<section id="H71F83DE8A6E24A148B4B50C2DCC572F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Appalachian Forest National Heritage Area Act of 2017</short-title></quote>.</text> </section> <section id="H1E3EB018F350419F9B746BD003F00ACF"><enum>2.</enum><header>Findings; purposes</header> <subsection id="H708FE843D62F4CD49D5EB8C1EC454A8D"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H394526F307984AECB6D961E7251C5CC1"><enum>(1)</enum><text>the Heritage Area—</text> <subparagraph id="HD8F761D1CC364A80B0C3CE5B6E86C961"><enum>(A)</enum><text>is comprised of 18 counties that are located in West Virginia and western Maryland; and</text> </subparagraph>
<subparagraph id="HD87217F4C9A24B72AE98791B5A30CFE8"><enum>(B)</enum><text>taken as a whole—</text> <clause id="HFF37CEBF111342929F013685BCD87625"><enum>(i)</enum><text>possesses exceptional cultural, natural, and historical resources that form a cohesive and nationally distinctive landscape;</text> </clause>
<clause id="H6F4DE2A42B024DC4A40C6510ED3AAE3B"><enum>(ii)</enum><text>demonstrates landscapes that arose from patterns of human activity that were shaped by the geography of the forested central Appalachian Mountains; and</text> </clause> <clause id="HDCCF42EE5B5743319E95069E8B7C6419"><enum>(iii)</enum><text>reflects both modern and historical uses by citizens who continue to affect, and be affected by, the landscape of the forest;</text> </clause></subparagraph></paragraph>
<paragraph id="H120BE238F5C54E11A0EDDB05ECD96570"><enum>(2)</enum><text>there is a national interest in conserving, restoring, promoting, and interpreting the benefits of the Heritage Area for—</text> <subparagraph id="HEF9E219720BA4EF19A8C3AFA95F7155A"><enum>(A)</enum><text>the residents of the Heritage Area; and</text> </subparagraph>
<subparagraph id="H81C7A8CD83244AC99E8BC1547409FBDB"><enum>(B)</enum><text>visitors to the Heritage Area;</text> </subparagraph></paragraph> <paragraph id="H188F150A426F4159AB27D2C72775865F"><enum>(3)</enum><text>nationally significant historical and cultural resources located in the Heritage Area form a unique aspect of the heritage of the United States;</text> </paragraph>
<paragraph id="H06FE59B5E18B4F53AB919C8AC5C5C310"><enum>(4)</enum><text>with respect to the economic development of the United States—</text> <subparagraph id="H66F50EAB68B743D2AC371B01BC83CBA3"><enum>(A)</enum><text>the timber harvesting activities in the region helped fuel late 19th century and early 20th century industrial growth throughout the United States; and</text> </subparagraph>
<subparagraph id="HC6AE27516DE64EA89F191002FCE93EAC"><enum>(B)</enum><text>prominent industrialists of the region were also active in the national economy;</text> </subparagraph></paragraph> <paragraph id="HFC086A87F9F44311A39BAE20D1B8920C"><enum>(5)</enum><text>workers who participated in the timber boom of the region brought a blending of cultures of European and African-American immigrants;</text> </paragraph>
<paragraph id="H77E73F6B898E41F0A5D608457FCD9184"><enum>(6)</enum><text>the growth of each community located in the region was impacted by the forested central Appalachian Mountains;</text> </paragraph> <paragraph id="H93F027054A704802A795CA4D6A71F0B5"><enum>(7)</enum><text>the rich culture of central Appalachia—</text> 
<subparagraph id="HADF050B884AD46E5A7C6E0B68A2A4EE6"><enum>(A)</enum><text>includes folklife, music, dance, crafts, and other culturally rich traditions; and</text> </subparagraph> <subparagraph id="H22B30A0BD9A443FF966334297DAD0AAB"><enum>(B)</enum><text>is inextricably tied to the forest land of the region;</text> </subparagraph></paragraph>
<paragraph id="HE530C70FC5D14D69AC58C14ABB9E6E87"><enum>(8)</enum><text>significant historical and cultural sites and resources located in the Heritage Area include—</text> <subparagraph id="H71E5ABE3DEBC490DB96C32206A34BAF4"><enum>(A)</enum><text>historic sites from the logging era (including the intact logging company town that is located at the Cass Scenic Railroad State Park);</text> </subparagraph>
<subparagraph id="HE955E0D86D114ED3BBE14A340C553DE1"><enum>(B)</enum><text>historic sites that evidence conservation efforts (including structures constructed by the Civilian Conservation Corps);</text> </subparagraph> <subparagraph id="H22B6D069D415450FB685D708D8CEEB5F"><enum>(C)</enum><text>5 national historic landmarks; and</text> </subparagraph>
<subparagraph id="H4BD56C012D4946EC80D28CE5E0A05070"><enum>(D)</enum><text>segments of 4 National Scenic Byways and 1 All-American Road;</text> </subparagraph></paragraph> <paragraph id="H221E597449AE492CA8DD14CB53C18905"><enum>(9)</enum><text>nationally significant natural and physical resources in the Heritage Area include spectacular natural, scenic, and recreational resources, featuring the core of the central hardwood forest of the United States, which—</text> 
<subparagraph id="HE8EF7A11E9834CF4BCF9BB556CC6DF2B"><enum>(A)</enum><text>as a result of sound forest management and conservation of public land, grew from the original cutting of the forest; and</text> </subparagraph> <subparagraph id="HA61B2BE7E2C3450CA7ADC9EEA9195017"><enum>(B)</enum><text>includes—</text> 
<clause id="H4BC29B54547E4928AB34754E5E759E2A"><enum>(i)</enum><text>the remnants of old growth forests;</text> </clause> <clause id="HA366161B056647F484223BCCFC97DC4E"><enum>(ii)</enum><text>protected wilderness areas;</text> </clause>
<clause id="HBCB7BD34280C4517BC495DF7ABDA6D6F"><enum>(iii)</enum><text>14 national natural landmarks;</text> </clause> <clause id="HCCADBE6D02114FF393492F9ECAEFCCC2"><enum>(iv)</enum><text>Federal and State forest lands that were created to foster the regrowth of the forests of the United States, including the Monongahela National Forest, and 7 State forests;</text> </clause>
<clause id="H5388FA6A79AC43E893F597FD2BDC7227"><enum>(v)</enum><text>experimental forests that demonstrate the evolution of forestry management;</text> </clause> <clause id="H482E44496C234341B0B3404DFC76F1CB"><enum>(vi)</enum><text>forests managed by public and private entities; and</text> </clause>
<clause id="HD0B95A39598D46DC9624C4F4F164F380"><enum>(vii)</enum><text>a dynamic forest industry comprised of mills that demonstrate the ongoing importance of the forest land and forest products to the region;</text> </clause></subparagraph></paragraph> <paragraph id="H165DED267F294B39931B8844F5C984F5"><enum>(10)</enum><text>local public and private partnerships that are based on the visions of the community and region are working together to promote the stewardship, enhancement, and interpretation of the resources of the Heritage Area;</text> </paragraph>
<paragraph id="H9155A74A08EF409894CA83CE07920E80"><enum>(11)</enum><text>to promote the goals described in paragraph (10), local residents, organizations, and governments support the establishment of a national heritage area; and</text> </paragraph> <paragraph id="H922DF9BDC36144BA852DBFC3E2F4FBE6"><enum>(12)</enum><text>involvement by the Federal Government would enhance the efforts to promote the cultural, natural, historical, and recreational resources of the region that have been made by—</text> 
<subparagraph id="H2AFDED887B114DC8B44F5BE19EED3CFE"><enum>(A)</enum><text>the States of West Virginia and Maryland;</text> </subparagraph> <subparagraph id="H8976954FF7074227AC64ED077BE18628"><enum>(B)</enum><text>political subdivisions of the States of West Virginia and Maryland;</text> </subparagraph>
<subparagraph id="H54D2DF6F1F074194BBC43BFC84B43137"><enum>(C)</enum><text>volunteer organizations; and</text> </subparagraph> <subparagraph id="HD257AF559A014C9FBF1649D1F042D211"><enum>(D)</enum><text>private businesses.</text> </subparagraph></paragraph></subsection>
<subsection id="HDACFE04015E148878CE1D03AE2448120"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> <paragraph id="HB03E1542CAE442DCAC02F97C547F3906"><enum>(1)</enum><text>to provide a cooperative management framework to the States of West Virginia and Maryland, the political subdivisions of those States, and the citizens of those States to conserve, enhance, and interpret the significant features of the forest, land, water, and structures of the Heritage Area; and</text> </paragraph>
<paragraph id="HC7786A6872EB4AEDBD8FD04AB90D4216"><enum>(2)</enum><text>to foster a close working relationship with all levels of government, the private sector, and the local communities of the region to enable those communities—</text> <subparagraph id="H3D8EA2D58A59469B89CCBEDD9E86778E"><enum>(A)</enum><text>to conserve the heritage of those communities; and</text> </subparagraph>
<subparagraph id="H5288A5B2494E4F708ACC844FB372E2E9"><enum>(B)</enum><text>to continue to pursue economic opportunities for those communities.</text> </subparagraph></paragraph></subsection></section> <section id="H1F1FEF4E8B5C4E30A3105CC687536DAC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HCB6AA43314F9401A8A5C24295A92E08F"><enum>(1)</enum><header>Heritage area</header><text>The term <term>Heritage Area</term> means the Appalachian Forest National Heritage Area established by section 4(a).</text> </paragraph> <paragraph id="HCF43DF6E04964C7DA416A61DE2A6601B"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the management entity for the Heritage Area as specified in section 4(d)(1).</text> </paragraph>
<paragraph id="HEC566E5406E84AB88193F07EF3556103"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Heritage Area developed under section 5(a).</text> </paragraph> <paragraph id="H215DD717B1B9428EBE700E3381B28FD7"><enum>(4)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Appalachian Forest National Heritage Area</quote>, numbered T07/80,000, and dated October 2007.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HED4C5FA056AB4E8FABC5504D49060733"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1FB006208A0A4A42A04BF14B783DF83B"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the States of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8A7F31B0B878477590E98A4BAEE8A2CE"><enum>(A)</enum><text>Maryland; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB5E63D1BCBDA43DF9666BC6DE5E72840"><enum>(B)</enum><text>West Virginia.</text> </subparagraph></paragraph></section>
<section id="H2D36F2C13CC544699F45F4D428FA8231"><enum>4.</enum><header>Appalachian Forest National Heritage Area</header> 
<subsection id="H5767CE16B32F4696981323AD03FC1677"><enum>(a)</enum><header>Establishment</header><text>There is established the Appalachian Forest National Heritage Area.</text> </subsection> <subsection id="H816A26020148443D9A18B70D5DF3ECFD"><enum>(b)</enum><header>Boundaries</header><text>The Heritage Area shall include—</text> 
<paragraph id="HC02AFE5F2FDF44F095B0BDFF600F7E51"><enum>(1)</enum><text>the Barbour, Braxton, Grant, Greenbrier, Hampshire, Hardy, Mineral, Morgan, Nicholas, Pendleton, Pocahontas, Preston, Randolph, Tucker, Upshur, and Webster Counties of the State of West Virginia; and</text> </paragraph> <paragraph id="HCB087A472ED84D77AE63C9187A8C5633"><enum>(2)</enum><text>the Allegany and Garrett Counties of the State of Maryland.</text> </paragraph></subsection>
<subsection id="HF9F93584E9DD4DFFB37E7A7F8F04F4E9"><enum>(c)</enum><header>Availability of map</header><text>A map of the Heritage Area shall be on file and available for public inspection in the appropriate offices of—</text> <paragraph id="H7C911E2E49AA4F57BCE1D309754E26E9"><enum>(1)</enum><text>the National Park Service; and</text> </paragraph>
<paragraph id="HB423D944E8704459B85459D6EECDDC3A"><enum>(2)</enum><text>the local coordinating entity.</text> </paragraph></subsection> <subsection id="H8429F1F6F25F40F5AEAAA12ACC1C7D68"><enum>(d)</enum><header>Local coordinating entity</header><text>The Appalachian Forest Heritage Area, Inc., shall—</text> 
<paragraph id="H897674E421F74F66A53267FE2A255432"><enum>(1)</enum><text>serve as the local coordinating entity for the Heritage Area;</text> </paragraph> <paragraph id="HD2CA0EBAD6C34082AA9E547AA6B61C54"><enum>(2)</enum><text>oversee the development of a management plan under section 5(a); and</text> </paragraph>
<paragraph id="H742C257673D74AABA7E412530509B0DA"><enum>(3)</enum><text>be governed by a board of directors from a geographic balance across the included counties and States and which shall—</text> <subparagraph id="HD32DB61AA3F44A6983BC53761D97C563"><enum>(A)</enum><text display-inline="yes-display-inline">be composed of no fewer than 7 and no more than 15 members elected by the membership;</text> </subparagraph>
<subparagraph id="H689468974EBF4B8F9D6387294F87A056"><enum>(B)</enum><text display-inline="yes-display-inline">be selected to represent a balanced group of diverse interests, including—</text> <clause id="H794AB1CA20D9414EA570CA8C2D056839"><enum>(i)</enum><text>forest industry;</text> </clause>
<clause id="H82C889B1330B479CAB9FED63A5DC6EA4"><enum>(ii)</enum><text>environmental;</text> </clause> <clause id="H885E2B0DD6CA4E26A53B875F054FE6D1"><enum>(iii)</enum><text>cultural heritage;</text> </clause>
<clause id="H13F6C96AE5B64B23927CD41053CF593B"><enum>(iv)</enum><text>tourism; and</text> </clause> <clause id="HD307B69C15024C04BBADF1CC875AFA11"><enum>(v)</enum><text>regional agency partners;</text> </clause></subparagraph>
<subparagraph id="H9D971C670356481CA564A813888C757F"><enum>(C)</enum><text>exercise all corporate powers of the local coordinating entity;</text> </subparagraph> <subparagraph id="H49A597F3195A4E79B0B2B3FB5E2886F3"><enum>(D)</enum><text>manage the activities and affairs of the local coordinating entity; and</text> </subparagraph>
<subparagraph id="H76102FCB0F2348339E0C932405A944A3"><enum>(E)</enum><text>subject to any limitations in the articles and bylaws of the local coordinating entity, this section, and any other applicable Federal or State law, establish the policies of the local coordinating entity.</text> </subparagraph></paragraph></subsection></section> <section id="H49C5C401DCD247DEAEE2E6BBE0F42FD5"><enum>5.</enum><header>Management plan</header> <subsection id="H0016286F5E19447CA2F779BDB3BD27B0"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to carry out this Act, the local coordinating entity shall develop and submit to the Secretary for approval a management plan for the Heritage Area.</text> </subsection>
<subsection id="HC59FF992DEBD4006A32D3759F349C075"><enum>(b)</enum><header>Requirements</header><text>The management plan shall—</text> <paragraph id="H6B7A7022EEF04284B54F5E9906B485D4"><enum>(1)</enum><text>present comprehensive policies, goals, strategies, and recommendations for—</text> 
<subparagraph id="H94B86D9A6C1143E198B54737DB0A6239"><enum>(A)</enum><text>presenting to the citizens of the United States the heritage of the region; and</text> </subparagraph> <subparagraph id="H03AFFBBECB054665A30C85602171E980"><enum>(B)</enum><text>encouraging the long-term resource conservation, enhancement, interpretation, funding, management, and development of the Heritage Area;</text> </subparagraph></paragraph>
<paragraph id="H9F067B414327453FB1C305DDE3EEC2A4"><enum>(2)</enum><text>take into consideration and coordinate Federal, State, and local plans to present a unified historic preservation and interpretation plan;</text> </paragraph> <paragraph id="H687BAB2763B54B38A3F1DA4BB77FB1F2"><enum>(3)</enum><text>involve residents, public agencies, and private organizations of the Heritage Area;</text> </paragraph>
<paragraph id="H30019C001E2743E7A963EC91B55C7566"><enum>(4)</enum><text>describe actions that units of government, private organizations, and citizens recommend for the conservation, enhancement, interpretation, funding, management, and development of the resources of the Heritage Area;</text> </paragraph> <paragraph id="HD4420597D48E4DEAAC17D2768F769244"><enum>(5)</enum><text>identify—</text> 
<subparagraph id="HA7F05124AF9A4C89A19A5800661A8D03"><enum>(A)</enum><text>existing and potential sources of Federal and non-Federal funding for the conservation, enhancement, interpretation, funding, management, and development of the resources of the Heritage Area; and</text> </subparagraph> <subparagraph id="H6657F206D6F14ED8BC2FFADB50ED9FB9"><enum>(B)</enum><text>economic development strategies for the conservation, enhancement, interpretation, funding, management, and development of the resources of the Heritage Area;</text> </subparagraph></paragraph>
<paragraph id="HCD3BEA639C2D46BAAFC7D0BABE80CD0B"><enum>(6)</enum><text>include—</text> <subparagraph id="HE289628B6EAB4445BBEE6CB5A9CC78F1"><enum>(A)</enum><text>an inventory of the cultural, natural, historical, educational, scenic, and recreational resources contained in the Heritage Area, including a list of property that—</text> 
<clause id="HF690C0916C774E1CA3AFF69BD3FDB669"><enum>(i)</enum><text>is related to the themes of the Heritage Area; and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HA53E88A874E747B1B0B3A1BB18CEAE62"><enum>(ii)</enum><text>should be conserved, enhanced, managed, or developed;</text> </clause></subparagraph>
<subparagraph id="HBD983FF184B54DBBBE05F219380D71EF"><enum>(B)</enum><text>a recommendation of policies and strategies for resource management and conservation, including the development of intergovernmental cooperative agreements to manage and conserve the cultural, natural, historical, educational, scenic, and recreational resources of the Heritage Area;</text> </subparagraph> <subparagraph id="H68DBAF89B47E41E7A03943AFBBB254BA"><enum>(C)</enum><text>a program of strategies and actions to implement the management plan that includes—</text> 
<clause id="H67EC18AC2D7F4259826522FB7EF6630A"><enum>(i)</enum><text>performance goals;</text> </clause> <clause id="HC6DE3A155B2C4CF6979B1CEFFBCF0EFB"><enum>(ii)</enum><text>resource conservation plans;</text> </clause>
<clause id="H291A395C64F447D9B3B1FF229FF43CF3"><enum>(iii)</enum><text>enhancement strategies;</text> </clause> <clause id="HD2DABA61C5A04407B5ACEA36F705968B"><enum>(iv)</enum><text>interpretation strategies; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HED0997C383484818AE43D4E2A6A8899D"><enum>(v)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any government, organization, business, or individual;</text> </clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1CD9BE84E3904ECC846E7AD03DBF3990"><enum>(D)</enum><text>an analysis of, and recommendations for, means by which Federal, State, and local programs may best be coordinated to further the purposes of this Act, including an analysis of the role of the National Park Service and other Federal agencies associated with the Heritage Area;</text> </subparagraph>
<subparagraph id="H687F4829AFF848E280B1BA3DD9F9726A"><enum>(E)</enum><text>a business plan that—</text> <clause id="H8104FC11E34B447AB7294A6570E482D3"><enum>(i)</enum><text>describes the role, operation, financing, and functions of—</text> 
<subclause id="H10E991DBFBC748019DB1D7DBF537E871"><enum>(I)</enum><text>the local coordinating entity; and</text> </subclause> <subclause id="HA60D09C2421846E0BBD7CCCAB972533E"><enum>(II)</enum><text>each of the major activities included in the management plan; and</text> </subclause></clause>
<clause id="HE66B8E9F150342BFA2ED1316CCD90B53"><enum>(ii)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan; and</text> </clause></subparagraph> <subparagraph id="H36F0B821835141A3ACAA3A6492241D50"><enum>(F)</enum><text>an interpretive plan for the Heritage Area; and</text> </subparagraph></paragraph>
<paragraph id="H323AE79C866944CA9643967A36475F61"><enum>(7)</enum><text>list any revisions to the boundaries of the Heritage Area proposed by the local coordinating entity and requested by the affected local government.</text> </paragraph></subsection> <subsection id="H5421DD55CEB4459D8EBEC77567AC0BA2"><enum>(c)</enum><header>Deadline; termination of funding</header> <paragraph id="HA12EDB029FAE4D93ADEA70663880E758"><enum>(1)</enum><header>Deadline</header><text>Not later than 3 years after the date on which funds are made available under section 11(a), the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph>
<paragraph id="HE7B79005C3214F5F840D53724259B520"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with this section, the Secretary shall not provide to the local coordinating entity any additional financial assistance under this Act until the management plan is submitted to and approved by the Secretary under subsection (d)(1).</text> </paragraph></subsection> <subsection id="HE37B271DA2EC4777AC86F673DC5FED33"><enum>(d)</enum><header>Approval of management plan</header> <paragraph id="H8A8BDCC01C7243ABA204B3CC7BC590AA"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after the date of receipt of the management plan under subsection (c)(1), the Secretary shall review and approve or disapprove the management plan.</text> </paragraph>
<paragraph id="H8FAE3EA3E51C409287F734821BCECAED"><enum>(2)</enum><header>Criteria</header><text>In determining whether to approve the management plan, the Secretary shall consider whether—</text> <subparagraph id="HC8757EA7C3114023B018B8584DCDE937"><enum>(A)</enum><text>the management plan meets all requirements identified in subsection (b); and</text> </subparagraph>
<subparagraph id="H05362FA3BF1C487BAC31851FBE0D2CE6"><enum>(B)</enum><text>the local coordinating entity has afforded adequate opportunity, including public hearings, for public and governmental involvement in the preparation of the management plan.</text> </subparagraph></paragraph></subsection> <subsection id="H2806D503424748C4A117CB32073FECD0"><enum>(e)</enum><header>Action following disapproval</header><text>If the Secretary disapproves the management plan under subsection (d)(1), the Secretary shall—</text> 
<paragraph id="H181AC52CEEDE4793853FDC41F905DC80"><enum>(1)</enum><text>advise the local coordinating entity in writing of the reasons for the disapproval;</text> </paragraph> <paragraph id="H1591BCBE0F07403B8517122BF8307BD2"><enum>(2)</enum><text>make recommendations for revisions to the management plan; and</text> </paragraph>
<paragraph id="H90A4E4A017CC4722A2AB939E6C231A53"><enum>(3)</enum><text>not later than 180 days after the date of receipt of a proposed revision to the management plan, approve or disapprove the proposed revision.</text> </paragraph></subsection> <subsection id="HA1E2D4E3E7C64F06A6D428216202AC04"><enum>(f)</enum><header>Amendments</header> <paragraph id="HAC5D398AD6514D19A7328C23D230133B"><enum>(1)</enum><header>In general</header><text>The Secretary shall review and approve or disapprove each amendment to the management plan that the Secretary determines may substantially alter the purposes of the Heritage Area.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9764121EA635403491A0621D0AA0BCD5"><enum>(2)</enum><header>Use of funds</header><text>Funds made available under this Act shall not be expended by the local coordinating entity to implement an amendment described in paragraph (1) until the Secretary approves the amendment.</text> </paragraph></subsection> <subsection id="HD273E0EF7E0344CB96EA53DD8AB13827"><enum>(g)</enum><header>Effect of inaction</header><text>If the Secretary does not approve or disapprove a management plan, revision, or change within 180 days after it is submitted to the Secretary, then the management plan, revision, or change shall be deemed to have been approved by the Secretary.</text> </subsection></section>
<section id="H7B883E8977BA4355B0B34D934FFEA37A"><enum>6.</enum><header>Authorities, duties, and prohibition of the local coordinating entity</header> 
<subsection id="HB365228DDBD54D038FF49166601ED002"><enum>(a)</enum><header>Authorities</header><text>To prepare and carry out the management plan, the local coordinating entity may use funds made available under this Act to—</text> <paragraph id="HE00CD5D1E10E4B819618707996584BEB"><enum>(1)</enum><text>make grants to—</text> 
<subparagraph id="H217B446F5CEE4A0E801BE840498C81F1"><enum>(A)</enum><text>political jurisdictions;</text> </subparagraph> <subparagraph id="HA61017A0FB754B209253089D598FEA2F"><enum>(B)</enum><text>nonprofit organizations; and</text> </subparagraph>
<subparagraph id="HC81A7EF2FD544138A046AE43E7FA4074"><enum>(C)</enum><text>other parties located in the Heritage Area;</text> </subparagraph></paragraph> <paragraph id="H46B17ACFEB044920A3C0FE5D02811980"><enum>(2)</enum><text>enter into cooperative agreements with, or provide technical assistance to—</text> 
<subparagraph id="H7D54EE8C3DB14F8E9C137DA9FABD692C"><enum>(A)</enum><text>political jurisdictions;</text> </subparagraph> <subparagraph id="HE8BD0236BA8C450FA1145F0ED656B0C6"><enum>(B)</enum><text>nonprofit organizations;</text> </subparagraph>
<subparagraph id="H3D29716D33C44218AC62A11C8FEF7901"><enum>(C)</enum><text>Federal agencies; and</text> </subparagraph> <subparagraph id="H6F772FAF22364F988EAA672E24C35E92"><enum>(D)</enum><text>other interested parties;</text> </subparagraph></paragraph>
<paragraph id="HCB4263540D9F446383BE66DE398578CF"><enum>(3)</enum><text>hire and compensate staff who have demonstrated expertise in the fields of—</text> <subparagraph id="HD499616D6B2249529BE579CAC9AD45BF"><enum>(A)</enum><text>cultural, natural, and historical resources conservation;</text> </subparagraph>
<subparagraph id="H6B0ACA5652D4473E9FEE81ED9E9B3ABD"><enum>(B)</enum><text>economic and community development;</text> </subparagraph> <subparagraph id="H410037AACA3C401096F19EFD0648DA98"><enum>(C)</enum><text>forestry; or</text> </subparagraph>
<subparagraph id="H54EBB0AAAD8749428896B5A6CBA074E5"><enum>(D)</enum><text>heritage planning;</text> </subparagraph></paragraph> <paragraph id="H5469C306DE144661BA70BDE31C62E04A"><enum>(4)</enum><text>obtain funds from any source (including a program that has a cost-sharing requirement);</text> </paragraph>
<paragraph id="H61688329D0DE43B080F6F1CD2861756B"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H758392558C584D5CB1F7B31CFF9FADE7"><enum>(6)</enum><text>support activities of partners, and any other activities, that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCC3FBF2D719D43A5AE8AF99CB443A012"><enum>(A)</enum><text>further the purposes of the Heritage Area; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H8473C813102B4088A9BF85A885D31545"><enum>(B)</enum><text>are consistent with the management plan approved under section 5(d)(1).</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H2702DDF260804B219C36FD203A06B1D6"><enum>(b)</enum><header>Duties</header><text>In addition to developing the management plan, the local coordinating entity shall—</text> <paragraph id="H0C9EB2C5A9B94156B0FB2F4E05CA438C"><enum>(1)</enum><text>for any fiscal year for which Federal funds have been received by the local coordinating entity under this Act—</text> 
<subparagraph id="HAD2401BC7759440CA6E2C6D1247DC2D9"><enum>(A)</enum><text>submit an annual report to the Secretary that describes—</text> <clause id="H81B02102E0B5462B896DFA692B3525E3"><enum>(i)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </clause>
<clause id="H306C6CA2DB0E4A659E062DE4EEED1B01"><enum>(ii)</enum><text>the expenses and income of the local coordinating entity;</text> </clause> <clause id="H9D69AC71F40C429E8B537A198A1AED9C"><enum>(iii)</enum><text>the amounts and sources of matching funds;</text> </clause>
<clause id="HE1E6207D7F504A3988ADCA0E79EF9082"><enum>(iv)</enum><text>the amounts leveraged with Federal funds and the sources of the leveraging; and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HCAE9D64118F1483A988E745F30E03443"><enum>(v)</enum><text>any grants made to any other entities during the fiscal year; and</text> </clause></subparagraph>
<subparagraph id="H2764805755954137820AC3ECA1D28637"><enum>(B)</enum><text>make available for audit by Congress, the Secretary, and appropriate units of government, all records pertaining to the expenditure of the funds and any matching funds; and</text> </subparagraph></paragraph> <paragraph id="H5AB8EFDF71BF4E9E9B76EAA8DBF507D9"><enum>(2)</enum><text>encourage, by appropriate means and consistent with the purposes of the Heritage Area, the economic viability of the Heritage Area.</text> </paragraph></subsection>
<subsection id="H8CFFF445A12044CDB7FFA06F48C3FAB6"><enum>(c)</enum><header>Prohibition on the acquisition of real property</header><text>The local coordinating entity shall not use Federal funds made available under this Act to acquire real property or any interest in real property.</text> </subsection></section> <section id="HA225250192D242AE8F30175D6600E203"><enum>7.</enum><header>Authorities and duties of the Secretary</header> <subsection id="HF84DFEE15E1849D6ADD5C8748FD1A6AA"><enum>(a)</enum><header>Technical and financial assistance</header><text>On request of the local coordinating entity, the Secretary may provide technical and financial assistance, on a reimbursable or nonreimbursable basis, to the local coordinating entity for—</text> 
<paragraph id="H2163726E9C8C4917BBC8B343F92ADAC5"><enum>(1)</enum><text>the development and implementation of the management plan; and</text> </paragraph> <paragraph id="H9E2B17F798B8414DBE43883E64EB48D3"><enum>(2)</enum><text>other initiatives of the local coordinating entity.</text> </paragraph></subsection>
<subsection id="H45567E2DA6C2443890B3B3B165D863FB"><enum>(b)</enum><header>Cooperative agreements</header> 
<paragraph id="H4943417149174E8BBA582B7DE71AD8BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out this Act, the Secretary may enter into cooperative agreements with the local coordinating entity and other public and private entities to provide assistance under subsection (a).</text> </paragraph> <paragraph id="H131C1919F7CC427CBCDF3456C76C7160"><enum>(2)</enum><header>Requirements</header><text>The cooperative agreement under paragraph (1) shall, at a minimum—</text> 
<subparagraph id="H5992DB9E2DC047909A7B5A6A21D135B7"><enum>(A)</enum><text>establish the goals and objectives of the Heritage Area; and</text> </subparagraph> <subparagraph id="H2491082BAB264EFD83E959B709BCE7D5"><enum>(B)</enum><text>include—</text> 
<clause id="HA0DDC2DA9CAA46FA99DD776F38A6809F"><enum>(i)</enum><text>a proposal relating to the conservation and interpretation of the Heritage Area; and</text> </clause> <clause id="H5CE8A6C3353A414FB093CBBF24D7EB4B"><enum>(ii)</enum><text>a general outline describing each measure agreed to by the Secretary and the local coordinating entity.</text> </clause></subparagraph></paragraph></subsection></section>
<section id="HE0140E8406F9421293FDEAE44A6397A2"><enum>8.</enum><header>Relationship to other Federal agencies</header> 
<subsection id="H12C90A305EA84368B7B3A913EDA9729A"><enum>(a)</enum><header>In general</header><text>This Act shall not affect the authority of any Federal official to provide technical or financial assistance under any other law.</text> </subsection> <subsection id="HEE2BDF70A07F491FA8DAE90C8DF869D2"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct an activity that may have an impact on the Heritage Area shall, to the maximum extent practicable—</text> 
<paragraph id="HCAD7CFB6BA2A4A80A084FBE111D30673"><enum>(1)</enum><text>consult with the Secretary and the local coordinating entity regarding the activity; and</text> </paragraph> <paragraph id="H1BDB8EF89F954B4995D886D46746B033"><enum>(2)</enum><text>coordinate the activity with the Secretary and the local coordinating entity.</text> </paragraph></subsection>
<subsection id="HA5E2FE4F0C1446A2A56CE9FF7A49AC0F"><enum>(c)</enum><header>Effect on other Federal agencies</header><text>Nothing in this Act—</text> <paragraph id="H03B0AA6795324EEB9713B4BA3E572A46"><enum>(1)</enum><text>modifies, alters, or amends any law (including a regulation) authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph>
<paragraph id="H393B18724EAA463D9EDFFA37CDD5A01C"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of the Heritage Area; or</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H36228163303F4F2E89F866DB79690381"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section>
<section id="HD88A0661020E410A861D17BDBF22B7B5"><enum>9.</enum><header>Property owners and regulatory protections</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to—</text> <paragraph id="H680BBAF7936743BCA19BB0FA497EF1FB"><enum>(1)</enum><text display-inline="yes-display-inline">abridge the rights of any property owner, whether public or private, including the right to refrain from participating in any plan, project, program, or activity conducted within the Heritage Area;</text> </paragraph>
<paragraph id="H75BB9487492C42249C3EC559837FD2C0"><enum>(2)</enum><text display-inline="yes-display-inline">require any property owner to permit public access (including Federal, Tribal, State, or local government access) to such property or to modify any provisions of Federal, Tribal, State, or local law with regard to public access or use of private lands;</text> </paragraph> <paragraph id="HAED84C3B308946FF99936EDD23852093"><enum>(3)</enum><text display-inline="yes-display-inline">alter any duly adopted land use regulation or any approved land use plan or any other regulatory authority of any Federal, State, or local agency or Tribal government, or to convey any land use or other regulatory authority to any local coordinating entity;</text> </paragraph>
<paragraph id="H4EF3F0B51D554280829C5CFE46C32A46"><enum>(4)</enum><text display-inline="yes-display-inline">authorize or imply the reservation or appropriation of water or water rights;</text> </paragraph> <paragraph id="HB594FD339D5A42128F6D1B9743CDFFCA"><enum>(5)</enum><text display-inline="yes-display-inline">diminish the authority of the State to manage fish and wildlife including the regulation of fishing and hunting within the Heritage Area;</text> </paragraph>
<paragraph id="HB3EAA25D21FB43EFAD2808076C9083C9"><enum>(6)</enum><text display-inline="yes-display-inline">create any liability, or to have any effect on any liability under any other law, of any private property owner with respect to any persons injured on such private property; or</text> </paragraph> <paragraph id="H1FF1E8B5DBB34CC9A61E7DD3861C4832"><enum>(7)</enum><text>abridge, or authorize the Secretary or the local coordinating entity to abridge, valid rights to timber harvesting.</text> </paragraph></section>
<section id="H752892B600FC4B649EC390516288C7EE"><enum>10.</enum><header>Evaluation</header> 
<subsection id="H53D56BFE640540688784903F9BD1DD2A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years before the date on which authority for Federal funding terminates for the Heritage Area, the Secretary shall conduct an evaluation of the accomplishments of the Heritage Area and prepare a report with recommendations for the National Park Service’s future role, if any, with respect to the Heritage Area.</text> </subsection> <subsection id="HE29FAD2E91ED49FBB51D6D9C1795C89C"><enum>(b)</enum><header>Evaluation components</header><text display-inline="yes-display-inline">An evaluation prepared under subsection (a) shall—</text> 
<paragraph id="H6100DA335F5A4B99ABF28E16A20798A6"><enum>(1)</enum><text display-inline="yes-display-inline">assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="HE6003841542F41648B92C71F3994005D"><enum>(A)</enum><text display-inline="yes-display-inline">accomplishing the purposes of the authorizing legislation for the Heritage Area; and</text> </subparagraph>
<subparagraph id="HB56E71DC18184EAB9B079027FA6A8BEB"><enum>(B)</enum><text display-inline="yes-display-inline">achieving the goals and objectives of the approved management plan for the Heritage Area;</text> </subparagraph></paragraph> <paragraph id="HA5BD68028E674DFDB966D72AF49DDD88"><enum>(2)</enum><text display-inline="yes-display-inline">analyze the Federal, State, local, and private investments in the Heritage Area to determine the leverage and impact of the investments; and</text> </paragraph>
<paragraph id="H85971499DB884F5AAF5976FE3BF55A15"><enum>(3)</enum><text display-inline="yes-display-inline">review the management structure, partnership relationships, and funding of the Heritage Area for purposes of identifying the critical components for sustainability of the Heritage Area.</text> </paragraph></subsection> <subsection id="HF633C4551EF94A6B8EC0865E9D6FDF5A"><enum>(c)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Based upon the evaluation under subsection (a), the Secretary shall prepare a report with recommendations for the National Park Service’s future role, if any, with respect to the Heritage Area.</text> </subsection>
<subsection id="H352050BAADBB4D28A589271942E0FBBF"><enum>(d)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">On completion of a report under subsection (c), the Secretary shall submit the report to—</text> <paragraph id="HCC295C3A82FB40C2B91BD6D42D744FD5"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural Resources of the Senate; and</text> </paragraph>
<paragraph id="HE69077C15A5E498B867D3A86EDD7B5F1"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives.</text> </paragraph></subsection></section> <section id="H7A1A1EB6159C4CF391884A1F8AE65606"><enum>11.</enum><header>Funding</header> <subsection id="H782DEA889D2F49AEB85BE9564580AAE5"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this Act $10,000,000, of which not more than $1,000,000 may be authorized to be appropriated for any fiscal year.</text> </subsection>
<subsection id="H0AE138DFE26B432EB35CDFB05022FB7D"><enum>(b)</enum><header>Matching funds</header> 
<paragraph id="H5D053AA60ED243C086DBAB6AC3E728E4"><enum>(1)</enum><header>In general</header><text>As a condition of receiving assistance under subsection (a), the local coordinating entity shall match any amounts provided to the local coordinating entity under this Act.</text> </paragraph> <paragraph id="HF6C30AC5F6A5425880954290C50E866E"><enum>(2)</enum><header>Forms of payment</header><text>To meet the matching requirement described in paragraph (1), the local coordinating entity shall provide to the Secretary payments that—</text> 
<subparagraph id="H9CEEA416FE444532B8FFD1683938D44D"><enum>(A)</enum><text>shall be derived from non-Federal sources; and</text> </subparagraph> <subparagraph id="HA5FCE219E22C4FC7A62885CD69906C89"><enum>(B)</enum><text>may be in-kind contributions of goods or services.</text> </subparagraph></paragraph></subsection></section>
<section id="H999E8981F79E4AFC951FBEC43B2BD7B8"><enum>12.</enum><header>Termination of authority</header> 
<subsection id="H92983055382747A6A99326762DBFDF4C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), the authority of the Secretary to provide financial assistance under this Act terminates on the date that is 15 years after the date of enactment of this Act.</text> </subsection> <subsection id="H6B5D2C2269984D3BA8EECCA9CD6F8456"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The termination of authority of the Secretary under subsection (a) shall not effect the authority of the Secretary to provide to the local coordinating entity technical assistance and administrative oversight.</text> </subsection></section>
