<section id="H3F065DB26AE34DFE80ADB91EE692E301" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regulatory Certainty Act of 2017</short-title></quote>.</text></section> <section id="H8DEEA23C8154453D9771963E3753A65F"><enum>2.</enum><header>Permits for dredged or fill material</header> <subsection id="H6EDB3F66AC9642FBA5DF82CC06482652"><enum>(a)</enum><header>In general</header><text>Section 404(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344(c)</external-xref>) is amended—</text> 
<paragraph id="HDF5B8DB480EF446CA03A486221CF8B31"><enum>(1)</enum><text>by striking <quote>(c)</quote> and inserting <quote>(c)(1)</quote>;</text> </paragraph> <paragraph id="H4862B208D9534ACE9AA5C1C4ED5F9293"><enum>(2)</enum><text>in paragraph (1), as so designated, by inserting <quote>during the period described in paragraph (2) and</quote> before <quote>after notice and opportunity for public hearings</quote>; and</text> </paragraph>
<paragraph id="HB63C0933EBA44B828111733940D6CE78"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HC716686D8D4C4F819372E7A3C4E02BBB" style="OLC"> <paragraph id="H4C8DDE9981F94EA396D2CEF15C6BE896"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H5F9854A675FF4218B08E3C659E0D4735"><enum>(A)</enum><text>The period during which the Administrator may prohibit the specification (including the withdrawal of specification) of any defined area as a disposal site, or deny or restrict the use of any defined area for specification (including the withdrawal of specification) as a disposal site, under paragraph (1) shall—</text> 
<clause id="H7D9449DADD6449628BDC6E59825EC94F" indent="up1"><enum>(i)</enum><text>begin on the date that the Secretary provides notice to the Administrator that the Secretary has completed all procedures for processing an application for a permit under this section relating to the specification and is ready to determine, in accordance with the record and applicable regulations, whether the permit should be issued; and</text> </clause> <clause id="HA932474FA511448F9010B444279DF33C" indent="up1"><enum>(ii)</enum><text>end on the date that the Secretary issues the permit.</text> </clause></subparagraph>
<subparagraph id="H2B91DDE9948E47308A0CD7312D634714" indent="up1"><enum>(B)</enum><text>The Secretary shall ensure that the period described in subparagraph (A) consists of not fewer than 30 consecutive days.</text> </subparagraph> <subparagraph id="H009CB31B8CEE4C0DA70F9E015B24A367" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary may issue a permit under this section only after the Secretary provides notice to the Administrator in accordance with this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="HD1728627943D4859BA27472C567AFBB0"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to a permit application submitted under section 404(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344(a)</external-xref>) after the date of enactment of this Act.</text> </subsection></section> </legis-body></bill>
