<subsection id="H9A80E7F8FF0441808E8507DEB3AE3D73"><enum>(a)</enum><header>Proposal</header><text display-inline="yes-display-inline">Section 141(b) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10161">42 U.S.C. 10161(b)</external-xref>) is amended—</text> <paragraph id="HD9CCCAA4BF6A47BCBE7307CCF9993822"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HD5F4AD5C833D4B1CAE6C41151E23D65A"><enum>(A)</enum><text>by striking <quote>1985</quote> and inserting <quote>2019</quote>; and</text></subparagraph> <subparagraph id="HE178E52B82184CE9A217B5911DE3AA33"><enum>(B)</enum><text>by striking <quote>the construction of</quote>; </text></subparagraph></paragraph>

<paragraph id="H696186CFB9A048E1BDD84FE26743B2F2" commented="no"><enum>(3)</enum><text>by amending paragraph (4) to read as follows:</text> <quoted-block style="OLC" id="H7DC524F69C25410AA6A3716584F86490" display-inline="no-display-inline"> <paragraph id="H259E6D8C9100495B8E2BF31296A52E92" indent="up1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall, not later than 90 days after the date of enactment of the <short-title>Nuclear Waste Policy Amendments Act of 2017</short-title>, publish a request for information to help the Secretary evaluate options for the Secretary to enter into MRS agreements with respect to one or more monitored retrievable storage facilities.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBB134265FB734F03B4288748AD43E003"><enum>(b)</enum><header>Additional amendments</header> 
<paragraph id="H0AB0D4FC920742098029A1D3FECDEF50"><enum>(1)</enum><header>In general</header><text>Section 141 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10161">42 U.S.C. 10161</external-xref>) is further amended—</text> <subparagraph id="H025D6444526A4BF5973413823D623CA2" commented="no"><enum>(A)</enum><text>in subsection (c)(2)—</text> 
<clause id="HA19762EE000847E781933A2F7BA6DC12"><enum>(i)</enum><text>by striking <quote>If the Congress</quote> and all that follows through <quote>monitored retrievable storage facility, the</quote> and inserting <quote>The</quote>; and</text></clause> <clause id="HB4CA645DF3B64F7BA53597089A601C12"><enum>(ii)</enum><text>by striking <quote>construction of such facility</quote> and inserting <quote>construction of a monitored retrievable storage facility</quote>; and</text></clause></subparagraph> 
<subparagraph id="H41D78589288A40A3929096FE82CBA5BF"><enum>(B)</enum><text>by striking subsections (d) through (h).</text></subparagraph></paragraph> <paragraph id="H3FF00307BE1148D6BC574E3C5E8440B7" commented="no"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>) is amended—</text> 
<subparagraph id="HAB80542AAB524ACD81FFFD318F234DD3"><enum>(A)</enum><text>in paragraph (34), by striking <quote>the storage facility</quote> and inserting <quote>a storage facility</quote>; and</text></subparagraph> <subparagraph id="H8FF9B3D4354645F9A667622BD0AD9021"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="H2EB8C5D682EE47619EFDC21E422BCC0F" commented="no"><enum>(2)</enum><text>store, pursuant to an MRS agreement, Department-owned civilian waste at a monitored retrievable storage facility for which a non-Federal entity holds a license described in section 143(1).</text></paragraph></subsection> <subsection id="H8E1C0219CEA84973A9DC0F1AA3545332" commented="no"><enum>(c)</enum><header>Priority</header> <paragraph id="HA13FE7ECDC80427089A8B729BE82201A" commented="no"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall prioritize storage of Department-owned civilian waste at a monitored retrievable storage facility authorized under subsection (b)(2).</text></paragraph> 
<paragraph id="H330CFDB9B1674B85BA36C696D4133289" commented="no"><enum>(2)</enum><header>Exception</header> 
<subparagraph id="HEADDA560ACF143C8B0E1B25A14FF4277" commented="no"><enum>(A)</enum><header>Determination</header><text>Paragraph (1) shall not apply if the Secretary determines that it will be faster and less expensive to site, construct, and operate a facility authorized under subsection (b)(1), in comparison to a facility authorized under subsection (b)(2).</text></subparagraph> <subparagraph id="H6CDD6F8FA8ED4E1E88B1D068D6D9D404" commented="no"><enum>(B)</enum><header>Notification</header><text>Not later than 30 days after the Secretary makes a determination described in subparagraph (A), the Secretary shall submit to Congress written notification of such determination.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H47EC1029A2AC4A73871B8B5C432507C5"><enum>103.</enum><header>Conditions for MRS agreements</header> 
<subsection id="H08ED0027D6CF486EBB5EBB1C254B995B"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 143 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10163">42 U.S.C. 10163</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="HF4DE9D60D0D44EE4A08A9E1220E27AA7" display-inline="no-display-inline"> <section id="HBD9A883F35334CC3AB16CE753869A52F" commented="no"><enum>143.</enum><header>Conditions for MRS agreements</header> <subsection id="H63BB768CFCA94DD1B38ED889088BADCE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not enter into an MRS agreement under section 142(b)(2) unless—</text> 
<paragraph id="H6C26EB7FEC4A4B53B1712258E128C26B" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the monitored retrievable storage facility with respect to which the MRS agreement applies has been licensed by the Commission under the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011</external-xref> et seq.);</text></paragraph> <paragraph id="HF9FE0EAB3CFB466C84C085DE5809C4E1" commented="no"><enum>(2)</enum><text>the non-Federal entity that is a party to the MRS agreement has approval to store Department-owned civilian waste at such facility from each of—</text> 
<subparagraph id="HA0F3039FFFB348BC9405B14BD3E629EB" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the Governor of the State in which the facility is located;</text></subparagraph> <subparagraph id="H43DEF5199F6E48DFBF249997E2A129FD" commented="no"><enum>(B)</enum><text>any unit of general local government with jurisdiction over the area in which the facility is located; and</text></subparagraph> 
<subparagraph id="H36D64D251A5642D19C2F240AF756BAD9" commented="no"><enum>(C)</enum><text>any affected Indian tribe; </text></subparagraph></paragraph> <paragraph id="HF034E52666AF4EB1B5183F8EB76CC555"><enum>(3)</enum><text>except as provided in subsection (b), the Commission has issued a final repository decision; and</text></paragraph> 
<paragraph id="HB349D2B12847439E8D3569982A1723B8" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">the MRS agreement provides that the quantity of high-level radioactive waste and spent nuclear fuel at the site of the facility at any one time will not exceed the limits described in section 148(d)(3) and (4).</text></paragraph></subsection> <subsection id="H8C74273779DB4C8F810627D2E6DAB1F3"><enum>(b)</enum><header>Initial agreement</header> <paragraph id="H8744E43F9209404C991192747F2DA671"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary may enter into one MRS agreement under section 142(b)(2) before the Commission has issued a final repository decision.</text></paragraph> 
<paragraph id="H9B6881289B7F44BB9E5667E485C0CEB2"><enum>(2)</enum><header>Funding</header><text>There are authorized to be appropriated to carry out this subsection—</text> <subparagraph id="H92D84799E2C8422C85C99C3FAD936F65"><enum>(A)</enum><text>for each of fiscal years 2020 through 2022, the greater of—</text> 
<clause id="HC2BC16ED80544EE6A46D11BDE4123F4C"><enum>(i)</enum><text>$50,000,000; or</text></clause> <clause id="HE7A13266F1ED496FA410F147E13401D8"><enum>(ii)</enum><text>the amount that is equal to 10 percent of the amounts appropriated from the Waste Fund in that fiscal year; and</text></clause></subparagraph> 
<subparagraph id="H40BF6BBDCE5740DCB72E11C2E60A2296"><enum>(B)</enum><text display-inline="yes-display-inline">for each of fiscal years 2023 through 2025, the amount that is equal to 10 percent of the amounts appropriated from the Waste Fund in that fiscal year.</text></subparagraph></paragraph> <paragraph id="HFEC4FB86768E46FE9AA6C97ACDC7539A"><enum>(3)</enum><header>Priority</header> <subparagraph id="H10024FED6D954C4FB0D343E23E056C1E"><enum>(A)</enum><header>In general</header><text>An MRS agreement entered into pursuant to paragraph (1) shall, to the extent allowable under this Act (including under the terms of the standard contract established in section 691.11 of title 10, Code of Federal Regulations), provide for prioritization of the storage of Department-owned civilian waste that originated from facilities that have ceased commercial operation.</text></subparagraph> 
<subparagraph id="H8A20F7FE0F334C0FBFF43FCB49563DD5"><enum>(B)</enum><header>No effect on standard contract</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed to amend or otherwise alter the standard contract established in section 691.11 of title 10, Code of Federal Regulations.</text></subparagraph></paragraph> <paragraph id="HA4E53BBC44CC4A77A5CC2D7127080B67"><enum>(4)</enum><header>Conditions</header> <subparagraph id="HB11687E44D0F4A2495D90A337AC284EE"><enum>(A)</enum><header>No storage</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Secretary may not store any Department-owned civilian waste at the initial MRS facility until the Commission has issued a final repository decision.</text></subparagraph> 
<subparagraph id="H4C7CD32677734A2181E97A5C2BD11C8F"><enum>(B)</enum><header>Exception</header> 
<clause id="H93CA0D27364C453CBE819BF7DA488B8A"><enum>(i)</enum><header>Finding</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Chairman of the Commission, may make a finding that a final repository decision is imminent, which finding shall be updated not less often than quarterly until the date on which the Commission issues a final repository decision.</text></clause> <clause id="HC50252D2C0C243D7ADCD5CF1D19B9803"><enum>(ii)</enum><header>Storage</header><text display-inline="yes-display-inline">If the Secretary makes a finding under clause (i), the Secretary may store Department-owned civilian waste at the initial MRS facility in accordance with this section.</text></clause> 
<clause id="HF3A9B78F1B624D08A883E95DE6B6338C"><enum>(iii)</enum><header>Notice</header><text display-inline="yes-display-inline">Not later than seven days after the Secretary makes or updates a finding under clause (i), the Secretary shall submit to Congress written notification of such finding.</text></clause> <clause id="HC0A17BAF25FD42B2B29FF35375597CDE" commented="no"><enum>(iv)</enum><header>Reporting</header><text display-inline="yes-display-inline">In addition to the requirements of section 114(c), if the Secretary makes a finding under clause (i), the Secretary shall submit to Congress the report described in such section 114(c) not later than 1 month after the Secretary makes such finding and monthly thereafter until the date on which the Commission issues a final repository decision.</text></clause></subparagraph> 
<subparagraph id="H5664DD5CC861416AA80770D38BEFD1A6" commented="no"><enum>(C)</enum><header>No effect on Federal disposal policy</header><text display-inline="yes-display-inline">Nothing in this subsection affects the Federal responsibility for the disposal of high-level radioactive waste and spent nuclear fuel, or the definite Federal policy with regard to the disposal of such waste and spent fuel, established under subtitle A, as described in section 111(b).</text></subparagraph></paragraph></subsection> <subsection id="H0D3CCC3BCE6D456B85BE84EB232EFC1D"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H89440FC1D801483D9C82929ADA23A2A3"><enum>(1)</enum><header>Final repository decision</header><text display-inline="yes-display-inline">The term <term>final repository decision</term> means a final decision approving or disapproving the issuance of a construction authorization for a repository under section 114(d)(1).</text></paragraph> <paragraph id="HBCA4E3FE24A8427BA9588346E086CB29"><enum>(2)</enum><header>Initial MRS facility</header><text display-inline="yes-display-inline">The term <term>initial MRS facility</term> means the monitored retrievable storage facility with respect to which an MRS agreement is entered into pursuant to subsection (b)(1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDBDB7063AB374F80934EF3CA237D8E7D"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The item relating to section 143 in the table of contents for the Nuclear Waste Policy Act of 1982 is amended to read as follows:</text> <quoted-block style="OLC" id="H77E2B92AFE494F2DB04FBEA20CB1C443" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 143. <subsection id="HCC6D9FBA40BC482B820F6AFC34470822" commented="no"><enum>(b)</enum><header>Request for proposals</header><text>The Secretary shall issue a request for proposals for an MRS agreement authorized under section 142(b)(2) before conducting a survey and evaluation under subsection (a), and shall consider any proposals received in response to such request in making the evaluation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H74AEC047926944F6889D483F777F16F8"><enum>105.</enum><header>Site selection</header><text display-inline="no-display-inline">Section 145 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10165">42 U.S.C. 10165</external-xref>) is amended—</text> 
<paragraph id="H68ED9823992343C6B53A14E4DFB7FAA2"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HACB95680EEED4309AEA6C85E258121D2"><enum>(A)</enum><text>by striking <quote>select the site evaluated</quote> and inserting <quote>select a site evaluated</quote>;</text></subparagraph>

<subsection id="H695BDD505F2C4395B76566AFE7BF8490" commented="no"><enum>(a)</enum><header>Review of license application</header><text display-inline="yes-display-inline">Section 148(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10168">42 U.S.C. 10168(c)</external-xref>) is amended by striking <quote>section 142(b)</quote> and inserting <quote>section 142(b)(1)</quote>.</text></subsection> <subsection id="H4F067E17AB9F4C13AACCD9BCC8660A3E" commented="no"><enum>(b)</enum><header>Licensing conditions</header><text display-inline="yes-display-inline">Section 148(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10168">42 U.S.C. 10168(d)</external-xref>) is amended—</text>

<section id="H039FE12DC3F747E58560B94D0E08C41D" commented="no"><enum>108.</enum><header>Financial assistance</header><text display-inline="no-display-inline">Section 149 of the Nuclear Waste Policy Act of 1982 is amended by inserting <quote>authorized under section 142(b)(1)</quote> after <quote>a monitored retrievable storage facility</quote>.</text></section></title> <title id="HDB989E9C57AB48D7AD45E9B2BEE78EC9"><enum>II</enum><header>Permanent Repository</header> <section id="H8A333B2618F6464488A5ED4DCF21C2C5"><enum>201.</enum><header>Land withdrawal, jurisdiction, and reservation</header> <subsection id="H52D4A6C8AAC04CD689F2F5C03CC100C1"><enum>(a)</enum><header>Land withdrawal, jurisdiction, and reservation</header> <paragraph id="HDF24626465804DCBA7B974B45A652A05"><enum>(1)</enum><header>Land withdrawal</header><text display-inline="yes-display-inline">Subject to valid existing rights and except as provided otherwise in this section, the lands described in subsection (c) are withdrawn permanently from all forms of entry, appropriation, and disposal under the public land laws, including the mineral leasing laws, the geothermal leasing laws, and the mining laws.</text></paragraph> 
<paragraph id="H30BC76AA7C254F6F90E05619542A4FB6"><enum>(2)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, jurisdiction over the withdrawal is vested in the Secretary. There are transferred to the Secretary the lands within the withdrawal under the jurisdiction of the Secretary concerned on the effective date described in subsection (j)(1).</text></paragraph> <paragraph id="H183221C462D341C1BC2DC53D065FFA0B"><enum>(3)</enum><header>Reservation</header><text>The withdrawal is reserved for use by the Secretary for development, preconstruction testing and performance confirmation, licensing, construction, management and operation, monitoring, closure, postclosure, and other activities associated with the disposal of high-level radioactive waste and spent nuclear fuel under the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.).</text></paragraph></subsection> 
<subsection id="HB52E7AD4B8D14BFB9D96A95B91E3B8E9"><enum>(b)</enum><header>Revocation and modification of public land orders and rights-of-Way</header> 
<paragraph id="HEF3BDBD32B594ACB82981E75EF572A1F"><enum>(1)</enum><header>Public land order revocation</header><text display-inline="yes-display-inline">Public Land Order 6802 of September 25, 1990, as extended by Public Land Order 7534, and any conditions or memoranda of understanding accompanying those land orders, are revoked.</text></paragraph> <paragraph id="HB4ABAB2EEE3443A88BB4812352D81A05"><enum>(2)</enum><header>Right-of-way reservations</header><text>Project right-of-way reservations N–48602 and N–47748 of January 2001, are revoked.</text></paragraph></subsection> 
<subsection id="HB107BF869B464E4CAA275BE7EBC2DF2E"><enum>(c)</enum><header>Land description</header> 
<paragraph id="HB7411B2A3D07457BB5E57C73193BFCDE"><enum>(1)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The lands and interests in lands withdrawn and reserved by this section comprise the approximately 147,000 acres of land in Nye County, Nevada, as generally depicted on the Yucca Mountain Project Map, YMP–03–024.2, entitled <quote>Proposed Land Withdrawal</quote> and dated July 21, 2005.</text></paragraph> <paragraph id="H2B454A95EFF445DFB07FE6346A809F8F"><enum>(2)</enum><header>Legal description and map</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary of the Interior shall—</text> 
<subparagraph id="H27158F587FF7480FA30312A61BAF5EC2"><enum>(A)</enum><text>publish in the Federal Register a notice containing a legal description of the withdrawal; and</text></subparagraph> <subparagraph id="H084267E5508845E48FF6F9433403ACB3"><enum>(B)</enum><text>file copies of the maps described in paragraph (1) and the legal description of the withdrawal with the Congress, the Governor of the State of Nevada, and the Archivist of the United States.</text></subparagraph></paragraph> 
<paragraph id="H5379966A5EEE4264A2A267C5B276C36D"><enum>(3)</enum><header>Technical corrections</header><text>The maps and legal description referred to in this subsection have the same force and effect as if they were included in this section. The Secretary of the Interior may correct clerical and typographical errors in the maps and legal description.</text></paragraph></subsection> <subsection id="H89F89EBF83BA4EFCA272E10E8C6E8EDA" commented="no"><enum>(d)</enum><header>Relationship to other reservations</header><text>The provisions of subtitle A of title XXX of the Military Lands Withdrawal Act of 1999 (sections 3011–3023 of <external-xref legal-doc="public-law" parsable-cite="pl/106/65">Public Law 106–65</external-xref>) and of Public Land Order 2568 do not apply to the lands withdrawn and reserved for use by the Secretary under subsection (a). This Act does not apply to any other lands withdrawn for use by the Department of Defense under subtitle A of title XXX of the Military Lands Withdrawal Act of 1999.</text></subsection> 
<subsection id="H8E08F9E460A24BA4B41657FFEDFD7234"><enum>(e)</enum><header>Management responsibilities</header> 
<paragraph id="H0ADCA9F2D51F47E587DE95735A0A4744"><enum>(1)</enum><header>General authority</header><text display-inline="yes-display-inline">The Secretary shall manage the lands withdrawn by subsection (a) consistent with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.), this section, and other applicable law. The Secretary shall consult with the Secretary concerned in discharging that responsibility.</text></paragraph> <paragraph id="HE590B6F1D66C4EF4B696A71B8FAE5EBB"><enum>(2)</enum><header>Management plan</header> <subparagraph id="H8D0C87E046CB47D2976210B0A8AA12C6"><enum>(A)</enum><header>Development</header><text display-inline="yes-display-inline">The Secretary, after consulting with the Secretary concerned, shall develop a management plan for the use of the withdrawal. Within 3 years after the date of enactment of this Act, the Secretary shall submit the management plan to the Congress and the State of Nevada.</text></subparagraph> 
<subparagraph id="H4AFF3101BC694EAA8FE08AB8C71B6037"><enum>(B)</enum><header>Priority of Yucca Mountain Project-related issues</header><text>Subject to subparagraphs (C) and (D), any use of the withdrawal for activities not associated with the Project is subject to conditions and restrictions that the Secretary considers necessary or desirable to permit the conduct of Project-related activities.</text></subparagraph> <subparagraph id="H9FC8FCB45F1D4FF9B11BAC769407CF86"><enum>(C)</enum><header>Department of the Air Force uses</header><text>The management plan may provide for the continued use by the Department of the Air Force of the portion of the withdrawal within the Nellis Air Force Base Test and Training Range under terms and conditions on which the Secretary and the Secretary of the Air Force agree concerning Air Force activities.</text></subparagraph> 
<subparagraph id="H815D268C95D94624932063FCAD7B0C00"><enum>(D)</enum><header>Other non-Yucca-Mountain-Project uses</header><text>The management plan shall provide for the maintenance of wildlife habitat and shall provide that the Secretary may permit non-Project-related uses that the Secretary considers appropriate, including domestic livestock grazing and hunting and trapping in accordance with the following requirements:</text> <clause id="H8CD02C5FBCE0409786B4F6A4367C2767"><enum>(i)</enum><header>Grazing</header><text>The Secretary may permit grazing to continue where established before the effective date described in subsection (j)(1), subject to regulations, policies, and practices that the Secretary, after consulting with the Secretary of the Interior, determines to be necessary or appropriate. The management of grazing shall be conducted in accordance with applicable grazing laws and policies, including—</text> 
<subclause id="H5D19600F2B104F0787EA1E6EED47D989"><enum>(I)</enum><text>the Act commonly known as the <quote>Taylor Grazing Act</quote> (<external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315</external-xref> et seq.);</text></subclause> <subclause id="H2AECCE67392F497D8E3929B9100A1F75"><enum>(II)</enum><text>title IV of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1751">43 U.S.C. 1751</external-xref> et seq.); and</text></subclause> 
<subclause id="H436575508379474D87AA983883E0DC6A"><enum>(III)</enum><text>the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1901">43 U.S.C. 1901</external-xref> et seq.).</text></subclause></clause> <clause id="HF4051FC78989465F943BF2D351F324FB"><enum>(ii)</enum><header>Hunting and trapping</header><text display-inline="yes-display-inline">The Secretary may permit hunting and trapping within the withdrawal where established before the effective date described in subsection (k)(1), except that the Secretary, after consulting with the Secretary of the Interior and the State of Nevada, may designate zones where, and establish periods when, no hunting or trapping is permitted for reasons of public safety, national security, administration, or public use and enjoyment.</text></clause></subparagraph> 
<subparagraph id="H6A942568DB81406FAA4CF701FF52CED8"><enum>(E)</enum><header>Mining</header> 
<clause id="HA4F0BD4C37C240A8BB708A4CC21A018F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), surface or subsurface mining or oil or gas production, including slant drilling from outside the boundaries of the withdrawal, is not permitted at any time on lands on or under the withdrawal. The Secretary of the Interior shall evaluate and adjudicate the validity of all unpatented mining claims on the portion of the withdrawal that, on the date of enactment of this Act, was under the control of the Bureau of Land Management. The Secretary shall provide just compensation for the acquisition of any valid property right.</text></clause> <clause id="H2908EB6FD7484E0DAC13DC0F385DC70A" commented="no"><enum>(ii)</enum><header>Cind-R–Lite Mine</header><text display-inline="yes-display-inline">Patented Mining Claim No. 27–83–0002, covering the Cind–R–Lite Mine, shall not be affected by establishment of the withdrawal set forth in subsection (a)(1). In that event, the Secretary shall provide just compensation.</text></clause></subparagraph> 
<subparagraph id="H94FAB2B18D2C4B86AD4C2E4381D54740"><enum>(F)</enum><header>Limited public access</header><text display-inline="yes-display-inline">The management plan may provide for limited public access to the portion of the withdrawal under Bureau of Land Management control on the effective date described in subsection (j)(1). Permitted uses may include continuation of the Nye County Early Warning Drilling Program, utility corridors, and other uses the Secretary, after consulting with the Secretary of the Interior, considers consistent with the purposes of the withdrawal.</text></subparagraph></paragraph> <paragraph id="H7CEDF78D9A574A1390E2B25F135A7C46"><enum>(3)</enum><header>Closure</header><text>If the Secretary, after consulting with the Secretary concerned, determines that the health and safety of the public or the common defense and security require the closure of a road, trail, or other portion of the withdrawal, or the airspace above the withdrawal, the Secretary may effect and maintain the closure and shall provide notice of the closure.</text></paragraph> 
<paragraph id="HA2F321B9D29143A6AEFCB746053734EF"><enum>(4)</enum><header>Implementation</header><text>The Secretary and the Secretary concerned shall implement the management plan developed under paragraph (2) under terms and conditions on which they agree.</text></paragraph></subsection> <subsection id="HB2025A57A33F4F5488F7C2C6D7270DEA"><enum>(f)</enum><header>Immunity</header><text>The United States and its departments and agencies shall be held harmless and shall not be liable for damages to persons or property suffered in the course of any mining, mineral leasing, or geothermal leasing activity conducted on the withdrawal.</text></subsection> 
<subsection id="H1835A4FD7A6543FDB2BC318CE9CB383A" commented="no"><enum>(g)</enum><header>Land acquisition</header><text>The Secretary may acquire lands and interests in lands within the withdrawal. Those lands and interests in lands may be acquired by donation, purchase, lease, exchange, easement, rights-of-way, or other appropriate methods using donated or appropriated funds. The Secretary of the Interior shall conduct any exchange of lands within the withdrawal for Federal lands outside the withdrawal.</text></subsection> <subsection id="HDEC7C5E9815A43E3AFC0E40352039B61" commented="no"><enum>(h)</enum><header>Material requirements</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal, State, Interstate, or local requirement, either substantive or procedural, that is referred to in section 6001(a) of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6961">42 U.S.C. 6961(a)</external-xref>) applies with respect to any material—</text> 
<paragraph id="H55507815683942DC93245FA8F8780021" commented="no"><enum>(1)</enum><text>as such material is transported to a repository for disposal at such repository; or</text></paragraph> <paragraph id="HF77EAA38534C4A89A5614EE42FF685EE" commented="no"><enum>(2)</enum><text>as, or after, such material is disposed of in a repository.</text></paragraph></subsection> 
<subsection id="HE3CFF5162BCC4AEAB52E308CA5B350C5"><enum>(i)</enum><header>Definitions</header> 
<paragraph id="H6EC7488FC547429FAA9EC1CC0537BE3C" commented="no"><enum>(1)</enum><header>Nuclear Waste Policy Act of 1982 definitions</header><text display-inline="yes-display-inline">For purposes of this section, the terms <term>disposal</term>, <term>high-level radioactive waste</term>, <term>repository</term>, <term>Secretary</term>, and <term>spent nuclear fuel</term> have the meaning given those terms in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph> <paragraph id="HBFA7ABB1F2EC43FB88ED7EF4B9556BAE"><enum>(2)</enum><header>Other definitions</header><text>For purposes of this section—</text> 
<subparagraph id="HE3F026699A9B4B1382C4E4C54C0E6A65" commented="no"><enum>(A)</enum><text>the term <term>withdrawal</term> means the geographic area consisting of the land described in subsection (c);</text></subparagraph> <subparagraph id="H3B70689028294508AA0A60B995BE8151"><enum>(B)</enum><text>the term <term>Secretary concerned</term> means the Secretary of the Air Force or the Secretary of the Interior, or both, as appropriate; and</text></subparagraph> 
<subparagraph id="H0F7FC354BC9D42408FC14D79408A41EC"><enum>(C)</enum><text>the term <term>Project</term> means the Yucca Mountain Project.</text></subparagraph></paragraph></subsection> <subsection id="H9896F51693AE40CCB216212576B28923"><enum>(j)</enum><header>Effective date</header> <paragraph id="H36282B8B8008489E9D2AF7804D14A6BE" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), this section shall take effect on the date on which the Nuclear Regulatory Commission issues a final decision approving the issuance of a construction authorization for a repository under section 114(d)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) (as so designated by this Act).</text></paragraph> 
<paragraph id="H6B593ABCF4A84D259F3860EF71785DC7"><enum>(2)</enum><header>Exceptions</header><text>Subsections (c), (e)(2)(A), (h), (i), and (j) shall take effect on the date of enactment of this Act.</text></paragraph></subsection></section> <section id="H2173107D69BB47FFB3838C1631EE9906"><enum>202.</enum><header>Application procedures and infrastructure activities</header> <subsection id="HB975D2DB9EA9401A8A7ECFA3D4DDEB73"><enum>(a)</enum><header>Status report on application</header><text display-inline="yes-display-inline">Section 114(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(c)</external-xref>) is amended by striking <quote>the date on which such authorization is granted</quote> and inserting <quote>the date on which the Commission issues a final decision approving or disapproving such application</quote>. </text></subsection> 
<subsection id="HCBA9B31D5176400E9C7026FFB15C51B1"><enum>(b)</enum><header>Application procedures and infrastructure activities</header><text display-inline="yes-display-inline">Section 114(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) is amended—</text> <paragraph id="H58564D6FBEA0422B93CEA87DC8ECE795"><enum>(1)</enum><text>by striking <quote>The Commission shall consider</quote> and inserting the following: </text>

<paragraph id="H79D1F480D8424A028C4D1DBA38E90814"><enum>(1)</enum><header>Applications for construction authorization</header><text display-inline="yes-display-inline">The Commission shall consider</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H5BC9DD7FAFDA4459BA9EE04D27B37A5B" commented="no"><enum>(2)</enum><text>by striking <quote>the expiration of 3 years after the date of the submission of such application</quote> and inserting <quote>30 months after the date of enactment of the <short-title>Nuclear Waste Policy Amendments Act of 2017</short-title></quote>; </text></paragraph> 
<paragraph id="H4747A54394E74DA8B54879EDE8B7A8CE"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>70,000 metric tons</quote> each place it appears and inserting <quote>110,000 metric tons</quote>; and </text></paragraph> <paragraph id="HC1EA803A9C124880938D163F80A924EA"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" id="HB669EAB1ACB1400BBA5BA963BE456849" display-inline="no-display-inline"> 
<paragraph id="HECA4F5F5632D4E16BAA23A25082A8F0D" commented="no"><enum>(2)</enum><header>Applications to amend</header><text display-inline="yes-display-inline">If the Commission issues a construction authorization for a repository pursuant to paragraph (1) and the Secretary submits an application to amend such authorization, the Commission shall consider the application to amend using expedited, informal procedures, including discovery procedures that minimize the burden on the parties to produce documents. The Commission shall issue a final decision on such application to amend within 1 year after the date of submission of such application, except that the Commission may extend such deadline by not more than 6 months if, not less than 30 days before such deadline, the Commission complies with the reporting requirements established in subsection (e)(2).</text></paragraph> <paragraph id="H2131F5EF04094CC9AF2AAB01B114F662"><enum>(3)</enum><header>Infrastructure activities</header> <subparagraph id="H10B08C8AB55A4779A9F4564780BA71FB" display-inline="no-display-inline" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">At any time before or after the Commission issues a final decision approving or disapproving the issuance of a construction authorization for a repository pursuant to paragraph (1), the Secretary may undertake infrastructure activities that the Secretary considers necessary or appropriate to support construction or operation of a repository at the Yucca Mountain site or transportation to such site of spent nuclear fuel and high-level radioactive waste. Infrastructure activities include safety upgrades, site preparation, the construction of a rail line to connect the Yucca Mountain site with the national rail network (including any facilities to facilitate rail operations), and construction, upgrade, acquisition, or operation of electrical grids or facilities, other utilities, communication facilities, access roads, and nonnuclear support facilities.</text></subparagraph> 
<subparagraph id="H9DE9B88A5448455BA6E969E2E24B5ECD" commented="no"><enum>(B)</enum><header>Environmental analysis</header><text>If the Secretary determines that an environmental analysis is required under the National Environmental Policy Act of 1969 with respect to an infrastructure activity undertaken under this paragraph, the Secretary need not consider alternative actions or a no-action alternative. To the extent any other Federal agency must consider the potential environmental impact of such an infrastructure activity, the agency shall adopt, to the extent practicable, any environmental analysis prepared by the Secretary under this subparagraph without further action. Such adoption satisfies the responsibilities of the adopting agency under the National Environmental Policy Act of 1969, and no further action is required by the agency.</text></subparagraph> <subparagraph id="H8CEBFCA7EE4544589A0A0E23A988EA29" commented="no"><enum>(C)</enum><header>No grounds for disapproval</header><text>The Commission may not disapprove, on the grounds that the Secretary undertook an infrastructure activity under this paragraph—</text> 
<clause id="HEF70DAEC2D424042B74B30ED83782705" commented="no"><enum>(i)</enum><text>the issuance of a construction authorization for a repository pursuant to paragraph (1);</text></clause> <clause id="HBAA459BDFA864964948B93CD3593E441" commented="no"><enum>(ii)</enum><text>a license to receive and possess spent nuclear fuel and high-level radioactive waste; or</text></clause> 
<clause id="HE56605C2653D4CE98DBDE0CEA0D41C39" commented="no"><enum>(iii)</enum><text>any other action concerning the repository.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6C146B1726AF4432AF7735B49B783106"><enum>(c)</enum><header>Connected actions</header><text display-inline="yes-display-inline">Section 114(f)(6) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(f)(6)</external-xref>) is amended by striking <quote>or nongeologic alternatives to such site</quote> and inserting <quote>nongeologic alternatives to such site, or an action connected or otherwise related to the repository to the extent the action is undertaken outside the geologic repository operations area and does not require a license from the Commission</quote>.</text></subsection></section> 
<section id="H02B4FC6A510F4C8095CCE23227ED98A1"><enum>203.</enum><header>Pending repository license application</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to require the Secretary to amend or otherwise modify an application for a construction authorization described in section 114(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) pending as of the date of enactment of this Act.</text></section> <section id="H2686A25A309240D3898251D9FDC54896" commented="no"><enum>204.</enum><header>Limitation on planning, development, or construction of defense waste repository</header> <subsection id="H4296140C686843F3AFF9A921226F8F93" commented="no"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary of Energy may not take any action relating to the planning, development, or construction of a defense waste repository until the date on which the Nuclear Regulatory Commission issues a final decision approving or disapproving the issuance of a construction authorization for a repository under section 114(d)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) (as so designated by this Act).</text></subsection> 
<subsection id="HC0397538C37549ADB59FC1CA01C18D45" commented="no"><enum>(b)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H233AF7BF9F8A4FA08DFF8DA3063FF08E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>atomic energy defense activity</term>, <term>high-level radioactive waste</term>, <term>repository</term>, and <term>spent nuclear fuel</term> have the meanings given those terms in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>); and</text></paragraph> 
<paragraph id="H71D580C5234549BAACB99BE128B99DE2" commented="no"><enum>(2)</enum><text>the term <term>defense waste repository</term> means the repository for high-level radioactive waste and spent nuclear fuel derived from the atomic energy defense activities of the Department of Energy, as described in the draft plan of the Department titled <quote>Draft Plan for a Defense Waste Repository</quote> published on December 16, 2016.</text></paragraph></subsection></section> <section id="H1131D971A2E04B3DA5319A209FCEC99D" commented="no"><enum>205.</enum><header>Sense of Congress regarding transportation routes</header><text display-inline="no-display-inline"> It is the sense of Congress that the Secretary of Energy should consider routes for the transportation of spent nuclear fuel or high-level radioactive waste transported by or for the Secretary under subtitle A of title I of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10131">42 U.S.C. 10131</external-xref> et seq.) to the Yucca Mountain site that, to the extent practicable, avoid Las Vegas, Nevada. </text></section></title> 
<title id="HE76477FD2EF04C458E1CA638E4546CE7"><enum>III</enum><header>DOE Contract Performance</header> 
<section id="H604DECD050644AC88F2344D90B6F0BAB"><enum>301.</enum><header>Title to material</header><text display-inline="no-display-inline">Section 123 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10143">42 U.S.C. 10143</external-xref>) is amended—</text> <paragraph id="H2BB44DA1B4EF41BCBD976DAF5788F6AE" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Delivery</quote> and inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a) </enum-in-header>In general.—</header-in-text>Delivery</quote>;</text></paragraph>

<subsection id="H515DADBDC6E24F2F996E859550231176" commented="no"><enum>(b)</enum><header>Contract modification</header><text display-inline="yes-display-inline">The Secretary may enter into new contracts or negotiate modifications to existing contracts, with any person who generates or holds title to high-level radioactive waste or spent nuclear fuel of domestic origin, for acceptance of title, subsequent transportation, and storage of such high-level radioactive waste or spent nuclear fuel (including to expedite such acceptance of title, transportation, and storage of such waste or fuel from facilities that have ceased commercial operation) at a monitored retrievable storage facility authorized under subtitle C.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> <title id="H529D20E3BEAF4117A87A507619B01CF7"><enum>IV</enum><header>Benefits to Host Community</header> <section id="HC816156B5A6F4CAFAAF40648C4AAD6CA"><enum>401.</enum><header>Consent</header><text display-inline="no-display-inline">Section 170 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10173">42 U.S.C. 10173</external-xref>) is amended—</text>

<subsection id="H0AB594A9E5D549E2B396139C507C6508"><enum>(g)</enum><header>Consent</header><text display-inline="yes-display-inline">The acceptance or use of any of the benefits provided under a benefits agreement under this section by the State of Nevada shall not be considered to be an expression of consent, express or implied, to the siting of a repository in such State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H6A3E594AC5394E45B75CA0715AE64F7D"><enum>402.</enum><header>Content of agreements</header> <subsection id="HEAE42BE53CB541BBB6E7BEE92D221F97" commented="no"><enum>(a)</enum><header>Benefits schedule</header><text display-inline="yes-display-inline">The table in section 171(a)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10173a">42 U.S.C. 10173a(a)(1)</external-xref>) is amended to read as follows:</text>

<section id="HE7E7E243615B4FE68E04BCE5510CC6B6"><enum>403.</enum><header>Covered units of local government</header> 
<subsection id="H243915C061E94545911F5AF57D4FDCA9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.) is amended by inserting after section 172 the following new section:</text> <quoted-block style="OLC" id="H1131F405FAC643959AA2124C1F6F4170" display-inline="no-display-inline"> <section id="HFEF8319032C4461EA5C0A6F891355CDA"><enum>172A.</enum><header>Covered units of local government</header> <subsection id="HA46139809DE34F9781BA96402356278B"><enum>(a)</enum><header>Benefits agreement</header><text display-inline="yes-display-inline">Not earlier than 1 year after the date of enactment of this section, the Secretary may enter into a benefits agreement with any covered unit of local government concerning a repository for the acceptance of high-level radioactive waste or spent nuclear fuel in the State of Nevada.</text></subsection> 
<subsection id="HDC68C20D31A1447DBF078F820A29DD40"><enum>(b)</enum><header>Content of agreements</header><text display-inline="yes-display-inline">In addition to any benefits to which a covered unit of local government is entitled under this Act, the Secretary shall make payments to such covered unit of local government that is a party to a benefits agreement under subsection (a) to mitigate impacts described in section 175(b).</text></subsection> <subsection id="HF9768479D2024128AAADB2C020E0441B"><enum>(c)</enum><header>Payments from Waste Fund</header><text display-inline="yes-display-inline">The Secretary shall make payments to a covered unit of local government under a benefits agreement under this section from the Waste Fund.</text></subsection> 
<subsection id="H6F668650E4A7434CB59A212376A27634"><enum>(d)</enum><header>Restriction on use</header><text display-inline="yes-display-inline">None of the payments made pursuant to a benefits agreement under this section may be used—</text> <paragraph id="H45E69EFC7E304BE189979A28413BAFE0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">directly or indirectly to influence legislative action on any matter pending before Congress or a State legislature or for any lobbying activity as provided in section 1913 of title 18, United States Code;</text></paragraph> 
<paragraph id="HF52CA25072BD4970A6B550C75D087339"><enum>(2)</enum><text>for litigation purposes; or</text></paragraph> <paragraph id="HE5C301186C09481B921143F7AA6AB766" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">to support multistate efforts or other coalition-building activities inconsistent with the siting, construction, or operation of the repository.</text></paragraph></subsection> 
<subsection id="H326E56EBC8034A2D8F283D1780C22774" commented="no"><enum>(e)</enum><header>Consent</header><text display-inline="yes-display-inline">The acceptance or use of any of the benefits provided under a benefits agreement under this section by any covered unit of local government shall not be considered to be an expression of consent, express or implied, to the siting of a repository in the State of Nevada.</text></subsection> <subsection id="H26A85CE70CB6432FAED69B6934D9BDF9"><enum>(f)</enum><header>Covered unit of local government defined</header><text>In this section, the term <term>covered unit of local government</term> means—</text> 
<paragraph id="H7F7CB86AC9CE4850841218874A584714"><enum>(1)</enum><text>any affected unit of local government with respect to a repository; and</text></paragraph> <paragraph id="H045CF7D16F2F462F8D1B27E366BB3873"><enum>(2)</enum><text>any unit of general local government in the State of Nevada.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HE5C02103C5DA40B5AA107084E654B014" commented="no"><enum>(1)</enum><header>Benefits agreement</header><text display-inline="yes-display-inline">Section 170(a)(4) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10173">42 U.S.C. 10173(a)(4)</external-xref>) is amended—</text> <subparagraph id="H2429D472B1914EB6B8DDAD51C2B60D14" commented="no"><enum>(A)</enum><text>by inserting <quote>made available pursuant to a benefits agreement under this section</quote> after <quote>under this subtitle</quote>; and</text></subparagraph>

<subsection id="H11E199CC1D894DB28F43E64C2F5031AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle G of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10174">42 U.S.C. 10174</external-xref> et seq.) is amended by adding at the end the following new section: </text> <quoted-block style="OLC" id="H69D3D22EF7DD4B5390CEEECCC6145E98" display-inline="no-display-inline"> <section id="HE5300B1C2B9F4D4A8ED46079468FAE29" commented="no"><enum>176.</enum><header>Priority funding for certain institutions of higher education<editorial></editorial></header> <subsection id="HCFFBF86D005F43C99442391F3CD58D95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In providing any funding to institutions of higher education from the Waste Fund, the Secretary shall prioritize institutions of higher education that are located in the State of Nevada.</text></subsection>

<clause id="H25106DE7E994461C92CC7A0CDFC93E3E" commented="no"><enum>(iii)</enum><header>Payment of full amounts</header><text>Notwithstanding the noncollection of a fee by the Secretary pursuant to clause (ii) in any fiscal year, a person who has entered into a contract with the Secretary under this subsection shall pay any uncollected amounts when determined necessary by the Secretary, subject to clause (ii), for purposes described in subsection (d). </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2D42078F0E504AB4B50475EE227C7B58" commented="no"><enum>(b)</enum><header>Authority To modify contracts</header><text display-inline="yes-display-inline">The Secretary of Energy may seek to modify a contract entered into under section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) before the date of enactment of this Act to ensure that the contract complies with the provisions of such section, as amended by this Act.</text></subsection>

<section id="H55A264C5C48A44DB89E8230E543FAD8E"><enum>502.</enum><header>Use of Waste Fund</header> 
<subsection id="HC4E5F18DC6EE4B4EAD2879775D75FB56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 302(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(d)</external-xref>) is amended—</text> <paragraph id="H964B25B5A2E54226AF6CA5C68B9A1109"><enum>(1)</enum><text>in paragraph (1), by striking <quote>maintenance and monitoring</quote> and all that follows through the semicolon at the end and inserting <quote>maintenance and monitoring of any repository or test and evaluation facility constructed under this Act;</quote>;</text></paragraph> 
<paragraph id="H442A5E4BCAC8400DBF8E99879E5E0EA9"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>to be disposed of</quote> and all that follows through the semicolon at the end and inserting <quote>to be disposed of in a repository or to be used in a test and evaluation facility;</quote>; </text></paragraph> <paragraph id="H97D5FA5BA7044DB39668CB3F45DA3AFE"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>at a repository site</quote> and all that follows through the end and inserting <quote>at a repository site or a test and evaluation facility site and necessary or incident to such repository or test and evaluation facility;</quote>; </text></paragraph>

<section id="HC1B1D39E75A54B96AA1386A9B0550E75" commented="no"><enum>503.</enum><header>Annual multiyear budget proposal</header><text display-inline="no-display-inline">Section 302(e)(2) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(e)(2)</external-xref>) is amended by striking <quote>triennially</quote> and inserting <quote>annually</quote>.</text></section> <section id="H31BC07B4CEDB4A8BBD376DEBD5EAFAFD"><enum>504.</enum><header>Availability of certain amounts</header><text display-inline="no-display-inline">Section 302 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HF07A45DDCEAF46A69ED66D6A985B4C58"><enum>(f)</enum><header>Availability of certain amounts</header> 
<paragraph id="H5384B3AC22134E759C4295C5EB21B5CA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, for the purposes described in subsection (d) that are specified in subparagraphs (A) through (E) of this paragraph, the following amounts from the Waste Fund shall be available to the Secretary without further appropriation:</text> <subparagraph id="H61D7C2B604E442B18CAC299ADDC1F536" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">An amount equal to 1 percent of 2017 Waste Fund amounts, on the date on which high-level radioactive waste or spent nuclear fuel is received at the Yucca Mountain site, and in each of the 25 years thereafter, for costs associated with construction and operation of a repository or facilities at the Yucca Mountain site.</text></subparagraph> 
<subparagraph id="H6E4EB341E2734832A1A2E7820EF24136" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">An amount equal to 1 percent of 2017 Waste Fund amounts, on the date on which high-level radioactive waste or spent nuclear fuel is received at the Yucca Mountain site, to make payments under a benefits agreement entered into under section 170 with the State of Nevada concerning a repository.</text></subparagraph> <subparagraph id="H5DD4CB0E78A344CCB9CAC8C83033EDF9" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">An amount equal to 0.1 percent of 2017 Waste Fund amounts, on the date that is one year after the date on which high-level radioactive waste or spent nuclear fuel is received at the Yucca Mountain site, and in each year thereafter until closure of the repository, to make payments under a benefits agreement entered into under section 170 with the State of Nevada concerning a repository.</text></subparagraph> 
<subparagraph id="H2C61AECF5C6A4222A1547F54AD9F9125" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">An amount equal to 20 percent of 2017 Waste Fund amounts, on the date on which monitoring of the repository during the decommissioning period commences, for waste package and drip shield fabrication activities.</text></subparagraph> <subparagraph id="H661C46A92B134B66BA9BE4E745644A59" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">An amount equal to the amount of any fee collected pursuant to subsection (a)(3) after the date of enactment of the <short-title>Nuclear Waste Policy Amendments Act of 2017</short-title>, on the date on which such fee is collected, for costs associated with construction and operation of a repository or facilities at the Yucca Mountain site.</text></subparagraph></paragraph> 
<paragraph id="HB9E3494717254132B8D89E076F1F42FE"><enum>(2)</enum><header>2017 Waste Fund amounts</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>2017 Waste Fund amounts</term> means the amounts in the Waste Fund on the date of enactment of the <short-title>Nuclear Waste Policy Amendments Act of 2017</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title> <title id="HD9858B42367D40E991B2A710DE9B5719"><enum>VI</enum><header>Miscellaneous</header> <section id="H4732A181EA2A48A3AACB661DC4D9C5F7" commented="no"><enum>601.</enum><header>Certain standards and criteria</header> <subsection id="H50715042167747198BFE7D65577D8CC7" commented="no"><enum>(a)</enum><header>Generally applicable standards and criteria</header> <paragraph id="H842C5692326C45DAA1F43BDBEC6876B3" commented="no"><enum>(1)</enum><header>Environmental Protection Agency standards</header> <subparagraph id="H4D112C392F0B4E5ABC4D3DBC9B0BCE3E" commented="no"><enum>(A)</enum><header>Determination and report</header><text display-inline="yes-display-inline">Not later than 2 years after the Nuclear Regulatory Commission has issued a final decision approving or disapproving the issuance of a construction authorization for a repository under section 114(d)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) (as so designated by this Act), the Administrator of the Environmental Protection Agency shall—</text> 
<clause id="H0D17030FD75B42B084E5894323158832" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">determine if the generally applicable standards promulgated under section 121(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10141">42 U.S.C. 10141(a)</external-xref>) should be updated; and</text></clause> <clause id="H471E7ACF34584FF79E5A0E0626F45BC4" commented="no"><enum>(ii)</enum><text>submit to Congress a report on such determination. </text></clause></subparagraph> 
<subparagraph id="H0D12FA59C0D2497B925447E0D5FB9121" commented="no"><enum>(B)</enum><header>Rule</header><text display-inline="yes-display-inline">If the Administrator of the Environmental Protection Agency determines, under subparagraph (A), that the generally applicable standards promulgated under section 121(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10141">42 U.S.C. 10141(a)</external-xref>) should be updated, the Administrator, not later than 2 years after submission of the report under subparagraph (A)(ii), shall, by rule, promulgate updated generally applicable standards under such section.</text></subparagraph></paragraph> <paragraph id="H1C9E3E694F11427FBE5DA0E4FD551148" commented="no"><enum>(2)</enum><header>Commission requirements and criteria</header><text>Not later than 2 years after the Administrator of the Environmental Protection Agency promulgates updated generally applicable standards pursuant to paragraph (1)(B), the Commission shall, by rule, promulgate updated technical requirements and criteria under section 121(b) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10141">42 U.S.C. 10141(b)</external-xref>) as necessary to be consistent with such updated generally applicable standards.</text></paragraph></subsection> 
<subsection id="HDEB7FF901C214E20B98F56B7A5230059" commented="no"><enum>(b)</enum><header>Site-Specific standards and criteria</header><text display-inline="yes-display-inline">Nothing in this section shall affect the standards, technical requirements, and criteria promulgated by the Administrator of the Environmental Protection Agency and the Nuclear Regulatory Commission for the Yucca Mountain site under section 801 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/10141">42 U.S.C. 10141</external-xref> note). </text></subsection></section> <section id="HF2DB6A108CF34D9591DB80C6446E177C"><enum>602.</enum><header>Application</header><text display-inline="no-display-inline">Section 135 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10155">42 U.S.C. 10155</external-xref>) is amended by striking subsection (h) and redesignating subsection (i) as subsection (h).</text></section> 
<section id="HB26FA33F7623406C83D23D48E00987FF" section-type="subsequent-section"><enum>603.</enum><header>Transportation safety assistance</header><text display-inline="no-display-inline">Section 180(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10175">42 U.S.C. 10175(c)</external-xref>) is amended—</text> <paragraph id="H6872E3125EFB4A45872CC3416E67F1A7"><enum>(1)</enum><text>by striking <quote>(c) The Secretary</quote> and inserting the following:</text>

<section id="H608E2B27A7094A488760A8E7271E685C" commented="no"><enum>604.</enum><header>Office of Civilian Radioactive Waste Management</header> 
<subsection id="H56F7E045D5BC4171AA0BAEC3C2F453F2" commented="no"><enum>(a)</enum><header>Amendment to the Nuclear Waste Policy Act of 1982</header><text display-inline="yes-display-inline">Subsection (b) of section 304 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10224">42 U.S.C. 10224(b)</external-xref>) is amended to read as follows: </text> <quoted-block style="OLC" id="H306A726DB2D844D3BD4CF7EBFC4B2B0D" display-inline="no-display-inline"> <subsection id="HC3C00412E5D14FFD9B303D0EC0E622FD" commented="no"><enum>(b)</enum><header>Director</header> <paragraph id="H2755F01945ED40A5946B372CDBCE33F9" commented="no"><enum>(1)</enum><header>Functions</header><text display-inline="yes-display-inline">The Director of the Office shall be responsible for carrying out the functions of the Secretary under this Act. The Director of the Office shall report directly to the Secretary.</text></paragraph> 
<paragraph id="H91EFCF86184E41AFA372E15CAD267342" commented="no"><enum>(2)</enum><header>Qualifications</header><text>The Director of the Office shall be appointed from among persons who have extensive expertise and experience in organizational and project management.</text></paragraph> <paragraph id="H075773D89DCA450D8991070286E7042A" commented="no"><enum>(3)</enum><header>Tenure</header><text>The Director of the Office may serve not more than two 5-year terms.</text></paragraph> 
<paragraph id="H92DDFCA928CB475799E6B2353B61349B"><enum>(4)</enum><header>Service during interim period</header><text>Upon expiration of the Director’s term, the Director may continue to serve until the earlier of—</text> <subparagraph id="H7337AF3735EB45BAB8BC4B6F17AA037D"><enum>(A)</enum><text>the date on which a new Director is confirmed; or</text></subparagraph> 
<subparagraph id="HC5966F52375943EEB5B933B8EA11B706"><enum>(B)</enum><text>the date that is one year after the date of such expiration.</text></subparagraph></paragraph> <paragraph id="H484D2045EDFD4BD38F9063ABC60D6F03"><enum>(5)</enum><header>Removal</header><text display-inline="yes-display-inline">The President may remove the Director only for inefficiency, neglect of duty, or malfeasance in office. If the President removes the Director, the President shall submit to Congress a statement explaining the reason for such removal.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HF88C560420E74856B54C33FCF3056CAF"><enum>(1)</enum><header>Amendment</header><text>Section 203(a) of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7133">42 U.S.C. 7133(a)</external-xref>) is amended by striking paragraph (8).</text></paragraph> <paragraph id="H1420BBC88D204BB9ACF26651DA8C3A1A"><enum>(2)</enum><header>Transfer of functions</header><text display-inline="yes-display-inline">The functions described in the paragraph (8) stricken by the amendment made by paragraph (1) shall be transferred to and performed by the Office of Civilian Radioactive Waste Management, as provided in section 304 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10224">42 U.S.C. 10224</external-xref>).</text></paragraph></subsection> 
<subsection id="H0B08BA37FB3B42489294A5F2DC7DDF8D" commented="no"><enum>(c)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 2(17) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101(17)</external-xref>) is amended by striking <quote>section 305</quote> and inserting <quote>section 304</quote>.</text></subsection></section> <section id="H1B5DACE000BF402F85E6B66053180960" section-type="subsequent-section"><enum>605.</enum><header>West Lake Landfill</header><text display-inline="no-display-inline">Not later than one year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a report containing the final remedy to be implemented at the West Lake Landfill and the expected timeline for implementation of such final remedy.</text></section> 
<section id="HAA586ABA23B4468DA247AD75DDE2FB7C"><enum>606.</enum><header>Subseabed or ocean water disposal</header> 
<subsection id="H7178AE3514DF4EAF88BA098CD1FAAF66"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 5 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10104">42 U.S.C. 10104</external-xref>) is amended—</text> <paragraph id="H8A9E03F7F266436F8239FCF331634487"><enum>(1)</enum><text>by striking <quote>Nothing in this Act </quote> and inserting:</text>

<paragraph id="H254972D5C36F4C088A4EE3EC2A9F61C2"><enum>(2)</enum><text>no funds shall be obligated for any activity relating to the subseabed or ocean water disposal of spent nuclear fuel or high-level radioactive waste.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5B2F9914748247519AFD26A882F7D8EF"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 224 of the Nuclear Waste Policy Act of 1982, and the item relating thereto in the table of contents for such Act, are repealed.</text></subsection></section>
