General may</quote> and inserting <quote>Attorney General and the Secretary of Homeland Security may</quote>; and</text> </subparagraph><subparagraph id="H35442B08D0124008890899CFFCB87E54"><enum>(B)</enum><text>by striking <quote>the Attorney General considers</quote> and inserting <quote>the Attorney General or the Secretary of Homeland Security, as applicable, considers</quote>;</text>
 </subparagraph></paragraph><paragraph id="HD2B75DDA692E4827A21F3F3A4397813B"><enum>(3)</enum><text>in paragraph (3)—</text> <subparagraph id="H17FCE0B2845C440EBCC554292636E70F"><enum>(A)</enum><text>by striking <quote>Attorney General and the lawful owner</quote> and inserting <quote>Attorney General or the Secretary of Homeland Security, as applicable, and the lawful owner</quote>;</text>
 </subparagraph><subparagraph id="H9B77A62FF0C847219F8166567FE0E7E2"><enum>(B)</enum><text>by striking <quote>Attorney General may</quote> and inserting <quote>Attorney General or the Secretary of Homeland Security, as applicable, may</quote>; and</text> </subparagraph><subparagraph id="H070771CD4BD04690A6AC875EC0D36B8B"><enum>(C)</enum><text>by inserting before the period at the end the following: <quote>, except that neither the Attorney General nor the Secretary may commence any such proceedings for the acquisition of any interest in land for the purpose of constructing a wall, or other physical barrier, along the international border between the United States and Mexico</quote>; and</text>
 </subparagraph></paragraph><paragraph id="H6C0DEB9D19724498A9B5A40CC695E4C6"><enum>(4)</enum><text>in paragraph (4), by striking <quote>Attorney General may</quote> and inserting <quote>Attorney General and the Secretary of Homeland Security may</quote>.</text> </paragraph></section></legis-body></bill>
