<section id="H2E4C47B147D24006AD4EDFF9B7BEE3E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Residency Choice Act</short-title></quote>.</text></section> <section id="HD6B08FF263654EC4A3F45D2F9FF34547"><enum>2.</enum><header>Residence of spouses of servicemembers for tax purposes</header> <subsection id="H1CDEC3B8103F40BEBB26DDC6954C38DB"><enum>(a)</enum><header>Residence for tax purposes</header><text display-inline="yes-display-inline">Section 511(a)(2) of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4001">50 U.S.C. 4001(a)(2)</external-xref>) is amended by adding at the end the following new sentence: <quote>The spouse of a servicemember may elect to use the same residence for purposes of taxation as the servicemember regardless of the date on which the marriage of the spouse and the servicemember occurred.</quote>.</text></subsection>
<subsection id="H92F953C27C26410F91C2B5F83D6B26FE"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to any return of State or local income tax filed for any taxable year beginning with the taxable year that includes the date of the enactment of this Act.</text></subsection></section> <section id="H007141FED86748A8A6ABFF7B32511901"><enum>3.</enum><header>Residence of spouses of servicemembers for voting</header> <subsection id="H5F89F621DF6A42D182EBA4FF54704C75"><enum>(a)</enum><header>In general</header><text>Section 705(b) of such Act is amended—</text>
<paragraph id="HD68A9799BF184085B12E308993B6AD61"><enum>(1)</enum><text>by striking <quote>State or local office</quote> and all that follows through the period at the end of paragraph (3) and inserting <quote>State or local office—</quote>; and</text></paragraph> <paragraph id="H06FCBB605D4D4D46AEA8864B0DFA29F9"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text>
<quoted-block display-inline="no-display-inline" id="H0B9CE8F6AD224B8AB59D2D3D192EDD3D" style="OLC">
<paragraph id="HC0C51C88B6B04948BB95BA9A6961AD60"><enum>(1)</enum><text display-inline="yes-display-inline">a person who is absent from a State because the person is accompanying the person’s spouse who is absent from that same State in compliance with military or naval orders shall not, solely by reason of that absence—</text> <subparagraph id="H523647407B5E47CAB105DDC07CE63768"><enum>(A)</enum><text display-inline="yes-display-inline">be deemed to have lost a residence or domicile in that State, without regard to whether or not the person intends to return to that State;</text></subparagraph>
<subparagraph id="H5FA0E3A7EF5E4D4F961666CAF5FF5149"><enum>(B)</enum><text>be deemed to have acquired a residence or domicile in any other State; or</text></subparagraph> <subparagraph id="H35EC4B92A0244513B752AA3945C96F5D"><enum>(C)</enum><text>be deemed to have become a resident in or a resident of any other State; and</text></subparagraph></paragraph>
<paragraph id="H09EF6E902C0B4D9E8AD2D9FCA1FB3DA2"><enum>(2)</enum><text>the spouse of a servicemember may elect to use the same residence as the servicemember regardless of the date on which the marriage of the spouse and the servicemember occurred.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H30CC5C4F226C4216BBF1E96991A0E751"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on the date that is 90 days after the enactment of this Act.</text></subsection></section>
