 </subsection></section><section id="HD0F46F56968D4BAF918CDEED28347C69"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text> </section><title id="H9FEBFCA80AB243F08BB8962203C0A0C4"><enum>I</enum><header>Farms</header> <section id="HCC7D8C18A064487AB177B6143ADF93A7" section-type="subsequent-section"><enum>101.</enum><header>Use of Rural Energy for America Program to reduce food and crop waste</header> <subsection id="H900C7B6E90004991A0A66252FE522466"><enum>(a)</enum><header>Requirements relating to installation of anaerobic digesters</header><text display-inline="yes-display-inline">Section 9007(c) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107(c)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H748709340A3C4273BAD6CC91D9D86921" style="OLC">
 <paragraph id="H343B61B0413E4DE68723CB16E40B5EEA"><enum>(5)</enum><header>Requirements relating to installation of anaerobic digesters</header><text display-inline="yes-display-inline">In the case of a loan guarantee or grant provided under this subsection to an agricultural producer or rural small business to support the installation of an anaerobic digester that will use food waste in addition to manure to produce renewable energy, the Secretary shall obtain from the recipient of the loan guarantee or grant—</text>
 <subparagraph id="H7B91AE6B22C24004B9E3FD19C5207069"><enum>(A)</enum><text display-inline="yes-display-inline">a written commitment that the recipient has read and agrees to comply with the Food Recovery Hierarchy of the Environmental Protection Agency, particularly as applied to apparently wholesome food (as defined in section 22(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>) that may be provided to, or received by, the recipient; and</text>
 </subparagraph><subparagraph id="H7C4D8D1C896D403C899EFF08A2E03413"><enum>(B)</enum><text>a written end-product recycling plan that provides for the beneficial use of the material resulting from the anaerobic digester, in a manner that meets all applicable Federal, State, and local laws safeguarding human health and the environment.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HD76FB5DF993144A48AE58C603C249B28"><enum>(b)</enum><header>Funding</header><text>Section 9007(g)(1) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107(g)(1)</external-xref>) is amended—</text>
 <paragraph id="H66FEC9D3C2664DC0BC071D66B763930D"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="HA19FA7D301E147609031C121019C6BE7"><enum>(2)</enum><text>in subparagraph (E), by striking <quote>fiscal year 2014 and each fiscal year thereafter.</quote> and inserting <quote>each of fiscal years 2014 through 2018; and</quote>; and</text>
 </paragraph><paragraph id="HF68BAA96ECB24AC7915900BBF29170DB"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H62D69F55231547C8BA993C249D90020F" style="OLC"> <subparagraph id="HF0A9F8F37D5B4828A5733F8C7502F8B9"><enum>(F)</enum><text>$70,000,000 for fiscal year 2019 and each fiscal year thereafter, of which not less than $20,000,000 shall be reserved for use for loan guarantees and grants described in subsection (c)(5).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HF5ADC5E61D4B40909986884CCF45DF47" section-type="subsequent-section"><enum>102.</enum><header>Farm storage facility loan program</header><text display-inline="no-display-inline">Section 1614(a) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8789">7 U.S.C. 8789(a)</external-xref>) is amended by striking <quote>to construct or upgrade storage and handling facilities</quote> and inserting <quote>to acquire, construct, or upgrade storage, handling, and transportation facilities, which may include refrigerated vehicles to improve storage and marketing and other means to reduce food waste,</quote>.</text>
			</section><section id="H314C80530EB34EF2AA58B6E5E9B099FD"><enum>103.</enum><header>Composting as conservation practice</header>
 <subsection id="HEAD6CA70E9514554B7122C67EDD4867A"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1201(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3801">16 U.S.C. 3801(a)</external-xref>) is amended—</text> <paragraph id="HB9399DF435A94CA283AEDC276BA8D56E"><enum>(1)</enum><text>by redesignating paragraphs (3) through (27) as paragraphs (4) through (28), respectively; and</text>
 </paragraph><paragraph id="HB4008ED163E643D295D8AED6759C609C"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="H4454C41BAEA44827B93734A01A607039" style="OLC"> <paragraph id="HE8F0B9BEDD8643BC8A434E4363F1899C"><enum>(3)</enum><header>Composting practice</header><text display-inline="yes-display-inline">The term <term>composting practice</term> means—</text>
 <subparagraph id="HAC3BF79BBB794D86B8A0E613B87E414A"><enum>(A)</enum><text>an activity (including an activity that does not require the use of a composting facility) to produce compost from organic waste that is—</text>
 <clause id="HBF140141E8444B6293B00AA2C0C66AD4"><enum>(i)</enum><text>generated on a farm; or</text> </clause><clause id="H2DEB92D67DE44B2699C23DA630F1C5F1"><enum>(ii)</enum><text>brought to a farm from the nearby community; and</text>
 </clause></subparagraph><subparagraph id="HF3DE4078E0C04F0099593CE89D7F1AC7"><enum>(B)</enum><text>the use of compost on a farm to improve water retention and soil health, subject to the condition that such a use shall be in compliance with applicable Federal, State, and local laws.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HB470CBB8D2334260B7DFCAD180388D61"><enum>(b)</enum><header>Conservation stewardship program</header><text>Section 1238D(2)(B)(i) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3838d">16 U.S.C. 3838d(2)(B)(i)</external-xref>) is amended by inserting <quote>and composting practices</quote> after <quote>agriculture drainage management systems</quote>.</text>
 </subsection><subsection id="HFBE99474814340309F4B27FE97B9FD51"><enum>(c)</enum><header>Environmental quality incentives program</header><text>Section 1240A(4)(A)(ii) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-1">16 U.S.C. 3839aa–1(4)(A)(ii)</external-xref>) is amended by inserting <quote>, including composting practices</quote> before the semicolon at the end.</text>
 </subsection><subsection id="H11654A7AA87C4F70A6E34BF025F976AC"><enum>(d)</enum><header>Delivery of technical assistance</header><text>Section 1242(h) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842(h)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA21F94DCBEBF4FA499552000500A3BE5" style="OLC">
 <paragraph id="HEA01B00DF9C745AF976A8AD91B9AECD0"><enum>(4)</enum><header>Development of composting practice standard</header><text>In addition to conducting a review of any composting facilities practice standard under this subsection, the Secretary shall develop and implement a composting practice standard.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H818EFF9957934B9BACC0E7D77010245C"><enum>104.</enum><header>Study and report on methods to decrease incidence of food waste</header>
 <subsection commented="no" id="H360D79DE876741A989546C8B8781E344"><enum>(a)</enum><header>Definition of agricultural product</header><text display-inline="yes-display-inline">In this section, the term <term>agricultural product</term> has the meaning given the term <term>agricultural products</term> in section 207 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1626">7 U.S.C. 1626</external-xref>).</text> </subsection><subsection id="HA71E9C1612E340B5B6B14E83EE058054"><enum>(b)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study regarding—</text>
 <paragraph id="HCDA271FC63944987BE25439D7E9DA45D"><enum>(1)</enum><text>new technologies to increase the period during which an agricultural product may be stored before the agricultural product is considered adulterated under State or Federal law; and</text>
 </paragraph><paragraph id="HBBF6C65C3C624EE2A7BBF940A90B43F6"><enum>(2)</enum><text>a method to measure the quantity of agricultural product that is not harvested or sent to market each year by the farms that produce the agricultural product.</text>
 </paragraph></subsection><subsection id="H7D1A658E8F2B40BAAC14973C02FAD803"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report that includes—</text>
 <paragraph id="HBA4E5BCE1D344E50ABC2E6DDEDAF629A"><enum>(1)</enum><text>the results of the study conducted under subsection (b); and</text> </paragraph><paragraph id="H775CA068724442F5BCCEE734729D6CA2"><enum>(2)</enum><text>the recommendations of the Secretary with respect to methods of decreasing the incidence of food waste.</text>
					</paragraph></subsection></section></title><title id="H111BFA44B2DC43A09EEF26F809EE02D8"><enum>II</enum><header>Retail and restaurants</header>
			<section id="HF4E24A3743164874999C8CB4A67D33B7" section-type="subsequent-section"><enum>201.</enum><header>Good Samaritan food donation</header>
 <subsection id="H7ECD89667DD5412093D98059D70D1557"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>) is amended—</text> <paragraph id="H7F7BF9FEE5FE41648016FF66AD56D821"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="H7B719AA501824B51A9EB4E6F30D447EA"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H7205658F676344E4A045959757011D94"><enum>(i)</enum><text>by striking <quote>quality and labeling</quote> and inserting <quote>safety and safety-related labeling</quote>; and</text>
 </clause><clause id="H9407B871749D400A8023F71AE6094E05"><enum>(ii)</enum><text>by inserting <quote>passage of a date on a date label,</quote> after <quote>surplus,</quote>;</text> </clause></subparagraph><subparagraph id="HED1E152A75824E44B792826DB63F8109"><enum>(B)</enum><text>in paragraph (2)—</text>
 <clause id="H9B15662534354746BC7B104DD4429FB8"><enum>(i)</enum><text>by striking <quote>quality and labeling</quote> and inserting <quote>safety and safety-related labeling</quote>; and</text> </clause><clause id="H5207F575653441309D9E32CA514D559D"><enum>(ii)</enum><text>by inserting <quote>passage of a date on a date label,</quote> after <quote>surplus,</quote>;</text>
 </clause></subparagraph><subparagraph id="H3EDE8F50D27D4B4BA35B97762E733D2F"><enum>(C)</enum><text>in paragraph (3), by striking <quote>not required to give anything of monetary value</quote> and inserting <quote>not required to give anything of monetary value or charged a good Samaritan reduced price</quote>;</text> </subparagraph><subparagraph id="HFCA5377302314CFAB596988022E5D479"><enum>(D)</enum><text>by redesignating paragraphs (6), (7), (8), (9), and (10) as paragraphs (7), (8), (9), (10), and (11), respectively; and</text>
 </subparagraph><subparagraph id="H581437AC416445089E59E27D8215EE10"><enum>(E)</enum><text>by inserting after paragraph (5) the following:</text> <quoted-block display-inline="no-display-inline" id="H42857810C1B64CCC89E5F0C8A3A8FF86" style="OLC"> <paragraph id="HC94367590FCE474BB6DBBE1E393EF41D"><enum>(6)</enum><header>Good samaritan reduced price</header><text>The term <term>good Samaritan reduced price</term> means the price of an apparently wholesome food or an apparently fit grocery product that is an amount not greater than the cost of handling, administering, and distributing the apparently wholesome food or apparently fit grocery product.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HF85CFA7F3F214B59B116D4AC4755466A"><enum>(2)</enum><text>in subsection (c)—</text> <subparagraph id="H43827508018B40108A2947388B000156"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>or sells at a good Samaritan reduced price</quote> after <quote>donates in good faith</quote>;</text>
 </subparagraph><subparagraph id="H8EF783C76FB74902AF2F90997C581A03"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>or from a sale at a good Samaritan reduced price</quote> after <quote>donation in good faith</quote>;</text> </subparagraph><subparagraph id="HAFB875DA62514668B4BB218D4F9B00E4"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (4);</text>
 </subparagraph><subparagraph id="H4BC09CE0EDB244F39458C20C07A7D500"><enum>(D)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="H73F745F8B6684D67B9DAF29550BAF93A" style="OLC"> <paragraph id="H60DA1A681A0C40928E5DB434BA53B264"><enum>(3)</enum><header>Direct donations to needy individuals</header> <subparagraph id="H2142447530694684850C66E77F082000"><enum>(A)</enum><header>In general</header><text>A qualified direct donor described in subparagraph (B) shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of apparently wholesome food or an apparently fit grocery product that the qualified direct donor donates in good faith or sells at a good Samaritan reduced price to a needy individual.</text>
 </subparagraph><subparagraph id="HF5CDCC2EA7B74E6F97FB88A76A156DFA"><enum>(B)</enum><header>Qualified direct donor described</header><text>A qualified direct donor referred to in subparagraph (A) is a retail grocer, wholesaler, agricultural producer, restaurant, caterer, school food authority, or institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HB9AF49DDBECC4158AEDD33B27003C15B"><enum>(E)</enum><text>in paragraph (4) (as redesignated by subparagraph (C)), by striking <quote>Paragraphs (1) and (2)</quote> and inserting <quote>Paragraphs (1), (2), and (3)</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HFED1CC4CC5824C299069839F06416A84"><enum>(b)</enum><header>Regulations; guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall—</text>
 <paragraph id="H2E4847E7103E4D9688BF14ED1C3EB131"><enum>(1)</enum><text>in consultation with the Secretary of Health and Human Services, issue regulations with respect to the safety and safety-related labeling standards of an apparently wholesome food and an apparently fit grocery product under the Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>) (as amended by subsection (a));</text>
 </paragraph><paragraph id="H917287A05FF44EE6ADDBD79EEE6EF783"><enum>(2)</enum><text>promote awareness of food donation under that Act (as amended by subsection (a)); and</text> </paragraph><paragraph id="H6596AC45209D4523836F87040C1FA9F2"><enum>(3)</enum><text>issue guidance with respect to the amendments made by subsection (a).</text>
 </paragraph></subsection></section><section id="HB375ABB78B3841948CC7E51DA3D027F3"><enum>202.</enum><header>Report on food donation by retail food stores</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report describing the recommendations of the Secretary with respect to methods of increasing food donation by retail food stores, as defined by the Secretary.</text>
			</section><section id="H1AA0EF046EDE4086924ED40CD52FCBB0"><enum>203.</enum><header>Use of Commodity Credit Corporation funds to cover Emergency Food Assistance Program storage and
 distribution costs</header><text display-inline="no-display-inline">Section 204 of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7508">7 U.S.C. 7508</external-xref>) is amended—</text> <paragraph id="H1E371BD7293C47F1AC1D4B35FCB19A42"><enum>(1)</enum><text>by striking the section designation and heading and all that follows through <quote>available to the States</quote> in the first sentence of subsection (a)(1) and inserting the following:</text>

For purposes of the preceding sentence, the terms <quote>food bank</quote>, <quote>food pantry</quote>, and <quote>soup kitchen</quote> have the meanings given such terms by section 201A of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H7E3DBA2D85FF4D5898579183BC40174D"><enum>(b)</enum><header>Effective date</header><text>Except as otherwise provided in this subsection, the amendment made by this section shall apply to contributions made after the date of the enactment of this Act, in taxable years ending after such date.</text>
				</subsection></section></title><title id="HD9F164E7E20C4F15A0740FAA258BA287"><enum>III</enum><header>Schools and other institutions</header>
 <section id="HE76C13A95CAF49B8AB485E6C9DF7629A"><enum>301.</enum><header>Establishment of Food Recovery Liaison</header><text display-inline="no-display-inline">Subtitle A of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6901">7 U.S.C. 6901</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H13517AC53D2A4FAA9194AF0D6C331771" style="OLC">
					<section commented="no" id="HC7616408702C4B97842DAE9D1878B453"><enum>221.</enum><header>Food Recovery Liaison</header>
 <subsection id="H7606C3BC161D4B5F99B24B4F4A7C55C1"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish within the Office of the Secretary a Food Recovery Liaison to coordinate Federal programs to measure and reduce the incidence of food waste in accordance with this section.</text>
 </subsection><subsection id="H862256A48D5142C4B07FF35ABA1D5651"><enum>(b)</enum><header>Duties</header><text>The Food Recovery Liaison shall—</text> <paragraph id="H2DFB3F36A87D4FEB98C127DB52E334E9"><enum>(1)</enum><text>coordinate food waste reduction efforts with other Federal agencies, including—</text>
 <subparagraph id="HC74ACF63FE064177A3BC70B6B479D0C5"><enum>(A)</enum><text>the Environmental Protection Agency; and</text> </subparagraph><subparagraph id="HD3D3EA43E2644FA0A4C205ADA087191A"><enum>(B)</enum><text>the Food and Drug Administration;</text>
 </subparagraph></paragraph><paragraph id="HA955411427824C0F8A3002D434516410"><enum>(2)</enum><text>support and promote Federal programs to measure and reduce the incidence of food waste;</text> </paragraph><paragraph id="H0198EB0195A24357BADCC99BF93EB1CC"><enum>(3)</enum><text>provide information to, and serve as a resource for, entities engaged in food recovery concerning the availability of, and eligibility requirements for, participation in Federal programs;</text>
 </paragraph><paragraph id="HF4C0675E5FA648E4A1DD40E25AD34BB0"><enum>(4)</enum><text>raise awareness of food recovery issues in interactions with employees of the Department; and</text> </paragraph><paragraph id="H72D3EAA28A9B4F3A903A62D4446F3AA1"><enum>(5)</enum><text>make recommendations with respect to reducing the incidence of food waste.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H036E30FAA0674EB3B93649004DCF2E8F" section-type="subsequent-section"><enum>302.</enum><header>Amendments to Federal Food Donation Act to require food donations by executive agencies and
			 Congress</header>
 <subsection id="HF1B552428FAF444C912117C90E30D713"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">Section 2 of the Federal Food Donation Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/247">Public Law 110–247</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/1792">42 U.S.C. 1792</external-xref> note) is amended by striking <quote>encourage</quote> and inserting <quote>require</quote>.</text>
 </subsection><subsection id="HE5F4D050D8F44F86A4DB17FCFB1F0E16"><enum>(b)</enum><header>Definitions</header><text>Section 3 of the Federal Food Donation Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/247">Public Law 110–247</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/1792">42 U.S.C. 1792</external-xref> note) is amended—</text>

 <paragraph id="HDF1E5BFA2493472AB0AD6D58E40560B8"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HCA54B872BBE54F0396F2533B88ADFBC7"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting the subparagraphs appropriately;</text>

 </subparagraph></paragraph><paragraph commented="no" id="H4603A2A2C3984EE5945A5FEEAF5C6929"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HFA801EC8725B449DA5E436E27531D49F" style="OLC"> <subsection commented="no" id="HB86975D26FE8494C99062713FABD663A"><enum>(c)</enum><header>Application to Congress</header> <paragraph commented="no" id="HBA5A7C65A53B4B8EA053EB91CC0614D9"><enum>(1)</enum><header>Contracts</header><text>This Act shall apply to the House of Representatives and to contracts entered into by the House of Representatives, and to the Senate and to contracts entered into by the Senate, in the same manner and to the same extent as this Act applies to an executive agency and to contracts entered into by an executive agency.</text>
 </paragraph><paragraph commented="no" id="H170DF27E073F4FB6A2A5D9D088BED78A"><enum>(2)</enum><header>Administration</header><text>For purposes of carrying out paragraph (1)—</text> <subparagraph commented="no" id="HE44AF0D11771441AAE5D6EA7006638BA"><enum>(A)</enum><text>the Chief Administrative Officer of the House of Representatives shall be considered to be the head of the House of Representatives; and</text>
 </subparagraph><subparagraph commented="no" id="H21BCC16BE7A24E1796018455E9A0A78B"><enum>(B)</enum><text>the Secretary of the Senate shall be considered to be the head of the Senate.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="H3E7B11B7F48647B2A111692108990A60"><enum>(d)</enum><header>Data; reports</header> <paragraph commented="no" id="HDB5187E0F4B34FFD9384E3E93BDBD7FA"><enum>(1)</enum><header>Data</header><text>The head of each executive agency shall collect data on the quantity of apparently wholesome food donated in accordance with this Act.</text>
 </paragraph><paragraph commented="no" id="H95369B629A2E4821BD5F40696BF6BD77"><enum>(2)</enum><header>Reports</header><text>Not less frequently than once every 2 years, the head of each executive agency shall submit to Congress a report describing the data collected under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H8ECE9A645AA04DF8B171D4BC911BCB64"><enum>(d)</enum><header>Authorization of appropriations</header><text>The Federal Food Donation Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/1792">42 U.S.C. 1792</external-xref>) is amended by adding at the end the following:</text>

 <section id="H5B5153E9769149A3A926EB5150783858"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary of Agriculture to carry out this Act $10,000,000 for each fiscal year.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="H80E8FA60AC7540AA83E5679457479217"><enum>303.</enum><header>Food and agriculture service learning program</header><text display-inline="no-display-inline">Section 413 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7633">7 U.S.C. 7633</external-xref>) is amended—</text>
 <paragraph id="H4BD7EC4A27464092835E95628CEB5A0F"><enum>(1)</enum><text>in subsection (b)(4), by inserting <quote>to promote agricultural education, to raise awareness regarding the consequences of wasted food, and to encourage the implementation of food recovery initiatives to reduce the quantity of wasted food</quote> before the semicolon;</text>
 </paragraph><paragraph id="H1BCDE660418A44D38D8917BCB2E06CE4"><enum>(2)</enum><text>in subsection (c)—</text> <subparagraph id="HF221EDCAA68F456C91D3E17D4CB24E86"><enum>(A)</enum><text>in paragraph (2)—</text>
 <clause id="H5F6902FE973F4D07B6DB3EC6BD502CE8"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and where food comes from; and</quote> and inserting <quote>, where food comes from, the consequences of food waste, and food recovery initiatives;</quote>;</text> </clause><clause id="H2F96DF2FE137452C86F3DD873EAB1FAF"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </clause><clause id="H69EC0D2E1B8D44A9BCC8744EE88368CA"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1A90CBD2E0F64A52892A86B31688E84A" style="OLC"> <subparagraph id="H54BEF5DC10CB40EF979FCC43BEE2005E"><enum>(E)</enum><text>have the capacity to carry out national or regional projects that include 2 or more States.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H24BDA176E10A4C07813F1204DB9DD7DE"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5B22EB7DD3BF4D2EB0828E256C5AE67C" style="OLC"> <paragraph id="H17AB362067084881996BA6D8F59F66F6"><enum>(3)</enum><header>Reservation</header><text>The majority of the funds made available to carry out this subsection shall be reserved for projects that—</text>
 <subparagraph id="H0A40888AA1BB4973B54AA2BEE4C34ECB"><enum>(A)</enum><text>are larger in scale as compared to other proposed projects;</text> </subparagraph><subparagraph id="H75D1FF01E48C46B4BEA0F1E8FFF66892"><enum>(B)</enum><text>are national or regional in scope; and</text>
 </subparagraph><subparagraph id="H02E00B19410E4B1FAC2612C681EBAC82"><enum>(C)</enum><text>include 2 or more States.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H0C4FCCC5C92F4CA4BD6C76B1F87593C6"><enum>(3)</enum><text>in subsection (e)(1), by striking <quote>$25,000,000, to remain available until expended</quote> and inserting <quote>$5,000,000 for each of fiscal years 2018 through 2022</quote>.</text>
				</paragraph></section><section id="H1323AEF2F2B242188904BC92B01A3BEC" section-type="subsequent-section"><enum>304.</enum><header>Modification of National School Lunch Program procurement requirements to encourage purchase of
 lower-price, nonstandard-size or -shape produce</header><text display-inline="no-display-inline">Section 9(a)(4)(C) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)(4)(C)</external-xref>) is amended by striking clause (ii) and inserting the following:</text>

 <clause commented="no" display-inline="no-display-inline" id="H44F3BFF8C2114893BF5384CEE2E3686D"><enum>(ii)</enum><text display-inline="yes-display-inline">in the product specifications and practices required under clause (i), encourage State departments of agriculture and education, school food authorities, local educational agencies, and local processing entities to purchase lower-price, nonstandard-size or -shape produce to be used in school nutrition programs under this Act and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771</external-xref> et seq.); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HB663787C835B4759A5CD4E32510B6EF1" section-type="subsequent-section"><enum>305.</enum><header>Farm to school grant program to improve access to local foods in schools and reduce food waste</header><text display-inline="no-display-inline">Section 18(g)(3) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769(g)(3)</external-xref>) is amended—</text>
 <paragraph id="H53116738C5A042F4864FAB62E2A0445C"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(v), by inserting <quote>and reducing food waste at both the school and farm levels</quote> before the semicolon at the end; and</text> </paragraph><paragraph id="HE0F1D1680FBC4880BF5AB015DF3AA53C"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H80E705A8545E40D9942158F6916FB19E" style="OLC">
 <subparagraph id="H7ACFF41415174E8F9B3555FC1A0F4D4A"><enum>(D)</enum><header>Priority for projects with food waste plans</header><text>In making awards under this subsection, the Secretary shall give priority to eligible schools that have in effect a plan to reduce or recover food waste.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H8B12E0739A104287A9B045BBDFF534E4" style="OLC"><enum>IV</enum><header>Food date labeling</header>
 <section id="HD5B07F062C3E43DFAABA869DDB137295"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H46FA66DFB94D4A4799D5EF1D35BC5185"><enum>(1)</enum><header>Administering Secretaries</header><text>The term <term>administering Secretaries</term> means—</text>
 <subparagraph id="HDEE05CD928194696A3AE99F44D874D82"><enum>(A)</enum><text>with respect to products described in paragraph (4)(A), the Secretary; and</text> </subparagraph><subparagraph id="HC5BCD793850541D8A816F9DAFC08B445"><enum>(B)</enum><text>with respect to products described in paragraph (4)(B), the Secretary of Health and Human Services.</text>
 </subparagraph></paragraph><paragraph id="H9EC22364B29F42D6BE6E119D33C073B5"><enum>(2)</enum><header>Food labeler</header><text>The term <term>food labeler</term> means the producer, manufacturer, distributor, or retailer that places a date label on food packaging of a product.</text>
 </paragraph><paragraph id="H58562EE64EAC4C2BA870509AF11B3C5E"><enum>(3)</enum><header>Quality date</header><text>The term <term>quality date</term> means a date voluntarily printed on food packaging that is intended to communicate to consumers the date after which the quality of the product may begin to deteriorate, but the product remains apparently wholesome food (as defined in section 22(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>).</text>
 </paragraph><paragraph id="H9C7CBF4807074D3C80AD46C00F33D8B6"><enum>(4)</enum><header>Ready-to-eat product</header><text>The term <term>ready-to-eat product</term> means—</text> <subparagraph id="H5F555C7890C9422480C08A9C5EE29DE6"><enum>(A)</enum><text>with respect to a product under the jurisdiction of the Secretary, a product that—</text>
 <clause id="H099F6F376CB94A6ABC5EE34CAF701925"><enum>(i)</enum><text>is in a form that is edible without additional preparation to achieve food safety and may receive additional preparation for palatability or aesthetic, epicurean, gastronomic, or culinary purposes; and</text>
 </clause><clause id="HB62EC5BDE1E04870B0399B769DF0911D"><enum>(ii)</enum><text>is—</text> <subclause id="H7B288E67E7DE4B9DB4C084AF2A53AC2F"><enum>(I)</enum><text>a poultry product (as defined in section 4 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453</external-xref>));</text>
 </subclause><subclause id="HBF59A38A48A748A6AA28EC0D4B3FA7E4"><enum>(II)</enum><text>a meat food product (as defined in section 1 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref>)); or</text>
 </subclause><subclause id="H99DF902AF3A748ED889ED5D26A437181"><enum>(III)</enum><text>an egg product (as defined in section 4 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1033">21 U.S.C. 1033</external-xref>)); and</text> </subclause></clause></subparagraph><subparagraph id="H8A28593482F04B0F8568007D3E697838"><enum>(B)</enum><text>with respect to a food (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>)) under the jurisdiction of the Secretary of Health and Human Services—</text>
 <clause id="H1AEBC1FEA64346A881990679E535FEF4"><enum>(i)</enum><text>a food that is normally eaten in its raw state; or</text> </clause><clause id="HAEFB4491F9DA45108AFD55C0E7564FB1"><enum>(ii)</enum><text>any other food, including a processed food, for which it is reasonably foreseeable that the food will be eaten without further processing that would significantly minimize biological hazards.</text>
 </clause></subparagraph></paragraph><paragraph id="HAC135E18CB814125845DA0994B0508C2"><enum>(5)</enum><header>Safety date</header><text>The term <term>safety date</term> means a date printed on food packaging of a high-risk ready-to-eat product, which signifies the end of the estimated period of shelf life under any stated storage conditions, after which the product may pose a health safety risk.</text>
				</paragraph></section><section id="H6205279E946F48B19586AB0B28752FC1"><enum>402.</enum><header>Quality dates and safety dates</header>
				<subsection id="H8D905AB0D43B4C1D82797410C09F07B1"><enum>(a)</enum><header>Quality dates</header>
 <paragraph id="H5F5BD10DF2B1483884ADFE7CD4B76F73"><enum>(1)</enum><header>In general</header><text>If a food labeler includes a quality date on food packaging, the label shall use the uniform quality date label phrase under paragraph (2).</text>
 </paragraph><paragraph id="H54CAA27D093A48CE86D51B49E1F095A9"><enum>(2)</enum><header>Uniform phrase</header><text>The uniform quality date label phrase under this paragraph shall be <quote>BEST If Used By</quote>, unless and until the administering Secretaries, acting jointly, specify through rulemaking another uniform phrase to be used for purposes of complying with paragraph (1).</text>
 </paragraph><paragraph id="HD78C67E48DA446DCADD33F9DBCAE1E3B"><enum>(3)</enum><header>Option of labeler</header><text>The decision to include a quality date on food packaging shall be at the discretion of the food labeler.</text>
					</paragraph></subsection><subsection id="HA621AB6C40A14E69AE81B03E6C45D197"><enum>(b)</enum><header>Safety dates</header>
 <paragraph id="HB20FB2BA0234442282EADC1B3E33AEC2"><enum>(1)</enum><header>In general</header><text>The label of a ready-to-eat product that meets the criteria established under paragraph (3)(A) shall include a safety date determined under paragraph (3)(B) that is immediately preceded by the uniform safety date label phrase under paragraph (2).</text>
 </paragraph><paragraph id="HD4BBC538325B4FE8AE71852F4EA5331F"><enum>(2)</enum><header>Uniform phrase</header><text>The uniform safety date label phrase under this paragraph shall be <quote>USE By</quote>, unless and until the administering Secretaries jointly specify through rulemaking another uniform phrase to be used for purposes of complying with paragraph (1).</text>
 </paragraph><paragraph id="HFE04B21C1C5F49A2ADF49887B8ECC13E"><enum>(3)</enum><header>High-risk ready-to-eat products</header><text>The administering Secretaries, acting jointly, shall issue guidance—</text> <subparagraph id="H4AA937B37D3141EB90A99D580F72DD54"><enum>(A)</enum><text>establishing criteria for determining the conditions under which ready-to-eat products may have a high level of risk associated with consumption after a certain date; and</text>
 </subparagraph><subparagraph id="H703217A350584230914F8AF808B9BFF4"><enum>(B)</enum><text>for determining safety dates for high-risk ready-to-eat products described in subparagraph (A).</text> </subparagraph></paragraph></subsection><subsection id="H1584431F0C8D415AB9BE69C08A1CE730"><enum>(c)</enum><header>Quality date and safety date labeling</header> <paragraph id="H1CCED5E1AF534339BF4BCD850BDFD653"><enum>(1)</enum><header>In general</header><text>The quality date and safety date, as applicable, and immediately adjacent uniform quality date label phrase or safety date label phrase shall be—</text>
 <subparagraph id="HC579EF7472FA4C389318DB4AA870C8E3"><enum>(A)</enum><text>in single easy-to-read type style; and</text> </subparagraph><subparagraph id="H28D059A8591948E2BEE4090CC0AD8D39"><enum>(B)</enum><text>located in a conspicuous place on the package of the food.</text>
 </subparagraph></paragraph><paragraph id="H0629C33235A34880AA48EF73D40E6023"><enum>(2)</enum><header>Date format</header><text>Each quality date and safety date shall be stated in terms of day and month and, as appropriate, year.</text>
 </paragraph><paragraph id="HE94D9B0D9D224CB89D150819C9E7B4F4"><enum>(3)</enum><header>Abbreviations</header><text>A food labeler may use a standard abbreviation of <quote>BB</quote> and <quote>UB</quote> for the quality date and safety date, respectively, only if the food packaging is too small to include the uniform phrase described in subsection (a)(2) or (b)(2), as applicable.</text>
 </paragraph><paragraph id="HD24E0C40CF944FB2B732CF6F19CC0EF2"><enum>(4)</enum><header>Freeze by</header><text>A food labeler may add <quote>or Freeze By</quote> following a quality date or safety date uniform phrase described in subsection (a)(2) or (b)(2), as applicable.</text>
 </paragraph></subsection><subsection id="H3F57B0F5726E46F8AE65B84ADC6D38F3"><enum>(d)</enum><header>Sale or donation after quality date</header><text display-inline="yes-display-inline">The sale, donation, or use of any product shall not be prohibited based on passage of the quality date of the product.</text>
 </subsection><subsection id="H7C819A73929A4C80B1C2B9715B16B3E3"><enum>(e)</enum><header>Education</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the administering Secretaries, acting jointly, shall provide consumer education and outreach on the meaning of quality date and safety date food labels.</text>
				</subsection><subsection id="HA8C8C8FE46A640F0844A76D463F6E067"><enum>(f)</enum><header>Rule of construction; preemption</header>
 <paragraph id="HC72596275C2243F09A8F843FBF390352"><enum>(1)</enum><header>Rule of construction</header><text>Nothing in this section prohibits any State or political subdivision of a State from establishing or continuing in effect any requirement that prohibits the sale or donation of foods based on passage of the safety date.</text>
 </paragraph><paragraph id="HBD108EC541284C67BB069428FA44E497"><enum>(2)</enum><header>Preemption</header><text>No State or political subdivision of a State may establish or continue in effect any requirement that—</text>
 <subparagraph id="H511B26BEEBFB4BA28DB67BB3E7301A58"><enum>(A)</enum><text>relates to the inclusion in food labeling of a quality date or a safety date that is different from or in addition to, or that is otherwise not identical with, the requirements under this section; or</text>
 </subparagraph><subparagraph id="H4DE1BCA9CD2E4DC28395BE0B23C299C7"><enum>(B)</enum><text>prohibits the sale or donation of foods based on passage of the quality date.</text> </subparagraph></paragraph><paragraph id="H9C628C45E3164B8DAE2BAE252BE33BEF"><enum>(3)</enum><header>Enforcement</header><text>The administering Secretaries, acting jointly and in coordination with the Federal Trade Commission, shall ensure that the uniform quality date label phrase and uniform safety date label phrase are standardized across all food products.</text>
 </paragraph><paragraph id="HC6341A62333C4A04A04F81F6870A46D7"><enum>(4)</enum><header>Savings</header><text>Nothing in this Act, any amendment made by this Act, or any standard or requirement imposed pursuant to this Act preempts, displaces, or supplants any State or Federal common law rights or any State or Federal statute creating a remedy for civil relief, including those for civil damage, or a penalty for criminal conduct.</text>
 </paragraph></subsection><subsection id="HC613AF18DD3340DCA55F83A45DD490B8"><enum>(g)</enum><header>Time temperature indicator labels</header><text display-inline="yes-display-inline">Nothing in this section prohibits or restricts the use of time-temperature indicator labels or similar technology that is consistent with the requirements of this Act.</text>
				</subsection></section><section id="HF5C8F841FA594BFCA04456C2DDE6E995"><enum>403.</enum><header>Misbranding violation for quality dates and safety dates in food labeling</header>
 <subsection id="HA513DBDE06824B6A8EB1AFF6234D1337"><enum>(a)</enum><header>FDA violations</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5D53059F7B284A62B3A351A21CDC7940" style="OLC">
 <subsection id="H30BCC9467DCD400FBCABB0C9C2C49542"><enum>(z)</enum><text>if its labeling is in violation of section 402 of the <short-title>Food Recovery Act of 2017</short-title> (relating to quality dates and safety dates).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HE48B7FA7236042739206D646F2A32245"><enum>(b)</enum><header>Poultry products</header><text>Section 4(h) of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453(h)</external-xref>) is amended—</text>
 <paragraph id="H08CB6994290841858A5F8C8153EC7096"><enum>(1)</enum><text>in paragraph (11), by striking <quote>or</quote> at the end;</text> </paragraph><paragraph id="H6B63976DB6F74C759A7F92C0ADF71B3C"><enum>(2)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </paragraph><paragraph id="H9109FEAB8CC949CCA67B1113686723E5"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE20EA230EA8945168F4F44BC87B82CD8" style="OLC"> <paragraph id="H07CA15C543A34163A53DA4F5E6AC0CDA"><enum>(13)</enum><text>if it does not bear a label in accordance with section 402 of the <short-title>Food Recovery Act of 2017</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H802F29F6493341AD8A0F273E06465683"><enum>(c)</enum><header>Meat products</header><text>Section 1(n) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601(n)</external-xref>) is amended—</text> <paragraph id="HF0A31E56ABA74220A092B057A18EBF2B"><enum>(1)</enum><text>in paragraph (11), by striking <quote>or</quote> at the end;</text>
 </paragraph><paragraph id="HA48812DD90554ADEBED2E49B8363F0BD"><enum>(2)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph><paragraph id="H22F118DEC7D641E49946081FD1CE21FD"><enum>(3)</enum><text>by adding at the end the following:</text>

 <paragraph id="H9428462023BB47B98CF72F3E4AF2D427"><enum>(13)</enum><text>if it does not bear a label in accordance with section 402 of the <short-title>Food Recovery Act of 2017</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H3D0BF1BF1CB04BA09D8A800D47150352"><enum>(d)</enum><header>Egg products</header><text>Section 7(b) of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1036">21 U.S.C. 1036(b)</external-xref>) is amended in the first sentence by adding before the period at the end <quote>or if it does not bear a label in accordance with section 402 of the <short-title>Food Recovery Act of 2017</short-title></quote>.</text>
				</subsection></section><section id="H63514FE7BE4944B7A6C0B38F9C581084"><enum>404.</enum><header>Regulations and guidance</header>
 <subsection id="HECA4A4F8D7074085AC20A1B717E7E7B7"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the administering Secretaries, acting jointly, shall—</text>
 <paragraph id="HD428E91E17D94A28AD0349ECB7001D48"><enum>(1)</enum><text>promulgate final regulations for carrying out this title and the amendments made by this title (other than section 402(b)(3)); and</text>
 </paragraph><paragraph id="H29078F07FE6844A780D58964208170C0"><enum>(2)</enum><text>issue the guidance required by section 402(b)(3).</text> </paragraph></subsection><subsection id="HFBA1A94C03D44FC283725729CE27839E"><enum>(b)</enum><header>Updates to guidance</header><text>Not less frequently than once every 4 years, the administering Secretaries, acting jointly, shall review and, as the administering Secretaries determine to be appropriate, update the guidance required by section 402(b)(3).</text>
 </subsection></section><section id="H95FCA3315EAE42C3943881EB60244D3F"><enum>405.</enum><header>Delayed applicability</header><text display-inline="no-display-inline">This title and the amendments made by this title shall apply only with respect to food products that are labeled on or after the date that is 2 years after the date on which final regulations are promulgated under section 404(a)(1).</text>
 </section><section commented="no" display-inline="no-display-inline" id="H91FE8411D1D94A8B9EA4568CEFDD9D20" section-type="subsequent-section"><enum>406.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the administering Secretaries, acting jointly, shall report to the appropriate committees of Congress on rates of compliance of food labelers with the food date labeling requirements under this title and the amendments made by this title.</text>
			</section></title><title id="H5AFFE522FF01446EAD6EC71DBA6ADDE2"><enum>V</enum><header>Consumers and local infrastructure</header>
			<section id="H5AFC4B23C21C48F5B3AE29A33E030048"><enum>501.</enum><header>Support for national media campaigns to decrease incidence of food waste</header>
 <subsection id="HE296CAFCBD4E4AC7954D91E31BF8AAF4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall support national media campaigns to decrease the incidence of food waste.</text> </subsection><subsection commented="no" id="HBA4207CBC9FB442C9DE3AF5298246425"><enum>(b)</enum><header>Mandatory funding</header> <paragraph commented="no" id="H47B0D3925DA248A192C53FCA003DAE65"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall use $8,000,000 of funds of the Commodity Credit Corporation to carry out this section for fiscal year 2018.</text>
 </paragraph><paragraph commented="no" id="H055C062E69254F3384A97D841AB18846"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">Funds described in paragraph (1) shall remain available until expended.</text> </paragraph></subsection></section><section id="H858E18CC50CB4BC19AD49D9801F1BA68" section-type="subsequent-section"><enum>502.</enum><header>Increase in resources for community facilities loans directed at composting and anaerobic digestion food waste-to-energy operations</header><text display-inline="no-display-inline">Section 306(a)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)(1)</external-xref>) is amended by inserting after the first sentence the following: <quote>5 percent of the amounts made available for each fiscal year for loans for essential community facilities under the preceding sentence shall be reserved for loans, in accordance with subsection (c)(2), for municipal or county composting, anaerobic digestion food waste-to-energy projects, and the conversion of animal waste products into industrial products or into raw materials that can be converted into finished products other than by anaerobic digestion or the production of bioethanol through fermentation. The Secretary shall not make or insure a loan under the preceding sentence to an entity that will use the amounts under the loan for an anaerobic digester that uses solely manure as undigested biomass, and shall give preference to loans under the preceding sentence for anaerobic digesters that use primarily nonedible food, crop waste, or nonedible food and crop waste as undigested biomass.</quote>.</text>
			</section><section id="H32B7A1F4A2AF42BF81B62D6C6D7E2039"><enum>503.</enum><header>Expansion of rural utilities service water and waste disposal program to provide loans and grants
			 for rural communities to adapt waste disposal facilities to incorporate
 anaerobic digestion food waste-to-energy operations</header><text display-inline="no-display-inline">Section 306 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926</external-xref>) is amended by inserting after subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H48ECDF5283594FF09F199A14435471A4" style="OLC">
					<subsection id="H8C387AE1F42C41909D943FECBFE56891"><enum>(c)</enum><header>Water or waste disposal loans and grants for projects To incorporate anaerobic digestion food
			 waste-to-Energy operations in waste disposal facilities</header>
 <paragraph id="H19C545015B3F4E0895222E5EE3A5558B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning in fiscal year 2018, in addition to any other amounts available for water or waste disposal loans and grants under paragraphs (1) and (2) of subsection (a), $50,000,000 of the funds of the Commodity Credit Corporation for each fiscal year shall be available for those loans and grants, of which the Secretary shall use—</text>
 <subparagraph id="H567A9C2EA4214A4E82CDD01BFBE1D60A"><enum>(A)</enum><text>$25,000,000 for loans, in accordance with paragraph (2), for the adaptation of waste disposal facilities to incorporate anaerobic digestion food waste-to-energy operations; and</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="HAB9B57E31E8E4CBD8D2F3F9B000C9BFE"><enum>(B)</enum><text display-inline="yes-display-inline">$25,000,000 for grants, in accordance with paragraph (2), for the adaptation of waste disposal facilities to incorporate anaerobic digestion food waste-to-energy operations.</text>
							</subparagraph></paragraph><paragraph id="H78A84510BFCE4051A4168439AD633460"><enum>(2)</enum><header>Requirements</header>
 <subparagraph id="H0FC756FA31EA4009A3DD0FDA5CBB3CAC"><enum>(A)</enum><header>In general</header><text>A loan or grant is made in accordance with this paragraph if, before making the loan or grant, the Secretary has obtained from the recipient of the loan or grant—</text>
 <clause id="H5987A095D19E459D82EA6CCCE108A365"><enum>(i)</enum><text display-inline="yes-display-inline">a written commitment that the recipient has read and agrees to comply with the Food Recovery Hierarchy of the Environmental Protection Agency, particularly as applied to apparently wholesome food (as defined in section 22(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>) that may be provided to or received by the recipient; and</text>
 </clause><clause id="HFB04A21A3699456FBBA9C175AE9EF658"><enum>(ii)</enum><text display-inline="yes-display-inline">a written end-product recycling plan that provides for the beneficial use of the material resulting from any anaerobic digestion food waste-to-energy operation with respect to which the loan or grant is made, in a manner that meets all applicable Federal, State, and local laws that protect human health and the environment.</text>
 </clause></subparagraph><subparagraph id="H3E8AE6C5C33B4E47B8B7AE6450475777"><enum>(B)</enum><header>Limitation</header><text>A loan or grant under paragraph (1) may not be used for an anaerobic digester that uses solely manure as undigested biomass.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H767BAD67EEB346DD800201C48B8CD7F9"><enum>(C)</enum><header display-inline="yes-display-inline">Preference</header><text display-inline="yes-display-inline">The Secretary shall give preference to loans and grants under paragraph (1) for anaerobic digesters that use primarily nonedible food, crop waste, or nonedible food and crop waste as undigested biomass.</text>
 </subparagraph></paragraph><paragraph id="H6D60D94879E14371A966E37992F9CDF4"><enum>(3)</enum><header>Availability</header><text>Funds made available under paragraph (1) shall remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="HE7240F3EAFB84042BB6D0278487209D1"><enum>504.</enum><header>Grants for composting and anaerobic digestion food waste-to-energy projects</header> <subsection id="H6189F4D965AC4CD2931A4AE0FF6FA9CD"><enum>(a)</enum><header>In general</header><text>Subtitle G of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6971">42 U.S.C. 6971</external-xref> et seq.) is amended by adding at the end the following:</text>
					<quoted-block id="H76FBAC7122634FC7875B90A7EC107C5A" style="OLC">
						<section id="H83F161C91CE147A88F24E9FF449EEB08"><enum>7011.</enum><header>Grants for composting and anaerobic digestion food waste-to-energy projects</header>
 <subsection id="HC973A95009134BD28894652376FDB8D0"><enum>(a)</enum><header>Grants</header><text>The Administrator shall establish a grant program to award grants to States eligible to receive the grants under subsection (b)(1) to construct large-scale composting or anaerobic digestion food waste-to-energy projects.</text>
							</subsection><subsection id="HD6BA0D7FBD564FDA88E9F74F287E55E6"><enum>(b)</enum><header>Eligible States</header>
 <paragraph id="HB68268733687472BA7D09E83760F9DBD"><enum>(1)</enum><header>Eligibility</header><text>In order to be eligible to receive a grant under this section, a State shall—</text> <subparagraph id="HB4592C433578462CB9DBB6BAC8AA7154"><enum>(A)</enum><text>have in effect a plan to limit the quantity of food waste that may be disposed of in landfills in the State; and</text>
 </subparagraph><subparagraph id="HBCFB9E34CD0241E1854CD94082161D07"><enum>(B)</enum><text>provide to the Administrator—</text> <clause id="HC64E0EC98578479ABC1EC2FB2A64AAFA"><enum>(i)</enum><text display-inline="yes-display-inline">a written commitment that the State has read and agrees to comply with the Food Recovery Hierarchy of the Environmental Protection Agency, particularly as applied to apparently wholesome food (as defined in section 22(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>) that may be provided to or received by the State; and</text>
 </clause><clause id="HC4E9DCD94C1E4B39B11A3F6FCF124680"><enum>(ii)</enum><text>a written end-product recycling plan that provides for the beneficial use of the material resulting from any anaerobic digestion food waste-to-energy operation with respect to which the loan or grant is made, in a manner that meets all applicable Federal, State, and local laws that protect human health and the environment.</text>
 </clause></subparagraph></paragraph><paragraph id="H7E3A43AC5A394738B4612D531962B1EE"><enum>(2)</enum><header>Limitation</header><text>A grant under subsection (a) may not be used for an anaerobic digester that uses solely manure as undigested biomass.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA01539DE40BA4E04AE391B431041482A"><enum>(3)</enum><header display-inline="yes-display-inline">Preference</header><text display-inline="yes-display-inline">The Administrator shall give preference to grants under subsection (a) for anaerobic digesters that use primarily nonedible food, crop waste, or nonedible food and crop waste as undigested biomass.</text>
 </paragraph></subsection><subsection id="HA0F76B7C87E9499DBC99BFBF23572EC9"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HC45D5071C2704809913E84A1B7931227"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref> et seq.) is amended by inserting after the item relating to section 7010 the following:</text>

				</subsection></section><section id="H10EBE39D2E1A43A8B3312B9DC3503BDF"><enum>505.</enum><header>Government Accountability Office audit</header>
 <subsection id="H661B5C8D6D3441BCA320150A150E3A6E"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States (referred to in this section as the <term>Comptroller General</term>) shall conduct an audit to assess estimates of postharvest food loss and waste in the United States, including estimates by the Department of Agriculture and other government, academic, and industry stakeholders.</text>
 </subsection><subsection id="HE7D2650050BA4B26B598A9DA054FBCD4"><enum>(b)</enum><header>Requirements</header><text>The Comptroller General, as part of the audit conducted under subsection (a)—</text> <paragraph id="H3E773E85B3DC4978A6D9649470F75C77"><enum>(1)</enum><text>shall—</text>
 <subparagraph id="H894C65F46F78463F8D44C90F5639E363"><enum>(A)</enum><text>assess the extent to which the estimates described in that subsection provide a valid benchmark for the amount and value of postharvest food loss and waste in the United States;</text>
 </subparagraph><subparagraph id="H060BDD919C46406DAD1F5177E695843C"><enum>(B)</enum><text>evaluate the reliability of the data, and the validity and accuracy of the assumptions and models, underlying the estimates; and</text>
 </subparagraph><subparagraph id="H27411C96EED546BB84427253AF32542F"><enum>(C)</enum><text>if appropriate, include recommendations to improve the estimates; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H165280127EA644B4AD214D50986621D9"><enum>(2)</enum><text>if the Comptroller General determines that the estimates described in that subsection are invalid under paragraph (1)(A), may conduct an estimate of postharvest food loss and waste in the United States.</text>
