 <section id="HEF9E692F6B8F4BABB4E2DEBC00E5241E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sunset the CRA and Restore American Protection Act of 2017 </short-title></quote> or the <quote><short-title>SCRAP Act</short-title></quote>.</text> </section><section id="H0F748ED2D0BE4308A79C5D3909D8873C"><enum>2.</enum><header>Repeal</header> <subsection id="H9CA77B4D01FF4E22AD8A8936E8D87656"><enum>(a)</enum><header>Repeal</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">Chapter 8</external-xref> of title 5, United States Code, is repealed.</text>
 </subsection><subsection id="H9B8508A3188C41058C4D74B546DD3257"><enum>(b)</enum><header>Table of chapters</header><text>The table of chapters for part I of title 5, United States Code, is amended by striking the item relating to chapter 8.</text>
			</subsection><subsection id="HE602B20E50464B879431A413A3A6515C"><enum>(c)</enum><header>Technical and conforming amendments</header>
 <paragraph id="HA3ED119210BE4B26BEE94F5646ABB8FF"><enum>(1)</enum><header>Family Smoking Prevention and Tobacco Control Act</header><text>Section 102(a) of the Family Smoking Prevention and Tobacco Control Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387a-1">21 U.S.C. 387a–1(a)</external-xref>) is amended by striking paragraph (7).</text>
 </paragraph><paragraph id="HD1FE03AE7B404C509F00C4C5A0F558C3"><enum>(2)</enum><header>American Jobs Creation Act of 2004</header><text>Section 642 of the American Jobs Creation Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/7/519a">7 U.S.C. 519a</external-xref>) is amended by striking subsection (c).</text>
 </paragraph><paragraph id="HD997DCC46F8247AFB6C274016A9154FB"><enum>(3)</enum><header>Farm Security and Rural Investment Act of 2002</header><text>Section 1601(c) of the Farm Security and Rural Investment Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7991">7 U.S.C. 7991(c)</external-xref>) is amended by striking paragraph (3).</text>
 </paragraph><paragraph id="HDF63BAA0A7F842B8AA8DF27AEA2DD0C4"><enum>(4)</enum><header>Food, Conservation, and Energy Act of 2008</header><text>Section 1601(c) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8781">7 U.S.C. 8781(c)</external-xref>) is amended—</text> <subparagraph id="H6157FF43E2824154A3AEA4D2AA60C6AA"><enum>(A)</enum><text>by striking paragraph (3); and</text>
 </subparagraph><subparagraph id="H0E2D694CC8A847ACAED78549D835CDEB"><enum>(B)</enum><text>by redesignating paragraph (4) as paragraph (3).</text> </subparagraph></paragraph><paragraph id="H182B4BC7890F4298A656DED003255E95"><enum>(5)</enum><header>Agricultural Act of 2014</header><text>Section 1601(c) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9091">7 U.S.C. 9091(c)</external-xref>) is amended by striking paragraph (3).</text>
 </paragraph><paragraph id="HA2C7CFB1450742BBBEE39F0E0AA33AD3"><enum>(6)</enum><header>Food Security Act of 1985</header><text>Section 1246 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3846">16 U.S.C. 3846</external-xref>) is amended by striking subsection (c).</text>
 </paragraph><paragraph id="HDB7389C115CE4D668E6E107E1B26349A"><enum>(7)</enum><header>Federal Nonnuclear Energy Research and Development Act of 1974</header><text>Section 12 of the Federal Nonnuclear Energy Research and Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5911">42 U.S.C. 5911</external-xref>) is amended—</text>
 <subparagraph id="H1D8271656F22439DB558E440F01B7D18"><enum>(A)</enum><text>by striking <quote>(a) The President</quote> and inserting <quote>The President</quote>; and</text> </subparagraph><subparagraph id="H0ED7E2D00DC04DF48509B543FFE52EE6"><enum>(B)</enum><text>by striking subsection (b).</text>
 </subparagraph></paragraph><paragraph id="H31C102FDADC045D0A79A11F5D8D8BEBB"><enum>(8)</enum><header>Elementary and Secondary Education Act of 1965</header><text>Section 1601(e) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6571">20 U.S.C. 6571(e)</external-xref>) is amended by striking <quote>or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code (commonly known as the <quote>Congressional Review Act</quote>)</quote>.</text>
 </paragraph><paragraph id="H2343D16F39FB4ACE82963A88105BA42E"><enum>(9)</enum><header>Public Health Service Act</header><text>Section 401(f)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281(f)(4)</external-xref>) is amended by striking the second sentence.</text>
 </paragraph><paragraph id="H6BEA4FB614EC42A58809F1333C8AE0FE"><enum>(10)</enum><header>Credit Union Membership Access Act</header><text>Section 205 of the Credit Union Membership Access Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1759">12 U.S.C. 1759</external-xref> note) is repealed.</text> </paragraph><paragraph id="H3F4B346F16894B9B808F8CBEA9A6F186"><enum>(11)</enum><header>Medicare Prescription Drug, Improvement, and Modernization Act of 2003</header><text>Section 303(i) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u</external-xref> note) is amended—</text>
 <subparagraph id="H45E1681CED0D42D483C1091A2306BA0E"><enum>(A)</enum><text>by striking paragraph (5); and</text> </subparagraph><subparagraph id="HC025D39A5AA5409A82EA254EA56FB0D4"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (5).</text>
 </subparagraph></paragraph><paragraph id="HF3CD82E4FC5A4E3EBA0E83B4B8A72DF2"><enum>(12)</enum><header>Tax and Trade Relief Extension Act of 1998</header><text>Section 5101(i)(1) of the Tax and Trade Relief Extension Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref> note) is amended by striking <quote>(without regard to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code)</quote>.</text>
				</paragraph></subsection></section><section id="H000EF83EF8094A2994611C801453FDBB"><enum>3.</enum><header>Reinstatement of disapproved rules</header>
 <subsection id="H7E4C734BB9464A1B8CE6F3BDECF35548"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H39CC8825099B448A98B308A683C5B204"><enum>(1)</enum><text>the term <term>covered rule</term> means a rule for which a joint resolution of disapproval was enacted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code, before the date of enactment of this Act; and</text>
 </paragraph><paragraph id="HD54CDE33010B4C8291F06F6BF1FE37AA"><enum>(2)</enum><text>the term <term>Federal agency</term> has the meaning given the term <quote>agency</quote> in section 551(1) of title 5, United States Code.</text> </paragraph></subsection><subsection id="HEBF6C83CF6A742F396233DBB6E02E601"><enum>(b)</enum><header>Fast-Track reinstatement</header><text>A Federal agency may reinstate a covered rule by publishing the covered rule in the Federal Register during the 1-year period beginning on the date of enactment of this Act.</text>
 </subsection><subsection id="H87B3BA94C1E149CCB4300C41D88C8218"><enum>(c)</enum><header>Reinstatement after one-Year period</header><text>After the end of the 1-year period beginning on the date of enactment of this Act, a Federal agency may reinstate a covered rule using the rule making procedures described in section 553 of title 5, United States Code.</text>
