			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a National Flood Research and Education Center to provide research, data, and
			 recommendations on physical science, social science, economic analysis,
			 policy analysis, risk analysis, monitoring, predicting, and planning as
			 they relate to flooding and flood-related issues.</official-title></form>

 <section id="HA43D30F987EC4217973CC724CBFF9435" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Flood Research and Education Center Act</short-title></quote>.</text> </section><section id="H9136D91A836A4EB692F17926D252B55D"><enum>2.</enum><header>National Flood Research and Education Center establishment and purpose</header> <subsection id="H6A5541C1C63B4C719B3FFFDD4C6311E9"><enum>(a)</enum><header>Establishment</header><text>There is established within the National Oceanic and Atmospheric Administration a National Flood Research and Education Center (in this Act referred to as <quote>NFREC</quote>) which shall consist of—</text>
 <paragraph id="HF2B62BA5E6E840E6900D0F455FE16C9E"><enum>(1)</enum><text>an office within the National Oceanic and Atmospheric Administration;</text> </paragraph><paragraph id="HE1DDCBF6D80A4D2BBBA359ACA9DB7615"><enum>(2)</enum><text>one public university or college selected by the Administrator of the National Oceanic and Atmospheric Administration (in this Act referred to as the <quote>Administrator</quote>), which shall serve as the lead partner institution with the National Oceanic and Atmospheric Administration; and</text>
 </paragraph><paragraph id="H51641A21635847BFAAAAFB1D577B782A"><enum>(3)</enum><text>a consortium of other public universities or colleges selected by the Administrator and the lead partner institution based on their ability to fulfill specific purposes of NFREC.</text>
 </paragraph></subsection><subsection id="HD42DD574007D4F0A95229AEC1B74CE7C"><enum>(b)</enum><header>Purposes</header><text>The purposes of NFREC are as follows:</text> <paragraph id="HD4134D55DD014D76B2434A133312F8AB"><enum>(1)</enum><text>To plan, conduct, and arrange for competent public research, data, education, and recommendations within the following categories as they relate to flooding issues nationwide, regionally, and locally:</text>
 <subparagraph id="H76F62E5551954A2FB5B86F794A261455"><enum>(A)</enum><text>Physical sciences, including engineering, hydrology, environmental, and atmospheric sciences, of flooding and flood-related events.</text>
 </subparagraph><subparagraph id="H635C36A02B444B05B1E3F84AEEF8157B"><enum>(B)</enum><text>Social science of flooding and flood-related events focused on increasing community resilience.</text> </subparagraph><subparagraph id="H21089F93E6A040B2A8A2795541719E0C"><enum>(C)</enum><text>Economic analysis of flooding and flood-related events in addition to analysis of a variety of existing and new strategies and techniques to reduce, manage, and prevent flooding and flood-related events.</text>
 </subparagraph><subparagraph id="HB26D6C5E4EA547E889BDE3028DAE0E0C"><enum>(D)</enum><text>Policy analysis and recommendations on flooding-related policy on a Federal, State, and local governmental basis.</text>
 </subparagraph><subparagraph id="HC10A9641B1514960B147503F5551F575"><enum>(E)</enum><text>Risk analysis and risk management of flooding and flood-related events.</text> </subparagraph><subparagraph id="H016C60BD3FE94EDFBA444EBF42AB7544"><enum>(F)</enum><text>Improvement of existing, and testing of new, risk assessment tools, methods, and models for flooding and flood risks used by Federal, State, and local governments and other interested organizations.</text>
 </subparagraph><subparagraph id="HE855AB885A474CD58AA7E0C1DC35D349"><enum>(G)</enum><text>Improvement of existing, and testing of new, monitoring and predicting strategies and techniques of flooding and flood-related events.</text>
 </subparagraph><subparagraph id="H6A61D85BA5834C409C70E25BF027DEE6"><enum>(H)</enum><text>Improvement of existing, and testing of new, flood management and prevention strategies and techniques.</text>
 </subparagraph></paragraph><paragraph id="HB946F8AB5D224DD2B4ED63510372F92A"><enum>(2)</enum><text>To carry out this Act within a variety of regions in the United States which are identified and categorized by NFREC based on their specific flooding and flood-related issues, hydrology, weather, and related issues so that diverse flood situations are represented and examined through NFREC’s work.</text>
 </paragraph><paragraph id="H55A25AD9FD9C4CBFAEB9DDAD58B88199"><enum>(3)</enum><text>To identify opportunities for increased efficiency in allocation of resources, coordination, cooperation, and consolidation of efforts as they relate to local, statewide, regional, and Federal flood-related efforts with respect to NFREC’s purposes.</text>
 </paragraph><paragraph id="H79015D4D24D04C6EBA6437BFAB7D1E51"><enum>(4)</enum><text>To develop or improve undergraduate and graduate degree programs and other programs at the consortium-member public universities and colleges to advance the entry of new talent into flooding-related fields.</text>
 </paragraph><paragraph id="H9D9528510E904F9B977ACCE0C3288EFC"><enum>(5)</enum><text>To collaborate with other colleges and universities in the region that have demonstrated capability for research, information dissemination, and graduate training in order to develop regional networks that are knowledgeable on regional flooding issues.</text>
				</paragraph></subsection></section><section id="HD6466909A5A14D94A1EB2892B8AB56CF"><enum>3.</enum><header>Consortium selection and collaboration</header>
 <subsection id="H7144E8A12FC94975A65B069396DF16F6"><enum>(a)</enum><header>Selection of the lead partner institution</header><text>The Administrator, within 180 days after the date of enactment of this Act, shall select the lead partner institution described in section 2(a)(2). The Administrator shall select a public university or college which—</text>
 <paragraph id="H807FF7BB154B46B3BA05CEB812D54DE3"><enum>(1)</enum><text>has demonstrated and proven expertise in physical and environmental science, flooding, hydraulic research, hydroscience, engineering, and meteorological issues;</text>
 </paragraph><paragraph id="HB4C51D23848441BB813E786503F69620"><enum>(2)</enum><text>is located in a State which frequently experiences inland flooding;</text> </paragraph><paragraph id="HA4964ACC93C44DDE95B2DCBFBA676D13"><enum>(3)</enum><text>has previously partnered with, or received funds from, Federal and international agencies for flooding, hydrology, and watershed issues, including the Army Corps of Engineers, the United States Geological Survey, the National Oceanic and Atmospheric Administration, the Department of Agriculture, the Federal Emergency Management Agency, the National Science Foundation, the Department of Housing and Urban Development, and the United Nations Educational, Scientific, and Cultural Organization;</text>
 </paragraph><paragraph id="H8C728EC5E18A4DDF863C88296D26320F"><enum>(4)</enum><text>has the capacity to develop and submit a plan on how it will operate as the lead partner institution, the type of research, activities, and collaboration it would undertake, and how it would incorporate its previous work on issues related to the purposes of NFREC into its new mission as the lead partner institution;</text>
 </paragraph><paragraph id="H0101B249E1174D0CAD0CA5602433DBAF"><enum>(5)</enum><text>can demonstrate an ability to take the leading role of coordinating and fulfilling the purposes of NFREC;</text>
 </paragraph><paragraph id="H82A005252423453285FA6E9E63938233"><enum>(6)</enum><text>can demonstrate an ability to provide technical assistance and demonstration project management and oversight both of grantees demonstration projects and of demonstration projects initiated through consortium members;</text>
 </paragraph><paragraph id="HE190FCB36F3040EFAEBF3A8531E0D947"><enum>(7)</enum><text>can demonstrate an ability to incorporate NFREC work into undergraduate and graduate educational programs within the public university or college; and</text>
 </paragraph><paragraph id="H8A52234E63284E04B9E2433F76C8923D"><enum>(8)</enum><text>can demonstrate an ability to contribute the required non-Federal matching funding to maintain a lead partner institution center.</text>
 </paragraph></subsection><subsection id="H16AAA6FEF676484AB2BDA38860E5C54C"><enum>(b)</enum><header>Selection of consortium members</header><text>The Administrator, in partnership with the lead partner institution, shall select, within 90 days after the selection of the lead partner institution, additional universities and colleges to participate in a consortium through criteria as determined by the Administrator and the lead partner institution which shall, among other criteria determined by the Administrator and lead partner institution, prioritize institutions that—</text>
 <paragraph id="H44724898297D4F0AB29B34B659B93AA8"><enum>(1)</enum><text>have a focus or expertise in at least one of the categories described in section 2(b)(1);</text> </paragraph><paragraph id="H12D5D1C33D914AE489F86A403529E194"><enum>(2)</enum><text display-inline="yes-display-inline">have the ability to plan, conduct, and arrange for competent public research, data, education, and recommendations as they relate to flooding in diverse regions of the United States identified and in the categories described in section 2(b)(1) and meet the purposes of NFREC;</text>
 </paragraph><paragraph id="H79B9565B74804A1DBC7871CF1C476CD4"><enum>(3)</enum><text>can demonstrate an ability to provide technical assistance and demonstration project management and oversight;</text>
 </paragraph><paragraph id="H4E90208739B14606B4E8F4EBA7FFA62E"><enum>(4)</enum><text>can demonstrate an ability to incorporate NFREC work into undergraduate and graduate educational programs within the university or college; and</text>
 </paragraph><paragraph id="HCF847243964E444F97F3E9363134EAD0"><enum>(5)</enum><text>can demonstrate an ability to contribute the required non-Federal matching funding to maintain a consortium member center.</text>
 </paragraph></subsection><subsection id="H1AB022E62DF44E278E0176E57D91EE21"><enum>(c)</enum><header>Consortium partnerships</header><text>The member institutions of NFREC shall partner for the purposes of this Act in the following ways:</text> <paragraph id="HF95E383EB0F649D38F21C58E22D50D65"><enum>(1)</enum><header>NOAA Partnership</header><text>The National Oceanic and Atmospheric Administration shall partner directly with the lead partner institution for the purposes of NFREC.</text>
 </paragraph><paragraph id="H54E1C96DD3D54BB0B069FC479D7745B0"><enum>(2)</enum><header>Lead Partner Institution Partnership</header><text>The lead partner institution shall partner directly with the National Oceanic and Atmospheric Administration and the consortium members for the purposes of NFREC.</text>
 </paragraph><paragraph id="HB05A5FB45C4D458783768A0980113926"><enum>(3)</enum><header>Consortium Member Partnership</header><text>The consortium members shall partner with the lead partner institution for the purposes of NFREC.</text> </paragraph></subsection></section><section id="HFC1BBFD8218C48858F64C0671D1FE705"><enum>4.</enum><header>Partnerships and collaboration with Federal, regional, State, and local governments and organizations</header> <subsection id="H2451F32EB90A4AEEA27922DC560CF893"><enum>(a)</enum><header>Partnerships</header><text>NFREC shall partner with the United States Geological Survey and the Army Corps of Engineers for the purposes of this Act.</text>
 </subsection><subsection id="HCCBB10D2DA21454883DBD3DD403F9A4D"><enum>(b)</enum><header>Collaboration</header><text display-inline="yes-display-inline">NFREC shall—</text> <paragraph id="H2D662BCEA61D42D08AD94D20AE534149"><enum>(1)</enum><text>collaborate on Federal flood-related issues with Federal agencies such as the Federal Emergency Management Agency, the Environmental Protection Agency, the National Aeronautics and Space Administration, the National Science Foundation, and the Department of Agriculture;</text>
 </paragraph><paragraph id="H8FBC6383982F4FFF93962FE480BCC2F1"><enum>(2)</enum><text>collaborate and share best practices on regional, State, and locally specific flooding and flood-related issues with—</text>
 <subparagraph id="H8E482183155E46EF81522AB065448107"><enum>(A)</enum><text>State, county, and local governments;</text> </subparagraph><subparagraph id="H41404DECB20F4149A6DF306BCF2689C9"><enum>(B)</enum><text>local councils of governments or regional planning organizations;</text>
 </subparagraph><subparagraph id="H30143C2DFCB84037B878CFDD72DEC864"><enum>(C)</enum><text>State agriculture, natural resource, environment, economic development, and water agencies;</text> </subparagraph><subparagraph id="H91B39CE25AFF4A9A802F385122C7D0AB"><enum>(D)</enum><text>floodplain managers;</text>
 </subparagraph><subparagraph id="HE9309B6D38AD4D70921ED1CD67FDB0B9"><enum>(E)</enum><text>State Homeland Security personnel, county disaster recovery coordinators, emergency management personnel, and first responders;</text>
 </subparagraph><subparagraph id="HEFDE0F1C103F46BCB9B06911C0AFBCF0"><enum>(F)</enum><text>resource conservation and development councils;</text> </subparagraph><subparagraph id="HC29F91817A1A4B85A25537FAFEA5E028"><enum>(G)</enum><text>watershed organizations and boards;</text>
 </subparagraph><subparagraph id="H278487F6DD66407982CE98B09F0ABC00"><enum>(H)</enum><text>agriculture and commodity organizations and farmers;</text> </subparagraph><subparagraph id="H47A741FE10A247D490A6EB02E9795455"><enum>(I)</enum><text>environmental organizations; and</text>
 </subparagraph><subparagraph id="H5B434EE70FC94ED4A3E66BBB81F7BD31"><enum>(J)</enum><text>business and development organizations; and</text> </subparagraph></paragraph><paragraph id="H9AF27BF3D40E49F4A7ADA0A022887A60"><enum>(3)</enum><text>explore opportunities to collaborate, when appropriate, on Federal flood-related issues with other Federal agencies such as the Bureau of Reclamation, the Tennessee Valley Authority, the Bureau of Land Management, the National Park Service, the Bureau of Indian Affairs, the Public Health Administration, the National Science Foundation, the Department of Defense, the Department of the Interior, the Department of Housing and Urban Development, and various national laboratories.</text>
				</paragraph></subsection></section><section id="H34249B9F93CB430C9EC09AA20318F171"><enum>5.</enum><header>Information collection and dissemination</header>
			<subsection id="H7824813E4EA04BFB9C910A184CD73C07"><enum>(a)</enum><header>NOAA</header>
 <paragraph id="H9C115CE2E26C41AEB245FD0B684762E3"><enum>(1)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Administrator shall publish annually a report containing the activities, partnerships and collaborations, Federal policy recommendations, previous and continuing budgets, findings, and any other applicable information from the consortium members, and shall provide each report to Congress and the President and make it available to the public in an easily accessible electronic format on the National Oceanic and Atmospheric Administration’s website.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84C43D4393FE42C1B93FA6D6AF17F311"><enum>(2)</enum><header>Review of reports from consortium members</header><text>The Administrator shall review the reports from the consortium members to ensure that funds are being spent properly according to the purposes of this Act and that the consortium members are producing competent public research, data, education, and recommendations in regard to flooding and flood-related issues.</text>
 </paragraph><paragraph commented="no" id="H362C417F2D2448509E97336C76262EE9"><enum>(3)</enum><header>Review of consortium operations</header><text display-inline="yes-display-inline">The Administrator shall periodically review the operation of consortium members to ensure that funds are being spent properly according to the purposes of this Act and that the consortium members are producing competent public research, data, education, and recommendations in regard to flooding and flood-related issues.</text>
				</paragraph></subsection><subsection id="H0361F70C042E4ABC93A971E7E2190001"><enum>(b)</enum><header>Lead partner institution</header>
 <paragraph id="H305A781F55CA4ACD97E28CA26E1A7E6A"><enum>(1)</enum><header>Compilation of annual consortium member reports</header><text>The lead partner institution shall compile annually reports from consortium members, along with its own report, containing the activities, partnerships and collaborations, Federal policy recommendations, previous and continuing budgets, findings, and any other applicable information from consortium members, and shall provide this information to the Administrator annually by a date determined by the Administrator.</text>
 </paragraph><paragraph commented="no" id="HBC7A7B7B8E9F43C69EC24AE05A12BC22"><enum>(2)</enum><header>Annual lead partner institution report</header><text>In addition, the lead partner institution shall publish annually a report specific to its activities, partnerships and collaborations, State and local policy recommendations, previous and continuing budgets, findings, and other applicable information by a date determined by the Administrator which shall also be made available to the public in an easily accessible electronic format on the lead partner institution’s website.</text>
 </paragraph></subsection><subsection id="H2DAF279FA6BE42B29665940467C40708"><enum>(c)</enum><header>Consortium members</header><text>The consortium members shall each publish annually a report containing the activities, partnerships and collaborations, State and local policy recommendations, previous and continuing budgets, findings, and other applicable information by a date determined by the lead partner institution which shall also be made available to the public in an easily accessible electronic format on the consortium members’ websites.</text>
 </subsection><subsection id="H1C10DA090BAE48709076D637CEB97C80"><enum>(d)</enum><header>National flood research and education center website</header><text>NFREC shall establish a website which shall contain at least the following information:</text> <paragraph id="H7E925E58C1A94DD99C23C406E9F9DC16"><enum>(1)</enum><text>Key findings and best practices.</text>
 </paragraph><paragraph id="H848A1A77B49740BBAB62226C8A31F860"><enum>(2)</enum><text>Collaborations and partnerships.</text> </paragraph><paragraph id="H05C729EB445F4024BE0AEA7DC3847AC9"><enum>(3)</enum><text>Annual reports and other pertinent information on its purposes.</text>
 </paragraph><paragraph id="HAF04166AB1FB4787B904FAA3729E0D42"><enum>(4)</enum><text>The location and contact information for the consortium members.</text> </paragraph><paragraph id="HFB3F904915CF4A1D8D6D8AD26F742369"><enum>(5)</enum><text>Federal, State, local, and regionally specific public research, data, education, and policy recommendations which shall be updated in a timely manner with new information.</text>
 </paragraph><paragraph id="HCF42628A063D410ABC96260C8FD48DF6"><enum>(6)</enum><text>The variety of regions in the United States which are identified and categorized by NFREC, based on their specific flooding and flood-related issues, hydrology, weather, and related issues.</text>
 </paragraph><paragraph id="H3F997A61CC5648088CC51E0AADAC79F6"><enum>(7)</enum><text>Approved demonstration projects and their progress in addition to information on applying for demonstration project assistance.</text>
 </paragraph><paragraph id="H31D95CA693044E17B0826598F9DFB399"><enum>(8)</enum><text display-inline="yes-display-inline">Tools for monitoring, predicting, and modeling flooding as they become available.</text> </paragraph></subsection></section><section id="H18524767CEE94A1A8CBB5D066C978B0D"><enum>6.</enum><header>Technical assistance and demonstration projects</header> <subsection id="HCEDF268169AA467CA534AEE4C10F0634"><enum>(a)</enum><header>Technical assistance and demonstration projects</header><text display-inline="yes-display-inline">NFREC may provide technical assistance and demonstration project grant assistance to eligible entities on a competitive basis to assist with implementing recommendations of NFREC or testing new or improved strategies or technologies for the categories described in section 2(b)(1).</text>
 </subsection><subsection id="H24ED6362CFA748A189B2CDE0AAE4FE56"><enum>(b)</enum><header>Eligible Entities</header><text display-inline="yes-display-inline">The following are eligible entities for purposes of this section:</text> <paragraph id="HF594FCA8BCA8453F85CB990D0B6F432D"><enum>(1)</enum><text>State governments.</text>
 </paragraph><paragraph id="H250209A6FD264F03A84D7ABFB21C100F"><enum>(2)</enum><text>County governments.</text> </paragraph><paragraph id="H8B86D9D49C70454B8696CBBDEC3D01CE"><enum>(3)</enum><text>Local governments.</text>
 </paragraph></subsection><subsection id="HCE43CA85A70C41E8B8C7BC954F6093D0"><enum>(c)</enum><header>Technical Assistance</header><text>Consortium members may provide technical assistance at their discretion to eligible entities that have limited capacity for developing an application for demonstration project grants. Consortium members may also provide technical assistance at their discretion in implementing demonstration projects approved by the Administrator.</text>
 </subsection><subsection id="HC87C3205A8B04FB5B3198B2D03B78079"><enum>(d)</enum><header>Competitive Criteria</header><text>The Administrator, in partnership with the lead partner institution, shall develop criteria required for submitting a competitive demonstration project grant application and for the approval of such an application.</text>
 </subsection><subsection id="H30D30994B96F4B47888FD26091B48DDD"><enum>(e)</enum><header>Eligible Activities</header><text>Grantees may use funds only for flooding-related projects which implement recommendations of NFREC or for testing of—</text>
 <paragraph id="H7A57C898E3A44E56A30D2461FE12063D"><enum>(1)</enum><text>improved existing and or new risk analysis and risk management of flooding and flood-related events;</text>
 </paragraph><paragraph id="HEA10615311AF490CB3352BD55F635C17"><enum>(2)</enum><text>improved existing and or new risk assessment tools, methods, and models for flooding and flood risks used by Federal, State, and local governments and other interested organizations;</text>
 </paragraph><paragraph id="H96466C55C5C242159D30CA63AA7D4363"><enum>(3)</enum><text>improved existing and or new monitoring and predicting strategies and techniques of flooding and flood-related events; or</text>
 </paragraph><paragraph id="H8B1F1B6DE47446A6A871772E209B4099"><enum>(4)</enum><text>improved existing and or new flood management and prevention strategies and techniques.</text> </paragraph></subsection><subsection id="H52274E8ADF1D4392A00EFF8F41D73E26"><enum>(f)</enum><header>Subcontracting</header><text>Eligible entities may subcontract a portion of grant funds received for necessary construction-related costs to pursue an eligible activity.</text>
			</subsection><subsection id="HEB7ACAFA00FF4DE79E3F5BC8C597EA16"><enum>(g)</enum><header>Applications</header>
 <paragraph id="HE358818F740D419A9FE18E9D209B5D12"><enum>(1)</enum><header>Consortium review and approval</header><text display-inline="yes-display-inline">Within 60 days of receiving a completed application, the consortium member in whose region the project will take place and the lead partner institution shall review and approve or disapprove the application.</text>
 </paragraph><paragraph commented="no" id="H766FE54E4115401080E5D0DB1B0C1E16"><enum>(2)</enum><header>Administrator approval</header><text>Within 30 days of receiving an application that has been approved by the applicable consortium members, the Administrator shall determine whether to provide the project final approval.</text>
				</paragraph></subsection><subsection id="H3B6C1C5B01604DE8B6FBC620BD918028"><enum>(h)</enum><header>Grant Size</header>
 <paragraph id="HD598FEA8EC9F4B22A568221CDC981ED4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Demonstration project grant awards under this section shall not exceed $250,000 per project.</text> </paragraph><paragraph commented="no" id="H44F77332B12F4926A5E054ADBA94324B"><enum>(2)</enum><header>Waiver of grant size limitation</header><text>The Administrator may waive such grant size limitation if—</text>
 <subparagraph commented="no" id="H012D6C8112824BBCABDCE7699BE4BB83"><enum>(A)</enum><text>all consortium members approve of such a waiver;</text> </subparagraph><subparagraph commented="no" id="H2368DC9BB50A4D19925EEAA546F82C68"><enum>(B)</enum><text>the eligible entity has the expertise, or will work with partners that have the expertise, to manage the proposed project; and</text>
 </subparagraph><subparagraph commented="no" id="HAAE1D6ABD844438F80F8ED9E184EC356"><enum>(C)</enum><text>the eligible entity can show that a project involves multiple watersheds or jurisdictions, benefits multiple communities, has broad community support, and incorporates multiple aspects of NFREC’s work in the project.</text>
 </subparagraph></paragraph></subsection><subsection id="H073DB850FD544C17A606C19654699BC3"><enum>(i)</enum><header>Matching Funds</header><text>Entities receiving a demonstration project grant under this section shall be required to provide a 30-percent non-Federal cost share.</text>
 </subsection><subsection id="H286C59FB3F414961955BCFC43E17FE6D"><enum>(j)</enum><header>Total Demonstration Project Grant Amount Available</header><text>There shall be not more than $2,000,000 available annually for demonstration project grants under this section nationwide.</text>
 </subsection><subsection id="H35E17D06103F405183D8E527A1F0FED0"><enum>(k)</enum><header>Monitoring and Reporting</header><text>For a demonstration project that receives a grant under this section, the applicable regional consortium member shall monitor the effectiveness, efficiency, and progress of the project and report on these factors and their involvement periodically to the lead partner institution. The applicable regional consortium member shall make this information available through its website and additionally provide this information in its annual reports.</text>
			</subsection></section><section id="H2107D50850D9431084D709E3A35C5FFF"><enum>7.</enum><header>Authorization of appropriations</header>
 <subsection id="H3277119D8CF44CD09EDCDD464043A718"><enum>(a)</enum><header>In general</header><text>For each of the fiscal years 2018 through 2023, there are authorized for NFREC, $10,000,000, of which—</text>
 <paragraph id="HCBEA50C9F14B4523B889D52D84AFAC11"><enum>(1)</enum><text>not more than $2,000,000 each fiscal year shall be for the operation of the National Oceanic and Atmospheric Administration’s center; and</text>
 </paragraph><paragraph id="HD042A31301DA4583B2F0EF0886BF3F3D"><enum>(2)</enum><text>not more than $3,000,000 each fiscal year shall be for the operation of the lead partner institution’s center, matched by a 20-percent non-Federal cost share.</text>
				</paragraph></subsection><subsection id="H3EEA7E859A2746C5B5DE88B1B9252127"><enum>(b)</enum><header>Additional Authorization</header>
 <paragraph id="H2C41FF61CD26491882FAD4FC69C98E10"><enum>(1)</enum><header>Lead partner institution</header><text display-inline="yes-display-inline">There are authorized such sums as may be necessary for the lead partner institution to improve its facilities to a level that meets the requirements of the role of lead partner institution.</text>
 </paragraph><paragraph id="H503576CA61874C5E8AF2604A19C2D789"><enum>(2)</enum><header>Plan</header><text>Before the lead partner institution receives any funding under this subsection, a plan detailing what type of facility construction or improvements will take place must first be approved by the Administrator. Such plan shall include any land acquisition, engineering, design, and staffing and equipment needs, in addition to other information as required by the Administrator.</text>
 </paragraph><paragraph id="H9C52A2C530354C799C4BE4299F48187A"><enum>(3)</enum><header>Non-Federal cost share</header><text>There shall be a non-Federal cost share of 20 percent for facility improvement or construction projects pursued by the lead partner institution.</text>
 </paragraph><paragraph id="H0189450133D141B0B13D83E64C032F30"><enum>(4)</enum><header>Wage rate requirements</header><text>Any authorized and funded construction activity shall meet Federal prevailing wage requirements as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of part A of subtitle II of title 40, United States Code (commonly referred to as the <quote>Davis-Bacon Act</quote>).</text>
				</paragraph></subsection><subsection id="H7C5AC7062EC54CA19B5EB31F7B941E57"><enum>(c)</enum><header>Consortium Member Centers</header>
 <paragraph id="H2C46D37C382F461DBB9DE655EF3EF59A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not more than $3,000,000 each fiscal year shall be for the operation of all consortium members’ centers, matched by a 20-percent non-Federal cost share.</text>
 </paragraph><paragraph id="HD3676F01F4C24924AFAC2D6BE939D8C6"><enum>(2)</enum><header>Limitation</header><text>Any one consortium member shall not receive more than $500,000 in Federal funds in one fiscal year.</text> </paragraph></subsection><subsection id="HECA817C119C04E87BD3304628DFBA7AC"><enum>(d)</enum><header>Grants</header><text>Not more than $2,000,000 each fiscal year shall be made available for demonstration project grants nationwide.</text>
