			 of top secret information to certain foreign countries, and for other
			 purposes.</official-title></form>
	<legis-body id="HE804EFA3656341879BA284D43626B4EE" style="OLC">
 <section id="H828A2D1023BB464E9034A4C9E50B5FCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevention and Oversight of Intelligence Sharing with Enemies Act</short-title></quote> or the <quote>POISE Act</quote>.</text> </section><section id="H6EFA1E3F23B240ABB58610DE03478F11"><enum>2.</enum><header>Congressional notification of disclosure of top secret information to certain foreign countries</header> <subsection id="HA09A0BEBDF2C4B26A6F6548B4246B1F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of section 501 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091(a)</external-xref>) is amended—</text>
 <paragraph id="HC6FBA3830D054E22A5172377B72D4744"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text> </paragraph><paragraph id="H568BBE13D2AC4FAFB74C7C84768F72F9"><enum>(2)</enum><text>by inserting after paragraph (1) the following new paragraph (2):</text>
					<quoted-block display-inline="no-display-inline" id="HEC18CFD3C3AD4D0B97D7F978415EFE74" style="USC">
						<paragraph id="H8B063206F426429F9CEF9A5CF584CAF3"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H8FA7A8B849454094AE58F187F502CB4F"><enum>(A)</enum><text display-inline="yes-display-inline">The President shall furnish to the congressional intelligence committees any information or material concerning any disclosure of top secret information, including such information relating to sensitive intelligence sources and methods, to any government official, agent, or representative of a foreign country, which at the time of such disclosure—</text>
 <clause id="H70C3248E651345808E08B8B0F161F6DF" indent="up1"><enum>(i)</enum><text>is a state sponsor of terrorism; or</text> </clause><clause id="H5E893EE81C3B4AB8A43AE4C0CC972DC0" indent="up1"><enum>(ii)</enum><text>is subject to economic sanctions.</text>
 </clause></subparagraph><subparagraph id="HC05AA3129F6E4A8E80681D8DD15BF35A" indent="up1"><enum>(B)</enum><text>Such information or material shall be furnished as soon as possible but in no event more than 48 hours after the disclosure is made.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H1CAF92C9F3EA47C48AFFAFD8D98A6666"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Subsection (f) of such section is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H28C7261B819541B0BC78E1A8192C8F15" style="OLC"> <subsection id="H9D0BD740E40445FB973E47D0F080DE48"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
 <paragraph id="H844DD082E1474122A84341EC6953EADA"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>intelligence activities</quote> includes covert actions as defined in section 503(e) of this title, and includes financial intelligence activities.</text>
 </paragraph><paragraph id="H4FBB241F6A4142D89080A861BC411F9A"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>top secret information</quote> has the meaning given such term in section 1.2(a)(1) of Executive Order No. 13526, as in effect on the date of the enactment of the POISE Act.</text>
 </paragraph><paragraph commented="no" id="H4150AF51951E43D9ADF6BD806AB615E0"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>economic sanctions</quote> means any sanctions program administered by the Office of Foreign Assets Control of the Department of the Treasury relating to sanctions imposed—</text>
 <subparagraph commented="no" id="H4147E38D14464B7DB8C3C73E3073A639"><enum>(A)</enum><text>pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) or any other provision of law; and</text>
 </subparagraph><subparagraph commented="no" id="HF137F28F1D8E48F9BB290E563641DB8F"><enum>(B)</enum><text display-inline="yes-display-inline">by reason of state-sponsored conduct or conduct by government officials.</text> </subparagraph></paragraph><paragraph id="H5F0DA3E9D03D4575AEF96087D882F9C1"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>state sponsor of terrorism</quote> means a country the government of which the Secretary of State has determined, for purposes of section 6(j) of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/4605">50 U.S.C. 4605(j)</external-xref>) (as continued in effect pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.)), section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>), section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>), or any other provision of law, is a government that has repeatedly provided support for acts of international terrorism.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
