 </subsection></section><section id="HC089054E493C4A77AF9C3B20F63B5A68"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H95FDEEBDCBD44B6B8DA066EE1FB3183F"><enum>(1)</enum><header>Federal land management agency</header><text>The term <term>Federal land management agency</term> has the meaning given the term in section 802 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6801">16 U.S.C. 6801</external-xref>).</text>
 </paragraph><paragraph id="HF13F76B164E74396BAEB0E5E6A8F4711"><enum>(2)</enum><header>Federal recreational land and water</header><text>The term <term>Federal recreational land and water</term> has the meaning given the term <term>Federal recreational lands and waters</term> in section 802 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6801">16 U.S.C. 6801</external-xref>).</text> </paragraph><paragraph id="H8C4001DDC7484BFE9C40B51134A9841C"><enum>(3)</enum><header>Secretaries</header><text>Except as otherwise provided in this Act, the term <term>Secretaries</term> means—</text>
 <subparagraph id="HE279F23407294BE68A00748874553030"><enum>(A)</enum><text>the Secretary of the Interior; and</text> </subparagraph><subparagraph id="H7350B84853034F6493BB1AB0A3E6FD2E"><enum>(B)</enum><text>the Secretary of Agriculture.</text>
 </subparagraph></paragraph></section><section id="HFC3B49E0323548E18B9114D0162DA565"><enum>3.</enum><header>Sense of Congress regarding outdoor recreation</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="H9F1C9BC3BAE7424DA982AD8A08A74D42"><enum>(1)</enum><text>outdoor recreation and the $887,000,000,000 outdoor industry that outdoor recreation supports are vital to the United States;</text>
 </paragraph><paragraph id="HB7F6E585915746A9A8D882DBBE65333D"><enum>(2)</enum><text>access to outdoor recreation on land and waters of the United States is important to the health and wellness of all people of the United States, especially young people;</text>
 </paragraph><paragraph id="HC360F4F8834D47E889B39AA128492490"><enum>(3)</enum><text>$524,800,000,000 of the amount described in paragraph (1) contributes to the travel and tourism industry of the United States, which generates over $2,000,000,000,000 in annual spending;</text>
 </paragraph><paragraph id="H54F6FBD1CDD4482895A2AEAED6701BE3"><enum>(4)</enum><text>outdoor recreation (including hunting, fishing, and boating) are appropriate uses of public land;</text> </paragraph><paragraph id="H3D748B006FA84F1C9350D85EA66EFBCB"><enum>(5)</enum><text>access to healthy public land and water is critical to supporting the uses described in paragraph (4);</text>
 </paragraph><paragraph id="HB0924ED6805C4FBBB53FD59C52CEBC71"><enum>(6)</enum><text>Congress supports the creation of outdoor recreation sector leadership positions within the economic development offices of States or in the office of the Governor, as well as coordination with recreation and tourism organizations within the State to guide the growth of this sector, as evidenced by recent examples in the States of Colorado, Utah, and Washington;</text>
 </paragraph><paragraph id="H6FBE006C1D9B472F8D5F818E1D752421"><enum>(7)</enum><text>State and local recreation and tourism offices play a pivotal role in—</text> <subparagraph id="H13E3614FB422478F8437E2B19D6A8F1E"><enum>(A)</enum><text>coordinating State outdoor recreation policies, management, and promotion among Federal, State, and local agencies and entities;</text>
 </subparagraph><subparagraph id="HB716595E13DB406FB2683DD47D96CEC8"><enum>(B)</enum><text>disseminating information, increasing awareness, and growing demand for outdoor recreation experiences among visitors across the United States and throughout the world;</text>
 </subparagraph><subparagraph id="H66A3EBDE20894B749A891A15CF656DB7"><enum>(C)</enum><text>improving funding for, access to, and participation in outdoor recreation; and</text> </subparagraph><subparagraph id="HA396316319AB42068B3D7B3EB1CCB0F3"><enum>(D)</enum><text>promoting economic development in the State by coordinating with stakeholders, improving recreational opportunities, and recruiting outdoor recreation businesses;</text>
 </subparagraph></paragraph><paragraph id="HA61876351704446D914AC932C0D81BC4"><enum>(8)</enum><text>Congress supports the coordination and collaboration of the Federal and State land and water management agencies in the delivery of visitor services and management of outdoor recreation for the United States; and</text>
 </paragraph><paragraph id="H1368CD437FF8400F9C16BCE3F696465D"><enum>(9)</enum><text>Congress recognizes—</text> <subparagraph id="H9CAD80A844A044B1BCB6819A0FF0D53B"><enum>(A)</enum><text>the growing role that recreation has on public land and water;</text>
 </subparagraph><subparagraph id="H79EF67DCC5C947BEA1FFF2C894FFFF38"><enum>(B)</enum><text>the need to provide adequate staffing within Federal land management agencies to facilitate sustainable and accessible outdoor recreation opportunities; and</text>
 </subparagraph><subparagraph id="H7AAEA6B5C9CE41F0868967A538C51C51"><enum>(C)</enum><text>the important role that volunteers and volunteer partnerships play in maintaining public land.</text> </subparagraph></paragraph></section><title id="H16D0D8803E684E7AB779690496BD27CF"><enum>I</enum><header>Modernizing recreation permitting</header> <section id="H0D7C5A0096AD4BF69DA56B3F1C4DC35B"><enum>101.</enum><header>Special recreation permitting</header><text display-inline="no-display-inline">Section 803(h) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(h)</external-xref>) is amended—</text>
 <paragraph id="HBB5205B3F9074D59B4E0EEA6F5BD3047"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H20EE62A7323F4DDA907D5D99234263A6" style="OLC"> <paragraph id="H66216D9631864BD89BFFAFF32BD03637"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H2FB15E1834E04D629DAB43259510579C"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9A31AB78877A48D1BFCE8983EAA74AA7" style="OLC"> <paragraph id="H9451BC08A4A94C1CA6D9869C0B01400E"><enum>(2)</enum><header>Outfitters and guides</header> <subparagraph id="H19CCF083BF674399B061A73C09850170"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text>
 <clause id="H87A1394A39C54510A6DDEE019C4EAE5E"><enum>(i)</enum><header>Associated agency</header><text>The term <term>associated agency</term> means any agency that manages the land or water on which a minority portion of the trip or activity that is the subject of a special recreation permit will take place.</text>
 </clause><clause id="H9D3CA46DBF4149A6946EF7642B54565F"><enum>(ii)</enum><header>Lead agency</header><text>The term <term>lead agency</term> means the agency that manages the land or water on which the majority of the trip or activity that is the subject of the special recreation permit will take place.</text>
 </clause></subparagraph><subparagraph id="HAB0B1A2FA0854A0585E14CC82BAF38A3"><enum>(B)</enum><header>Outfitter and guide permits</header><text>In issuing special recreation permits or charging special recreation permit fees in connection with the issuance of permits under paragraph (1) with respect to outfitters and guides, within a reasonable time after the date of enactment of the <short-title>Recreation Not Red-Tape Act</short-title>, the Director of the Bureau of Land Management and the Chief of the Forest Service shall, in consultation with the public, including stakeholder groups that represent the interests of organizations that facilitate outdoor access—</text>
 <clause id="H46458F5E5E7A41AF949AEF87DAC4B7A9"><enum>(i)</enum><text>review permit application forms and revise if needed to improve efficiency and ensure the paperwork is concise and understandable to the general public;</text>
 </clause><clause id="HD1A8E9B08D00413B85970128D428A758"><enum>(ii)</enum><text>review the process for the issuance and renewal of outfitter and guide special recreation permits and use existing authorities to streamline permit processes if applicable;</text>
 </clause><clause id="H612200F70AA84DF791484BFD389386F5"><enum>(iii)</enum><text>coordinate between agencies to develop consistent submission deadlines for activities that cross jurisdictional boundaries;</text>
 </clause><clause id="HCC96B4E4402A46658D3560B245E9C724"><enum>(iv)</enum><text>shorten application processing times and minimize application and administration costs; and</text> </clause><clause id="H60F6178A0B764A558703AF98C1859BCB"><enum>(v)</enum><text>create outreach materials and make the materials available online and in print to help outfitters and guides navigate the permitting process.</text>
								</clause></subparagraph><subparagraph commented="no" id="HF10093A46B4648589B9A2A0EBAF6614C"><enum>(C)</enum><header>Permits for cross-jurisdictional trips</header>
 <clause commented="no" id="H3E9E94455AF24853831DD980C345A09E"><enum>(i)</enum><header>In general</header><text>In the case of an activity or trip requiring a permit issued under the subsection for use of land managed by the Forest Service and the Bureau of Land Management that will cross jurisdictional boundaries, the Secretaries shall issue a joint permit based on a single application to both agencies if the issuance of a joint permit based on a single application will lower the processing and other administrative costs for the permittee, unless the permit applicant opts to apply for separate permits rather than a joint permit.</text>
 </clause><clause commented="no" id="HF8AEB44554E44D34B9F32B01E19C2C30"><enum>(ii)</enum><header>Permit application</header><text>The permit application required under clause (i) shall be—</text> <subclause commented="no" id="H5643FCF973C34957A59210D367624DA7"><enum>(I)</enum><text>the application required by the lead agency; and</text>
 </subclause><subclause commented="no" id="HACA553D2441D428682E039DDB0D90454"><enum>(II)</enum><text>submitted to the lead agency.</text> </subclause></clause><clause commented="no" id="HB1770D1B3D224FBF85923943D876FBB0"><enum>(iii)</enum><header>Requirements of lead agency</header><text>The lead agency for a permit issued under clause (i) shall—</text>
 <subclause commented="no" id="HDED17B62EAF9419AB25C134D5D19B392"><enum>(I)</enum><text>coordinate, consistent with the authority of the Secretaries under section 330 of the Department of the Interior and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/43/1703">43 U.S.C. 1703</external-xref>), to develop, in consultation with the public (including stakeholder groups that represent the interests of organizations that facilitate outdoor access), a process for issuing 1 joint permit that covers the entirety of the trip;</text>
 </subclause><subclause commented="no" id="HE1A730F8D4544ED2B20FA8DF8CDF0A9D"><enum>(II)</enum><text>in processing the joint permit application, consider the findings, requirements, interests, and needs of the lead agency and any associated agencies; and</text>
 </subclause><subclause commented="no" id="H5CFB4B98A5544443841647B0C8B0BE60"><enum>(III)</enum><text>coordinate with the associated agencies to develop a method for cost sharing.</text> </subclause></clause></subparagraph><subparagraph commented="no" id="HBD8C12397F83402EAE0FD1F48A4CE270"><enum>(D)</enum><header>Reasonable timeframe</header><text>The Secretaries shall complete the permitting process under this paragraph within a reasonable timeframe.</text>
 </subparagraph><subparagraph commented="no" id="HA1FD576772BD44A28A165D1DC4D16BE9"><enum>(E)</enum><header>Online availability</header><text>To the maximum extent practicable, where feasible and efficient, the Secretaries shall make available—</text>
 <clause commented="no" id="H677B81BBBCED46F196078E82145095D8"><enum>(i)</enum><text>all special recreation permit applications, to be filled out and submitted online; and</text> </clause><clause commented="no" id="H65A4441C7C664BCFA8251086D94C7D62"><enum>(ii)</enum><text>online information regarding—</text>
 <subclause commented="no" id="H546A4D45A346444AAD59A3A956C35437"><enum>(I)</enum><text>the application process; and</text> </subclause><subclause commented="no" id="HAE284720F5864E44AB759236855392FA"><enum>(II)</enum><text>the means by which an applicant can contact the Secretaries for guidance on the permit process before submitting a permit application.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HF44C151CDD834FB5B860D3AB13CF48FD"><enum>102.</enum><header>Availability of Federal and State recreation passes</header>
 <subsection id="H22954142AC9F4901B466E8ACD5340A37"><enum>(a)</enum><header>In general</header><text>The Federal Lands Recreation Enhancement Act is amended by inserting after section 805 (<external-xref legal-doc="usc" parsable-cite="usc/16/6804">16 U.S.C. 6804</external-xref>) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H318036187B0249E0A49B5999DAFD48F9" style="OLC">
						<section id="H1F60A7B1ADE8439E9F3E50031A4A1C37"><enum>805A.</enum><header>Availability of Federal and State recreation passes</header>
							<subsection id="HAE4CB0A6955842C6BD01DBBC34088078"><enum>(a)</enum><header>Establishment of program</header>
 <paragraph id="H0FA80A1461744743B8021CF3E14CAA54"><enum>(1)</enum><header>In general</header><text>To improve the procurement of Federal and State outdoor recreation passes, the Secretaries are encouraged to consult with States to coordinate the availability of Federal and State recreation passes in a way that allows a purchaser to buy a Federal recreation pass and a State recreation pass at Federal and State facilities in the same transaction.</text>
 </paragraph><paragraph id="H535368CF26DB47C29753A97D12EA9971"><enum>(2)</enum><header>Included passes</header><text>Passes covered by the program established under paragraph (1) include—</text> <subparagraph id="H56E49319EF654A2BBE1A13268064AE6A"><enum>(A)</enum><text>a National Parks and Federal Recreational Lands Pass under section 805; and</text>
 </subparagraph><subparagraph id="H0E4F6B04DFF142E1BD953FAE28693878"><enum>(B)</enum><text>a pass that shall cover any fees charged by participating States and localities for entrance and recreational use of parks and public land in the participating States.</text>
									</subparagraph></paragraph></subsection><subsection id="HF41B2AFBCF3E41BEAED668C07DFEF256"><enum>(b)</enum><header>Agreements with States</header>
 <paragraph id="HAF6C9A616F8A4C619F19950220F1147E"><enum>(1)</enum><header>In general</header><text>The Secretaries, after consultation with the States, may enter into agreements with States to coordinate the availability of passes as described in subsection (a)(1).</text>
 </paragraph><paragraph id="H9D138BD5B96746B886F22824CDCA0F23"><enum>(2)</enum><header>Revenue from pass sales</header><text>The agreements between the Secretaries and the States shall ensure that—</text> <subparagraph id="H369B1568CDF84C6EAFF07A041FAE145E"><enum>(A)</enum><text>funds from the sale of State passes are transferred to the appropriate State agency;</text>
 </subparagraph><subparagraph id="H5125A557C99141079B4FFE416A4F97F7"><enum>(B)</enum><text>funds from the sale of Federal passes are transferred to the appropriate Federal agency; and</text> </subparagraph><subparagraph id="H7DC1F086BB52482682C6B30088028304"><enum>(C)</enum><text>fund transfers are completed by the end of a fiscal year for all pass sales occurring during the fiscal year.</text>
 </subparagraph></paragraph><paragraph id="HA825300EEFF54D5DB5B9CDD461B386EE"><enum>(3)</enum><header>Notice</header><text>In entering into an agreement under paragraph (1), the Secretaries shall publish in the Federal Register a notice describing the agreement.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H4CA6BABDF3534AFD9B15ABC61065E142"><enum>(b)</enum><header>Conforming amendment</header><text>Section 805(a)(9) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6804">16 U.S.C. 6804(a)(9)</external-xref>) is amended by inserting <quote>and section 805A</quote> before the period at the end.</text>
				</subsection></section><section id="HE03C2D7A1E374910A022ED52978482D9"><enum>103.</enum><header>Online purchases of National Parks and Federal Recreational Lands Pass</header>
 <subsection id="H2079170BA07041BAB12CB6DEFEA20C0F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 805(a)(6) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6804">16 U.S.C. 6804(a)(6)</external-xref>) is amended by striking subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H66303DED0E384DF69A11F81E0404A177" style="OLC">
 <subparagraph id="H5E73F63741F2478CA1519CDD0AF06E2B"><enum>(A)</enum><header>In general</header><text>The Secretaries shall sell the National Parks and Federal Recreational Lands Pass—</text> <clause id="H53B89D5597F848C49921795232B06A40"><enum>(i)</enum><text>at all Federal recreational lands and waters at which an entrance fee or a standard amenity recreation fee is charged;</text>
 </clause><clause id="H3F1017058E674BD5872BF32DA94EB384"><enum>(ii)</enum><text>at such other locations as the Secretaries consider appropriate and feasible; and</text> </clause><clause id="HE4A41DE313A44EAEA6A3047229C9A2FF"><enum>(iii)</enum><text>through the website of each of the Federal land management agencies and the websites of the relevant units and subunits of those agencies, with—</text>
 <subclause id="HBBDE1283B52041038589182E26C48915"><enum>(I)</enum><text>a prominent link on each website; and</text> </subclause><subclause id="HB91F3EF691354E35A57F8D5795E40CD1"><enum>(II)</enum><text>information about where and when passes are needed.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HAA3228CD272B4D3FACBAF29B02CD25A7"><enum>(b)</enum><header>Entrance pass and amenity fees</header><text>The Secretaries shall make available for purchase or payment online, if appropriate and feasible, for each unit where passes and fees are required—</text>
 <paragraph id="HBD9854F85B9E479CBAC14EFDA605C3A1"><enum>(1)</enum><text>all entrance fees under section 803(e) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(e)</external-xref>);</text>
 </paragraph><paragraph id="HFEAC438EC84C4E98A67EEB65628D41F1"><enum>(2)</enum><text>all standard amenity recreation fees under section 803(f) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(f)</external-xref>); and</text> </paragraph><paragraph id="H17932AF5BD38480CA71385D8224EF358"><enum>(3)</enum><text>all expanded amenity recreation fees under section 803(g) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(g)</external-xref>).</text>
					</paragraph></subsection></section></title><title id="HCC1F41D4347A441F9C8A66428D0A43DD" style="OLC"><enum>II</enum><header>Accessing the outdoors</header>
			<section id="HFB94FE5DBE4E47BF84813A2A8A74D98E"><enum>201.</enum><header>Access for servicemembers and veterans</header>
 <subsection id="HE6C51C1D346A4B63A7B4B59D03997D70"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretaries are encouraged to work with the Secretary of Defense and the Secretary of Veterans Affairs on ways to ensure servicemembers and veterans have access to outdoor recreation and to outdoor-related volunteer and wellness programs as a part of the basic services provided to servicemembers and veterans.</text>
 </subsection><subsection id="H4989998690724C5D8F27EF8E1E6D5B20"><enum>(b)</enum><header>Inclusion of information</header><text>Each branch of the Armed Forces is encouraged to include information regarding outdoor recreation and outdoors-based careers in the materials and counseling services focused on resilience and career readiness provided in transition programs, including—</text>
 <paragraph id="HFE83AB5DAF584A518F4C6A97FE9E5B07"><enum>(1)</enum><text>the benefits of outdoor recreation for physical and mental health;</text> </paragraph><paragraph id="H7251E6C3C9214E5D904673536C157ED3"><enum>(2)</enum><text>resources to access guided outdoor trips and other outdoor programs connected to the local office of the Department of Veterans Affairs; and</text>
 </paragraph><paragraph id="H81C22965F8BA46A8AF5C993695E36E7C"><enum>(3)</enum><text>information regarding programs and jobs focused on continuing national service such as the Public Land Corps of the National Park Service, AmeriCorps, or a conservation corps program.</text>
 </paragraph></subsection><subsection id="H38E6E9C804B34917A8DA7873848679A9"><enum>(c)</enum><header>Outdoor recreation program attendance</header><text>Each branch of the Armed Forces is encouraged to permit members of the Armed Forces on active duty status, at the discretion of the commander of the member, to use not more than 7 days of a permissive temporary duty assignment or terminal leave allotted to the member to participate in a program related to environmental stewardship or guided outdoor recreation following deployment.</text>
 </subsection><subsection id="H0FBC9C6627B44466AC0D779404907A47"><enum>(d)</enum><header>Veteran hiring</header><text>The Secretaries are strongly encouraged to hire veterans in all positions related to the management of Federal land.</text>
				</subsection></section></title><title id="HAE8C0593DB984FE6A69A5D14B86B4850"><enum>III</enum><header>Making recreation a priority</header>
			<section id="HB0552089C1F94041978358D2EE0B0C6A"><enum>301.</enum><header>Extension of seasonal recreation opportunities</header>
 <subsection id="H856AA94BF4A5460CA212F45B053EDBFD"><enum>(a)</enum><header>In general</header><text>The relevant unit managers of land managed by the Forest Service, the Bureau of Land Management, and the National Park Service, through the respective land management planning processes of those agencies, may—</text>
 <paragraph id="HDB0ABC5A21244ACDB809289156F0837A"><enum>(1)</enum><text>identify areas of Federal recreational land and water in which recreation use is highly seasonal;</text> </paragraph><paragraph id="H3225F37CFAE146F19A6F755F3BF373B6"><enum>(2)</enum><text>where appropriate, develop a management plan for extending the recreation season or increasing recreation use in a sustainable manner during the offseason; and</text>
 </paragraph><paragraph id="H9695B952C8BF468B9274D26EC7991958"><enum>(3)</enum><text>make information about extended season schedules and related recreational opportunities available to the public and local communities.</text>
 </paragraph></subsection><subsection id="H9062AC7282E7454FB497BB54A7A45C20"><enum>(b)</enum><header>Inclusions</header><text>The management plan developed under subsection (a)(2) may include—</text> <paragraph id="H5BF8F35D9838477D83BCDC862F947830"><enum>(1)</enum><text>the addition of facilities that would increase recreation use during the offseason; and</text>
 </paragraph><paragraph id="HB85E70FB7EC94DF0820D1C4A0FB99244"><enum>(2)</enum><text>improvement of access to the area to extend the season.</text> </paragraph></subsection><subsection id="H70753B488B214A88818FE4267AB0E4F6"><enum>(c)</enum><header>Requirement</header><text>The management plan developed under subsection (a)(2) shall be compatible with all applicable Federal laws, regulations, and policies, including land use plans.</text>
				</subsection></section><section id="H03F8BFD197654EF3920EEB33AA30EA34"><enum>302.</enum><header>Recreation performance metrics</header>
 <subsection id="H9990CA292BF5470D952D20C0F3254462"><enum>(a)</enum><header>In general</header><text>The Chief of the Forest Service and the Director of the Bureau of Land Management shall evaluate land managers under their jurisdiction based on the achievement of applicable agency recreational and tourism goals as described in applicable land management plans.</text>
				</subsection><subsection id="H0035AC4CED9A498791C7CCE9F5AA14C2"><enum>(b)</enum><header>Metrics</header>
 <paragraph id="HEE63C8D3EC0E4E148529597AAE8B7906"><enum>(1)</enum><header>In general</header><text>The metrics used to evaluate recreation and tourism outcomes shall ensure—</text> <subparagraph id="H39E7BCF462914CC4BFA50EF45FA47AD8"><enum>(A)</enum><text>the advancement of recreation and tourism goals; and</text>
 </subparagraph><subparagraph id="H2CC50E970DA144AB87C181D92DD4CFA5"><enum>(B)</enum><text>the ability of the land manager to enhance the outdoor experience of the visitor.</text> </subparagraph></paragraph><paragraph id="H28C13DABE7A845FD9BC35EC0C9985F2D"><enum>(2)</enum><header>Inclusions</header><text>The metrics referred to paragraph (1) may include, to the maximum extent practicable—</text>
 <subparagraph id="H3048F439F8D9498E9E7EE9E5F57533B8"><enum>(A)</enum><text>the quality of visitor experience;</text> </subparagraph><subparagraph id="H7F7C42C97F164C6DB08AE6E30407EC4F"><enum>(B)</enum><text>the number of first-time visitors;</text>
 </subparagraph><subparagraph id="HC29E084AE65F4724AA67B949A2AFB48C"><enum>(C)</enum><text>the number of repeat visitors;</text> </subparagraph><subparagraph id="H812F379C478B4CC89AB667769B2269B9"><enum>(D)</enum><text>the number of school and youth groups that visited;</text>
 </subparagraph><subparagraph id="HC068598D4CF44B6CA2597313310B0D38"><enum>(E)</enum><text>the number of available recreational opportunities;</text> </subparagraph><subparagraph id="H5B80240DAEE5472D855A305AD1A71731"><enum>(F)</enum><text>the number of recreational and environmental educational programs offered and the success of those programs;</text>
 </subparagraph><subparagraph id="H4FF357623E6143A6982E398E4F6030D3"><enum>(G)</enum><text>visitor satisfaction; and</text> </subparagraph><subparagraph id="H5D0F4AE47C5E432BB672D2E9D8A8684B"><enum>(H)</enum><text>the maintenance and expansion of existing recreation infrastructure.</text>
						</subparagraph></paragraph></subsection></section><section id="H47B8BFAFDC664F98A298F124B5A66DD8"><enum>303.</enum><header>Recreation mission</header>
 <subsection id="HEC44781AA1374231ADA5FC1610B2DAE7"><enum>(a)</enum><header>Definition of Federal agency</header><text>In this section, the term <term>Federal agency</term> means each of—</text> <paragraph id="HC597D594F24B490C8B9B99EEBBB31B20"><enum>(1)</enum><text>the Corps of Engineers;</text>
 </paragraph><paragraph id="HAF3D4647376546F88FEDF139E4670252"><enum>(2)</enum><text>the Bureau of Reclamation;</text> </paragraph><paragraph id="HA64719EA93F64018A760D167DB90DD92"><enum>(3)</enum><text>the Federal Energy Regulatory Commission; and</text>
 </paragraph><paragraph id="HA7F9DE9D0AF548F8B0CF7827F110D48F"><enum>(4)</enum><text>the Department of Transportation.</text> </paragraph></subsection><subsection id="H0646B371C08C4F8EAD0D11781A670259"><enum>(b)</enum><header>Mission</header><text>With respect to the mission of the Federal agency, each Federal agency shall consider how land and water management decisions can enhance recreation opportunities and the recreation economy.</text>
				</subsection></section><section id="HA90662641FBC4E13AC0B990463FDAFEF"><enum>304.</enum><header>Ski area fee retention</header>
 <subsection id="HB4D96EF527684D75BBF6C157D0F651A0"><enum>(a)</enum><header>In general</header><text>Section 701 of division I of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/16/497c">16 U.S.C. 497c</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0866BFE5A7374E08B5C74CCADD68A450" style="OLC">
						<subsection id="H48FF0781749644648DD7719D6A1B8BF6"><enum>(k)</enum><header>Ski Area Fee Retention Account</header>
 <paragraph id="H542B7C79841045CCAF4EC0AF0ED97DBB"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HDD55292B7D1249EBB0A5E63A617C270C"><enum>(A)</enum><header>Account</header><text>The term <quote>Account</quote> means the Ski Area Fee Retention Account established under paragraph (2).</text>
 </subparagraph><subparagraph id="HCD816717A4584182A162DF0179757DCE"><enum>(B)</enum><header>Covered unit</header><text>The term <quote>covered unit</quote> means an administrative unit of the National Forest System subject to a rental charge under this section.</text>
 </subparagraph><subparagraph id="H4D8B3943A050431585543926D0362281"><enum>(C)</enum><header>Rental charge</header><text>The term <quote>rental charge</quote> means a permit rental charge that is charged under subsection (a).</text> </subparagraph><subparagraph id="H1199C6A63C3B4590973F5261FA5FC2CC"><enum>(D)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
 </subparagraph></paragraph><paragraph id="HDB0905ABC122471C8BD8771FA1D54B36"><enum>(2)</enum><header>Establishment</header><text>The Secretary of the Treasury shall establish in the Treasury a special account, to be known as the <quote>Ski Area Fee Retention Account</quote>, into which there shall be deposited—</text> <subparagraph id="H850BD4CD780A44B3A6442FFE8E056188"><enum>(A)</enum><text>in the case of a covered unit at which not less than $15,000,000 is collected by the covered unit from rental charges in a fiscal year, an amount equal to 50 percent of the rental charges collected at the covered unit in the fiscal year; or</text>
 </subparagraph><subparagraph id="H2429B39D76F1401E936B0015A523557D"><enum>(B)</enum><text>in the case of any other covered unit, an amount equal to 65 percent of the rental charges collected at the covered unit in a fiscal year.</text>
 </subparagraph></paragraph><paragraph id="HAF57551DDBFD4538B69B398169E04739"><enum>(3)</enum><header>Availability</header><text>Subject to paragraphs (4), (5), and (6), any amounts deposited in the Account under paragraph (2) shall remain available for expenditure, without further appropriation, until expended.</text>
							</paragraph><paragraph id="H5F07B591D61F4663AF8464A3108C6E24"><enum>(4)</enum><header>Local distribution of amounts in the Account</header>
 <subparagraph id="HCABD1047F1B340ACAD12EF297172E83B"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), 100 percent of the amounts deposited in the Account from a specific covered unit shall remain available for expenditure at the covered unit at which the rental charges were collected.</text>
								</subparagraph><subparagraph id="HEC6A606C376843348617C47567A6E457"><enum>(B)</enum><header>Reduction</header>
 <clause id="H7C80E66C1E0C42FE8D9AEF03DC0F8CD9"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Secretary may reduce the percentage of amounts available to a covered unit under subparagraph (A) if the Secretary determines that the rental charges collected at the covered unit exceed the reasonable needs of the covered unit for that fiscal year for authorized expenditures described in paragraph (5)(A).</text>
 </clause><clause id="H4EC95A1AD3C442179A1A96F8327DC738"><enum>(ii)</enum><header>Limitation</header><text>The Secretary may not reduce the percentage of amounts available under clause (i)—</text> <subclause id="H3DEB2C4F4BEA42F8B0119A1523F58590"><enum>(I)</enum><text>in the case of a covered unit described in paragraph (2)(A), to less than 35 percent of the amount of rental charges deposited in the Account from the covered unit in a fiscal year; or</text>
 </subclause><subclause id="HF4323BFB2D2A47DBB7F8736DD60CDF54"><enum>(II)</enum><text>in the case of any other covered unit, to less than 50 percent of the amount of rental charges deposited in the Account from the covered unit in a fiscal year.</text>
										</subclause></clause></subparagraph><subparagraph id="H479E5D00593F466FAADA5A076C443FDD"><enum>(C)</enum><header>Transfer to other covered units</header>
 <clause id="H7847F22C1EC745199361AECCB23276DC"><enum>(i)</enum><header>Distribution</header><text>If the Secretary determines that the percentage of amounts otherwise available to a covered unit under subparagraph (A) should be reduced under subparagraph (B), the Secretary may transfer to other covered units, for allocation in accordance with clause (ii), the percentage of the amounts withheld from the covered unit under subparagraph (B), to be expended by the other covered units in accordance with paragraph (5).</text>
 </clause><clause id="HC90CE7B2A217481A9EECFC80ADBED927"><enum>(ii)</enum><header>Criteria</header><text>In determining the allocation of amounts to be transferred under clause (i) among other covered units, the Secretary shall consider—</text>
 <subclause id="H09A3B24E33644B079808A15A0414CA5F"><enum>(I)</enum><text>the number of proposals for ski area improvements in the other covered units;</text> </subclause><subclause id="H526FC7B11B44427294FFD40540D8162D"><enum>(II)</enum><text>any backlog in ski area permit administration or the processing of ski area proposals in the other covered units; and</text>
 </subclause><subclause id="HE09D170A81E14D5B90154B1159259C12"><enum>(III)</enum><text>any need for services, training, or staffing in the other covered units that would improve the administration of the Forest Service Ski Area Program.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HF44B1F4D216C4663B22EAA8C7C64ED43"><enum>(5)</enum><header>Authorized expenditures</header>
 <subparagraph id="H2F4406DAF4514B9FA946E3C6A8C998F6"><enum>(A)</enum><header>In general</header><text>Amounts distributed from the Account to a covered unit under this subsection may be used for—</text> <clause id="HD2D35EEE1D914F8CB8C19311A791C35E"><enum>(i)</enum><text>ski area special use permit administration and processing of proposals for ski area improvement projects in the covered unit, including—</text>
 <subclause id="H38BF580D3C0B4B1F9CE462DC64483A53"><enum>(I)</enum><text>upgrades to, or the replacement or installation of, passenger ropeways, including tramways, funiculars, chair lifts, conveyors, and tows;</text>
 </subclause><subclause id="HD2125ADEE74E41DEBE215511CD4C3857"><enum>(II)</enum><text>snowmaking improvements and new or upgraded water facilities;</text> </subclause><subclause id="H8864C836D1524986B7364BD3DB62FF80"><enum>(III)</enum><text>projects relating to buildings, structures, or other facilities owned by the ski area on National Forest System land;</text>
 </subclause><subclause id="HEAD511A8185A4A75AED40BB21D9096EE"><enum>(IV)</enum><text>trail, service road, or terrain change projects;</text> </subclause><subclause id="H08A0D6DE00DC4EB694ECD8ACEBD8B439"><enum>(V)</enum><text>additional seasonal or year-round recreational activities and associated facilities and trails in the covered unit, including activities carried out under section 3(c) of the National Forest Ski Area Permit Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/497b">16 U.S.C. 497b(c)</external-xref>);</text>
 </subclause><subclause id="HEA9447580A6F4CE681948767CBB06F35"><enum>(VI)</enum><text>ski area employee housing constructed on the permit area or on nearby National Forest System land;</text> </subclause><subclause id="H1B1B7AA681D04CAC9D0F0828CF6C0AF5"><enum>(VII)</enum><text>land exchanges relating to the ski area, in accordance with Federal laws (including regulations); and</text>
 </subclause><subclause id="HDEF262DA38AB469BB35CDDAABE3B7664"><enum>(VIII)</enum><text>any other improvements or facilities to enhance or increase ski area recreational opportunities;</text> </subclause></clause><clause id="HF97B54CB5E4842AD8E644A7B8793A7BD"><enum>(ii)</enum><text>training programs on processing ski area applications and administering ski area permits; and</text>
 </clause><clause id="H3C092E061EC842238AB7EDA5D339F744"><enum>(iii)</enum><text>interpretation activities, visitor information, visitor services, and signage in the covered unit to enhance—</text>
 <subclause id="H2A54E3CD4821424BADED57C9D3780BE6"><enum>(I)</enum><text>the ski area visitor experience on National Forest System land; and</text> </subclause><subclause id="H633C0378A0E7401CA7A0571BC61D384E"><enum>(II)</enum><text>avalanche information and education activities carried out by the Forest Service.</text>
 </subclause></clause></subparagraph><subparagraph id="H38A226B665474E01BF551E658BC942CD"><enum>(B)</enum><header>Limitation</header><text>Amounts in the Account may not be used for—</text> <clause id="H0CFE7676638E449092520637E22D8BD4"><enum>(i)</enum><text>the conduct of wildfire suppression or preparedness activities;</text>
 </clause><clause id="HBB844FADBD044C6AA6024A4BAABF9E19"><enum>(ii)</enum><text>the conduct of biological monitoring on National Forest System land under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) for listed species or candidate species, except as required by law for environmental review of ski area projects;</text>
 </clause><clause id="HFC13EA36528141C0917800D37C5D9A94"><enum>(iii)</enum><text>the acquisition of land for inclusion in the National Forest System; or</text> </clause><clause id="H1A0A15EF7F24491DB75621C98ED94755"><enum>(iv)</enum><text>Forest Service administrative sites.</text>
									</clause></subparagraph></paragraph><paragraph id="HF46D0496CDF64AA0904AEB0DADB678AC"><enum>(6)</enum><header>Savings provisions</header>
 <subparagraph id="H281AFDD8D29E48E2B69D4706D0181E09"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection affects the applicability of section 7 of the Act of April 24, 1950 (commonly known as the <quote>Granger-Thye Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref>), to ski areas on National Forest System land.</text>
 </subparagraph><subparagraph id="HC93CDDFF431E4DDF83743DF7398CB362"><enum>(B)</enum><header>Revenue allocation payments</header><text>Rental charges deposited in the Account under paragraph (2) shall be considered to be amounts received from the National Forest System for purposes of calculating amounts to be paid under—</text>
 <clause id="HF21E62DBF2B14D469291842BB9E2F2AB"><enum>(i)</enum><text>the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7101">16 U.S.C. 7101</external-xref> et seq.);</text> </clause><clause id="H866D7ADD3FD043F19FD3F09A845AAEB2"><enum>(ii)</enum><text>the sixth paragraph under the heading <quote>forest service</quote> in the Act of May 23, 1908 (35 Stat. 260; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>), and section 13 of the Act of March 1, 1911 (36 Stat. 963; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>); and</text>
 </clause><clause id="HE0AF237CA7C643B0BB25703C1448E2E1"><enum>(iii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code.</text> </clause></subparagraph><subparagraph id="H1864B62F94764B61A614F2FDDEE2F7D1"><enum>(C)</enum><header>Supplemental funding</header><text>Rental charges retained and expended under this subsection shall supplement (and not supplant) appropriated funding for the operation and maintenance of each covered unit.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HAACC4277B52D42B08D042E8E999E3C69"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section (including the amendments made by this section) shall take effect on the date that is 60 days after the date of enactment of this Act.</text>
 </subsection><subsection id="HCACBF85C4A83452D98F36FCA3FEA83EC"><enum>(c)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary shall not be required to issue regulations or policy guidance to implement this section (including the amendments made by this section).</text>
				</subsection></section><section id="HBB3503FC19C245E8958069FF6F018180"><enum>305.</enum><header>National Recreation Area System</header>
				<subsection id="H6561788236804208A602A40FE7C4E05A"><enum>(a)</enum><header>Declaration of policy; effect of section</header>
 <paragraph id="H123A2E0DEA574796B94FA57752465E26"><enum>(1)</enum><header>Declaration of policy</header><text>It is the policy of the United States that—</text> <subparagraph id="H221F0E5B2D2F4F2F9CBBB5DB42C7861A"><enum>(A)</enum><text>certain natural landscapes possess remarkable recreational values and should be managed for sustainable outdoor recreational and other benefits for the people of the United States;</text>
 </subparagraph><subparagraph id="H4DC0A186863B4ACD91733828FFAF4645"><enum>(B)</enum><text>the remarkable recreational values described in subparagraph (A) may include—</text> <clause id="H1E2161C297E646EBBACCCE74E5E28BBA"><enum>(i)</enum><text>areas offering existing or prospective recreation opportunities;</text>
 </clause><clause id="H6D234C6A36B247B28500190E6A406BCB"><enum>(ii)</enum><text>areas that play, or have the potential to play, a role in addressing high or unmet demand for recreational opportunities;</text>
 </clause><clause id="HB178470AE9DF40A096A813826FA2B8AC"><enum>(iii)</enum><text>areas that play an important role in supporting the outdoor recreation economy;</text> </clause><clause id="H649FCA1EB42F488C9E6FDA5888636BEA"><enum>(iv)</enum><text>areas with unique ecological, geological, hydrological, scenic, cultural, or historic features or attributes that accommodate a variety of outdoor recreation activities; and</text>
 </clause><clause id="HE97E572EAED94E168889E6A067A072A3"><enum>(v)</enum><text>areas with high fish and wildlife values;</text> </clause></subparagraph><subparagraph id="H4E35B32090E540B888D06FD47F1A47AB"><enum>(C)</enum><text>in addition to other uses of Federal land, certain landscapes should be protected and managed primarily for the recreational, social, and health benefits people receive from the landscapes through outdoor recreation, for the specific and meaningful experiences made possible by unique and varied landscapes, and for the contributions those landscapes make in support of the outdoor recreation economy; and</text>
 </subparagraph><subparagraph id="H9A94FFB1E0FE401D9C286C4CCEF3C7A6"><enum>(D)</enum><text>in addition to land identified as National Recreation Areas, the Secretaries should continue to promote recreation on other Federal land in accordance with applicable land management plans.</text>
 </subparagraph></paragraph><paragraph id="HEBBDB11A28AD4C95A07BD5FBBCD5E1C3"><enum>(2)</enum><header>Effect of section</header><text>Nothing in this section diminishes the importance of prioritizing recreation on Federal land located outside of a National Recreation Area.</text>
 </paragraph></subsection><subsection id="H25331501F40A4F0DB3D49D6115E48810"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H155DC55194914AAF98A6613D482080AB"><enum>(1)</enum><header>Natural feature</header><text>The term <term>natural feature</term> means a healthy ecological, geological, hydrological, scenic, cultural, or historic feature or attribute of a specific area.</text>
 </paragraph><paragraph id="H0E922A0FB491420EA3014F36D25757B8"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means—</text> <subparagraph id="H31BE2E263A814733897CA1A12A14DE53"><enum>(A)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management with respect to land administered by the Bureau of Land Management; and</text>
 </subparagraph><subparagraph id="HD8AD5EF0B13A428FAB6491BFBD1B83D4"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to National Forest System land.</text>
 </subparagraph></paragraph><paragraph id="HEEA4D575A4A7479FBC766F3F1C2B40B9"><enum>(3)</enum><header>System</header><text>The term <term>System</term> means the National Recreation Area System established by subsection (c).</text> </paragraph><paragraph id="H930F285B807147D39FAE966917F56E6D"><enum>(4)</enum><header>System unit</header><text>The term <term>System unit</term> means a System unit designated pursuant to subsection (c).</text>
 </paragraph></subsection><subsection id="H5C73FE152E104D0CA70A9B6F3957FBE4"><enum>(c)</enum><header>Composition</header><text>There is established a National Recreation Area System, to be comprised of—</text> <paragraph id="H590FC96AD754468C9D335AA6C6F1A520"><enum>(1)</enum><text>existing National Recreation Areas described in subsection (g); and</text>
 </paragraph><paragraph id="H9B5C88579B224500A8360CAD3A7D91D8"><enum>(2)</enum><text>new System units designated by Congress on or after the date of enactment of this Act.</text> </paragraph></subsection><subsection id="H4FAA2ECBAB3F45D880B2F8A040471349"><enum>(d)</enum><header>Administration</header> <paragraph id="H640DFDEA64B64ACA90B3A238D91C82FF"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage each System unit in a manner that maximizes the protection and enhancement of the remarkable recreational values of the System unit (including natural features that support the recreation experiences) consistent with subsection (a)(1)(C), and provides for enjoyment by current and future generations.</text>
 </paragraph><paragraph id="H6DD06C20ED1342D98D08DF7EB9E8E756"><enum>(2)</enum><header>State, tribal, and local involvement</header><text>The Secretary shall consult and work, to the maximum extent practicable, with States, political subdivisions of States, affected Indian tribes, adjacent landowners, and the public in the planning and administration of System units.</text>
					</paragraph><paragraph id="HB5B1F6F4EA464623BEA8A959484D7B58"><enum>(3)</enum><header>Fish and wildlife</header>
 <subparagraph id="H59B3CA25CB684EA7B25EAAFBAA98D5A3"><enum>(A)</enum><header>In general</header><text>Nothing in this section affects the jurisdiction or responsibilities of a State with respect to fish and wildlife in a System unit in the State.</text>
 </subparagraph><subparagraph id="H6F1070B5B82C4C63B7D69C2DCBA08F5C"><enum>(B)</enum><header>Administration</header><text>Hunting, fishing, and motorized recreation (including boating) may be allowed on System units if permitted under applicable Federal and State laws (including regulations) and conducted in accordance with the applicable land management plans.</text>
 </subparagraph></paragraph><paragraph id="HBBCC650FC57E46E49FDD06AA9B571340"><enum>(4)</enum><header>Water rights</header><text>Nothing in this section affects any valid or vested water right in existence on the date of enactment of this Act.</text>
					</paragraph></subsection><subsection id="HA450D97407D44A6DAF8DCFC5EC4FCD19"><enum>(e)</enum><header>Components of National Recreation Area System</header>
					<paragraph id="HBEA4F6AE9929447EAB8BB0388E57602A"><enum>(1)</enum><header>Map; legal description</header>
 <subparagraph id="HBF66D67620B34E4484DDFF630F076C76"><enum>(A)</enum><header>In general</header><text>For System units established on or after the date of enactment of this Act, as soon as practicable after the date of designation of a System unit, the Secretary shall prepare a map and legal description of the System unit.</text>
 </subparagraph><subparagraph id="HC72F8EEBF2B44283B89B8DE8C39BBB00"><enum>(B)</enum><header>Force of law</header><text>The map and legal description filed under subparagraph (A) shall have the same force and effect as if included in this section, except that the Secretary may correct typographical errors in the map and legal description.</text>
 </subparagraph><subparagraph id="H480C3702D7F24EB9BF2A9999E74FBF67"><enum>(C)</enum><header>Public availability</header><text>The map and legal description filed under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management and the Forest Service.</text>
						</subparagraph></paragraph><paragraph id="HF2BA9A2893E24625BB5C5DB5054ADD50"><enum>(2)</enum><header>Comprehensive management plan</header>
 <subparagraph id="HAA272D36FB7F4042ABA0C3F533C03A19"><enum>(A)</enum><header>In general</header><text>The Secretaries shall prepare a comprehensive management plan for each System unit within the jurisdiction of the Secretaries that is designated by Congress after the date of enactment of this Act—</text>
 <clause id="H85F1C645BD4244A8BC81DAE1C56B4E7E"><enum>(i)</enum><text>to maximize the protection and enjoyment of the remarkable recreational values of the System unit; and</text>
 </clause><clause id="H19C325C2C4144BBA812BE228076E0CA5"><enum>(ii)</enum><text>to protect the natural features of the System unit that support recreation.</text> </clause></subparagraph><subparagraph id="H0CE6F97B39CE45E78198102FDC9E3FF2"><enum>(B)</enum><header>Timing</header> <clause id="HE87CF19F5DCD4644A1E4E6FF2F627DA9"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), a comprehensive management plan described in subparagraph (A) shall be completed by not later than 3 years after the date of designation of the System unit, subject to the availability of funds and resources.</text>
 </clause><clause id="H912BCFA542454E7D88CD86641771ECAC"><enum>(ii)</enum><header>Inadequate funds and resources</header><text>If funds and resources are not available in accordance with clause (i), the applicable agency may complete the plan as part of the regular management plan revisions of the agency.</text>
 </clause></subparagraph><subparagraph id="H4C9D76F2734F4841AEAEEDE78BB1BCEB"><enum>(C)</enum><header>Review</header><text>A comprehensive management plan described in subparagraph (A) shall be regularly reviewed and updated as part of the regular land management planning process of the applicable agency.</text>
 </subparagraph><subparagraph id="HB59FA1FC20384FD2B0904CD9BB4F5482"><enum>(D)</enum><header>Management by Secretary</header><text>The Secretary shall manage each National Recreation Area in accordance with the management plan for the National Recreation Area in effect at the time of the designation, to the extent the plan is consistent with this Act and the Act designating the National Recreation Area, until the plan is revised or superseded by a new comprehensive management plan issued in accordance with this subsection.</text>
 </subparagraph><subparagraph id="H7100C2B4547A4AD5BCEAF616FB9481E6"><enum>(E)</enum><header>Requirements</header><text>A comprehensive management plan prepared under subparagraph (A) shall—</text> <clause id="H32667B0EBB174694A19E4B217428CC85"><enum>(i)</enum><text>identify the existing, and to the extent practicable, prospective remarkable recreational and other important values of the System unit;</text>
 </clause><clause id="H3C3BB565231A4CC5B68E8641A5B05854"><enum>(ii)</enum><text>ensure the System unit is managed to protect and enhance purposes for which the System unit was established;</text>
 </clause><clause id="H42D4E87D710F4F96B1AF96A403BF8CFB"><enum>(iii)</enum><text>ensure the System unit is managed to protect and enhance the resources that make the area suitable for designation under subsection (c)(2) in accordance with subsection (a);</text>
 </clause><clause id="H224359B8B4BB49F2A865DB27D2345C18"><enum>(iv)</enum><text>be coordinated with resource management planning for affected adjacent Federal land;</text> </clause><clause id="H60120A6D832B4CC88F0DF1D1417D1537"><enum>(v)</enum><text>be prepared—</text>
 <subclause id="H1CE3F27E627D4AD5A30A486B81164503"><enum>(I)</enum><text>in accordance with the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.) or section 14 of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>), as applicable; and</text>
 </subclause><subclause id="H2ADC1029B22E44D2A0FEF4D365B1BE33"><enum>(II)</enum><text>in consultation with States, political subdivisions of States, affected Indian tribes, adjacent landowners, and the public; and</text>
 </subclause></clause><clause id="HDB5646287B784D6886AA6EFC9ECC2DCF"><enum>(vi)</enum><text>designate a sustainable road and trail network, consistent with subsection (a) and the purposes for which the System was established.</text>
 </clause></subparagraph><subparagraph id="H4BAA9C6AEB2049B48C0B388225538438"><enum>(F)</enum><header>Notice</header><text>The Secretary shall publish in the Federal Register notice of the completion and availability of a plan prepared under this paragraph.</text>
						</subparagraph></paragraph></subsection><subsection id="H0E449C996C5D4724BB177AC9E7837C38"><enum>(f)</enum><header>Potential Additions to National Recreation Area System</header>
 <paragraph id="H5FBF9A7D5080405D9D9723F639F491DA"><enum>(1)</enum><header>Eligible area</header><text>An area eligible for inclusion in the System is an area that possesses one or more of the remarkable recreational values described in subsection (a)(1)(B).</text>
 </paragraph><paragraph id="H95B9A073C9E743D0B303E830C981466D"><enum>(2)</enum><header>Potential additions</header><text>In carrying out the land management planning process, the Secretary shall—</text> <subparagraph id="HCE212EC9EB1F41899B082C8FF54081D7"><enum>(A)</enum><text>identify eligible areas that possess remarkable recreational values described in subsection (a)(1)(B);</text>
 </subparagraph><subparagraph id="H5236B9FAD7C34F438246E43FD1D46101"><enum>(B)</enum><text>develop and maintain a list of eligible areas as potential additions to the System;</text> </subparagraph><subparagraph id="H41814DDEC6C54C059C7D8AE83021FC5A"><enum>(C)</enum><text>ensure that relevant land management plans support the recreational values of areas identified as potential additions to the System; and</text>
 </subparagraph><subparagraph id="H497428E07D024C5DA3E1FC7DCF31BD17"><enum>(D)</enum><text>consider input from the Governor of, political subdivisions of, and affected Indian tribes located in, the State in which the eligible areas are located.</text>
 </subparagraph></paragraph></subsection><subsection id="H89BD5A92667A4C0B9DB5CAF3083769C7"><enum>(g)</enum><header>Existing National Recreation Areas</header><text display-inline="yes-display-inline">Each National Recreation Area that is under the jurisdiction of the Forest Service or the Bureau of Land Management and that was established before the date of enactment of this Act shall be—</text>
 <paragraph id="H0AA15E54A0124D82988C46359CE8F5A7"><enum>(1)</enum><text>deemed to be a unit of the System; and</text> </paragraph><paragraph id="H4AD7EDFBF5BF4469B8643A8D3EF775C9"><enum>(2)</enum><text>notwithstanding subsection (d)—</text>
 <subparagraph id="HFFA2EB235FC242B0BB7E2DCBCD6EEC12"><enum>(A)</enum><text>administered under the law pertaining to the applicable System unit; and</text> </subparagraph><subparagraph id="H35E809B77E604B3EB085B10EDCC66C4D"><enum>(B)</enum><text>managed in accordance with the purposes set forth in the original designation of the National Recreation Area.</text>
 </subparagraph></paragraph></subsection><subsection id="HEC6C4609EB4F4B03A617669F74251A4C"><enum>(h)</enum><header>Standard fees</header><text display-inline="yes-display-inline">In accordance with sections 803 through 808 of the Consolidated Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802–6807</external-xref>), the Secretary may establish a standard amenity fee at each National Recreation Area designated after the date of enactment of this Act that is managed by the Bureau of Land Management or the Forest Service, if—</text>
 <paragraph id="H6BF7CEAD5AC1485390A4E259FBC355E9"><enum>(1)</enum><text>the purpose of the fee is to enhance visitor services and stewardship of the recreation area; and</text> </paragraph><paragraph id="H36D43887CFB04E0F9A7B5CA57371A8FC"><enum>(2)</enum><text>the establishment of a fee is not prohibited by other Federal law.</text>
 </paragraph></subsection><subsection id="H101E67CDC3FC4B449734CD3B642F140F"><enum>(i)</enum><header>Compliance with existing laws</header><text display-inline="yes-display-inline">Nothing in this section modifies any obligation—</text> <paragraph id="H8D93E9C8CA14427DAC1508FAEC909AA6"><enum>(1)</enum><text>of the Secretary to prepare or implement a land use plan in accordance with section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) or section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>);</text>
 </paragraph><paragraph id="HC6267826A90949928B9D6F286F993C20"><enum>(2)</enum><text>under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.);</text> </paragraph><paragraph id="HFE566C986BBC4279B4B1933460076397"><enum>(3)</enum><text>under the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.); or</text>
 </paragraph><paragraph id="HD25CF9A39352444ABE0AD9B5CD04BF7E"><enum>(4)</enum><text>under any other applicable law.</text> </paragraph></subsection><subsection id="H3C1C3FE8375B4A429FFC10E581D6D29E"><enum>(j)</enum><header>Applicability of other land management designations</header><text>Nothing in this section affects—</text>
 <paragraph id="HC21BAEEFFAA84DFFA62244594CD15291"><enum>(1)</enum><text>any other land or water management designation under any other provision of law; or</text> </paragraph><paragraph id="H784D5CE847184633A5753AC006FC1CF7"><enum>(2)</enum><text>any obligation to comply with a requirement applicable to such a designation.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H978C27AD10924CC1B0BE5887FE350DC9"><enum>(k)</enum><header>Native American treaty rights</header><text display-inline="yes-display-inline">Nothing in this section alters, modifies, enlarges, diminishes, or abrogates the treaty rights of any Indian tribe, including any off-reservation reserved rights.</text>
				</subsection></section></title><title id="H818B2D24CB384BE9A48A24C8EC3B2028"><enum>IV</enum><header>Maintenance of public land</header>
			<subtitle id="H9FBFC2A131D944228318B9095A21D547"><enum>A</enum><header>Volunteers</header>
				<section id="H0FB356A5EB654D328A50BD81578438FF"><enum>401.</enum><header>Private-sector volunteer enhancement program</header>
 <subsection id="H4C899B04BDD14BCEB9C029AD84138CFA"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to promote private-sector volunteer programs within the Department of the Interior and the Department of Agriculture to enhance stewardship, recreation access, and sustainability of the resources, values, and facilities of the Federal land managed by the Federal land management agencies.</text>
 </subsection><subsection id="H63BEB5BA3CA249D7B464D6A2B50DD477"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HA39F6AC212D34BDC9E5665B8933BB02A"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means any land—</text>
 <subparagraph id="HDE12FFDEEF654923A7442D29B6CC4A59"><enum>(A)</enum><text>owned by the United States; and</text> </subparagraph><subparagraph id="H53E43A6AF5FC4C208BA449459FCE3705"><enum>(B)</enum><text>managed by the head of a Federal land management agency.</text>
 </subparagraph></paragraph><paragraph id="HAE539C44312F42C4A89ABFDDDEB7DD3A"><enum>(2)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> <subparagraph commented="no" id="HF2F940997D8449399C2E7EFDF4F68F42"><enum>(A)</enum><text>the Secretary of Agriculture (acting through the Chief of the Forest Service), with respect to National Forest System land; and</text>
 </subparagraph><subparagraph commented="no" id="H51EAA973D641475B8FF9D1C00D566D7C"><enum>(B)</enum><text>the Secretary of the Interior, with respect to land managed by the Bureau of Land Management.</text> </subparagraph></paragraph><paragraph id="H55C950C55DB74D1BA2DA5123E0545072"><enum>(3)</enum><header>Volunteer</header><text>The term <term>volunteer</term> means any individual who performs volunteer services under this section.</text>
 </paragraph></subsection><subsection id="H2BC83067A4AF42E885C970D143A88F63"><enum>(c)</enum><header>Establishment</header><text>The Secretary concerned shall develop an initiative to further enhance private-sector volunteer programs and to actively promote private-sector volunteer opportunities and provide outreach and coordination to the private sector.</text>
					</subsection><subsection id="H00B94B3DE9984BCA98A26AAE382932F2"><enum>(d)</enum><header>Cooperative agreements for stewardship of Federal land</header>
 <paragraph id="H87573E5C250940F6B09752E15738E5D9"><enum>(1)</enum><header>Authority to enter into agreements</header><text>The Secretary concerned may enter into cooperative agreements (in accordance with section 6305 of title 31, United States Code) with private agencies, organizations, institutions, corporations, individuals, or other entities to carry out one or more projects or programs with a Federal land management agency in accordance with this section.</text>
 </paragraph><paragraph id="HCE6AFDDA556847FE90DC6424D4FA9130"><enum>(2)</enum><header>Project and program instructions</header><text>The Secretary concerned shall include in the cooperative agreement the desired outcomes of the project or program and the guidelines for the volunteers to follow, including—</text>
 <subparagraph id="H43A0E83A27E14A7F9FB5BADAA45A5137"><enum>(A)</enum><text>the physical boundaries of the project or program;</text> </subparagraph><subparagraph id="H3B7AB7CDA5FF48559462D529211477C6"><enum>(B)</enum><text>the equipment the volunteers are authorized to use to complete the project or program;</text>
 </subparagraph><subparagraph id="HDDB4F049D9F54E138190594CDE4062DC"><enum>(C)</enum><text>the training the volunteers are required to complete, including agency consideration and incorporation of trainings offered by qualified nongovernmental organizations and volunteer partner organizations;</text>
 </subparagraph><subparagraph id="HE8C2047C4BC343EB81947B67540D423E"><enum>(D)</enum><text>the actions the volunteers are authorized to take to complete the project or program; and</text> </subparagraph><subparagraph id="H10A1BF05C73A42D0BB0A2F7954E97A79"><enum>(E)</enum><text>any other information that the Secretary concerned determines necessary for the volunteer group to complete the project or program.</text>
 </subparagraph></paragraph><paragraph id="HC1E6D5EBF24847BFA117C72AB0566460"><enum>(3)</enum><header>Authorized projects and programs</header><text>Subject to paragraph (4), the Secretary concerned may use a cooperative agreement to carry out projects and programs for Federal land that—</text>
 <subparagraph id="HAFABA84CC08C4C148C9F5D728FA10EFB"><enum>(A)</enum><text>promote the stewardship of resources of Federal land by volunteers;</text> </subparagraph><subparagraph id="H94110EB9D0F540B49BDB7944FF3DAD15"><enum>(B)</enum><text>support maintaining the resources, trails, and facilities on Federal land in a sustainable manner;</text>
 </subparagraph><subparagraph id="H9CF1D7C9A6254E34A3AFAF006F0E1BA6"><enum>(C)</enum><text>increase awareness, understanding, and stewardship of Federal land through the development, publication, or distribution of educational materials and products; and</text>
 </subparagraph><subparagraph id="H2B09993D25BB4C45AE947E464264D2A8"><enum>(D)</enum><text>advance education concerning the Federal land and the missions of the Federal land management agencies through the use of the Federal land as outdoor classrooms and development of other educational programs.</text>
 </subparagraph></paragraph><paragraph id="HEFDDA8D80FD141628646B7B814FBF444"><enum>(4)</enum><header>Conditions on use of authority</header><text>The Secretary concerned may use a cooperative agreement under paragraph (1) to carry out a project or program for the Federal land only if the project or program—</text>
 <subparagraph id="H830D7CC22C2B4C828FB180DCB57EC9C5"><enum>(A)</enum><text>complies with all Federal laws (including regulations) and policies;</text> </subparagraph><subparagraph id="H4F3F6F95A1DB4C73A257A077E1720194"><enum>(B)</enum><text>is consistent with an applicable management plan for any Federal land and waters involved;</text>
 </subparagraph><subparagraph id="H243FB313AFA64C55A1F15A299E40475B"><enum>(C)</enum><text>is monitored by the relevant Federal land management agency during the project and after project completion to determine compliance with the instructions under paragraph (2); and</text>
 </subparagraph><subparagraph id="HD35C186E499C42BD816EEFF884C510BC"><enum>(D)</enum><text>satisfies such other terms and conditions as the Secretary concerned determines to be appropriate.</text> </subparagraph></paragraph></subsection></section></subtitle><subtitle id="H6DEB9AEFAD3E4C32B9934245CAAA35BA"><enum>B</enum><header>Priority trail maintenance</header> <section id="HE89FDCFA0C93421BB262ACA88D718F83"><enum>411.</enum><header>Interagency trail management</header> <subsection id="H8456E938963042A7B6C317E2F259C145"><enum>(a)</enum><header>In general</header><text>The Secretaries shall establish an interagency trail management plan under which Federal land management agencies shall coordinate so that trails that cross jurisdictional boundaries between the Federal land management agencies are managed and maintained in a uniform manner.</text>
 </subsection><subsection id="H6F6129EDD555458E8C93464B854AEA3D"><enum>(b)</enum><header>Requirement</header><text>The plan established under subsection (a) shall ensure compliance with all Federal environmental laws applicable to each jurisdiction.</text>
