			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize and amend the Marine Debris Act to promote international action to reduce marine
			 debris, and for other purposes.</official-title></form>
	<legis-body id="HC5B34A85937D4C349A3265882684FD7F" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="H69DD5E8489734F4BBAEC0EF3F38E5E5A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Seas Act of 2017</short-title></quote> or the <quote><short-title>SOS Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H9E46253B9D364A9DA6D1A17AEF218F08" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">NOAA Marine Debris Program</header><text display-inline="no-display-inline">Subsection (b) of section 3 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(b)</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HFCE811B4069C4A4A9F87C96EA9AB5A71"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0FE6194B6C2D4DD3A06E6ABDE45E7A8D"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5)(C), by striking the period at the end and inserting a semicolon; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7EDEB46D377D49B8A9CEDC85EA6F44ED"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5BF5F1FABB2346C7A51DF82643E7F7A1" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H63727103E00744838DA173698195767C"><enum>(6)</enum><text display-inline="yes-display-inline">work with other Federal agencies to develop outreach and education strategies to address both land- and sea-based sources of marine debris; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D7D4A7B0F374D9383F3909ACB3A1F05"><enum>(7)</enum><text display-inline="yes-display-inline">work with the Department of State and other Federal agencies to promote international action to reduce the incidence of marine debris.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H4CD2BA8E723F446397A40FBCFF559B1A" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Assistance for severe marine debris events</header><text display-inline="no-display-inline">Section 3 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H23D6840645EC476482BF0A6977B1C0BA" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="H888C5EDF06704DD7B9D89947E5D5E745"><enum>(d)</enum><header display-inline="yes-display-inline">Assistance for severe marine debris events</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H359AE5639A5743DBBF7473AF14729243"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">At the discretion of the Administrator or at the request of the Governor of an affected State, the Administrator shall determine whether there is a severe marine debris event.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4C300296EB04F1B942B5DC404D072A0"><enum>(2)</enum><header display-inline="yes-display-inline">Assistance</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="H1885D380B7324A1EA98F4E99B495F832"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the Administrator makes a determination under paragraph (1) that there is a severe marine debris event, the Administrator is authorized to make sums available to be used by the affected State or by the Administrator in cooperation with the affected State—</text>
 <clause commented="no" display-inline="no-display-inline" id="H3D1415DDECB540329E2B519C04CBBE54"><enum>(i)</enum><text display-inline="yes-display-inline">to assist in the cleanup and response required by the severe marine debris event; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="HA7BE566ABDAC4DD9BC9249CE2159689E"><enum>(ii)</enum><text display-inline="yes-display-inline">such other activity as the Administrator determines is appropriate in response to the severe marine debris event.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE12554B368524F96B44EC9E98694B86E"><enum>(B)</enum><header>Priority assistance</header><text display-inline="yes-display-inline">In providing assistance under this paragraph, the Administrator shall prioritize assistance for activities to respond to a severe marine debris event—</text>
 <clause commented="no" display-inline="no-display-inline" id="HBA43CAFFF3B441D7968ED60F025EB916"><enum>(i)</enum><text display-inline="yes-display-inline">in a rural or remote community; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="H0B2B6E08EDEA4021922679FD6652FCB8"><enum>(ii)</enum><text>in a habitat of national concern.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H592704B15EAC45BF971E39EA17CB7482"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="H6F570080EBF846E4B8A946827427C22D"><enum>(A)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of an activity carried out under the authority of this subsection shall be—</text>
 <clause commented="no" display-inline="no-display-inline" id="H08D94A742DE549468D5C6C0FDCBA98F3"><enum>(i)</enum><text>if the activity is funded wholly by funds made available by an entity, including the government of a foreign country, to the Federal Government for the purpose of responding to a severe marine debris event, 100 percent of the cost of the activity; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H7B9F34E952774324B3070FA083D050DB"><enum>(ii)</enum><text display-inline="yes-display-inline">for any activity other than an activity funded as described in clause (i), 75 percent of the cost of the activity.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA922C6F56724BE282E60221192282C6"><enum>(B)</enum><header>Limitation on administrative expenses</header><text display-inline="yes-display-inline">In the case of an activity funded as described in subparagraph (A)(i), not more than 5 percent of the funds made available for the activity may be used by the Administrator for administrative expenses.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" display-inline="no-display-inline" id="HA0BE708BCD714F6086B7ADAE83C5EF68" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Sense of Congress on international engagement to respond to marine debris</header><text display-inline="no-display-inline">It is the sense of Congress that the President should—</text> <paragraph commented="no" display-inline="no-display-inline" id="HB3DB399ACB2041CDA800A3103FA88AA6"><enum>(1)</enum><text display-inline="yes-display-inline">support Federal funding for research and development of bio-based and other alternatives or environmentally feasible improvements to materials that reduce municipal solid waste and its consequences in the ocean;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FFC71D7F7664787BE393E7E0A0B3C60"><enum>(2)</enum><text display-inline="yes-display-inline">work with representatives of foreign countries that contribute the most to the global marine debris problem to learn about, and find solutions to, the contributions of such countries to marine debris in the world's oceans;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEAA54B11D05647C5ADFA36CB1336D85D"><enum>(3)</enum><text display-inline="yes-display-inline">carry out studies to determine—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HA9C5D4060BB346CF8536A6B79B736A9A"><enum>(A)</enum><text display-inline="yes-display-inline">the primary means by which solid waste enters the oceans;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB1D1C37D29244108A3C94A09285F0184"><enum>(B)</enum><text display-inline="yes-display-inline">the manner in which waste management infrastructure can be most effective in preventing debris from reaching the oceans;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H778EB7D940E44A0685217EB26B15FEBE"><enum>(C)</enum><text display-inline="yes-display-inline">the long-term economic impacts of marine debris on the national economies of each country set out in paragraph (1) and on the global economy; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4D5F8090CED4AFABA7026F11CE38A91"><enum>(D)</enum><text display-inline="yes-display-inline">the economic benefits of decreasing the amount of marine debris in the oceans;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11EB454A9DF64351B2458B1D589DA553"><enum>(4)</enum><text display-inline="yes-display-inline">work with representatives of foreign countries that contribute the most to the global marine debris problem, including land-based sources, to conclude one or more new international agreements that include provisions—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H6166815E8E7147BFB43DF62AAC4EB958"><enum>(A)</enum><text display-inline="yes-display-inline">to mitigate the risk of land-based marine debris contributed by such countries reaching an ocean; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07E78ED646C34668B8856C8CCDE5A8B3"><enum>(B)</enum><text display-inline="yes-display-inline">to increase technical assistance and investment in waste management infrastructure, if the President determines appropriate; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H20B2735D0ECF4388909089B35030C111"><enum>(5)</enum><text>encourage the United States Trade Representative to consider the impact of marine debris in relevant future trade agreements.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H709FFFE2DB294B669CC3A528F2486D72" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Membership of the Interagency Marine Debris Coordinating Committee</header><text display-inline="no-display-inline">Section 5(b) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1954">33 U.S.C. 1954(b)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H96EF5DF05EF9425FA412C2B9A82ED09B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD32DB98DC8B449F4B847DECF5B7FC451"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph (7); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B29BBA081AF46F2924E2DD1B8E8A70D"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF8064AE025734D0C86F2C905628D2047" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="HDECEE7020B3049F38D1766A7F41AF18F"><enum>(5)</enum><text display-inline="yes-display-inline">the Department of State;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9A8B8DCC67F415080956A1397481DC0"><enum>(6)</enum><text display-inline="yes-display-inline">the Department of the Interior; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H26DEF7333F034BEEAD5D4A3ECCB336F1" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">Section 9 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1958">33 U.S.C. 1958</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H51B290A37F8D40C39F5316EF8C16FFFB" style="OLC"> <section commented="no" display-inline="no-display-inline" id="H64A77490DAEE4CA7956FC6F061DECA25" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated for each fiscal year 2018 through 2022—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H317F0D33488547DE9E9C00BD9267D35B"><enum>(1)</enum><text display-inline="yes-display-inline">to the Administrator for carrying out sections 3, 5, and 6, $10,000,000, of which no more than 10 percent may be for administrative costs; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7791B71F33C44445BBC621E0EB5C54D5"><enum>(2)</enum><text display-inline="yes-display-inline">to the Secretary of the Department in which the Coast Guard is operating, for the use of the Commandant of the Coast Guard in carrying out section 4, $2,000,000, of which no more than 10 percent may be used for administrative costs.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
