<section id="H08F2DB2B580A45DEBCC635F0DC1211EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Closed-Loop Pumped Storage Hydropower Act</short-title></quote>.</text> </section> <section id="H99566CE2079D48D8AA6F0F2853D71ECE"><enum>2.</enum><header>Closed-loop pumped storage projects</header><text display-inline="no-display-inline">Part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792</external-xref> et seq.) is amended by adding at the end the following:</text>

<section id="HE1B86B6F769341099F591A65BDDBC8E9"><enum>34.</enum><header>Closed-loop pumped storage projects</header> 
<subsection commented="no" id="H3640B1A7F6DB449EBAA3C3E0D8139CEF"><enum>(a)</enum><header>Expedited licensing process for closed-Loop pumped storage projects</header> 
<paragraph commented="no" id="H58757DA8582A4A6D828506986E74EAD6"><enum>(1)</enum><header>In general</header><text>As provided in this section, the Commission may issue and amend licenses and preliminary permits, as appropriate, for closed-loop pumped storage projects.</text> </paragraph> <paragraph commented="no" id="HEED45E4B4606419A9BBEF355FB1BCB6A"><enum>(2)</enum><header>Rule</header><text>Not later than 180 days after the date of enactment of this section, the Commission shall issue a rule establishing an expedited process for issuing and amending licenses and preliminary permits for closed-loop pumped storage projects under this section.</text> </paragraph> 
<paragraph commented="no" id="H22CCFE11A5954436892173E6C7DA6EBD"><enum>(3)</enum><header>Interagency Task Force</header><text>In establishing the expedited process under this section, the Commission shall convene an interagency task force, with appropriate Federal and State agencies and Indian tribes represented, to coordinate the regulatory processes associated with the authorizations required to construct and operate closed-loop pumped storage projects.</text> </paragraph> <paragraph commented="no" id="H81B5325D991D46A5ABC0ABBCB800CA82"><enum>(4)</enum><header>Length of Process</header><text>The Commission shall ensure that the expedited process under this section will result in final decision on an application for a license by not later than 2 years after receipt of a completed application for such license.</text> </paragraph></subsection> 
<subsection id="HAD9C99BC16044FAF85F0D405084DD296"><enum>(b)</enum><header>Dam safety</header><text>Before issuing any license for a closed-loop pumped storage project, the Commission shall assess the safety of existing dams and other structures related to the project (including possible consequences associated with failure of such structures).</text> </subsection> <subsection commented="no" id="H9AFF37A10CB140C9BD76EBE35AD72F5F"><enum>(c)</enum><header>Exemptions from other requirements</header> <paragraph commented="no" id="H60936F4ED3904A5D98AB26810D30E8B2"><enum>(1)</enum><header>In general</header><text>In issuing or amending a license or preliminary permit pursuant to the expedited process established under this section, the Commission may grant an exemption from any other requirement of this part with respect to any part of the closed-loop pumped storage project (not including any dam or other impoundment).</text> </paragraph> 
<paragraph commented="no" id="H93755796BE7B4062A30E44A66913EEF2"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In granting an exemption under paragraph (1), the Commission shall consult with the United States Fish and Wildlife Service and the State agency exercising administration over the fish and wildlife resources of the State in which the closed-loop pumped storage project is or will be located, in the manner provided by the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661</external-xref> et seq.).</text> </paragraph> <paragraph commented="no" id="HEAC51348D04C4EC8967233A08CE4A4BE"><enum>(3)</enum><header>Terms and conditions</header><text>In granting an exemption under paragraph (1), the Commission shall include in any such exemption—</text> 
<subparagraph commented="no" id="H006815CC182240DE8A02F011DDC9EB4C"><enum>(A)</enum><text>such terms and conditions as the Fish and Wildlife Service, National Marine Fisheries Service, and the State agency described in paragraph (2) each determine are appropriate to prevent loss of, or damage to, fish and wildlife resources and to otherwise carry out the purposes of the Fish and Wildlife Coordination Act; and</text> </subparagraph> <subparagraph commented="no" id="H1ADA262663274B9A88C188D2BDA38BCA"><enum>(B)</enum><text>such terms and conditions as the Commission deems appropriate to ensure that such closed-loop pumped storage project continues to comply with the provisions of this section and terms and conditions included in any such exemption.</text> </subparagraph></paragraph> 
<paragraph id="H8C878596C6034CE29DB68E99963AD13A"><enum>(4)</enum><header>Fees</header><text display-inline="yes-display-inline">The Commission, in addition to the requirements of section 10(e), shall establish fees which shall be paid by an applicant for a license for a closed-loop pumped storage project that is required to meet terms and conditions set by fish and wildlife agencies under paragraph (3). Such fees shall be adequate to reimburse the fish and wildlife agencies referred to in paragraph (3) for any reasonable costs incurred in connection with any studies or other reviews carried out by such agencies for purposes of compliance with this section. The fees shall, subject to annual appropriations Acts, be transferred to such agencies by the Commission for use solely for purposes of carrying out such studies and shall remain available until expended.</text> </paragraph></subsection> <subsection id="H9346C8726ADE40CC92B1620EBF7A73ED"><enum>(d)</enum><header>Transfers</header><text display-inline="yes-display-inline">Notwithstanding section 5, and regardless of whether the holder of a preliminary permit for a closed-loop pumped storage project claimed municipal preference under section 7(a) when obtaining the permit, the Commission may, to facilitate development of a closed-loop pumped storage project—</text> 
<paragraph id="HAB3FF9869A0148C6B44EC1C3DE2B5019"><enum>(1)</enum><text>add entities as joint permittees following issuance of a preliminary permit; and</text> </paragraph> <paragraph commented="no" id="H00E91D17EA444B9185EAAA3C9EC07AAB"><enum>(2)</enum><text display-inline="yes-display-inline">transfer a license in part to one or more nonmunicipal entities as co-licensees with a municipality, if the municipality retains majority ownership of the project for which the license was issued.</text> </paragraph></subsection> 
<subsection commented="no" id="H9D46973413504B8297B9D7285108AE38"><enum>(e)</enum><header>Interagency communications</header><text>Interagency cooperation in the preparation of environmental documents under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) with respect to an application for a license for a closed-loop pumped storage project submitted pursuant to this section, and interagency communications relating to licensing process coordination pursuant to this section, shall not—</text> <paragraph commented="no" id="HC7C6763922C84B9CAA3FDDB48B559C2E"><enum>(1)</enum><text>be considered to be ex parte communications under Commission rules; or</text> </paragraph> 
<paragraph commented="no" id="H1E368EC43DFB4A90AC382D7B80DA3AF9"><enum>(2)</enum><text>preclude an agency from participating in a licensing proceeding under this part.</text> </paragraph></subsection> <subsection commented="no" id="H16C04BEDCCC1461888C7CFDF8E8333A5"><enum>(f)</enum><header>Developing abandoned mines for pumped storage</header> <paragraph commented="no" id="HBD57A45CCE5244BA9B04F2B17931AC66"><enum>(1)</enum><header>Workshop</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this section, the Commission shall hold a workshop to explore potential opportunities for development of closed-loop pumped storage projects at abandoned mine sites.</text> </paragraph> 
<paragraph commented="no" id="H5A1E9E60282E401DA6A8F5123842A2F2"><enum>(2)</enum><header>Guidance</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall issue guidance to assist applicants for licenses or preliminary permits for closed-loop pumped storage projects at abandoned mine sites.</text> </paragraph></subsection> <subsection commented="no" id="H2B801DB312964FE8A66525FD29F61DAF"><enum>(g)</enum><header>Qualifying criteria for closed-Loop pumped storage projects</header> <paragraph commented="no" id="H6DBFF75441BC4DF6B9565B819BEB9985"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall establish criteria that a pumped storage project shall meet in order to qualify as a closed-loop pumped storage project eligible for the expedited process established under this section.</text> </paragraph> 
<paragraph commented="no" id="H358333CCBB8D4EFE9219956C07EA186B"><enum>(2)</enum><header>Inclusions</header><text>In establishing the criteria under paragraph (1), the Commission shall include criteria requiring that the pumped storage project—</text> <subparagraph commented="no" id="H077E2AF12C264BE78ABDDF0267C820FC"><enum>(A)</enum><text>cause little to no change to existing surface and groundwater flows and uses; and</text> </subparagraph> 
<subparagraph commented="no" id="HEBE665932A3F47F288CFC6A31BF08E97"><enum>(B)</enum><text display-inline="yes-display-inline">is unlikely to adversely affect species listed as a threatened species or endangered species under the Endangered Species Act of 1973.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section commented="no" id="H90192D6A7C2B46C8A4EA7BFA28866B7B"><enum>3.</enum><header>Obligation for payment of annual charges</header><text display-inline="no-display-inline">Section 10(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803(e)</external-xref>) is amended by adding at the end the following:</text>
