<paragraph id="H4CD20A21B7F34785BBB09DAB88DD5239"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H8D21A1B4C1B84B07A142BEFC598700CE"><enum>(2)</enum><text>in subparagraph (C)(iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H8687A2A2230E4BD4B3472A4FEDB12038"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="HDBC9FBD2FD03431E98F9C165000EF123" display-inline="no-display-inline"> <subparagraph id="H70523D6BC0494E188AC22EB5EE3E635B"><enum>(D)</enum><text display-inline="yes-display-inline">not later than 120 days after the date of the enactment of this subparagraph, and not later than December 31 of each year thereafter, submit to the Committee on Science, Space, and Technology and the Committee on Small Business of the House of Representatives, and to the Committee on Small Business and Entrepreneurship of the Senate, a report describing the goals set under subparagraph (A) and the incentives used or created under subparagraph (B).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0202A5538DDC467FA17514CA3210919A"><enum>4.</enum><header>Encouraging innovation in United States manufacturing</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by adding at the end the following new subsection: </text> <quoted-block style="OLC" id="H42D027C711554BD283BA65A98F8990C1" display-inline="no-display-inline"> <subsection id="H915ABE4B54134815BB1BBD96D3AD7503"><enum>(tt)</enum><header>Encouraging innovation in United States manufacturing</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator shall—</text> 
<paragraph id="H13F3465909FE4687829B2380FBF23F6B"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that, in selecting small business concerns to participate in SBIR or STTR programs under this section, Federal agencies give high priority to small manufacturing companies and other small business concerns engaged in or planning to engage in manufacturing research and development for the purpose of developing and producing new products and technologies in the United States; and</text></paragraph> <paragraph id="H0062CDAB6B374EBFBD73941627318E02"><enum>(2)</enum><text display-inline="yes-display-inline">include in the annual report to Congress under subsection (b)(7) a determination of whether the priority described in paragraph (1) is being carried out.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC6468F16DD6D4B88A54567D527EC894B"><enum>5.</enum><header>Encouraging innovation in cybersecurity</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 4, is further amended by adding at the end the following new subsection: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB38FAEF3C9FA4FBDB6981412FC6728C4"> <subsection id="HC73F46270F014A10B8148E6C50A5CB67"><enum>(uu)</enum><header>Encouraging innovation in cybersecurity</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator shall—</text> 
<paragraph id="HD444E566E0B84793AFCFB98D64443AEC"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that, in selecting small business concerns to participate in SBIR or STTR programs under this section, Federal agencies engaged in cybersecurity research give high priority to small business concerns that are engaged in cybersecurity research and development, for the purpose of developing and implementing technology services and products to strengthen the security of United States Government and private computer systems, including software, hardware, and portable devices; and </text></paragraph> <paragraph id="H6006486FF1C34FE4B451AA0665F390A0"><enum>(2)</enum><text display-inline="yes-display-inline">include in the annual report to Congress under subsection (b)(7) a determination of whether the priority described in paragraph (1) is being carried out.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H58B3363C99D244C4ACC9E24BFDE18ABA"><enum>6.</enum><header>Compliance of Phase III awards with competitive procedures</header><text display-inline="no-display-inline">Section 9(r)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(r)(4)</external-xref>) is amended by inserting <quote>as direct follow-on awards issued without further competition</quote> after <quote>developed the technology</quote>.</text></section> <section id="HA02229B2BF26458F859758FC83CFDB09" section-type="subsequent-section"><enum>7.</enum><header>Improvements to technical and business assistance in the SBIR and STTR programs</header><text display-inline="no-display-inline">Section 9(q) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(q)</external-xref>) is amended—</text> 
<paragraph id="HB50DE6AE84AA45028D568942753AC064"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and business</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">technical</header-in-text></quote>;</text></paragraph> <paragraph id="HB3C86F5CDD6D4B7F994CDF7143284FE9"><enum>(2)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HF15E84758F8C40FCBFC71126E5084F09"><enum>(A)</enum><text>in the matter preceding subparagraph (A)—</text> <clause id="H3E7959A8B9CD4558938409D87F88DB0E"><enum>(i)</enum><text>by striking <quote>a vendor selected under paragraph (2)</quote> and inserting <quote>1 or more vendors selected under paragraph (2)(A)</quote>;</text></clause> 
<clause id="HBE0BCF39C1864B52ADDE823CA0392CC4"><enum>(ii)</enum><text>by inserting <quote>and business</quote> before <quote>assistance services</quote>; and</text></clause> <clause id="H768E677F2FD64C65BA33925E346E01F6"><enum>(iii)</enum><text>by inserting <quote>assistance with product sales, intellectual property protections, market research, market validation, and development of regulatory plans and manufacturing plans,</quote> after <quote>technologies,</quote>; and</text></clause></subparagraph> 
<subparagraph id="H1FD0292CABCC435B96DD63A19EDAD303"><enum>(B)</enum><text>in subparagraph (D), by inserting <quote>, including intellectual property protections</quote> before the period at the end;</text></subparagraph></paragraph> <paragraph id="H1191119C345A4811A1C80D8818F3DEAA"><enum>(3)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H6406A262AC2F49308191A45A3F878D42"><enum>(A)</enum><text>by striking <quote>Each agency may select a vendor to assist small business concerns to meet</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H54AD171596FC4BD3861434227A093C34" style="OLC"> <subparagraph id="HE7B2D7B739554F6D9C7971A4B56BAE4D"><enum>(A)</enum><header>In general</header><text>Each agency may select 1 or more vendors from which small business concerns may obtain assistance in meeting</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H8798E2E41F2C4A2A934792E79E81E1A6"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H81FCD755F9534BC68D37C3A95D342FF7" style="OLC"> <subparagraph id="H4DFBD4053DE94B8D92CFC780AD4FD7E5"><enum>(B)</enum><header>Selection by small business concern</header><text>A small business concern may, by contract or otherwise, select 1 or more vendors to assist the small business concern in meeting the goals listed in paragraph (1).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HFED906AA31DA44BB97B783FD66C837BC"><enum>(4)</enum><text>in paragraph (3)—</text> <subparagraph id="HC1E96843FC824A399458379FB12B2021"><enum>(A)</enum><text>by inserting <quote>(A)</quote> after <quote>paragraph (2)</quote> each place it appears;</text></subparagraph> 
<subparagraph id="HC488860D955E4413A520E7CD05807050"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>$5,000 per year</quote> each place it appears and inserting <quote>$6,500 per project</quote>;</text></subparagraph> <subparagraph id="H6E518B0BEC664B32A2BDB34F25A572D7"><enum>(C)</enum><text>in subparagraph (B)—</text>

<subparagraph id="H93F2C9D31958413592698617E01EB9C8"><enum>(D)</enum><text>in subparagraph (C)—</text> <clause id="HA9BAE0EEED0D48E59AAA3D6AAEF7F78A"><enum>(i)</enum><text>by inserting <quote>or business</quote> after <quote>technical</quote>;</text></clause> 
<clause id="H0C319BB76EAC4092BE079BBC1FAC7632"><enum>(ii)</enum><text>by striking <quote>the vendor</quote> and inserting <quote>a vendor</quote>; and</text></clause> <clause id="H3867FBDB686944D9BC1FAF008F63A019"><enum>(iii)</enum><text>by adding at the end the following: <quote>Business-related services aimed at improving the commercialization success of a small business concern may be obtained from an entity, such as a public or private organization or an agency of or other entity established or funded by a State that facilitates or accelerates the commercialization of technologies or assists in the creation and growth of private enterprises that are commercializing technology.</quote>;</text></clause></subparagraph>

<subparagraph commented="no" display-inline="no-display-inline" id="HAC05179FC53546B2A7836D5F8B6501EA"><enum>(E)</enum><header>Multiple award recipients</header><text display-inline="yes-display-inline">The Administrator shall establish a limit on the amount of technical and business assistance services that may be received or purchased under subparagraph (B) by a small business concern that has received multiple Phase II SBIR or STTR awards for a fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="HDC5C2CECDB71406EB4C099612A40D7C9" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Procurement center representatives and other acquisition personnel in the SBIR and STTR programs</header> <subsection id="HA7CA878D0C9E4DF6BB1C9371A1D1C281"><enum>(a)</enum><header>Definition of senior procurement executive</header><text display-inline="yes-display-inline">Section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>) is amended—</text> 
<paragraph id="H2E0AA3AB769541ED99874DEA93435CFB"><enum>(1)</enum><text>in paragraph (12)(B), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H00304C2F1CDC4263991E6038BF4EA68A"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (13)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>

<paragraph id="HF4C2BE18CF584ABC8C030198FE49D50B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(b)</external-xref>) is amended—</text> <subparagraph id="HEBBCD22963974112891C2F839F58A691"><enum>(A)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H170A3CA49E9545E0BB7A9E1C7737567F"><enum>(B)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H31D10B79B45243A485A773A94C932829"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H4FE2A4B0DEBE4D75BD533AC99350DAD8"><enum>(10)</enum><text display-inline="yes-display-inline">to coordinate, where appropriate, with the senior procurement executive of the relevant Federal agency to assist small business concerns participating in a SBIR or STTR program with commercializing research developed under such a program before such small business concern is awarded a contract from such Federal agency.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HE70A369926EE4C36A5DDD8334E44338E"><enum>(2)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 9(b)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(b)(3)</external-xref>) is amended by striking <quote>and</quote> at the end.</text></paragraph></subsection> 
<subsection id="H5E0EC2934749461FB2DA06E5F8CDD26D"><enum>(c)</enum><header>Modifications relating to procurement center representatives and other acquisition personnel</header> 
<paragraph id="HC7021DC58DF0487695DB281C67EE77A3"><enum>(1)</enum><header>SBIR amendment</header><text display-inline="yes-display-inline">Section 9(j) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HBC2E258C48764C87B35F46DFD58FB552" display-inline="no-display-inline"> <paragraph id="HA0E998D3E78D428B8C9DEDC916F8A7A0"><enum>(4)</enum><header>Modifications relating to procurement center representatives</header><text display-inline="yes-display-inline">Upon the enactment of this paragraph, the Administrator shall modify the policy directives issued pursuant to this subsection to require procurement center representatives (as described in section 15(l)) to coordinate with the appropriate contracting officer or SBIR program officer, and the appropriate Director of Small and Disadvantaged Business Utilization established pursuant to section 15(k) for the agency letting the contract, to assist small business concerns participating in the SBIR program, particularly in Phase III. The procurement center representatives shall coordinate with the appropriate contracting officer and the appropriate Director of the Office of Small and Disadvantaged Business Utilization established pursuant to section 15(k) for the agency letting the contract.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC7C8A36E3D0D42F99A487DC35B3F69BC"><enum>(2)</enum><header>STTR amendment</header><text display-inline="yes-display-inline">Section 9(p)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(p)(2)</external-xref>) is amended—</text> <subparagraph id="H7634FFDD9EF34637A68CAC0F783FB4A4"><enum>(A)</enum><text>in subparagraph (E)(ii), by striking <quote>and</quote> at the end;</text></subparagraph>

<subparagraph id="H5B73F43E2F7848C58B088D29E0FD26C4"><enum>(G)</enum><text display-inline="yes-display-inline">procedures to ensure that procurement center representatives (as described in section 15(l))—</text> <clause id="H1C1F8258FF944D978A1FE0B35058C3E4"><enum>(i)</enum><text display-inline="yes-display-inline">coordinate with the appropriate contracting officer or STTR program officer, and the appropriate Director of Small and Disadvantaged Business Utilization established pursuant to section 15(k) for the agency letting the contract, to assist small business concerns participating in the STTR program, particularly in Phase III; and</text></clause> 
<clause id="H692980E0536D42A4872308178EDDE6A5"><enum>(ii)</enum><text display-inline="yes-display-inline">coordinate with the appropriate contracting officer and the appropriate Director of the Office of Small and Disadvantaged Business Utilization established pursuant to section 15(k) for the Federal agency letting the contract in providing the assistance described in clause (i); and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H62D5A596761F4C4CB36F14E22EFEFAEC"><enum>(d)</enum><header>Amendment to duties of procurement center representatives</header><text>Section 15(l)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(l)(2)</external-xref>) is amended—</text>

<subparagraph id="H0A02B78CFEA84CCFB545552B77EA422E"><enum>(K)</enum><text display-inline="yes-display-inline">coordinate with the appropriate contracting officer and the appropriate Director of the Office of Small and Disadvantaged Business Utilization established pursuant to subsection (k) for the agency letting the contract; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6D028A7028A54708A9B87F029E11D228"><enum>(e)</enum><header>Amendment to the duties of the Director of Small and Disadvantaged Business Utilization for Federal agencies</header><text>Section 15(k) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(k)</external-xref>) is amended—</text> 
<paragraph id="HD6E07E5DF9FE4A05BD2A03A1BCC1C8C1"><enum>(1)</enum><text>in paragraph (19), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HC9DB29AD47374A2CB37613389D235D0D"><enum>(2)</enum><text>in paragraph (20), by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="H4BFD73F62D1E405EB2F99401C3400E78"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text> <quoted-block style="OLC" id="HE74DE67455CE4F5D8B60D8A47D4A3AF9" display-inline="no-display-inline"> <paragraph id="HF972E465E151400A82A35852AF98FC51"><enum>(21)</enum><text display-inline="yes-display-inline">shall coordinate with the appropriate contracting officer of SBIR or STTR program officer to assist small business concerns participating in a SBIR or STTR program under section 9 with researching applicable solicitations for the award of a Federal contract (particularly with the Federal agency that has a funding agreement (as defined under section 9) with the concern) to market the research developed by such concern under such SBIR or STTR program; and</text></paragraph> 
<paragraph id="H970F64D817D748049EC0D803F2DBC66E"><enum>(22)</enum><text display-inline="yes-display-inline">shall provide technical assistance to small business concerns participating in a SBIR or STTR program under section 9 to submit a bid for an award of a Federal contract, including coordination with procurement center representatives and the appropriate senior procurement executive for the agency letting the contract.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H48E61882A4054557B3803C6D3FFEF0EE"><enum>9.</enum><header>Increased outreach requirements</header> <subsection id="H2E8093CAB5B949B983C391249D0E06C9"><enum>(a)</enum><header>In general</header> <paragraph id="HA9EF9EA14CC04333B9687A3680CC9DEB"><enum>(1)</enum><header>SBIR amendment</header><text display-inline="yes-display-inline">Section 9(j) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>), as amended by section 8, is further amended by adding at the end the following new paragraph:</text>

<subparagraph id="H48495E24EFB34A2B8F24F10436CD7E80"><enum>(C)</enum><text display-inline="yes-display-inline">to make the application processes for programs under this section more efficient; and</text></subparagraph> <subparagraph id="H1664F7F0E63148619AA81886C5216086"><enum>(D)</enum><text display-inline="yes-display-inline">to increase participation in the programs established under this section.</text></subparagraph></paragraph>

<section id="HDAAA16051F7743538A1C07ACEC27D91F" section-type="subsequent-section"><enum>12.</enum><header>Commercialization assistance pilot programs</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 10, is further amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H5999751C5748493F8ED2C0B9D542AB75" display-inline="no-display-inline"> <subsection id="H00A214DBBFF14A86B44ED55671C5C173"><enum>(ww)</enum><header>Commercialization assistance pilot programs</header> <paragraph id="HAC786C71C0A745598684A3E552EAD73E"><enum>(1)</enum><header>Pilot programs implemented</header> <subparagraph id="H55C2F6F820204F5EB3F669D5B5A9D542"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), not later than one year after the date of the enactment of this subsection, a covered agency shall implement a commercialization assistance pilot program, under which an eligible entity may receive a subsequent Phase II SBIR award.</text></subparagraph> 
<subparagraph id="HA438021841694A9A973EA204220EDC36"><enum>(B)</enum><header>Exception</header><text>If the Administrator determines that a covered agency has a program that is sufficiently similar to the commercialization assistance pilot program established under this subsection, such covered agency shall not be required to implement a commercialization assistance pilot program under this subsection.</text></subparagraph></paragraph> <paragraph id="H56F0F1962DD94DD4829639F1D1CA225A"><enum>(2)</enum><header>Percent of agency funds</header><text display-inline="yes-display-inline">The head of each covered agency may allocate not more than 5 percent of the funds allocated to the SBIR program of the covered agency for the purpose of making a subsequent Phase II SBIR award under the commercialization assistance pilot program.</text></paragraph> 
<paragraph id="HCDB6E4B4E90646098E6FB5981FCC338C"><enum>(3)</enum><header>Termination</header><text>A commercialization assistance pilot program established under this subsection shall terminate on September 30, 2022.</text></paragraph> <paragraph id="HAD7282B03DD9483DA0C22C5FFC678F39"><enum>(4)</enum><header>Application</header><text display-inline="yes-display-inline">To be selected to receive a subsequent Phase II SBIR award under a commercialization assistance pilot program, an eligible entity shall submit to the covered agency implementing such pilot program an application at such time, in such manner, and containing such information as the covered agency may require, including—</text> 
<subparagraph id="H366CAF3F72F744EE80E315358DA33BC7"><enum>(A)</enum><text>an updated Phase II commercialization plan; and</text></subparagraph> <subparagraph id="H18D9CF7DFD2E4B5A8946A9E9C8954687"><enum>(B)</enum><text>the source and amount of the matching funding required under paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H68116DAA164E41458BD398ACA921D0C6"><enum>(5)</enum><header>Matching funding</header> 
<subparagraph id="HCF2BDF9E2F6F4421B78B52B3275FC8A8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall require, as a condition of any subsequent Phase II SBIR award made to an eligible entity under this subsection, that a matching amount (excluding any fees collected by the eligible entity receiving such award) equal to the amount of such award be provided from an eligible third-party investor.</text></subparagraph> <subparagraph id="H9ED8D0578FB94272AE52D53A53FBBBFC" commented="no"><enum>(B)</enum><header>Ineligible sources</header><text display-inline="yes-display-inline">An eligible entity may not use funding from ineligible sources to meet the matching requirement of subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H38E05058DB9E4997808ACD8D26925C10"><enum>(6)</enum><header>Award</header><text display-inline="yes-display-inline">A subsequent Phase II SBIR award made to an eligible entity under this subsection—</text> <subparagraph id="HF14168792B5C48909405E017B36751E7"><enum>(A)</enum><text display-inline="yes-display-inline">may not exceed the limitation described under subsection (aa)(1); and</text></subparagraph> 
<subparagraph id="HE808D51F352748B4AF17D82146B4CD17"><enum>(B)</enum><text display-inline="yes-display-inline">shall be disbursed during Phase II.</text></subparagraph></paragraph> <paragraph id="H0EAA8C2764404355AA6C78772FABB213"><enum>(7)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The funds awarded to an eligible entity under this subsection may only be used for research and development activities that build on eligible entity’s Phase II program and ensure the research funded under such Phase II is rapidly progressing towards commercialization.</text></paragraph> 
<paragraph id="H501A7DFEED12441B91B9127A92823CCC"><enum>(8)</enum><header>Selection</header><text display-inline="yes-display-inline">In selecting eligible entities to participate in a commercialization assistance pilot program under this subsection, the head of a covered agency shall consider—</text> <subparagraph id="HF3161F12781A4570980D80857E6347DE"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which such award could aid the eligible entity in commercializing the research funded under the eligible entity’s Phase II program;</text></subparagraph> 
<subparagraph id="H2D674FD589B440D4BC0DC7037E69EE87"><enum>(B)</enum><text display-inline="yes-display-inline">whether the updated Phase II commercialization plan submitted under paragraph (4) provides a sound approach for establishing technical feasibility that could lead to commercialization of such research;</text></subparagraph> <subparagraph id="HBB49ECB47DE942FB8CD54BC79C3D9BA8"><enum>(C)</enum><text display-inline="yes-display-inline">whether the proposed activities to be conducted under such updated Phase II commercialization plan further improve the likelihood that such research will provide societal benefits;</text></subparagraph> 
<subparagraph id="H29FBAE41978A49B4A76C8764C27A4373"><enum>(D)</enum><text display-inline="yes-display-inline">whether the small business concern has progressed satisfactorily in Phase II to justify receipt of a subsequent Phase II SBIR award;</text></subparagraph> <subparagraph id="H49C9F897229F4DCD996BC925CC965D7B"><enum>(E)</enum><text display-inline="yes-display-inline">the expectations of the eligible third-party investor that provides matching funding under paragraph (5); and</text></subparagraph> 
<subparagraph id="H8DFBECBFFDEB49EDB87FC880292CB481"><enum>(F)</enum><text display-inline="yes-display-inline">the likelihood that the proposed activities to be conducted under such updated Phase II commercialization plan using matching funding provided by such eligible third-party investor will lead to commercial and societal benefit.</text></subparagraph></paragraph> <paragraph id="H9C8EBBD8821C416AACDF6C34072D67AB"><enum>(9)</enum><header>Evaluation Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this subsection, the Comptroller General of the United States shall submit to the Committee on Science, Space, and Technology and the Committee on Small Business of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate, a report including—</text> 
<subparagraph id="HFAE685DE253243ADB405EA670008EEFF"><enum>(A)</enum><text>a summary of the activities of commercialization assistance pilot programs carried out under this subsection;</text></subparagraph> <subparagraph id="HA2AA52F1930044D2B913353D7504785B"><enum>(B)</enum><text display-inline="yes-display-inline">a detailed compilation of results achieved by such commercialization assistance pilot programs, including the number of eligible entities that received awards under such programs;</text></subparagraph> 
<subparagraph id="HA5BF1475341F499AA7187CDE4DF40670"><enum>(C)</enum><text display-inline="yes-display-inline">the rate at which each eligible entity that received a subsequent Phase II SBIR award under this subsection commercialized research of the recipient;</text></subparagraph> <subparagraph id="HD7FF858B03074F18A0E1CF059FDA2574"><enum>(D)</enum><text display-inline="yes-display-inline">the growth in employment and revenue of eligible entities that is attributable to participation in a commercialization assistance pilot program;</text></subparagraph> 
<subparagraph id="HAB0F5EBD8FE14FCCAF7D868E1D2BAA57"><enum>(E)</enum><text display-inline="yes-display-inline">a comparison of commercialization success of eligible entities participating in a commercialization assistance pilot program with recipients of an additional Phase II SBIR award under subsection (ff);</text></subparagraph> <subparagraph id="H64AFDC2D003A426BA9F727A989ECD8C7"><enum>(F)</enum><text display-inline="yes-display-inline">demographic information, such as ethnicity and geographic location, of eligible entities participating in a commercialization assistance pilot program;</text></subparagraph> 
<subparagraph id="HC9B24F556B244DEEB5ACC1D2DC5A0D34"><enum>(G)</enum><text display-inline="yes-display-inline">an accounting of the funds used at each covered agency that implements a commercialization assistance pilot program under this subsection;</text></subparagraph> <subparagraph id="H248A68D5BCC441E4B3B9B7AB8DD5C585"><enum>(H)</enum><text display-inline="yes-display-inline">the amount of matching funding provided by eligible third-party investors, set forth separately by source of funding;</text></subparagraph> 
<subparagraph id="H5D944FB5B8BD4A77995F3CBF9573B512"><enum>(I)</enum><text display-inline="yes-display-inline">an analysis of the effectiveness of the commercialization assistance pilot program implemented by each covered agency; and</text></subparagraph> <subparagraph id="H8CC41A9843C24AB3BA02342985C50E0B"><enum>(J)</enum><text display-inline="yes-display-inline">recommendations for improvements to the commercialization assistance pilot program.</text></subparagraph></paragraph> 
<paragraph id="HFCEDFB21FD6D4062BAD53FB9EAD43478"><enum>(10)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection:</text> <subparagraph id="HAC24D3BAD8E14E9BB5C7759E3B52D9F5"><enum>(A)</enum><header>Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means a Federal agency required to have an SBIR program.</text></subparagraph> 
<subparagraph id="HD2FEC997B60D412ABD879E9818DEC96D"><enum>(B)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a small business concern that has received a Phase II award under an SBIR program and an additional Phase II SBIR award under subsection (ff) from the covered agency to which such small business concern is applying for a subsequent Phase II SBIR award.</text></subparagraph> <subparagraph id="H6B1DEF856E874D81BBE0E73004885EE9"><enum>(C)</enum><header>Eligible third-party investor</header><text display-inline="yes-display-inline">The term <term>eligible third-party investor</term> means a small business concern other than an eligible entity, a venture capital firm, an individual investor, a non-SBIR Federal, State or local government, or any combination thereof.</text></subparagraph> 
<subparagraph id="H0F1EF2B4C9DF4A22BC684F75C9F8D79E"><enum>(D)</enum><header>Ineligible sources</header><text>The term <term>ineligible sources</term> means the following:</text> <clause id="H66BDC155294C4AC7AA5E22BE053087DD"><enum>(i)</enum><text display-inline="yes-display-inline">The eligible entity’s internal research and development funds.</text></clause> 
<clause id="HFB9048EEB65F4B7193A086521CB305AD"><enum>(ii)</enum><text display-inline="yes-display-inline">Funding in forms other than cash, such as in-kind or other intangible assets.</text></clause> <clause id="H6EE3178393EE48F797D4EEA0C9C24C3C"><enum>(iii)</enum><text display-inline="yes-display-inline">Funding from the owners of the eligible entity, or the family members or affiliates of such owners.</text></clause> 
<clause id="H3AD3346BA157458D9F27663899650181"><enum>(iv)</enum><text display-inline="yes-display-inline">Funding attained through loans or other forms of debt obligations.</text></clause></subparagraph> <subparagraph id="H059A9B4EEE424824A713666541180F7F"><enum>(E)</enum><header>Subsequent Phase II SBIR award</header><text>The term <term>subsequent Phase II SBIR award</term> means an award granted to an eligible entity under this subsection to carry out further commercialization activities for research conducted pursuant to an SBIR program.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2771670437FC417997DF0248D78A42F0"><enum>13.</enum><header>Phase 0 Proof of Concept Partnership Pilot Program</header> 
<subsection id="HBBA2488E30C34415A1ED761F1387CE8A"><enum>(a)</enum><header>Inclusion of additional agencies in pilot program</header><text display-inline="yes-display-inline">Section 9(jj) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(jj)</external-xref> is amended—</text> <paragraph id="H15901659BDCB4198B8274BB54DD6154B"><enum>(1)</enum><text>in paragraph (1)—</text>

<subsection id="H8DB7C58C4D434B30B7E1A65BF21E6E24" commented="no"><enum>(b)</enum><header>Extension of pilot program authority</header><text display-inline="yes-display-inline">Section 9(jj)(7) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(jj)(7)</external-xref>) is amended by striking <quote>fiscal year 2017</quote> and inserting <quote>fiscal year 2022</quote>.</text></subsection></section> <section id="H7D6604D2FB184B5D8EB42A9F8967D1F3" section-type="subsequent-section"><enum>14.</enum><header>Reporting requirements</header> <subsection id="HF4746505DB1046838746437A8C71AFE8"><enum>(a)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Section 9(b)(7) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(b)(7)</external-xref>) is amended by striking <quote>to report not less than annually</quote> and inserting <quote>to submit a report not later than December 31 of each year</quote>.</text></subsection> 
<subsection id="HF5678F04C30E48A29FD668CB4F32F5E6"><enum>(b)</enum><header>Annual report to SBA and the Office of Science and Technology Policy</header><text display-inline="yes-display-inline">Section 9(g)(9) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)(9)</external-xref>) is amended—</text> <paragraph id="H9C1505B32B03412A908B079CC28CD85F"><enum>(1)</enum><text>by striking <quote>make an annual report</quote> and inserting <quote>not later than March 30 of each year, submit a report</quote>; and</text></paragraph> 
<paragraph id="H713176A1309E4196A2E661061E119664"><enum>(2)</enum><text>by striking <quote>and the Office of Science and Technology Policy</quote> and inserting <quote>, the Office of Science and Technology Policy, the Committee on Science, Space, and Technology and the Committee on Small Business of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate</quote>. </text></paragraph></subsection></section> <section id="HB5A8F2B6001D495E95504E61B2D84EE4"><enum>15.</enum><header>SBIR Phase flexibility</header><text display-inline="no-display-inline">Section 9(cc) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(cc)</external-xref>) is amended by striking <quote>During fiscal years</quote> and all that follows through <quote>may each provide</quote> and inserting <quote>During fiscal years 2018 through 2022, all agencies participating in the SBIR program may provide</quote>.</text></section>
