 <section id="H2EB2488603DA41E78E3E9A6BD44217F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Local Business Act</short-title></quote>.</text> </section><section id="HFF496078515E44B1B6B697FE002B972A"><enum>2.</enum><header>Clarification of joint employment</header> <subsection commented="no" id="H18D92ACF794E47CBB917C3B861146797"><enum>(a)</enum><header>National Labor Relations Act</header><text display-inline="yes-display-inline">Section 2(2) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(2)</external-xref>) is amended—</text>
 <paragraph commented="no" id="H69F2640F626C47BF98AAFC9C4831E73B"><enum>(1)</enum><text>by striking <quote>The term <quote>employer</quote></quote> and inserting <quote>(A) The term <quote>employer</quote></quote>; and</text> </paragraph><paragraph commented="no" id="H29919E8835624FB3BA932401E2971B27"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H557AFDA314264C71AA6EB91ABDECFB6C" style="traditional">
 <subparagraph display-inline="no-display-inline" id="H4EEA4EDC73BE40E8B459571EE1A5ED6D" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">A person may be considered a joint employer in relation to an employee only if such person directly, actually, and immediately, and not in a limited and routine manner, exercises significant control over essential terms and conditions of employment, such as hiring employees, discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, or administering employee discipline.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H1AA8DAB4E9CA427B983B57BBAAD65125"><enum>(b)</enum><header>Fair Labor Standards Act of <enum-in-header>1938</enum-in-header></header><text display-inline="yes-display-inline">Section 3(d) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(d)</external-xref>) is amended—</text> <paragraph id="HB11C783349574BD787FCF5032E9A5FF6"><enum>(1)</enum><text>by striking <quote><quote>Employer</quote> includes</quote> and inserting <quote>(1) <quote>Employer</quote> includes</quote>; and</text>
 </paragraph><paragraph id="HA22AB2DCF0574C94A3913919709F375A"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE2F904CF64B049DF8B52FD5ECD0F8CAF" style="traditional"> <paragraph id="H7C3956F886F7405498E40438A2426D41" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A person may be considered a joint employer in relation to an employee for purposes of this Act only if such person meets the criteria set forth in section 2(2)(B) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(2)(B)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
