 <section id="HCFFA9092D10D481CB4F5BCEF687A26A7"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Fishing Protection Act</quote>.</text> </section><section id="H834AD6CF939C4B919682B932EB33A820"><enum>102.</enum><header>Modification of definition</header><text display-inline="no-display-inline">Section 3(2)(B) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2602">15 U.S.C. 2602(2)(B)</external-xref>) is amended—</text>

 </paragraph></section><section id="HE7955F8093114D28BC18D2825BFAFDAA"><enum>103.</enum><header>Limitation on authority to regulate ammunition and fishing tackle</header><text display-inline="no-display-inline">Except as provided in section 20.21 of title 50, Code of Federal Regulations, as in effect on the date of the enactment of this Act, or any substantially similar successor regulation thereto, the Secretary of the Interior, the Secretary of Agriculture, and any bureau, service, or office of the Department of the Interior or the Department of Agriculture, may not regulate the use of ammunition cartridges, ammunition components, or fishing tackle based on the lead content thereof if such use is in compliance with the law of the State in which the use occurs.</text>
			</section></title><title id="H296F1828C8A44F71B1961EC255F9E02A"><enum>II</enum><header>Target Practice and Marksmanship Training Support Act</header>
 <section id="HB6CE6155E71D4F749A18C4AD4D98A643"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Target Practice and Marksmanship Training Support Act</quote>.</text> </section><section id="H1F0A9BEB5E784513AFD69268525B089D"><enum>202.</enum><header>Definition of public target range</header><text display-inline="no-display-inline">In this title, the term <term>public target range</term> means a specific location that—</text>
 <paragraph id="HB294AFD7F36346E6974246CF2C94C2AF"><enum>(1)</enum><text>is identified by a governmental agency for recreational shooting;</text> </paragraph><paragraph id="H3FF307B8A97247018E7CEFA7D4A946A6"><enum>(2)</enum><text>is open to the public;</text>
 </paragraph><paragraph id="H17137010B95B4AB3B929DE666D2A5AB9"><enum>(3)</enum><text>may be supervised; and</text> </paragraph><paragraph id="HE6E8280D60B0415CA2253FA523252DF1"><enum>(4)</enum><text>may accommodate archery or rifle, pistol, or shotgun shooting.</text>

 <subsection id="H7C6107B53A794C449A117C8117E25EAB"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>) is amended—</text> <paragraph id="H355407EBA58F44219B961E287EC54771"><enum>(1)</enum><text>by redesignating paragraphs (2) through (8) as paragraphs (3) through (9), respectively; and</text>

 </subparagraph><subparagraph id="H8BFA052510A64A9B90AC73AE8A7A3A3D"><enum>(C)</enum><text>may be supervised; and</text> </subparagraph><subparagraph id="H3A661C94458D48BDBD950871DA16F328"><enum>(D)</enum><text>may accommodate archery or rifle, pistol, or shotgun shooting;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 <paragraph id="HFDED21FBE7E545DBA539E50F32FCAE7B"><enum>(3)</enum><header>Allocation of additional amounts</header><text>Of the amount apportioned to a State for any fiscal year under section 4(b), the State may elect to allocate not more than 10 percent, to be combined with the amount apportioned to the State under paragraph (1) for that fiscal year, for acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

 </paragraph><paragraph id="H7799A6BCF4F84DD4A54548DD1F741EF5"><enum>(2)</enum><header>Public target range construction or expansion</header><text>The Federal share of the cost of acquiring land for, expanding, or constructing a public target range in a State on Federal or non-Federal land pursuant to this section or section 8(b) shall not exceed 90 percent of the cost of the activity.</text>
 </paragraph><paragraph id="H32C8555E607C4B1ABD11CBD22CD5C6BB"><enum>(3)</enum><header>In-kind match</header><text>For the purposes of cost sharing, any institution (as defined by <external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>) that is eligible to receive amounts under this section shall be allowed to use the present value of their land as an in-kind match to satisfy cost sharing requirements regardless of any restrictions in law that would otherwise prohibit the use of the land for such purpose.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H199BFD3A430A4E6D866825EFAB4D9A2F"><enum>(3)</enum><text>in subsection (c)(1)—</text> <subparagraph id="H9B28A1DC7280450092E1D3578E7C345B"><enum>(A)</enum><text>by striking <quote>Amounts made</quote> and inserting the following:</text>

						</subparagraph></paragraph></subsection></section><section id="HB44F9ED314FE4D979712310F57C70510"><enum>204.</enum><header>Limits on liability</header>
 <subsection id="HD3215DFD47FC41CA845BCC9434683E65"><enum>(a)</enum><header>Discretionary function</header><text>For purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly referred to as the <quote>Federal Tort Claims Act</quote>), any action by an agent or employee of the United States to manage or allow the use of Federal land for purposes of target practice or marksmanship training by a member of the public shall be considered to be the exercise or performance of a discretionary function.</text>
 </subsection><subsection id="HDB9D53CA174F4718B467DFDA6335D3EB"><enum>(b)</enum><header>Civil action or claims</header><text>Except to the extent provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, the United States shall not be subject to any civil action or claim for money damages for any injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is—</text>
 <paragraph id="H8696DFD053FA4279942298CD27C65631"><enum>(1)</enum><text>funded in whole or in part by the Federal Government pursuant to the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669</external-xref> et seq.); or</text>
 </paragraph><paragraph id="H0880FFB1A0794663A478663F8EF25EB9"><enum>(2)</enum><text>located on Federal land.</text> </paragraph></subsection></section><section id="HC8E0A283717B490F8F5EBB68A9D6AD84"><enum>205.</enum><header>Sense of Congress regarding cooperation</header><text display-inline="no-display-inline">It is the sense of Congress that, consistent with applicable laws and regulations, the Chief of the Forest Service and the Director of the Bureau of Land Management should cooperate with State and local authorities and other entities to carry out waste removal and other activities on any Federal land used as a public target range to encourage continued use of that land for target practice or marksmanship training.</text>
			</section></title><title id="H2BF197FAC2F04A799D3804EC8BA6D754"><enum>III</enum><header>Recreational Lands Self-Defense Act</header>
 <section id="H948FEFAB43894D479053757E619E0399"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Recreational Lands Self-Defense Act</quote>.</text> </section><section id="H2916F5E89B9949F585CF81FCE84C4783"><enum>302.</enum><header>Protecting Americans from violent crime</header><text display-inline="no-display-inline">The Secretary of the Army shall not promulgate or enforce any regulation that prohibits an individual from possessing a firearm, including a firearm that is assembled, loaded, and functional, at a water resources development project covered under section 327.0 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act), if—</text>
 <paragraph id="H747568434B204F3AAFE7A6E777D0B05C"><enum>(1)</enum><text>the individual is not otherwise prohibited by law from possessing the firearm; and</text> </paragraph><paragraph id="H4FF0F72DBA9D458081CA8B43AAD931CA"><enum>(2)</enum><text>the possession of the firearm is in compliance with the law of the State in which the water resources development project is located.</text>
				</paragraph></section></title><title id="H2DF88334CEF0403A8E2629F8230CB6B5"><enum>IV</enum><header>Recreational Fishing and Hunting Heritage Opportunities Act</header>
 <section id="HC2001C8AEF9445B19C200F804D815E39"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Recreational Fishing and Hunting Heritage and Opportunities Act</quote>.</text> </section><section id="H230E550B52B041619F1CEF7CD4BE5790"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
 <paragraph id="H7C94657F36D44212874E060899FE3729"><enum>(1)</enum><header>Federal public land</header><text>The term <term>Federal public land</term> means any land or water that is owned and managed by the Bureau of Land Management or the Forest Service.</text>
 </paragraph><paragraph id="HF56ACD2696AC46A2BC3CA51B787522BC"><enum>(2)</enum><header>Federal public land management officials</header><text>The term <term>Federal public land management officials</term> means—</text> <subparagraph id="H7E56DB9919B343F0ABC077C4F1A0A275"><enum>(A)</enum><text>the Secretary of the Interior and the Director of the Bureau of Land Management regarding Bureau of Land Management lands and waters; and</text>
 </subparagraph><subparagraph id="H148AEFE8BCC94D29B2E874255156671C"><enum>(B)</enum><text>the Secretary of Agriculture and the Chief of the Forest Service regarding the National Forest System.</text>
					</subparagraph></paragraph><paragraph id="HE7E7044B209E4C92A2273CF8B9CD7949"><enum>(3)</enum><header>hunting</header>
 <subparagraph id="H8FF51DBA98F340A1A389B8EB6B96C777"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>hunting</term> means use of a firearm, bow, or other authorized means in the lawful—</text> <clause id="HAFE9695767EB48F0B423591198C62C1F"><enum>(i)</enum><text>pursuit, shooting, capture, collection, trapping, or killing of wildlife;</text>
 </clause><clause id="H777BC8BAC00C43E4A2020D6E9B49377B"><enum>(ii)</enum><text>attempt to pursue, shoot, capture, collect, trap, or kill wildlife; or</text> </clause><clause id="H2209CEE470344753BD2F718B955E93B1"><enum>(iii)</enum><text>the training of hunting dogs, including field trials.</text>
 </clause></subparagraph><subparagraph id="HF7FC08989E5D41B192392D9AD1FA4FAB"><enum>(B)</enum><header>Exclusion</header><text>The term <term>hunting</term> does not include the use of skilled volunteers to cull excess animals (as defined by other Federal law).</text>
 </subparagraph></paragraph><paragraph id="H10DD2B381AD44725A703E4E21B41D6D7"><enum>(4)</enum><header>Recreational fishing</header><text>The term <term>recreational fishing</term> means the lawful—</text> <subparagraph id="H15B0338E4CE94AD8B9BE08639F501ABB"><enum>(A)</enum><text>pursuit, capture, collection, or killing of fish; or</text>
 </subparagraph><subparagraph id="H8803C531878E477C894A511B4409B080"><enum>(B)</enum><text>attempt to capture, collect, or kill fish.</text> </subparagraph></paragraph><paragraph id="H2F335F89C6F94C79B038F1BBBFA9DA87"><enum>(5)</enum><header>Recreational shooting</header><text>The term <term>recreational shooting</term> means any form of sport, training, competition, or pastime, whether formal or informal, that involves the discharge of a rifle, handgun, or shotgun, or the use of a bow and arrow.</text>
				</paragraph></section><section id="HB24D4474CE3443CF9F15427F1DC84E2A"><enum>403.</enum><header>Recreational fishing, hunting, and shooting</header>
 <subsection id="HE6484246EF174F2D8B2785601154E7CD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to valid existing rights and subsection (g), and cooperation with the respective State fish and wildlife agency, Federal public land management officials shall exercise authority under existing law, including provisions regarding land use planning, to facilitate use of and access to Federal public lands, including National Monuments, Wilderness Areas, Wilderness Study Areas, and lands administratively classified as wilderness eligible or suitable and primitive or semi-primitive areas, for recreational fishing, hunting, and shooting, except as limited by—</text>
 <paragraph id="H9F478E41A2FB4964BDE22D52E84F45CD"><enum>(1)</enum><text>statutory authority that authorizes action or withholding action for reasons of national security, public safety, or resource conservation;</text>
 </paragraph><paragraph id="H220742E27DBF4709ABD17F23433B2DC7"><enum>(2)</enum><text>any other Federal statute that specifically precludes recreational fishing, hunting, or shooting on specific Federal public lands, waters, or units thereof; or</text>
 </paragraph><paragraph id="H3F502C21DC93432A987A71259F662921"><enum>(3)</enum><text>discretionary limitations on recreational fishing, hunting, and shooting determined to be necessary and reasonable as supported by the best scientific evidence and advanced through a transparent public process.</text>
 </paragraph></subsection><subsection id="H997428F9FB0E4A88901BD385E36D009E"><enum>(b)</enum><header>Management</header><text>Consistent with subsection (a), the head of each Federal public land management agency shall exercise its land management discretion—</text>
 <paragraph id="HCC05C6607A614A99B4F9825849FFA8CC"><enum>(1)</enum><text>in a manner that supports and facilitates recreational fishing, hunting, and shooting opportunities;</text>
 </paragraph><paragraph id="HE597C2D0B9534AE3B70CF6580512FFB8"><enum>(2)</enum><text>to the extent authorized under applicable State law; and</text> </paragraph><paragraph id="HDF2EAE6ABEA1434CA2B89CB6C04A5EF8"><enum>(3)</enum><text>in accordance with applicable Federal law.</text>
					</paragraph></subsection><subsection id="HC0F3DBC71AD74E259F3BF58449E2432A"><enum>(c)</enum><header>Planning</header>
 <paragraph id="HF1080999ACD943D59A247DF989E104A0"><enum>(1)</enum><header>Evaluation of effects on opportunities to engage in recreational fishing, hunting, or shooting</header><text>Federal public land planning documents, including land resources management plans, resource management plans, and comprehensive conservation plans, shall include a specific evaluation of the effects of such plans on opportunities to engage in recreational fishing, hunting, or shooting.</text>
 </paragraph><paragraph id="HB6F21AA264CA47B8ABAF0EE07A336901"><enum>(2)</enum><header>No major federal action</header><text display-inline="yes-display-inline">No action taken under this title, or under section 4 of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd</external-xref>), either individually or cumulatively with other actions involving Federal public lands or lands managed by the United States Fish and Wildlife Service, shall be considered under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) to be a major Federal action significantly affecting the quality of the human environment, and no additional identification, analysis, or consideration of environmental effects, including cumulative effects, is necessary or required with respect to such an action.</text>
 </paragraph><paragraph id="H82226CB4E415407CB08D59A890F86255"><enum>(3)</enum><header>Other activity not considered</header><text>Federal public land management officials are not required to consider the existence or availability of recreational fishing, hunting, or shooting opportunities on adjacent or nearby public or private lands in the planning for or determination of which Federal public lands are open for these activities or in the setting of levels of use for these activities on Federal public lands, unless the combination or coordination of such opportunities would enhance the recreational fishing, hunting, or shooting opportunities available to the public.</text>
					</paragraph></subsection><subsection id="H8B21969D536B4A23889E0FB9AFDA023B"><enum>(d)</enum><header>Federal public lands</header>
 <paragraph id="HDB569670D086460DA92738DD38324D1C"><enum>(1)</enum><header>Lands open</header><text>Notwithstanding any other law, lands under the jurisdiction of the Bureau of Land Management or the Forest Service, including Wilderness Areas, Wilderness Study Areas, lands designated as wilderness or administratively classified as wilderness eligible or suitable and primitive or semi-primitive areas and National Monuments, but excluding lands on the Outer Continental Shelf, shall be open to recreational fishing, hunting, and shooting unless the managing Federal agency acts to close lands to such activity. Lands may be made subject to closure to or restriction on recreational fishing, hunting, or shooting if determined by the head of the agency concerned to be necessary and reasonable and supported by facts and evidence, for purposes including resource conservation, public safety, energy or mineral production, energy generation or transmission infrastructure, water supply facilities, protection of other permittees, protection of private property rights or interest, national security, or compliance with other law.</text>
					</paragraph><paragraph id="H91C3C6C3E5C24DF98250F8F1746A0F90"><enum>(2)</enum><header>Shooting ranges</header>
 <subparagraph id="H699C50C478D24B2EA9C16283EEB0513A"><enum>(A)</enum><header>In general</header><text>The head of each Federal agency shall use his or her authorities in a manner consistent with this title and other applicable law, to—</text>
 <clause id="H34DBC1C29E984176A8B2EFF471CC3804"><enum>(i)</enum><text>lease or permit use of lands under the jurisdiction of the agency for shooting ranges; and</text> </clause><clause id="HBA2E07FB48B248B08D8B6D3FDF4D05D6"><enum>(ii)</enum><text>designate specific lands under the jurisdiction of the agency for recreational shooting activities.</text>
 </clause></subparagraph><subparagraph id="HDEDCE4CE2B15450688E675F0F6CEA5C3"><enum>(B)</enum><header>Limitation on liability</header><text>Any designation under subparagraph (A)(ii) shall not subject the United States to any civil action or claim for monetary damages for injury or loss of property or personal injury or death caused by any activity occurring at or on such designated lands.</text>
						</subparagraph></paragraph></subsection><subsection id="HDFA36E57CEB043A996333BD6B619288D"><enum>(e)</enum><header>Necessity in wilderness areas and <quote>within and supplemental to</quote> wilderness purposes</header>
 <paragraph id="H64E6CB579A344E63BFAD2AE841F1ADE4"><enum>(1)</enum><header>Minimum requirements for administration</header><text display-inline="yes-display-inline">The provision of opportunities for recreational fishing, hunting, and shooting and the conservation of fish and wildlife to provide sustainable use recreational opportunities on designated Federal wilderness areas shall constitute measures necessary to meet the minimum requirements for the administration of the wilderness area, provided that this determination shall not authorize or facilitate commodity development, use, or extraction, motorized recreational access or use that is not otherwise allowed under the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), or permanent road construction or maintenance within designated wilderness areas.</text>
 </paragraph><paragraph id="HDBE12CC1D55E4C1D9435F6EE918F48F4"><enum>(2)</enum><header>Application of Wilderness Act</header><text display-inline="yes-display-inline">Provisions of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), stipulating that wilderness purposes are <quote>within and supplemental to</quote> the purposes of the underlying Federal land unit are reaffirmed. When seeking to carry out fish and wildlife conservation programs and projects or provide fish and wildlife dependent recreation opportunities on designated wilderness areas, the head of each Federal agency shall implement these supplemental purposes so as to facilitate, enhance, or both, but not to impede the underlying Federal land purposes when seeking to carry out fish and wildlife conservation programs and projects or provide fish and wildlife dependent recreation opportunities in designated wilderness areas, provided that such implementation shall not authorize or facilitate commodity development, use or extraction, or permanent road construction or use within designated wilderness areas.</text>
 </paragraph></subsection><subsection id="HAB425DEF692F4C929029B8D72403DE81"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Beginning on the second October 1 after the date of the enactment of this Act and biennially on October 1 thereafter, the head of each Federal agency who has authority to manage Federal public land on which recreational fishing, hunting, or shooting occurs shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that describes—</text>
 <paragraph id="HE941328D5E694C4896943A6489175F49"><enum>(1)</enum><text display-inline="yes-display-inline">any Federal public land administered by the agency head that was closed to recreational fishing, hunting, or shooting at any time during the preceding year; and</text>
 </paragraph><paragraph id="HE4F7E34E12CE4F4AAFE6A4EA7DF347CE"><enum>(2)</enum><text>the reason for the closure.</text> </paragraph></subsection><subsection id="H81BC5EDB306640DABCDE8151805A5BC6"><enum>(g)</enum><header>Closures or significant restrictions of 640 or more acres</header> <paragraph id="HBF882E8289B3436BB856A702D68CBAD6"><enum>(1)</enum><header>In general</header><text>Other than closures established or prescribed by land planning actions referred to in subsection (d) or emergency closures described in paragraph (3) of this subsection, a permanent or temporary withdrawal, change of classification, or change of management status of Federal public land that effectively closes or significantly restricts 640 or more contiguous acres of Federal public land to access or use for recreational fishing or hunting or activities related to recreational fishing or hunting, or both, shall take effect only if, before the date of withdrawal or change, the head of the Federal agency that has jurisdiction over the Federal public land—</text>
 <subparagraph id="HB78701F9112C46269DAFDD4E07F04285"><enum>(A)</enum><text>publishes appropriate notice of the withdrawal or change, respectively;</text> </subparagraph><subparagraph id="HB8FEF0830E4048E7887B208233470024"><enum>(B)</enum><text>demonstrates that coordination has occurred with a State fish and wildlife agency; and</text>
 </subparagraph><subparagraph id="HE0CC371044D5482DB1FE9DE88F051B3E"><enum>(C)</enum><text>submits to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate written notice of the withdrawal or change, respectively.</text>
 </subparagraph></paragraph><paragraph id="H0E424262EF774FCEBF6BD415DD85B0CB"><enum>(2)</enum><header>Aggregate or cumulative effects</header><text>If the aggregate or cumulative effect of separate withdrawals or changes effectively closes or significantly restricts 1,280 or more acres of land or water, such withdrawals and changes shall be treated as a single withdrawal or change for purposes of paragraph (1).</text>
 </paragraph><paragraph id="HBE3AC9073BB14546AA0D9EE31B9DB556"><enum>(3)</enum><header>Emergency closures</header><text>Nothing in this title prohibits a Federal land management agency from establishing or implementing emergency closures or restrictions of the smallest practicable area to provide for public safety, resource conservation, national security, or other purposes authorized by law. Such an emergency closure shall terminate after a reasonable period of time unless converted to a permanent closure consistent with this title.</text>
 </paragraph></subsection><subsection id="H630A87B04DEF43538DB0804873B0619A"><enum>(h)</enum><header>National park service units not affected</header><text>Nothing in this title shall affect or modify management or use of units of the National Park System.</text>
 </subsection><subsection id="H70225D7AC3124399A5231D0C2E59F802"><enum>(i)</enum><header>No priority</header><text>Nothing in this title requires a Federal land management agency to give preference to recreational fishing, hunting, or shooting over other uses of Federal public land or over land or water management priorities established by Federal law.</text>
 </subsection><subsection id="H53D45FD8EE69400989954E47DC632623"><enum>(j)</enum><header>Consultation with councils</header><text>In fulfilling the duties set forth in this Act, the heads of Federal agencies shall consult with respective advisory councils as established in Executive Order Nos. 12962 and 13443.</text>
				</subsection><subsection id="H03B614901F054C94B658E106C48DDD6C"><enum>(k)</enum><header>Authority of the States</header>
 <paragraph id="H15122B60A167423BB666E42BA47D16C6"><enum>(1)</enum><header>In general</header><text>Nothing in this title shall be construed as interfering with, diminishing, or conflicting with the authority, jurisdiction, or responsibility of any State to exercise primary management, control, or regulation of fish and wildlife under State law (including regulations) on land or water within the State, including on Federal public land.</text>
 </paragraph><paragraph id="HCB269147DF694C62B3A7E5588DFD45E5"><enum>(2)</enum><header>Federal licenses</header><text>Nothing in this title shall be construed to authorize the head of a Federal agency to require a license, fee, or permit to fish, hunt, or trap on land or water in a State, including on Federal public land in the States, except that this paragraph shall not affect the Migratory Bird Stamp requirement set forth in the Migratory Bird Hunting and Conservation Stamp Act (<external-xref legal-doc="usc" parsable-cite="usc/16/718">16 U.S.C. 718</external-xref> et seq.).</text>
					</paragraph></subsection></section><section id="HDB3C4D557D9B4AB2BF83BA182B10FE3E"><enum>404.</enum><header>Volunteer hunters; reports; closures and restrictions</header>
 <subsection id="HECF45C6338AF4F2DB73FE9A5FF58372B"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section:</text> <paragraph commented="no" id="H9804945453FE453691B0719F8AD7DE87"><enum>(1)</enum><header>Public land</header><text display-inline="yes-display-inline">The term <term>public land</term> means—</text>
 <subparagraph commented="no" id="H0318978D3B8F42428DAE2E3C7FF810AF"><enum>(A)</enum><text>units of the National Park System;</text> </subparagraph><subparagraph commented="no" id="H89CED64F59FF47A0B98B6D959161402B"><enum>(B)</enum><text>National Forest System lands; and</text>
 </subparagraph><subparagraph commented="no" id="HBEDD3B0DB12A40B1AC4ECECBEFC08D32"><enum>(C)</enum><text>land and interests in land owned by the United States and under the administrative jurisdiction of—</text> <clause id="H435B276606F944E4BB69E924B416E161"><enum>(i)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service; or</text>
 </clause><clause id="H6BCC35D670DC4176845305D496B430DC"><enum>(ii)</enum><text>the Bureau of Land Management.</text> </clause></subparagraph></paragraph><paragraph id="H79AA32DDA64748709898FDF45475D721"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means—</text>
 <subparagraph id="H259CAAE38F8545DA83F93085E3E1C3A3"><enum>(A)</enum><text>the Secretary of the Interior and includes the Director of the National Park Service, with regard to units of the National Park System;</text>
 </subparagraph><subparagraph id="H1EDBF058A4794166965E4705DF82F8B2"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior and includes the Director of the United States Fish and Wildlife Service, with regard to United States Fish and Wildlife Service lands and waters;</text>
 </subparagraph><subparagraph id="HD4F010A4EE5C498995BF1C88154E286F"><enum>(C)</enum><text>the Secretary of the Interior and includes the Director of the Bureau of Land Management, with regard to Bureau of Land Management lands and waters; and</text>
 </subparagraph><subparagraph id="HF2EA15A414D3420090E5EC7D83A16F90"><enum>(D)</enum><text>the Secretary of Agriculture and includes the Chief of the Forest Service, with regard to National Forest System lands.</text>
 </subparagraph></paragraph><paragraph id="HF246C55D2349438CAFB91E9C446812C6"><enum>(3)</enum><header>Volunteer from the hunting community</header><text>The term <term>volunteer from the hunting community</term> means a volunteer who holds a valid hunting license issued by a State.</text> </paragraph></subsection><subsection commented="no" id="HF41B593C1B0347C191A7248F80FD5B5C"><enum>(b)</enum><header>Volunteer Hunters</header><text display-inline="yes-display-inline">When planning wildlife management involving reducing the size of a wildlife population on public land, the Secretary shall consider the use of and may use volunteers from the hunting community as agents to assist in carrying out wildlife management on public land. The Secretary shall not reject the use of volunteers from the hunting community as agents without the concurrence of the appropriate State wildlife management authorities.</text>
 </subsection><subsection commented="no" id="HF8E6171199A246BCA2AC34CACB2F1D46"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Beginning on the second October 1 after the date of the enactment of this Act and biennially on October 1 thereafter, the Secretary shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that describes—</text>
 <paragraph commented="no" id="H8A43A4C187CF413E8A8565A69DE3C8A5"><enum>(1)</enum><text display-inline="yes-display-inline">any public land administered by the Secretary that was closed to fishing, hunting, and recreational shooting at any time during the preceding year; and</text>
 </paragraph><paragraph commented="no" id="HE3731DF877CA4843B132C9D081FEA2A1"><enum>(2)</enum><text>the reason for the closure.</text> </paragraph></subsection><subsection commented="no" id="HE2E7A4B3743C4D578146AE0786F65D57"><enum>(d)</enum><header>Closures or significant restrictions</header> <paragraph commented="no" id="H85E73367466E4D80BC48B59C0626B14E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Other than closures established or prescribed by land planning actions referred to in section 604(e) or emergency closures described in paragraph (2), a permanent or temporary withdrawal, change of classification, or change of management status of public land that effectively closes or significantly restricts any acreage of public land to access or use for fishing, hunting, recreational shooting, or activities related to fishing, hunting, or recreational shooting, or a combination of those activities, shall take effect only if, before the date of withdrawal or change, the Secretary—</text>
 <subparagraph commented="no" id="HA56DBC91C9104C5987D150BAFA1FE6C7"><enum>(A)</enum><text>publishes appropriate notice of the withdrawal or change, respectively;</text> </subparagraph><subparagraph commented="no" id="H643F8510C792439EA7D0812EFAA9C727"><enum>(B)</enum><text>demonstrates that coordination has occurred with a State fish and wildlife agency; and</text>
 </subparagraph><subparagraph commented="no" id="H241FC15588374DF3BDD0C258906C153B"><enum>(C)</enum><text>submits to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate written notice of the withdrawal or change, respectively.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HDE3C6D19784742FCBD0C1390F234BD45"><enum>(2)</enum><header>Emergency closures</header><text>Nothing in this Act prohibits the Secretary from establishing or implementing emergency closures or restrictions of the smallest practicable area to provide for public safety, resource conservation, national security, or other purposes authorized by law. Such an emergency closure shall terminate after a reasonable period of time unless converted to a permanent closure consistent with this Act.</text>
 </paragraph></subsection></section><section id="H2B407E3844774998B7D28B44C9BA756B"><enum>405.</enum><header>Withdrawal of existing rule regarding hunting and trapping in Alaska</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of the Interior shall withdraw the final rule entitled <quote>Alaska; Hunting and Trapping in National Preserves</quote> and published in the Federal Register on October 23, 2015 (80 Fed. Reg. 64325), and shall not issue a rule that is substantially similar to that rule.</text>
			</section></title><title id="HB75731E0CE5945C2BE12C5F271F24102"><enum>V</enum><header>Farmer and Hunter Protection Act</header>
 <section id="H3E5F9864BAD9476B919389E2FFD1C62A"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Hunter and Farmer Protection Act</quote>.</text> </section><section id="H2C034C6B1CFC4AFEBBF485AE874AE155"><enum>502.</enum><header>Baiting of migratory game birds</header><text display-inline="no-display-inline">Section 3 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/704">16 U.S.C. 704</external-xref>) is amended by striking subsection (b) and inserting the following:</text>

 <paragraph id="H6A0751388BCC45E5B6324AA03320CA37"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H42E580F0EA944D52939F5CC6FBE6196D"><enum>(A)</enum><header>Baited area</header> <clause id="H89E3123CBA724CF1BB6DC2DBCE85AE8F"><enum>(i)</enum><header>In general</header><text>The term <term>baited area</term> means—</text>
 <subclause id="H78C5F7294B9E49E489B077541C92AAF9"><enum>(I)</enum><text>any area on which salt, grain, or other feed has been placed, exposed, deposited, distributed, or scattered, if the salt, grain, or feed could lure or attract migratory game birds; and</text>
 </subclause><subclause id="H80A7112D84C8444EB19BE11ABF630B74"><enum>(II)</enum><text>in the case of waterfowl, cranes (family Gruidae), and coots (family Rallidae), a standing, unharvested crop that has been manipulated through activities such as mowing, discing, or rolling, unless the activities are normal agricultural practices.</text>
 </subclause></clause><clause id="HD462EBF476F242D98EAF4706C5374C82"><enum>(ii)</enum><header>Exclusions</header><text>An area shall not be considered to be a <quote>baited area</quote> if the area—</text> <subclause id="H39EAC6926FF6444BA35C915CC4DE048F"><enum>(I)</enum><text>has been treated with a normal agricultural practice;</text>
 </subclause><subclause id="HADA7D984A350462E81F33AB30B47E628"><enum>(II)</enum><text>has standing crops that have not been manipulated; or</text> </subclause><subclause id="H86DF003960D44A7D90E0D648E6C7DD88"><enum>(III)</enum><text>has standing crops that have been or are flooded.</text>
 </subclause></clause></subparagraph><subparagraph id="H30FB4F3A68D8403CB0AA3D067196BDB7"><enum>(B)</enum><header>Baiting</header><text>The term <term>baiting</term> means the direct or indirect placing, exposing, depositing, distributing, or scattering of salt, grain, or other feed that could lure or attract migratory game birds to, on, or over any areas on which a hunter is attempting to take migratory game birds.</text>
 </subparagraph><subparagraph id="H897A61D40A9F44E1A67EF4A8675A71F9"><enum>(C)</enum><header>Migratory game bird</header><text>The term <term>migratory game bird</term> means migratory bird species—</text> <clause id="H861FA014B5C243A09EE7D47ACE7D52D3"><enum>(i)</enum><text>that are within the taxonomic families of Anatidae, Columbidae, Gruidae, Rallidae, and Scolopacidae; and</text>
 </clause><clause id="H5278D08D8C5345A1AC7B888E14886EEB"><enum>(ii)</enum><text>for which open seasons are prescribed by the Secretary of the Interior.</text> </clause></subparagraph><subparagraph id="HDF3AD85A71E5434A8FC92B4775521E79"><enum>(D)</enum><header>Normal agricultural practice</header> <clause id="HA93E2E08771E4C6181E9A79A75F7A524"><enum>(i)</enum><header>In general</header><text>The term <term>normal agricultural practice</term> means any practice in one annual growing season that—</text>
 <subclause id="H8FBF8A569F2B45478BD3E20468C47BA5"><enum>(I)</enum><text>is carried out in order to produce a marketable crop, including planting, harvest, postharvest, or soil conservation practices; and</text>
 </subclause><subclause id="H59370AE00692404984B0EE6521EDFE5F"><enum>(II)</enum><text>is recommended for the successful harvest of a given crop by the applicable State office of the Cooperative Extension System of the Department of Agriculture, in consultation with, and if requested, the concurrence of, the head of the applicable State department of fish and wildlife.</text>
									</subclause></clause><clause id="HF6033819004C49D5A5EBFF718707F17E"><enum>(ii)</enum><header>Inclusions</header>
 <subclause id="H079420F941E34F4DABCFF454FED47F44"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), the term <term>normal agricultural practice</term> includes the destruction of a crop in accordance with practices required by the Federal Crop Insurance Corporation for agricultural producers to obtain crop insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501</external-xref> et seq.) on land on which a crop during the current or immediately preceding crop year was not harvestable due to a natural disaster (including any hurricane, storm, tornado, flood, high water, wind-driven water, tidal wave, tsunami, earthquake, volcanic eruption, landslide, mudslide, drought, fire, snowstorm, or other catastrophe that is declared a major disaster by the President in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>)).</text>
 </subclause><subclause id="H066A5A0152694686AB8A29F498618C76"><enum>(II)</enum><header>Limitations</header><text>The term <term>normal agricultural practice</term> only includes a crop described in subclause (I) that has been destroyed or manipulated through activities that include (but are not limited to) mowing, discing, or rolling if the Federal Crop Insurance Corporation certifies that flooding was not an acceptable method of destruction to obtain crop insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501</external-xref> et seq.).</text>
 </subclause></clause></subparagraph><subparagraph id="HFBBA4F7FAE5547539EFD2276941C9E54"><enum>(E)</enum><header>Waterfowl</header><text>The term <term>waterfowl</term> means native species of the family Anatidae.</text> </subparagraph></paragraph><paragraph id="H2234A596D7564AA1AEABFE9D1CB2E7F5"><enum>(2)</enum><header>Prohibition</header><text>It shall be unlawful for any person—</text>
 <subparagraph id="H3432689801DC4132A39C13AA721CCA3B"><enum>(A)</enum><text display-inline="yes-display-inline">to take any migratory game bird by baiting or on or over any baited area, if the person knows or reasonably should know that the area is a baited area; or</text>
 </subparagraph><subparagraph id="H2F164B8A9DB34ABB8D4D33D1764F369B"><enum>(B)</enum><text display-inline="yes-display-inline">to place or direct the placement of bait on or adjacent to an area for the purpose of causing, inducing, or allowing any person to take or attempt to take any migratory game bird by baiting or on or over the baited area.</text>
 </subparagraph></paragraph><paragraph id="HA2642B607204432AA108209E48B7BFE3"><enum>(3)</enum><header>Regulations</header><text>The Secretary of the Interior may promulgate regulations to implement this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section></title><title id="HDB5DDD886C914CCD8BBE583B06DD9987"><enum>VI</enum><header>Transporting Bows Across National Park Service Lands</header> <section id="H647E88BFE860440D98FC9A81920CB2F3"><enum>601.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Hunter Access Corridors Act</quote>.</text>
			</section><section id="H382D6AC2588440D8BE5529B9E7C84C7D"><enum>602.</enum><header>Bowhunting opportunity and wildlife stewardship</header>
 <subsection id="HA2F708F91E13477CA86CC74E26AFC070"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/1015">chapter 1015</external-xref> of title 54, United States Code, is amended by adding at the end the following:</text>

 <subsection id="H07998E2922A54158A37DEB378CFE54BF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H2B8A5AF0DCDF4C0B8AEEDB23A13B6352"><enum>(1)</enum><header>Not ready for immediate use</header><text>The term <term>not ready for immediate use</term> means—</text>
 <subparagraph id="H73C63CAC363A417BBF1E32280C32CD03"><enum>(A)</enum><text>a bow or crossbow, the arrows of which are secured or stowed in a quiver or other arrow transport case; and</text>
 </subparagraph><subparagraph id="H5A9395B81D7947669CDAC0C3E66F83B5"><enum>(B)</enum><text>with respect to a crossbow, uncocked.</text> </subparagraph></paragraph><paragraph id="HC9B73236719A41BF865E4BCF72156192"><enum>(2)</enum><header>Valid hunting license</header><text>The term <term>valid hunting license</term> means a State-issued hunting license that authorizes an individual to hunt on private or public land adjacent to the System unit in which the individual is located while in possession of a bow or crossbow that is not ready for immediate use.</text>
								</paragraph></subsection><subsection id="H2A754B278A0A4F30B1F76035FD07C6BB"><enum>(b)</enum><header>Transportation authorized</header>
 <paragraph id="HB1DB4E4FB8D74FF99D49C8340F073716"><enum>(1)</enum><header>In general</header><text>The Director shall not require a permit for, or promulgate or enforce any regulation that prohibits an individual from transporting bows and crossbows that are not ready for immediate use across any System unit if—</text>
 <subparagraph id="H276970FC5C5D45CDB81C4BD6B5CBA99F"><enum>(A)</enum><text>in the case of an individual traversing the System unit on foot—</text> <clause id="HEABF56F1972049009164D1A3F95835F9"><enum>(i)</enum><text>the individual is not otherwise prohibited by law from possessing the bows and crossbows;</text>
 </clause><clause id="HABE0333FE8194A3AA99DE2585FBEDE87"><enum>(ii)</enum><text>the bows or crossbows are not ready for immediate use throughout the period during which the bows or crossbows are transported across the System unit;</text>
 </clause><clause id="H9222179CFBE7450692C7E8B262C7B95B"><enum>(iii)</enum><text>the possession of the bows and crossbows is in compliance with the law of the State in which the System unit is located; and</text>
										</clause><clause id="H4D26740461524EE5BBC36F03CE9F8768"><enum>(iv)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="HADB545B8CC77474E85BCA1B2D31037F0"><enum>(I)</enum><text>the individual possesses a valid hunting license;</text> </subclause><subclause changed="added" committee-id="HII00" id="H717C42B760AC41708F1B975F1C34E5EF" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>the individual is traversing the System unit en route to a hunting access corridor established under subsection (c)(1); or</text>
 </subclause><subclause changed="added" committee-id="HII00" id="HFBB4B0123FF04122AB00029A060908E3" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>the individual is traversing the System unit in compliance with any other applicable regulations or policies; or</text>
 </subclause></clause></subparagraph><subparagraph id="HF26552D130334DD2B970082C15C4B9F3"><enum>(B)</enum><text>the bows or crossbows are not ready for immediate use and remain inside a vehicle.</text> </subparagraph></paragraph><paragraph id="HC580C8EF1C37484187742EE6F5B9EF3E"><enum>(2)</enum><header>Enforcement</header><text>Nothing in this subsection limits the authority of the Director to enforce laws (including regulations) prohibiting hunting or the taking of wildlife in any System unit.</text>
								</paragraph></subsection><subsection id="HB8658C457E854931B477846A30B7F11C"><enum>(c)</enum><header>Establishment of hunter access corridors</header>
 <paragraph id="H2D47F6E52FD44048A20C3BCAA7492B6F"><enum>(1)</enum><header>In general</header><text>On a determination by the Director under paragraph (2), the Director may establish and publish (in accordance with section 1.5 of title 36, Code of Federal Regulations (or a successor regulation)), on a publicly available map, hunter access corridors across System units that are used to access public land that is—</text>
 <subparagraph id="HF5C93D5A20BB440A96B1FCC9F4E25E78"><enum>(A)</enum><text>contiguous to a System unit; and</text> </subparagraph><subparagraph id="H40BF1514873D4DDE899072BAB763C7C3"><enum>(B)</enum><text>open to hunting.</text>
 </subparagraph></paragraph><paragraph id="H6F99F482DD864FF194E3AC45320D2606"><enum>(2)</enum><header>Determination by director</header><text>The determination referred to in paragraph (1) is a determination that the hunter access corridor would provide wildlife management or visitor experience benefits within the boundary of the System unit in which the hunter access corridor is located.</text>
 </paragraph><paragraph id="H46DB5EC5B95648439D9A98832A4B69D5"><enum>(3)</enum><header>Hunting season</header><text>The hunter access corridors shall be open for use during hunting seasons.</text> </paragraph><paragraph id="H6B3D226A771B4EA3903F96F6CAFA2817"><enum>(4)</enum><header>Exception</header><text>The Director may establish limited periods during which access through the hunter access corridors is closed for reasons of public safety, administration, or compliance with applicable law. Such closures shall be clearly marked with signs and dates of closures, and shall not include gates, chains, walls, or other barriers on the hunter access corridor.</text>
 </paragraph><paragraph id="H37856A6DC6554362AC4DCD2ED19786E3"><enum>(5)</enum><header>Identification of corridors</header><text>The Director shall—</text> <subparagraph id="H227FDBBED2FD41E3B2E6DEB642D3BEBB"><enum>(A)</enum><text>make information regarding hunter access corridors available on the individual website of the applicable System unit; and</text>
 </subparagraph><subparagraph id="H34AA6A4D889F47D2809A4BF732AEB5E2"><enum>(B)</enum><text>provide information regarding any processes established by the Director for transporting legally taken game through individual hunter access corridors.</text>
 </subparagraph></paragraph><paragraph id="H904FEE563EDC4790B0C4338C88677180"><enum>(6)</enum><header>Registration; transportation of game</header><text>The Director may—</text> <subparagraph id="H271D26D23F444E779289679B2DF9FE5A"><enum>(A)</enum><text>provide registration boxes to be located at the trailhead of each hunter access corridor for self-registration;</text>
 </subparagraph><subparagraph id="H5A7C1578B0FB4A7DBC1B04838E6417F9"><enum>(B)</enum><text>provide a process for online self-registration; and</text> </subparagraph><subparagraph id="HD9B479AFD3174B20BCF04534A01AE144"><enum>(C)</enum><text>allow nonmotorized conveyances to transport legally taken game through a hunter access corridor established under this subsection, including game carts and sleds.</text>
 </subparagraph></paragraph><paragraph id="HD2897B18B81A4E89AC95EA0890320EBD"><enum>(7)</enum><header>Consultation with states</header><text>The Director shall consult with each applicable State wildlife agency to identify appropriate hunter access corridors.</text>
 </paragraph></subsection><subsection id="H02A5C150787D400792D93982ED22CDEF"><enum>(d)</enum><header>Effect</header><text>Nothing in this section—</text> <paragraph id="HB8F9732B945242238A1E1EB5654AE658"><enum>(1)</enum><text>diminishes, enlarges, or modifies any Federal or State authority with respect to hunting, recreational shooting, or any other recreational activities within the boundaries of a System unit; or</text>
 </paragraph><paragraph id="HE3AC919D09784A718D776C70B5DE226E"><enum>(2)</enum><text>authorizes—</text> <subparagraph id="HF5CAF5AB03754B07A470DE0AB0205EA3"><enum>(A)</enum><text>the establishment of new trails in System units; or</text>
 </subparagraph><subparagraph id="HD2754ED24E8A498FA55CEEC3596BB477"><enum>(B)</enum><text>authorizes individuals to access areas in System units, on foot or otherwise, that are not open to such access.</text>
									</subparagraph></paragraph></subsection><subsection id="HB04262D676D64358A0A8BCD280491F92"><enum>(e)</enum><header>No major federal action</header>
 <paragraph id="H1C26BA6799C94D2E900FD4D73DF7C714"><enum>(1)</enum><header>In general</header><text>Any action taken under this section shall not be considered a major Federal action significantly affecting the quality of the human environment under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </paragraph><paragraph id="H9F2AF307F7634E5DA3CCE94E82B802AF"><enum>(2)</enum><header>No additional action required</header><text>No additional identification, analyses, or consideration of environmental effects (including cumulative environmental effects) is necessary or required with respect to an action taken under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 </paragraph><paragraph id="H54B16BD585FE4C12A1969655782570F4"><enum>(2)</enum><header>Online databases</header><text>The online databases required by section 504(e) of title 5, United States Code, and section 2412(d)(5) of title 28, United States Code, shall be established as soon as practicable after the date of the enactment of this Act, but in no case later than 1 year after the date of the enactment of this Act.</text>
					</paragraph></subsection></section></title><title id="H41A38077D7D44B9DA9932A0A9D0A9582"><enum>X</enum><header>Good Samaritan Search and Recovery</header>
 <section id="HC88C5BAB396342829D64E42D04F273FC"><enum>1001.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Good Samaritan Search and Recovery Act</quote>.</text> </section><section id="H9335ADDECDC04A53A0FA0E9DFB7A63CC"><enum>1002.</enum><header>Expedited access to certain Federal land</header> <subsection id="H83EB9EF186E04EF586CFBCB4240AD892"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="HA8BC9BDB1C494FD4AFC59AAE30209CE2"><enum>(1)</enum><header>Eligible</header><text>The term <term>eligible</term>, with respect to an organization or individual, means that the organization or individual, respectively, is—</text>
 <subparagraph id="H949E930A055345258BF16FD20AFB2AED"><enum>(A)</enum><text>acting in a not-for-profit capacity; and</text> </subparagraph><subparagraph id="HD524F73273CF4919BACB799A3953F784"><enum>(B)</enum><text>composed entirely of members who, at the time of the good Samaritan search-and-recovery mission, have attained the age of majority under the law of the State where the mission takes place.</text>
 </subparagraph></paragraph><paragraph id="H08E373D131584CBF8B242A770439786D"><enum>(2)</enum><header>Good samaritan search-and-recovery mission</header><text>The term <term>good Samaritan search-and-recovery mission</term> means a search conducted by an eligible organization or individual for one or more missing individuals believed to be deceased at the time that the search is initiated.</text>
 </paragraph><paragraph id="HE367F080F319492E9C1AA4A5B0BD6F6F"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior or the Secretary of Agriculture, as applicable.</text> </paragraph></subsection><subsection id="H7E2C142501CA4C5C943BAFBD8A469713"><enum>(b)</enum><header>Process</header> <paragraph id="H069E426061E34A81AD9760489C084858"><enum>(1)</enum><header>In general</header><text>Each Secretary shall develop and implement a process to expedite access to Federal land under the administrative jurisdiction of the Secretary for eligible organizations and individuals to request access to Federal land to conduct good Samaritan search-and-recovery missions.</text>
 </paragraph><paragraph id="H888B13B15A794D2EA0C6DBBDC1C83E34"><enum>(2)</enum><header>Inclusions</header><text>The process developed and implemented under this subsection shall include provisions to clarify that—</text>
 <subparagraph id="H2A384F9D05B24147AD604EC8C3E2558A"><enum>(A)</enum><text>an eligible organization or individual granted access under this section—</text> <clause id="H769E031A13AD44A1A6604B357F7C3626"><enum>(i)</enum><text>shall be acting for private purposes; and</text>
 </clause><clause id="H4CD543DEF6A64CA98C2F5F0E06A109DC"><enum>(ii)</enum><text>shall not be considered to be a Federal volunteer;</text> </clause></subparagraph><subparagraph id="H1EC145B2A854428BA66ED27A0CA9FBF6"><enum>(B)</enum><text>an eligible organization or individual conducting a good Samaritan search-and-recovery mission under this section shall not be considered to be a volunteer under section 102301(c) of title 54, United States Code;</text>
 </subparagraph><subparagraph id="H4F44633D362C4E038C00EA2DE1C906B3"><enum>(C)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>), shall not apply to an eligible organization or individual carrying out a privately requested good Samaritan search-and-recovery mission under this section; and</text>
 </subparagraph><subparagraph id="H774CBAE93321423BB4E804E765128259"><enum>(D)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code (commonly known as the “Federal Employees’ Compensation Act”), shall not apply to an eligible organization or individual conducting a good Samaritan search-and-recovery mission under this section, and the conduct of the good Samaritan search-and-recovery mission shall not constitute civilian employment.</text>
 </subparagraph></paragraph></subsection><subsection id="HC93FA52CB49445BF969B7D83D92EB505"><enum>(c)</enum><header>Release of Federal Government from liability</header><text>The Secretary shall not require an eligible organization or individual to have liability insurance as a condition of accessing Federal land under this section, if the eligible organization or individual—</text>
 <paragraph id="HC52E08C0EFD848AB911BCDFE88ED49A8"><enum>(1)</enum><text>acknowledges and consents, in writing, to the provisions described in subparagraphs (A) through (D) of subsection (b)(2); and</text>
 </paragraph><paragraph id="H6E00E7EE7FDA4841AE486C13FDE3472C"><enum>(2)</enum><text>signs a waiver releasing the Federal Government from all liability relating to the access granted under this section and agrees to indemnify and hold harmless the United States from any claims or lawsuits arising from any conduct by the eligible organization or individual on Federal land.</text>
					</paragraph></subsection><subsection id="H772230666E44401CAC82CBEAF77C7E69"><enum>(d)</enum><header>Approval and denial of requests</header>
 <paragraph id="H2B7FFF89FB0D40D4A26DAD687195E400"><enum>(1)</enum><header>In general</header><text>The Secretary shall notify an eligible organization or individual of the approval or denial of a request by the eligible organization or individual to carry out a good Samaritan search-and-recovery mission under this section by not later than 48 hours after the request is made.</text>
 </paragraph><paragraph id="HF6D1CFAAD12A4AF5A3D9E3E576DB58D2"><enum>(2)</enum><header>Denials</header><text>If the Secretary denies a request from an eligible organization or individual to carry out a good Samaritan search-and-recovery mission under this section, the Secretary shall notify the eligible organization or individual of—</text>
 <subparagraph id="HA0B0865E8B3D4256BA34E79D88723556"><enum>(A)</enum><text>the reason for the denial of the request; and</text> </subparagraph><subparagraph id="H8127847E55FA433CAAAB7AC7257683BD"><enum>(B)</enum><text>any actions that the eligible organization or individual can take to meet the requirements for the request to be approved.</text>
 </subparagraph></paragraph></subsection><subsection id="H154238A9E3394105AD191D06289A6157"><enum>(e)</enum><header>Partnerships</header><text>Each Secretary shall develop search-and-recovery-focused partnerships with search-and-recovery organizations—</text>
 <paragraph id="HA08E4D1FBFEC4F6D8B11EDD08E5ADA9F"><enum>(1)</enum><text>to coordinate good Samaritan search-and-recovery missions on Federal land under the administrative jurisdiction of the Secretary; and</text>
 </paragraph><paragraph id="H37E16377AFA34DEA9914820314AE9A5B"><enum>(2)</enum><text>to expedite and accelerate good Samaritan search-and-recovery mission efforts for missing individuals on Federal land under the administrative jurisdiction of the Secretary.</text>
 </paragraph></subsection><subsection id="H47CE046F1375406595269B6EAC51CD58"><enum>(f)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretaries shall submit to Congress a joint report describing—</text>
 <paragraph id="H1F79965E763B419091D98B41987EA841"><enum>(1)</enum><text>plans to develop partnerships described in subsection (e)(1); and</text> </paragraph><paragraph id="HEE13EB5BFA014A7BB5D1C2E1943C021E"><enum>(2)</enum><text>efforts carried out to expedite and accelerate good Samaritan search-and-recovery mission efforts for missing individuals on Federal land under the administrative jurisdiction of each Secretary pursuant to subsection (e)(2).</text>
					</paragraph></subsection></section></title><title id="H1A2618CC10AA4B848898ED090D9FCE4E"><enum>XI</enum><header>Interstate Transportation of Firearms or Ammunition</header>
			<section id="H215214C34DE7478BA668E384D041A681"><enum>1101.</enum><header>Interstate transportation of firearms or ammunition</header>
 <subsection id="H430E706BB67A493992B8AE9F1FD51CFD"><enum>(a)</enum><header>In general</header><text>Section 926A of title 18, United States Code, is amended to read as follows:</text> <quoted-block changed="added" committee-id="HII00" id="HDA27E4BA80F841729DE257BE5D2D61B7" reported-display-style="italic" style="USC"> <section id="HF0554E880B5849BDB0FBE264E90A05EB"><enum>926A.</enum><header>Interstate transportation of firearms or ammunition</header> <subsection id="H0A1A630EED2546DB867430EFEE90F54D"><enum>(a)</enum><text>Notwithstanding any provision of any law, rule, or regulation of a State or any political subdivision thereof:</text>
 <paragraph id="H478EC20E1459484DABC0B87736E52D21"><enum>(1)</enum><text>A person who is not prohibited by this chapter from possessing, transporting, shipping, or receiving a firearm or ammunition shall be entitled to transport a firearm for any lawful purpose from any place where the person may lawfully possess, carry, or transport the firearm to any other such place if, during the transportation, the firearm is unloaded, and—</text>
 <subparagraph id="H4CF567B298DE4872A737990EBF6BC35F"><enum>(A)</enum><text>if the transportation is by motor vehicle, the firearm is—</text> <clause id="H699B7D69249444C895C8F13EB5EA8E1C"><enum>(i)</enum><text>not directly accessible from the passenger compartment of the vehicle;</text>
 </clause><clause id="H715360C10D564C7AAD059EFB824C553B"><enum>(ii)</enum><text>in a locked container other than the glove compartment or console; or</text> </clause><clause id="H7A95D5DE08014D0EA7E01EC45D584FEE"><enum>(iii)</enum><text>secured by a secure gun storage or safety device; or</text>
 </clause></subparagraph><subparagraph id="HD3748F5E692A4A19917300D581F5D4C2"><enum>(B)</enum><text>if the transportation is by other means, the firearm is in a locked container or secured by a secure gun storage or safety device.</text>
 </subparagraph></paragraph><paragraph id="H9FB4B23F4AF64326A6464A59747D5171"><enum>(2)</enum><text>A person who is not prohibited by this chapter from possessing, transporting, shipping, or receiving a firearm or ammunition shall be entitled to transport ammunition for any lawful purpose from any place where the person may lawfully possess, carry, or transport the ammunition, to any other such place if, during the transportation, the ammunition is not loaded into a firearm, and—</text>
 <subparagraph id="H5AFCB53F04674096B2701C882C79B6AD"><enum>(A)</enum><text>if the transportation is by motor vehicle, the ammunition is—</text> <clause id="HB5543007DA1149A79118B2E9E17C4781"><enum>(i)</enum><text>not directly accessible from the passenger compartment of the vehicle; or</text>
 </clause><clause id="H79A100469D3D45088333F53A6123C4B2"><enum>(ii)</enum><text>is in a locked container other than the glove compartment or console; or</text> </clause></subparagraph><subparagraph id="H3D6181EA56C949058636FA215B5B88BC"><enum>(B)</enum><text>if the transportation is by other means, the ammunition is in a locked container.</text>
 </subparagraph></paragraph></subsection><subsection id="H2474079326044E3A8A7A48CDA6D1F53E"><enum>(b)</enum><text>In subsection (a), the term <term>transport</term> includes staying in temporary lodging overnight, stopping for food, fuel, vehicle maintenance, an emergency, medical treatment, and any other activity incidental to the transport.</text>
							</subsection><subsection id="H023E6EFDBCC741569B8CB8647400E2A9"><enum>(c)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H64D930F08E3343D499C07BCFB9244D8D"><enum>(1)</enum><text>A person who is transporting a firearm or ammunition may not be arrested or otherwise detained for violation of any law or any rule or regulation of a State or any political subdivision thereof related to the possession, transportation, or carrying of firearms, unless there is probable cause to believe that the person is doing so in a manner not provided for in subsection (a).</text>
 </paragraph><paragraph changed="added" committee-id="HII00" id="H081E0297214D482AAC8C30A98B10D6CB" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>When a person asserts this section as a defense in a criminal proceeding, the prosecution shall bear the burden of proving, beyond a reasonable doubt, that the conduct of the person did not satisfy the conditions set forth in subsection (a).</text>
 </paragraph><paragraph changed="added" committee-id="HII00" id="HACD09F828CD546FB9AD1F0B6B106B4B0" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>When a person successfully asserts this section as a defense in a criminal proceeding, the court shall award the prevailing defendant a reasonable attorney’s fee.</text>
								</paragraph></subsection><subsection id="H3045450F14F44CBC8E42B08C5B508B88"><enum>(d)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H3D06B8F472354B48AA08C369C148D2F3"><enum>(1)</enum><text>A person who is deprived of any right, privilege, or immunity secured by this section, section 926B or 926C, under color of any statute, ordinance, regulation, custom, or usage of any State or any political subdivision thereof, may bring an action in any appropriate court against any other person, including a State or political subdivision thereof, who causes the person to be subject to the deprivation, for damages and other appropriate relief.</text>
 </paragraph><paragraph changed="added" committee-id="HII00" id="H28B739674BEC4EF79AED9F4D1E3200CA" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The court shall award a plaintiff prevailing in an action brought under paragraph (1) damages and such other relief as the court deems appropriate, including a reasonable attorney’s fee.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA2A9607B6B044D95B28436DB16707E38"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended in the item relating to section 926A by striking <quote>firearms</quote> and inserting <quote>firearms or ammunition</quote>.</text> </subsection></section></title><title id="HB14C315E812441549B7D3167343F80EC"><enum>XII</enum><header>Polar Bear Conservation and Fairness Act</header> <section id="H4E3BAEA039534F39B078178AD048FAF5" section-type="subsequent-section"><enum>1201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Polar Bear Conservation and Fairness Act</short-title></quote>.</text>
 </section><section id="HE410D876C9CB4740A27157BDE19D7D0C" section-type="subsequent-section"><enum>1202.</enum><header>Permits for importation of polar bear trophies taken in sport hunts in Canada</header><text display-inline="no-display-inline">Section 104(c)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)(5)(D)</external-xref>) is amended to read as follows:</text>

					<subparagraph id="H59A8FB6E7B7D4C19AE1666210532916C" indent="up1"><enum>(D)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HCA77AAC940A6459A89090493461EDC1E"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of the Interior shall, expeditiously after the expiration of the applicable 30-day period under subsection (d)(2), issue a permit for the importation of any polar bear part (other than an internal organ) from a polar bear taken in a sport hunt in Canada to any person—</text>
 <subclause changed="added" committee-id="HII00" id="HBAC4FA90168F49C3993E87AB6176AA69" indent="up1" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">who submits, with the permit application, proof that the polar bear was legally harvested by the person before February 18, 1997; or</text>
 </subclause><subclause changed="added" committee-id="HII00" id="HAB7CC4C19DCB476AB42948E34A23A8A7" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">who has submitted, in support of a permit application submitted before May 15, 2008, proof that the polar bear was legally harvested by the person before May 15, 2008, from a polar bear population from which a sport-hunted trophy could be imported before that date in accordance with section 18.30(i) of title 50, Code of Federal Regulations.</text>
 </subclause></clause><clause changed="added" committee-id="HII00" id="H01A78B1859F24128819A91D7C3A6003F" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(I) without regard to subparagraphs (A) and (C)(ii) of this paragraph, subsection (d)(3), and sections 101 and 102. Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(I). This clause shall not apply to polar bear parts that were imported before June 12, 1997.</text>
 </clause><clause changed="added" committee-id="HII00" id="HF534C06E9E83461E87E7735A0F016654" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(II) without regard to subparagraph (C)(ii) of this paragraph or subsection (d)(3). Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(II). This clause shall not apply to polar bear parts that were imported before the date of enactment of the <short-title>Polar Bear Conservation and Fairness Act</short-title>.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H857B5494190D4BE79E38C6673F7BF9B8"><enum>XIII</enum><header>North American Wetlands Conservation Extension</header>
 <section id="H7366BA943E5745A2AC856BCDEA0F2DFB" section-type="subsequent-section"><enum>1301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>North American Wetlands Conservation Extension Act</short-title></quote>.</text> </section><section id="H0777C1044A184C17815A0ACC60E680E2"><enum>1302.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 7(c) of the North American Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4406">16 U.S.C. 4406(c)</external-xref>) is amended by striking <quote>not to exceed—</quote> and all that follows through paragraph (5) and inserting <quote>not to exceed $50,000,000 for each of fiscal years 2018 through 2022.</quote>.</text>
			</section><section id="H7B7AED8B28674798926D74F6533F96C4"><enum>1303.</enum><header>Limitation on expenditures for purchase of land</header>
 <subsection id="H9B5A87A3A19F41629A2890ED6B5A8D61"><enum>(a)</enum><header>Limitation</header><text>Section 6 of the North American Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4405">16 U.S.C. 4405</external-xref>) is amended by adding at the end the following:</text>

 </subsection><subsection id="HCB8106F25F92481D85B7F9C9D607407E"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall not apply with respect to any specific land acquisition required by contract or other agreement entered into before the date of enactment of this Act.</text>
 </subsection></section><section id="H8938F64CE8E446DEA48EF108385F538B"><enum>1304.</enum><header>Enhanced report on expenditures</header><text display-inline="no-display-inline">Section 10(2) of the North American Wetlands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4409">16 U.S.C. 4409(2)</external-xref>) is amended to read as follows:</text>

			</section></title><title id="H4DC3140B099B44FCB239DED57FD3882F"><enum>XIV</enum><header>Gray Wolves</header>
			<section id="HD78DA9E75BF34C19B851E0F0BC8E4891"><enum>1401.</enum><header>Reissuance of final rules relating to gray wolves in the Western Great Lakes and the State of
			 Wyoming</header>
 <subsection id="H996D4B7C0AA74CB3A42C1159BEA752F8"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, not later than 60 days after the date of enactment of this Act, the Secretary of the Interior shall reissue—</text>
 <paragraph id="H66310FA448584EF79FA59D51508B724E"><enum>(1)</enum><text>the final rule entitled <quote>Endangered and Threatened Wildlife and Plants; Revising the Listing of the Gray Wolf (Canis lupus) in the Western Great Lakes</quote> (76 Fed. Reg. 81666 (December 28, 2011)); and</text>
 </paragraph><paragraph id="HBD5D97940A5D4B5A9C805C46FC289A04"><enum>(2)</enum><text>the final rule entitled <quote>Endangered and Threatened Wildlife and Plants; Removal of the Gray Wolf in Wyoming From the Federal List of Endangered and Threatened Wildlife and Removal of the Wyoming Wolf Population’s Status as an Experimental Population</quote> (77 Fed. Reg. 55530 (September 10, 2012)).</text>
 </paragraph></subsection><subsection id="H5CED697628C44C8C94E58359B51E66BC"><enum>(b)</enum><header>No judicial review</header><text>The reissuance of the final rules described in subsection (a) shall not be subject to judicial review.</text>
				</subsection></section></title><title id="H151052FBF3DE4316BB25059F2D13F1BE"><enum>XV</enum><header>Hearing Protection</header>
 <section id="H88DA142B690A46C4ABB469D87F5B05F9" section-type="subsequent-section"><enum>1501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Hearing Protection Act</short-title></quote>.</text> </section><section id="H3E0925839ED640ACA7A56737F7C4612F"><enum>1502.</enum><header>Equal treatment of silencers and firearms</header> <subsection id="H3DBB1D8AD8F74EDF887534471FDE7E48"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(7) any silencer</quote> and all that follows through <quote>; and (8)</quote> and inserting <quote>and (7)</quote>.</text>
 </subsection><subsection id="H3FEC3214560F47AFBE81B807DB2FD74D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to calendar quarters beginning more than 90 days after the date of the enactment of this Act.</text>
 </subsection></section><section commented="no" id="HCE9C3B332A304FCD912759934AB489D0"><enum>1503.</enum><header>Treatment of certain silencers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5841">Section 5841</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H9E7053DFC0974F6F95FA38133C1AEA7F" reported-display-style="italic" style="OLC"> <subsection commented="no" id="H25236F23142643859A5D88D16A3A63D2"><enum>(f)</enum><header>Firearm silencers</header><text display-inline="yes-display-inline">A person acquiring or possessing a firearm silencer in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, shall be treated as meeting any registration and licensing requirements of the National Firearms Act with respect to such silencer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HD1EE63F42E1F4864B1BF8D45F17FA681" section-type="subsequent-section"><enum>1504.</enum><header>Preemption of certain State laws in relation to firearm silencers</header><text display-inline="no-display-inline">Section 927 of title 18, United States Code, is amended by adding at the end the following: <quote>Notwithstanding the preceding sentence, a law of a State or a political subdivision of a State that imposes a tax, other than a generally applicable sales or use tax, on making, transferring, using, possessing, or transporting a firearm silencer in or affecting interstate or foreign commerce, or imposes a marking, recordkeeping or registration requirement with respect to such a firearm silencer, shall have no force or effect.</quote>.</text>
 </section><section id="H42939082799F41DBBB3B7DE6F143BB10"><enum>1505.</enum><header>Destruction of records</header><text display-inline="no-display-inline">Not later than 365 days after the date of the enactment of this Act, the Attorney General shall destroy any registration of a silencer maintained in the National Firearms Registration and Transfer Record pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986, any application to transfer filed under <external-xref legal-doc="usc" parsable-cite="usc/26/5812">section 5812</external-xref> of the Internal Revenue Code of 1986 that identifies the transferee of a silencer, and any application to make filed under <external-xref legal-doc="usc" parsable-cite="usc/26/5822">section 5822</external-xref> of the Internal Revenue Code of 1986 that identifies the maker of a silencer.</text>
 </section><section id="H0BA4F22F3FC2409D99F678E83D5943A9"><enum>1506.</enum><header>Amendments to title <enum-in-header>18</enum-in-header>, United States Code</header><text display-inline="no-display-inline">Title 18, United States Code, is amended—</text> <paragraph id="HFA921A80B203492D8A008E9C12D3879B"><enum>(1)</enum><text display-inline="yes-display-inline">in section 921(a), by striking paragraph (24) and inserting the following:</text>

 </paragraph><paragraph id="HC32D5D3BE2474486964BCD743AF91B55"><enum>(2)</enum><text display-inline="yes-display-inline">in section 922(b)—</text> <subparagraph id="H0223B224AF4443CDAF45799E65CEAA5B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>shotgun or rifle</quote> the first place it appears and inserting <quote>shotgun, rifle, firearm silencer or firearm muffler</quote>; and</text>

The Attorney General shall grant such a request except on showing good cause that marking the firearm silencer or firearm muffler as requested would not further the purposes of this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></section><section display-inline="no-display-inline" id="H60F5D237AA8D4739A1C6F1C31531FECA" section-type="subsequent-section"><enum>1507.</enum><header>Imposition of tax on firearm silencers or firearm mufflers</header>
 <subsection id="H30073EC9D38C40648CBB3D59D54E2784"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4181">Section 4181</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end of the list relating to <quote>Articles taxable at 10 percent</quote> the following:</text>

 <paragraph id="HEB00E276454D46AAB0C95ACDF231ACB7"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4181 of such Code is amended by striking <quote>other than pistols and revolvers</quote> and inserting <quote>other than articles taxable at 10 percent under this section</quote>.</text> </paragraph><paragraph id="H9AA0F75B06EF4447BD8C608A3D710D7B"><enum>(2)</enum><text display-inline="yes-display-inline">Section 4182(b) of such Code is amended by striking <quote>firearms, pistols, revolvers, shells, and cartridges</quote> and inserting <quote>articles described in section 4181 and</quote>.</text>
 </paragraph><paragraph id="HB61B3B227BE14DB1BEE1B49D4D09784F"><enum>(3)</enum><text>Section 4182(c)(1) of such Code is amended by striking <quote>or firearm</quote> and inserting <quote>firearm, firearm silencer, or firearm muffler,</quote>.</text> </paragraph></subsection><subsection id="HC9C9DF5E62CF4314A0B2972E2C6963B5"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to articles sold by the manufacturer, producer, or importer in any calendar quarter beginning more than 90 days after the date of the enactment of this Act.</text>
				</subsection></section></title><title id="H3BB83C5C39AF48F08AF4946CC87D5366"><enum>XVI</enum><header>Lawful purpose and self-defense</header>
 <section display-inline="no-display-inline" id="HC16023BB82744E3582B7F23060BBA856" section-type="subsequent-section"><enum>1601.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lawful Purpose and Self Defense Act</short-title></quote>.</text> </section><section id="HF4A851DA3BF84C69B99DE83F92F159C2"><enum>1602.</enum><header>Elimination of authority to reclassify popular rifle ammunition as <quote>armor piercing ammunition</quote></header><text display-inline="no-display-inline">Section 921(a)(17) of title 18, United States Code, is amended—</text>
 <paragraph display-inline="no-display-inline" id="H3B2EC9813EB5438CAB184670A940BC64"><enum>(1)</enum><text>in subparagraph (B)(i), by striking <quote>may be used</quote> and inserting <quote>is designed and intended by the manufacturer or importer for use</quote>;</text> </paragraph><paragraph id="HAD09D1527F294AA7A5F09610F01AFCA5"><enum>(2)</enum><text>in subparagraph (B)(ii), by inserting <quote>by the manufacturer or importer</quote> before <quote>for use</quote>; and</text>

				</paragraph></section><section id="HDD129DF647C04E33A37299DBEA86C08A"><enum>1603.</enum><header>Elimination of restrictions on importation of non-National Firearms Act firearm or ammunition that
			 may otherwise be lawfully possessed and sold in the United States</header>
 <subsection id="H9425F2E68BDB40CC9942AD4F3F19A316"><enum>(a)</enum><header>Elimination of prohibitions</header><text>Section 922 of title 18, United States Code, is amended—</text> <paragraph id="HA4F9EEF8AAC74A3D8274FD0B79D02AA5"><enum>(1)</enum><text>in subsection (a), by striking paragraph (7) and inserting the following:</text>
						<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H1DA3B74010B54B0E83E3A827B6B654D9" reported-display-style="italic" style="OLC">
 <paragraph id="H779ACEA1466B4B2ABAB8555004A77EC9"><enum>(7)</enum><text display-inline="yes-display-inline">for any person to manufacture or import armor piercing ammunition, unless the manufacture or importation of the ammunition—</text>
 <subparagraph id="H5F5897DA60EF42F38940368324906C63"><enum>(A)</enum><text>is for the use of the United States, any department or agency of the United States, any State, or any department, agency, or political subdivision of a State;</text>
 </subparagraph><subparagraph id="H5CE1E7E46F344441A4B7772C248D8A93"><enum>(B)</enum><text>is for the purpose of exportation; or</text> </subparagraph><subparagraph id="H3FD2140455D3497F81C0904E2A038880"><enum>(C)</enum><text>is for the purpose of testing or experimentation, and has been authorized by the Attorney General;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph display-inline="no-display-inline" id="HA76650A0B0C14716AB2B76BB56E7135A"><enum>(2)</enum><text>in subsection (l), by striking <quote>925(d) of this chapter</quote> and inserting <quote>925</quote>; and</text> </paragraph><paragraph id="H7497D7623EC74A8E912BF4D27902BF0A"><enum>(3)</enum><text>by striking subsection (r).</text>
 </paragraph></subsection><subsection id="H100D8D0AC6874833A13F5E890CE0D4A8"><enum>(b)</enum><header>Broadening of exceptions</header><text>Section 925 of such title is amended—</text> <paragraph id="H5742AA1F2ACD4787A627FDC8227265AC"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>determined</quote> and all that follows through the end and inserting <quote>intended for the lawful personal use of such member or club.</quote>;</text>
 </paragraph><paragraph id="HDE6CB6AE76714F31844FE379A88BAD81"><enum>(2)</enum><text>in subsection (a)(4), by striking <quote>(A)</quote> and all that follows through <quote>for the</quote> and inserting <quote>intended for the lawful</quote>; and</text> </paragraph><paragraph id="HD70BB476D8B94DC986D72385AAFF3E67"><enum>(3)</enum><text>by striking subsections (d) through (f) and inserting the following:</text>

 <paragraph commented="no" display-inline="yes-display-inline" id="H5BF9A8950E154CF6A8441F8D6A700C19"><enum>(1)</enum><text display-inline="yes-display-inline">Within 30 days after the Attorney General receives an application therefor, the Attorney General shall authorize a firearm or ammunition to be imported or brought into the United States or any possession thereof if—</text>
 <subparagraph changed="added" committee-id="HII00" id="H8B1993001F1C4E918F156FB7D77C5D25" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the firearm or ammunition is being imported or brought in for scientific, research, testing, or experimentation purposes;</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="HAA1BF9783D164FFFB64CE3AD4F952B2A" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the firearm is an unserviceable firearm (other than a machine gun as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845(b)</external-xref> of the Internal Revenue Code of 1986 that is readily restorable to firing condition) imported or brought in as a curio or museum piece;</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H52CA50C4DF9D4EA3B8FF32098ECD4AE0" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>the firearm is not a firearm as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845(a)</external-xref> of the Internal Revenue Code of 1986;</text> </subparagraph><subparagraph changed="added" committee-id="HII00" id="HCA57FAE7CF504BB8B24CCD72275438C0" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">the ammunition is not armor piercing ammunition (as defined in section 921(a)(17)(B) of this title), unless subparagraph (A), (E), (F), or (G) applies;</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H54866C2ABB0E44EFA5822F9A1AA2DD64" indent="up1" reported-display-style="italic"><enum>(E)</enum><text display-inline="yes-display-inline">the firearm or ammunition is being imported or brought in for the use of the United States, any department or agency of the United States, any State, or any department, agency, or political subdivision of a State;</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H6F7063E6A32C40C29EDA9558D132B473" indent="up1" reported-display-style="italic"><enum>(F)</enum><text>the firearm or ammunition is being imported or brought in for the purpose of exportation;</text> </subparagraph><subparagraph changed="added" committee-id="HII00" id="HB9478976A5E84EBDB9722861E133827E" indent="up1" reported-display-style="italic"><enum>(G)</enum><text>the firearm or ammunition was previously taken out of the United States or a possession thereof by the person who is bringing in the firearm or ammunition; or</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H53CAEDD0DBA74443A8942FDEA93D80FF" indent="up1" reported-display-style="italic"><enum>(H)</enum><text display-inline="yes-display-inline">the firearm is a firearm defined as curio or relic by the Attorney General under section 921(a)(13) of this title.</text>
 </subparagraph></paragraph><paragraph changed="added" committee-id="HII00" id="H3CADA6FBD6EB4906914B509D6F255EFF" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Within 30 days after the Attorney General receives an application therefor, the Attorney General shall permit the conditional importation or bringing in of a firearm or ammunition for examination and testing in connection with the making of a determination as to whether the importation or bringing in of the firearm or ammunition will be allowed under this subsection.</text>
 </paragraph><paragraph changed="added" committee-id="HII00" id="H6DDF799800614C30A5C5DD64457EB654" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Attorney General shall not authorize, under this subsection, the importation of any firearm the importation of which is prohibited by section 922(p).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H13B0BC57C4E74B0183AE40720C385E23"><enum>1604.</enum><header>Protection of shotguns, shotgun shells, and large caliber rifles from arbitrary classification as <quote>destructive devices</quote></header>
 <subsection id="H8D438FC43C0B4D87ABF7819FC2F24100"><enum>(a)</enum><header>Amendments to the National Firearms Act</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(f)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="HA336EC1F86AA4197B3DDDFD09630266B"><enum>(1)</enum><text>in paragraph (2), by striking <quote>recognized as particularly suitable for sporting purposes</quote> and inserting <quote>recognized as suitable for lawful purposes</quote>; and</text>
 </paragraph><paragraph id="HD40F9649C6DE44E4A615301ED6184ED1"><enum>(2)</enum><text>by striking <quote>use solely for sporting purposes</quote> and inserting <quote>use for sporting purposes</quote>.</text> </paragraph></subsection><subsection id="H4339606B689D43E4A6D034F93BD01127"><enum>(b)</enum><header>Amendments to title <enum-in-header>18</enum-in-header>, United States Code</header><text>Section 921(a)(4) of title 18, United States Code, is amended—</text>
 <paragraph id="HB2AC3DCE10674D3B89FD8C0F166B7DAE"><enum>(1)</enum><text>in subparagraph (B) of the first sentence, by striking <quote>particularly suitable for sporting</quote> and inserting <quote>suitable for lawful</quote>; and</text> </paragraph><paragraph id="H54987421EAD9417BB81EB8FEEC07D371"><enum>(2)</enum><text>in the second sentence, by striking <quote>solely</quote>.</text>
					</paragraph></subsection></section><section id="HB801F5CFD4A642BBA9360EC9951EC6E1"><enum>1605.</enum><header>Broadening of the temporary interstate transfer provision to allow temporary transfers for all
 lawful purposes rather than just for <quote>sporting purposes</quote></header><text display-inline="no-display-inline">Section 922 of title 18, United States Code, is amended in each of subsections (a)(5)(B), (a)(9), and (b)(3)(B), by striking <quote>sporting</quote>.</text>
			</section></title><title id="H8F9AA60F2E024D68AE54F077113454F6"><enum>XVII</enum><header>Federal Land Transaction Facilitation Act Reauthorization (FLTFA) </header>
 <section id="H3901E2773F554B12A50F89E84FE7BC0D" section-type="subsequent-section"><enum>1701.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Federal Land Transaction Facilitation Act Reauthorization</short-title></quote>.</text> </section><section id="H17EAE064609448E8A773C853B07CF70C"><enum>1702.</enum><header>Federal Land Transaction Facilitation Act</header><text display-inline="no-display-inline">The Federal Land Transaction Facilitation Act is amended—</text>
 <paragraph id="HA5070B712D7B417C8C5DEA0C6C94DDA5"><enum>(1)</enum><text>in section 203(1) (<external-xref legal-doc="usc" parsable-cite="usc/43/2302">43 U.S.C. 2302(1)</external-xref>), by striking <quote>cultural, or</quote> and inserting <quote>cultural, recreational access and use, or other</quote>;</text> </paragraph><paragraph id="HA586C72C7B384CD9909CB1CEF238D0FC"><enum>(2)</enum><text>in section 203(2) in the matter preceding subparagraph (A), by striking <quote>on the date of enactment of this Act was</quote> and inserting <quote>is</quote>;</text>

 </paragraph><paragraph id="H537AEFAFBFCB4693AEEF71A03A12D081"><enum>(2)</enum><text>not later than 180 days after the date of the enactment of the Federal Land Transaction Facilitation Act Reauthorization, to establish and make available to the public, on the website of the Department of the Interior, a database containing a comprehensive list of all the land referred to in paragraph (1); and</text>
 </paragraph><paragraph id="H72C680B718FB4B65B446A3CD0EEB0D63"><enum>(3)</enum><text>to maintain the database referred to in paragraph (2).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="HABE97F80B8634E099C55CFAD90C9CA1D"><enum>(B)</enum><text>in subsection (d), by striking <quote>11</quote> and inserting <quote>22</quote>;</text>

 </subparagraph><subparagraph id="HFA45D8D533784786A6C0F8B379940D55"><enum>(B)</enum><header>Purposes</header><text display-inline="yes-display-inline">Except as authorized under paragraph (2), funds in the Federal Land Disposal Account shall be used for one or more of the following purposes:</text>
 <clause id="H12348DB7F3434F32A30D64C62D8BA63D"><enum>(i)</enum><text>To purchase lands or interests therein that are otherwise authorized by law to be acquired and are one or more of the following:</text>
 <subclause id="HB9F1C9131A4A404A872DE8A3AF3B225B"><enum>(I)</enum><text>Inholdings.</text> </subclause><subclause id="H8FAEB47F1B4141659104DAE7B5EDCD68"><enum>(II)</enum><text>Adjacent to federally designated areas and contain exceptional resources.</text>
 </subclause><subclause id="H94240A5A9DD041C4B8058AA5100755A6"><enum>(III)</enum><text display-inline="yes-display-inline">Provide opportunities for hunting, recreational fishing, recreational shooting, and other recreational activities.</text>
 </subclause><subclause id="HC19161C81F3A4AF1A97724F6BE99ABBD"><enum>(IV)</enum><text display-inline="yes-display-inline">Likely to aid in the performance of deferred maintenance or the reduction of operation and maintenance costs or other deferred costs.</text>
 </subclause></clause><clause id="H4AEF891EED0C485BB8DBBA30C7A86EA9"><enum>(ii)</enum><text>To perform deferred maintenance or other maintenance activities that enhance opportunities for recreational access.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HA55A919CB3CC42F59E1CB207FE75ECF6"><enum>(5)</enum><text>in section 206(c)(2) (<external-xref legal-doc="usc" parsable-cite="usc/43/2305">43 U.S.C. 2305(c)(2)</external-xref>)—</text> <subparagraph id="H2851D2F170554585B91243E4AC580D82"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (A);</text>
 </subparagraph><subparagraph id="HD7B905B7704E4D139F9E5D0D3C062C3C"><enum>(B)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (A), (B), and (C), respectively;</text> </subparagraph><subparagraph id="H4495838B17644D4C8F59F7B4B069EA35"><enum>(C)</enum><text>in subparagraph (C) (as so redesignated by this paragraph)—</text>
 <clause id="H551FA213A6F64B719BFCD6A054AEAB03"><enum>(i)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">purchases</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">land purchases and performance of deferred maintenance activities</header-in-text></quote>;</text> </clause><clause id="HB19A9569E35C41CD8C3B88C84B063CF5"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>subparagraph (C)</quote> and inserting <quote>subparagraph (B)</quote>; and</text>
 </clause><clause commented="no" id="H5CC17FFA5F0744479DF11DB22D59C191"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting <quote>for the activities outlined in paragraph (1)</quote> after <quote>generated</quote>; and</text> </clause></subparagraph><subparagraph commented="no" id="H84EE7226FE3244F3902A0C425FDCB9C6"><enum>(D)</enum><text>by adding at the end the following:</text>

 <paragraph id="H5B5185A6E5A54F5D90D5167AC829CC20"><enum>(1)</enum><text display-inline="yes-display-inline">In subsection (a)—</text> <subparagraph id="HF1511547901744AE94A26CF69E380D7E"><enum>(A)</enum><text>in paragraph (1), by striking <quote>provide a fair return to the United States</quote> and inserting <quote>be sufficient to cover the cost of a film permit and other administrative and personnel costs</quote>; and</text>
 </subparagraph><subparagraph id="H3C3767996BD24A17A60E5ACA3936B462"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H555324DFFFB2417DBBEFF5EFF2F67D58" reported-display-style="italic" style="OLC"> <paragraph display-inline="no-display-inline" id="H91E0A177370A41CDA6F85C37C1C5BE51"><enum>(3)</enum><header>Film crew of 5 persons or fewer</header><text display-inline="yes-display-inline">For a commercial film crew of 5 persons or fewer for commercial filming activities or similar projects on Federal land and waters administered by the Secretary the Secretary shall—</text>
 <subparagraph id="H3994689802A34B56B428C13A5E934871"><enum>(A)</enum><text display-inline="yes-display-inline">assess an annual fee in an amount sufficient to cover the administrative cost of issuing a permit under this section, but not greater than $200; and</text>
 </subparagraph><subparagraph id="HA4453291E6F54A619866CE7AA5B14BC3"><enum>(B)</enum><text>require a permit which shall be valid for commercial filming activities or similar projects that occur in areas designated for public use during public hours on all Federal land and waterways administered by the Secretary for a 1-year period beginning on the date of issuance of the permit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 <paragraph id="HF7F3C3164A2B4793B7FDE509C64946E6"><enum>(1)</enum><text>the filming or still photography conducted is incidental to the permitted activity that is the subject of the commercial use authorization or special recreation permit; and</text>
 </paragraph><paragraph id="HF162E0736CE54B85872260CDD168EDB8"><enum>(2)</enum><text>the holder of the commercial use authorization or special recreation permit is an individual or small business concern (within the meaning of section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text>
 </paragraph></subsection><subsection id="H8CE32149F3314852BC4B13934A91BB33"><enum>(g)</enum><header>News Gathering Activities</header><text display-inline="yes-display-inline">For the purposes of this section, a news gathering shall not be considered a commercial activity.</text> </subsection><subsection id="H9137882BA1BD461CB70D27ACAC679ED9"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section—</text>
 <paragraph id="HFA78AC97C3F341DFBAF4250A67B44302"><enum>(1)</enum><text>the term <term>commercial film crew</term> means any persons present on Federal land or water under the jurisdiction of the Secretary who are associated with the production of a film;</text>
 </paragraph><paragraph id="HDC57A9772F64481AB4E98958C3A28E26"><enum>(2)</enum><text>the term <term>news gathering</term> means the gathering, recording, and filming of news and information related to news in any medium; and</text>
 </paragraph><paragraph id="H9B3088EB95C94E0F88E393DBB3D6969B"><enum>(3)</enum><text>the term <term>Secretary</term> means the Secretary of the Interior or the Secretary of Agriculture, as applicable, with respect to land under the respective jurisdiction of such Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H3E80F355EB63480D8670E9CB29425FDF"><enum>XIX</enum><header>Respect for State Wildlife Management Authority</header>
 <section id="H13D990ABBBC84DD6A90806FFC022FFA6"><enum>1901.</enum><header>Authority of the States</header><text display-inline="no-display-inline">Nothing in this Act shall be construed as interfering with, diminishing, or conflicting with the authority, jurisdiction, or responsibility of any State to exercise primary management, control, or regulation of fish and wildlife under State law on land or water within the State, including on Federal land administered by the Bureau of Land Management or the Forest Service.</text>
 </section><section id="HB4FE646D7C7C4C40BE4C3E4B0A88A9E6"><enum>1902.</enum><header>Federal licenses</header><text display-inline="no-display-inline">Nothing in this Act, shall be construed to authorize the head of a Federal agency to require a license, fee, or permit to fish, hunt, or trap on land or water in a State, including on Federal land in the State, except that this paragraph shall not affect the Migratory Bird Stamp requirement set forth in the Migratory Bird Hunting and Conservation Stamp Act (<external-xref legal-doc="usc" parsable-cite="usc/16/718">16 U.S.C. 718</external-xref> et seq.).</text>
			</section><section id="H1F6A13E4D81A44698050B6BE37E9F8F9"><enum>1903.</enum><header>Cooperation with State Fish and Wildlife Agencies on Management Plans</header>
 <subsection id="HA20FFFDADDDF44088ADECEC95FE5A545"><enum>(a)</enum><header>Use of State fish and wildlife data and analyses</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall prioritize coordination, consultation, and cooperation with the appropriate State fish and wildlife agencies and local governments to recognize and fully utilize State and local government fish and wildlife data and analyses, unless it is determined by the State or local government that such data is proprietary or protected from disclosure under State law, as a primary source to inform—</text>
 <paragraph commented="no" id="H13B8D0D39240417D8E603066AB7DF1A6"><enum>(1)</enum><text display-inline="yes-display-inline">land and resource management plans for units of the National Forest System developed under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>);</text>
 </paragraph><paragraph id="HCEB7E7DDF8F14A72BDB333911BB3E277"><enum>(2)</enum><text display-inline="yes-display-inline">land use plans developed under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>);</text>
 </paragraph><paragraph commented="no" id="H6B467E190F324BBD81672C36D9A478D9"><enum>(3)</enum><text display-inline="yes-display-inline">comprehensive conservation plans developed under section 4 of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd</external-xref>);</text>
 </paragraph><paragraph commented="no" id="H5156374FB69F40EBBDC0330740A2BD75"><enum>(4)</enum><text>project planning and execution; and</text> </paragraph><paragraph id="H9DACDD80C9954277A07379264595C731"><enum>(5)</enum><text>related natural resource policies and decisions.</text>
 </paragraph></subsection><subsection id="HC755ED7E70354984B2FCF3756339252A"><enum>(b)</enum><header>Sharing data</header><text display-inline="yes-display-inline">Federal agencies shall evaluate and utilize existing analysis of data on fish and wildlife populations prepared by appropriate State or local governments and share Federal data with fish and wildlife managers and local governments.</text>
				</subsection></section></title><title id="HAD3063FFEB9442BA8DB7365E534E6E0F"><enum>XX</enum><header>Grand Canyon Bison Management Act</header>
 <section id="H4DAAAF2A09E74C81BC5C2871FCD254AB" section-type="subsequent-section"><enum>2001.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Grand Canyon Bison Management Act</short-title></quote>.</text> </section><section id="H7944534C1628410B8C132A7906863973"><enum>2002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
 <paragraph id="H3ED0DFC19796472DBBC269D1276252F5"><enum>(1)</enum><header>Full bison</header><text>The term <term>full bison</term> means all of the remains of a bison after field dressing.</text> </paragraph><paragraph id="H4B9EED651D364EC7AB673C9F2F5049E1"><enum>(2)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan published under section 2003(a).</text>
 </paragraph><paragraph id="HE2B7B886BFF04685BD663DB64D5F72D1"><enum>(3)</enum><header>Park</header><text>The term <term>Park</term> means the Grand Canyon National Park.</text> </paragraph><paragraph id="H83E8EE86C8C640519C30BB030F7A3EB8"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
 </paragraph><paragraph id="H3342A781B6EE477C967A5EEB1CD6CBF5"><enum>(5)</enum><header>Skilled public volunteer</header><text>The term <term>skilled public volunteer</term> means an individual who possesses—</text> <subparagraph id="H76A5965360B145ABB8B8B96566E34048"><enum>(A)</enum><text>a valid hunting license issued by the State of Arizona; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBCB23F2C5BF54015824DD396178FA572"><enum>(B)</enum><text>such other qualifications as the Secretary may require, after consultation with the Arizona Game and Fish Commission.</text>
					</subparagraph></paragraph></section><section id="HF5A1ABDA6A32423F947750223F69D3EB"><enum>2003.</enum><header>Bison management plan for <enum-in-header>G</enum-in-header>rand <enum-in-header>C</enum-in-header>anyon <enum-in-header>N</enum-in-header>ational <enum-in-header>P</enum-in-header>ark</header>
 <subsection id="H91061EF89D8E424BB01C19D432BC9E2C"><enum>(a)</enum><header>Publication of plan</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall publish a management plan to reduce, through humane lethal culling by skilled public volunteers and by other nonlethal means, the population of bison in the Park that the Secretary determines are detrimental to the use of the Park.</text>
 </subsection><subsection id="H6782803194C949BCB0D92AA9E91B6266"><enum>(b)</enum><header>Removal of Animal</header><text display-inline="yes-display-inline">Notwithstanding section 4 of the Act of March 2, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/16/198c">16 U.S.C. 198c</external-xref>) or any other provision of law, a skilled public volunteer may remove from the Park a full bison harvested in accordance with the management plan.</text>
 </subsection><subsection id="HA7AEDBB4EA9F44238DD421EC211ADF0E"><enum>(c)</enum><header>Coordination</header><text>The Secretary shall coordinate with and obtain written approval from the Arizona Game and Fish Commission regarding the development and finalization of the management plan and any amendments to the management plan.</text>
 </subsection><subsection id="HF6AACCE576A64FB6BF10150CF9357A85"><enum>(d)</enum><header><enum-in-header>NEPA</enum-in-header> Compliance</header><text>In developing the management plan, the Secretary shall comply with all applicable Federal environmental laws (including regulations), including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </subsection><subsection id="HB5C6710D9D464379BD426912B2077128"><enum>(e)</enum><header>Limitation</header><text>Nothing in this Act applies to the taking of wildlife in the Park for any purpose other than the implementation of the management plan.</text>
				</subsection></section></title><title id="H795499A8D19841D0BD855EE03CCD65B2"><enum>XXI</enum><header>Guides and Outfitters</header>
			<section id="H91473350670649C8994BD1E4B7CAA642" section-type="subsequent-section"><enum>2101.</enum><header>Short title; definitions</header>
 <subsection id="HBA3E9ACEFB6D4147BAAD5922D4CB7875"><enum>(a)</enum><header>Short title</header><text>This title may be cited as the <quote><short-title>Guides and Outfitters Act</short-title></quote> or the <quote><short-title>GO Act</short-title></quote>.</text> </subsection><subsection id="H1C30218A15D8414E80CEBDB5FA42B99B"><enum>(b)</enum><header>Definitions</header><text>In this title:</text>
 <paragraph id="H914162F77A4C43329CC5B19E5D3B304A"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means—</text> <subparagraph id="H2CC654734C7649509345B1C9CC95166E"><enum>(A)</enum><text>the Secretary of the Interior, with respect to a Federal land management agency (other than the Forest Service); and</text>
 </subparagraph><subparagraph id="H7B0227836C57436AA664CC3F8C308ABD"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to the Forest Service.</text> </subparagraph></paragraph><paragraph id="HB6CB46DA177C4D71A068B66A78AC714B"><enum>(2)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of the Interior and the Secretary of Agriculture acting jointly.</text>
 </paragraph></subsection></section><section id="H2003DD4E7D18400E8DA3C42DFAAC90BD"><enum>2102.</enum><header>Special recreation permit and fee</header><text display-inline="no-display-inline">Subsection (h) of section 803 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802</external-xref>) is amended to read as follows:</text>

 <paragraph id="HE33DA4A215274EEDBBC8402FFFE39D75"><enum>(1)</enum><header>In general</header><text>The Secretary may—</text> <subparagraph id="HE3B4101DDE9042C78736600008202D21"><enum>(A)</enum><text>issue a special recreation permit for Federal recreational lands and waters; and</text>
 </subparagraph><subparagraph id="H5F97004E3D0F4CA3984867973FCCF763"><enum>(B)</enum><text>charge a special recreation permit fee in connection with the issuance of the permit.</text> </subparagraph></paragraph><paragraph id="H569647496CA24DF781242756FEACB232"><enum>(2)</enum><header>Special recreation permits</header><text>The Secretary may issue special recreation permits in the following circumstances:</text>
 <subparagraph id="H9ECC565048A147AF93EF7C9FFA0B8D9E"><enum>(A)</enum><text>For specialized individual and group use of Federal facilities and Federal recreational lands and waters, such as, but not limited to, use of special areas or areas where use is allocated, motorized recreational vehicle use, and group activities or events.</text>
 </subparagraph><subparagraph id="H38D98D67392D4E09A365C272672157E4"><enum>(B)</enum><text>To recreation service providers who conduct outfitting, guiding, and other recreation services on Federal recreational lands and waters managed by the Forest Service, Bureau of Land Management, Bureau of Reclamation, or the United States Fish and Wildlife Service.</text>
 </subparagraph><subparagraph id="HDF80551AB2F64017AF45892C5D46B6E6"><enum>(C)</enum><text>To recreation service providers who conduct recreation or competitive events, which may involve incidental sales on Federal recreational lands and waters managed by the Forest Service, Bureau of Land Management, Bureau of Reclamation, or the United States Fish and Wildlife Service.</text>
							</subparagraph></paragraph><paragraph id="H7B2B57B492444FF7AD14A0CC2493FDAD"><enum>(3)</enum><header>Reduction in Federal Costs and Duplication of Analysis</header>
 <subparagraph id="HB5B8EAAEE240423682C4879703E60329"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The issuance of a new special recreation permit for activities under paragraph (2) shall be categorically excluded from further analysis and documentation under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), if the proposed use is the same as or similar to a previously authorized use and the Secretary determines that such issuance does not have significant environmental effects based upon application of the extraordinary circumstances procedures established by the Secretary under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="H5B5DA0ACD6E349E78301F71962240EE6"><enum>(B)</enum><header>Definition</header><text>For the purposes of this paragraph, the term <term>similar</term> means—</text> <clause id="HABC77C0D2F8C4E7A910AC0A595C6B99D"><enum>(i)</enum><text>substantially similar in type, nature, and scope; and</text>
 </clause><clause id="H4C73A6502A7B43A8A7ACACA0469B538E"><enum>(ii)</enum><text>will not result in significant new impacts.</text> </clause></subparagraph></paragraph><paragraph id="H6FF06AB0CB654CD8B38213CE09BE0F95"><enum>(4)</enum><header>Relation to fees for use of highways or roads</header><text>An entity that pays a special recreation permit fee shall not be subject to a road cost-sharing fee or a fee for the use of highways or roads that are open to private, noncommercial use within the boundaries of any Federal recreational lands or waters, as authorized under section 6 of <external-xref legal-doc="public-law" parsable-cite="pl/88/657">Public Law 88–657</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/537">16 U.S.C. 537</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H26A59925EA204EC5B6F042D1D24F68A4"><enum>2103.</enum><header>Permit across multiple jurisdictions</header>
 <subsection id="H1385579D263B4D0D8CF28E2A112C2B83"><enum>(a)</enum><header>In general</header><text>In the case of an activity requiring permits pursuant to subsection (h) of section 803 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802</external-xref>) for use of lands managed by both the Forest Service and the Bureau of Land Management—</text>
 <paragraph id="HE793F96A9B8844A1B48369941E5D6990"><enum>(1)</enum><text>the Secretaries may issue a joint permit based upon a single application to both agencies when issuance of a joint permit based upon a single application will lower processing and other administration costs for the permittee, provided that the permit applicant shall have the option to apply for separate permits rather than a joint permit; and</text>
 </paragraph><paragraph id="HF5184A7F716C4086857C6B0E4D09664E"><enum>(2)</enum><text>the permit application required under paragraph (1) shall be—</text> <subparagraph id="HB35A9DCA88E5462DA206D240E5A65080"><enum>(A)</enum><text>the application required by the lead agency; and</text>
 </subparagraph><subparagraph id="HE23E84767CF14057AE88631BE3B829E9"><enum>(B)</enum><text>submitted to the lead agency.</text> </subparagraph></paragraph></subsection><subsection id="H65133AB9F1AA4326ACC82CE9D4D3BE66"><enum>(b)</enum><header>Requirements of the lead agency</header><text>The lead agency for a permit under subsection (a) shall—</text>
 <paragraph id="H4E1FE1B9DB3C4EB0A13CC32EB755986A"><enum>(1)</enum><text>coordinate with the associated agencies, consistent with the authority of the Secretaries under section 330 of the Department of the Interior and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/43/1703">43 U.S.C. 1703</external-xref>), to develop and issue the single, joint permit that covers the entirety of the trip;</text>
 </paragraph><paragraph id="H94262B1C29DE4BD794C69B414B126D23"><enum>(2)</enum><text>in processing the joint permit application, incorporate the findings, interests, and needs of the associated agencies, provided that such coordination shall not be subject to cost recovery; and</text>
 </paragraph><paragraph id="H654D1D61B428433D865E6BC7D464372C"><enum>(3)</enum><text>complete the permitting process within a reasonable time after receiving the permit application.</text> </paragraph></subsection><subsection id="H4852F2D09C634AD3B48CF1646300C7E0"><enum>(c)</enum><header>Effect on regulations</header><text>Nothing in this section shall alter, expand, or limit the applicability of any Federal law (including regulations) to lands administered by the relevant Federal agencies.</text>
 </subsection><subsection id="HD0996BAF9A234FEA87D99BE66351DB1C"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H8E229334606B417EB23E2C5ED54210C1"><enum>(1)</enum><header>Associated agency</header><text>The term <term>associated agency</term> means an agency that manages the land on which the trip of the special recreation permit applicant will enter after leaving the land managed by the lead agency.</text>
 </paragraph><paragraph id="H4A206DB597844EC48024937064606E85"><enum>(2)</enum><header>Lead agency</header><text>The term <term>lead agency</term> means the agency that manages the land on which the trip of the special recreation permit applicant will begin.</text>
					</paragraph></subsection></section><section id="H200BF634DD884234916E5271ADCCDD93"><enum>2104.</enum><header>Guidelines and permit fee calculation</header>
 <subsection id="H70019EC95AAE4ACA86BBE5C879A5B232"><enum>(a)</enum><header>Guidelines and exclusion of certain revenues</header><text>The Secretary shall—</text> <paragraph id="HDB52114F4916462685D67BDD68FDBF82"><enum>(1)</enum><text>publish guidelines in the Federal Register for establishing recreation permit fees; and</text>
 </paragraph><paragraph id="H165B8DB78BF24F3786958671A40789BD"><enum>(2)</enum><text display-inline="yes-display-inline">provide appropriate deductions from gross revenues used as the basis for the fees established under paragraph (1) for—</text>
 <subparagraph id="H7B5E8A8E1F5C4EEFB7C963805FD286B0"><enum>(A)</enum><text>revenue from goods, services, and activities provided by a recreation service provider outside Federal recreational lands and waters, such as costs for transportation, lodging, and other services before or after a trip; and</text>
 </subparagraph><subparagraph id="H62B8AC9C17DD403C9859822BE43B0AED"><enum>(B)</enum><text>fees to be paid by permit holder under applicable law to provide services on other Federal lands, if separate permits are issued to that permit holder for a single event or trip.</text>
 </subparagraph></paragraph></subsection><subsection id="H378ABE7C7F53488BBDE4572DF0F0D1AE"><enum>(b)</enum><header>Fee conditions</header><text>The fee charged by the Secretary for a permit issued under section 803(h) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)</external-xref>) shall not exceed 3 percent of the recreational service provider’s annual gross revenue for activities authorized by the permit on Federal lands, plus applicable revenue additions, minus applicable revenue exclusions or a similar flat per person fee.</text>
 </subsection><subsection id="HAB3F1C515DAD4826835FFFB5F041444B"><enum>(c)</enum><header>Disclosure of fees</header><text>A holder of a special recreation permit may inform its customers of the various fees charged by the Secretary under section 803(h) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)</external-xref>).</text>
				</subsection></section><section id="H17B86558C9384FA4A0A76A71EC4028C6"><enum>2105.</enum><header>Use of permit fees for permit administration</header>
 <subsection id="H8C73F2A1D5634629BA049A98AB2B7B4E"><enum>(a)</enum><header>Deposits</header><text display-inline="yes-display-inline">Subject to subsection (b), revenues from special recreation permits issued to recreation service providers under subparagraphs (B) and (C) of section 803(h)(2) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)(2)</external-xref>) shall be held in special accounts established for each specific unit or area for which such revenues are collected, and shall remain available for expenditure, without further appropriation, until expended.</text>
 </subsection><subsection id="H3971610E1B72468DAAF2547D9EEDC323"><enum>(b)</enum><header>Use of Permit fees</header><text display-inline="yes-display-inline">Revenues from special recreation permits issued to recreation service providers under subparagraphs (B) and (C) of section 803(h)(2) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)(2)</external-xref>) shall be used only—</text>
 <paragraph id="H0D0AFF5E32FA4676B58F67632021169A"><enum>(1)</enum><text>to partially offset the Secretary’s direct cost of administering the permits;</text> </paragraph><paragraph id="H42C6C5F16B4042B08F50D2D8733E6836"><enum>(2)</enum><text>to improve and streamline the permitting process; and</text>
 </paragraph><paragraph id="H604FC7E708D844AC98F43818B46E5832"><enum>(3)</enum><text display-inline="yes-display-inline">for related recreation infrastructure and other purposes specifically to support recreation activities at the specific site for which use is authorized under the permit, after obtaining input from any related permittees; provided, however, that the Federal Advisory Committee Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/1">5 U.S.C. App. 1</external-xref> et seq.) shall not apply to any advisory committee or other group established to carry out this paragraph.</text>
 </paragraph></subsection><subsection id="H416AD6B8E12A4AD38A88F6E5182998E6"><enum>(c)</enum><header>Limitation on use of fees</header><text display-inline="yes-display-inline">The Secretary may not use any permit fees for biological monitoring on Federal recreational lands and waters under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) for listed or candidate species.</text>
				</subsection></section><section id="HBCC2A057DB6B4A2BBFEFC6127FABEF2C"><enum>2106.</enum><header>Adjustment to permit use reviews</header>
 <subsection id="H532D79579DB94FE0858B92F2AE8AB289"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In reviewing and adjusting allocations of use for priority use permits for special uses of Federal recreational lands and waters managed by the Forest Service, and in renewing such permits, the Secretary of Agriculture shall allocate to a permit holder a level of use that is no less than the highest amount of actual annual use over the reviewed period plus 25 percent, capped at the amount of use allocated when the permit was issued unless additional capacity is available. The Secretary may assign any use remaining after adjusting allocations on a temporary basis to qualified permit holders.</text>
 </subsection><subsection id="H63E0B7A55CDA4B4A8BADDCA4F803C897"><enum>(b)</enum><header>Waiver</header><text display-inline="yes-display-inline">Use reviews under subsection (a) may be waived for periods in which circumstances that prevented use of assigned capacity, such as weather, fire, natural disasters, wildlife displacement, business interruptions, insufficient availability of hunting and fishing licenses, or when allocations on permits include significant shoulder seasons. The authorizing office may approve non-use without reducing the number of service days assigned to the permit in such circumstances at the request of the permit holder. Approved non-use may be temporarily assigned to other qualified permit holders when conditions warrant.</text>
 </subsection></section><section id="H8724D44787834C55BA45656C64B9A15B"><enum>2107.</enum><header>Authorization of temporary permits for new uses for the <enum-in-header>F</enum-in-header>orest <enum-in-header>S</enum-in-header>ervice and <enum-in-header>BLM</enum-in-header></header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Agriculture and the Secretary of the Interior shall establish and implement a program to authorize temporary permits for new recreational uses of Federal recreational lands and waters managed by the Forest Service or the Bureau of Land Management, respectively, and to provide for the conversions of such temporary permits to long-term permits after 2 years of satisfactory operation. The issuance and conversion of such permits shall be subject to subsection (h)(3) of section 803 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802</external-xref>).</text>
			</section><section id="H413C4D239D9B49A4AF01B522A3E95CBC"><enum>2108.</enum><header>Indemnification requirements</header>
 <subsection id="HCA6B791585A94827B8CBCC4E4EF7DE60"><enum>(a)</enum><header>Indemnification</header><text>A permit holder that is prohibited by the State from providing indemnification to the Federal Government shall be considered to be in compliance with indemnification requirements of the Department of the Interior and the Department of Agriculture if the permit holder carries the required minimum amount of liability insurance coverage or is self-insured for the same minimum amount.</text>
 </subsection><subsection id="H03F2324AEA2D4AEF86079CB76BF89C18"><enum>(b)</enum><header>Exculpatory agreements</header><text display-inline="yes-display-inline">The Secretary shall not implement, administer or enforce any regulation or policy prohibiting the use of exculpatory agreements between recreation service providers and their customers for services provided under a special recreation permit.</text>
				</subsection></section><section id="H488E82033DC34F7B82B54DE9586A5B63"><enum>2109.</enum><header>Streamlining of permitting process</header>
 <subsection id="HEC3BAEC0BBA847D3AD988D90573D30F1"><enum>(a)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Agriculture shall revise part 251, subpart B, of title 36 Code of Federal Regulations, and the Secretary of the Interior shall revise subpart 2932, of title 43, Code of Federal Regulations, to streamline the processes for the issuance and renewal of outfitter and guide special use permits. Such amended regulations shall—</text>
 <paragraph id="HE78D3CE2D1F747DD95D93592B5664ED1"><enum>(1)</enum><text>shorten application processing times and minimize application and administration costs; and</text> </paragraph><paragraph id="HF31A5667C1FC4692BA28CC16E398DEC6"><enum>(2)</enum><text display-inline="yes-display-inline">provide for the use of programmatic environmental assessments and categorical exclusions for environmental reviews under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) for the issuance or renewal of outfitter and guide and similar recreation special use permits when the Secretary determines that such compliance is required, to the maximum extent allowable under applicable law, including, but not limited to, use of a categorical exclusion as provided under section 803(h)(3) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)(3)</external-xref>).</text>
 </paragraph></subsection><subsection id="HD5856BD680A84859B104B6F88FA9B484"><enum>(b)</enum><header>Online applications</header><text>To the maximum extent practicable, where feasible and efficient, the Secretary shall make special recreation permit applications available to be filled out and submitted online.</text>
				</subsection></section><section id="HAAD74D7DDF254B169A0E6580CE49E097"><enum>2110.</enum><header>Cost recovery reform</header>
 <subsection id="H54975DAF906748838EAC070A197CB22B"><enum>(a)</enum><header>Regulatory process</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall revise section 251.58 of title 36, Code of Federal Regulations, and the Secretary of the Interior shall revise section 2932.31(e) and (f) of title 43, Code of Federal Regulations, to reduce costs and minimize the burden of cost recovery on small businesses and adverse impacts of cost recovery on jobs in the outfitting and guiding industry and on rural economies provided, however, that nothing in the revised regulations shall further limit the Secretary’s authority to issue or renew recreation special use permits.</text>
				</subsection><subsection id="HFA59169B8C0C4DF0A4B6BCC5166228BD"><enum>(b)</enum><header>De minimis exemption</header>
 <paragraph id="HDE17722A23A94233ADB4AE042FF7EAF9"><enum>(1)</enum><header>Cost recovery limitation</header><text>Any regulations issued by the Secretary of the Interior or the Secretary of Agriculture to establish fees to recover processing costs for recreation special use applications and monitoring costs for recreation special use authorizations shall include an exemption providing that at least the first 50 hours of work necessary in any one year to process and/or monitor such an application shall not be subject to cost recovery. The application of a 50-hour credit per permit shall also apply to any monitoring fees on a per annum basis during the term of each permit.</text>
 </paragraph><paragraph id="HAC8E672F40D94BFD922E110E7F6932FB"><enum>(2)</enum><header>Application of exemption</header><text>An exemption under paragraph (1) shall apply to the processing of each recreation special use permit application and monitoring of each recreation special use authorization for which cost recovery is required, including any application or authorization requiring more than 50 hours (or such other greater number of hours specified for exemption) to process or monitor. In the event that the amount of work required to process such an application or monitor such an authorization exceeds the specified exemption, the amount of work for which cost recovery is required shall be reduced by the amount of the exemption.</text>
 </paragraph><paragraph id="HE2B30B87244C4CE3A01AC269A39682D5"><enum>(3)</enum><header>Multiple applications</header><text>In situations involving multiple recreation special use applications for similar services in the same unit or area that require more than 50 hours (or such other greater number of hours specified for exemption) in the aggregate to process, the Secretary shall, regardless of whether the applications are solicited or unsolicited and whether there is competitive interest—</text>
 <subparagraph id="H9BD44DD1595A4143A971D19C68CE5793"><enum>(A)</enum><text>determine the share of the aggregate amount to be allocated to each application, on an equal or prorated basis, as appropriate; and</text>
 </subparagraph><subparagraph id="HF43835D81A6E40A19347E8C35CBB184D"><enum>(B)</enum><text>for each application, apply a separate exemption of up to 50 hours (or such other greater number of hours specified for exemption) to the share allocated to such application.</text>
 </subparagraph></paragraph><paragraph id="HC1F7A103166B4A74949E3EDBCBAD757D"><enum>(4)</enum><header>Cost reduction</header><text>The agency processing a recreation special use application shall utilize existing studies and analysis to the greatest extent practicable in order to reduce the amount of work and cost necessary to process the application.</text>
 </paragraph><paragraph id="HEE3252DABC57474C9E11550D29A74E47"><enum>(5)</enum><header>Limitation</header><text>The Secretary of the Interior and the Secretary of Agriculture may not recover as processing costs for recreation special use applications and monitoring costs for recreation special use authorizations any costs for consultations conducted under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>) or for biological monitoring on Federal recreational lands and waters under such Act for listed, proposed, or candidate species.</text>
 </paragraph><paragraph id="H3710F88D90104E73B4F6D0F46726F07A"><enum>(6)</enum><header>Waiver of cost recovery</header><text>The Secretary of the Interior and the Secretary of Agriculture may waive the recovery of costs for processing recreation special use permit applications and renewals, on a categorical or case-by-case basis as appropriate, if the Secretary determines that—</text>
 <subparagraph id="H1A2923BEF4BB4BD29FD9F860BDAC87FC"><enum>(A)</enum><text>such costs would impose a significant economic burden on any small business or category of small businesses;</text>
 </subparagraph><subparagraph id="H68295EE2B62447EBB40C3EE04EBA9EC0"><enum>(B)</enum><text>such cost recovery could threaten the ability of an applicant or permittee to provide, in a particular area, a particular outdoor recreational activity that is consistent with the public interest and with applicable resource management plans; or</text>
 </subparagraph><subparagraph id="H56471BB1A6AC442B8FD4CB67F15C5932"><enum>(C)</enum><text>prevailing economic conditions are unfavorable, such as during economic recessions, or when drought, fire, or other natural disasters have depressed economic activity in the area of operation.</text>
 </subparagraph></paragraph></subsection></section><section id="H1CA39A4D3FD54E98AA56E4B1C9987CD7"><enum>2111.</enum><header>Extension of forest service recreation priority use permits</header><text display-inline="no-display-inline">Where the holder of a special use permit for outfitting and guiding that authorizes priority use has submitted a request for renewal of such permit in accordance with applicable laws and regulations, the Secretary of Agriculture shall have the authority to grant the holder one or more extensions of the existing permit for additional items not to exceed 5 years in the aggregate, as necessary to allow the Secretary to complete the renewal process and to avoid the interruption of services under such permit. Before granting an extension under this section, the Secretary shall take all reasonable and appropriate steps to complete the renewal process before the expiration of the special use permit.</text>
			</section></title><title id="H0E56853F67514A8A8DDCC9F75B7B7E25"><enum>XXII</enum><header>Hunting and recreational fishing within certain National Forests</header>
 <section id="H4EBA6C69971649D8B1BCD5FE72FFFAF5"><enum>2201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H28E41F05831641EE95CD5B7BB422E45A"><enum>(1)</enum><header>Hunting</header><text>The term <term>hunting</term> means use of a firearm, bow, or other authorized means in the lawful pursuit, shooting, capture, collection, trapping, or killing of wildlife; attempt to pursue, shoot, capture, collect, trap, or kill wildlife; or the training and use of hunting dogs, including field trials.</text>
 </paragraph><paragraph id="H966A104C683346C5B7B01F7440F23D61"><enum>(2)</enum><header>Recreational fishing</header><text>The term <term>recreational fishing</term> means the lawful pursuit, capture, collection, or killing of fish; or attempt to capture, collect, or kill fish.</text>
 </paragraph><paragraph id="H98C1900363FF42B08DB4812EF1DAF24B"><enum>(3)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text>
 </paragraph><paragraph id="H7AEE8830A9004E43A93CD55D443084FA"><enum>(4)</enum><header>National forest system</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)</text>
				</paragraph></section><section id="H22426CFD1391473A9951D14BD4EC1497"><enum>2202.</enum><header>Hunting and recreational fishing within the <enum-in-header>N</enum-in-header>ational <enum-in-header>F</enum-in-header>orest <enum-in-header>S</enum-in-header>ystem</header>
 <subsection id="HF12403A5EFF5499B9202DF83E68CB89B"><enum>(a)</enum><header>Prohibition of restrictions</header><text>The Secretary of Agriculture or Chief of the Forest Service may not establish policies, directives, or regulations that restrict the type, season, or method of hunting or recreational fishing on lands within the National Forest System that are otherwise open to those activities and are consistent with the applicable forest plan.</text>
 </subsection><subsection id="H24C3584EBF5640B6BA9C8CF65CAB94AD"><enum>(b)</enum><header>Prior restrictions void</header><text>Any restrictions imposed by the Secretary of Agriculture or Chief of the Forest Service regarding the type, season, or method of hunting or recreational fishing on lands within the National Forest System that are otherwise open to those activities in force on the date of the enactment of this Act shall be void and have no force or effect.</text>
 </subsection><subsection id="H098A4093E41E445C8FEFE600E636322D"><enum>(c)</enum><header>Applicability</header><text>This section shall apply only to—</text> <paragraph id="H1FBBD57E9AB24CD5833243A3A7B432E6"><enum>(1)</enum><text>the Kisatchie National Forest in the State of Louisiana;</text>
 </paragraph><paragraph id="H0EC02792BDBD440ABB27B63EB1603D1D"><enum>(2)</enum><text>the De Soto National Forest in the State of Mississippi; and</text> </paragraph><paragraph id="H08A5DE4F6CDA41A7AF24AA6FDB5EB098"><enum>(3)</enum><text>the Ozark National Forest, the St. Francis National Forest, and the Ouachita National Forest in the States of Arkansas and Oklahoma.</text>
 </paragraph></subsection><subsection id="H5012038A6748415C9F70998CAF4ED52B"><enum>(d)</enum><header>State authority</header><text>Nothing in this section, section 1 of the Act of June 4, 1897 (<external-xref legal-doc="usc" parsable-cite="usc/16/551">16 U.S.C. 551</external-xref>), or section 32 of the Act of July 22, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/7/1011">7 U.S.C. 1011</external-xref>) shall affect the authority of States to manage hunting or recreational fishing on lands within the National Forest System.</text>
