 <section id="HD0022480798D4AFCA22CC4CDFBB07E81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Civil and Criminal Penalties Update Act</short-title></quote>.</text> </section><section id="HE54F86001B9348DEB76806BDA6F365EF"><enum>2.</enum><header>Increased civil and criminal penalties and increased sentences for Federal health care program fraud and abuse</header> <subsection id="H82078B87229040BE83B75A23119060CC"><enum>(a)</enum><header>Increased civil money penalties and criminal fines</header> <paragraph display-inline="no-display-inline" id="H0002B42B36E04AB79C8DAA1D1993BEFA"><enum>(1)</enum><header>Increased civil money penalties</header><text>Section 1128A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7a">42 U.S.C. 1320a–7a</external-xref>) is amended—</text>
 <subparagraph id="HD2AACBE46DD747528A833555AEE0F3B3"><enum>(A)</enum><text>in subsection (a), in the matter following paragraph (10)—</text> <clause id="H25C8C2E6C24340E1BB5E35D781A90D92"><enum>(i)</enum><text>by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote> each place it appears;</text>
 </clause><clause id="H234FCF63E8E443E1B9CF3121D81AAFF5"><enum>(ii)</enum><text>by striking <quote>$15,000</quote> and inserting <quote>$30,000</quote>; and</text> </clause><clause id="H763ACB6DE0B4432CBD87D7CEB4552929"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>$50,000</quote> and inserting <quote>$100,000</quote> each place it appears; and</text>
 </clause></subparagraph><subparagraph id="H9A07399DA897427C96986E2BC7515C4F"><enum>(B)</enum><text>in subsection (b)—</text> <clause id="H29B5A283EC3D45D9BC3AF8BC72403BBE"><enum>(i)</enum><text>in paragraph (1), in the flush text following subparagraph (B), by striking <quote>$2,000</quote> and inserting <quote>$5,000</quote>;</text>
 </clause><clause id="H849AE9FD76624BB19D05A28769DC43A7"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>$2,000</quote> and inserting <quote>$5,000</quote>; and</text> </clause><clause id="HA1E1E37A28774D3C9400556D30C2CC71"><enum>(iii)</enum><text>in paragraph (3)(A)(i), by striking <quote>$5,000</quote> and inserting <quote>$10,000</quote>.</text>
 </clause></subparagraph></paragraph><paragraph id="HB9B590530A9E4564959D295F22C3E3CA"><enum>(2)</enum><header>Increased criminal fines</header><text>Section 1128B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7b">42 U.S.C. 1320a–7b</external-xref>) is amended—</text> <subparagraph id="HAD5FC9715D534A8FB4CCB224A450B2B1"><enum>(A)</enum><text>in subsection (a), in the matter following paragraph (6)—</text>
 <clause id="H8B0EE0F5A6334675ABE1CF51F304A440"><enum>(i)</enum><text>by striking <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text> </clause><clause id="H8007C3131D6E4137BA839B3AD2CB234C"><enum>(ii)</enum><text>by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>;</text>
 </clause></subparagraph><subparagraph id="H9EA6ED40BDC34E2C9B1E1A5C7114AF76"><enum>(B)</enum><text>in subsection (b)—</text> <clause id="HBF6DC16A3B624F38A9A6D07281838186"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), in the flush text following subparagraph (B), by striking <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text>
 </clause><clause id="HAFDA12C7A6E54CF5ABE67EA92613C5E8"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2), in the flush text following subparagraph (B), by striking <quote>$25,000</quote> and inserting <quote>$100,000</quote>;</text> </clause></subparagraph><subparagraph id="H05C96F65A1E6491AAA78D0E0317E0147"><enum>(C)</enum><text>in subsection (c), by striking <quote>$25,000</quote> and inserting <quote>$100,000</quote>;</text>
 </subparagraph><subparagraph id="H035E283201F6435E89468E0891898C28"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (d), in the flush text following paragraph (2), by striking <quote>$25,000</quote> and inserting <quote>$100,000</quote>; and</text> </subparagraph><subparagraph id="H04017C1AB55849789B1FF43A3083735D"><enum>(E)</enum><text>in subsection (e), by striking <quote>$2,000</quote> and inserting <quote>$4,000</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H183129E5EAF7491AA5084B4EFEA1FFDF"><enum>(b)</enum><header>Increased sentences for felonies involving Federal health care program fraud and abuse</header>
 <paragraph id="H9198026EA715412DB5E7B8F56C7F66C8"><enum>(1)</enum><header>False statements and representations</header><text display-inline="yes-display-inline">Section 1128B(a) of the Social Security Act (42 U.S.C. 1320a–7b(a)) is amended, in the matter following paragraph (6), by striking <quote>not more than five years or both, or (ii)</quote> and inserting <quote>not more than 10 years or both, or (ii)</quote>.</text>
 </paragraph><paragraph id="H0DD65751C32E4F0CA26F00496BE7480C"><enum>(2)</enum><header>Antikickback</header><text>Section 1128B(b) of such Act (42 U.S.C. 1320a–7b(b)) is amended—</text> <subparagraph id="HC85F19B225E04E62AD4F383C955BCBFB"><enum>(A)</enum><text>in paragraph (1), in the flush text following subparagraph (B), by striking <quote>not more than five years</quote> and inserting <quote>not more than 10 years</quote>; and</text>
 </subparagraph><subparagraph id="H574F82352FC9435E84AE34657F0584C2"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), in the flush text following subparagraph (B), by striking <quote>not more than five years</quote> and inserting <quote>not more than 10 years</quote>.</text> </subparagraph></paragraph><paragraph id="H5C89C600D83E4908A6423B1EDBFF8877"><enum>(3)</enum><header>False statement or representation with respect to conditions or operations of facilities</header><text>Section 1128B(c) of such Act (42 U.S.C. 1320a–7b(c)) is amended by striking <quote>not more than five years</quote> and inserting <quote>not more than 10 years</quote>.</text>
 </paragraph><paragraph id="H875654598E954D5AA88C3110D68AFE1C"><enum>(4)</enum><header>Excess charges</header><text>Section 1128B(d) of such Act (42 U.S.C. 1320a–7b(d)) is amended, in the flush text following paragraph (2), by striking <quote>not more than five years</quote> and inserting <quote>not more than 10 years</quote>.</text>
 </paragraph></subsection><subsection id="H8EA6D7F8CE4E4209A048EFEA0D72A4A1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to acts committed after the date of the enactment of this Act.</text>
