			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to provide for a standard medical expense deduction
			 under the supplemental nutrition assistance program, and for other
			 purposes.</official-title></form>
	<legis-body id="HF486037854AE484192E7E175F9E1843F" style="OLC">
 <section id="H1CBFEEF1FF7E4D6DA81A0C18ED919249" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Standard Medical Expense Deduction Act of 2017</short-title></quote>.</text> </section><section id="H48E2283CC23A45918C31A546A0A715E3"><enum>2.</enum><header>Standard medical expense deduction</header><text display-inline="no-display-inline">Section 5(e)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(5)</external-xref>) is amended—</text>
 <paragraph id="H99153F39B8D54DEAB7879E36851114DB"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Excess medical</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Medical</header-in-text></quote>;</text> </paragraph><paragraph id="HA34DEF8E3C8A4EFDAED2F35F675A743B"><enum>(2)</enum><text>by striking subparagraph (A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF52220AE121747F1AEE5A67CC8AFED81" style="OLC">
					<subparagraph id="HA833CC5DE4E844E7996BA842F2A26C47"><enum>(A)</enum><header>Standard medical deduction</header>
 <clause id="H401FCEDF30E24FD0B647467F77621970"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), a household containing an elderly or disabled member shall be entitled, with respect to expenses other than expenses paid on behalf of the household by a third party—</text>
 <subclause commented="no" display-inline="no-display-inline" id="HF052CC456FD44A4E8E21E20BC2F13454"><enum>(I)</enum><text display-inline="yes-display-inline">if the amount of actual costs of allowable medical expenses incurred by the elderly or disabled member for a month, exclusive of special diets, is equal to or greater than $35, to a standard medical deduction for each month of an amount equal to—</text>
 <item id="HFF7A05E491C449D283C7EAF749BBF73B"><enum>(aa)</enum><text>for fiscal year 2018, $140; and</text> </item><item id="H7BBFEFA7D82645DFA2CC469F0E621861"><enum>(bb)</enum><text>for fiscal year 2019 and each subsequent fiscal year, the applicable amount during the preceding fiscal year, as adjusted to reflect changes for the 12-month period ending the preceding June 30 in the Consumer Price Index for All Urban Consumers: Medical Care published by the Bureau of Labor Statistics of the Department of Labor; or</text>
 </item></subclause><subclause commented="no" display-inline="no-display-inline" id="HC7BB2CBCCE9C4DEEBB89B4417DBADFC6"><enum>(II)</enum><text display-inline="yes-display-inline">if the amount of actual costs of allowable medical expenses incurred by the elderly or disabled member for a month, exclusive of special diets, is greater than the sum of the amount of that standard medical deduction and $35, to a deduction equal to the amount of those actual costs.</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="HD9F0A2D81AB64E11AA50D25F0F9916EC"><enum>(ii)</enum><header>Effect on State authority to adjust standard medical deduction</header><text display-inline="yes-display-inline">Nothing in this subparagraph precludes—</text> <subclause commented="no" display-inline="no-display-inline" id="H51D9AB92D494435BA8C9356716AAC1A1"><enum>(I)</enum><text display-inline="yes-display-inline">a State that has an approved standard medical deduction as of the date of enactment of the <short-title>SNAP Standard Medical Expense Deduction Act of 2017</short-title> in an amount that is greater than the amount of the standard medical deduction described in item (aa) or (bb) of clause (i)(I), as applicable, from continuing in effect that standard medical deduction; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="H4E4028EA734640F5B9D9232EA946B4FF"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary from approving a standard medical deduction in an amount that is greater than the amount of the standard medical deduction described in item (aa) or (bb) of clause (i)(I), as applicable.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H8C31059E188A4F8F9694B6B85954AF8A"><enum>(3)</enum><text>in subparagraph (B)—</text> <subparagraph id="H61A35F39F4BB4393A7262314DB53DA76"><enum>(A)</enum><text>in the subparagraph heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">actual costs</header-in-text></quote> before <quote><header-in-text level="subparagraph" style="OLC">deduction</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="HD884E4FB3E4F4F729361A2177DC07C9D"><enum>(B)</enum><text>in clause (i), by striking <quote>excess medical expense deduction</quote> and inserting <quote>actual costs deduction described in clause (i)(II) of that subparagraph</quote>.</text> </subparagraph></paragraph></section><section id="H3DDE8ADE0753489B8119C8EA98EACF80"><enum>3.</enum><header>Reports and studies</header> <subsection id="HD015E39C1DB5466787E59C93E9A5B25E"><enum>(a)</enum><header>State performance on enrolling eligible seniors and individuals with disabilities in low-Income health and nutrition benefits</header><text display-inline="yes-display-inline">Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3C11FCD4097045A8AFC9779AA0596561" style="OLC">
					<subsection id="H276A719A72CC4453B115E6C49B4DD833"><enum>(m)</enum><header>State performance on enrolling eligible seniors and individuals with disabilities in low-Income
			 health and nutrition benefits</header>
 <paragraph id="HA77D350D894F4EB3AB705388E6A1AED9"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H11ED3753C66A47E98E4620EFE59968BA"><enum>(A)</enum><header>Covered program</header><text>The term <term>covered program</term> means—</text>
 <clause id="HAEE212BCA7AE43009389EBC7BBFAA520"><enum>(i)</enum><text>the supplemental nutrition assistance program;</text> </clause><clause id="H5BF36421037D400EAC04F7C7D718BF74"><enum>(ii)</enum><text>the Medicare part D low-income subsidy under section 1860D–14 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114</external-xref>); and</text>
 </clause><clause id="HC0B37DC651C346AABA870D56A247B0BE"><enum>(iii)</enum><text>the Medicare Savings Program, as defined in section 1144(c)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-14">42 U.S.C. 1320b–14(c)(7)</external-xref>).</text>
 </clause></subparagraph><subparagraph commented="no" id="H8892014DB49C4D66BB3B53C1381587B8"><enum>(B)</enum><header>Disabled individual</header><text>The term <term>disabled individual</term> means a member of a household described in any of paragraphs (2) through (7) of section 3(j).</text> </subparagraph><subparagraph commented="no" id="HC22F212806A34A0882DC571C1B1B4142"><enum>(C)</enum><header>Elderly individual</header><text>The term <term>elderly individual</term> means a member of a household who is not less than 60 years old.</text>
							</subparagraph></paragraph><paragraph id="H005EA4CB90B44E7B8016C0095B56C991"><enum>(2)</enum><header>Reports</header>
 <subparagraph id="HE654AC9B2CD9486AAD09860EDD547346"><enum>(A)</enum><header>In general</header><text>Not later than June 30, 2018, and June 30 of each year thereafter, the Secretary, in collaboration with the Secretary of Health and Human Services and the Commissioner of Social Security, shall submit to the committees described in subparagraph (B) a report that assesses the effectiveness of each State in enrolling eligible elderly individuals and disabled individuals in each covered program.</text>
 </subparagraph><subparagraph id="HB42400F2E36B4BD186B48EA6FFCAB2EC"><enum>(B)</enum><header>Committees described</header><text>The committees referred to in subparagraph (A) are—</text> <clause id="H714749EE0CCB4BBA860C93C3DBFC346C"><enum>(i)</enum><text>of the House of Representatives—</text>
 <subclause id="HFA8367DAFC684945B91B56A608E3FFF6"><enum>(I)</enum><text>the Committee on Agriculture;</text> </subclause><subclause id="HE67CD7B465AF4A67AD887D26DCCC09EC"><enum>(II)</enum><text>the Committee on Ways and Means; and</text>
 </subclause><subclause id="HA2FE4F18D8EB4D168FF3578E4B450FA9"><enum>(III)</enum><text>the Committee on Energy and Commerce; and</text> </subclause></clause><clause id="H6EE1FCEAC2B648EEAA4779BD2DD334B0"><enum>(ii)</enum><text>of the Senate—</text>
 <subclause id="HFACEBE0C6B9441D1BA13BF38540B72FD"><enum>(I)</enum><text>the Committee on Agriculture, Nutrition, and Forestry; and</text> </subclause><subclause id="H9674B07AB35247FB98F967268EC8C457"><enum>(II)</enum><text>the Committee on Finance.</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="H158A7B07CD7D47B8B350708A3FB30718"><enum>(3)</enum><header>Specific measures</header><text>The report submitted under paragraph (2)(A) shall include, with respect to the previous fiscal year—</text>
 <subparagraph id="H35C81A197A6E4EEEAE97AEC8ABBB2283"><enum>(A)</enum><text>an estimate of the number of elderly individuals and the number of disabled individuals, by State, who were eligible for each covered program;</text>
 </subparagraph><subparagraph id="HD280AABCF41444658AC2858E635E4F91"><enum>(B)</enum><text>an estimate of the number of elderly individuals and the number of disabled individuals, by State, who participated in each covered program;</text>
 </subparagraph><subparagraph id="HAB1AD77987C04DC4B2B4BED3AB6FDE58"><enum>(C)</enum><text>an estimate of the number of elderly individuals and the number of disabled individuals who were eligible for all 3 covered programs;</text>
 </subparagraph><subparagraph id="H3AF5F3CBD36A45509236476EB4E4FD86"><enum>(D)</enum><text>an estimate of the number of elderly individuals and the number of disabled individuals who participated in all 3 covered programs; and</text>
 </subparagraph><subparagraph id="H02DFFBC5CD6A4160B0FCABEC14879E65"><enum>(E)</enum><text>an estimate of—</text> <clause id="H5C2F5DAC6808471AB0D8236AD1714D99"><enum>(i)</enum><text>the number of individuals whose eligibility for each covered program was initiated through an application with the Social Security Administration;</text>
 </clause><clause id="HCB4FDD8A562E4F78981676B4C46F4345"><enum>(ii)</enum><text>the number of individuals described in clause (i) who qualified for each covered program; and</text> </clause><clause id="H5D2068CC37E646CA942CC42208A4348A"><enum>(iii)</enum><text>the number of individuals described in clause (i) who participated in each covered program.</text>
 </clause></subparagraph></paragraph><paragraph id="H40B1B2B099664C7C98B109CF5D9B9A30"><enum>(4)</enum><header>Performance innovations</header><text>The report submitted under paragraph (2)(A) shall include a description of best practices of 1 or more States with the best performances for that fiscal year, or the most improved performances from the previous fiscal year, under each of the measures described in paragraph (3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H39EBC67BB09B49C398C30E3AC11B0CF3"><enum>(b)</enum><header>Studies on disability and food insecurity</header><text>Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) (as amended by subsection (a)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7E64B1D824C142739E558354600B774A" style="OLC">
					<subsection id="H5807CE9B268843E3AC03875C1B38727B"><enum>(n)</enum><header>Studies on disability and food insecurity</header>
						<paragraph id="H5B96EE587E48489183D6652C62E121E3"><enum>(1)</enum><header>Definition of disabled individual</header>
 <subparagraph id="H0DE7F040C9D74D1081F5C5584EE564E8"><enum>(A)</enum><header>In general</header><text>In this subsection, the term <term>disabled individual</term> means a member of a household described in any of paragraphs (2) through (7) of section 3(j).</text> </subparagraph><subparagraph id="H95C0FA2AE0B949FAB27B62D261743D74"><enum>(B)</enum><header>Inclusions</header><text>In this subsection, the term <term>disabled individual</term> includes a member of a household who, as determined by the Secretary—</text>
 <clause id="H204CAA3DD51548D78B2BB43EF23EE3CE"><enum>(i)</enum><text>is not considered disabled under subparagraph (A); but</text> </clause><clause id="H9303B066386E4B989D200AB0FE67D5B9"><enum>(ii)</enum><text>has a physical, mental, or sensory condition that limits the daily activities of the individual.</text>
 </clause></subparagraph></paragraph><paragraph id="HC6F5CE8757274B0B823765D847E6D278"><enum>(2)</enum><header>Studies</header><text>The Secretary—</text> <subparagraph id="H0DB56DD11CE04F3E9E1563E8A89877E3"><enum>(A)</enum><text>shall carry out a study—</text>
 <clause id="H4BAB1038EACF4F8DA4B35DA9ED2DB89D"><enum>(i)</enum><text>on the relationship between disability and food insecurity for disabled individuals;</text> </clause><clause id="HA3B2E3DD1CD94D2494A061FE41E008E6"><enum>(ii)</enum><text>on the effectiveness of Federal food assistance programs in responding to the causes of food insecurity in households with disabled individuals; and</text>
 </clause><clause id="H0C57F9DCEF2D4963AE726FFF0E51EA37"><enum>(iii)</enum><text>making recommendations for how Federal food assistance programs could be improved to better meet the needs of households with disabled individuals; and</text>
 </clause></subparagraph><subparagraph id="HCDD1F4202D564E3A8A9AE74DF2F7BA24"><enum>(B)</enum><text>in collaboration with the Civil Rights Division of the Department of Justice, shall carry out a study on the best practices of States in complying with—</text>
 <clause commented="no" display-inline="no-display-inline" id="HDEAC9AC08B57406E9703C5CB6135C504"><enum>(i)</enum><text display-inline="yes-display-inline">section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>) and the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.) regarding practices to avoid discrimination on the basis of disability, such as through provision of reasonable accommodations, in carrying out Federal food assistance programs; and</text>
 </clause><clause id="H495AD18B16244859BAEB54F48551CD22"><enum>(ii)</enum><text>section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>) regarding the comprehensive use of adaptive technologies for disabled individuals in accessing Federal food assistance programs.</text>
 </clause></subparagraph></paragraph><paragraph id="H39F60BB951E840E7A99DF9D8C507A762"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date on which the studies are completed under paragraph (2), the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the results of the studies, including such recommendations as the Secretary considers appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H37890B00AC6645A788888232788F2DBA"><enum>(c)</enum><header>Report on standard medical deduction</header><text>Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) (as amended by subsection (b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCD0AC7E3F4EC4B77A6F5A23BABFFC374" style="OLC">
 <subsection id="H52F5106B856A4F1EA3AE9E54DD91E7B6"><enum>(o)</enum><header>Report on standard medical deduction</header><text>Not later than 2 years after the date of enactment of the <short-title>SNAP Standard Medical Expense Deduction Act of 2017</short-title>, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that—</text>
 <paragraph id="HDA7EAAA9F8DE4CC38CB52EBE387D35A3"><enum>(1)</enum><text>identifies which States were most effective at increasing the use by individuals in the State of the standard medical deduction authorized under section 5(e)(5)(A) during the period covered by the report; and</text>
 </paragraph><paragraph id="H1FF0656B7D8C4D9CA3B5120C132D9CC5"><enum>(2)</enum><text>provides an assessment of which factors were important in increasing the use of the standard medical deduction by individuals in the States identified under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
